The thought of the ancient atomists about the activity of the soul in the body is an important chapter in the history of reflection on the soul in ancient philosophy. A review of testimonies and fragments attributed to Democritus of Abdera shows its singular conception of the soul as a complex network of transactions through which it exercises, inside compound bodies, its role in driving principle of beings animated. These texts show the tension and dynamism that characterize the activity of (...) the soul and especially the close relationship between the activities of perceiving and thinking, essential activities to the economy of living beings, now for what is the management of biological life, now in terms of knowledge and human action. What we propose here is to examine how Democritus conceived the activity of the soul in its complexity and the various operations through which it accomplishes its function in the animation and the maintenance of life of animate beings, and particularly of human life. To do this, we will take as a basis the testimonies referred to the nature of the soul – especially the testimony of Aristotle and his disciples and commentators – and then examine the activities through which proceeds its role of motor principle, namely the sensations and the intellection. And, finally, we intend to demonstrate that these operations should not be considered, in the context of atomist thought, as two independent and opposed faculties or activities, but as two different levels or degree, contiguous and complementary, of one and the same activity. This book collects texts from three specialists in ancient philosophy which deal with the question of perceptive and intellective knowledge in antiquity. They try to present, in their different analyzes, the complex interrelationship among perception and thought in ancient authors, like Heraclitus, Parmenides, Democritus, Plato and Aristotle. The purpose of the texts is to expose the visible field - the perceptual knowledge domain - interacts with the invisible - the domain of reason and thought. « La mesure est le plus grand des biens » et « rien de trop » apparaissent dans les sentences attribuées aux Sept Sages de l’Antiquité Grecque. Elles font état d’une sagesse qui blâme l’excès et invite à la modération. Les échos de ces propos résonnent dans différentes périodes de l’Antiquité et chez des auteurs appartenant aux traditions les plus variées, parmi lesquels se trouve notamment Démocrite. Nombreux sont en effet les fragments qui attestent de sa condamnation des excès, de (...) sa réflexion critique sur les richesses et de son éloge de la modération et de l’équilibre entendus comme conditions du bien-être et de l’action bonne. « La juste proportion est belle en toutes choses » (DK 68 B 102), proclame le philosophe. Cette juste proportion est érigée en condition pour atteindre la « bonne humeur » ( euthymiê ) et le « bien-être » ( euestô ). La réflexion de Démocrite se fonde sur une sorte de principe économique qui s’exprime par la notion de « mesure » ( metriotês ). La capacité à être modéré est aussi le signe distinctif de l’être humain bien accompli (DK 68 B 70), et s’oppose aux différentes formes de l’avidité. Lorsque l’on examine les fragments qui traitent de ce sujet, l’on constate que le philosophe a dressé un inventaire qui prend en compte les domaines les plus divers de la vie. Il est en effet question de la mesure aussi bien dans le cadre des affections comme le plaisir et le désir, que dans celui de la satisfaction de nos besoins élémentaires. Il en est également question pour ce qui est de notre attitude à l’égard des biens matériels et des richesses. Dans cet article nous avons choisi de faire porter l’attention sur la réflexion du philosophe sur les richesses et les biens matériels, en prenant tout particulièrement en compte sa mise en cause du désir dans l’économie de la vie humaine. . The uniform prior distribution is often seen as a mathematical description of noninformativeness. This paper uses the well-known Three Prisoners Paradox to examine the impossibility of maintaining noninformativeness throughout hierarchization. The Paradox has been solved by Bayesian conditioning over the choice made by the Warder when asked to name a prisoner who will be shot. We generalize the paradox to situations of N prisoners, k executions and m announcements made by the Warder. We then extend the consequences of hierarchically (...) placing uniform and symmetrical priors for the probability p of the Warder naming Prisoner B, say. We prove that breaks of indifference and neutrality caused by assignment of uniform and symmetrical priors in lieu of degenerate indifference probabilities hold in general. Speaking of unknown probabilities or of probability of a probability must be forbidden as meaningless. A função e o sentido do casamento são apresentados por Mary Wollstonecraft (1759-1797), em “Reivindicação dos direitos da mulher” (1792). Escrito em formato de