As the mother of a daughter who has and will always require care to meet her most basic needs, I have seen firsthand how critical it is to have adequate means by which to meet those needs—for her sake, mine, and my family’s. Recent interpretations of Kant’s international political philosophy have argued that the formation of a coercive world-state (Völkerstaat) is morally required. While these interpretations highlight the importance of a strong world government, they ignore Kant’s alternative to a Völkerstaat, a world-federation (Völkerbund). For both theoretical and practical reasons, the Völkerbund plays a crucial role in cosmopolitan right, and Kant can only justifiably reject the formation of the Völkerstaat because of the structure of the Völkerbund. This article explains the constitution (...) and functions of the Völkerbund, and thereby shows why Kant was not ultimately committed to supporting a coercive world-state. (shrink)

Immanuel Kant’s position on international justice is beset by some troublesome inconsistencies, most notably a conflicted set of views on the status of federations as suitable alternatives to a world state. It is tempting for contemporary readers to interpret Kant’s indecision as a lack of commitment or resoluteness. Closer inspection demonstrates that this problem involves deeper paradoxes, rooted in the concept of sovereignty. On this matter, Kant’s Rechtslehre is the source of the difficulties found in the “popular” essays. Kant’s (...) vacillating position on the proper institutional end for international relations is attributable to the fundamentally “permissive” character of his concept of right. Rechtslehre doctrines entail a form of skepticism, from which a coherent cosmopolitan program cannot possibly be derived. (shrink)

Purpose This study advances a reconceptualization of data and information which overcomes normative understandings often contained in data policies at national and international levels. This study aims to propose a conceptual framework that moves beyond subject- and collective-centric normative understandings. Design/methodology/approach To do so, this study discusses the European Union (EU) and China’s approaches to data-driven technologies highlighting their similarities and differences when it comes to the vision underpinning how tech innovation is shaped. Findings Regardless of the different attention (...) to the subject (the EU) and the collective (China), the normative understandings of technology by both actors remain trapped into a positivist approach that overlooks all that is not and cannot be turned into data, thus hindering the elaboration of a more holistic ecological thinking merging humans and technologies. Originality/value Revising the philosophical and political debate on data and data-driven technologies, a third way is elaborated, i.e. federated data as commons. This third way puts the subject as part by default of a collective at the centre of discussion. This framing can serve as the basis for elaborating sociotechnical alternatives when it comes to define and regulate the mash-up of humans and technology. (shrink)

Although similar in some respects, Rawls' and Kant' visions of world order fall apart on the question of sovereignty. Rawls never advocates of an international single state with international authority. Kant, on the other hand, inspired by the project of Enlightenment, as a final form of international sovereignty sees federative state of states as a provider for eternal peace among peoples. Technological change within sport receives attention within the media only when an athlete or team has contravened the rules within a sport. In this respect, the use and effect of technology and, indeed, its apparent importance is comparable to the use of drugs in sport. Governing bodies of sport are keen to ensure that technology does not become too dominant within a competition and will endeavour to justify policy decisions on the basis of some essentialist conception of their sport. Again, (...) the approach taken by governing bodies in respect of new technology is comparable to approaches regarding drug use. Yet, there does not appear to be the degree of hysteria about new technology as there is in respect of drug use. Undoubtedly, this is somewhat reflective of the way in which drug use is perceived as having anti-social implications. However, if arguments against drug use are being made on the basis of them being unfair, then equally persuasive arguments can be made in the context of performance-enhancing technology. (shrink)

