This chapter examines the methodologies, new approaches, and challenges in the use of rabbinic literature to study the history of Judaism in late antiquity. It provides some examples that demonstrate some of the issues concerning the applicability of rabbinic literature to the study of Judaism in late-Roman Palestine. It concludes that rabbinic literature can serve as a historical source, especially when read indirectly and through the lens of well-defined theoretical frameworks, and when perceived as a rabbinic cultural (...) product that reflects delicate, sophisticated and hardly recoverable relationships between text and reality. At a time when bioethical issues are at the top of public and political agendas, there is a renewed interest in representations of the embryo in various religious traditions. One of the major traditions that have contributed to Western representations of the embryo is the Jewish tradition. This tradition poses some difficulties that may deter scholars, but also presents some invaluable advantages. These derive from two components, the search for limits and narrativity, both of which are directly connected with the (...) manner in which Jewish tradition was constructed in Antiquity. The article accomplishes three goals: • To introduce some central elements in ancient Rabbinic literature on the subject of the embryo and its representation; • To present this body of literature as clearly as possible, noting some of the difficulties encountered by scholars who engage in its study; • To explain how the literature’s textuality came about, examining the particular sociopolitical circumstances of Judaism at that time, including the reasons for the delay in the production of scientific texts, transmitted as such, as compared to other philosophical or religious traditions. The claim is that these circumstances engendered a tradition peculiarly relevant for the study and teaching of medical ethics today. (shrink)

Challenging earlier cognitivist approaches, recent theories of embodied cognition argue that the human mind and its functions are best understood as intimately bound up with the human body and its physiological dimensions. Some scholars have suggested that such theories, in departing from some core assumptions of the Western philosophical tradition, display significant similarities to certain non-Western traditions of thought, such as Buddhism. This essay extends such parallels to the Jewish tradition and argues that, in particular, classical rabbinic thought presents a (...) profoundly nondualistic account of the body–soul relation in its connection to cognition, action, and embodiment. Classical rabbinic texts therefore model the possibility of engaging with ‘Western’ conceptions such as God and the soul, while doing so in a manner that resonates strongly with many aspects of contemporary scientific theories. Thus, beyond their value as historical documents, insight into the texts and concepts of classical rabbinic Judaism can contribute to the further development of new theories of intellect and cognition. Judaism is often described as a religion that tolerates, even celebrates arguments with God. In Pious Irreverence, Dov Weiss has written the first scholarly study of the premodern roots of this distinctively Jewish theology of protest, examining its origins and development in the rabbinic age (70 CE-800 CE).

This essay explores classical rabbinic literature's understanding of the prohibition of bloodshed alongside its understanding that "the image of God" corresponds to the physically embodied individual. This conception generates radical implications so that, apart from the narrow instance of a direct aggressor with intent to kill or rape, it is never legitimate to cause the death of any person, even in pursuit of a supposed "greater good." While notions of war and execution are retained in principle, the requirement of (...) direct divine sanction for such actions neutralizes them in practice, removing them from the domain of human judgment and justification. In the rabbinic literature from the land of Israel the poor are depicted not as passive recipients of gifts and support, but as independent agents who are responsible for their own behaviour. Communal care for the needy was expected to go beyond their basic needs for food, clothing and shelter; the physical safety of the poor and the value of their time as well as their dignity and self-worth were also included in the scope of charity. In this monograph, (...) Yael Wilfand offers a comprehensive and contextual analysis of major rabbinic texts on poverty and charity composed during the first five centuries of the Common Era in the land of Israel, principally the Mishnah, the Tosefta, the Palestinian Talmud and midrashim. She shows that, for the rabbis, the poor were not necessarily considered outsiders; indeed, some students and rabbis in Palestine may have personally experienced poverty. Wilfand claims that such socio-economic diversity contributed to the thinking of these rabbis, who rarely saw poverty as a result of transgression (in contrast to the Babylonian Talmud). This book presents a number of contrasting viewpoints held by Palestinian rabbis over such questions as: Must communal administrators ensure applicants' eligibility for alms? Should the newly indigent from wealthy families receive exceptional levels of support? Might neighbouring gentiles qualify for economic assistance from Jewish communal sources? By examining Palestinian rabbinic sources within the contexts both of the hegemonic Greco-Roman (later, Christian) milieu and of the biblical heritage, this volume offers an absorbing account of some ancient approaches to timeless social challenges. Abstract:This study explores the relationship between beauty and intellect, often represented as diametrical opposites, in Chinese and Jewish texts, particularly with reference to Confucian and rabbinic texts. Four discourses concerning the nexus of beauty and intellect are presented: antagonistic, complementary, authentic, and epistemic. In both traditions, although more so in Confucianism, intellect is sometimes elided with moral virtue, adding another element to the discussion. The comparison of this theme in distant traditions seeks to highlight their shared resistance to a single (...) interpretation or a consistent outlook: while Confucian texts tend to embrace a complementary discourse, along the lines of a physiognomic tradition, competing views can be detected. Likewise, the rabbinic tradition inherits the biblical view that "beauty is vain" but still manifests some cases of a complementary discourse. (shrink)

