The aim of the study was to determine the acceptance and perception of Nigerian patients to medical photography. A self-administered questionnaire was distributed among Nigerian patients attending oral and maxillofacial surgery and plastic surgery clinics of 3 tertiary health institutions. Information requested included patients' opinion about consent process, capturing equipment, distribution and accessibility of medical photographs. The use of non-identifiable medical photographs was more acceptable than identifiable to respondents for all purposes (P = 0.003). Most respondents were favourably disposed to (...) photographs being taken for inclusion in the case note, but opposed to identifiable photographs being used for other purposes most especially in medical websites and medical journals. Female respondents preferred non-identifiable medical photographs to identifiable ones (P = 0.001). Most respondents (78%) indicated that their consent be sought for each of the outline needs for medical photography. Half of the respondents indicated that identifiable photographs may have a negative effect on their persons; and the most commonly mentioned effects were social stigmatization, bad publicity and emotional/psychological effects. Most of the respondents preferred the use of hospital-owned camera to personal camera/personal camera-phone for their medical photographs. Most respondents (67.8%) indicated that they would like to be informed about the use of their photographs on every occasion, and 74% indicated that they would like to be informed of the specific journal in which their medical photographs are to be published. In conclusion, non-identifiable rather than identifiable medical photography is acceptable to most patients in the studied Nigerian environment. The use of personal camera/personal camera-phone should be discouraged as its acceptance by respondents is very low. Judicious use of medical photography is therefore advocated to avoid breach of principle of privacy and confidentiality in medical practice. (shrink)
As in other professions, such as law and medicine, accounting has a Code of Professional Conduct (Code) that members are expected to abide by. In today''s legalistic society, however, the question of what is the right thing to do, is often confused with what is legal? In many instances, this may present a conflict between adhering to the Code and doing what some may perceive as proper ethical behavior. This paper examines (1) the reasoning process that CPAs use in resolving (...) ethical issues related to confidentiality; and, (2) whether or not there is a perceived conflict in adhering to the Code and the moral values of some CPAs. The results indicate that although most CPAs sampled resolve ethical issues in accordance with the Code, such decisions do not always reflect their belief of what is morally right. Although the results are useful in understanding how some CPAs reason in making moral choices involving confidentiality decisions, care should be exercised in drawing further inferences from this study due to the limited sample size. I relate the aesthetic mediation of reason and the identity of religion and mythology found in the Earliest System-Programme of German Idealism to Hegel’s account of the transition from the ancient Greek religion of art to the revealed religion (Christianity) in his theory ofabsolute spirit. While this transition turns on the idea that the revealed religion mediates reason more adequately in virtue of its form (i. e., representational thought), I argue that Hegel’s account of the limitations of religious representational thought, (...) when taken in conjunction with some of his ideas concerning Romantic art, suggests that he fails to demonstrate the necessity of the transition in question, thus undermining the triadic structure (i. e., art, religion, philosophy) of his theory of absolute spirit.Dans cet article, jelais un lien entre, d’une part, la médiation esthétique de la raison et l’identite de la religion et de la mythologie formulées dans le premier programme systématique de l’idéalisme allemand et, d’autre part, le récit que fait Hegel de la transition menant de la religion grecque antique de l’art à la religion révélée (la chrétienté) dans sa théorie de l’Esprit absolu. Bien que cette transition repose sur l’idée que la religion révélée médiatise la raison plus adéquatement grâce à sa forme (la pensée représentationnelle) , je soutiens que, si on considère parallèlement à ses idées sur l’art romantique les explications que donne Hegel au sujet des limitations de la pensée représentationnelle religieuse, ces explications laissent apercevoir qu’il échoue à démontrer la nécessité de la transition en question, ce qui a pour effet de faire s’effondrer la structure ternaire art, religion, philosophie de sa théorie de l’Esprit absolu. The release of Stéphane Madelrieux's William James, L'attitude empiriste (William James, The Empiricist Stance) is excellent news indeed for French James studies: it is the first comprehensive study of James's works in French. It will certainly prove to be a reference for James studies and empiricist studies in general.James was introduced quite early in France, and although there