Ideal rule utilitarianism says that a moral code C is correct if its acceptance maximizes utility; and that right action is compliance with C. But what if we cannot accept C? Rawls and L. Whitt suggest that C is correct if accepting C maximizes among codes we can accept; and that right action is compliance with C. But what if merely reinforcing a code we can't accept would maximize? G. Trianosky suggests that C is correct if reinforcing it maximizes; and (...) that right action is action that has the effect of reinforcing compliance with C. I object to this and argue that C is correct if both accepting and reinforcing C would maximize and if C is reinforcible; and that right action consists in coming as close as possible to perfect acceptance of and compliance with C. This collection of essays presents Jeffrie G. Murphy's most recent ideas on punishment, forgiveness, and the emotions of resentment, shame, guilt, remorse, love, and jealousy. In Murphy's view, conscious rationales of principle -- such as crime control or giving others what in justice they deserve -- do not always drive our decisions to punish or condemn others for wrongdoing. Sometimes our decisions are in fact driven by powerful and rather base emotions such as malice, spite, envy, and cruelty. But our (...) decisions to punish or condemn can also be driven by noble emotions. Indeed, if we punish to express the justified resentment and indignation that decent people feel toward the wronging of a human being, punishment and condemnation can be seen acts of love. Once we realize the vital roles that emotions can play in punishment and other forms of condemnation, we can explore them in a variety of important ways. Jealousy sometimes causes crimes, forgiveness allows us to overcome resentment, and mercy - inspired by compassion-- limits the severity of punishment. Metaethics is a perennially popular subject, but one that can be challenging to study and teach. As it consists in an array of questions about ethics, it is really a mix of (at least) applied metaphysics, epistemology, philosophy of language, and mind. The seminal texts therefore arise out of, and often assume competence with, a variety of different literatures. It can be taught thematically, but this sample syllabus offers a dialectical approach, focused on metaphysical debate over moral realism, which spans (...) the century of debate launched and framed by G. E. Moore's Principia Ethica. The territory and literature are, however, vast. So, this syllabus is highly selective. A thorough metaethics course might also include more topical examination of moral supervenience, moral motivation, moral epistemology, and the rational authority of morality. This is one of the few clear, accessible, and comprehensive surveys of the subject, written by someone sympathetic with moral naturalism. Researchers working on children’s moral understanding maintain that the child’s capacity to distinguish morality from convention shows that children regard moral violations as objectively wrong (e.g. Nucci, L. (2001). Education in the moral domain. Cambridge: Cambridge University Press). However, one traditional way to cast the issue of objectivism is to focus not on conventionality, but on whether moral properties depend on our responses, as with properties like icky and fun. This paper argues that the moral/conventional task is inadequate for assessing (...) whether children regard moral properties as response-dependent. Unfortunately, children’s understanding of responsedependent properties has been neglected in recent research. Two experiments are reported showing that children are more likely to treat properties like fun and icky as response-dependent than moral properties like good and bad. This paper builds on previous work by Sirgy, M. J. (1999), Journal of Business Ethics 19, 193–206, dealing with issues of code of conduct of marketing educators. Sirgy developed a discussion document outlining a semblance of what might be construed as a code of ethics for marketing educators. The discussion document was debated and accompanied by three commentaries (Ferrell, O. C.: 1999, Journal of Business Ethics 19, 225–228; Kurtz, D. L.: 1999, Journal of Business Ethics 19, 207–209; Malhotra, (...) N. and G. L. Miller: 1999, Journal of Business Ethics 19, 211–224). One conclusion derived from the discussion document and the commentaries is the need to develop a code of ethics involving behaviors that most marketing educators find morally unacceptable. The current paper reports on a descriptive study involving a survey of marketing educators in which survey respondents were asked to rate the extent to which certain behaviors are deemed acceptable or unacceptable. The results of the survey identified certain behaviors deemed unacceptable by the vast majority of survey respondents. This evidence of hypernorms (a concept derived from social contract theory) within the community of marketing educators was used to propose an initial code of ethics. (shrink)
