Questions connected with the admissibility of rules of inference and the solvability of the substitution problem for modal and intuitionistic logic are considered in an algebraic framework. The main result is the decidability of the universal theory of the free modal algebra imageω extended in signature by adding constants for free generators. As corollaries we obtain: there exists an algorithm for the recognition of admissibility of rules with parameters in the modal system Grz, the substitution problem for Grz (...) and for the intuitionistic calculus H is decidable, intuitionistic propositional calculus H is decidable with respect to admissibility . A semantical criterion for the admissibility of rules of inference in Grz is given. (shrink)

This paper concerns modal logics of provability — Gödel-Löb systemGL and Solovay logicS — the smallest and the greatest representation of arithmetical theories in propositional logic respectively. We prove that the decision problem for admissibility of rules (with or without parameters) inGL andS is decidable. Then we get a positive solution to Friedman''s problem forGL andS. We also show that A. V. Kuznetsov''s problem of the existence of finite basis for admissible rules forGL andS has a negative solution. We study quasi-characterizing inference rules (this notion was introduced into consideration by A. Citkin (1977). The main result of our paper is a complete description of all self-admissible quasi-characterizing inference rules. It is shown that a quasi-characterizing rule is self-admissible iff the frame of the algebra generating this rule is not rigid. We also prove that self-admissible rules are always admissible in canonical, in a sense, logics S4 or IPC regarding the type of algebra generating rules.

We give a necessary and sufficient condition for any modal logic with fmp to inherit all inference rules admissible in S4. Using this condition we describe all tabular modal logics inheriting inference rules admissible for S4.

While specifications and verifications of concurrent systems employ Linear Temporal Logic , it is increasingly likely that logical consequence in image will be used in the description of computations and parallel reasoning. Our paper considers logical consequence in the standard image with temporal operations image and image . The prime result is an algorithm recognizing consecutions admissible in image, so we prove that image is decidable w.r.t. admissible inference rules. As a consequence we obtain algorithms verifying the validity of consecutions (...) in image and solving the satisfiability problem. We start by a simple reduction of logical consecutions of image to equivalent ones in the reduced normal form . Then we apply a semantic technique based on image-Kripke structures with formula definable subsets. This yields necessary and sufficient conditions for a consecution to be not admissible in image. These conditions lead to an algorithm which recognizes consecutions admissible in image by verifying the validity of consecutions in special finite Kripke structures of size square polynomial in reduced normal forms of the consecutions. We investigate logical consequence in temporal logics in terms of logical consecutions. i.e., inference rules. First, we discuss the question: what does it mean for a logical consecution to be 'correct' in a propositional logic. We consider both valid and admissible consecutions in linear temporal logics and discuss the distinction between these two notions. The linear temporal logic LDTL, consisting of all formulas valid in the frame 〈L, ≤, ≥〉 of all integer numbers, is the prime object of our investigation. (...) We describe consecutions admissible LDTL in a semantic way—via consecutions valid in special temporal Kripke/Hintikka models. Then we state that any temporal inference rule has a reduced normal form which is given in terms of uniform formulas of temporal degree 1. Using these facts and enhanced semantic techniques we construct an algorithm, which recognizes consecutions admissible in LDTL. Also, we note that using the same technique it follows that the linear temporal logic L (N) of all natural numbers is also decidable w.r.t. inference rules. So, we prove that both logics LDTL and L (N) are decidable w.r.t. admissible consecutions. The paper studies the logic TL(NBox+-wC) – logic of discrete linear time with current time point clusters. Its language uses modalities Diamond+ (possible in future) and Diamond- (possible in past) and special temporal operations, – Box+w (weakly necessary in future) and Box-w (weakly necessary in past). We proceed by developing an algorithm recognizing theorems of TL(NBox+-wC), so we prove that TL(NBox+-wC) is decidable. The algorithm is based on reduction of formulas to inference rules and converting the rules in special reduced (...) normal form, and, then, on checking validity of such rules in models of singleexponential size in the rules. Also we consider the admissibility problem for TL(NBox+-wC) and show how to reduce the problem for admissibility to the decidability of TL(NBox+-wC) itself using definable universal modalities. We find an explicit basis for all admissible rules of the modal logic S4. Our basis consists of an infinite sequence of rules which have compact and simple, readable form and depend on increasing set of variables. This gives a basis for all quasi-identities valid in the free modal algebra ℱS4 of countable rank.