are a number of translations at hand,1 as well as two books by David Lapoujade,2 a comprehensive (...) monograph was still lacking. Madelrieux's book is, from this standpoint, a remarkable achievement. Social conditions of race and class continue to combine in ways that raise systemic questions about the adequacy and legitimacy of liberal, capitalist democracy in America. More radical alternatives, however, are still generally held to be irrelevant in the American context. The following is an effort to correct this widespread misrepresentation of socialism’s relevance to America generally, and to matters of race in particular. I consider the work of C.L.R. James who, fifty years ago, developed a class-oriented, explicitly Marxist (...) theory in which the aspirations and struggles of African-Americans were given a central place, both analytically and politically. The six questions involve: 1) the nature of a mental disorder; 2) the definition of mental disorder; 3) the issue of whether, in the current state of psychiatric science, DSM-5 should assume a cautious, conservative posture or an assertive, transformative posture; 4) the role (...) of pragmatic considerations in the construction of DSM-5; 5) the issue of utility of the DSM - whether DSM-III and IV have been designed more for clinicians or researchers, and how this conflict should be dealt with in the new manual; and 6) the possibility and advisability, given all the problems with DSM-III and IV, of designing a different diagnostic system. Part I of this article took up the first two questions. Part II will take up the second two questions. Question 3 deals with the question as to whether DSM-V should assume a conservative or assertive posture in making changes from DSM-IV. That question in turn breaks down into discussion of diagnoses that depend on, and aim toward, empirical, scientific validation, and diagnoses that are more value-laden and less amenable to scientific validation. Question 4 takes up the role of pragmatic consideration in a psychiatric nosology, whether the purely empirical considerations need to be tempered by considerations of practical consequence. The six questions involve: 1) the nature of a mental disorder; 2) the definition of mental disorder; 3) the issue of whether, in the current state of psychiatric science, DSM-5 should assume a cautious, conservative posture or an assertive, transformative posture; 4) the role (...) of pragmatic considerations in the construction of DSM-5; 5) the issue of utility of the DSM - whether DSM-III and IV have been designed more for clinicians or researchers, and how this conflict should be dealt with in the new manual; and 6) the possibility and advisability, given all the problems with DSM-III and IV, of designing a different diagnostic system. Part I of this article will take up the first two questions. With the first question, invited commentators express a range of opinion regarding the nature of psychiatric disorders, loosely divided into a realist position that the diagnostic categories represent real diseases that we can accurately name and know with our perceptual abilities, a middle, nominalist position that psychiatric disorders do exist in the real world but that our diagnostic categories are constructs that may or may not accurately represent the disorders out there, and finally a purely constructivist position that the diagnostic categories are simply constructs with no evidence of psychiatric disorders in the real world. The second question again offers a range of opinion as to how we should define a mental or psychiatric disorder, including the possibility that we should not try to formulate a definition. American Catholic Philosophical Association President James Marsh is calling for a “Philosophy after Catonsville.” This paper begins by examining Catonsvilleas specifically American, Catholic, and philosophical. “Wildness” is then presented as it has emerged recently as a category in environmental philosophy andis shown to necessitate a social ecology for Catonsville. Finally, Marsh’s problematic relationship to ecology will be presented and resolved by discussing the necessary entailment of social ecology by his trilogy of Post-Cartesian Meditations, Critique, Action, and Liberation, and Process, (...) Praxis, and Transcendence. By the end of this paper, wildness will have established a crucial connection between Catonsville, Marsh’s “greened” critical theory, and social ecology as a necessary condition for the possibility of a “Philosophy after Catonsville.”