In the rabbinic literature from the land of Israel the poor are depicted not as passive recipients of gifts and support, but as independent agents who are responsible for their own behaviour. Communal care for the needy was expected to go beyond their basic needs for food, clothing and shelter; the physical safety of the poor and the value of their time as well as their dignity and self-worth were also included in the scope of charity. Yael Wilfand offers a comprehensive and contextual analysis of major rabbinic texts on poverty and charity composed during the first five centuries of the Common Era in the land of Israel, principally the Mishnah, the Tosefta, the Palestinian Talmud and midrashim. She shows that, for the rabbis, the poor were not necessarily considered outsiders; indeed, some students and rabbis in Palestine may have personally experienced poverty. Wilfand claims that such socio-economic diversity contributed to the thinking of these rabbis, who rarely saw poverty as a result of transgression (in contrast to the Babylonian Talmud). This book presents a number of contrasting viewpoints held by Palestinian rabbis over such questions as: Must communal administrators ensure applicants' eligibility for alms? Transitional Justice (TJ) focuses on the processes of dealing with the legacy of large-scale past abuses (in the aftermath of traumatic experiences such as war or authoritarianism) with the aim of fostering domestic justice and creating the basis for a sustainable peace. TJ however also entails the problem of how a torn society may be able to become a self-determining member of a just international order. This paper presents a minimal conception of TJ, which departs from Rawls' conception of normative (...) stability of the international order, which suggests disentangling the two goals of fostering democracy within torn societies and TJ itself. The scope of TJ is therefore limited to enabling these societies to create minimal internal conditions for joining a just international order on equal footing. This paper makes an original contribution to two different debates, namely normative research on TJ, and post-Rawlsian literature in general. First, it provides a new direction for normative theorizing about TJ which takes both its domestic and international dimensions seriously into consideration. Second, it extends Rawls' political liberal outlook to an area where it is not usually understood to apply. (shrink)

Throughout history the image of the non-Jew in Judaism has profoundly influenced the way in which Jews interact with non-Jews. It has also shaped the understanding that Jews have of their own identity, as it determines just what distinguishes them from the non-Jews around them. A crucial element in this is the concept of Noahide law, understood by the ancient rabbis and subsequent Jewish thinkers as incumbent upon all humankind, unlike the full 613 divine commandments of the Torah, which are (...) incumbent on Jews alone. The approach adopted in this now classic study is to consider the history of the idea of Noahide law, and to show how the concept is relevant to practical discussions of the halakhah pertaining to non-Jews and to relations between Jews and non-Jews. The seven chapters that make up the first part of the study examine each of the Noahide laws in turn, with a view to showing their halakhic development in the rabbinic sources, in the codes, and in the responsa literature. The discussion draws primarily on classical texts by traditional commentators as they attempt to deal with living issues from the rabbinic world as equally vital concerns in their own time. The second part deals with the theory of Noahide law, concluding with a consideration of why it is an appropriate starting point for Jewish philosophy today. (shrink)

This chapter examines the methodologies, new approaches, and challenges in the use of rabbinic literature to study the history of Judaism in late antiquity. At a time when bioethical issues are at the top of public and political agendas, there is a renewed interest in representations of the embryo in various religious traditions. One of the major traditions that have contributed to Western representations of the embryo is the Jewish tradition. This tradition poses some difficulties that may deter scholars, but also presents some invaluable advantages. These derive from two components, the search for limits and narrativity, both of which are directly connected with the (...) manner in which Jewish tradition was constructed in Antiquity. The article accomplishes three goals: • To introduce some central elements in ancient Rabbinic literature on the subject of the embryo and its representation; • To present this body of literature as clearly as possible, noting some of the difficulties encountered by scholars who engage in its study; • To explain how the literature’s textuality came about, examining the particular sociopolitical circumstances of Judaism at that time, including the reasons for the delay in the production of scientific texts, transmitted as such, as compared to other philosophical or religious traditions. The claim is that these circumstances engendered a tradition peculiarly relevant for the study and teaching of medical ethics today. (shrink)