There is considerable interest in the use of neuroimaging techniques for forensic purposes. Memory detection techniques, including the well-publicized Brain Fingerprinting technique (Brain Fingerprinting Laboratories, Inc., Seattle WA), exploit the fact that the brain responds differently to sensory stimuli to which it has been exposed before. When a stimulus is specifically associated with a crime, the resulting brain activity should differentiate between someone who was present at the crime and someone who was not. This article reviews the scientific literature on (...) three such techniques: priming, old/new, and P300 effects. The forensic potential of these techniques is evaluated based on four criteria: specificity, automaticity, encoding flexibility, and longevity. This article concludes that none of the techniques are devoid of forensic potential, although much research is yet to be done. Ethical issues, including rights to privacy and against self-incrimination, are discussed. A discussion of legal issues concludes that current memory detection techniques do not yet meet United States standards of legal admissibility. (shrink)

Phenomenon of transdisciplinarity was put into the fore of analysis rather recently. In the article an attempt is made to find out whether it is possible to attribute this phenomenon not only to a science of the 21st century, or we have here the case where some scientific realities come to the attention of researchers with certain delay and has its value for the culture in general? It is possible to judge even the emergence of a kind of cognitive revolution (...) affecting both science culture. We need to find out what is meant by a transdisciplinarity, and how it differs from the inter- or multiransdisciplinarity. In the study the method of historical reconstruction, combining elements of presentism and antiqurism, was implemented. This method allows us to interpret historical events in the context of a specific level of knowledge, and at the same time to evaluate them in terms of modern ideas related to transdisciplinarity, inter- and multidisciplinarity. System-structural method, focused on an integrated analysis of the dynamics of development of cognitive processes in culture was implied as well, and the method of comparative analysis, which is aimed at comparing different but conceptually similar processes in various areas of conceptual art practice. It is in the framework of paradigm adopted a tacit agreement among scientists about the validity and effectiveness of research methods and techniques of inquiry. Within the paradigm, which presupposes certain fundamental principles, goals, and certain values shared by the scientific community, the novel sprouts of radical ideas once emerge. The scientific revolution here means a radical revision of the admissibility of accepted and proven methods, goals and values that are common to the members of the scientific community. Typically, new theories and concepts proposed and already mastered new scientific community, which is gradually replacing its representatives on the key command altitudes. The kernel of scientific community in fact is a style of thinking that is emerged in the context of a particular discipline, and then experience expansion in the form of discursive practices at a wide space of science and culture due to the novel cognitive schemes open the way to synthesize various research domains into a certain integrity. There is no question of the scientific revolution in the sense of Kuhn, since any significant goals and values of the scientific communities are not affected. Nevertheless, in some sense cognitive revolution taking place, the revolution of transdisciplinary type. The adoption of a new style of scientific thinking often gives rise to new types of objects and directions of cognitive activity, a new type of explanation that require new types of research proposals and cultural activities. Thus, the main idea of this article is that along with the Kuhn type scientific revolutions, transdisciplinary type scientific revolutions are conceivable, and even transdisciplinary cognitive types. This revolutions manifests in a change in style of reasoning, and it results in the expansion of this style to wide space of science and culture through the cognitive schemes and techniques, which enables to synthesize research and art activity in some integrity. Adoption of a new way of reasoning and the transition to new discursive practices generates new types of research facilities, new mechanisms of explanation, new cultural blueprints and instruments. Cognitive activity, based on a new style of thinking, involves multidisciplinarity, formation of new scientific and cultural institutions, and, therefore, causes a noticeable social change. Based on an analysis of interdisciplinary, multidisciplinary and transdisciplinary processes in modern science and culture the authors claim that it is namely transdisciplinarity would determine the face of science and culture in the medium term, and will form the basis for the convergence of science, technology, art, and consciousness studies in general. The main result of this paper is the following theorem: each modal logic extendingK4 having the branching property belowm and the effective m-drop point property is decidable with respect to admissibility. A similar result is obtained for intermediate intuitionistic logics with the branching property belowm and the strong effective m-drop point property. Thus, general algorithmic criteria which allow to recognize the admissibility of inference rules for modal and intermediate logics of the above kind are found. Our investigation is concerned with the finite model property with respect to admissible rules. We establish general sufficient conditions for absence of fmp w. r. t. admissibility which are applicable to modal logics containing K4: Theorem 3.1 says that no logic λ containing K4 with the co-cover property and of width > 2 has fmp w. r. t. admissibility. Surprisingly many, if not to say all, important modal logics of width > 2 are within the scope of this (...) theorem–K4 itself, S4, GL, K4.1, K4.2, S4.1, S4.2, GL.2, etc. Thus the situation is completely opposite to the case of the ordinary fmp–the absolute majority of important logics have fmp, but not with respect to admissibility. As regards logics of width ≤ 2, there exists a zone for fmp w. r. t. admissibility. It is shown that all modal logics A of width ≤ 2 extending S4 which are not sub-logics of three special tabular logics have fmp w.r.t. admissibility. (shrink)

