In 2007, many legislatures considered, and two enacted, bills mandating HPV vaccination for young girls as a condition of school attendance. Such mandates raise signifcant legal, ethical, and social concerns. This paper argues that mandating HPV vaccination for minor females is premature since long-term safety and efectiveness of the vaccine has not been established, HPV does not pose imminent and signifcant risk of harm to others, a sex specifc mandate raises constitutional concerns, and a mandate will burden fnancially existing government (...) health programs and private physicians. Absent careful consideration and public conversation, HPV mandates may undermine coverage rates for other vaccines. (shrink)

The human papillomavirus is the most common sexually transmitted infection worldwide. In the United States, more than six million people are infected each year. Although most HPV infections are benign, two strains of HPV cause 70 percent of cervical cancer cases. Two other strains of HPV are associated with 90 percent of genital warts cases.In June 2006, the Food and Drug Administration approved the first vaccine against HPV. Sold as Gardasil, the quadrivalent vaccine is intended to prevent four strains of (...) HPV associated with cervical cancer, precancerous genital lesions, and genital warts. Following FDA approval, the national Advisory Committee on Immunization Practices recommended routine vaccination for girls ages 11-12 with three doses of quadrivalent HPV vaccine. Thereafter, state legislatures around the country engaged in an intense effort to pass laws mandating vaccination of young girls against HPV. This activity was spurred in part by an intense lobbying campaign by Merck, the manufacturer of the vaccine. (shrink)

Americans who are afraid of living for many years with Alzheimer's might seek a way to end their lives early, when their dementia has just entered the moderate phase. There is no legal process for doing so. In this paper I argue that advance directives, in particular, are not a legal solution for those who prefer to die rather than suffer years of dementia. The problem is that an advance directive only works to hasten death when there is a life-threatening (...) illness for which one can refuse treatment; more often than not, Alzheimer's kills the self long before it kills the body. Why do humans menstruate while most mammals do not? Here, we present our answer to this long‐debated question, arguing that (i) menstruation occurs as a mechanistic consequence of hormone‐induced differentiation of the endometrium (referred to as spontaneous decidualization, or SD); (ii) SD evolved because of maternal–fetal conflict; and (iii) SD evolved by genetic assimilation of the decidualization reaction, which is induced by the fetus in non‐menstruating species. The idea that menstruation occurs as a consequence of SD has been proposed in (...) the past, but here we present a novel hypothesis on how SD evolved. We argue that decidualization became genetically stabilized in menstruating lineages, allowing females to prepare for pregnancy without any signal from the fetus. We present three models for the evolution of SD by genetic assimilation, based on recent advances in our understanding of the mechanisms of endometrial differentiation and implantation. Testing these models will ultimately shed light on the evolutionary significance of menstruation, as well as on the etiology of human reproductive disorders like endometriosis and recurrent pregnancy loss. At the end of his writing, “La Différance,” Jacques Derrida deconstructs his text by taking on an authoritative rhetorical tone. Reflecting back on his discussion of metaphysics, Derrida announces that “(t)here will be no unique name, even if it were the name of Being”. And then he takes a surprising phenomeno-logical turn and advocates a privileged attitude or disposition towards his reflection:And we must think this without nostalgia, that is, outside the myth of a purely maternal or paternal language, a (...) lost native country of thought. Young children spend a large portion of their time pretending about non-real situations. Why? We answer this question by using the framework of Bayesian causal models to argue that pretending and counterfactual reasoning engage the same component cognitive abilities: disengaging with current reality, making inferences about an alternative representation of reality, and keeping this representation separate from reality. In turn, according to causal models accounts, counterfactual reasoning is a crucial tool that children need to plan for the future and learn (...) about the world. Both planning with causal models and learning about them require the ability to create false premises and generate conclusions from these premises. We argue that pretending allows children to practice these important cognitive skills. We also consider the prevalence of unrealistic scenarios in children's play and explain how they can be useful in learning, despite appearances to the contrary. (shrink)