reunião de panfletos e publicado antes de partir para a França revolucionária, com o propósito de acompanhar o levante republicano contra o Antigo Regime, “Reivindicação dos direitos da mulher” contém uma denúncia generalizada da desigualdade de gênero e de seus efeitos deletérios, e um projeto de reforma das instituições e da sociedade. É nesse texto que a (...) filósofa teoriza de maneira consistente e fecunda, sobre o casamento como instituição central a ser transformada, e é também ao tratar do casamento que a filósofa de fato opera com os conceitos de direitos e obrigações. “Reivindicação dos direitos da mulher” tem “direitos” no título, mas é de fato um livro sobre educação e sua argumentação se ergue sobre um pressuposto metafísico, a partir e contra a teoria da liberdade de Jean-Jacques Rousseau. Neste estudo, apresento como a categoria do casamento como instituição pedagógica e política desempenhar papel estruturante na transformação da sociedade. A função do casamento, para a filósofa, é articular as esferas privada e pública, de maneira engajada nos requisitos revolucionários, como uma categoria da transformação social. Este é o sentido da noção de “cimento da sociedade” que pretendo apresentar. (shrink)

O século XX trouxe uma ciência impossível: a ciência da mente. Esta ciência ignora os problemas semiológico, nosológico e sociocultural a ela inerentes e que a inviabilizam. Como resultado, observamos a criação de uma pandemia global de transtornos mentais, majoritariamente administrados através de psicofármacos. Em contraponto, o pensamento filosófico desafia esta logica desde Canguilhem, passando por Michel Foucault, Deleuze & Guattari, dentre tantos outros. E da Éticaespinosana dos afetos e afecções, nasceu a Heterogênese Urbana (HU), que tem como objeto original (...) a revitalização criativa das potências humanas através do contato entre subjetividades diversas. Etimologicamente, “criação a partir e com a diversidade”. Com a circulação dos afetos, dos desejos, das ideias nos espaços públicos, a HU promove, fenomenologicamente, a expressão daquilo que, antes permanecia invisível e indizível face o silêncio da vida da cidade. Os campos de afetações intersubjetivo e intercorpóreo entre vidas tão distintas desloca e descola o olhar fundado na psicopatologia clássica para atravessar a vida da cidade pelas potências que cada indivíduo é capaz nas experiências coletivas.A HU denuncia a multicomplexidade do conceito “produção de saúde”, que apenas inicia-se nas práticas biomédicas, compreendendo todos os saberes para a construção do cidadão autônomo e afetivo. In An Introduction to Probability Theory and its Applications, W. Feller established a way of ending the St. Petersburg paradox by the introduction of an entrance fee, and provided it for the case in which the game is played with a fair coin. A natural generalization of his method is to establish the entrance fee for the case in which the probability of heads is θ. The deduction of those fees is the main result of Section 2. We then propose (...) a Bayesian approach to the problem. When the probability of heads is θ the expected gain of the St. Petersburg game is finite, therefore there is no paradox. However, if one takes θ as a random variable assuming values in the paradox may hold, which is counter-intuitive. In Section 3 we determine necessary conditions for the absence of paradox in the Bayesian approach and in Section 4 we establish the entrance fee for the case in which θ is uniformly distributed in, for in this case there is a paradox. According to most accounts of trust, you can only trust other people (or groups of people). To trust is to think that another has goodwill, or something to that effect. I sketch a different form of trust: the unquestioning attitude. What it is to trust, in this sense, is to settle one’s mind about something, to stop questioning it. To trust is to rely on a resource while suspending deliberation over its reliability. Trust lowers the barrier of monitoring, challenging, checking, (...) and questioning. Trust sets up open pipelines between yourself and parts of the external world. Trust permits external resources to have a similar relationship to one as one’s internal cognitive faculties. This creates efficiency, but at the price of exquisite vulnerability. We must trust in this way because we are cognitively limited beings in a cognitively overwhelming world. Crucially, we can hold the unquestioning attitude towards objects and technologies. When I trust my climbing rope, I stop worrying about its reliability. When I trust my online calendaring system, I simply go to the events indicated, without question. But, one might worry, how could one ever hold such a normatively loaded attitude as trust towards mere objects? How could it ever make sense to feel betrayed by an object? Trust is our engine for expanding and outsourcing our agency — for binding external processes into our practical selves. Thus, we can be betrayed by our smartphones in the same way that we can be betrayed by our memory. When we trust, we try to make something a part of our agency, and we are betrayed when our part lets us down. To unquestioningly trust something is to let it in—to attempt to bring it inside one’s practical functioning. This suggests a new form of gullibility: agential gullibility, which occurs when agents too hastily and carelessly integrate external resources into their own agency. (shrink)