To hold an error theory about morality is to endorse a kind of radical moral skepticism—a skepticism analogous to atheism in the religious domain. The atheist thinks that religious utterances, such as “God loves you,” really are truth-evaluable assertions (as opposed to being veiled commands or expressions of hope, etc.), but that the world just doesn’t contain the items (e.g., God) necessary to render such assertions true. Similarly, the moral error theorist maintains that moral judgments are truth-evaluable assertions (thus contrasting (...) with the noncognitivist), but that the world doesn’t contain the properties (e.g., moral goodness, evil, moral obligation) needed to render moral judgments true. In other words, moral discourse aims at the truth but systematically fails to secure it. If there is no such property as moral wrongness, for example, then no judgment of the form “X is morally wrong” will be true (where “X” denotes an actual action or state of affairs). Advocates of this position include Hinckfuss 1987; Joyce 2001; Mackie 1977 (see MACKIE, J. L.). Various forms of moral skepticism—some of which are arguably instances of the error theoretic stance—have been familiar to philosophers since ancient times. (See SKEPTICISM, MORAL.) Error theoretic views can be controversial—as in the case of religion and morality—or widely agreed upon—as in the case of ghosts and phlogiston. It is important to note that error theorists maintain that the judgments in question are erroneous not merely because of the absence of any objective moral facts sufficient to render them true, but also because of the absence of any non-objective moral facts sufficient to render them true. There is, for example, a kind of moral realist who maintains that moral properties are objective features of the universe (see REALISM, MORAL). There is also a family of metaethical views according to which moral properties are in some manner constituted by us—by our beliefs, attitudes, practices, etc.. (shrink)
The one central point in all my writing on this top i c , f rom “ Fa m i n e , Af f luence and Morality” onward,has been that the failure of people in the rich nations to make any significant sacrifices in order to assist people who are dying from poverty - related causes is ethically ind efensible. It is not simply the absence of charity, let alone of m oral saintliness: It is wron g, and on (...) e cannot claim to be a morally decent person unless one is doing far more than the typical comfortably-off person does. Nothing Kuper has said, either in his original article or his reply to my response, contradicts this central claim. His arguments go to the details of how best we can assist people in desperate poverty. Perhaps instead of giving mon ey to Ox f a m , he su gge s t s , we should buy goods from su pp l i ers wh o ensure a fair return to laborers in developing countries. Perhaps we should stop going to F l orida and Pa ri s , and inste ad go on environ m en t a lly su s t a i n a ble and non ex p l oi t ative trips to devel oping co u n tri e s . Perh a p s we should support movements against corru pti on , or for bet ter terms of trade for devel oping co u n tri e s . I ’d be very happy if people would do any or all of these things, and if they have nothing left over to give to Ox f a m , that wo u l d n’t tro u ble me ei t h er. In contrast to many of his contemporaries, A. J. Ayer was an analytic philosopher who had sustained throughout his career some interest in developments in the work of his ‘continental’ peers. Ayer, who spoke French, held friendships with some important Parisian intellectuals, such as Camus, Bataille, Wahl and Merleau-Ponty. This paper examines the circumstances of a meeting between Ayer, Merleau-Ponty, Wahl, Ambrosino and Bataille, which took place in 1951 at some Parisian bar. The question under discussion during this meeting was (...) whether the sun existed before humans did, over which the various philosophers disagreed. This disagreement is tangled with a variety of issues, such as Ayer’s critique of Heidegger and Sartre (inherited from Carnap), Ayer’s response to Merleau-Ponty’s critique of empiricism, and Bataille’s response to Sartre’s critique of his notion of ‘unknowing’, which uncannily resembles Ayer’s critique of Sartre. Amidst this tangle one finds Bataille’s statement that an ‘abyss’ separates English from French and German philosophy, the first recorded announcement of the analytic-continental divide in the twentieth century. Calls for the expansion of ethics education in the business and accounting curricula have resulted in a variety of interventions including additional material on ethical cases, the code of conduct, and the development of new courses devoted to ethical development [Lampe, J.: 1996]. The issue of whether ethics should be taught has been addressed by many authors [see for example: Hanson, K. O.: 1987; Huss, H. F. and D. M. Patterson: 1993; Jones, T. M.: 1988–1989; Kerr, D. S. and L. (...) M. Smith: 1995; Loeb, S. E.: 1988; McDonald, G. M. and G. D. Donleavy: 1995]. The question addressed in this paper is not whether ethics should be taught but whether accounting students can reason more ethically after an intervention based on a discrete and dedicated course on accounting ethics. The findings in this paper indicate that a discrete intervention emphasising dilemma discussion has a positive and significant effect on students’ moral reasoning and development. The data collected from interviews suggest that the salient influences on moral judgement development include: learning theories of ethics particularly Kohlberg’s theory of cognitive moral