In this paper I argue that Rawlsians have largely misunderstood the idea of an overlapping consensus of reasonable comprehensive doctrines, thereby failing to delineate in an appropriate way the place of comprehensive doctrines in political liberalism. My argument rests on two core claims. The first claim is that (i) political liberalism is committed to three theses about the overlapping consensus. The first thesis concerns the subject of the overlapping consensus; the second thesis concerns the function of (...) the overlapping consensus; the third thesis explains how the overlapping consensus can serve its function in accordance with political liberalism’s commitment to epistemic neutrality. The second claim on which my argument relies is empirical: (ii) Rawlsians typically deny at least one of the three theses to which political liberalism is committed. Based on (i) and (ii), I conclude that Rawlsians have hitherto provided unconvincing accounts of the place of comprehensive doctrines in political liberalism. (shrink)

For more than a decade now a profound rule-of-law crisis has gripped the European Union, and while the fight for the rule of law has topped not only the academic but also the judicial and political agenda, the results have been disappointingly meagre. This article argues that the main reason for that should be sought in a political strategic move of justifying the assaults on the rule of law by resorting to an “illiberal democracy.” This premeditated political narrative shift has (...) unleashed onto the political sphere and onto public discourse at large comprehensive doctrines which had hitherto been left dormant thanks to an overlapping consensus on the rule of law as a central building block of the political conception of justice à la Rawls. Once this overlapping consensus was broken, the rule of law itself lost its neutral character as a referee on the right among the many conceptions of the good, itself becoming part of the highly politicized power play for dominance among irreconcilable—liberal and illiberal—comprehensive doctrines. The overlapping consensus in the EU is thus broken, but there are no conceptual reasons inherent to the rule of law itself for which it could not be rebuilt in the future. (shrink)

Recent scholarship has drawn attention to John Rawls’s concern with stability—a concern that, as Rawls himself notes, motivated Part III of A Theory of Justice and some of the more important changes of his political turn. For Rawls, the possibility of achieving ‘stability for the right reasons’ depends on citizens possessing sufficient moral motivation. I argue, however, that the moral psychology Rawls develops to show how such motivation would be cultivated and sustained does not cohere with his specific descriptions of (...) ‘pluralist ’ doctrines. Considering Rawls’s claims that ‘most’ citizens—both in contemporary liberal democracies and in the well-ordered society—possess such doctrines, this incompatibility threatens to undermine his stability arguments. Despite the enormous importance of pluralist doctrines and the potential difficulties they pose for Rawls’s project, remarkably little attention has been paid to them. By critically examining these difficulties, the article begins to address this oversight. (shrink)

In his last works, John Rawls explicitly argued for an overlapping consensus on a family of reasonable liberal political conceptions of justice, rather than just one. This ‘Deep Version’ of political liberalism opens up new questions about the relationship between citizens’ political conceptions, from which they must draw and offer public reasons in their political advocacy, and their comprehensive doctrines. These questions centre on whether a reasonable citizen’s choice of political conception can be influenced by her comprehensive (...) doctrine. In this paper I present two models of the relationship, which give contrasting answers to these questions, and defend the model that is more permissive with regard to the influence of comprehensive doctrines. This has important implications for our understanding of Rawlsian political liberalism, and reduces the force of objections that have been offered by theorists sympathetic to religion. (shrink)

This paper comprises a critical examination of foundationalist conceptions of comprehensive doctrines in the religion in politics-debate. I argue that John Rawls, the towering figure of this debate, operates with a foundationalist conception of comprehensive doctrines that has shaped the debate’s view of relevant alternatives (often referred to as exclusivism and inclusivism). However, there are several problems with foundationalist conceptions, and the most serious is that they are empirically inadequate in relation to modern Western societies. I (...) conclude that participants of the exclusivist/inclusivist debate ought to look closer at alternative, non-foundationalist conceptions, and I supply a brief sketch of one such approach, inspired by American pragmatism. Ethics commissions provide expert advice to governments on what policies