Logical positivists describe certain classes of propositions as analytic or synthetic. Their position would be unassailable if they left the matter at that. Unfortunately they add a rider to the effect that all propositions are one or the other. Pseudo–propositions, being neither one nor the other, are described as nonsense. The above rider itself appears to fall into neither class and an immediate objection may be made to the positivist's standpoint on the ground that it commits him to nonsense by (...) his own definition. As the creator, God is the source of the abundance for immense variety manifest in creation. The reservoir for this abundance is the primordial chaos, identified as the Pandemonium Tremendum. God manages this inexhaustible “storehouse of the snow” through decisions or “willings,” giving rise to constraints that result in the ordered array of creation. Without this active and decisive vigilance, the Pandemonium Tremendum would scour and ravage the creation. Also, as an omniscient, unobtrusive, and impartial witness, God manages the primordial (...) chaos without compromising its unfettered variety. What is the role of chaos as the Ungrund? All creatures are the consequence of acts of decision. God alone is self‐decisive and, hence, the uniquely sovereign creator. That is, God arises spontaneously through an aboriginal act of in–speaking. Otherwise, and in utter contradiction to its radically unprincipled character, the primordial chaos would provide the arche or sufficient reason for divine causation. This mythic and metaphysical account falls in the tradition of Meister Eckhart and Nicolas Berdyaev and is expressed in the rubric of communication theory. (shrink)

Though the concept of ideology appears central to the explanation of the perseverance of systematic domination, the coherence and viability of the concepthave been repeatedly questioned. The status of the concept of ideology in critical theory has become one of simultaneous dependence and suspicion. While Habermas has been reluctant to develop the concept in his communications theory, this paper argues that ideology can be usefully and coherently defined in terms of distorted communication. In this article I critically engage with Robert Craig’s constitutive metamodel of communication theory from the vantage point of an integrational semiology, as developed by Oxford Professor Roy Harris in his book Signs, Language and Communication (1996). I argue that Harris’ dichotomy of a ‘segregational’ vs. an ‘integrational’ tradition of theorizing language and communication makes the metamodel redundant on the grounds that Craig’s communicational perspective on social reality is replaced by two semiologies sponsoring mutually exclusive ontologies (...) and epistemologies. Prominent views about representation share a premise: that mathematical communication theory is blind to representational content. Here I challenge that premise by rejecting two common misconceptions: that Claude Shannon said that the meanings of signals are irrelevant for communication theory (he didn't and they aren't), and that since correlational measures can't distinguish representations from natural signs, communication theory can't distinguish them either (the premise is true but the conclusion is false; no valid argument can (...) link them). This paper explores communicative punishment from a non-idealized perspective. I argue that, given the specific racial dynamics involved, and given the broader social and historical context in which they are embedded, American policing and punishment function as a form of racially derogatory discourse. Understood as communicative behavior, criminal justice activities express a commitment to a broader ideology. Given the facts about how the American justice system actually operates, and given its broader socio-political context, American carceral behaviors express a commitment to (...) the same types of derogatory, subordinating anti-minority ideologies that are paradigmatically conveyed through racial slurs and similar forms of derogatory speech. Moreover, I argue, this derogatory meaning presents a significant obstacle to adequate criminal justice reform. (shrink)

Each essay contains a very helpful bibliography (...) of work in the appropriate area and in addition the book contains a general bibliography prepared by Hugh Duncan which includes comments about the contents and nature of each book listed. The excellent essays of Searle and Fodor, Jenkins, and Saporta make the most direct connection with philosophical issues being widely discussed today, but most of the essays provide material which should be of interest to philosophers.--R. This paper considers the applicability of expressive theories of punishment to the punishment of corporate entities. The author argues that although arguments which suggest that the denunciatory account is superior to a communicative account in paradigmatic cases of punishment cannot be transferred straightforwardly to cover this kind of case, there are other reasons, connected with the different attitudes we have to regret and remorse in individual and collective cases, for preferring a communicative to a denunciatory account here.