reasoning and development; peer learning; and moral discourse. The implications from the findings in this study suggest that moral reasoning is responsive to particular types of ethics intervention and educators should carefully plan their attempts to foster moral judgement development. In a recent paper that appeared in this journal Fritz Allhoff addresses the morality of bluffing in negotiations1. He focuses on cases in which people misstate their reservation price in negotiations, e.g., suppose that I am selling a house and tell a prospective buyer that $300,000 is absolutely the lowest price that I will accept, when I know that I would be willing to accept as little as $270,000 for the house rather than continue to try to sell it. Allhoff (...) criticizes my (qualified) defense of bluffing in my paper Second Thoughts on Bluffing,2 and offers what he takes to be a more plausible defense of bluffing. Allhoffs criticisms rest on several serious misinterpretations of my views. He ascribes to me several arguments that I dont make. He also attributes to me an unqualified defense of bluffing that I explicitly reject. I briefly document this in Section 1. In Sections 2 and 3 I explain and criticize Allhoffs positive views about bluffing and the morality of bluffing. (shrink)
Gilbert Harman’s defense of moral relativism is distinctive because it is grounded upon a fundamental theory of moral obligation, and not merely upon certain well-known anthropological facts (e.g., cultural diversity). Harman’s theory of moral obligation is a particular form of “internalism”-roughly, that to have a moral obligation, one must have some adequate motivation (either dispositional or occurrent) to observe such constraints on action. It is argued, in the present piece, that Harman’s version of internalism fails to account for the sense (...) of using common moral judgments for the purposes of moral education (there is, in other words, a relativism that exists between those with more complex moralities and those who are just learning moral ideas). But this use of moral judgments seems to be crucial in moral education. Since this is so, this difficulty poses an important anomaly to Harman’s relativistic moral theory. (shrink)

Longtemps méconnue, l'herméneutique universelle des Lumières connaît actuellement un regain considérable d'intérêt. Après une caractérisation générale du profil de cette herméneutique, l'étude se focalise sur le Précis d'herméneutique de G.F. Meier, en prenant pour guide la thèse que le principe d'équité herméneutique forme l'âme de toute herméneutique qui se veut philosophique. Même s'il paraît difficile de faire encore de ce principe la clé de voûte épistémologique de l'herméneutique, les thèses de Meier relatives à ce principe conservent toute leur actualité, notamment (...) dans les débats anglo-saxons récents relatifs au « principle of charity », de même qu'elles montrent la voie à une éthique de l'interprétation. The triumph of the romantic paradigm of hermeneutics as a general theory of understanding has partially hidden the former general hermeneutics of the Enligthment. In the current discussion about radical interpretation, we have good reasons to rediscover this older model. G.F. Meier's idea of a general hermeneutics including natural as well as artificial signs is under this respect of a special interest. The article focusses on Meier's statement that the principle of hermeneutic equity is the soul of a philosophical hermeneutics. Although it is impossible to maintain this principle as the epistemological foundation of hermeneutics, it shows the way toward an ethics of interpretation, which shades a new light on the debates regarding the so-called « principle of charity ». Societies vary in their levels of social inequality and in the degree of popular support for policies that reduce disparities within them. Survey research in Texas, where levels of disparity in health and medical care are relatively high, studied how psychological mechanisms of moral disengagement relate to public support for expanding access to government-subsidized health care. Telephone interviews ( N = 1,063) measured agreement with statements expressing tendencies to minimize the effects of inequality, blame its victims and morally justify limits (...) on government help. The interviews also assessed support for general and specific policies to reduce inequality, e.g., through state-subsidized health care for lower income groups, as well as political party affiliation, ideological orientation, gender, age, education and income. Agreement with beliefs expressing moral disengagement was associated with opposition to governmental policies to reduce inequality in children’s health care. Beliefs that justify the withholding of government assistance, blame the victims of societal inequality, and minimize perceptions of their suffering were strongly related to variation between and within groups in support for governmental action to reduce inequality. H. L. A. Hart, in his classic book Law, Liberty, and Morality, is unsuccessful in arguing that James Fitzjames Stephen’s observations about the role of vice in criminal sentencing have no relevance to a more general defense of legal moralism. He does, however, have a very important insight about the special significance of sexual liberty.