Argumentos evolutivos debunking (AEDs), de maneira geral, têm o objetivo de danificar o status epistêmico de um domínio de crenças ao se apelar para suas origens evolutivas. No horizonte da metaética, AEDs normalmente são direcionados a teses realistas da moralidade e consistem essencialmente em afirmar que se nossas crenças morais sofreram influência significativa de pressões seletivas durante nossa história evolutiva, então se segue algum tipo de ceticismo moral. Um dos argumentos paradigmáticos articulados nessa direção é o Dilema Darwiniano de Sharon (...) Street. Nossa proposta no artigo presente é colocarmos o argumento evolutivo contra o naturalismo (AECN) de Alvin Plantinga – um AED oriundo da filosofia analítica da religião – como possível resposta ao problema do ceticismo moral proposto por Street. Dessa forma, Plantinga pontua que considerações evolutivas tomadas dentro do framework do naturalismo ontológico acarretam em um conflito epistêmico para o sujeito que deseja manter em seu sistema doxástico tanto a crença na teoria contemporânea da evolução, quanto a crença no naturalismo ontológico. Argumentamos, a partir dessa questão, que o Dilema Darwiniano sofre de um problema estrutural por causa do seu comprometimento com a ontologia naturalista, o que faz com que o dilema se generalize em seu escopo e afete, de maneira nociva, crenças não-morais, se tornando autorreferencialmente incoerente. Value capture occurs when an agent’s values are rich and subtle; they enter a social environment that presents simplified — typically quantified — versions of those values; and those simplified articulations come to dominate their practical reasoning. Examples include becoming motivated by FitBit’s step counts, Twitter Likes and Re-tweets, citation rates, ranked lists of best schools, and Grade Point Averages. We are vulnerable to value capture because of the competitive advantage that such crisp and clear expressions of value have in (...) our private reasoning and our public justification. There is, however, a price. In value capture, we take a central component of our autonomy — our ongoing deliberation over the exact articulation of our values — and we outsource it. And the metrics to which we outsource usually engineered for the interests of some external force, like a large-scale institution’s interest in cross-contextual comprehensibility and quick aggregability. That outsourcing cuts off one of the key benefits to personal deliberation. In value capture, we no longer adjust our values and their articulations in light of own rich experience of the world. Our values should often be carefully tailored to our particular selves or our small-scale communities, but in value capture, we buy our values off the rack. In some cases – like decreasing CO2 emissions – the costs of non-tailored values are outweighed by the benefit of precise collective coordination. In other cases, like in our aesthetic lives, they are not. This suggests that we should want different values suited to different scales. We should want value federalism. Some values are perhaps best pursued at the largest-scale level, others at smaller scales. The problem occurs when we exhibit an excess preference for the largest-scale values – when we consistently let the universal metrics swamp our quieter interests. (shrink)

Schopenhauer como educador é a terceira, das quatro Considerações Intempestivas e, nesta obra, o então mestre de Nietzsche figura como modelo de educador. Schopenhauer é visto por Nietzsche, neste momento, como um exemplo de gênio, pois figurou na sociedade como exceção, não como regra. A universidade da época e a estrutura estatal são reprovadas por Nietzsche, e, para as confrontar, ele as utiliza como chave de leitura crítica o pensamento do autor conterrâneo. Estudaremos, perpassando as análises que Nietzsche de que (...) modo este autor figurou como alguém que apontou para uma educação intempestiva. Como essa postura de esforço de priorizar a singularidade pode ser configurada como perspectiva também artística. (shrink)

L'obiettivo del presente articolo è l'osservazione storica delle politiche della memoria nel Brasile contemporaneo, con particolare attenzione al periodo tra il 2019 e il 2022 (governo Bolsonaro). Dall'analisi delle azioni giudiziarie proposte da diversi attori sociali e politici, l'articolo propone una riflessione sulle temporalità coinvolte nelle politiche della memoria nel contesto post-dittatoriale, soprattutto dalla prospettiva delle vittime del regime.