This chapter aims to define to state of investigation of research into rabbinic literature. It describes the most important approaches in research on the basis of which rabbinic literature has been and is being studied. These include the traditional halakhic approach, the exploitative-apologetic approach, and the thematic approach. This chapter concludes that the questioning of the redactional identity of the individual works of rabbinic literature inevitably also disavows the research approach to the work at the level of (...) the final redaction. The rabbis found a measure of David's importance in the importance of his son Solomon, and an echo of that same sentiment is also at work in the New Testament traditions about David's messianic son.

Do ubiquitous modes of thought (types of analysis, types of argumentation) pervade the entire corpus of the Rabbinic writings of late antiquity and impart coherence to those diverse documents? Here are the results of a systematic probe of representative Halakhic and Aggadic documents in search of the answer to that question. The result is limited but one-sided: the answer is yes, they do. The inquiry proves urgent, because the bases for supposing the Rabbinic documents coalesce have diminished, and the differences (...) between and among the respective documents have made their mark. The book asks whether, however diverse, all of the documents conform to a single, determinate program of [1] analysis and [2] argumentation. Do they raise in common a set of questions that are ubiquitous, and do they pursue a uniform inquiry, whatever the data subject to study? Further, does a single protocol of argumentation dictate the means by which analytical propositions are advanced and tested? If they do, then Rabbinic Judaism finds coherence in shared intellectual traits. These, then, would serve to define the foundations for the construction of all components into the Rabbinic system and structure. (shrink)

In opposition to the perception of Judaism as a legal system, he argues that the Talmud demands inner spiritual effort, to which the trait of humility and the refinement of the ego are central. This leads to the question of the attitude to the Other, in general, and especially to women. The discussion of shi and lun is the discussion of the relationship between historical data on the one side and theories of history on the other. It is the only methodological discussion historians in the PRC have been going through since the People's Republic of China was founded in October 1949. The question of how to relate data to theory gained a new dimension as not only the quality of historical research but also historians' loyalty to the Communist regime was (...) evaluated according to the methodological approach they preferred.In this article the political aspect of discussions of historiography in the PRC is left aside; here the discussion of the relationship between data and theory is used to develop a typology of Marxist historiography in the PRC. This discourse is characterized by three "slogans": theory has to take the lead over data ; data and theory have to be combined ; and interpretation has to emerge from data . The theory-oriented first slogan coincides with a way of writing history in which data are used to show the plausibility of Marxist theory. In contrast to this, the slogan demanding the combination of data and theory is aimed at finding the specific laws governing the historical process in China by applying Marxism as a kind of methodology to Chinese history, whereas the third idea of having interpretations emerge from the data is based on the idea of probing the quality of Marxism by having interpretations come out of historical research which might or might not prove to be compatible with Marxism.The typology suggested in this article results from discussions with both the "European" and the Chinese. By borrowing from both Hayden D. White and Jörn Rüsen on the one side, and by introducing on the other side the debate Chinese historians have been carrying on, a solution is found that is specific with regard to answers concerning Marxist historiography in China, but which might be of further interest insofar as the method of establishing this typology might be of broader use when trying to understand historiography organized around philosophical concepts rather than plot structures borrowed from literature. Rabbinic tales of drought, disaster, and charismatic holy men illuminate critical questions about power, ethics, and ecology in Jewish late antiquity. Through a sustained reading of the Babylonian Talmud's tractate on fasts in response to drought, this book shows how Bavli Taʿanit challenges Deuteronomy's claim that virtue can assure abundance and that misfortune is an unambiguous sign of divine rebuke. This paper discusses the historiography of the ‘two cultures’ controversy. C. P. Snow’s lament about the ‘two cultures’, literary and scientific, has inspired a wide range of comment—much of which begins by citing Snow and his thesis, before going on to discuss very different things. This paper focuses upon one strand of this commentary, the historical analysis of the controversy itself. A ‘historical’ analysis is defined here as one that resists the impulse to enter the argument on behalf of (...) Snow or Leavis, to conceive of their argument in the terms that Snow defined, or to invoke their argument as a precursor to some contemporary issue. Instead, a historical interpretation registers distance between that day and this, takes the controversy itself as its object of study, and explores the tensions and associations that came to be packed into those now familiar terms. Recently, the government of Zimbabwe unveiled a newly constructed statue of the esteemed spirit medium and liberation icon who intrepidly fought against the British imperialism. The distinguished heroine is passionately known as Mbuya Nehanda Charwe Nyakasikana. The lexical item, ‘Mbuya’ in Shona language literally means grandmother. This study examines the ways in which the spectres of religion, historiography, gender and national politics find expression in often contested state narratives of Mbuya Nehanda and in selected Zimbabwean fictional writings. Foucault’s theorisation (...) of socio-political practices and subjectification as sites of power, together with the Critical Discourse Analysis (CDA) framework and bell hooks’ feminist thought of ‘talking back’, provide provocative insights about regimes of power that could be more edifying in the interlocking discursive terrain of the African cosmology, frequently disputed archeology of historical memory, socio-political relations, which are noticeable in discourses and gender politics. The study interrogates whether the Nehanda grand narrative is told by politicians as the revolutionary story of all citizens or not. If not, what alternative versions are proffered in selected Yvonne Vera and NoViolet Bulawayo’s literary texts? Arguably, the mythology of Nehanda in the chosen literary texts locates women as agents of revolution thereby generating semantic dissonance in the Zimbabwean context, which is largely considered as land of the Fathers. Contribution: The study situates the Nehanda narrative within contested terrains of national history, gender and religion in Zimbabwe’s transitional politics and literature. It concludes that in Vera and Bulawayo’s writings, the Nehanda narrative is deployed to interject significations of woman (hood) and nation (hood) which seek to marginalise some sections of the society. The dissonances embedded in the Nehanda narrative produce a dialoguing space that’ talks back’ and rebuts single storytelling. (shrink)

