This paper argues that certain expressions of practical necessity – like ‘I have to do this, I do not have a choice’ or ‘Here I stand, I can do no other’ – allow an insight into deep structures of personality and self-understanding. They point at a limit where someone would have to ‘become another person’ (in his own view), if he was forced to an alternative decision, because of neglecting ground-projects and convictions, which are essential for his self-conception. This (...) limit is marked by a loss of autonomy and authenticity. The paper discusses why and in how far expressions of personal necessities seem to have a special value and authority as they call forth the respect of the other towards an individual personality, even though this does not exclude that there may also be a necessity of self-reform. A transcript of three lectures, given at Princeton University in 1970, which deals with (inter alia) debates concerning proper names in the philosophy of language.

Consider the following three claims. (i) There are no truths of the form ‘p and ~p’. (ii) No one holds a belief of the form ‘p and ~p’. (iii) No one holds any pairs of beliefs of the form {p, ~p}. Irad Kimhi has recently argued, in effect, that each of these claims holds and holds with metaphysical necessity. Furthermore, he maintains that they are ultimately not distinct claims at all, but the same claim formulated in different ways. I (...) find his argument suggestive, if not entirely transparent. I do think there is at least an important kernel of truth even in (iii), and that (i) ultimately explains what’s right about the other two. Consciousness of an impossibility makes belief in the obtaining of the corresponding state of affairs an impossibility. Interestingly, an appreciation of this fact brings into view a novel conception of inference, according to which it consists in the consciousness of necessity. This essay outlines and defends this position. A central element of the defense is that it reveals how reasoners satisfy what Paul Boghossian calls the Taking Condition and do so without engendering regress. (shrink)

In this paper, I argue that taking basic human rights seriously—and the basic right to subsistence in particular—requires acknowledging that, given certain conditions, people in need have a right of necessity to take, use and/or occupy the property of others in order to get out of their plight. I explore the implications of this for the phenomenon of illegalized migration for subsistence reasons, and suggest that receiving countries ought not to deny entry to these migrants. On the contrary, those (...) seeking to enter should be morally permitted to do it. The reason is that, just as basic rights should serve as internal limits to any minimally reasonable system of property rights, so should they serve as limits to any minimally reasonable system of territorial rights. After developing this idea, I address some objections to the principle and its application, and conclude by pointing to the immediate, mediate and final duties that this principle gives rise to. I discuss a short string of five sentences in Metaphysics V.5, 1015b6-9 relating demonstration to necessity. My proposal is that Aristotle focuses his attention on the demonstration as a demonstration. Other interpretations reduce the necessity in question to the modality of the component sentences of the demonstrations (the conclusion and the premises). My view does not deny that the modality of the component sentences is important, but takes seriously the idea that a demonstration itself should be understood as (...) necessary—as not capable of being otherwise. A demonstration cannot be different from what it is in the sense that [i] its components cannot be different from what they are, [ii] its components must be related to each other exactly in the way they are related. Demonstrations aim at the fully appropriate explanation of a given explanandum—and each demonstration is individuated by the explanandum it takes. Thus, the basic idea is that, for the target explanandum that individuates a given demonstration, the premises delivering the fully appropriate explanation cannot be replaces with different ones. I show how this proposal, which explains Aristotle’s language in 1015b6-9 accurately, does not make demonstrations ‘melt down into conditional necessity’, first, because the modality of the component sentences is still importantly involved, second, because the explanatory relation expressed in a demonstration is a necessary fact in the real world, so that the demonstration itself is also necessary (in the way I have explained) inasmuch as it captures that fact. That is, could there be a property P that is instanti-ated at worlds w1 and w2, and is perfectly natural at w1 but not at w2? Here, we offer an original argument for the non-world-relativity of perfect naturalness. Brian Leftow offers a theist theory of necessity and possibility, and a new sort of argument for God's existence. He argues that necessities of logic and mathematics are determined by God's nature, but that it is events in God's mind - his imagination and choice - that account for necessary truths about concrete creatures.

The necessity constraint is at the heart of the ethics of both self-defense and war, and yet we know little about it. This article seeks to remedy that defect. It proceeds in two stages: first, an analysis of the concept of necessity in self-defense; second, an application of this analysis to war, looking at both its implications for just war theory and its application in the laws of war.