A more complete methodology for normative ethics is needed, and Kierkegaard's philosophy, which emphasizes the individual's role in moral decision-making, can help to meet this need. This essay discusses two ways in which Kierkegaard sought to expand a commonly accepted conception of morality. First, he stressed that the agent changes as part of the process of moral decision-making, with personal experience and insight integral parts of that process. Second, Kierkegaard included within the realm of morality decisions (e.g., about occupation) which (...) are normally viewed as simply matters of personal preference. (shrink)
Wittgenstein hérite de Frege l'idée d'une égalité de statut entre affirmation et négation, mais au lieu d'en tirer la thèse d'une absence de force de la négation, il en restaure au contraire la force alors même qu'il ne lui correspond aucune objectivité. D'où vient cette force ? Cette force serait d'expression. Dans cet article, je montre que Wittgenstein n'est finalement pas intéressé par la question sémantique de la négation, mas plutôt par cette attitude propre au philosophe consistant à ne pas (...) faire cas de son symbolisme opératoire, ce qui l'entraîne indûment à s'interroger sur son essence cachée.S'agissant du cas de la négation, Wittgenstein montre comment s'attaquer à la source de notre errement plutôt qu ' à la source de la signification justifiant son usage. Il « traite » ainsi ce qu'il appelle dans une de ses Dictées le « problème de Socrate » . L'impasse sur le symbolisme de la négation est un symptôme d'aveuglement au symbolisme. Reste donc à saisir l'articulation du signe avec le symptôme, soit entre deux espèces de traits que Wittgenstein tient pour hétérogènes. Pourtant, dans son combat contre les préjugés grammaticaux, Wittgenstein entend bien redonnera l'expression du signe une importance qui permet de comprendre en même temps son action sur le symptôme (sa disparition).Dans la « résolution » , une certaine concomitance freudienne entre les deux est donc présupposée. Nous examinons ce point de rencontre avec Freud tout en distinguant leurs conceptions respectives du grammatical. Wittgenstein inherits Frege's conception of equality of status of negative and positive assertions. Yet, far from concluding with Frege that the negation is weak, he restores its strength while at the same time he thinks it is devoid of objectivity since negative facts do not exist. Where does this strength come from ? The answer is : from its sole expressivity. My contention is therefore to show that Wittgenstein is less interested in the semantics of negation than in the philosopher's attitude which consists in neglecting the symbolic operation of negating, hence his questioning the essence of negation.Against this « symptom » Wittgenstein calls « Socrates ' problem » , the right thing to do is to cure it by tracing back the wot of our being misled by grammatical prejudices rather than to look for the source of meaning. What is to be treated is our blindness to symbolism. However we are left with a question concerning the connection between the sign of negation and the « symptom » resulting from omitting the latter. The difficulty arises from the fact that for Wittgenstein they belong to two different realms, while at the same time he seems to assume that the sole strength of expressing negation as a symbol could effect the desappearing of the symptom e.g. the « solution » of the « problem » . It is impossible to appraise this meeting-point between Wittgenstein and Freud without taking into account their respective conceptions of « the grammatical ». (shrink)

Abstract: A cognitive?developmental approach to the phenomenon of empathy attempts to describe the age related (but not age specific) development of empathic understanding as a function of the development of basic social?cognitive processes and concepts. Recent research indicates that there are developmental levels in the process by which the child comes to know how his own view of self and other relates to the view of other (social perspective?taking) and related levels in conceptions of persons. Drawing upon our own research (...) as well as the theory of J. M. Baldwin, G. H. Mead, and L. Kohlberg, we describe these developing processes and concepts and hypothesize as to the relation of social perspective?taking to each level of developing forms of empathic understanding. (shrink)
