This paper explores the intersections between national identity and the production of medical/population genomics in Mexico. The ongoing efforts to construct a Haplotype Map of Mexican genetic diversity offers a unique opportunity to illustrate and analyze the exchange between the historic-political narratives of nationalism, and the material culture of genomic science. Haplotypes are central actants in the search for medically significant SNP’s (single nucleotide polymorphisms), as well as powerful entities involved in the delimitation of ancestry, temporality and variability ( www.hapmap.org (...) ). By following the circulation of Haplotypes, light is shed on the alignments and discordances between socio-historical and bio-molecular mappings. The analysis is centred on the comparison between the genomic construction of time and ethnicity in the laboratory (through participant observation), and on the public mobilisation of a “Mexican Genome” and its wider political implications. Even though both: the scientific practice and the public discourse on medical/population genomics are traversed by notions of “admixture”, there are important distinctions to be made. In the public realm, the nationalist post-revolutionary ideas of Jose Vasconcelos, as expressed in his Cosmic Race ( 1925 ), still hold sway in the social imaginary. In contrast, admixture is treated as a complex, relative and probabilistic notion in laboratory practices. I argue that the relation between medical/population genomics and national identity is better understood as a process of re-articulation (Fullwiley Social Studies of Science 38:695, 2008 ), rather than coproduction (Reardon 2005 ) of social and natural orders. The evolving process of re-articulation conceals the novelty of medical/population genomics, aligning scientific facts in order to fit the temporal and ethnic grids of “Mestizaje”. But it is precisely the social and political work, that matches the emerging field of population genomics to the pre-existing projects of national identity, what is most revealing in order to understand the multiple and even subtle ways in which population genomics challenges the historical and identitarian frames of a “Mestizo” nation. Conservatism about perceptual justification tells us that we cannot have perceptual justification to believe p unless we also have justification to believe that perceptual experiences are reliable. There are many ways to maintain this thesis, ways that have not been sufficiently appreciated. Most of these ways lead to at least one of two problems. The first is an over-intellectualization problem, whereas the second problem concerns the satisfaction of the epistemic basing requirement on justified belief. I argue that there is at (...) least one Conservative view that survives both difficulties, a view which has the further ability to undercut a crucial consideration that has supported Dogmatist views about perceptual justification. The final section explores a tension between Conservatism and the prospects of having a completely general account of propositional justification. Ironically, the problem is that Conservatives seem committed to making the acquisition of propositional justification too easy. My partial defense of Conservatism concludes by suggesting possible solutions to this problem. (shrink)

BackgroundFor many decades, the debate on children’s competence to give informed consent in medical settings concentrated on ethical and legal aspects, with little empirical underpinnings. Recently, data from empirical research became available to advance the discussion. It was shown that children’s competence to consent to clinical research could be accurately assessed by the modified MacArthur Competence Assessment Tool for Clinical Research. Age limits for children to be deemed competent to decide on research participation have been studied: generally children of 11.2 (...) years and above were decision-making competent, while children of 9.6 years and younger were not. Age was pointed out to be the key determining factor in children’s competence. In this article we reflect on policy implications of these findings, considering legal, ethical, developmental and clinical perspectives.DiscussionAlthough assessment of children’s competence has a normative character, ethics, law and clinical practice can benefit from research data. The findings may help to do justice to the capacities children possess and challenges they may face when deciding about treatment and research options. We discuss advantages and drawbacks of standardized competence assessment in children on a case-by-case basis compared to application of a fixed age limit, and conclude that a selective implementation of case-by-case competence assessment in specific populations is preferable. We recommend the implementation of age limits based on empirical evidence. Furthermore, we elaborate on a suitable model for informed consent involving children and parents that would do justice to developmental aspects of children and the specific characteristics of the parent-child dyad.SummaryPrevious research outcomes showed that children’s medical decision-making capacities could be operationalized into a standardized assessment instrument. Recommendations for policies include a dual consent procedure, including both child as well as parents, for children from the age of 12 until they reach majority. For children between 10 and 12 years of age, and in case of children older than 12 years in special research populations of mentally compromised patients, we suggest a case-by-case assessment of children’s competence to consent. Since such a dual consent procedure is fundamentally different from a procedure of parental permission and child assent, and would imply a considerable shift regarding some current legislations, practical implications are elaborated. Social theory has paid little attention to air, despite its centrality to bodily existence and air pollution being named the world’s biggest public health crisis. Where attention to air is found, the body is largely absent. On the other hand, conceptualizing the body without life-sustaining breath fails to highlight breathing as the ongoing metabolic bodily act in which the materiality of human and more-than-human intermingle and transmute one another. Political ecology studies how unequal power structures and knowledge production reproduce human–environment (...) relations, including a nascent focus on the body and air – but as separate issues. This article argues that a political ecology of air would productively fuse with a political ecology of the body to bring the visceral realm into intersectional analysis of air’s contemporary materialities. A feminist political ecology situates explicitly air-and-breathing-bodies, their intimately posthuman, relational, elemental and corpomaterial intra-action, at the heart of such analysis. (shrink)