Saul Smilansky holds that there is a widespread intuition to the effect that pre-punishment – the practice of punishing individuals for crimes which they have not committed, but which we are in a position to know that they are going to commit – is morally objectionable. Smilanksy has argued that this intuition can be explained by our recognition of the importance of respecting the autonomy of potential criminals. (Smilansky, 1994) More recently he has suggested that this account of the intuition (...) only vindicates it if determinism is false, and argues that this presents a problem for compatibilists, who, he says, are committed to thinking that the truth of determinism makes no moral difference (Smilansky, 2007).In this paper I argue that the intuitions Smilansky refers to can be explained and vindicated as consequences of the truth of a communicative conception of punishment. Since the viability of the communicative conception does not depend on the falsity of determinism, our intuitions about pre-punishment do not clash with (what Smilanksy calls) compatibilism. And if the communicative theory of punishment is – as Duff (2001) suggests – a form of retributivism, the account also meets New's (1992) challenge to retributivists to explain what is wrong with pre-punishment. The is not an attempt to provide an overview of theories in communication. Nor is it an attempt to provide a complete picture of approaches to communication theory. The book is an attempt to defend a very general empiricist approach to the scientific study of communication. The author is referring to the most general notion of empiricism, that we can come to some knowledge about the world through the use of our perceptions. Empiricism in these senses (...) has taken quite a critical beating over the centuries, but in the sense in which he uses this term here it remains alive and well and prepared to serve as the foundation for the scientific study of communication, as it has for several decades. Secondly, the book is an attempt to defend a 'conventional' view of scientific theory. Thirdly, the book is an attempt to introduce into the mainstream of communication scholarship an approach to the philosophy of science known as 'scientific realism'. In the ‘realist’ view defended by Sánchez and Campos (2009), communication is a biologically based behavioural phenomenon that communication science should endeavour to describe and explain as accurately as possible. Although this rationale for a biological-behavioural science of communication makes sense to me on its own terms, I will argue that an intellectual discipline that intends to cultivate the social practice of communication (i.e., a practical discipline as proposed by Craig 1989) unavoidably confronts normative and interpretive (...) problems of praxis, as well as empirical and technical questions, and cannot, therefore, be reduced to an exclusively biological-behavioral science. Does this argument entail a categorical rejection of epistemological realism? Mats Bergman (2012) has criticized what he sees as my tendency to describe my pragmatist, social constructionist stance in communication theory as if it were incompatible with realism. Referring to the ‘habit-realism’ of Peirce and Dewey, Bergman claims that I don’t necessarily need to reject this broad realism, which can embrace a moderate constructivism. Reflecting on Bergman’s critique, this article reviews his account of habit-realism and considers what difference it would make for a practical discipline of communication to embrace pragmatist realism as opposed to an anti-realist constructivism on the one side, or an anti-constructivist realism like that of Sánchez and Campos on the other. An interaction paradigm continues to predominate in social communication models to this day and yet often tends to be heavily intuitive, epistemologically conservative and acritical. This article seeks to examine some of the implications for our intuitive understanding of interaction when greater instability is introduced into social communication theory where communication is conceptualized as a complex uncertainty. The theoretical architecture of this undertaking is in itself interdisciplinary, comprising concepts from the fields of social theory, logic, (...) information theory and constructivism. In these interdisciplinary considerations, interaction is conceptualized as a fictional construction and thus disabused of the strong transcendental claims which accompany concepts of dialogism, consensus or intersubjectivity. Whereas uncertainty is customarily seen as the opposite of rational inclusive communication and a risk to be somehow avoided, this article explores a different theoretical modelling of the relationship between uncertainty and social communication. Here, communication is conceived as an extremely precarious undertaking. This very precariousness is a fact of everyday life where communication is social construction in progress and norms are constantly regenerated, negotiated and challenged. (shrink)

Indeterminate sentencing is a sentencing practice where offenders are sentenced to a range of potential imprisonment terms and where the actual release date is determined later, typically by a parole board. Although indeterminate sentencing is often considered morally problematic from a retributivist perspective, Michael O’Hear has provided an interesting attempt to reconcile indeterminate sentencing with the communicative version of retributivism developed by Antony Duff. O’Hear’s core argument is that delayed release, within the parameters of the indeterminate sentence, can be seen (...) as an appropriate retributivist response to the violations of prison rules. This article highlights several problems in O’Hear’s proposal and argues that the communicative theory is not easily reconciled with his proposed model for indeterminate sentencing. In conclusion, it is argued that proponents of the communicative version of retributivism should resist indeterminate prison sentences. (shrink)