Abstract The paper presents a critique of the values clarification model as developed by Louis E. Raths and associates in such works as Values and Teaching: Working with Values in the Classroom and Values Clarification: A Handbook of Suggestions. After presenting an overview of the central recommendations of the authors, they are critically evaluated with reference to theoretical considerations and to other models of moral and values education. Values clarification methods are found to rest on untried empirical assumptions and seriously (...) insufficient theoretical foundations. A distinctive contribution to values education, and one that has had considerable influence on teaching practice in this area, particularly in the USA over the past ten years, is a teaching method of values clarification put forward by Louis E. Raths, Merrill Harmin and Sidney B. Simon in their book Values and Teaching: Working with Values in the Classroom.1 There the authors recommend certain teaching strategies employed to some extent by other values educators whose main writings in the field have appeared since this book was first published, e.g. Peter McPhail, Lawrence Stenhouse, Milton Meux, the AVER group at the University of British Columbia, and John Wilson.2. Contemporary Western culture is experiencing a heightened awareness of religious diversity. This article surveys a range of possible responses to such diversity, and distinguishes between responses that concern the salvation or moral transformation of persons (soteriological views) and those that concern the alethic or epistemic status of religious beliefs (doctrinal views). After providing a brief taxonomy of these positions and their possible relations to one another, the article focuses primarily on competing views about the truth and rationality of religious beliefs (...) (e.g., pluralism, exclusivism, and skepticism). Here a heavy emphasis is placed on arguments for and against the rationality and moral propriety of retaining one's religious beliefs in the face of disagreement. The article surveys some of the more prominent arguments from the literature on this topic and closes with suggestions for further research. (shrink)
An inquiry into the possibility that life?after?death be understood as waking from a shared dream into the real world. Attempts to outlaw the possibility that ?really? we are, e.g., vat?brains are shown to lead to unwelcome, anti?realist conclusions about either the world or consciousness. The unsatisfactory nature of empirically observable (Humean) causal connections suggests that real causes may be found beyond the world of our present experience. Though such a story cannot now be proved to be true, we are entitled (...) to entertain it as a serious possibility. An attempt is made to say what life is like in the ?Real World?, whether this be a spatial world like our present one or not, and what moral it holds for our present life. I suggest (like Plato) that there are many levels of waking, and that our ?Real Self should not be identified simply with our present egos. (shrink)
This article introduces a new scale to measure executive servant leadership, situating the need for this scale within the context of ethical leadership and its impacts on followers, organizations and the greater society. The literature on servant leadership is reviewed and servant leadership is compared to other concepts that share dimensions of ethical leadership (e.g., transformational, authentic, and spiritual leadership). Next, the Executive Servant Leadership Scale (ESLS) is introduced, and its contributions and limitations discussed. We conclude with an agenda for (...) future research, describing ways the measure can be used to test hypotheses about organizational moral climate, ethical organizational culture, corporate responsibility, and institutional theory. Cassirer hat sich — wie der späte Cohen und der späte Natorp — von der Marburger Beschränkung auf Erkenntnistheorie entfernt. In bisher unpublizierten Texten aus der Emigrationszeit befaßte Cassirer sich mit dem Problem der Metaphysik. Goethes Lehre von den Urphänomenen und die Gestalttheorie Kurt Goldsteins beeinflußten Cassirers späte Theorie der « Basisphänomene ». Diese neue Denkrichtung knüpfte an die Symboltheorie Cassirers an und wies auf ihren Ausgang hin. Tout comme Cohen et Natorp dans leur œuvre tardive, Cassirer s'est situé au-delà (...) de la théorie de la connaissance à laquelle l'École de Marbourg entendait se limiter. Dans des textes écrits durant son exil et qui n'ont pas encore été publiés, Cassirer aborde la problématique de la métaphysique. La théorie gœthéenne des phénomènes originaires comme la théorie de la forme développée par Kurt Goldstein ont influencé la réflexion tardive de Cassirer sur les « phénomènes de base ». J. L. A. Garcia holds that my defense of voluntary euthanasia in an earlier paper amounts to an "assault on traditional common sense" about what medical ethics permits physicians to do, particularly insofar as I hold that a physician's duty to abstain from intentionally killing is only a defeasible duty, not an unconditional one. But I argue here that it is Garcia's views that are more at odds with common sense, and that voluntary euthanasia is in fact a humane alternative (...) that respects patient autonomy and is consistent with the most fundamental moral duties of physicians. Among these is a duty to relieve suffering, which can sometimes outweigh the fundamental duty to conserve life. (shrink)