Purpose of this article is to investigate the role that the "miraculous" – that is, everything that goes beyond “natural” – plays in the worldview of Western man. Methodology. I do not consider “miracles” as the facts of nature, but as the facts of culture, so in this article I am not talking about specific cases of violation of “laws of nature”, but about the place of “miraculous” in the view of the world of Western man and those transformations, that (...) occur with this element outlook influenced the development of information technologies. Novelty. It has been proved that miracles should be sought in mind, because the “miraculous” event does our attitude towards it. Moreover, it is impossible to determine the “true miracle”, while we are “inside” the reality. It has been demonstrated that influenced the development of society is transformed representations of gods and miracles. It has been discovered fundamental shift associated with the transition from mythology-as-faith to mythology-as-show. However, even within the latter remains a need for miracles, though, and goes to a completely different level. Conclusions. The term "miracle" has no meaning outside of accepted socio-cultural settings. The last set as the “natural” conditions and admissibility (inadmissibility) of its violation. And these installations are formed by social institutions, which in this age and at this time have a weight sufficient to impose their views to all the congregation or the greater part. Any extraordinary event can be explained by the action of internal agents unknown to us, and their ability to alter the reality is not necessarily superior to even our own capabilities. The only thing we can not do – is to change the source code of being (e.g., fundamental physical constants). This could make only creatures that are not spelled out in these source codes. However, people have not seen anything like it, and scarcely become witnesses of such events. (shrink)

The aim of this paper is to look from the point of view of admissibility of inference rules at intermediate logics having the finite model property which extend Heyting's intuitionistic propositional logic H. A semantic description for logics with the finite model property preserving all admissible inference rules for H is given. It is shown that there are continuously many logics of this kind. Three special tabular intermediate logics λ, 1 ≥ i ≥ 3, are given which describe all (...) tabular logics preserving admissibility: a tabular logic λ preserves all admissible rules for H iff 7λ has width not more than 2 and is not included in each λ. We study the problem of finding a basis for all rules admissible in the intuitionistic propositional logic IPC. The main result is Theorem 3.1 which gives a basis consisting of all rules in semi-reduced form satisfying certain specific additional requirements. Using developed technique we also find a basis for rules admissible in the logic of excluded middle law KC.