The division of literature by language and nation has become so common that it seems to be obvious and natural. But it is not so, and moreover this not even a very old practice. But the national literary histories, apart from their political-cultural aims, are without justification since the history of literature in its themes, subjects and forms has rarely been confined to one nation. Quite large cultural areas exist, bound by space and time, in which literary phenomena (...) are inextricably linked. This essay therefore proposes a coherent and unified treatment of the literary traditions of Eastern and Western Europe. (shrink)

The late antique rabbis of Roman Palestine were seasoned jurists, experts on exegesis and legal interpretation. Yet rabbinic literature does not theorize. A positive account of rabbinic conceptions of language therefore remains a desideratum. I choose an alternative approach. Legal reasoning relies on language to ground the determinacy of the law. Jurists must thus confront language when it threatens to undermine the latter. Conversely, they may hold language to safeguard legal determinacy. Drawing on insights from legal theory, I turn (...) to an unusual rabbinic rule of inference. Its earliest attested version suggests a universal possibility of inference “from the category of yes that of no, from the category of no that of yes.” I show that the ever-evolving uses of this rule allow us to observe a shift in linguistic attitude, increasingly acknowledging linguistic uncertainty. My findings tie in with recent advances in the study of rabbinic exegesis. (shrink)

Turning an Info-Glut into a Library. Science 266 (7 October): 20-22, p. 20), Internet resources now receive numerous levels of organization, from basic directory listings (...) to elaborate "links" (cross-references to other Internet documents) that flash and glow in the dark. In many ways, the Internet functions as a direct extension of the traditional library. Following linked references across various sites is an electronic version of browsing library stacks, and the serendipitous discoveries made while "surfing the Net" recall the wonders of physically going "book-to-book." Although many of the Internet's best aspects augment library strengths by eliminating physical distance from sources, Net resources pose unique problems for researchers. It is not always clear who is responsible for the content of Web documents, when the document was produced, or how often (if ever) it is updated. Internet resource tools, then, must enable researchers to identify appropriate resources and to evaluate what they find when they get there. Web Research as Taking "Snapshots" Given the Internet's visual nature and fluid content, the process of conducting research on the Web has been likened to taking an informal picture of information on a specific date at a particular time. This metaphor also conveys the "zoom-in" aspect of searching through Web pages by going from general to specific categories. In the first section of this Scope Note, National Reference Center for Bioethics Literature (NRCBL) staff present a snapshot of bioethics resources taken during the spring months of 2000. Entries are divided into the categories of directories, electronic journals, full-text documents, news/current awareness, and teaching resources. In the two subsequent sections, this series of categories is repeated for entries on a specific topic within bioethics-genetics-and again for general search and evaluation tools. Where a Web site may contain pages applicable [End Page 175] to more than one category, multiple entries are made for that site with appropriate information for each category.Much as telecommunication advances have strengthened the relationship of patients and providers as partners, the dynamic nature of the Internet acknowledges that the researcher functions as a librarian whenever accessing the Web. It is our hope that BIOETHICSLINE and the other NRCBL databases not only will enable researchers to search the Web more efficiently, but also will help them to evaluate what they find when they get there. Bioethicsline on the Web: An International Plan in Progress Once only available through libraries, the U.S. National Library of Medicine (NLM), the funding agency for the ongoing development of the BIOETHICS LINE® database from the Kennedy Institute, has provided free Web access to that database of 63,000 citations since September 1998 through Internet Grateful Med. Plans are now underway to eliminate such specialty databases and incorporate all citations into PubMed (for journal articles) or LOCATORplus (for book-like materials and chapters in books). Both of these databases are likewise available at no cost on the Web. In the transition to PubMed and LOCATORplus some features of BIOETHICSLINE that presently are available may be lost. Researchers are encouraged to contact the National Reference Center for Bioethics Literature with search requests or for search strategy assistance with either the current or the future system ([email protected]).The inclusion of bioethics citations in PubMed and LOCATORplus will