I take it that liberal justice recognises special protections against the restriction of speech and expression; this is what I call the Free Speech Principle. I ask if this Principle includes speech acts which might broadly be termed ‘hate speech’, where ‘includes’ is sensitive to the distinction between coverage and protection , and between speech that is regulable and speech that should be regulated . I suggest that ‘hate speech’ is too broad a designation to be usefully analysed as a single category, since it includes many different kinds of speech acts, each of which involves very different kinds of free speech interests, and may cause very different kinds of harm. I therefore propose to disaggregate hate speech into various categories which are analysed in turn. I distinguish four main categories of hate speech, namely (1) targeted vilification, (2) diffuse vilification, (3) organised political advocacy for exclusionary and/or eliminationist policies, and (4) other assertions of fact or value which constitute an adverse judgment on an identifiable racial or religious group. Reviewing these categories in the light of the justifications for the Free Speech Principle, I will argue that category (1) is uncovered by the Principle, categories (2) and (3) are covered but unprotected , and that category (4) is protected speech.

The theory of speech acts is partly taxonomic and partly explanatory. It must systematically classify types of speech acts and the ways in which they can succeed or fail. It must reckon with the fact that the relationship between the words being used and the force of their utterance is often oblique. For example, the sentence 'This is a pig sty' might be used nonliterally to state that a certain room is messy and filthy and, further, to demand indirectly that it be straightened out and cleaned up. Even when this sentence is used literally and directly, say to describe a certain area of a barnyard, the content of its utterance is not fully determined by its linguistic meaning--in particular, the meaning of the word 'this' does not determine which area is being referred to. A major task for the theory of speech acts is to account for how speakers can succeed in what they do despite the various ways in which linguistic meaning underdetermines use.
To assert something is to perform a certain kind of act. This act is different in kind both from other speech acts, like questions, requests, commands, promises, and apologies, and from acts that are not speech acts, like toast buttering and inarticulate yodeling. My question, then is this: what features of an act qualify it as an assertion, and not one of these other kinds of act? To focus on a particular example: in uttering “Bill will close the window,” one might be practicing English pronunciation, asserting that Bill will close the window, or requesting that Bill close the window. What makes it the case that one is doing one of these and not another?
The idea of a theory of speech acts, when taken in its strict sense,1 has been employed of late to indicate a bundle of theories growing out of J. L. Austin’s How to Do Things with Words of 1962. John Searle’s book Speech Acts, published in 1969, is undoubtedly the most conspicuous contribution to this theory to date. With the lapse of time, however, our distance to these fundamental works has become great enough to allow some reflection on the criteria which must be met by a ‘theory of speech acts’ properly so called, so that it has become possible also to consider in this light candidate..
In this paper I try to use the conceptual framework of the speech act theory to clarify a few points regarding the philosophical debate about the existence of negative acts. For this, I start by looking at some of the most popular candidates to this title: failing, omitting, avoiding and refraining. In the second part of my paper I consider some examples of verbal actions and try to investigate how would the property of 'being negative' apply to them, concluding that we could only say about the locutionary contentent of a speech act that it is negative. Since the illocutionary force, which gives the kind of the verbal act performed, cannot be properly called 'negative', there cannot be any 'negative speech acts'. Next, I try to show how this can be applied to such cases. At the end of the paper I propose that an analysis of the situations in which our actions seem to oppose each other should replace the misleading problem of negative acts.

1 The aim of this paper is to capture the similarities and differences between assertions and polar questions so as to be able to account for the systematic partial overlap that exists in reactions to these speech acts in English and beyond. We first discuss the discourse components we assume, and then define default assertions and default polar questions in a way that allows us to characterize two types of responses to these speech acts, confirming and reversing reactions. The common characteristics of assertions and polar questions are responsible for the fact that both allow these reactions; the differences between the two speech acts explain the different contextual effects confirming and reversing moves have depending on whether they react to an assertion or a polar question. We then examine the distribution of a set of ‘polarity’ particles in Romanian in terms of the notions defined in the rest of the paper, and end with a series of predictions concerning polarity particles across languages.
At the center of the hate speech controversy is the question whether it constitutes conduct. If hate speech is not conduct, then restricting it runs counter to free speech. But even if it could be shown that it is a kind of conduct, complicated questions arise. Does it necessarily follow that we restrict speech? Practically speaking, can speech even be restricted, either through new legislation or the enforcement of existing laws regulating conduct? Are measures such as hate crimes legislation both useful and appropriate in protecting individuals and groups from violence? The present paper aims to address these questions by reconstructing and assessing Judith Butler’s important treatment of speech-acts and hate speech in her book Excitable Speech: The Politics of the Performative.

In this paper, we address several puzzles concerning speech acts,particularly indirect speech acts. We show how a formal semantictheory of discourse interpretation can be used to define speech actsand to avoid murky issues concerning the metaphysics of action. Weprovide a formally precise definition of indirect speech acts, includingthe subclass of so-called conventionalized indirect speech acts. Thisanalysis draws heavily on parallels between phenomena at the speechact level and the lexical level. First, we argue that, just as co-predicationshows that some words can behave linguistically as if they're `simultaneously'of incompatible semantic types, certain speech acts behave this way too.Secondly, as Horn and Bayer (1984) and others have suggested, both thelexicon and speech acts are subject to a principle of blocking or ``preemptionby synonymy'': Conventionalized indirect speech acts can block their`paraphrases' from being interpreted as indirect speech acts, even ifthis interpretation is calculable from Gricean-style principles. Weprovide a formal model of this blocking, and compare it withexisting accounts of lexical blocking.
Speech acts have sometimes been considered as unembeddable, for principled reasons. In this paper, I argue that speech acts can be embedded under certain circumstances. In particular, I consider denegation and conjunction of speech acts, quantification into speech acts, conditionalization of speech acts, the embedding of speech acts by verbs like say and wonder, speechact-modifying adverbials like frankly, clauses commenting on speech acts, like certain uses of because-clauses, parentheticals, and appositive relative clauses. A crucial distinction is made between speech acts and speech act potentials, linguistic objects that can be used to perform speech acts when applied in a specific communicative situation. I develop a semantic theory in which speech act potentials are captured as semantic functions that change a world-time index, reflecting the nature of speech acts as events that happen in the world. As index changers, speech act potentials become nearly regular semantic objects, with a proper semantic type on which other semantic objects can operate on. In this way, speech acts (or rather, speech-act potentials) become part of the recursive structure of language.