. This analysis examines whistleblowing within the context of organizational culture. Several factors which have provided impetus for organizations to emphasize ethical conduct and to encourage internal, rather than external, whistleblowing are identified. Inadequate protection for whistleblowers and statutory enticement for them to report ethical violations externally are discussed. Sundstrand's successful model for cultural change and encouragement of internal whistleblowing is analyzed to show how their model of demonstrating management's commitment to ethical conduct, establishing ethical expectations of employees, training to ensure (...) that employees understand the concepts and expectations, promoting of employee ownership of the program, making the program visible, protecting the whistleblower and undertaking periodic reviews of the program's success may serve as a model for other organizations. Abstract Ecological communities around the world are under threat while a consensus theory of community structure remains elusive. In the last decade ecologists have struggled with two seemingly opposing theories: niche-based theory that explains diversity with species’ differences and the neutral theory of biodiversity that claims that much of the diversity we observe can be explained without explicitly invoking species’ differences. Although ecologists are increasingly attempting to reconcile these two theories, there is still much resistance against the neutral theory of (...) biodiversity. Here we argue that the dispute between the two theories is a classic example of the dichotomy between philosophical perspectives, realism and instrumentalism. Realism is associated with specific, small-scale and detailed explanations, whereas instrumentalism is linked to general, large-scale, but less precise accounts. Recognizing this will help ecologists get both niche-based and neutral theories in perspective as useful tools for understanding biodiversity patterns. In The New Constitutionalism , seven distinguished scholars develop an innovative perspective on the power of institutions to shape politics and political life. Believing that constitutionalism needs to go beyond the classical goal of limiting the arbitrary exercise of political power, the contributors argue that it should--and can--be designed to achieve economic efficiency, informed democratic control, and other valued political ends. More broadly, they believe that political and social theory needs to turn away from the negativism of critical theory to (...) consider how a good society should be "constituted" and to direct the work of designing institutions that can constitute a "good polity," in both the economic and civic senses. Charles Anderson, James Ceaser, and the editors then offer different interpretations of the central issues regarding institutional design in a constitutionalist social science, consider various ways of performing the task, and discuss the inadequacy of recent political science to the job it ought to be doing. Fourteen philosophers share their experience teaching Peirce to undergraduates in a variety of settings and a variety of courses. The latter include introductory philosophy courses as well as upper-level courses in American philosophy, philosophy of religion, logic, philosophy of science, medieval philosophy, semiotics, metaphysics, etc., and even an upper-level course devoted entirely to Peirce. The project originates in a session devoted to teaching Peirce held at the 2007 annual meeting of the Society for the Advancement of American Philosophy. In the conclusion to this multi-part article I first review the discussions carried out around the six essential questions in psychiatric diagnosis – the position taken by Allen Frances on each question, the commentaries on the respective question along with Frances’ responses to the commentaries, and my own view of the multiple discussions. In this review I emphasize that the core question is the first – what is the nature of psychiatric illness – and that in some manner all further (...) questions follow from the first. Following this review I attempt to move the discussion forward, addressing the first question from the perspectives of natural kind analysis and complexity analysis. This reflection leads toward a view of psychiatric disorders – and future nosologies – as far more complex and uncertain than we have imagined. (shrink)

In contrast to many of his contemporaries, A. J. Ayer was an analytic philosopher who had sustained throughout his career some interest in developments in the work of his ‘continental’ peers. Ayer, who spoke French, held friendships with some important Parisian intellectuals, such as Camus, Bataille, Wahl and Merleau-Ponty. This paper examines the circumstances of a meeting between Ayer, Merleau-Ponty, Wahl, Ambrosino and Bataille, which took place in 1951 at some Parisian bar. The question under discussion during this meeting was (...) whether the sun existed before humans did, over which the various philosophers disagreed. This disagreement is tangled with a variety of issues, such as Ayer’s critique of Heidegger and Sartre (inherited from Carnap), Ayer’s response to Merleau-Ponty’s critique of empiricism, and Bataille’s response to Sartre’s critique of his notion of ‘unknowing’, which uncannily resembles Ayer’s critique of Sartre. Amidst this tangle one finds Bataille’s statement that an ‘abyss’ separates English from French and German philosophy, the first recorded announcement of the analytic-continental divide in the twentieth century. H. L. A. Hart, in his classic book Law, Liberty, and Morality, is unsuccessful in arguing that James Fitzjames Stephen’s observations about the role of vice in criminal sentencing have no relevance to a more general defense of legal moralism. He does, however, have a very important insight about the special significance of sexual liberty.