An algorithm recognizing admissibility of inference rules in generalized form (rules of inference with parameters or metavariables) in the intuitionistic calculus H and, in particular, also in the usual form without parameters, is presented. This algorithm is obtained by means of special intuitionistic Kripke models, which are constructed for a given inference rule. Thus, in particular, the direct solution by intuitionistic techniques of Friedman's problem is found. As a corollary an algorithm for the recognition of the solvability of logical (...) equations in H and for constructing some solutions for solvable equations is obtained. This paper offers a brief analysis of the unification problem in modal transitive logics related to the logic S4 : S4 itself, K4, Grz and Gödel-Löb provability logic GL . As a result, new, but not the first, algorithms for the construction of ‘best’ unifiers in these logics are being proposed. The proposed algorithms are based on our earlier approach to solve in an algorithmic way the admissibility problem of inference rules for S4 and Grz . The first algorithms (...) for the construction of ‘best’ unifiers in the above mentioned logics have been given by S. Ghilardi in [ 16 ]. Both the algorithms in [ 16 ] and ours are not much computationally efficient. They have, however, an obvious significant theoretical value a portion of which seems to be the fact that they stem from two different methodological approaches. (shrink)

(...) They appear in your mind when you walk by the hospital room they occupied or when someone mentions their name. There is [End Page 19] something about the narrative of their life and illness that makes you hold on to them. Lily is one such patient for me.Lily was a 45-year-old paraplegic woman who was well known to many providers in the hospital. She had a complex trauma history (childhood physical and sexual abuse, intimate partner violence, domestic violence), homelessness, and multiple psychiatric admissions. In addition, she had a complex medical history, including chronic pain issues and substance use disorder. Many providers considered her to be a "very difficult" or "challenging" patient because she would "dictate" her care, had low distress tolerance and would have explosive angry outbursts requiring frequent visits from Police and Security. To top it off, after months of a challenging stay on a unit, she would eventually leave against medical advice. Everyone involved in her care felt that discharge to a safe setting such as a skilled nursing facility would be her best option. Yet, she was a very "hard" sell to any facility because of her behavioral issues, relatively young age, extensive history of drug use, and medication non-compliance. Even though the unit I worked in was familiar with "difficult" patients like Lily, the floor staff was anxious and concerned about the effect Lily would have on patients, staff, and providers. The combined anticipatory anxiety worsened after we were told that Lily left against medical advice three days before her admission to our unit as a reaction to the staff's attempt to develop a behavioral plan.I remember the day I met Lily. I was working as the clinical social worker on the floor, helping patients with adjustment to coping with hospitalization, addressing mental health issues that usually exacerbate in the acute care setting, and providing support to the staff caring for a psychosocially complex patient population. It was the second day after Lily arrived on the floor, and Police and Security had already come up three times. As I walked out of another patient's room, a bedside nurse stopped me in the hallway. "Can you please talk to her? … Please, just talk to her, or sit with her. I just need a break. I have been in that room since I started my shift. I am exhausted." The nurse had an exasperated and pleading look, and even though I was rushing to a meeting, I decided to meet with Lily instead. When I walked into her room, I saw a thin, small-framed woman with brown hair pulled back into a tight bun. She had freckles peppered all over her round face, neck, and chest. Her features were delicate and small, and her almond-shaped green eyes were her most prominent feature. She was wearing a white tee and jeans. She was sitting in her wheelchair; her makeup bag was lying on the table next to her. I introduced myself and my role on the team, trying not to stumble under a very heavy glare. "Tell them to leave me alone. That nurse is always in my room. Spying. I might not be able to walk, but I can still use my hands. I can call if I need help."And so I did. And when I came back, Lily and I talked a little about her life. And the next day, we talked a little more. And then again. This paper defends the relevance of Taylor's (1964) critique of S-R behaviorism to Skinner's model of operant conditioning. In particular, it is argued against Ringen (1976) that the model of operant conditioning is a nonteleological variety of explanation. Operant conditioning is shown unable, on this account, to provide a parsimonious and predictive explanation of the behavior of higher level organisms. Finally, it is shown that the principle of operant conditioning implicitly assumes a teleological capacity, the admission of which renders the (...) principle of operant conditioning superfluous. Of the many works he wrote during 1848, his "richest and most fruitful year," Kierkegaard specified Practice in Christianity as "the most perfect and truest thing." In his reflections on such topics as Christ's invitation to the burdened, the imitatio Christi, the possibility of offense, and the exalted Christ, he takes as his theme the requirement of Christian ideality in the context of divine grace. Addressing clergy and laity alike, Kierkegaard asserts the need for institutional and personal admission of the (...) accommodation of Christianity to the culture and to the individual misuse of grace. As a corrective defense, the book is an attempt to find, ideally, a basis for the established order, which would involve the order's ability to acknowledge the Christian requirement, confess its own distance from it, and resort to grace for support in its continued existence. At the same time the book can be read as the beginning of Kierkegaard's attack on Christendom. Because of the high ideality of the contents and in order to prevent the misunderstanding that he himself represented that ideality, Kierkegaard writes under a new pseudonym, Anti-Climacus. (shrink)