This research examines the association between attitudes on cheating and cognitive moral development. In this research, we use Rest's (1979a) Defining Issues Test, the Attitudes on Honesty Scale (Authors) and Academic Integrity Index (Authors); the last two are adaptations of the DIT. A total of 220 students from three universities participated in the study (66 psychology majors and 154 business majors). The data indicate that 66.4 percent of the students reported that they cheated in high school, college, or both high (...) school and college. Psychology majors scored higher than business majors on both the Defining Issues Test (Rest, 1979a) and the Attitudes on Honesty Scale (AHS, Authors). Using factor analysis, we found significant associations between students' ratings of the importance considerations present in the three cheating scenarios and their estimates of whether cheating would occur (i.e., the Academic Integrity Index). Finally, using logistic regression, we found that the scores on the Attitudes on Honesty Scale and Academic Integrity Index associate with the self-reported cheating behavior of college students. In a world which can be increasingly described as a “society of organizations,” it is incumbent upon organizational researchers to account for the role of organizations in determining the well-being of societies and the individuals that comprise them. Workplace spirituality is a young area of inquiry with potentially strong relevance to the well-being of individuals, organizations, and societies. Previous literature has not examined ethical dilemmas related to workplace spirituality that organizations might expect based upon the co-existence of multiple ethical work (...) climates, nor has previous literature accounted for the relevance of the cosmopolitan (external, societal) source of moral reasoning in the ethical treatment of workplace spirituality. The purpose of this paper is to address these gaps by articulating two such ethical dilemmas related to workplace spirituality: the “quiet desperation” dilemma and the instrumentality dilemma. Moreover, I propose two theoretical contexts that foster “both-and” rather than “either-or” thinking, thereby mitigating (moderating) the relationships between climate combinations and conflictual aspects of the ethical dilemmas. For the “quiet desperation” dilemma, I propose a person–organization fit perspective to emphasize diversity of individual preferences instead of a managerially prescribed uniformity of spirituality. For the instrumentality dilemma, I propose a multiparadigm approach to workplace spirituality research to avoid the privileging of one research interest over another (e.g., instrumentality, individual fulfillment, societal good). There are human beings whose psychological capacities are rivalled or exceeded by many non-human animals; such humans are often referred to as 'marginal cases'. R G Frey has argued that there is no secure, non-arbitrary way of morally distinguishing between marginal humans and non-human animals. Hence, if the benefits of vivisection justify such painful and lethal procedures being performed on animals, so is the vivisection of marginal humans justified. This is a conclusion Frey is driven to with 'great reluctance', but (...) which he can see no way to avoid. This paper points out a feature of the condition of marginal humans unnoticed by Frey and his critics: such humans have suffered a tragic harm. It points towards an analysis of this harm, in terms of counterfactuals holding for marginal humans but not for psychologically equivalent animals. Finally, it discusses the moral implications of the harm that such humans have suffered, and argues that it serves as the basis of a defence for preferring humans to non-humans in cases of morally inescapable conflict. European animal disease policy seems to find its justification in a “harm to other” principle. Limiting the freedom of animal keepers—e.g., by culling their animals—is justified by the aim to prevent harm, i.e., the spreading of the disease. The picture, however, is more complicated. Both during the control of outbreaks and in the prevention of notifiable, animal diseases the government is confronted with conflicting claims of stakeholders who anticipate running a risk to be harmed by each other, and who ask (...) for government intervention. In this paper, we first argue that in a policy that aims to prevent animal diseases, the focus shifts from limiting “harm” to weighing conflicting claims with respect to “risks of harm.” Therefore, we claim that the harm principle is no longer a sufficient justification for governmental intervention in animal disease prevention. A policy that has to deal with and distribute conflicting risks of harm needs additional value assumptions that guide this process of assessment and distribution. We