Why is evolutionary theory controversial among members of the American public? We propose a novel explanation: allegiance to different criteria for belief. In one interview study, two online surveys, and one nationally representative phone poll, we found that evolutionists and creationists take different justifications for belief as legitimate. Those who accept evolution emphasize empirical evidence and scientific consensus. Creationists emphasize not only the Bible and religious authority, but also knowledge of the heart. These criteria for belief remain predictive of views (...) about evolution even when taking into account other related factors like religion, political affiliation, and education. Each view is supported by its own internally specified criteria for what constitutes a justified belief. Changing minds may thus require changing epistemic norms. (shrink)

How do readers create representations of fictional worlds from texts? We hypothesize that readers use the real world as a starting point and investigate how much and which types of real-world information is imported into a given fictional world. We presented subjects with three stories and asked them to judge whether real world facts held true in the story world. Subjects' responses indicated that they imported many facts into fiction, though what exactly is imported depends on two main variables: the (...) distance that a narrative world lies from reality and the types of fact being imported. Facts that are true of the real world are more likely to be imported into worlds that are more similar to the real world, and facts that are more central to the representation of the real world are more likely to be imported overall. These results indicate that subjects make nuanced inferences when creating fictional worlds, basing their representations both on how different a story world is from the real world and on what they know to be causally central to the real world. Prior work has found that Americans’ views on evolution are significantly and positively related to their understanding of this theory. However, whether this relationship is cross-culturally robust is unknown. This article extends earlier work by measuring and comparing the acceptance and understanding of evolution among highly educated individuals in China and the United States. We find a significantly higher evolution acceptance level in the Chinese sample than in the US sample, but no significant difference in their average levels of evolution (...) knowledge. Our analysis also shows that accepting evolutionary theory is related to understanding in both the US and the Chinese samples. These results provide evidence for the robustness of the relationship between understanding and acceptance of evolution across different cultural contexts. To our knowledge, this is the first attempt to comprehensively test understanding of evolutionary theory within a Chinese sample and to compare these results with the US sample. (shrink)

Both adults and children have the ability to not only think about reality but also use their imaginations and create fictional worlds. This article describes the process by which world creation happens, drawing from philosophical and psychological treatments of this issue. First, world creators recognize the need to create a fictional world, as when starting a pretend game or opening a novel. Then, creators merge some real-world knowledge with the premises of the fictional world to construct a fuller representation, though (...) there is some controversy about how much of the real world is represented in any given fictional world. After the world is created, events can be set in motion within it. While it is generally accepted that this basic process is used for a wide variety of fictional worlds, including fictional stories, pretend games, and counterfactual scenarios, this process of world creation can vary over the course of development and depending on the use to which it is put. Over the last ten years or so, many cognitive scientists have begun to work on topics traditionally associated with philosophical aesthetics, such as issues about the objectivity of aesthetic judgments and the nature of aesthetic experience. An increasingly interdisciplinary turn within philosophy has started to take advantage of these connections, to the benefit of all. But one area that has been somewhat overlooked in this new dialogue is developmental psychology, which treats questions about whether and to what extent children's intuitions (...) about various aspects of aesthetic experience match those of adults, as well as the origins and developmental trajectories of these intuitions. The current paper reviews some recent work in developmental psychology that has the potential to inform philosophical research on a variety of topics – not necessarily because of this work tells us directly about what children think, but because learning what children's aesthetic intuitions are and how they develop can help us to better understand why adults have the intuitions that they do. Many people feel the pull of both creationism and evolution as explanations for the origin of species, despite the direct contradiction. Some respond by endorsing theistic evolution, integrating the scientific and religious explanations by positing that God initiated or guided the process of evolution. Others, however, simultaneously endorse both evolution and creationism despite the contradiction. Here, we illustrate this puzzling phenomenon with interviews with a diverse sample. This qualitative data reveals several approaches to coping with simultaneous inconsistent explanations. For example, (...) some people seem to manage this contradiction by separating out ideological claims, which prioritize identity expression, from fact claims, which prioritize truth. Fitting with this interpretation, ambivalent individuals tended to call explanations “beliefs”, avoid mention of truth or falsity, and ground one or both beliefs in identity and personal history. Tertiary healthcare ethics (HCE) consultation occurs when an HCE consultant at a healthcare facility requests guidance from one or more senior HCE consultants who are not members of that facility’s HCE consultation service. Tertiary HCE consultants provide advanced HCE guidance and/or mentoring to facility (secondary) HCE consultants, mirroring healthcare consultation in clinical practice. In this article, we describe advantages and challenges of providing tertiary HCE consultation through a hub-and-spoke model administered by a national integrated HCE service.