This paper investigates the behavior of conformal fluctuations of space-time geometry that are admissible under the quantized version of Einstein's general relativity. The approach to quantum gravity is via path integrals. It is shown that considerable simplification results when only the conformal degrees of freedom are considered under this scheme, so much so that it is possible to write down a formal kernel in the most general case where the space-time contains arbitrary distributions of particles with no other interaction except (...) gravity. The behavior of this kernel near the classical space-time singularity then shows that quantum fluctuations inevitably diverge near the singularity. It is shown further that the root cause of this divergence lies in the fact that the Green's function for the conformally invariant scalar wave equation diverges at the singularity. The limitations on the validity of classical general relativity near the space-time singularity are discussed and it is argued that the notion of singularity itself needs to be radically modified once the quantum effects are taken into account. OBJECTIVES: To study the resuscitation preferences, choice of decision-maker, views on the seeking of patients' wishes and determinants of these of elderly hospital in-patients. DESIGN: Questionnaire administered on admission and prior to discharge. SETTING: Two acute geriatric medicine units (Southampton and Poole). PARTICIPANTS: Two hundred and fourteen consecutive consenting mentally competent patients admitted to hospital as emergencies. RESULTS: Resuscitation was wanted by 60%, particularly married and functionally independent patients and those who had not already considered it. Not wanted resuscitation was (...) associated with lack of social contacts. Sixty-seven per cent welcomed enquiry about their preferences and 78% wanted participation in decision, 43% as sole decision-maker. Wishing to choose oneself was associated with not wanting resuscitation, prior knowledge of it, and lack of a spouse. Patients' opinions remained stable during their admission. CONCLUSIONS: Discussion of resuscitation is practical on hospital admission without causing distress and the views expressed endure through the period of hospitalisation. Elderly patients' attitudes depend partly on personal health and social circumstances. This may assist doctors when patients are unable to participate themselves. (shrink)

Introduction: The decision of “do not attempt resuscitation” in the event of cardiopulmonary arrest is usually made when the patients are critically ill and cannot make an informed choice. Although, various professional bodies have published guidelines, little is know about the patients’ own views regarding DNAR discussion.Aim: The aim of this study was to determine patients’ attitudes regarding discussing DNAR before they are critically ill.Methods: A prospective study was performed in a general out patients department. A questionnaire was distributed to (...) consecutive outpatients along with an explanatory leaflet in the adult outpatient clinic.Results: 364 patients completed the questionnaire . 90% of respondents wanted all patients to be asked regarding DNAR decision at some point during a hospital admission. The majority would not find a DNAR discussion distressing. Only 10% would find it upsetting, however, 48% of these still wanted a discussion. 37% of respondents wanted to discuss DNAR decisions on admission; 32% in outpatients; 17% at consent for surgery, 14% when they are critically ill. 87% of respondents would not object to their relatives being involved in making decisions about their resuscitation status. However, only 12% of the subjects in the study had been involved in discussing the resuscitation status of a relative and 21% would not be comfortable to discuss a relative’s resuscitation status. Although 33% of patients preferred their resuscitation status to simply be documented within their clinical notes, 77% wanted it to be more easily accessible.Conclusions: This study suggests that contrary to current practice most patients want to discuss their DNAR status prior to becoming critically ill. This includes half of the small number that find it distressing to discuss. Although most patients are comfortable with relatives being involved in discussing DNAR, a significant proportion do not want their relatives to be asked. Furthermore, once a decision has been made, the majority of patients want it to be more accessible than current practice allows. (shrink)