This is a study of the philosophy and theology of the Scientific Revolution and its impact on European natural law and political liberalism. It analyses transformations of the concept of sacred nature and the human light of reason leading to the Anthropocene, and fluctuations between human necessities and scientific money.

The paper argues against a commitment to metaphysical necessity, semantic modalities are enough. The best approaches to elucidate the semantic modalities are (still) versions of lingustic ersatzism and fictionalism, even if only developed in parts. Within these necessary properties and the difference between natural and semantic laws can be accounted for. The proper background theory for this is an updated version of Logical Empiricism, which is congenial to recent trends in Structural Realism. The anti-metaphysical attitude of Logical Empiricism deserves (...) revitalization. The role of witness is a recurring theme in the work of Stanley Hauerwas: it is through enacting the truth in a world of lies, through seeking peace in a world of violence, that witnesses show who God is, who we are, and what the world is like. The Necessity of Witness is a study of Hauerwas and his fascinating but complex understanding of witness. Ariaan W. Baan argues that Hauerwas's approach makes a significant contribution to current debates in (...) systematic theology on the relation between truth and life. Reading Hauerwas can be a precarious adventure. His rhetoric is overwhelming, but his argument is not always crystal clear and carefully formulated. With the help of semiotic and philosophical analysis and biblical exegesis, Baan articulates Hauerwas's intuitions, fills some of the gaps in his argumentation, and discloses hidden biases. The results of this analysis sometimes surprise. Baan notes that unexpected pericopes in Scripture such as Isaiah and Revelation support Hauerwas's account of witness, and concludes that his work offers insight into how in our late modern society such diverse groups as martyrs and pop stars offer implicit witness through their lives. Through both an historical and philosophical analysis of the concept of possibility, we show how including both potentiality and actuality as part of the real is both compatible with experience and contributes to solving key problems of fundamental process and emergence. The book is organized into four main sections that incorporate our routes to potentiality: (1) potentiality in modern science [history and philosophy; quantum physics and complexity]; (2) Relational Realism [ontological interpretation of quantum physics; philosophy and logic]; (3) Process Physics (...) [ontological interpretation of relativity theory; physics and philosophy]; (4) on speculative philosophy and physics [limitations and approximations; process philosophy]. We conclude that certain fundamental problems in modern physics require complementary analyses of certain philosophical and metaphysical issues, and that such scholarship reveals intrinsic features and limits of determinism, potentiality and emergence that enable, among others, important progress on the quantum theory of measurement problem and new understandings of emergence. Alan Sidelle's Necessity, Essence, and Individuation is a sustained defense of empiricism—or, more generally, conventionalism—against recent attacks by realists. Sidelle focuses his attention on necessity a posteriori, a kind of necessity which contemporary realists have taken to support realism over empiricism. Turning the tables against the realists, Sidelle argues that if there are in fact truths necessary a posteriori, it is not realism, but rather empiricism which provides the best explanation for them.

General consensus has it that contingencies lack the requisite modal umph to serve as explanations for the modal status of necessities. The central aim of this paper is to show that this received opinion is incorrect: contingent necessity-makers are in fact possible. To do so, I identify certain conditions the satisfaction of which entail the possibility of contingent necessity-makers. I then argue for two broad instances where these conditions are satisfied. This paper examines the concept of medical necessity as it relates to mental health care rationing, arguing that the normal functioning model of medical necessity is insufficient because it fails to cohere with an important aim and function of mental health care, which is to provide support for individuals in abusive or otherwise difficult personal relationships.

The aim of this chapter is to explore to some extent the relationship between identity and necessity in logic and metaphysics. First, I provide a historically-based summary of proofs of the necessity of identity, highlighting the importance of the role that self-identity plays. Second, I introduce two examples of metaphysical topics where the necessity of identity has played a pivotal role: the necessary a posteriori, and the coincidence of material objects. I argue that important aspects of these (...) debates rest on how we represent identity. Third, I consider some recent work on generalized identity. Gerald Izenberg contends that our most important identities, while historically conditioned, are rooted in permanent categories of human existence, such as sexuality, sociality, and labor.

