Riccardo Martinelli (2015). A Philosopher in the Lab. Carl Stumpf on Philosophy and Experimental Sciences. Philosophia Scientiæ 19:23-43.
This essay addresses the interrelations between philosophy and experimental sciences that lie at the heart of Carl Stumpf’s epistemology. Following a biographical exposé demonstrating how Stumpf succeeded in acquiring a dual competence in both philosophical and scientific fields, we examine the vast array of academic disciplines encompassed by his research. Such a biographical treatment aims, indeed, to better promote the thrust of Stumpf’s assertion that philosophical enquiries should always be carried out in close connection with scientific (...)

Michael Salter (2013). Carl Schmitt on the Secularisation of Religious Texts as a Resacralisation of Jurisprudence? International Journal for the Semiotics of Law - Revue Internationale de Sémiotique Juridique 26 (1):113-147.
Carl Schmitt, an increasingly influential German law professor, developed a provocative and historically oriented model of “political theology” with specific relevance to legal scholarship and the authorship of constitutional texts. His “political theology” is best understood neither as an expressly theological discourse within constitutional law, nor as a uniquely legal discourse shaped by a hidden theological agenda. Instead, it addresses the possibility of the continual resurfacing of theological ideas and beliefs within legal discourses of, for instance, sovereignty, the force (...)

Absolutely no one still believes that every physical interactionconsists of material bodies bumping into each other. Those who have tried to work out a completely mechanistic physics have been unable to explain common phenomena like liquidity, gravitation and magnetism. In fact, there is great reason to doubt that such a physics could ever account for attractive forces in general.

This paper provides a translation of the introduction, titled ‘Account of the work’ Ratio operis, to the first edition of Genera plantarum, published in 1737 by the Swedish botanist Carl Linnaeus . The text derives its significance from the fact that it is the only published text in which Linnaeus engaged in an explicit discussion of his taxonomic method. Most importantly, it shows that Linnaeus was clearly aware that a classification of what he called ‘natural genera’ could not be (...)

    W. Rasch (2000). Conflict as a Vocation: Carl Schmitt and the Possibility of Politics. Theory, Culture and Society 17 (6):1-32.
Carl Schmitt's critique of liberal pluralism was conducted in the name of a different pluralism, a truer pluralism, according to him, namely, the pluralism of equal and sovereign nation-states. His friend/enemy distinction dictates that conflict is the only legitimate model for politics, at least on the international level. By translating Schmitt's theory of politics as conflict into terms derived from the work of Lyotard and Luhmann, this article asks whether Schmitt's concept of the political has any relevance for the (...)

Many studies have deduced subterranean dialogues between Hannah Arendt and Carl Schmitt from indirect evidence. This article uses new evidence from marginalia in Arendt’s copy of Nomos of the Earth and finds that she formed, but never published, an incisive critique of Schmitt’s geopolitics. Through an analysis of Arendt’s comments on the topics of soil, conquest, and contract, I show that Arendt deemed Schmitt’s theory to be imperialist and in contradiction with itself. Her reading of Schmitt prompts important new (...)

Carl Schmitt contends that liberal constitutionalism or the rule of law fails because it neglects the state of exception and the political, namely politics viewed as a distinction between friend and enemy groups. Yet, as a representative of liberal constitutionalism, Locke grapples with the state of exception by highlighting a magistrate prerogative and/or the right of the majority to act during a serious political crisis. Rather than neglecting the political, Locke’s state of war presupposes it. My thesis is that (...)

The intellectual relationship between Carl Schmitt and Max Weber has been a point of controversy for at least half a century. At the 1964 convention of the German Sociological Association, in honor of Weber's centenary, Schmitt was famously referred to as Weber's ?legitimate student.? This article uses the chapter Schmitt specifically wrote for an edited volume in Weber's memory, published in 1923, as the starting point for juxtaposing the two scholars, and then expands the analysis to encompass a range (...)

In this paper I explore the shared interest of John Dewey and Carl Jung in the developmental continuity between biological, psychological, and cultural phenomena. Like other first generation psychological theorists, Dewey and Jung thought that psychology could be used to deepen our understanding of this continuity and thus gain a degree of control over human development. While their pursuit of this goal received little institutional support, there is a growing body of theory and practice derived from the new field (...)

Carl J. Friedrich (1901?1984) defined constitutionalism as something more than can be expressed by the dominant behavioralist paradigm of modern political science and the typical academic focus on law and courts. A leading but now neglected post-WWII authority on constitutionalism, Friedrich argued that it should be understood as an institutionally-based, interactive system for deliberating the meaning and legal application of the norms of a political community. His approach shares much with the contemporary ?historical institutionalist? call to situate law and (...)

This article pays special attention to the large number of references to political theology by Hans Kelsen and Carl Schmitt, particularly in the interwar period, and seeks to interpret these references in a new way. While Schmitt's analogies between God and state are to be expected considering his strong Catholic roots, such comparisons are much more surprising for a positivist like Hans Kelsen, who always tried to relieve state and law from transcendental elements. The article concludes that, (...)

It has also been twenty years since Telos published the transcripts of what was presumed to be the complete three interrogations of him conducted by the prosecutor Robert M. W. Este artigo analisa a teoria da democracia de Carl Schmitt e procura destacar, a partir disso, suas virtudes e deficiências.

In his private life, however, Schmitt was haunted by the demons of his wild anti-Semitism, his self-destructive and compulsive sexuality and his deep-seated resentment against (...)

Lauterwein sets out different approaches to this topic in the German and Australian legal contexts. The book does not formally adopt a comparative methodology, but rather presents ‘an analysis using contextual and comparative elements’ (p. 45). He concentrates on analysing discussion of the limits of the criminal law in Australia, using the German legal (...)