_The purpose_ of this study is the reflection on ways of philosophical legitimation for the "Self-made-man" idea in the worldview of the Renaissance and Reformation. _Theoretical basis._ Historical, comparative, and hermeneutic methods became the basis for this. The study is based on the works of Nicholas of Cusa, G. Pico della Mirandola, N. Machiavelli, M. Montaigne, E. Roterodamus, M. Luther, J. Calvin together with modern researchers of this period. _Originality._ The analysis allows us to come to the conclusion that casts (...) doubt on the still widespread belief according to which the emergence of the "Self-made-man" idea is localized by the process of forming the American cultural code and the ideological heritage of Benjamin Franklin. It is highlighted that the formation of this idea is the result of a long process that originated in the ancient world and gains a special impetus in the Renaissance and Reformation. Precisely in the cultural context of the latter, the ancient intention to recognize the individual’s right to self-determination and self-government, which in the depths of Christian theology acquires only a potentially universal character, becomes not only acceptable but also, in the context of Protestantism worldview, the only admissible, in fact, individual’s obligatory life guidelines. _Conclusions._ Humanistic and reformation thoughts quite naturally led to further ideological legitimation of the person’s idea of who is creating oneself. This legitimation was during the complex interaction of numerous factors of culture in the Late Middle Ages, as well as ideas and intentions inherited from Antiquity. Key among them was the gradual formation of a new social order, in essence, indifferent to paternalistic rudiments, together with the ethics of Protestantism corresponding to it. The latter does not only legalize but, de facto, sacralizes the individual’s reorientation from hopes for the synergy of God’s grace and own free will in personal salvation, toward the self-reliance and personal efforts, awareness of personal responsibility for the own fate as key principles of the "Self-made-man" concept. Background and objective: Code status discussions may fail to address patients’ treatment-related goals and their knowledge of cardiopulmonary resuscitation (CPR). This study aimed to investigate patients’ resuscitation preferences, knowledge of CPR and goals of care. Design, setting, patients and measurements: 135 adults were interviewed within 48 h of admission to a general medical service in an academic medical centre, querying code status preferences, knowledge about CPR and its outcome probabilities and goals of care. Medical records were reviewed for clinical information (...) and code status documentation. Results: 41 (30.4%) patients had discussed CPR with their doctor, 116 (85.9%) patients preferred full code status and 11 (8.1%) patients expressed code status preferences different from the code status documented in their medical record. When queried about seven possible goals of care, patients affirmed an average of 4.9 goals; their single most important goals were broadly distributed, ranging from being cured (n = 36; 26.7%) to being comfortable (n = 8; 5.9%). Patients’ mean estimate of survival to discharge after CPR was 60.4%. Most patients believed it was helpful to discuss goals of care (n = 95; 70.4%) and the chances of surviving inhospital CPR (n = 112; 83.0%). Some patients expressed a desire to change their code status after receiving information about survival following inhospital CPR (n = 11; 8.1%) or after discussing goals of care (n = 2; 1.5%). Conclusions: Doctors need to address patients’ knowledge about CPR and take steps to avoid discrepancies between treatment orders and patients’ preferences. Addressing CPR outcome probabilities and goals of care during code status discussions may improve patients’ knowledge and influence their preferences. (shrink)