In Group Psychology and the Analysis of the Ego Freud addresses the problem of how groups are formed or of how society is possible. The question of the possibility of society presupposes that in some sense human beings are not thoroughly social beings, that they must agree to or be made to participate in a common life in which they submit to general principles regulating their conduct towards one another. The notion that the grounds for social order cannot be taken (...) for granted originates in the beginnings of modern thought, particularly in Hobbes’ Leviathan, in which the classical idea that human beings are essentially social and political animals is rejected in favor of the view that the individual is in a basic sense independent of society and opposed to it, and that society is merely a conventional unity. For Hobbes, society is primarily a defensive alliance guaranteed by fear of a sovereign who constitutes a legal order. Social order, then, is imposed externally on the individual, who submits to regulation only on the basis of prudence. The history of thought about the problem of order after Hobbes’ initial attempt to resolve it is a development of more refined motives for obedience, which culminates in Kant's notion of a self-legislated moral law. The importance of Kant's solution is that it provides a positive ground for society. Human beings do not merely submit to standards because they are inclined to, either out of fear or out of desire, but because they acknowledge a rational principle to which they give their voluntary assent. For Hobbes, society is at least an imposition and at most an expedient. For Kant, society may, indeed, be both an imposition and an expedient, but it is also an order of life that might be perfected. In Kant's view, human beings are imperfectly rational beings, not organisms entirely ruled by pleasure and pain, as they were for Hobbes. (shrink)

The past decade has witnessed escalating legal and ethical challenges to the diagnosis of death by neurologic criteria. The legal tactic of demanding consent for the apnea test, if successful, can halt the DNC. However, US law is currently unsettled and inconsistent in this matter. Consent has been required in several trial cases in Montana and Kansas but not in Virginia and Nevada. In this paper, we analyze and evaluate the legal and ethical bases for requiring consent before apnea testing (...) and defend such a requirement by appealing to ethical and legal principles of informed consent and battery and the right to refuse medical treatment. We conclude by considering and rebutting two major objections to a consent requirement for apnea testing: a justice-based objection to allocate scarce resources fairly and a social utility objection that halting the diagnosis of brain death will reduce the number of organ donors. Do victims’ emotions underlie preschoolers’ moral judgment abilities? Study 1 asked preschoolers (n = 72) to judge actions directed at characters who could and could not feel hurt and who did and did not cry. These judgments took into account only the nature of the action, not the nature of the victim. To further investigate how victims’ emotions might impact children’s moral judgments, Study 2 presented preschoolers (n = 37) with stories that varied in transgression type (Moral, Conventional, or None) (...) and victim’s reaction (Crying Present or Crying Absent). As in Study 1, children’s judgments were affected primarily by transgression type, and not by emotion. In an analogous task, judgments of children with autism spectrum disorders (Study 3; n = 12) were affected by both transgression type and crying. Typically developing children’s moral judgments are thus concerned primarily with action type, not with emotional displays, but the judgments of children with autism spectrum disorders can be swayed by victims’ emotions.