Abstract: In this essay a set of principles is defended that yields a determinate allocation of sovereign competences across a global system of territorially nested jurisdictions. All local sovereign competences are constrained by a universal, justiciable human rights regime that also incorporates a conception of cross-border distributive justice and regulates the competence to control immigration for a given territory. Subject to human rights constraints, sovereign competences are allocated according to a conception of global democracy. The proposed allocation scheme can accommodate (...) substantial local autonomy while at the same time ensuring that everyone has a voice in the political decisions that affect his or her interests. The relevant class of affected interests is fully specified. Relevant affects are of two kinds: those that impose norms of governance on individuals, and those that impose external costs on them. This Element introduces the reader to Kant's theory of peace and to its place in the broader context of the critical philosophy. It also delves into one aspect of the model that has generated much debate among interpreters, given Kant's changing thoughts on the matter. This aspect relates to the nature and powers of the international federation. Defending the idea that national sovereignty is indissolubly linked to states' full autonomy regarding the use of military power, this Element offers (...) an interpretation and defense of the Kantian federation that, in many regards, departs from the mainstream reading. Special emphasis is placed on the problematic coexistence of two conflicting theoretical desiderata: on the one hand, the necessity of establishing an international institution with coercive powers for securing peace; on the other hand, the necessity of avoiding the risk of an excessive erosion of states' sovereignty. In this paper we will argue in favor of federal funding of elective abortion, more specifically in support of Medicaid funding. To do so, we will address the restrictions on public funding presently in place and demonstrate that the various justifications offered in their defense are in­adequate. We will then suggest that the ‘failure to enable’ represented by a ban on Federal funding is morally equivalent to an outright prohibition on abortion for the target population. Just as a moral equivalence (...) can be established between killing and letting die in symmetrical cases, like criteria for equivalence can be established that help to identify those failures to make possible that are morally indistinguishable from proscriptions. On this basis, it can be shown that restrictions on Federal funding in such contexts can be thought to carry the same moral liability as prohibitions. (shrink)

There exists a standard view of Kant’s position on global order and this view informs much of current Kantian political theory. This standard view is that Kant advocates a voluntary league of states and rejects the ideal of a federative state of states as dangerous, unrealistic, and conceptually incoherent. This standard interpretation is usually thought to fall victim to three equally standard objections. In this essay, I argue that the standard interpretation is mistaken and that the three standard objections miss (...) their target. Kant does advocate the establishment of a non-coercive league of states, at least in his mature political writings (such as Perpetual Peace and the Metaphysics of Morals), but he does so for different reasons than is usually thought and without rejecting the ideal that a world federation of states eventually be realized. I end by indicating how Kant’s revised view can be made productive for present-day philosophical purposes. (shrink)

The primary purpose of government is to secure public goods that cannot be achieved by free markets. The Coordination Principle tells us to consolidate sovereign power in a single institution to overcome collective action problems that otherwise prevent secure provision of the relevant public goods. There are several public goods that require such coordination at the global level, chief among them being basic human rights. The claim that human rights require global coordination is supported in three main steps. First, I (...) consider Pogge's and Habermas's analyses as alternatives to Hobbesian conceptions of justice. Second, I consider the core conventions of international law, which are in tension with the primacy of state sovereignty in the UN system. Third, I argue that the just war tradition does not limit just causes for war to self-defense; it supports saving innocent third parties from crimes against humanity as a just reason for war. While classical authors focused less on this issue, the point is especially clear in twentieth-century just war theories, such as those offered by the American Catholic bishops, Jean Elshtain, Brian Orend, and Michael Walzer. Against Walzer, I argue that we add intractable military tyranny to the list of horrors meriting intervention if other ad bellum conditions are met. But these results require us to reexamine the "just authority" of first resort to govern such interventions. The Coordination Principle implies that we should create a transnational federation with consolidated powers in place of a treaty organization requiring near-unanimity. But to be legitimate, such a global institution must also be directly answerable to the citizens of its member states. While the UN Security Council is inadequate on both counts, a federation of democracies with a directly elected executive and legislature could meet both conditions. (shrink)

This book explores the constitutional, legally binding dimension to legisprudence in the light of the German Federal Constitutional Court's approach to rational lawmaking. Over the last decades this court has been remarkably active in applying legisprudential criteria and standards when reviewing parliamentary laws. It has thus supplied observers with a unique material to analyse the lawmakers' duty to legislate rationally, and to assess the virtues and drawbacks of this strand of judicial control in a constitutional democracy. By bringing together legislation (...) experts and public law scholars to elaborate on 'legisprudence under review', this contributed volume aspires to shed light on the constitutionalisation of rational lawmaking as a controversial trend gaining ground in both national and international jurisdictions. The book is divided into five parts. Part I frames the two key issues pervading the whole collection: the intricate relationship between judicial review and democracy, on the one hand, and the possibility of improving and rationalizing the task of legislation under the current circumstances of politics, on the other. Part II provides an overview of the judicial review of rational lawmaking, laying special emphasis on the duty of legislative justification imposed on lawmakers by the German Constitutional Court. Part III is devoted to the review of the systemic rationality of legislation, in particular to the requirements of legislative consistence and coherence as developed by this court. Contributions in Part IV revolve around the judicial scrutiny of the socio-empirical elements of rational lawmaking, with the control of legislative facts and impacts and the problem of symbolic laws being the central topics. Finally, Part V draws on the German case law to discuss the links between rational lawmaking, balancing and proportionality, and the interdependence between process review and substantive review of legislation. Davenport argues for a federation of democracies to replace the United Nations Security Council. This new level of government, he says, is necessary to achieve the international cooperation needed to manage a global economy and address global problems.