This paper discusses some serious difficulties for what we shall call the standard account of various kinds of relative necessity, according to which any given kind of relative necessity may be defined by a strict conditional - necessarily, if C then p - where C is a suitable constant proposition, such as a conjunction of physical laws. We argue, with the help of Humberstone, that the standard account has several unpalatable consequences. Emile Benvcniste may be used to introduce the topic. The French linguist begins an essay on “Euphemisms Ancient and Modern” with a paradox about the early Greek definitions of euphemism. “To speak words which augur well” is one meaning given, but another is “to maintain silence”. This initial contradiction is further compounded by yet a third expression, “to shout in triumph”. The dilemma is. however, easily dissolved. To speak words which augur well implies, for special occasions, an exhortation even to (...) shout triumphantly, “to assent by an, auspicious outcry”: it further implies, again depending on the circumstances, “to avoid words which augur ill”, hence, if necessary, to say nothing. As one definition explains “avoid all unlucky words during sacred rites: hence, as the surest mode of avoiding them, keep a religious silence” (original emphasis). Paradox terminates; we are merely dealing with “a euphemism for a euphemism” taking an expression of Benveniste out of context. (shrink)

It is generally agreed that using lethal or otherwise serious force in self-defense is justified only when three conditions are satisfied: first, there are some grounds for the defender to give priority to his own interests over those of the attacker (whether because the attacker has lost the protection of his right to life, for example, or because of the defender’s prerogative to prefer himself to others); second, the harm used is proportionate to the threat thereby averted; third, the harm (...) is necessary to avert that threat. The first and second conditions have been exhaustively discussed, but the third has been oddly neglected. Meanwhile a prominent school of thought has arisen, in the ethics of war, which seeks to ground the justification of killing in war in principles of individual self-defense. They too have failed to offer any substantive analysis of necessity, while at the same time appealing to it when it suits them to do so. In this paper, I attempt a detailed analysis of the necessity constraint on defensive force, and explore the implications of that analysis for the attempt to transpose principles of individual self-defense into the context of warfare. The traditional view that all logical truths are metaphysically necessary has come under attack in recent years. The contrary claim is prominent in David Kaplan’s work on demonstratives, and Edward Zalta has argued that logical truths that are not necessary appear in modal languages supplemented only with some device for making reference to the actual world (and thus independently of whether demonstratives like ‘I’, ‘here’, and ‘now’ are present). If this latter claim can be sustained, it strikes close to the (...) heart of the traditional view. I begin this paper by discussing and refuting Zalta’s argument in the context of a language for propositional modal logic with an actuality connective (section 1). This involves showing that his argument in favor of real world validity his preferred explication of logical truth, is fallacious. Next (section 2) I argue for an alternative explication of logical truth called general validity. Since the rule of necessitation preserves general validity, the argument of section 2 provides a reason for affirming the traditional view. Finally (section 3) I show that the intuitive idea behind the discredited notion of real world validity finds legitimate expression in an object language connective for deep necessity. (shrink)

Medical necessity (claiming that a medical intervention or care is – at minimum – reasonable, appropriate and acceptable) depends on empirical evidence and on the interpretation of that evidence. Evidence and its interpretation define the standard of care. This commentary argues that both the evidence base and its interpretation are currently weak gatekeepers. Empirical meta-research suggests that very few medical interventions have high quality evidence in support of their effectiveness and very few of them also have relatively thorough assessments (...) of their potential harms. Therefore, evidence on the risk-benefit ratios carries almost always very large uncertainty. Arbitration about medical necessity is thus left to the interpretation process. Professional guidelines are notoriously unreliable and biased in this regard. Regulatory approval ends up being the key arbitrator, but over the years the regulatory process has been subverted. Regulatory approval currently does not mean that an intervention has a favourable risk-benefit ratio, but simply that it can be marketed, sold and made profit from. The process leads to a tragedy of commons where the final victim is society at large: medical necessity is invoked as an alibi for medicine to absorb societal resources. (shrink)

The Master Argument, recorded by Epictetus, indicates that Diodorus had deduced a contradiction from the conjoint assertion of three propositions. The Argument, which has to do with necessity and contingency and therefore with freedom, has attracted the attention of logicians above all. There have been many attempts at reconstructing it in logical terms, without excessive worry about historical plausibility and with the foregone conclusion that it was sophistic since it directly imperilled our common sense notion of freedom. This text (...) takes exception to recent tradition, translating the propositions into logical terms. The propositions figuring in The Master Argument are interpreted in terms of temporal modal logic where both the modalities and the statements they govern have chronological indices. This means that the force of the argument comes not from purely logical or modal considerations, but from our experience of time. (shrink)