show that currently, policies are based on assumptions that are mainly economic considerations. In order to show the limitations of these considerations, we use the interests and position of keepers of backyard animals as an example. Based on the problems they faced during and after the recent outbreaks, we defend the thesis that in order to develop a sustainable animal disease policy other than economic assumptions need to be taken into account. Over the past three or four decades, the concept of medical ethics has changed from a limited set of standards to a broad field of debate and research. We define medical ethics as an arena of moral issues in medicine, rather than a specific discipline. This paper examines how the disciplines of health care ethics and health care law have developed and operated within this arena. Our framework highlights the aspects of jurisdiction (Abbott) and the assignment of responsibilities (Gusfield). This (...) theoretical framework prompted us to study definitions and changing responsibilities in order to describe the development and interaction of health care ethics and health law. We have opted for the context of the Dutch debate about end-of-life decisions as a relevant case study. We argue that the specific Dutch definition of euthanasia as 'intentionally taking the life of another person by a physician, upon that person's request' can be seen as the result of the complex jurisdictional process. This illustrates the more general conclusion that the Dutch debate on end-of-life decisions and the development of the two disciplines must be understood in terms of mutual interaction. (shrink)
I explore some new directions-suggested by feminism-for medical ethics and for philosophical ethics generally. Moral philosophers need to confront two issues. The first is deciding which moral issues merit attention. Questions which incorporate the perspectives of women need to be posed-e.g., about the unequal treatment of women in health care, about the roles of physician and nurse, and about relationship issues other than power struggles. "Crisis issues" currently dominate medical ethics, to the neglect of what I call "housekeeping issues." The (...) second issue is how philosophical moral debates are conducted, especially how ulterior motives influence our beliefs and arguments. Both what we select-and neglect-to study as well as the "games" we play may be sending a message as loud as the words we do speak on ethics. (shrink)
Cette étude a pour but de situer la discussion sur l'égalité économique dans le contexte existentiel qui lui est approprié. Interprétant le système économique non seulement comme un système de production et de distribution, mais aussi comme un lieu où s'opère une certaine forme de « colmatage existentiel » individuel, nous étudions les rouages enfouis du système économique qui pourraient expliquer pourquoi les arguments classiques d'incitation, souvent invoqués par la théorie économique égalitariste, peuvent cacher des obstacles puissants à l'égalité. Nous (...) mettons en question les approches des incitations développées par G. A. Cohen et Philippe Van Parijs et nous avançons une approche existentielle inspirée notamment de Norman O. Brown et de Ernest Becker, selon qui l'économie peut aisément devenir le lieu du déni de la corporéité et de la mortalité. L'égalité économique, dès lors, ne peut être atteinte pleinement qu'en couplant la philosophie politique avec l'analyse existentielle et spirituelle des conditions d'assumption individuelle du corps mortel. This study seeks to locate the discussion on economic equality within an appropriate existential context. Seeing the economic system not only as a system of production and distribution, but also as the locus where a certain form of individual « existential containment » is taking place, we study those buried underpinnings of the economic system which could explain why classical incentive arguments often used by economists might hide powerful obstacles to equality. The approaches to incentives proposed by G. A. Cohen and Philippe Van Parijs are discussed and questioned, and an alternative approach is suggested, inspired partially by Norman O. Brown and Ernest Becker, for whom the economy can easily become the locus of a denial of corporeity and mortality. Thus, economic equality can be fully attained only by coupling political philosophy with the existential and spiritual analysis of the conditions under which individuals can accept their mortal body. This article presents an overview ofregulations, guidelines and societal debates ineight member states of the EC about a)embryonic and fetal tissue transplantation(EFTT), and b) the use of human embryonic stemcells (hES cells) for research into celltherapy, including `therapeutic' cloning. Thereappears to be a broad acceptance of EFTT inthese countries. In most countries guidance hasbeen developed. There is a `strong' consensusabout some of the central conditions for `goodclinical practice' regarding EFTT.International differences concern, amongstothers, some of the informed consent issuesinvolved, and the (...) questions whether anintermediary organisation is necessary, whetherthe methods of abortion may be influenced bythe possible use of EFT, and whether EFTTshould only be used for the experimentaltreatment of rare disorders. The potential useof hES cells for research into cell therapy hasgiven a new impetus to the debate about (human)embryo research. The therapeutic prospects withregard to the retrieval and research use of hEScells appear to function as a catalyst for theintroduction of less restrictive regulationsconcerning research with spare embryos, atleast in some European countries. It remains tobe seen whether the prospect of treatingpatients suffering from serious disorders withtransplants produced by therapeutic cloningwill decrease the societal and moral resistanceto allowing the generation of embryos for`instrumental' use. In this paper I examine some logical features of Marxist/Christian compatibilist projects. I use Arthur McGovern’s Marxism: An American Christian Perspective as my chief stalking horse. As an heuristic device, I distinguish the views in Marx’s early writings (Marxist humanism--M-I)from the more mature theory of historical materialism (M-2), where the latter is construed primarily as a social scientific method for the explanation of historical change. I also distinguish C-1, the moral teachings of Jesus, from C-2, Christian theology. I argue that (...) the logic of Christian compatibilism requires the acceptance of C-1, C-2, and M-2, while it must reject or downplay M-l, Marxist humanism. Similarly, the logic of a Marxist compatibilism requires the acceptance of M-1, M-2, end C-1, while it must reject C-2, Christian theology. I conclude that, while Christian and Marxist compatibilists can work together in seeking to overcome capitalism and imperialism, it is more difficult to see how thedisagreements over Marxist humanism vs. Christian theology could ever be transcended. A genuine bioethics would be fiercely devoted to human life (bios) and would express that devotion by articulating as well as advocating moral virtues that rigorously protect that value against the temptation to see life in purely instrumental terms. In my view, no genuine bioethics exists today. In what follows, I will question two fundamental assumptions often presumed in discussions of euthanasia and assisted suicide. These are (i) the agent does will her victim (i.e., her putative beneficiary) some significant human (...) good, e.g., relief from pain, escape from becoming a burden to loved ones, a dignified death, or simply self-determination; (ii) in purposely helping someone to kill herself or in killing her for her own good, the agent wills her no serious harm. Put differently, I question the assumption of ‘mercy’ in so-called ‘mercy-killing’. (shrink)

This paper is a critical study of Christians among the Virtues: Theological Conversations with Ancient and Modern Ethics by Stanley Hauerwas and Charles Pinches. It has four parts. First, I consider several possible responses to G. E. M. Anscombe’s famous challenge to modern moral philosophy in order to provide a framework in which the project of Hauerwas and Pinches can be located. Next I criticize their attempt to eliminate the realm of obligation from morality. Then I examine their treatment of (...) Martha Nussbaum’s work onAristotle in order to explore differences between secular and Christian appropriations of Aristotle. Finally, I discuss their views on the virtue of obedience and criticize their arguments against rival Kantian and divine command views. (shrink)
Arguments from stability for liberal nationalism rely on considerations about conditions for the feasibility or stability of liberal political ideals and factual claims about the circumstances under which these conditions are fulfilled in order to argue for nationalist conclusions. Such reliance on factual claims has been criticised by among others G. A. Cohen in other contexts as ideological reifications of social reality. In order to assess whether arguments from stability within liberal nationalism, especially as formulated by David Miller, are (...) vulnerable to a comparable critique, the rationale for their reliance on factual claims is discussed on the basis of a number of concerns in John Rawls’s political liberalism. The concern with stability in liberal nationalism differs from stability in Rawls’s work, mainly because of the stronger non-ideal or ‘realist’ focus of the former. In so far as the ‘realism’ of arguments from stability for liberal nationalism is recognized, they are not vulnerable to the reification charge. But if the arguments are construed as realist, this at the same time makes for other tensions within liberal nationalism. (shrink)