James L. Anderson analyzed the conceptual novelty of Einstein's theory of gravity as its lack of ``absolute objects.'' Michael Friedman's related concept of absolute objects has been criticized by Roger Jones and Robert Geroch for implausibly admitting as absolute the timelike 4-velocity field of dust in cosmological models in Einstein's theory. Using Nathan Rosen's action principle, I complete Anna Maidens's argument that the Jones-Geroch problem is not solved by requiring that absolute objects not be varied. Recalling Anderson's proscription of (...) (globally) ``irrelevant'' variables that do no work (anywhere in any model), I generalize that proscription to locally irrelevant variables that do no work in some places in some models. This move vindicates Friedman's intuitions and removes the Jones-Geroch counterexample: some regions of some models of gravity with dust are dust-free, and there is no good reason to have a timelike dust 4-velocity vector there. Eliminating the irrelevant timelike vctors keeps the dust 4-velocity from counting as absolute by spoiling its neighborhood-by-neighborhood diffeomorphic equivalence to (1,0,0,0). A more fundamental Gerochian timelike vector field presents itself in gravity with spinors in the standard orthonormal tetrad formalism, though eliminating irrelevant fields might solve this problem as well. The Foundations of Pragmatism in American Thought Series offers two sets of volumes containing the most significant defenses and critiques of pragmatism written before World War I: the Early Defenders of Pragmatism and Early Critics of Pragmatism . This, the first collection, Early Defenders , provides key texts for understanding the context of pragmatism’s years of greatest vitality. The early defenders were products of pragmatism’s three cradles. H. Heath Bawden was a graduate of the Chicago philosophy department, having studied with (...) John Dewey and George Mead. John E. Boodin and Horace M. Kallen earned their Ph.Ds with William James and Josiah Royce at Harvard. D. L. Murray and Howard V. Knox were independent scholars and writers inspired by F. C. S. Schiller’s humanistic pragmatism at Oxford. This collection brings together the central texts of the movement along with a representative selection of the secondary texts, reviews and responses, they elicited. We share with Anderson & Lebiere (A&L) (and with Newell before them) the goal of developing a domain-general framework for modeling cognition, and we take seriously the issue of evaluation criteria. We advocate a more focused approach than the one reflected in Newell's criteria, based on analysis of failures as well as successes of models brought into close contact with experimental data. A&L attribute the shortcomings of our parallel-distributed processing framework to a failure to acknowledge a symbolic level of thought. (...) Our framework does acknowledge a symbolic level, contrary to their claim. What we deny is that the symbolic level is the level at which the principles of cognitive processing should be formulated. Models cast at a symbolic level are sometimes useful as high-level approximations of the underlying mechanisms of thought. The adequacy of this approximation will continue to increase as symbolic modelers continue to incorporate principles of parallel distributed processing. (shrink)
The concept of transliminality (''a hypothesized tendency for psychological material to cross thresholds into or out of consciousness'') was anticipated by William James (1902/1982), but it was only recently given an empirical definition by Thalbourne in terms of a 29-item Transliminality Scale. This article presents the 17-item Revised Transliminality Scale (or RTS) that corrects age and gender biases, is unidimensional by a Rasch criterion, and has a reliability of .82. The scale defines a probabilistic hierarchy of items that address (...) magical ideation, mystical experience, absorption, hyperaesthesia, manic experience, dream interpretation, and fantasy proneness. These findings validate the suggestions by James and Thalbourne that some mental phenomena share a common underlying dimension with selected sensory experiences (such being overwhelmed by smells, bright lights, sights, and sounds). Low scores on transliminality remain correlated with ''tough mindedness'' in on Cattell 16PF test, as well as ''self-control'' and ''rule consciousness,'' whereas high scores are associated with ''abstractedness'' and an ''openness to change'' on that test. An independent validation study confirmed the predictions implied by our definition of transliminality. Implications for test construction are discussed. (shrink)