to implement regarding pressing ethical issues, most often in bioethics. These commissions distinguish themselves by having members from the professions we are most likely to think of as moral experts, if we believe that these exist. The relationship between moral experts and the composition of ethics commissions is worthy of further exploration, especially because of the highly controversial nature of whether moral expertise exists and, if so, how, and whether, we (...) can identify moral experts. Moreover, it has been argued that the emergence of ethics commissions and how they have been composed have led to a “thinner” debate. In the first part of the article, the problem regarding checks for identifying moral experts is discussed. I argue that one way to handle this difficulty is through the application of Rawls’ concept of comprehensive doctrines. These doctrines have inherent standards that function similarly to independent checks, making it possible to identify moral experts from within such different doctrines. Using this approach makes it manageable to appoint moral experts to ethics commissions. In the second part, I consider the implications of seeing moral expertise through the prism of comprehensive doctrines for the composition of ethics commissions. One natural conclusion is that we should select moral experts representing different reasonable comprehensive doctrines to serve as members of ethics commissions. I consider six challenges to my proposal and demonstrate why these lack merit, and I point out some practical concerns that need further inquiry. (shrink)

This article critically assesses an account of religious liberty often associated with several legal and political philosophers: Ronald Dworkin, John Rawls, and Christopher Eisgruber and Lawrence Sager. In Public Reason Confucianism, Kim Sungmoon presents a perfectionist theory that is based on a partially comprehensive Confucian doctrine but is non-sectarian, since the doctrine is widely shared in East Asian societies. Despite its attractiveness, I argue that this project, unfortunately, fails because it is still vulnerable to the sectarian critique. The blurred distinction between partially and fully comprehensive doctrines will create a loophole problem. Sectarian laws and policies may gain legitimacy that they do not deserve. I (...) further defend political Confucianism, which is regarded by Kim as an inadequately intelligible form of Confucianism. Kim assumes a too narrow understanding of intelligibility. Although political Confucianism may not be politically intelligible, it is civically intelligible, i.e. it is culturally intelligibly different from other political theories in terms of its implications in citizens’ actions in civil society. There are two seemingly unrelated paradoxes of democracy. The older one is the doctrinal paradox or the discursive dilemma. or a comprehensive bibliography, see List 1995. The younger one is the mixed motivation problem introduced by Jonathan Wolff (1994) in this journal. In the mixed motivation problem, we have voters with mixed Benthamite and Rousseauian motivations who reach a majority on an issue that is neither in the self-interest of a majority of the voters, nor considered to be conducive (...) to the common good by a majority of the voters. For well over a decade, much of liberal political theory has accepted the founding premise of Rawls's political liberalism, according to which the fact of reasonable pluralism renders comprehensive versions of liberalism incoherent. However, the founding premise presumes that all comprehensive doctrines are moral doctrines. In this essay, the author builds upon recent work by Allen Buchanan and develops a comprehensive version of liberalism based in a partially comprehensive social epistemic doctrine. The distinction between ‘comprehensive’ and ‘political’ liberalisms, explored in the previous chapter, has become central to contemporary political theory. My aim in this chapter is to examine various ‘comprehensive’ liberalisms, with particular care to identifying in what sense they are comprehensive. As I have argued elsewhere (Gaus, 2003: chap. 7), the distinction between political and comprehensive liberalisms is elusive. Rawls repeatedly describes as ‘comprehensive’ ‘philosophical’, ‘moral’ and ‘religious’ ‘doctrines’ (1996: xxv, 4, 36, 38, 160) (...) or ‘beliefs’ (1996: 63). Indeed, so often does Rawls characterize comprehensiveness in terms of moral, religious and philosophical doctrines or beliefs that a reader may be tempted to conclude that doctrine C is comprehensive if and only if it is a moral, religious or philosophical doctrine or belief. But though it is tempting to understand ‘comprehensive conceptions’ in this way, it would be wrong. Rawls is clear that ‘the distinction between the political conception and other moral conceptions is a matter of scope; that is, the range of subjects, to which a conception applies and the content a wider range requires’ (1996: 13). Comprehensive and general doctrines cover a wide range of topics, values and ideals applicable