Challenging earlier cognitivist approaches, recent theories of embodied cognition argue that the human mind and its functions are best understood as intimately bound up with the human body and its physiological dimensions. Some scholars have suggested that such theories, in departing from some core assumptions of the Western philosophical tradition, display significant similarities to certain non-Western traditions of thought, such as Buddhism. This essay extends such parallels to the Jewish tradition and argues that, in particular, classical rabbinic thought presents a (...) profoundly nondualistic account of the body–soul relation in its connection to cognition, action, and embodiment. Classical rabbinic texts therefore model the possibility of engaging with ‘Western’ conceptions such as God and the soul, while doing so in a manner that resonates strongly with many aspects of contemporary scientific theories. Thus, beyond their value as historical documents, insight into the texts and concepts of classical rabbinic Judaism can contribute to the further development of new theories of intellect and cognition. This essay explores classical rabbinic literature's understanding of the prohibition of bloodshed alongside its understanding that "the image of God" corresponds to the physically embodied individual. This conception generates radical implications so that, apart from the narrow instance of a direct aggressor with intent to kill or rape, it is never legitimate to cause the death of any person, even in pursuit of a supposed "greater good." While notions of war and execution are retained in principle, the requirement of (...) direct divine sanction for such actions neutralizes them in practice, removing them from the domain of human judgment and justification. Abstract:This study explores the relationship between beauty and intellect, often represented as diametrical opposites, in Chinese and Jewish texts, particularly with reference to Confucian and rabbinic texts. Four discourses concerning the nexus of beauty and intellect are presented: antagonistic, complementary, authentic, and epistemic. In both traditions, although more so in Confucianism, intellect is sometimes elided with moral virtue, adding another element to the discussion. The comparison of this theme in distant traditions seeks to highlight their shared resistance to a single (...) interpretation or a consistent outlook: while Confucian texts tend to embrace a complementary discourse, along the lines of a physiognomic tradition, competing views can be detected. Likewise, the rabbinic tradition inherits the biblical view that "beauty is vain" but still manifests some cases of a complementary discourse. (shrink)

Do ubiquitous modes of thought (types of analysis, types of argumentation) pervade the entire corpus of the Rabbinic writings of late antiquity and impart coherence to those diverse documents? Here are the results of a systematic probe of representative Halakhic and Aggadic documents in search of the answer to that question. The result is limited but one-sided: the answer is yes, they do. The inquiry proves urgent, because the bases for supposing the Rabbinic documents coalesce have diminished, and the differences (...) between and among the respective documents have made their mark. The book asks whether, however diverse, all of the documents conform to a single, determinate program of [1] analysis and [2] argumentation. Do they raise in common a set of questions that are ubiquitous, and do they pursue a uniform inquiry, whatever the data subject to study? Further, does a single protocol of argumentation dictate the means by which analytical propositions are advanced and tested? If they do, then Rabbinic Judaism finds coherence in shared intellectual traits. These, then, would serve to define the foundations for the construction of all components into the Rabbinic system and structure. (shrink)