Thus far in the development of the discipline of medical ethics, the overriding concern has been with solutions to specific problems. But discussion is hampered by lack of understanding of the scope and methodology of medical ethics, and its scientific and philosophical basis. In Underpinnings of Medical Ethics Edmond A. Murphy, James J. Butzow, and Edward L. Suarez-Murias offer much-needed clarification of the purview, ontological basis, and methodology of a medical ethics that is to be comprehensive and yet readily (...) accepted by all. The authors begin by describing the scope of the analysis and discussing possible ethical systems and paradigms. They then deal with the structures and concepts necessary in the formulation of a coherent philosophy: normality and disease, scientific and juridical law, certainty and certitude, decisions. Finally, they introduce particular human dimensions, such as quality of life, pain, and responsibility. Throughout, case examples illustrate the authors' theoretical framework. (shrink)
James Madison is the thinker most responsible for laying the groundwork of the American commercial republic. But he did not anticipate that the propertied class on which he relied would become extraordinarily politically powerful at the same time as its interests narrowed. This and other flaws, argues Stephen L. Elkin, have undermined the delicately balanced system he constructed. In Reconstructing the Commercial Republic , Elkin critiques the Madisonian system, revealing which of its aspects have withstood the test of time (...) and which have not. The deficiencies Elkin points out provide the starting point for his own constitutional theory of the republic—a theory that, unlike Madison’s, lays out a substantive conception of the public interest that emphasizes the power of institutions to shape our political, economic, and civic lives. Elkin argues that his theory should guide us toward building a commercial republic that is rooted in a politics of the public interest and the self-interest of the middle class. He then recommends specific reforms to create this kind of republic, asserting that Americans today can still have the lives a commercial republic is intended to promote: lives with real opportunities for economic prosperity, republican political self-government, and individual liberty. James Griffin asks how, and how much, we can improve our ethical standards not lift our behaviour closer to our standards but refine the standards themselves. To give an answer to this question it is necessary to answer most of the questions of ethics. So Value Judgement includes discussion of what a good life is like, where the boundaries of the `natural world' come, how values relate to that world, how great human capacitiesthe ones important to ethicsare, and where (...) moral norms come from. -/- Throughout the book the question of what philosophy can contribute to ethics repeatedly arises. Philosophical traditions, such as most forms of utilitarianism and deontology and virtue ethics, are, Griffin contends, too ambitious. Ethics cannot be what philosophers in those traditions expect it to be because agents cannot be what their philosophies need them to be. -/- This clear, compelling, and original account of ethics will be of interest to anyone concerned with thinking about values: not only philosophers but legal, political, and economic theorists as well. Une invitation, reçue au début de l’automne 2011, à intervenir dans la séance du 7 mars 2012 d’un séminaire tenu à l’EHESS sur l’islamophobie, a été l’occasion de traiter de « l’affaire Gouguenheim » plus de trois ans après son irruption dans la sphère médiatique. Cette nouvelle lecture d’Aristote au Mont Saint-Michel a permis de mettre en évidence l’importance que Sylvain Gouguenheim attribue à un texte du haut Moyen Age pour suivre la diffusion de l’hellénisme dans l’Europe latine. Il s’agit (...) d’une lettre adressée par le pape Paul 1er à Pépin le Bref. Ce document, le plus souvent négligé par les latinistes en raison de ses obscurités, a excité la sagacité