Resumo: Este artigo se inicia discutindo um tema relativamente clássico na epistemologia, qual seja, analogia, conceito e teoria, explorando uma perspectiva contemporânea do fazer científico e, em alguma medida, da filosofia. A partir daí, busca reacender o debate, sempre necessário, sobre teoria, analogia e conceito, à luz da produção do conhecimento científico, destacando abordagens supradisciplinares e transparadigmáticas. Para tanto, socorre-se de diferentes áreas do conhecimento científico, a sociologia clássica e contemporânea, elementos da biologia, aspectos da cibernética, para demostrar que a (...) ciência, de modo geral, considerando suas múltiplas disciplinas, intercambia de forma cada vez mais dinâmica raciocínios analógicos, com vistas a dar conta da crescente complexidade em que se encontra.: This paper begins by discussing a classical theme in epistemology, namely analogy, concept, and theory using. It explores a contemporary perspective on scientific practies, Including some aspects of philosophical thinking. So it seeks to rekindle the always necessary debate on theory, analogy and concept about scientific production based on supradisciplinary and transparadigmatic approaches. In order to do so, we draw from different areas of scientific knowledge, classical and contemporary sociology, elements of biology, aspects of cybernetics, in order to demonstrate that science, considering its multiple disciplines, increasingly exchanges analogical reasoning. Recent conversation has blurred two very different social epistemic phenomena: echo chambers and epistemic bubbles. Members of epistemic bubbles merely lack exposure to relevant information and arguments. Members of echo chambers, on the other hand, have been brought to systematically distrust all outside sources. In epistemic bubbles, other voices are not heard; in echo chambers, other voices are actively undermined. It is crucial to keep these phenomena distinct. First, echo chambers can explain the post-truth phenomena in a way that epistemic (...) bubbles cannot. Second, each type of structure requires a distinct intervention. Mere exposure to evidence can shatter an epistemic bubble, but may actually reinforce an echo chamber. Finally, echo chambers are much harder to escape. Once in their grip, an agent may act with epistemic virtue, but social context will pervert those actions. Escape from an echo chamber may require a radical rebooting of one's belief system. A presente obra é o resultado de dois seminários de pesquisa que reuniram a Cátedra UNESCO Archai da Universidade de Brasília, o Centro de Estudos Clássicos e Humanísticos da Universidade de Coimbra e o Grupo Filosofia Antiga da Universidade Federal de Minas Gerais em dezembro de 2011 em Brasília e em março de 2012 na antiga cidade de Eleia, com o objetivo de realizar uma estudo exploratório tendo em vista a preparação de uma nova edição em língua portuguesa da obra (...) "Vidas e Doutrinas dos Filósofos Ilustres" de Diógenes Laércio. O estudo preparatório resultou nesta coleção de ensaios inéditos e ricos de estímulos e sugestões para a compreensão, imediatamente, da obra de Diógenes Laércio. O volume traz para o debate um panorama de questões sobre a obra e a sua recepção, assim como estudos mais específicos dedicados a uma passagem ou a uma das biografias, desejando desta forma constituir-se num trabalho de referência para os pesquisadores de Diógenes Laércio em língua portuguesa. The subject of life, birth and death constitutes one of the main topics in Democritus’ reflection on human questions. He seeks to understand what men think about the processes of birth and death and how they, accordingly, determine their behavior and attitudes. His reflections comprise a wide range of perspectives and aspects that include examining human behaviour and investigating how it reveals a certain temperament or inclination, inquiring about the nature of these processes and extending the analyses of the processes (...) of birth and death to whole beings through the couple generation-corruption. In the present paper, I intend to examine the main theses and arguments which appear in the testimonies and fragments through which Democritus’ thought was transmitted from antiquity. Furthermore, I will also discuss the hypotheses that for Democritus the most important opposition was not life-death, but rather birth-death and that, at the same time, his idea of nature and life comprises both processes in the perspective of atomistic philosophy. I shall show that corruption has to be considered in two different ways, that is, in the context of physical processes that keep the kosmos in its persistence and in the context of the existence of natural beings, both living and