In this passage, Kant declares that there are only two kinds of claim about what is practically necessary, or what we ought to do. Imperatives are hypothetical if they claim that we ought to do something as a means of achieving one of our ends. Imperatives are categorical if they claim that we ought to do something not as a means of achieving any end, but, as we can say, for its own sake only. These are not, as Kant declares, the only two kinds of imperative. Kant’s remarks involve, not one, but two distinctions, which combine to give us four possibilities. Kant maintains that retribution is the only morally sound justification for criminal punishment. He claims that all just criminal punishment must conform to the “principle of equality,” an inflexible juridical rule which takes the form of a categorical imperative. Focusing on his further claim that the principle of equality establishes that capital punishment is the only suitable punishment for murder, I question Kant’s contention that the principle of equality is a categorical imperative. Following two lines of inquiry drawing upon the nature of a categorical imperative, I suggest that the principle of equality is a principle conditioned by experience, a hypothetical imperative which Kant only shows to be consistent with, not necessarily mandated by, the idea of a just civil state.

Here are two widespread responses to Kant's categorical imperative. On one hand, one might note the absence of detailed rational derivation. On the other hand, even someone who maintains some skepticism is likely to have a sense that (nevertheless) there is something to Kant's central ideas. The recommended solution is analysis of elements of the categorical imperative. Their appeal turns out to have different sources. One aspect of the first formulation rests on the logic of normative utterances. But others can be justified only in terms of their contributions to desirable functionings of a moral order.
In this article, I examine anew the moral philosophy of Immanuel Kant and its contributions to educational theory. I make four claims. First, that Kant should be read as having the Categorical Imperative develop out of subjective maxims. Second, that moral self-perfection is the aim of moral education. Third, that moral self-perfection develops by children habituating the results of their moral maxims in scenarios and cases. Fourth, that character and culture, Kant’s highest aims for humanity, are the ultimate beneficiaries of this process.

This paper demonstrates something that Kant notoriously claimed to be possible, but which Kant scholars today widely believe to be impossible: unification of all three formulations of the Categorical Imperative. Part 1 of this paper tells a broad-brush story of how I understand Kant’s theory of practical reason and morality, showing how the three formulations of the Categorical Imperative appear to me to be unified. Part 2 then provides clear textual support for each premise in the argument for my interpretation.
Abstract: This article addresses a foundational issue in Kant's moral philosophy, the question of the relation of the Categorical Imperative to value. There is an important movement in current Kant scholarship that argues that there is a value underlying the Categorical Imperative. However, some scholars have raised doubts as to whether Kant has a conception of value that could ground the Categorical Imperative. In this paper I seek to add to these doubts by arguing, first, that value would have to be of a particular kind in order to be the foundation of Kant's moral philosophy. Second, I argue that Kant does not have such a conception of value, and that his arguments rule out that value could ground his moral philosophy. I then outline an alternative reading of how Kant uses ‘inner value’. My conclusion will be that Kant does not derive the Categorical Imperative from an underlying value. While some of his passages could also be read as if value were foundational for Kant, a close look at these passages and his arguments point away from this conclusion.
At the core of Kant's ethics lies the claim that if there is a supreme principle of morality then it cannot be a principle based on utilitarianism or Aristotelian perfectionism or the Ten Commandments. The only viable candidate for such a principle is the categorical imperative. This book is the most detailed investigation of this claim. It constructs a new, criterial reading of Kant's derivation of one version of the categorical imperative: the Formula of Universal Law. This reading shows this derivation to be far more compelling than contemporary philosophers tend to believe. It also reveals a novel approach to deriving another version of the categorical imperative, the Formula of Humanity, a principle widely considered to be the most attractive Kantian candidate for the supreme principle of morality. This book will be important not just for Kant scholars but for a broad swathe of students of philosophy.