des hellénistes, qui ont très majoritairement montré la difficulté d’en tirer des informations positives. La situation est singulière, si l’on se souvient que, pour l’essentiel, ce sont des latinistes et des arabisants qui ont mené la charge contre les impostures gouguenheimiennes. À la faveur de ce cas d’espèce, « l’affaire Gouguenheim » jette une lumière crue sur la place dérisoire que, pour des raisons historiques, l’enseignement supérieur accorde en France à la philosophie médiévale. Le scandale repose, certes, sur les manipulations d’un agrégé d’histoire ; mais il dévoile aussi l’une des lacunes de l’institution universitaire hexagonale dans l’enseignement de la philosophie médiévale. Après avoir dégagé quelques incarnations du rationalisme dont Bouveresse se démarque, j’indique quelques aspects qui ancrent son œuvre dans la tradition de l’Aufklärung (mais en la renouvelant), avant d’insister sur ce qui me semble plus distinctif de ce rationalisme dans lequel parviennent miraculeusement à cohabiter des sources philosophiques, littéraires et scientifiques : Cournot, Vuillemin, Carnap, Peirce, Wittgenstein, Russell, Frege, Sellars, Bolzano, Boltzmann ou Helmholtz, mais aussi Descartes, Kant, Schopenhauer, Fichte, Husserl, Cavaillès, Canguilhem, les pragmatistes James, Putnam, ou encore des (...) écrivains comme Valéry, T.S. Eliot, et, plus que tout peut-être, Lichtenberg, Kraus et Musil. Puis je me concentre particulièrement sur l’examen de ce rationalisme à l’aune des liens de Bouveresse avec la tradition « analytique », et avec Wittgenstein en particulier. (shrink)
Metaethics is a perennially popular subject, but one that can be challenging to study and teach. As it consists in an array of questions about ethics, it is really a mix of (at least) applied metaphysics, epistemology, philosophy of language, and mind. The seminal texts therefore arise out of, and often assume competence with, a variety of different literatures. It can be taught thematically, but this sample syllabus offers a dialectical approach, focused on metaphysical debate over moral realism, which spans (...) the century of debate launched and framed by G. E. Moore's Principia Ethica. The territory and literature are, however, vast. So, this syllabus is highly selective. A thorough metaethics course might also include more topical examination of moral supervenience, moral motivation, moral epistemology, and the rational authority of morality. Authors Recommend: Alexander Miller, An Introduction to Contemporary Metaethics (Cambridge: Polity Press, 2003). This is one of the few clear, accessible, and comprehensive surveys of the subject, written by someone sympathetic with moral naturalism. David Brink, Moral Realism and the Foundations of Ethics (Cambridge: Cambridge University Press, 1989). Brink rehabilitates naturalism about moral facts by employing a causal semantics and natural kinds model of moral thought and discourse. Michael Smith, The Moral Problem (Oxford: Blackwell, 1994). Smith's book frames the debate as driven by a tension between the objectivity of morality and its practical role, offering a solution in terms of a response-dependent account of practical rationality. Gilbert Harman and Judith Jarvis Thomson, Moral Relativism & Moral Objectivity (Cambridge, MA: Blackwell, 1996). Harman argues against the objectivity of moral value, while Thomson defends it. Each then responds to the other. Frank Jackson, From Metaphysics to Ethics (Oxford: Clarendon Press, 1998). Jackson argues that reductive conceptual analysis is possible in ethics, offering a unique naturalistic account of moral properties and facts. Mark Timmons, Morality without Foundations (Oxford: Oxford University Press, 1999). Timmons distinguishes moral cognitivism from moral realism, interpreting moral judgments as beliefs that have cognitive content but do not describe moral reality. He also provides a particularly illuminating discussion of nonanalytic naturalism. Philippa Foot, Natural Goodness (New York, NY: Oxford University Press, 2001). In James Gouinlock's essay "Dewey's Theory of Moral Deliberation," he argues that Morton White and Charles L. Stevenson's criticisms of John Dewey's ethical theory are based upon fundamental misinterpretations of Dewey's theory of moral deliberation. In this paper, I attempt, in the spirit of Gouinlock's 1978 essay, to widen and