lifeless. In May 1643 Elisabeth of Bohemia addressed a question to Descartes which inaugurated a six-year Correspondence, until his death. He dedicates his mature metaphysical work to the Princess (Principles of First Philosophy, 1644) and writes Passions of the Soul (1649) as one of the results of the dialogue with the philosopher of Bohemia. The silencing of the last hundred years of historiography on Elisabeth of Bohemia's legacy in this epistolary exchange caused distortions and, in some cases, underpinned the bias as (...) a rule and as the history. One of the consequences of this distortion is the interpretation according to which her first question would consist of a critique of substantial dualism. In this study I suggest an interpretation of the nature of the first question, in order to clarify the philosopher's thinking and her role in dialogue, in a comprehensive way, without subscribing to the literary paradigm of the Cartesian soliloquy, and its bias. In this article I want to focus on a specific function that promises fulfil in our lives: their role as a way of shaping our character. To make my case, I will present an account of truth-telling based on Bernard Williams’ work on genealogy and on the virtues of truth. This account will highlight how our selves (or characters) are not static entities in time, that they are not immediately transparent to us. Nonetheless, we seem to have what I call (...) a drive to be someone, to have a character. We need ways to ‘steady the mind’, that is, ways of shaping our selves to whom we are or want to be. The argument I will put forward is that promises are one of the resources we have for doing so. By making promises, we commit ourselves to acting in a certain way and by doing that we also shape our selves. The argument will help us to answer some philosophical challenges raised against promises, notably about their rationality and about their relationship with vows and resolutions. Additionally, it will impact our thinking about contract law. What emerges from this article is an account of an important role played by promises that has been often neglected by the literature. Em maio de 1643, Elisabeth da Bohemia endereçou uma questão a Descartes que inaugurou uma Correspondência de seis anos, até a morte do filósofo. Ele dedica à Princesa o seu trabalho de maturidade metafísica (Princípios de Filosofia Primeira, 1644) e redige Paixões da Alma (1649) como um dos resultados do diálogo com a filósofa. O silenciamento dos últimos cem anos de historiografia sobre o legado de Elisabeth da Bohemia nesta troca epistolar causou distorções e, em alguns casos, lastreou o viés (...) como regra e como a história. Uma das consequências dessa distorção está na leitura de que a questão da filósofa consistiria em uma crítica ao dualismo substancial. Neste estudo busco oferecer uma interpretação da natureza da primeira questão, com o intuito de esclarecer o pensamento da filósofa e o seu papel no diálogo, de uma maneira compreensiva, sem subscrever o paradigma literário do solilóquio cartesiano, e seu viés na literatura filosófica. In this essay I will put forward an account of the emotion of shame that draws from Bernard Williams’ groundbreaking work on _Shame and Necessity_. The main novelty will be a distinction between two senses of shame, “basic shame” and “complex shame”. Basic shame is related to what Williams refers to as a “loss of power” in relation to others that can be real or imaginary spectators and is a sense of diminishment towards those others. Complex shame, in turn, appears (...) when this diminishment is felt in relation to an “internalised other” that embodies the values she recognises as her own as well as other values she respects. Borrowing a page from Cheshire Calhoun, I argue that many accounts of shame face what I call the “challenge of unrespected judgments”: people are vulnerable to shame even when they do not endorse or respect the judgments of those shaming them. I claim that the proposed Williamsian account of the emotion can dissolve the challenge, because for one to feel basic shame there is no need for any further attitude of the ashamed person towards the shamer besides a sense of diminishment caused by the perception of loss of power. In addition to that, oppression can influence the internalised other of marginalised people in a way that makes them vulnerable to complex shame. I will conclude with some brief remarks about how moral education in the Aristotelian sense can help us to deal with the morally problematic instances of shame. (shrink)

