  7. Anthony Ellis (2003). A Deterrence Theory of Punishment. Philosophical Quarterly 53 (212):337–351.score: 120.0
I start from the presupposition that the use of force against another is justified only in self-defence or in defence of others against aggression. If so, the main work of justifying punishment must rely on its deterrent effect, since most punishments have no other significant self-defensive effect. It has often been objected to the deterrent justification of punishment that it commits us to using offenders unacceptably, and that it is unable to deliver acceptable limits on punishment. I describe a sort (...)

Do minority groups have a right to the preservation of their language? I argue that the rights of groups are always reducible to the rights of individuals. In that case, the question whether minorities have a right to the preservation of their language is a question of whether individuals have a right to it. I argue that, in the only relevant sense of ‘right’, they do not. They may have an interest in the preservation of their language, but, if so, (...)

This paper argues that there is a default presumption that punishment has some deterrent effect, and that the burden of proof is upon those who allege that the costs of any particular penal system are insufficient to offset its deterrent benefits. This burden of proof transmits to the discussion of international law, with the conclusion that it is those who oppose international jurisdiction, rather than their opponents, who must prove their position. This they have so far failed to do.

In the political arena, lesbian and gay issues have been contested typically on grounds of human rights, but with variable success. Using a moral developmental framework, the purpose of this study was to explore preferences for different types of moral arguments when thinking about moral dilemmas around lesbian and gay issues. The analysis presented here comprised data collected from 545 students at UK universities who completed a questionnaire, part of which comprised a moral dilemma task. Findings of the study showed (...)

Sprague has objected that under such a system, those who carry out punishments will be unable to justify their actions. I reply that if it (...)

In an essay in these pages, Jeffrey Friedman charged that Cultural Theory obscures the unity and uniqueness of modern egalitarian individualism; reduces culture to society; ignores history; is only applicable to contemporary, Western politics; provides an unsatisfactory account of preference formation and preference change; and leaves no place for the vitally important debate over what we should prefer. Although some of Friedman's criticisms stem from a misreading or strained reading of Cultural Theory, others raise vitally important questions not only about (...)

Portmann gathers an on-target collection of great writers on transgressions large and small. Read about defenses for promiscuity, greed, deceit, gossip, lust, breaking the golden rule, and more--and use this unusual guide to decide for yourself if sin has a place in our contemporary, and virtually unshockable, society. Twentieth century philosophy and psychology have been peculiarly averse to mental images. Throughout nearly two and a half millennia of philosophical wrangling, from Aristotle to Hume to Bergson, images (perceptual and quasi-perceptual experiences), sometimes under the alias of "ideas", were almost universally considered to be both the prime contents of consciousness, and the vehicles of cognition. The founding fathers of experimental psychology saw no reason to dissent from this view, it was commonsensical, and true to the lived experience of conscious (...)