to various areas of life. Even given the terms of Rawls’s own analyses, rather than conceiving of comprehensive liberalisms as all relying on a fully comprehensive doctrine, it is better to conceive of them in terms of a spectrum of theories, from those that rely on something like a fully comprehensive view to those that rely on, say, only a general theory of the right. This article examines the attempts by John Rawls in the works published after Political Liberalism to engage with some of the feminist responses to his work. Rawls goes a long way toward addressing some of the major feministliberal concerns. Yet this has the unintended consequence of pushing justice as fairness in the direction of a more comprehensive, rather than a strictly political, form of liberalism. This does not seem to be a problem peculiar to Rawls: rather, any form of (...) liberalism hospitable to feminist concerns must be, at the very least, a partly comprehensive, rather than a strictly political, doctrine. Duns Scotus and Aquinas agree that whereas God comprehends Himself or even is his own comprehension, no creature can ever comprehend God. In the 17th century, the two Scotists Bartolomeo Mastri and Bonaventura Belluto discuss comprehension in their manual of philosophical psychology. Although they attempt to articulate a genuine Scotist doctrine on the subject, this article shows that they in fact defend a stance close to the one endorsed by contemporary scholastics outside the Scotist school. The article situates their discussion (...) within 17th-century scholasticism. The article furthermore highlights the theological motifs in Mastri and Belluto’s discussion of comprehension. Although they claim that their discussion does not transgress the limits of Aristotelian psychology, all of their arguments are theological in nature. From this I conclude that in this particular context our two Scotists clearly start out with a set of theological convictions, rather than with any particular philosophico-epistemological beliefs. If one were to prioritise the most important contributions of John Wesley, within that list would be the contribution of his Doctrine of Christian Perfection. The development of this doctrine was a life-long project for Wesley, who always held the core belief that the telos of perfection was love for God and one's neighbour. Wesley's Doctrine of Christian Perfection found its most comprehensive outline in his 1743 manuscript, A Plain Account of Christian Perfection. This article will argue that Wesley's (...) ethics, as found in his teaching and the work of the Methodist movement, are built on the view that the life of the Christian should be a journey of an ever-growing love for God and love for neighbour. This article will explore Thoughts upon Slavery as a critical text in the Wesley corpus to see how the Doctrine of Christian Perfection influenced Wesley's thoughts on slavery. Finally, this article offers a way of doing Wesleyan ethics today. Wesleyan ethics are communally understood in that all holiness is social holiness, and Wesleyan ethics have as their primary concern Wesley's charge to do no harm, do good, and stay in love with God. Originally introduced by Plato and Aristotle, the doctrine of the mean is the most prevalent theory of ethics among Islamic scholars. According to this doctrine, every virtue or excellence of character lies in the observance of the mean, whereas vices are the excess or deficiency of the soul in his functions. Islamic scholars have been influenced by the doctrine, but they have also developed and re-conceptualized it in innovative ways. Kindi, Miskawayh, Avicenna, Raghib Isfahani, Nasir al-Din Tusi, and others are (...) among the Islamic contributors to the subject. Zhong 中 is a very important philosophical concept in early Confucianism. Both the received ancient Confucian classics and the newly discovered ancient bamboo manuscripts tell us that adhering to the principle of zhong was an important charge that had been transmitted and inherited by early ancient Chinese political leaders from generation to generation. Confucius and his followers adopted the concept of zhong and further developed it into a sophisticated doctrine, which is usually called zhongdao 中道 (the Way of zhong) or (...) zhongyong 中庸. Being a polysemous word, zhong has several different but philosophically related meanings. However, for a long time, people usually understood zhong in the sense of only one of its meanings, and zhongdao or zhongyong has been commonly interpreted as “the doctrine of the mean.” My argument in this paper is that a synthetic interpretation, which includes all the semantic meanings of zhong is necessary in order to acquire a deep and well-rounded comprehension of the philosophical significance of the Way of zhong. The Way of zhong features a dialectal view of the relationship between heaven and human beings, mind and materials, subjective desire and the available objective conditions, self and others, centrality and diversity, and so on. The Way of zhong has become a widely applied philosophical