Logical reflection in early modern philosophy (EMP) is marked by the instability of the period, although it is more lasting (the Port-Royal Logic was nevertheless used as a handbook in philosophy courses until the end of the nineteenth century). It started in the sixteenth century and ended in the nineteenth century, a period of 300 years during which there were deep transformations in the conceptions of authority and scientific method. For the history of twentieth-century philosophy, it was the period of (...) “classical logic,” which lasted from the Renaissance to the linguistic turn conducted by Gottlob Frege. The period was used to be thought of as centuries of little or no original contribution to logic, in which conceptions of logic were tainted by rhetoric, epistemology, and psychologism in the worst sense (Kneale and Kneale 1962; Michael 1997). From the last decades of the twentieth century, however, scholars began to regard this period more accurately with respect to reflection and changes in logic and semantics. O texto a seguir é fragmento de um trabalho de doutorado e abordará um período específico da vida do jovem Nietzsche, quando ele atuou como soldado-enfermeiro na guerra franco-prussiana. Foi o momento da escrita do seu primeiro livro O nascimento da tragédia. A luta pela cultura figurou como a arma utilizada para vigorar a favor de sua elevação. Visava-se que ela retomasse os clássicos da Antiguidade e da Alemanha como horizontes para orientar um pensamento como “instrumento de combate”. Para além (...) dessa vivência direta na guerra, essas missivas fazem referência à arte, sobretudo a musical que, no nosso entendimento, figurava como meio educativo. É válido salientar que vários momentos da vivência cotidiana de Nietzsche, suas ocupações, criações, brigas, dúvidas, sofrimentos, trabalhos; todas foram molas impulsionadoras do seu pensamento e da constituição de uma personalidade que aprendeu e criou formas de educar a si mesmo e também gerou um instrumental para pensar e confrontar o modo de vida dominante em seu tempo. Resumo: Esta é a tradução do texto “L’amplification dans les processus d’information”, conferência ministrada por Gilbert Simondon em 1962, no Colloque de Royaumont sobre “o conceito de informação na ciência contemporânea. Aqui Simondon apresenta, e correlaciona, três “níveis do processo informacional de amplificação”: a amplificação transdutiva “por recrutamento positivo”; a amplificação moduladora “por limitação”; e a amplificação organizadora “por descoberta de um sistema de compatibilidade”. Para cada um dos três níveis, Simondon apresenta exemplos dos mundos físico, vivo, técnico e psicossocial.: (...) In this paper, Simondon presents, and correlates, three “levels of the informational process of amplification”: transductive amplification “by positive recruiting”; modulative amplification “by limitation”; and organizing amplification “by discovery of a system of compatibility”. Desde os anos 1990, Laymert Garcia dos Santos vem, não apenas articulando sinergias consistentes doxamanismo yanomami com a arte contemporânea, como também reiteradamente colocando à prova a hipótese,via de regra formulada nos termos de Gilbert Simondon, de que “o primeiro técnico é o pajé, o medicine man, [...] [o]xamã”, que “traz para sua comunidade um elemento novo e insubstituível produzido num diálogo direto com o mundo,um elemento escondido ou inacessível para a comunidade até então”. Proponho neste texto retomar alguns casosetnograficamente (...) documentados de “xamaquinismos” audiovisuais à luz da hipótese simondoniana reformulada porGarcia dos Santos: se os xamãs são os primeiros técnicos, não seria pelo mesmo motivo que são também os primeirosartistas?, i.e.: por operarem reticularmente, sobre nós de articulação entre realidades normalmente incompatíveis?;por acessar, em bloco e de forma controlada, num aqui-agora singular, a presença de grandes potências normalmentedispersas num alhures-outrora inacessível e incontrolável? In this work I intend to explore the textual and conceptual roots of the moral view in the Early Modern Rationalism of Cartesian spectrum as detected by Elisabeth of Bohemia. To this intent, I will drive my analysis, first, to the remark Descartes adds to his own provisional morality of the Discourse in the Letter of August 4th, 1645 to Elisabeth. Second, I will approach the two aspects of her reply to Descartes, both in her Letter of September 13th 1645, (...) which I call a) the contextual aspect – with which she excludes the hypotheses of an infinite science at the service of assessing the good and b) the self-related aspect, with which the philosopher of Bohemia address the moral objectiveness as an intrinsic practical value, obtained by the passions that may lead to reasonable actions. The upshot is a practical and affective moral view, in which the normative trait of some passions of the soul can be taken as the explanation of an intentional infrastructure of the mind, without, however, a theory of ideas as such playing an explicit role. Instead of a representational endeavor, Elisabeth of Bohemia claims a kind of self-awareness from the discovery of a passionate function as an expression of the adequate measure between happiness and morality of actions. That kind of awareness, I shall demonstrate, is what objectiveness consists in. (shrink)