A questionnaire was distributed to (...) consecutive outpatients along with an explanatory leaflet in the adult outpatient clinic.Results: 364 patients completed the questionnaire . 90% of respondents wanted all patients to be asked regarding DNAR decision at some point during a hospital admission. The majority would not find a DNAR discussion distressing. Only 10% would find it upsetting, however, 48% of these still wanted a discussion. 37% of respondents wanted to discuss DNAR decisions on admission; 32% in outpatients; 17% at consent for surgery, 14% when they are critically ill. 87% of respondents would not object to their relatives being involved in making decisions about their resuscitation status. However, only 12% of the subjects in the study had been involved in discussing the resuscitation status of a relative and 21% would not be comfortable to discuss a relative’s resuscitation status. Although 33% of patients preferred their resuscitation status to simply be documented within their clinical notes, 77% wanted it to be more easily accessible.Conclusions: This study suggests that contrary to current practice most patients want to discuss their DNAR status prior to becoming critically ill. This includes half of the small number that find it distressing to discuss. Although most patients are comfortable with relatives being involved in discussing DNAR, a significant proportion do not want their relatives to be asked. Furthermore, once a decision has been made, the majority of patients want it to be more accessible than current practice allows. (shrink)

Of the many works he wrote during 1848, his "richest and most fruitful year," Kierkegaard specified Practice in Christianity as "the most perfect and truest thing." In his reflections on such topics as Christ's invitation to the burdened, the imitatio Christi, the possibility of offense, and the exalted Christ, he takes as his theme the requirement of Christian ideality in the context of divine grace. Addressing clergy and laity alike, Kierkegaard asserts the need for institutional and personal admission of the (...) accommodation of Christianity to the culture and to the individual misuse of grace. As a corrective defense, the book is an attempt to find, ideally, a basis for the established order, which would involve the order's ability to acknowledge the Christian requirement, confess its own distance from it, and resort to grace for support in its continued existence. At the same time the book can be read as the beginning of Kierkegaard's attack on Christendom. Because of the high ideality of the contents and in order to prevent the misunderstanding that he himself represented that ideality, Kierkegaard writes under a new pseudonym, Anti-Climacus. (shrink)

Assuming AD + (V = L(R)), it is shown that for κ an admissible Suslin cardinal, o(κ) (= the order type of the stationary subsets of κ) is "essentially" regular and closed under ultrapowers in a manner to be made precise. In particular, o(κ) ≫ κ +, κ ++ , etc. It is conjectured that this characterizes admissibility for L(R).

The increasing use of digital technologies in judicial and arbitration proceedings increases the usage of digital evidence by the parties, which brings the necessity of creating patterns for adjudicators to admit and assess this new type of evidence. This paper generally addresses digital evidence focusing on the second moment in international arbitration proceedings. It also narrows the topic to hacked and leaked evidence and its admissibility in international arbitration. The literature review showed a significant amount of research devoted to (...) the evidence in arbitration. Some considered electronic evidence within one jurisdiction; others focused on certain forms of digital evidence such as electronic signatures. Papers on digital evidence in international arbitration approach arbitration rules for digital evidence but skip admissibility issues. No systemic and complex works research digital evidence in arbitration, explicitly focusing on the admissibility of hacked and leaked digital evidence from a comparative perspective. Also, no research deals with enforcing international arbitration awards relying on illegally obtained digital evidence. In these cases, there could be a possible violation of domestic public policy under the New York Convention terms (art. V, 2, b). That is why the paper aims to offer the concept of digital evidence in international arbitration, including hacked and leaked evidence, criteria of its admissibility and relevance, and design the arbitration guidelines for assessing hacked and leaked evidence. Comparative legal analysis of the international arbitration rules and national procedure law allowed us to compare the regulatory approaches to the definition of digital evidence and its admissibility worldwide. The method of legal modeling allowed designing model guidelines for arbitral tribunals to evaluate the admissibility and relevance of digital evidence, including hacked and leaked evidence. Moreover, the case study method allowed us to analyze jurisprudence and define criteria for admission of hacked and leaked evidence. We conclude that the admissibility of hacked and leaked evidence depends solely on the arbitrator’s broad discretion to assess the evidence. Nevertheless, thorough evidence analysis and a well-reasoned award are always mandatory. (shrink)