RESUMEN En el siglo xi, la literatura dialógica nacida en el seno del cristianismo latino ha incluido en su repertorio de interlocutores a uno que resulta en todos los casos ficcional: el gentil. De allí que quepa preguntarse cuál es el propósito de dialogar con una otredad imaginaria. Se examinan las construcciones identitarias de los dos primeros personajes gentiles de los que hasta ahora se tiene noticia: el de la Disputatio christiani cumgentili de Gilberto Crispino y el de la (...) Disputatio inter christianum et gentilem del Pseudo-Anselmo. A partir de estas construcciones, se discutirá la función que cada gentil desempeña en su respectivo diálogo, con el objetivo de establecer qué relación mantienen estas identidades dialogantes con la intentio operis. ABSTRACT In the 11th century, the dialogical literature that emerged in the context of Latin Christianity included, among its repertoire of interlocutors, one that was always fictional: the Gentile. Thus, the question arises as to the purpose of entering into dialogue with an imaginary other. The article examines the constructions of identity of the first two known Gentile characters: that of Gilberto Crispino's Disputatio christiani cum gentili and that of Pseudo-Anselm's Disputatio inter christianum et gentilem. On the basis of these constructions, we discuss the role played by each Gentile in his respective dialogue, in order to establish the relationship between these participating identities and the intentio operis. Nach Fichte muss man das absolut erste und unbedingte Prinzip des gesamten menschlichen Wissens aufsuchen, damit die Philosophie tatsachlich Wissenschaft der Wissenschaft oder Wissenschaftslehre sein kann. Daher rekonstruiert der Autor zunachst Fichtes kritisch gegen Kant gerichtete Radikalisierung des Konzepts der Subjektivitat und die Uberschreitung der Grenze zur intellektuellen Anschauung. (...) Im zweiten Teil werden dann neue Perspektiven in der Analyse von Schellings Idealismus vorgeschlagen: Vor dem Hintergrund einer Analyse der intellektuellen, der asthetischen und der produktiven Anschauung bei Schelling wird das Verhaltnis zwischen Naturphilosophie und Transzendentalphilosophie behandelt. Im dritten Teil des Buches werden Hegels Kritik an Fichte und Schelling sowie an Kant (in der Enzyklopadie) und schliesslich die Bedeutung der Begriffe des Selbstbewusstseins und des Unendlichen vom transzendentalen Idealismus bis hin zu Hegels absolutem Idealismus untersucht. Partendo dal pensiero di Berkeley, Kant e Hegel, il filosofo elabora quello che chiama "idealismo attuale", spesso abbreviato in "attualismo", corrente che ha conosciuto grande fortuna nel periodo tra le due guerre.

Writing about secession is not an easy task for a political philosopher. Yet, writing about secession in India raises further practical and theoretical problems. The incredible task of professor Chandhoke’s book, Contested Secessions, is thus to provide a restatement of a liberal theory of secession, understood as a remedial right theory, which is still compatible with situations of contested secessions, such as those occurring in post-colonial societies like India. This paper focuses on two distinct yet related aspects of Chandhoke’s theory: (...) her distinctive version of remedial right theory, and her emphasis on a form of comprehensive pluralist liberalism. I argue that this approach might result in inconsistency due to the conflicting demands of these two approaches. If we take seriously Chandhoke’s political claim in favour of the legitimacy of what she calls “formal” democracy, further clarifications are needed with respect to the account of pluralism she proposes. Purpose: Tolerance for ambiguity (TFA) is a character trait that is associated with a multitude of benefits for physicians, including increased empathy, greater desire to work in underserved areas, fewer medical errors, enhanced psychological well-being, and lower rates of burnout. Furthermore, it has been shown that TFA is a malleable trait that can be enhanced with interventions such as art courses and group reflection. This study describes the utility of a six-week medical ethics elective course in increasing TFA in first- (...) and second-year medical students.Methods: First- and second-year medical students were enrolled in an elective medical ethics course at Cooper Medical School of Rowan University that guided students in critical thinking, group discussion, and respectful debate regarding various ethical dilemmas in medicine. Students took a validated survey before and after course completion to measure TFA. The average pre- and post-course scores for each semester, as well as the total cohort of 119 students, were compared using paired t-tests.Results: A statistically significant improvement in TFA scores was observed in the overall cohort, as well as in each individual semester of the medical ethics elective course offering.Conclusion: A six-week elective course in medical ethics can significantly improve medical students’ TFA. The Giving Voice to Values pedagogy and curriculum is described as an example of a powerful leverage point in the integration of business ethics and values-driven leadership across the business curriculum. GVV is post-decision-making in that it identifies an ethical course of action and asks practitioners to identify who are the parties involved and what’s at stake for them; what are the main arguments to be countered; and what levers that can be used to influence those who are in disagreement. The internalization of GVV’s constructs allows faculty to comfortably raise and endorse ethics as part of the natural order of business decision-making because the stakes of doing so have been normalized.
