Pragmatist reinterpretations of both deliberative-communicative theory and legal positivism point out the mentalist fallacy entailed by these prevalent models. I argue that pragmatist approaches imply analogous erroneous beliefs since they presuppose as given the shared perception of social contexts. Therefore they take for granted the shared interpretation of social problems and shared selection of common goals. Hence I advance the necessity of inquiring into the possibility conditions for a shared perception of social contexts. This would entail the organization of institutional (...) incentives meant to extend the scope and inclusiveness of the immediate perception of social context expressed by different agents. (shrink)
This article analyzes the evolution of the land ethic re-presented by J. Baird Callicott over the last two decades under pressure from the charge of misanthropy and ecofascism. It also traces the development of Callicott?s own ethical system, and examines its most current phase both in itself and in relation to his other theoretical commitments, including his particular version of moral monism, and his communitarian critique of egalitarianism. It concludes that Callicott?s communitarianism is by itself insufficient to fund an adequate (...) environmental ethic, and that for the sake of self-consistency he should either discard his moral monism or else further revise his ethical system. Clinical trials of stem cell transplantation raise ethical issues that are intertwined with scientific and design issues, including choice of control group and intervention, background interventions, endpoints, and selection of subjects. We recommend that the review and IRB oversight of stem cell clinical trials should be strengthened. Scientific and ethics review should be integrated in order to better assess risks and potential benefits. Informed consent should be enhanced by assuring that participants comprehend key aspects of the trial. The paper advances a Humean metaethical analysis of "intrinsic value" - a notion fundamental in moral philosophy in general and particularly so in environmental ethics. The analysis reduces an object's moral properties (e.g., its value) to the empirical relations between the object's natural properties and people's psychological dispositions to respond to them. Moral properties turn out to be both objective and subjective, but in ways compatible with, and complementary to, each other. Next, the paper investigates whether the Humean analysis can (...) support non-anthropocentric environmental ethical theories, which attribute intrinsic value to nonhuman natural entities. It argues that one of the most useful resources from Hume for non-anthropocentrism is his account of justice as an artificial virtue, which is a plausible model for the internalization of various environmentally friendly conventions and the creation of environmental values. Finally, the paper concludes that any Humean account of intrinsic value is empiricist all the way down. Moral questions about what things are intrinsically valuable, and to what extent they are so, are ultimately empirical questions about complex psychological capacities and dispositions of human beings, which cannot be single-handedly answered by philosophers a priori; and that ethics is more appropriately seen as an interdisciplinary investigation, requiring collaboration among the various psychological and social sciences, human biological and neurological sciences, and history and philosophy. I discuss the alleged assimilation of restored natural entities to artifacts, and argue that it does not follow from the ontological differences, if any, between the artifactual and the natural that the former is morally inferior to the latter. This defense against the (...) devaluation of restored natural entities is aimed at narrowing the ethical gap between the wild and thetamed, which is often endorsed by ecocentric environmental ethics. The idea of “just war” is not alien to Chinese thought. The term “yi zhan” (usually translated as “just war” or “righteous war” in English) is used in Mencius, was renewed by Mao Zedong, and is still being used in China today (zhengyi zhanzheng). The best place to start exploring this Chinese idea is in the enormous Art of War corpus in premodern China, of which the Seven Military Classics is the best representative. This set of treatises served as the (...) military bible in imperial China from 1078 CE. Ideas analogous to ius ad bellum and ius in bello can be found in these texts. These norms are present in these military texts, elaborated in subsequent commentaries, understood as a matter of fact in Chinese political history, and recently and briefly acknowledged by a few Chinese military scholars in the mainland and in Taiwan. This Chinese just war ethics has its distinctiveness vis-à-vis James Turner Johnson's articulation of the Western classic view. It differs from Johnson's claims that military lethal violence is intrinsically morally neutral and that last resort is not a primary consideration in deciding for war. Contemporary Chinese People's Liberation Army (PLA) military publications show that the PLA understands the general idea of just war, but they