This book is dedicated to V.A. Yankov’s seminal contributions to the theory of propositional logics. His papers, published in the 1960s, are highly cited even today. The Yankov characteristic formulas have become a very useful tool in propositional, modal and algebraic logic. The papers contributed to this book provide the new results on different generalizations and applications of characteristic formulas in propositional, modal and algebraic logics. In particular, an exposition of Yankov’s results and their applications in algebraic logic, the theory (...) of admissible rules and refutation systems is included in the book. In addition, the reader can find the studies on splitting and join-splitting in intermediate propositional logics that are based on Yankov-type formulas which are closely related to canonical formulas, and the study of properties of predicate extensions of non-classical propositional logics. The book also contains an exposition of Yankov’s revolutionary approach to constructive proof theory. The editors also include Yankov’s contributions to history and philosophy of mathematics and foundations of mathematics, as well as an examination of his original interpretation of history of Greek philosophy and mathematics. The known results about Σ 1 -completeness, Σ 1 -compactness, ordinal omitting etc. are given a unified treatment, which yields many new examples. It is shown that the unifying theorem is best possible in several ways, assuming V = L.

The perhaps most important criticism of the nontransitive approach to semantic paradoxes is that it cannot truthfully express exactly which metarules preserve validity. I argue that this criticism overlooks that the admissibility of metarules cannot be expressed in any logic that allows us to formulate validity-Curry sentences and that is formulated in a classical metalanguage. Hence, the criticism applies to all approaches that do their metatheory in classical logic. If we do the metatheory of nontransitive logics in a nontransitive (...) logic, however, there is no reason to think that the argument behind the criticism goes through. In general, asking a logic to express its own admissible metarules may not be a good idea. (shrink)

This paper explores some of the important parallels between recent reforms to legal rules for the admissibility of scientific and expert evidence, exemplified by the US Supreme Court's decision in Daubert v Merrell Dow Pharmaceuticals, Inc. in 1993, and similar calls for reforms to medical practice, that emerged around the same time as part of the Evidence-Based Medicine (EBM) movement. Similarities between the “movements” can be observed in that both emerged from a historical context where the quality of medicine (...) and legal approaches to science were being subjected to growing criticism, and in the ways that proponents of both movements have used appeals to “folk epistemologies” of science to help legitimate their reform aspirations. The term folk epistemology is used to describe the weaving together of formal and informal images of scientific method with normative and pragmatic concerns such as eradicating “junk science”, and promoting medical best practice. Perhaps unsurprisingly, given the unfocused breadth of these aspirations the implications of these “reforms” for medical and legal practice have not been straightforward, although they do represent an important new set of rhetorical resources to critique and or legitimate expertise in medical and legal domains. Discussion closes, by noting the growth of calls for these movements to reciprocate in areas where law and medicine intersect, such as medical negligence litigation. (shrink)

In two recent cases, Grutter v. Bollinger, 539 U.S. 306. and Gratz v. Bollinger, 539 U.S. 244., the Supreme Court held that the Equal Protection Clause permitted state schools to use race-sensitive admissions in order to obtain the educational benefits that flow from a diverse student body. The diversity-based argument for race-sensitive admissions, scholarships, awards, and other opportunities at universities should have been rejected because it does not consider the full range of costs and benefits and because the more narrow (...) educational effects probably weigh against such programs. However, this does not suggest that applicants' race, ethnicity, and gender should be ignored. Rather the same consideration that led to the defeat of the diversity argument, i.e., reasoning capacity, supports the consideration of demographic factors. However, attention to such factors further undermines the consequentialist case for affirmative action. (shrink)