For decades, the discussion on children’s competence to consent to medical issues has concentrated around normative concerns, with little progress in clinical practices. Decision-making competence is an important condition in the informed consent model. In pediatrics, clinicians need to strike a proper balance in order to both protect children’s interests when they are not fully able to do so themselves and to respect their autonomy when they are. Children’s competence to consent, however, is currently not assessed in a standardized way. (...) Moreover, the correlation between competence to give informed consent and age in children has never been systematically investigated, nor do we know which factors exactly contribute to children’s competence. Although law is established on a strong presumption that persons younger than a certain age are not competent to consent, statutory age limits for asking children’s consent to clinical research differ widely internationally. From a clinical perspective, competence is assumed to involve many factors including the developmental stage, the influence of parents and peers, and life experience. We examined potential determining factors for children’s competence to consent to clinical research and to what extent they explain the variation in competence judgments.

This entry introduces the Lockean Thesis and sketches the ways in which the lottery paradox, the preface paradox, and the problem of merely statistical evidence can be used to put pressure on the Lockean Thesis.

In this paper we discuss expected and reported effects on care provider-patient relations of the introduction of electronic patient records (EPRs) in consultation settings by reviewing exemplary studies and literature on the subject from the past decade. We argue that in order for such assessments to be meaningful, talk of effects of “the” EPR needs to be replaced by an “unpacking” of EPR systems into their constituent parts and functionalities, the effects of which need to be assessed individually. Following from (...) this principle, the paper discusses EPR systems ranging from simple data entry and retrieval systems to more sophisticated multi-user and multifunctional on-line systems. On a second level, our analysis of the literature is informed by the question which model of ideal patienthood underlies the assessment of effects of EPRs. To this end, we identify three “models of patienthood” implicit in writing about benefits and drawbacks of EPRs for patients: the autonomy, the consumer, and the holistic models, and argue that assumptions concerning these models need to be reflected upon more critically to improve understanding of what exactly EPR use does to the doctor-patient relationship. The Venezuelan poet and philosopher Ludovico Silva argues that much of the confusion around Marx's work results from a failure to understand his mode of expression. Through meticulous readings of key passages in Marx's oeuvre, Silva isolates the central elements of his style: the search for an architectonic unity at the level of the text, his capacity to express himself dialectically at the level of the sentence, and, above all, his great gift for metaphor.

This monograph offers a fresh perspective on the applicability of mathematics in science. It explores what mathematics must be so that its applications to the empirical world do not constitute a mystery. In the process, readers are presented with a new version of mathematical structuralism. The author details a philosophy of mathematics in which the problem of its applicability, particularly in physics, in all its forms can be explained and justified. Chapters cover: mathematics as a formal science, mathematical ontology: what (...) does it mean to exist, mathematical structures: what are they and how do we know them, how different layers of mathematical structuring relate to each other and to perceptual structures, and how to use mathematics to find out how the world is. The book simultaneously develops along two lines, both inspired and enlightened by Edmund Husserl’s phenomenological philosophy. One line leads to the establishment of a particular version of mathematical structuralism, free of “naturalist” and empiricist bias. The other leads to a logical-epistemological explanation and justification of the applicability of mathematics carried out within a unique structuralist perspective. This second line points to the “unreasonable” effectiveness of mathematics in physics as a means of representation, a tool, and a source of not always logically justified but useful and effective heuristic strategies. South Africa shared with the world the warning of a new strain of SARS-CoV2, Omicron, in November 2021. As a result, many high-income countries (HICs) instituted complete travel bans on persons leaving South Africa and other neighbouring countries. These bans were unnecessary from a scientific standpoint, and they ran counter to the International Health Regulations. In short, South Africa was penalized for sharing data. Data sharing during pandemics is commonly justified by appeals to solidarity. In this paper, we argue that (...) solidarity is, at best, an aspirational ideal to work toward but that it cannot ground an obligation to share data. Instead, low-and-middle income countries (LIMCs) should be guided by the principle of reciprocity, which states that we ought to return good for good received. Reciprocity is necessarily a conditional principle. LMICs, we argue, should only share data during future pandemics on the condition that HICs provide enforceable assurances that the benefits of data sharing will be equitably distributed and that LMICs won’t be penalized for sharing information. When a belief is self-fulfilling, having it guarantees its truth. When a belief is self-defeating, having it guarantees its falsity. These are the cases of “self-impacting” beliefs to be examined below. Scenarios of self-defeating beliefs can yield apparently dilemmatic situations in which we seem to lack sufficient reason to have any belief whatsoever. Scenarios of self-fulfilling beliefs can yield apparently dilemmatic situations in which we seem to lack reason to have any one belief over another. Both scenarios have been used (...) independently to challenge Evidentialism, on which what we may rationally believe is all and only what fits our current evidence. Here we tie the two scenarios together and explore what a knowledge-sensitive evidentialist approach to one implies for the other. (shrink)

