The growth of European colonial empires occurred during a period of intense international conflict. This article examines how the international position of colonial states altered the distribution of wealth within indigenous societies. Colonial administrators favored precolonial elites only if they were militarily and financially secure, a pattern that stems from balancing the advantages of working with these groups against their higher probability of revolt. This theory is tested using data on the wealth of Indian caste groups. In areas annexed at (...) times of European war, precolonial elites are poorer than other groups, whereas they remain richer in areas annexed at other times and in indirectly ruled areas. These results appear not to stem from preexisting differences between regions. The results highlight the variable impact of colonialism within societies, and the importance of the international system in shaping colonial and postcolonial outcomes. (shrink)

This article, drawing on Marsilius of Padua's Defensor Pacis, discusses Marsilius's theory of dominium, situating that theory within the context of the debate with Pope John XXII and William of Ockham. The author also reintroduces the long unsettled question of the extent of Marsilius's legal knowledge and training. The article closes by calling for a more sustained investigation of Marsilius's knowledge of Roman law, and of his relation to the poverty controversy and especially Ockham.

In this paper we introduce the 'New Substitution Problem' which, on its face, presents a problem for adaptation proposals that are justified by appeal to obligations of reparation. In contrast to the standard view, which is that obligations of reparation require that one restore lost value, we propose instead that obligations to aid and assist species and ecosystems in adaptation, in particular, follow from a failure to adequately justify - either by absence, neglect, omission or malice - actions that caused, (...) or coalesced to cause, climatic change. Because this position suggests a different reason for reparation - namely, it does not rely on the notion that an obligation to repair is contingent upon a lost good - it permits moving forward with assisted colonisation and migration, but does so without falling subject to the complications of the New Substitution Problem. ABSTRACT Some fear the Anthropocene heralds the end of nature, while others argue that nature will persist throughout the Anthropocene. Still others worry that acknowledging the Anthropocene grants humanity broad license to further inject itself into nature. We propose that this debate rests on a conflation between naturalness and wildness. Where naturalness is best understood as fundamentally a metaphysical category, wildness can be better understood as an inter-relational category. The raccoons in cities, the deer in suburban yards, the coyotes hunting (...) cats and dogs: these all return wildness, where naturalness may have been lost. (shrink)

U.S. conservation policy, both in structure and in practice, places a heavy burden on conservationists to halt development projects, rather than on advocates of development to defend their proposed actions. In this paper, we identify this structural phenomenon in several landmark environmental policies and in practice in the contemporary debate concerning oil drilling in the Arctic National Wildlife Refuge. The burdens placed on conservation can be understood in terms of constraints—as conservation ‘floors’ and degradation ‘ceilings’. At base, these floors and (...) ceilings emerge out of underlying consequentialist commitments that assume that our environmental activity can be justified by appeal primarily to ends. A series of intuition pumps guides our argument to instead shift the conservation discourse away from these consequentialist commitments to more widely justify activities on our public lands. For more than a century, scholars have believed that Italian humanism was predominantly civic in outlook. Often serving in communal government, fourteenth-century humanists like Albertino Mussato and Coluccio Saltuati are said to have derived from their reading of the Latin classics a rhetoric of republican liberty that was opposed to the "tyranny" of neighbouring signori and of the German emperors. In this ground-breaking study, Alexander Lee challenges this long-held belief. From the death of Frederick II in 1250 to the failure (...) of Rupert of the Palatinate's ill-fated expedition in 1402, Lee argues, the humanists nurtured a consistent and powerful affection for the Holy Roman Empire. Though this was articulated in a variety of different ways, it was nevertheless driven more by political conviction than by cultural concerns. Surrounded by endless conflict--both within and between city-states--the humanists eagerly embraced the Empire as the surest guarantee of peace and liberty, and lost no opportunity to invoke its protection. Indeed, as Lee shows, the most ardent appeals to imperial authority were made not by "signorial" humanists, but by humanists in the service of communal regimes. The first comprehensive, synoptic study of humanistic ideas of Empire in the period c.1250-1402, this volume offers a radically new interpretation of fourteenth-century political thought, and raises wide-ranging questions about the foundations of modern constitutional ideas.