acknowledge only the ad bellum part, not the in bello components. There is widespread agreement that the significant threat of terrorist activity and the importance we attach to safety and security demands that terrorists and terrorist activity be stifled as quickly and effectively as possible. However, much dominant thought about the very nature or approach taken to anti-terrorism legislation has gone without critical reflection. Drawing on a recent article by contemporary political philosopher Ronald Dworkin, in this paper I shall examine whether the metaphor of a balance, with safety or security pitted (...) against individual rights or civil liberties, is an appropriate way to understand or approach anti-terrorism legislation. To simplify matters, I shall depart from close consideration of Canada's new anti-terrorism legislation (in particular the new power of preventive arrest which it creates), with the observation that it is reflective of many other countries' legislative response to terrorism. Abstract Contemporary English and Chinese scholars alike have interpreted Sunzi's Art of War as advocating amoralism in warfare. That charge has a long history in pre-modern China and has not been fully refuted. This essay argues that the alleged amoral Machiavellianism is more appropriate for ancient Qin military thought than for Sunzi. The third chapter of Sunzi's treatise contains a distinctive moral perspective that cannot be found in the military thought of the state of Qin, which succeeded in defeating all (...) other states in the Period of the Warring States. Such a moral perspective contains both ad bellum and in bello norms. I submit that my interpretation of Sunzi's warfare ethics can provide an important resource for the People's Liberation Army of China to construct full-scale just war ethics that is similar to Western understandings. Le argomentazioni presentate in questo testo costituiscono le conclusioni ultime e definitive di un lavoro di ricerca, che ha investito l’insieme dei "Dialoghi Italiani", riuscendo a reperire ed a far emergere quello che pare il nucleo più profondo ed importante – il vero e proprio elevato fondamento – della speculazione bruniana: la presenza attiva di un concetto triadico teologico-politico – il "Padre", il "Figlio" e lo "Spirito" della tradizione trinitaria cristiana – però riformulato attraverso il capovolgimento rivoluzionario di questa stessa (...) tradizione, attuato attraverso il concetto creativo e dialettico dell’infinito. In questo modo la stessa tradizione platonica pare subire una trasformazione essenziale, abbandonando qualunque forma di alienazione e negazione, per riaprirsi invece verso soluzioni che paiono riprendere moniti ed osservazioni suscitati dalle prime, grandi e maestose, speculazioni dei filosofi presocratici. Talete, Anassimandro, Anassimene, Parmenide, Eraclito ed Empedocle sembrano rivivere nei testi bruniani, riproponendo una soluzione ben diversa a quei nodi e problemi teoretico-pratici – fondamentale il rapporto Uno-molti e tutto ciò che da esso consegue, sia sul piano naturale che politico – apparentemente risolti e codificati dal pensiero postsocratico, prima platonico e poi aristotelico. L’inscindibilità del principio di libertà (la figura teologica del "Padre") ed eguaglianza (il "Figlio"), attraverso il richiamo alla fonte amorosa infinita ed universale (lo "Spirito"), consente alla riflessione bruniana di presentare per la prima volta nel panorama filosofico mondiale di tutti i tempi la possibilità di salvaguardare sia l’aspetto creativo naturale, che la diversità politica, presentando nel contempo un concetto di ragione capace di esprimere un movimento infinito sempre aperto ed attento alla molteplicità. In questa liberazione della potenza e della volontà dalle strettoie ordinate e gerarchiche della tradizione il pensiero e la riflessione di Giordano Bruno danno inizio alla modernità, ripresentandosi quale mirabile soluzione ogni qual volta potere e violenza paiono assestarsi e reciprocamente incrementarsi, in un circolo apparentemente indistruttibile. Allora i capitoli di questo libro – attraverso l’analisi di concetti importanti nella filosofia bruniana, quali quelli del desiderio e dell’immaginazione, della materia e della ragione – riattraversano la storia della definizione filosofica delle entità reali più importanti – Dio, Natura, Ragione, Uno – per mostrare un’opposizione fondamentale: l’opposizione fra la fusione speculativa apportata dal pensiero neoplatonico-aristotelico (antico, moderno e contemporaneo), attenta alla difesa della necessità ordinata di un mondo unico, e la liberazione speculativo-pratica bruniana, attenta a far rivivere la coscienza dell’infinito, in noi e fuori di noi. In this essay, I focus on Recanati's treatment of 'What is said' in his book Literal Meaning. I discuss Recanati's conception of Minimalism, his views on propositional completeness, and his understanding of the processes governing the semantic interpretation of meaning-controlled contextuality. In the final sections, I draw some conclusions pertaining to Recanati's assessment of the interface between pragmatic and semantic processes. /// En este ensayo me enfoco en el trato que le da Recanati a "lo