This article intends to explore the philosophical potency in the work of the black writer Carolina Maria de Jesus (1914-1977). Carolina de Jesus is best known for her work Quarto de Despejo, diary of a favelada (1960), our approach, however, focuses specifically on her short story “Socrates Africano”, in which she deals with her experience with her grandfather Benedito and the relationship between her wisdom and that of the Greek philosopher Sócrates (5th century BC). Her reflection starts from the attempt (...) to understand the reason why her grandfather was compared to Socrates and called “African Socrates”. In this sense, we intend to expand the idea of an African Socrates and the origins of one of the African philosophical matrices, the Yoruba tradition, dialoguing with the thought of the Nigerian philosopher Sophie Oluwole (1935-2018) and her approximation between Socrates and Orunmilá, as a motto to think about the philosophical potentialities of Carolina's work and the traits of an Afro-Brazilian philosophy. In the article, I examine Hélène Cixous's play La Ville parjure ou le Réveil des Erinyes as a political contribution to the debate over memory and justice. The focus is on the question of how the telling of a story of atrocities may be therapeutic to both the victim and to society. I stress Cixous's alternative way of addressing justice: through forgiveness instead of criminal prosecution or other forms of retribution or reconciliation. Referring to Jacques Derrida's work, the main argument (...) revolves around the question of whether forgiveness for unspeakable crimes should be unconditional or conditional. Instead of seeing Cixous's play as an unequivocal stance on restorative justice in general, and on conditional forgiveness in particular, I stress that the main protagonist, the Mother, is not willing to forgive the crime itself because of its unforgivable nature. Dentro de las tesis que definen la metafísica de Leibniz, destaca aquella según la cual las esencias encierran una pretensión a la existencia. Esta tesis ha despertado un singular interés entre los comentaristas de Leibniz, dando origen a un debate que enfrenta a aquellos que defienden una interpretación metafórica con aquellos que profesan una interpretación literal: si el primer grupo sostiene que tal pretensión ha de entenderse como una atribución metafórica en virtud de la cual las esencias, desprovistas de tal (...) característica, son susceptibles de alcanzar la existencia al ser actualizadas por Dios, para el segundo grupo, las esencias son portadoras en sí de tal característica, la que debe entenderse entonces como una cualidad real e inherente presente en ellas. A partir de un examen de diversos manuscritos de Leibniz, nuestro propósito es reivindicar una interpretación literal de la tesis de la pretensión de las esencias a la existencia, explicando por qué la interpretación metafórica, además de carecer de fundamento, entraña contradicciones. A group of philosophers suggests that a sense of mineness intrinsically contained in the phenomenal structure of all conscious experiences is a necessary condition for a subject to become aware of himself as the subject of his experiences i.e. self-awareness. On this view, consciousness necessarily entails phenomenal self-awareness. This paper argues that cases of delusions of thought insertion undermine this claim and that such a phenomenal feature plays little role in accounting for the most minimal type of self-awareness entailed by (...) phenomenal consciousness. First, I clarify the main view endorsing this claim i.e. the Self-Presentational View of Consciousness and formulate the challenge from thought insertion. After, I offer a systematic evaluation of all the strategies used by the advocates of this view to deal with this challenge. Finally, I conclude that most of these strategies are unsatisfactory for they rest in unwarranted premises, imprecisions about the agentive nature of cognitive experiences, and especially, lack of distinction between the different ways in which subjects can become aware of their own thoughts. We can be aware of particulars, properties, events, propositions, facts, skills, and qualia. We can also have knowledge of and be conscious of a similar range of objects. We can, furthermore, be ignorant of such objects. Awareness is quite clearly related to knowledge, consciousness, and ignorance. But how? This entry explores some of the ways that awareness is (not) related to knowledge, consciousness, and ignorance. It also explores some of the ways that awareness might be required by, and thus fundamental (...) to, these other relations. The emerging insight is that additional clarity on the nature of awareness stands poised to add clarity to a wide range of philosophical issues in both epistemology and the philosophy of mind. The aim of this study was to describe how patients’ participation in the care they received was documented in their health care records during the last three months of their lives. Two hundred and twenty-nine deceased adult persons were randomly identified from 12 municipalities in a Swedish county and their records were selected from different health care units. Content analysis was used to analyse the text. Four categories of patient participation were described: refusing offered care and treatments; appealing for relief; (...) desire for everyday life; and making personal decisions. The most common way for these patients to be involved in their care at the end of their life was by refusal of the treatment and care offered. Characteristic of the different ways of participation were the diverse activities represented. The description of patients’ involvement in their life situation at this time indicated their dissociation from the health care offered more than consenting to it. (shrink)

Classical verse work expounding early Vedantic approach in Hindu philosophy.