methodology in Confucianism, as well as a political principle and a kind of personal moral merit in early Confucian doctrines. This study contrasts the evidence exclusion principles within the adversarial legal system of the United States, particularly the “fruit of the poisonous tree” doctrine, with the inquisitorial system of Vietnam. The U.S. model, emphasizing the exclusion of unlawfully obtained evidence to protect the presumption of innocence and ensure fair trials, relies on the Fourth Amendment to prevent police misconduct. Conversely, Vietnam, with its focus on uncovering the truth, has started to adopt adversarial elements, including evidence exclusion, to align with international (...) standards and enhance human rights protections within its criminal justice system. The research examines the application of the “fruit of the poisonous tree” doctrine in the U.S. and its implications for Vietnamese legal reforms, especially the proposed amendments to Article 87 of Vietnam's Criminal Procedure Code. These reforms aim to exclude unlawfully obtained evidence while allowing for the use of evidence collected independently from illegal actions. Highlighting the need for a balanced approach that respects procedural rights and promotes justice, the study advocates for comprehensive legal reforms in Vietnam. It suggests amendments to refine evidence exclusion principles, ensuring they reflect both the Vietnamese context and the progressive features of U.S. criminal justice practices, thereby enhancing the fairness and integrity of criminal proceedings. From the expression Beloved of my soul, William of Saint-Thierry highlights one of the main elements of his spiritual doctrine. From Expositio in Canticum Canticorum, the author comments how the Bride praises the Bridegroom through this formula, thus giving it a particular sense in relation to the beloved ones because this love somehow likes the one he looks for: sensum quemdam; love that is communicated to man so that he can love God, as God loves himself. For this, the Bride says to the sentinels: "Have you seen the beloved of my soul"? These words do not only reveal her affection, but also allow considering that the soul itself experiences the presence of God. John Rawls is widely acknowledged to be the most influential political philosopher of the twentieth century. But the implications of his views for both religious belief and religious believers are hotly contested. Building on the results of the Groundwork and the Critique of Practical Reason, Kant finally published his system of moral philosophy in two volumes in 1797. While for many years academic moral philosophy focused mainly on Kant’s earlier ethical treatises, there has recently been much interest in this (...) later and perhaps more mature work on moral philosophy, particularly the ethical part of the Metaphysics of Morals, the “Metaphysical Principles of the Doctrine of Virtue” or “Tugendlehre”. The present volume responds to these demands. These diverse groups are evangelicals because of their “consistency on moral choices,” doctrinal orientation, and styles of social advocacy (24). Although they differ in a number of ways, they all share having been influenced in some way by John and Charles Wesley, Jonathan Edwards, and the Reformation. All stress conversion in that “one must say yes to the divine Jesus Christ” and become identified with the community of faithful believers (57). And in recent decades, they have become a potent political force with regard to the issues of abortion and homosexuality.Thobaben covers a wide range of topics in this book: from a general discussion of theodicy and healing to bioethics, disability, sickness, family and congregational care, professional truthfulness, managing care, end-of-life decisions, assisted reproduction, organ donation, and death. Yet, although he claims to provide a “comprehensive resource” on evangelical Christian health care ethics, he fails to provide a thorough examination of his subject matter. For example, Thobaben pays little attention to the historic beginnings of the religious right. One misses any mention of political action groups or the coalitions formed with or by conservative Christian groups to pursue social reforms, or of why such disparate groups have cooperated for political or social goals under the same umbrella. He focuses solely on identifying and articulating the consensus among those who embrace certain moral values on the current scene. Thobaben’s uncritical approach to his subject matter leaves the impression that this book is essentially an apology for evangelical, right-wing Christian social thought. One searches in vain for any critical discussion of the beliefs and values he presents or any thoughtful engagement with those who might view the stances he presents as an assault against women’s rights or an attack on the rights of gays, lesbians, and transsexuals.Moreover, in a book like this, one would have expected a more careful assessment of biblical passages and historical precedents. Thobaben does not provide much rationale for his