I review the recent case of Edna Folz, a 73 year-old woman who was suffering through the end stages of very advanced Alzheimer's dementia when her case was adjudicated by the Wisconsin Supreme Court. I consider this case as an example of how courts are increasingly misinterpreting the ethical and legal decision-making standards known as substituted judgment and best interests and thereby threatening individuals' treatment decision-making rights as developed by other courts over the past two decades and creating serious (...) roadblocks to health-care providers' ability to render appropriate patient care. The Wisconsin Supreme Court held that Edna's legal guardian could not authorize withdrawal of Edna's treatment, ruling that as a matter of law, if an incompetent person is not in a persistent vegetative state, it is not in his or her best interests for life-sustaining treatment to be withdrawn unless (s)he has executed an advance directive or other statement clearly indicating his or her desires. Pierre Bayle was one of the most important sceptical thinkers of the seventeenth century. His work was a major influence on the development of the ideas of Voltaire (who acclaimed it for its candour on such subjects as atheism, obscenity and sexual conduct), Hume, Montesquieu and Rousseau. Banned in France on first publication in 1697, Bayle's Dictionnaire Historique et Critique became a bestseller and ran into several editions and translations. Sally L. Xenotransplantation, or the use of animal cells, tissues and organs for humans, has been promoted as an important solution to the worldwide shortage of organs. While scientific studies continue to be done to address problems of rejection and the possibility of animal-to-human virus transfer, socio-ethical and legal questions have also been raised around informed consent, life-long monitoring, animal welfare and animal rights, and appropriate regulatory practices. Many calls have also been made to consult publics before policy decisions are made. This (...) paper describes the Canadian public consultation process on xenotransplantation carried out by the Canadian Public Health Association in an arm’s length process from Health Canada, the ministry overseeing government health policy and regulation. Focusing on six citizen fora conducted around the country patterned after the citizen jury deliberative approach, the paper describes the citizen panelists’ recommendations to hold off on proceeding with clinical trials and the rationales behind this recommendation. The consultation process is discussed in the context of constructive technology assessment, a framework which argues for broader input into earlier stages of technology innovation, particularly at the technology design stage. Stem cell tourism is a small but growing part of the thriving global medical tourism marketplace. Much stem cell research remains at the experimental stage, with clinical trials still uncommon. However, there are over 700 clinics estimated to be operating in mostly developing countries – from Costa Rica and Argentina to China, India and Russia – that have lured many patients, mostly from industrialized countries, driven by desperation and hope, which in turn continue to fuel the growth of such tourism.While (...) much research has focused on such dimensions as the promotions that allow such businesses to make their services known, media coverage, some patient research, and regulatory conditions for developing country clinics, little attention has been paid to the non-affected members of the general population, the future potential users of such services. This empirical study based on five focus group discussions with a diverse group of healthy adults in a Canadian city, explored participant views of patients who use stem cell tourism services, the likelihood they would avail themselves of such services if they were to suffer similar illnesses, and the conditions under which they might do so, and the impact that admonitions and advice from international expert bodies might have on their decisions. Our findings suggest that these healthy adults are sympathetic to the drivers of hope and desperation, and, despite cautions about research limitations, may seek such treatments themselves under similar conditions. These findings are discussed in the context of the policy and ethical issues raised by this form of medical tourism. (shrink)
O presenta artigo se constitui em um estudo interpretativo a respeito dos efeitos da inserção maciça de tecnologias conectadas à rede mundial de computadores, em nossa cultura. Celebradas a ponto de se alastrarem como objeto de desejo por toda a parte, essas tecnologias, sobretudo as mídias móveis, têm se tornado ubíquas e não há um único segmento da sociedade que não tenha sido tocado por essa inserção. A educação formal em nosso país, por meio de políticas públicas como o Programa (...) Nacional de Tecnologia Educacional – Proinfo, procurou introduzir nas escolas da rede recursos para agregar qualidade ao nosso ensino básico, sabidamente precário. Entretanto a iniciativa se depara com resistências de toda a sorte, tanto por parte de gestores quanto de professores. Esse artigo pondera sobre essas resistências procurando ultrapassas questões, tais como falta de capacitação dos gestores, incidência de problemas técnicos ou mera falta interesse nas tecnologias. Busca pistas dessa oposição silenciosa a partir das alterações promovidas pela “virtualidade” na relação simbólica do sujeito com o meio, incidindo na esfera de sua identidade. (shrink)
Abstract This paper addresses the question of how the values of the kibbutz are presented and tested in six school?based curricula. The research reported here indicated that kibbutz values in school?based curricula are studied mainly by the examination of these values as ideals vis?à?vis the probability of their realisation and their practical application. Planners and teachers alike attempt to cope with this gap by promoting tolerance towards a partial and compromising realisation of values which fall short of absolute ideals, and (...) by examining practical solutions to dilemmas of principle explicit in kibbutz life. Moreover, the findings indicate that the most frequently practised way to present and teach kibbutz values is a neutral, objective approach that does not oblige the teacher to take a stand. This apparently stems from the ambivalent attitude of the teachers as individual kibbutz members towards the kibbutz way of life. (shrink)
Lotman’s contribution to semiotic theory, anthroposemiotics, the study of artistic texts and defining the relationship between language and culture represent some of the most powerful work produced within the Tartu–Moscow School of Semiotics. The importance of translation is one of the central principles that unites all of Lotman’s work. In the following paper, we will consider Lotman’s definition of translatability in the context of (1) the definition of semiospheric internal and external boundaries and the importance of crossing these boundaries, (2) (...) the role of no fewer than two languages as a minimal unit of semiotic meaning-generation, (3) culture text-level generation of collective memory, and (4) the ever-present tension in the communication act. In our concluding section, we will offer an extended model of the communication act, based on the fundamental principles given in Jakobson, Sebeok and Lotman, in order to specify important moments of the translation process.