The object of this article is to demonstrate how stakeholder theory can be enlarged and enhanced by two communications theories, media systems dependency and community infrastructure theory. The stakeholder perspective is often represented by a diagram in which a firm is centrally positioned, surrounded by stakeholders. However, relationships between stakeholders are given relatively little attention, the various groups theoretically encompassed by the term “community” remain relatively undefined, and other marginalized stakeholders often go unrecognized. MSD and CIT can enable (...) us to conceptualize the stakeholder model more clearly, to develop research projects that more adequately capture the dynamic quality of stakeholder relationships, to tailor management strategies to particular stakeholder characteristics, and to understand corporate social responsibility messages. The aim of this article is to explore how a self-referential social system, although it is not a human being, can be said to “observe.” For this purpose, the article reformulates Niklas Luhmann’s theory of social systems as sociological phenomenology, or the de-consciousness philosophized phenomenology, because a social system has the same structure of intentionality as consciousness: Just as consciousness is always consciousness of something, communication is always communication of something. In correlation to this communicative intentionality, communicated (...) environments come and go as social phenomena. A social system is not a thing, but an autonomously observing subject. Hence, this systems theory takes on the role of a second-order observer: It observes how social systems as first-order observers observe self-referentially because phenomena given to the natural attitude of the first-order observer constitute multiple social realities in daily life. Therefore, the theory of self-referential social systems is not objectivism, but a variation of mundane subjectivist phenomenology. (shrink)

Shanker & King (S&K) argue that information-theoretic approaches to communication are too rigid to capture the ebb and flow of communicative interactions. They advocate instead a dynamic systems approach based on the metaphor of dance. We focus on two problems arising from the dance metaphor: first, that its inherently cooperative tone contradicts basic tenets of behavioral biology; and second, that it risks obscuring rather than clarifying the details of communicative interactions.

The Communicational Theory of Law (CTL) usually differentiates between Legal Sociology and Legal Theory, in the sense that Legal Sociology is concerned with the social validity of the rules and Legal Theory with the formal or legal validity of the rules. It can be argued that both disciplines are two different perspectives of the same empirical reality (legal rules). Also, legal System and social milieu are two closely linked realities; they cannot be separated because they need each (...) other. The Law is the form or order that the social milieu takes, and, at the same time, the social environment provides the ideas, collective representations and other matters that need a legal regulation. For this reason, the epistemological separation between Sociology and Legal Theory must be overcome when the theoretical perspective comes to legal decisions. Thus, the decisional moment becomes the meeting point between the legal System and the social milieu. This is where the concept of the legal System fulfils its main function, as it allows for the dynamism and adaptability of the legal order. The hermeneutic re-elaboration of the normative texts will be the channel through which the social facts and other material elements can inform the meaning or possible interpretations of the rules and institutions of the legal order. This happens primarily by influencing theoretical and doctrinal works of an expository and didactic nature; and secondarily by influencing the decisions of legal operators and courts. This study seeks to explain how the social context influences legal decisions and the formation of the legal System, from a communicational perspective of Law. In order to do so, it will be necessary to set out two epistemological premises of CTL: the semiotic tripartition of the Theory of Law and the legal Order-legal System distinction. (shrink)