In this study, I intend to show how and why, in the Port-Royal Logic, a singular term can reveal the nature of the logical judgment in the handbook. As I argue, the treatment given to one of thee singular terms, namely, the defined descriptions, in the terminology introduced by Russell, leads to an opening to langage that sounds unexpected and unjustified. Considering the privilege of thinking over langage and also that judgment is the mental act that defines logic, however, we (...) may understand how the authors regard langage, in relation to the epistemic constituents, namely, the mental acts within the terms. In doing so we are compelled to recognize the implications of this step towards pragmatism in fixing the meaning of defined descriptions to the nature of judgment in the handbook. This opening to langage reveals the conception of judgment as a twofold mental act: a formal and a practical (moral and theological) one. (shrink)

O estudo das Cartas de Descartes a Elisabeth ocupou a literatura, ao passo que a fortuna da contribuição de Elisabeth foi soterrada pela historiografia. Essa negligência intelectual merece registro, visto que as cartas de Elisabeth foram descobertas no Século XIX e publicadas pela primeira vez em 1876 (Ebbersmeyer 2020, p. 4). O fato de que Elisabeth tenha sido ignorada pela historiografia explicita a precariedade a que o viés pode condenar uma narrativa, e torna o estudo sobre Elisabeth da Bohemia difícil. (...) Como se sabe, de 1876 para cá a história do racionalismo moderno levou muito a sério as Respostas de Descartes a Elisabeth, sobretudo quando foram estudados os problemas da interação entre mente e corpo, da união substancial e as concepções de movimento. Assim, uma relevante literatura resultou do estudo de respostas a questões ignoradas. -/- Somente a partir da década de noventa do Século XX, historiadoras da filosofia começaram a levar a sério que Descartes não estava em um solilóquio diante de Elisabeth. Em um período de intensa troca epistolar, no qual as cartas veicularam larga medida a nova filosofia (tanto do racionalismo como do empirismo), não era comum, estranhamente, a mudança de posições. Este não foi o caso do impacto que as questões de Elisabeth causaram em Descartes e, por isso, a literatura sobre as Respostas de Descartes à filósofa configura um caso paradigmático do viés misógino que contaminou a história da filosofia, desafiando a sua seriedade e rigor. Questiona-se, no artigo, a relevância de um método jurídico, em concepções de Direito pós-gadamerianas. O problema pode ser resumido como a identificação da relevância do método, mesmo ante a constatação de que o pensamento jurídico é, ao final, incompreensível. Tomada como correta a conclusão de Lenio Streck de que o método sempre chega tarde na compreensão, a pesquisa investiga se, ainda assim, aquele é de todo dispensável. A abordagem é qualitativa, e sustenta-se em fontes bibliográficas. Apresentam-se, sob a forma de (...) diversas figuras geométricas (linha, ângulo, círculo, elipse), as várias relações entre “o Direito” e “os fatos” — da total autonomia à recíproca pressuposição. Em especial no que se refere às concepções pós-gadamerianas, analisamse as teorias de Castanheira Neves, Lenio Streck e Friedrich Müller, para concluir-se que, ainda que longe da pretensão totalizante de “o método” juspositivista, o Direito como tarefa de realização concreta exige critérios prático-constitutivos que devem ser metodicamente problematizados. Examinamos as respostas apresentadas por Cícero, Plutarco e Galeno, representantes da filosofia da época imperial, à pergunta pela possibilidade e legitimidade de uma therapeia das paixões. Tomando como ponto de partida uma reflexão sobre a natureza da alma e o estatuto das paixões, eles reacenderam o debate que remonta à poesia épica, na cena em que Aquiles se vê às voltas com o apelo de Atena para que acalme seu coração. Para tanto elegemos os seguintes textos: de Cícero, o livro (...) IV das Tusculanas, de Plutarco, os tratados Se as paixões da alma são mais nefastas que aquelas do corpo e Como refrear a cólera, e de Galeno, os tratados As paixões e os erros da alma e As faculdades da alma seguem os temperamentos do corpo.In this paper we examine the answers given by Cicero, Plutarch