What is it for something to be essential to an item? For some time, it was standard to think that the concept of necessity alone can provide an answer: for something to be essential to an item is for it to be strictly implied by the existence of that item. We now tend to think that this view fails because its analysans is insufficient for its analysandum. In response, some argue that we can supplement the analysis in terms of (...) necessity with a further condition. In this paper I argue that this view is untenable in its current form. I then provide a glimmer of hope to those who think that essence is at least partially analyzable in terms of necessity. (shrink)

I explore the role of practical necessity in Kant’s essay Idea for a Universal History with a Cosmopolitan Aim. This form of necessity arises on the basis of social and interstate antagonism and Kant appeals to it with the aim of avoiding the introduction of a standpoint that is external to the agents whose attitudes and actions are being described. In connection with the role that Kant accords to practical necessity in the establishment of the legal and (...) political conditions required to fulfil the ‘plan of nature’ in the course of history, I argue that in this essay he fails to identify a mechanism that would explain a fundamental moral change in that which motivates human beings once these conditions have been established. This in turn invites questions concerning the kind of universal history that Kant proposes. In particular, I argue that the choice of historical material that it demands could, in certain circumstances, be regarded as counterpurposive in relation to the aim of nature of which Kant speaks in the same essay. The authors of this volume, originally published in 1985, developed a new approach to the problem, which focusses on the logical grammar of necessary propositions. This volume gathers their seminal essays on the problem of necessity, together with new material at the original time publication.

Many people hold that there is a distinctive notion of metaphysical necessity. In this paper I explain why I am skeptical about the view. I examine the sorts of considerations that are adduced for it, and argue that they meet equal and opposite considerations.

Grounding necessitarianism (GN) is the view that full grounds necessitate what they ground. Although GN has been rather popular among philosophers, it faces important counterexamples: For instance, A=[Socrates died] fully grounds C=[Xanthippe became a widow]. However, A fails to necessitate C: A could have obtained together with B=[Socrates and Xanthippe were never married], without C obtaining. In many cases, the debate essentially reduces to whether A indeed fully grounds C – as the contingentist claims – or if instead C is (...) fully grounded in A+, namely A plus some supplementary fact S (e.g. [Xanthippe was married to Socrates]) – as the necessitarian claims. Both sides typically agree that A+ necessitates C, while A does not; they disagree on whether A or A+ fully grounds C. This paper offers a novel defence of the claim that, in these typical cases, unlike A+, A fails to fully ground C – thereby bringing further support to GN. First and foremost, unlike A+, A fails to fully ground C because it fails to contain just what is relevant to do so, in two distinct senses – explanatory and generative relevance. Second, going for A, rather than A+, as a full ground undermines not just grounding necessitarianism, but modally weaker views which even contingentists may want to preserve. (shrink)

This thesis examines necessary truth and defends a normative, or linguistic, account of it. Roughly, it holds that necessary truths state or follow from conceptual norms (i.e., norms that determine patterns of correct concept use). While the thesis touches upon logical and mathematical truth, its primary focus are those necessary truths typically expressed using natural language. The thesis has three parts. In Part I, I criticise metaphysical accounts of necessity and present and defend a normative account of it. At (...) no point do I give a history of normative accounts, but clearly their roots are to be found in the first half of the twentieth century – in the works of Wittgenstein and Carnap, for example. In Part II, I consider whether language can sustain the normative account. Some argue that the account requires language to be regimented in a way that it is not. I show that while it requires a distinction in kind between empirical and conceptual principles, it nevertheless makes room for indeterminacy regarding whether a given statement is an empirical claim or follows from conceptual norms. Finally, in Part III, I consider the relationship between the world and our conceptual scheme. I argue that denying our concepts answer to the world does not mean that they cannot be justified. The normative account does not say that we have no reasons for categorising things in a certain way, but rather that natural facts, in combination with our interests, are fit to provide them. The purpose of the thesis is to show that normative accounts of necessity can be much more robust than they are often given credit for and needn’t have the malign implications often associated with them. Philosophers traditionally interpret Kant as a retributivist, but modern interpreters, with reference to Kant’s theory of justice and problematic passages, instead propose penal theories that mix retributive and deterrent features. Although these mixed penal theories are substantively compelling and capture the Kantian spirit, their dual aspects lead to a justificatory conflict that generates an apparent dilemma. To resolve this dilemma and clear the ground for these mixed theories, I will outline and reinterpret Kant’s penal theory by situating it in his (...) broader moral and political philosophy. This move grounds the followability requirement, which is necessary to resolve the dilemma. (shrink)