The International Federation of Accountants (IFAC) has recently issued a revised "Code of Ethics for Professional Accountants" (IFAC Code). As a requirement for membership in IFAC, a national accounting organization must either adopt the IFAC Code or adopt a code of conduct that is not "less stringent" than the IFAC Code. In this paper, we examine the extent to which 158 national accounting organizations have adopted the revised IFAC Code as their own. Our results indicate that 80 of (...) our sample organizations have adopted the IFAC Code (sometimes with minor modifications), while the remaining 78 opted not to utilize the model IFAC Code. We then test the hypothesis that national accounting organizations in lower income economies would be less likely to adopt the IFAC Code than those in high income economies. Our results do not support the hypothesis. We argue that one potential reason for such a finding is that adopting the IFAC Code may be a cost effective means of adopting a code of ethics for organizations in lower income economies. (shrink)

Since its early days, the labor movement has considered itself to be surrounded by a hostile bourgeois public and sought to counter this with a party press. As a result of the Cold War, Western social democratic parties abandoned in part their traditional beliefs about demarcation. Nevertheless, with the International Federation of the Socialist and Democratic Press, an organization emerged from 1951 to 1982 that manifested separation from the bourgeois public sphere. Drawing on an analytical framework derived from (...) counterpublic theory, this article analyzes ideas and practices developed by members of the organization linked to the Socialist International. The analysis of archival sources reveals that social democratic journalists and publishers remained wedded to the idea of a socialist press countering a hostile public sphere. However, the ideas and practices were mostly limited to strategies aimed at adapting to the existing media structures and only later included media policy approaches. (shrink)

The aim of this paper is to study the methodological foundations of the humanities education for international students as an alternative to transhumanist ideology. The paradigmatic approach is used as a factor analysis of students' educational processes. Particular attention is paid to the substantiation of the methodological foundations of the education humanisation on the basis of modern ontologically anthropological and religious‐anthropological achievements of the philosophical field of knowledge. The novelty of the study is due to a discussion of the (...) contradictions caused by all‐round technocratisation and informatisation, the fall of moral standards and the degradation of human behaviour. The practical significance of the study is determined by the need to develop a different pedagogy and model of education for modern students. United States federal regulations for pediatric research with no prospect of direct benefit restrict institutional review board (IRB) approval to procedures presenting: 1) no more than "minimal risk" (§ 45CFR46.404); or 2) no more than a "minor increase over minimal risk" if the research is commensurate with the subjects' previous or expected experiences and intended to gain vitally important information about the child's disorder or condition (§ 45CFR46.406) (DHHS 2001). During the 25 years since their adoption, these regulations have helped (...) IRBs balance subject protections with the pursuit of scientific knowledge to advance children's welfare. At the same time, inconsistency in IRB application of these regulations to pediatric protocols has been widespread, in part because of the ambiguity of the regulatory language. During the past decade, three federally-charged committees have addressed these ambiguities: 1) the National Human Research Protections Advisory Committee (NHRPAC) (Washington, DC), 2) the Institute of Medicine (IOM) Committee on the Ethical Conduct of Clinical Research Involving Children (Washington, DC); and 3) the United States Department of Health and Human Services Secretary's Advisory Committee for Human Research Protections (SACHRP) (Washington, DC). The committees have reached similar conclusions on interpretation of language within regulations § § 45CFR46.404 and 406; these conclusions are remarkably consistent with recent international recommendations and those of the original National Commission for the Protection of Human Subjects of Biomedical and Behavioral Research (1977) report from which current regulations are based. Drawing on the committees' public reports, this article identifies the ethical issues posed by ambiguities in regulatory language, summarizes the committees' deliberations, and calls for a national consensus on recommended criteria.