que se dice" en su (...) libro Literal Meaning. La tesis principal de este ensayo estipula que el determinismo causal es una propiedad de la naturaleza y el primer principio de la inteligibilidad natural. Se expresa, por ejemplo, en la frase de Lucrecio: “Nada surge de la nada ni va hacia la nada”. Todo lo que existe es efecto de una red de causas y es a su vez causa de otras cosas. Se sigue que la teoría científica orientada hacia la inteligibilidad —diferente de la ciencia positi-vista y pragmática— (...) es la búsqueda de determinismo causal. El desarrollo de esta tesis utiliza como hilo conductor el pensamiento de René Thom. Esto significa que el determinismo causal se examina en su rela-ción con (I) la estabilidad y la inestabilidad, (II) el desafío de la mecánica cuántica, (III) las raíces aporéticas de la ciencia tal como la dualidad determinismo-indeterminismo, y finalmente (IV) en su relación con el método para ponerlo de manifiesto, es decir la reducción de lo posible —estrategia que es, en este dominio, una de las ideas más originales de Thom.The main thesis of this essay is that causal determinism is a property of nature and the main principle of natural intelligibility. It can be expressed in Lucretius’ words: “Nothing comes out of nothing or passes into nothing”. Everything is the effect of a web of causes and is, in its turn, cause of something else. It follows that the essence of an intelligibility-oriented scientific theory —which is different from science in a positivist or pragmatist sense— is the search for causal determinism. The development of this thesis is guided by René Thom’s thought. This means that causal determinism is analysed, first, in its relation to stability and instability; second, in its relation to the prima facie indeterminism of quantum mechanics; third, in its relation to the aporetic roots of science such as the duality determinism —indeterminism, and, finally, in its relation to the method which allows science to follow the causal determinist ideal: the reduction of the possible— a strategy which is, in this field, one of Thom’s most original ideas. En el presente artículo examino algunas propuestas recientes que pretenden caracterizar una noción de lo innato coherente y teóricamente útil usando conceptos e ideas de la biología del desarrollo o de la biología evolucionista (o ambas), y argumento que la mayoría de elIas o bien padecen serios problemas conceptuales, o bien no pueden capturar de maneras biológicamente interesantes algunas de las connotaciones más importantes asociadas al termino ‘innato’ tal y como se usa en algunas disciplinas cognitivas de corte evolucionista. Asimismo, (...) defiendo mi propia propuesta mostrando que no tiene los problemas que aquejan a las otras propuestas, y sí muchas de sus ventajas.Here l examine some recent proposals to characterize a notion of innateness having some theoretical usefulness and using some concepts and ideas from either developmental biology or evolutionary biology (or both), and argue that most of them either have serious conceptual problems, or else fail to capture in biologically interesting ways some of the important connotations associated to the term ‘innate’ as it is used in some cognitive disciplines of an evolutionary sort. Ao conceber a interpretaçáo como singular, evidencia-se a historicidade do contexto e a personalidade do pensante. Iniciaremos com algumas considerações acerca da estética, em seguida, trataremos da forma como execuçáo e o formar como experimento. In his paper "Finitism" (1981), W.W. Tait maintains that the chief difficulty for everyone who wishes to understand Hilbert's conception of finitist mathematics is this: to specify the sense of the provability of general statements about the natural numbers without presupposing infinite totalities. Tait further argues that all finitist reasoning is essentially primitive recursive. In this paper, we attempt to show that his thesis "The finitist functions are precisely the primitive recursive functions" is disputable and that another, likewise defended by (...) him, is untenable. The second thesis is that the finitist theorems are precisely the universal closures of the equations that can be proved in PRA. /// En su articulo "Finitism" (1981), W.W. Alcuni commentatori della filosofia di Smith hanno osservato che la relazione tra la sua teoria morale e le sue credenze teologiche è “estremamente difficile da districare”1 . Una ragione ovvia di questo sta nel fatto che in nessuna delle opere di Smith troviamo una qualche discussione dettagliata di questioni teologiche sia di natura metafisica che morale. Non è perciò possibile usare altri scritti di Smith come strumento per chiarire le sue concezioni nella Theory of Moral Sentiments 2a proposito della relazione (...) tra etica e religione 3. Al di là di questo, i dati biografici sulla vita di Smith e i suoi atteggiamenti e pratiche religiose non risolvono tale questione in un senso o nell’altro. Le evidenze disponibili, come generalmente presentate , suggeriscono che sebbene Smith non era completamente ortodosso secondo i criteri dei contemporanei , non ha manifestato però orientamenti e impegni che fossero evidentemente o significativamente irreligiosi.