method for moving from the Bible to current social issues. For example, no prohibition against abortion is found in the Bible and the few passages about homosexual practices hardly add up to the fierce opposition to gays found among strident evangelicals. Moreover, Thobaben does not mention that in 1965 laws against contraceptives were declared unconstitutional by the Griswold vs. Connecticut decision, the Supreme Court’s rejection of a ban supported by an evangelical crusade led by Anthony Comstock. [End Page 204]It is interesting to note that Thobaben holds a strongly qualified commitment to religious liberty and only a “thin” version of the social contract basic to the Bill of Rights (37). He argues that in at least some situations “intolerance is not only morally understandable but strongly preferable,” as in the examples of the “abolition of slavery and prolife/antiabortion advocacy” (29) or, in another context—where he distinguishes between tolerance toward those outside the church and intolerance toward those within it—with regard to homosexuality and alcohol intoxication (30).The task of Christian ethics is to enlighten believers and the general citizenry by a careful exposition of the sources of wisdom available to those who want to think and think morally about issues of importance to human flourishing. Schelling’s doctrine of the potencies (Potenzlehre) for the English-speaking philosophical community as found in his, for the most part yet to be translated, late lectures on the positive philosophy of mythology and revelation. Its fundamental object consists in answering the question : what is knowledge ? what implies to answer another question : what ‘is’ is ? Fichte answers that knowledge is absolute existence, what is equivalent to the existence of absolute – and the author demonstrates his thesis through five attempts. L'article étudie la méthode de la théologie transcendantale et son application à la doctrine chrétienne de Dieu. Certains auteurs représentatifs de cette école théologique sont choisis, à savoir Lonergan, Donceel, Tracy et K. Rahner. Dans chaque cas trois questions sont posées: la relation entre expérience et notre compréhension de Dieu; la raison par rapport à la croyance en Dieu; le concept de Dieu qui ressort de l'emploi de la méthode transcendantale. Parmi les mérites de la méthode transcendantale il faut noter (...) sa rigueur intellectuelle et son ouverture au dialogue avec la non-croyance. Les auteurs dont il est question cherchent à montrer que la dimension religieuse est partie nécessaire de l'expérience humaine. Parmi les faiblesses on peut noter que les penseurs transcendantaux sont peut-être trop anthropologiques et ont une conception unilatérale de l'homme qui tend à négliger sa corporéité et son historicité. Leur affirmation sans compromis de la transcendance de Dieu fait aussi surgir la question comment l'apologétique chrétienne répond au problème de la souffrance humaine. La transcendance de Dieu ne doit-elle pas être compensée par son immanence afin que la relation de Dieu au monde ne soit pas unilatérale? (shrink)

ABSTRACT The aim of this paper is to discuss how Bruno Bauch deals with the problem of the coordination between empirical concepts and spatiotemporal objects. We shall argue that Bauch reformulates the Kantian distinction between concepts and intuitions by means of a philosophical consideration of differential calculus and that he thereby explains the possibility of such coordination, avoiding certain difficulties of the Kantian doctrine. Factors of a secularized world, among which, alongside with which there is Christian theology, encourage the latter to meet the high intellectual guidelines of the present culture, gain signs of persuasiveness, comprehensiveness, consistency and generally take into account the requirements and norms of common sense. However, trying to reflect reality, moreover, claiming Truth, religion and its ideas arise and function within the limits of subjective and accordingly can not be forced to adjust. This is largely reflected in theology as its (...) reflective presentation. However, not only the religious intellectual, but also any ordinary believer prefers to find in daily routine such arguments that it would undoubtedly point out that his faith is not an illusion that he meets the highest requirements of historical truth. In this sense, the well-known Catholic cleric and theologian Hans Kyung was not mistaken and even exaggerated, when he categorically reiterated: "Where faith is based on illusion, there is not faith, but superstition". McDermott presents James's thinking in all its manifestations, stressing the importance of radical empiricism and placing into perspective the doctrines of pragmatism and the will to believe. The critical periods of James's life are highlighted to illuminate the development of his philosophical and psychological thought. The anthology features representive selections from _The Principles of Psychology, The Will to Believe_, and _The Variety of Religious Experience_ in addition to the complete _Essays in (...) Radical Empiricism_ and _A Pluralistic Universe_. The original 1907 edition of _Pragmatism_ is included, as well as classic selections from all of James's other major works. The article underlines the significance of social rights as important constitutional rights of a human being and emphasises the peculiarities of their nature from the point of view of not only national, but also international law. The article presents an analysis of the constitutional doctrine of the protection of guarantees of social rights, which has been formulated by the Constitutional Court of the Republic of Lithuania in the course of considering the issues of reduction of social guarantees—pensions and remuneration, which (...) were determined by the economic crisis. In the Constitutional Court’s jurisprudence the personal right to social security has been construed in the most broad and comprehensive terms. The human rights and freedoms enshrined in the Constitution have been treated as constituting an integrated and harmonious system, and social rights have been interpreted not only as certain obligations of the state to the public, which inter alia are determined by the social purpose of the state, but also as a person’s individual rights, for which judicial defence is guaranteed. Such concept of the said rights has also been influenced by international law, inter alia the jurisprudence of the European Court of Human Rights. Social rights, while being an object of regulation of international law, have been forming the European doctrine of guarantees of these rights and have influenced the concept of these rights in national law. The main attention in the article is devoted to the analysis of the doctrine formulated in the Constitutional Court’s jurisprudence in relation to the correction (limitation) of social rights (payment of pensions and remuneration) under the conditions of economic crisis. In the article the period of formation of this doctrine is divided into two stages: the period of 2002–2006, when the Constitutional Court had to decide regarding the compliance of the legal acts whereby social guarantees had been constricted with the Constitution, and which was caused by the consequences of the so-called Russian economic crisis for the economic development of the state of Lithuania; and the period from 2009 to date, during which the Constitutional Court has been forming the constitutional doctrine of limitation of social rights, which was conditioned by the outcomes of the global economic crisis for the economy of the state of Lithuania. The article raises a question as to whether the constitutional doctrine being formed by the Constitutional Court in relation to the limitation of social rights under the conditions of economic crisis may be assessed as an independent one or whether it still remains to be a separate case of limitation of rights within the general doctrine of limitation of human rights. On the basis of the analysis of the Constitutional Court’s jurisprudence, a conclusion is drawn that the criteria established in the Constitutional Court’s doctrine of limitation of social rights under the conditions of economic crisis are even stricter than the universally recognised criteria for the limitation of human rights in the law of human rights, therefore, it is possible to assess the doctrine of limitation of social rights under the conditions of economic crisis, as formulated by the Constitutional Court during 2009–2012, which is the continuation of the previous doctrine, as an independent doctrine, the basis of which, undoubtedly, remains to be formed by the general principles of limitation of human rights recognised in the law of human rights. The article is not only confined to the analysis of the jurisprudence of the Constitutional Court of the Republic of Lithuania, it also provides examples of construction of the doctrine of social rights (inter alia those influenced by the economic crisis) by certain other constitutional courts. (...) An unprecedented hope broke into the world of the hopelessly marginalized, who did not have sufficient means to be cared for at home, and therefore had to go to hospitals, where they were often assisted only by untrained caregivers, who did so under obligation because they were either criminals or compelled by economic need to perform such menial service. This hope consisted in the message that the love of God urges the voluntary and sacrificial service of dedication to the sick, and especially to those who will not recover from their illness. However, this service should be holistic, because the welfare of the needy encompasses all the dimensions of the human person: the body and the soul, but also the spirit.The letter of the Congregation for the Doctrine of the Faith (CDF) Samaritanus Bonus, dated July 14, 2020—the liturgical day of commemoration of Camillus of Lellis—on the care of persons in the critical and [End Page 753] terminal phases of life, seeks to promote the same concern for comprehensive service to the sick out of respect for the divinely anchored dignity of the human person.