have several advantages. First, unique keywords from the Bioethics Thesaurus will be considered for inclusion in Medical Subject Headings (MeSH), the indexing vocabulary for PubMed and LOCATORplus, thereby enhancing retrieval of relevant clinical literature by offering more precise terminology covering ethical issues. Second, it will be easier to identify foreign-language materials, which are not currently included in the scope of BIOETHICSLINE. Third, the updating schedule will become more frequent. What would a Jewish process theology look like if it also adopted the a priori principles of rabbinic Judaism - among them, the authority of Torah given on Sinai, an historically particular revelation of divine instruction for a particular people, and the authority of the Oral Torah, an historically evolving hermeneutic, according to which that revelation becomes normative practice for communities of observant Jews? I trust this would not be a naturalism, since it would be a theology that found its (...) grammar or regulative logic in a textual hermeneutic rather than in an account of the orders of perception and imagination. It would not, for the same token, be an anti-naturalism, but rather a theology for which the distinction between natural and super- or non-natural was not definitional. For such a theology, for example, the world out there would belong to the order of creation (maaseh bereshit), rather than to "nature." This would mean that, since God creates through words, language (at least some sort of language) and world would be intimately connected rather than extrinsic phenomena, It would mean, furthermore, that for language to "know" the world would not be surprising and that something like a form of realism would not be out of the question, While it would presuppose the authority of divine speech and even of some human interpretations of it, this other-than natural theology would not, as naturalists might suppose, present a heteronomous conception of divine law, If the distinction nature/not nature would not be definitive for this theology, neither would those of autonomy/heteronomy, body/spirit, this world/other world, This theology would present its own variety of neutral monism; in this case, however, the undifferentiated plenum would be termed a plenum of undifferentiated signification (or pure semiosis), of which undifferentiated feeling (or pure experience) was an instance; "prehension" would be another term for interpretation, Max Kadushin was the first and, as far as I know, the only Jewish thinker to articulate a process theology in the service of what he considered the behavioral or halakhic authority of classical rabbinic literature. In this paper, I examine Kadushin's work as the foundation of a rabbinic text process theology, I assume, from the outset, that such a theology may complement a Jewish natural process theology and that a Jewish process theology, in general, would appear as a process of dialogue between textual- andnatural-process theologies. In this paper, I offer an explication of the notion of local explanation. In the literature, local explanations are considered as metaphysically and methodologically satisfactory: local explanations reveal the contingency of science and provide a methodologically sound historiography of science. However, the lack of explication of the notion of local explanation makes these claims difficult to assess. The explication provided in this paper connects the degree of locality of an explanans to the degree of contingency of the explanandum. (...) Moreover, the explication is shown to be compatible with the methodological need for a general consideration in the historiography of science. In this way, the explication satisfies the need to explicate an important notion, connects local explanations and contingency, and enables us to see how local explanations and general considerations can be connected. However, the explication also sheds critical light on many claims and expectations that are associated with local explanations and their satisfactoriness. (shrink)

This chapter evaluates the use of rabbinic literature in the study of the history of Christianity in Roman Palestine. It explains that this issue goes back to medieval Jewish-Christian controversy and intertwines with the whole history of the reception of the Talmud in Europe and the western world. It suggests that the view that Christians are most often envisaged in the rabbinic references to minim is consistent with the likelihood that Christianity is envisaged in a number of rabbinic and (...) targumic passages which do not mention minim. It publishes articles on Greek and Latin literature, historiography, philosophy, history of religion, linguistics, reception, and the history of scholarship. The journal aims to contribute to our understanding of Greco-Roman culture and its lasting influence on European civilization. The journal Philologus, conceived as a forum for discussion among different methodological approaches to the study of ancient texts and their reception, publishes (...) original scholarly contributions with a strong international focus.
