Private enforcement of eu and national competition law

Abstract

Domestic ordinary courts within the EU Member States are empowered to hear cases concerning damages actions arisen from the infringement of articles 81 and 82 ECT. This article analyzes the evolution of the rules governing this topic and emphasizes civil actions in Competition law, judicial powers, procedural rules and the impact of the EU law and institutions, as well as their cooperation with the national ones.