Ronald de Sousa is one of the few analytic philosophers to have explored the ineffability of emotion. Ineffability arises, for de Sousa, from attempts to translate experience, which involves non-conceptual content, into language, which involves conceptual content. As de Sousa himself rightly notes, such a characterization construes all perceptual experience as ineffable and does not explain what might set emotional ineffability apart. I build on de Sousa’s insights regarding what makes emotional ineffability distinctive by highlighting that in the case of (...) emotion the content in question is, crucially, evaluative. Evaluative content has normativity that makes the ineffability of emotion both particularly salient as well as particularly relevant, as the way in which an object is valuable is felt to be merited despite the experience’s ineffability. After proposing an improved working definition of emotional ineffability, I move to the question of how language and emotional experience interact, and whether these interactions can be evaluated in any systematic way. While de Sousa is pessimistic regarding the prospects of such an evaluation, I argue that if we move beyond an individual level of analysis it is possible to characterize cases where the ineffability of emotion leaves members of particular social groups vulnerable to a range of epistemic and affective injustices. I argue that we can similarly characterize cases where the ineffability of emotion holds radical potential to challenge and transform unjust social arrangements. I end by proposing that the representational content of emotion involves what I call ‘modal complexity’ and that this makes emotions particularly well-suited to play such radical roles. (shrink)

The article proposes to analyse whether the current configuration of national migration legislation from Arendt's perspective on the universalization of human rights and Agamben's reflections on bare life and the state of exception demonstrates its capacity to protect the human rights of people undergoing forced migration. To this end, a literature review of a bibliographical nature was used, using the historical procedure method. In order to interpret the effectiveness of the current configuration of the human rights of this vulnerable group, (...) an analysis of international and national legislation on migration was carried out, focusing mainly on the case of the New Brazilian Migration Law. To this end, a theoretical discussion was built to understand how human rights are framed considering the situation of migration and statelessness in the face of an increasingly prevalent state of exception. It was noted that the constitutive fragility of forced migrants is a perennial situation, aggravated by the political inaction of nation states. It has also been noted that there is a need for states and international organizations to adopt new practices to promote the human dignity of forced migrants. (shrink)

Por ocasião do centenário de nascimento de Paul Ricoeur, a Universidade de Coimbra juntou num mesmo volume um conjunto de estudos académicos em tributo a este pensador. Reuniram-se deste modo comunicações de professores, de novos investigadores e de estudantes de doutoramento em redor de temas que marcaram a receção da obra e do filósofo francês em Coimbra. Cada capítulo do presente livro demonstra a fecundidade de um pensamento que, enraizado na “tradição reflexiva”, assumindo a mensagem das “filosofias da existência”, articulando (...) Fenomenologia e Hermenêutica, adquire, hoje, crescente impacto e relevância. Esta é uma filosofia que promove o diálogo entre disciplinas, autores e culturas e supera divisões teóricas em ordem a enfrentar as exigências da praxis. O desafio da praxis fez assim emergir um pensamento exigente e, simultaneamente, capaz de dialogar com diversas áreas do saber como: a psicoterapia, a história, as neurociências, a bioética, as ciências sociais e os estudos literários. At the occasion of the Paul Ricoeur’s centenary this volume joined in tribute several scholars, young researchers, and Ph.D students around the main themes that marked the reception of the philosopher’s work in Portugal and, especially in the University of Coimbra. Each chapter demonstrates the vigour Ricoeur’s thought as it is rooted in the "reflexive tradition", as it assumed the "existentialist" horizon, as it articulated Phenomenology and Hermeneutics. This philosophical project as, today, an enormous range of influence. This is a project that promotes dialogue between disciplines, authors, and cultures, overcoming theoretical divisions in face the demands of praxis. From this rich and plural inspiration comes the ability to meet with other fields of thought, namely psychotherapy, history, neuroscience, bioethics, social sciences, and literary studies. (shrink)

This book represents an outstanding contribution to the field of somatic psychology. It focuses on the relationship between body and emotions, and on the linkages between mindfulness-based emotion studies and neuroscience. The author discusses the awakening of somatic intelligence as a journey through pain and trauma management, the moral dimensions of somatic passions, and the art and practice of embodied mindfulness. Issues such as the emotions and the body in relation to Buddhist contemplative practice, against the background of the most (...) recent findings of current neuroscience, are expanded in the book.