In this discussion note I reply to some criticisms that Marc Lange (2022) has directed at my Humean view of scientific laws (Bhogal, 2020) -- about whether Humean views can make sense of the apparent fact that laws are counterfactually invariant. The key idea of my response is that the Humean should think of their reduction of the laws to the Humean mosaic as closely related to other views where we reduce one domain to another but still allow that the (...) higher-level domain can be `autonomous' of the lower-level in some respects -- like, for example, the view that the special sciences reduce to physics but can still can work autonomously of physics. It is common to think of essence along modal lines: the essential truths, on this approach, are a subset of the necessary truths. But Aristotle conceives of the necessary truths as being distinct and derivative from the essential truths. Such a non-modal conception of essence also constitutes a central component of the neo-Aristotelian approach to metaphysics defended over the last several decades by Kit Fine. Both Aristotle and Fine rely on a distinction between what belongs to the essence proper of (...) an object and what merely follows from the essence proper of an object. In order for this type of approach to essence and modality to be successful, we must be able to identify an appropriate consequence relation which in fact generates the result that the necessary truths about objects follow from the essential truths. I discuss some proposals put forward by Fine and then turn to Aristotle’s account: Aristotle’s central idea, to trace the explanatory power of definitions to the causal power of essences has the potential to open the door to a philosophically satisfying response to the question of why certain things are relevant, while others are irrelevant, to the nature or essence of entities. If at all possible, it would be desirable for example to have something further to say by way of explanation to such questions as ‘Why is the number 2 completely irrelevant to the nature of camels?’. 이 글의 목적은 생태민주주의의 실현 방안의 하나로 ‘생태법인(Eco Legal Person)’ 제도의 필요성을 제기하는 데 있다. 아직은 생태학이나 법학에서 생태법인이라는 용어가 사용된 적은 없다. 필자는 생태법인이라는 용어를 “미래 세대는 물론 인간 이외의 존재들 가운데 생태적 가치가 중요한 대상에 대하여 법적 권리를 갖게 하는 제도”로 사용하고자 한다. 생태민주주의는 인간과 자연의 공존이라는 생태철학의 핵심 가치에 민주주의 체제의 우월성을 융합한 대안 정치이념이다. 생태민주주의 이념의 핵심은 공동체 의사결정과정에 미래 세대와 인간 이외 존재들의 생태적 이해관계가 고려되어야 한다는 주장을 담고 있다. 그런데 미래 세대나 인간 이외의 존재는 (...) 현세대와 의사소통이 어렵고 법적 권리도 없다. 따라서 생태민주주의를 실현하기 위한 구체적 방안 모색이 요구된다. 인류는 오래전부터 인간 이외의 존재에게 법적 권리를 인정하는 ‘법인’ 제도를 창안하여 사용해 오고 있다. 이에 비춰본다면 생태민주주의 작동 방안의 하나로 ‘생태법인’ 또한 사회적 공감대 형성을 통해 도입될 수 있다고 본다. 그리고 ‘생태법인’의 법적․제도적 안정성을 담보되기 위해서는 ‘생태법인’의 헌법적 지위를 확보하기 위한 노력이 필요하다. 오늘날 대부분의 국가는 헌정주의를 근본원리로 민주주의가 작동되고 있기 때문이다. In the last 30 years much philosophical discussion has been generated by Kripke’s proof of the necessity of origin for material objects presented in footnote 56 of ‘Naming and Necessity’. I consider the two most popular reconstructions of Kripke’s argument: one appealing to the necessary sufficiency of origin, and the other employing a strong independence principle allegedly derived from the necessary local nature of prevention. I argue that, to achieve a general result, both reconstructions presuppose an implicit Humean (...) atomistic thesis of recombination, according to which any two (non-overlapping) possible objects can simultaneously coexist in one and the same world. Yet recombination ill accords with the other assumptions of the proofs. I also argue that the locality of prevention does not entail strong independence. (shrink)