enrich the discussion of Dewey's theory of moral deliberation by relating it to a claim of political philosophers and theorists that is recently in vogue, namely, that Dewey's writings contain (...) a nascent theory of deliberative democracy. Deliberative democratic theorists contend that deliberation is the group activity that transforms individual preferences and behavior into mutual understanding, agreement and collective action. If Deweyan democracy is identified with deliberative democracy, do Dewey scholars risk making Dewey's democratic vision a useless relic for theorizing about democracy in the wake of the deliberative turn? The paper is organized into four sections. In the first, I summarize the positions of those scholars defending the view that John Dewey was a proto-deliberative democrat, in effect anticipating the deliberative turn in democratic theory. The second section examines Gouinlock's thesis that despite White and Stevenson's mistaken accounts, Dewey offered a distinctive and insightful way of understanding moral judgment. In the third section, my analysis reveals the political dimension of Dewey's theory of moral deliberation. The fourth and concluding section explores the lesson that my analysis might impart to commentators enamored with the idea that Dewey's vision of democracy is essentially deliberative. (shrink)
Pragmata: Festschrift für Klaus Oehler Chiefly in German, this handsomely produced volume, occasioned by the 80th birthday of Hamburg philosopher Klaus Oehler, assembles 31 papers, divided among 4 sections, successively devoted to ancient philosophy, semiotics, pragmatism and topics in modernity. One of the papers appears in French, “La philosophie de la musique dans l’ancien stoicisme,” by Evanghelos Moutsopoulos of the University of Athens. The book also contains 5 papers in English, concentrated in the sections on semiotics and pragmatism, including authors (...) familiar in these pages, such as Richard Robin “Charles Sanders Peirce Then and Now,” and Sandra Rosenthal writing on Peirce’s “neglected argument.” Several of the authors writing in German are also familiar to readers of these pages, including Helmut Pape, Hans Joas and Ludwig Nagl. The book is filled out with a short preface by the editors, a catalogue of the writings of Klaus Oehler from 1989 to 2008 (including mention of recent attention to William James), a comprehensive index of names and information on the contributing authors. The overall design of the book gives the impression of Peircean semiotics and pragmatism mediating between the ancients and modern problems.<br> The editors note some of Oehler’s honors: He received an honorary doctorate from the University of Athens (1993), was the first German President of the C.S. Peirce Society (1982) and in 1998 was awarded the International Prize of the Antonio Iannone Foundation in Rome. The title “Pragmata” is understood to stand for thought’s needed reference to facts and reality, and it expresses concern with relevance (Sachbezug). It is indicative of Oehler’s rejection of “all idealistic speculation,” and his “radical critique of idealism and utopian thinking” (Hingst and Liatsi, p. 9). One may sense Peirce-inspired echoes of the nineteenth century, neo-Kantian flight from Hegel: “Zu der Sache.”<br>. (shrink)

This article examines the three works of Jeremy Bentham on capital punishment dating Irom 1775, 1809, and 1831. Besides Hugo Bedau’s analysis of Bentham’s 1775 and 1831 works and James Crimmins’s assessment of Bentham’s 1809 work, little attention has been paid to his abolitionist arguments on this contentious issue. I review some of the developments in Bentham’s position, noting where the later work corrects some deficiencies in the earlier work, and I assess the cogency of the position as it (...) evolves. I concentrate on deterrence and irremissibility, though I also comment on his discussion of popularity in his 1831 address and his 1775 essay.Cet article se penche sur les trois textes qu’a écrits Jeremy Bentham sur la peine capitale (ils datent de 1775, 1809 et 1831). Hormis l’analyse qu’a faite Hugo Bedau des textes de 1775 et 1831 et la prise en compte, par Benjamin Crimmins, de celui de 1809, la position abolitionniste de Bentham sur cette question controversée ne s’est méritée que très peu d’attention de la part des spécialistes. Je passe en