On an influential account, chaos is explained in terms of random behaviour; and random behaviour in turn is explained in terms of having positive Kolmogorov-Sinai entropy (KSE). Though intuitively plausible, the association of the KSE with random behaviour needs justification since the definition of the KSE does not make reference to any notion that is connected to randomness. I provide this justification for the case of Hamiltonian systems by proving that the KSE is equivalent to a generalized version of Shannon's (...) communication-theoretic entropy under certain plausible assumptions. I then discuss consequences of this equivalence for randomness in chaotic dynamical systems. The article is a philosophical response to the oped of the German philosopher Jürgen Habermas Krieg und Empörung, published by him in the Süddeutsche Zeitung in April 2022. The oped demonstrates the philosopher’s view on ideological disputes and political debates or “indignation” (Empörung) in public sphere in both Germany and the EU concerning an attempt to develop a unanimous policy to help Ukraine with weapons against Russia’s military aggression. The authors presume that Habermas published the accountable message of a responsible (...) citizen that means it should be also taken as based on his theoretical achievements. The article consists of two parts. The first part sets out the main arguments of the philosopher’s newspaper article, which ends with a recommendation of compromise and partnership negotiations with the aggressor de facto due to the losses of Ukraine. The second part is an attempt by the authors to clarify the main preconditions and premises of Habermas’s communicative philosophy, which demonstrate the fundamental limitation of its explanatory power for this type of radical dissent, which is war. First of all, the authors suggest, it is the idea of pacification in interethnic relations, which forms the intellectual mood after World War II and finds its philosophical expression in the discovery of a priori foundations of understanding (Apel, Habermas) and ideas of developing formal pragmatics of communication. Attention to the latter allows the authors to demonstrate how consistent analysis of a priori (counterfactual) conditions of communication is considered by Habermas primarily in the historical perspective of positive dimensions of social integration - democratic equality, freedom, justice for participants of communicative interaction. The article concludes with a detailed analysis of the significance of the concept “lifeworld” as one of the central concepts within communicative theory and an analogue of “form of life” and “culture”. The authors argue the idea of perspective creating a common lifeworld for all in the processes of communication is fundamental to the works of the philosopher. The article concludes that the regulative idea of the single world as a basic ontological assumption of communicative theory does limit its explanatory capacity in terms of a war situation as a clash of different cultural worlds. Climate change has become one of the most pressing problems that can threaten the existence and development of humans around the globe. Almost all climate scientists have agreed that climate change is happening and is caused mainly by greenhouse gas emissions induced by anthropogenic activities. However, some groups still deny this fact or do not believe that climate change results from human activities. This essay discusses the causes, significance, and skeptical arguments of climate change denialism, as well as the roles (...) of scientists and science communication in addressing the issues. Through this essay, we call for the active participation of scientists in science communication activities with the public, the opening of new science communication sectors specified for climate change, and more attention to social sciences and humanities in addressing climate change issues. Research exists on how a corporation communicates during a crisis, the impact on its reputation, and how well it weathers that crisis. However, crisis communication research tends to view a company’s communication efforts from the standpoint of success or failure; looking at the communication critically to determine if the company’s power influences or silences potentially alternative voices and viewpoints is not currently part of the discussion. This article argues that critical discourse analysis techniques be added to the (...) framework of crisis communication theory in an effort to ensure that the corporation’s message or position of power does not unfairly marginalize or altogether silence alternative discourses. Despite widespread discussion of the impact of corporate social responsibility activities on consumer perceptions, little research has examined how consumers cope with CSR-based crisis response messages as a bolstering strategy. To fill this gap, we propose a framework integrating situational crisis communication theory with the persuasion knowledge model, applying the model to an experiment with a 2 × 2 × 2 between-subjects factorial design. In Study 1, we found interaction effects between CSR motives and crisis type on word-of-mouth (...) intention and purchase intention. In addition, inferences about CSR motives interacted with perceptions about CSR history on purchase intention. In Study 2, we replicated study 1 and found that crisis responsibility mediated the main effect of crisis type on behavioral intentions, but neither the main effect of CSR motives and CSR history nor the interactions effects among those variables were mediated by crisis responsibility. Our results indicate that consumer inferences from a company’s CSR-based crisis communications play a significant role in increasing consumer behavioral intentions in two situations: when a crisis is accidental and when a CSR history is short. The modern information age brings changes to all phenomena of human life. For example, the natu re of wars change. They are transferred from the actual battlefield to the information space, i.e. they become hybrid. The winner is the one whose narrative becomes dominant in the global information space. The Russian-Ukrainian war is a vivid example of the latest confrontation. It takes place between two absolutely opposite positions, a compromise between which is impossible. This conflict is deeply existential, because Russia (...) sharply denies the existence of Ukraine as an independent state and as a nation in general. This is evidenced by the rhetoric of the aggressor state and numerous war crimes. However, this war is not only between two sides. By denying Ukraine its existence, Russia is also at war with the values that Ukrainians uphold and on the basis of which they strive to build their own country. And these are the values of the free democratic world. Therefore, Russia opposes not only one country, but all those who also share them. That is why the information war begins to reach far beyond the borders of Ukraine. Already today, we can see the influence of Russia, whose propaganda influences the agenda of many leading Western countries. Using both classic mass media (newspapers, radio, television) and new ones (communities in social networks, bloggers, etc.), it intervenes in the global information space. The Internet only further complicates the dissemination of reliable information and promotes propaganda, because now there is almost no control over the flow of information. Habermas states this problem, noting that everyone is now a potential author without editorial control. Therefore, in conditions where the mass media gravitate towards entertainment and most of the information flows in an uncontrolled stream, there is a war for human minds. That’s why the current situation becomes a challenge for communicative theory, which has learned to make a correct diagnosis, but has not yet offered its option for exiting the crisis. Habermas’ post “War and In dignation” is so far only a testimony to the failure of his philosophy in the face of real challenges. Therefore, modern war is also a direct test for communicative theory, which must either find a way out of its limits or confirm its defeat. (shrink)