andGalen, all noted representatives of imperial Philosophy, to the question of thepossibility and legitimacy of a therapeia of the passions. Taking reflection on thenature of the soul and the status of the passions as starting point, they revivedthe debate that goes back to the scene in epic poetry where Achiles has todeal with Pallas Athene’s appeal to him to calm his heart. To that end we havechosen the following texts: Cicero’s Tusculans, book IV; Plutarch’s Whether thepassions of the soul are worse than those of the body and On the control of anger; and Galen’s On the passions and errors of the soul and That the faculties of the soul follow the temperaments of the body. Sortition, i.e. random appointment for public duty, has been employed by societies throughout the years as a firewall designated to prevent illegitimate interference between parties in a legal case and agents of the legal system. In judicial systems of modern western countries, random procedures are mainly employed to select the jury, the court and/or the judge in charge of judging a legal case. Therefore, these random procedures play an important role in the course of a case, and should comply with (...) some principles, such as transparency and complete auditability. Nevertheless, these principles are neglected by random procedures in some judicial systems, which are performed in secrecy and are not auditable by the involved parties. The assignment of cases in the Brazilian Supreme Court is an example of such a procedure, for it is performed using procedures unknown to the parties involved in the judicial cases. This article presents a review of how sortition has been historically employed by societies and discusses how Mathematical Statistics may be applied to random procedures of the judicial system, as it has been applied for almost a century on clinical trials, for example. A statistical model for assessing randomness in case assignment is proposed and applied to the Brazilian Supreme Court. As final remarks, guidelines for the development of good randomization procedures are outlined. (shrink)

The following text is a fragment of a doctoral work and will cover a specific period of the young Nietzsche's life, when he served as a nurse-soldier in the Franco-Prussian war. It was the moment of writing his first book The birth of tragedy. The struggle for culture figured as the weapon used to prevail in favor of its elevation. It was intended that she return to the classics of Antiquity and Germany as horizons to guide a thought as an (...) “instrument of combat”. In addition to this direct experience in the war, these missives refer to art, especially the musical, which, in our understanding, figured as an educational medium. It is worth noting that several moments in Nietzsche's daily experience, his occupations, creations, fights, doubts, suffering, work; all were springs that propelled his thinking and the constitution of a personality that learned and created ways to educate himself and also generated an instrument for thinking and confronting the dominant way of life in his time. A questão do processo judicial de adoção de crianças por casais homossexuais perpassa por diversas questões sociais. Envolve aspectos legais, culturais, que ultrapassam os limites simbólicos, e que transcorrem sobre questões jurídicas e étnicas, envolvendo questionamentos e enfrentamentos. Tem-se, explicitamente ou implicitamente, fronteiras étnicas que marcam o lugar de cada sujeito na sociedade, especificamente, por envolver a sexualidade, a homossexualidade, os “novos” conceitos de família, os questionamentos sociais, religiosos, filosóficos e jurídicos quanto à questão. Os “novos” arranjos familiares, posto à (...) etnicidade, a sociedade, em razão de diversas transformações, reorganiza-se e recria-se a família. Destarte, o presente trabalho investigou como e em que medida os marcadores étnicos e sociossexuais de casais homossexuais interferem, influenciam ou se apoiam nas decisões judiciais para a adoção de crianças em Jequié, Ilhéus e Vitória da Conquista, no Estado da Bahia, tendo como colaboradores juízes que acompanharam os mencionados pedidos de adoção e os casais que pretenderam realizar a adoção de crianças. Pensar como os discursos funcionam é colocar-se na encruzilhada de um duplo jogo da memória: o da memória institucional que estabiliza, cristaliza, e, ao mesmo tempo, o da memória constituída pelo esquecimento que é o que torna possível o diferente, a ruptura, o outro. Com a análise de dados sociológicos dos grupos envolvidos, a pesquisa apresentou alguns marcadores étnicos e sociossexuais de casais homossexuais como possíveis razões das decisões judiciais para a adoção de crianças pelos casais gays.