revue le développement de quelques-unes des argumentations de Bentham, en soulignant sur quels points les ouvrages publiés plus tard corrigent certains délauts de ceux publiés auparavant, et j’évalue la cohérence de son argumentation dans le cadre de cette évolution. Je concentre mon attention sur les notions de dissuasion et d’irrémissibilité, tout en commentant le traitement qu’il fait de la question de lapopularité dans son discours de 1831 et dans son texte de 1775. Partendo dall’analisi critica di Rawls e Habermas, James Bohman offre una risposta innovativa alla questione dell’accordo democratico. In tale proposta, parallelamente al rigetto di soluzioni meramente strategiche, viene riabilitata la nozione di compromesso morale nel quadro di un accordo normativo. Mantenendo fede ad una prospettiva composta da elementi normativi e fattuali, l’autore si propone di ampliare le opportunità democratiche nella riconciliazione tra conflitti (...) culturali profondi propri delle società contemporanee. L’elemento civico partecipativo risulta essere dunque una componente essenziale per la produzione di una sfera pubblica vibrante. Ne emerge una ricostruzione convincente volta non solo a respingere le critiche degli scettici sulle reali possibilità d’inclusività democratica, ma diretta soprattutto a suggerire un più efficace modello deliberativo per la garanzia della stabilità sociale. Questo testo è diventato ormai un riferimento internazionale classico nella discussione sul tema della deliberazione pubblica. L’autore ha inoltre sviluppato in ambito post-nazionale il suo modello deliberativo senza tuttavia ridiscutere i fondamenti concettuali della sua proposta teorica qui enunciati.Vista la rilevanza del tema e considerata la centralità del testo proposto, sembrerebbe dunque auspicabile rendere il testo disponibile anche al lettore italiano. Pragmatism is a philosophical movement developed near the turn of the century in the of several prominent American philosophers, most notably, Charles Sanders Peirce, William James, and John Dewey. Although many contemporary analytic philosophers never studied American Philosophy in graduate schoo l, analytic philosophy has been significantly shaped by philosophers strongly influenced by that tradition, most especially W. V. Quine, Donald Davidson, Hilary Putnam, and Richard Rorty. Like other philosophical movements, it developed in response to the then-dominant philosophical wisdom. (...) What unified pragmatism was its rejection of certain epistemological assumptions about the nature of truth, objectivity, and rationality. The rejection of these assumptions springs from the pragmatist's belief that practice is primary in philosophy. Meaningful inquiry originates in practice. Theorizing is valuable, for sure, but its value arises practice, is informed by practice, and, its proper aim is to clarify, coordinate, and inform practice. Theorizing divorced practice is useless. Pragmatism is at once both familiar and radical. Familiar in that it often begins with rather ordinary views; radical in that it often sees in those views insights that philosophers and lay people miss or misunderstand. A pragmatic ethic employs criteria without being criterial. It is objective without being absolutist. It acknowledges that ethical judgements are relative, without being relativistic. And it tolerates - indeed, welcomes some moral differences, without being irresolute. Precisely what each of these means, and why pragmatists hold them, emerges throughout this paper. I begin with the first since it sets the stage for introducing other pivotal pragmatic ideas. Ethical theorizing begins when we think about how we ought to live. Many people assume that means we must look for moral criteria: some list of rules or principles whereby we can distinguish good from bad and right wrong, or a list of virtues we try to inculcate.. Building from J.L. Austin's concept of âperformative,â this essay explores the production of subjectivity and of educational subjects by applying important work from Judith Butler on Foucault, Derrida, and as centrally illustrative, through an analysis of sex and gender. Given this analytical framework, the turn is then to queer performativity and the possibility of performative power in pedagogy. The last draws assistance from Valerie Walkerdine, Homi Bhabha and especially James Donald.
