It has been estimated that U.S. companies with global business operations can reduce their U.S. tax bill by up to 10 percentage points if they reincorporate in a zero or low tax offshore jurisdiction. But this activity, at a time of national crisis following the September 11 terrorists' attacks and recent spate of corporate scandals, has received a less than sympathetic response from the U.S. media, ordinary taxpayers, shareholders and politicians as concerns are raised about the reduction of the tax (...) base and the lack of oversight and regulation in offshore centres. Offshore reincorporation has been condemned as immoral, unconscionable, dishonest and unpatriotic, accusations that cast doubt on the legitimacy of the companies concerned. In question is their right to conduct business in the U.S. and in particular, their right to still be viewed as American. Their legitimacy once bestowed so readily by the company's shareholders is now being questioned not only by shareholders but also the media, politicians, government regulators, pension funds and labour unions. Expatriate companies have been slow to respond to questions of their legitimacy, viewing their offshore move as a financial decision needing only the consent of their shareholders. However, times have changed and corporate legitimacy is now in the hands of all the company's stakeholders. Companies will need to explicitly consider the determinants of their legitimacy and the implications of the implied social contract under which they operate, to remain relevant in the days ahead. Friedrich Nietzsche is often depicted in popular and scholarly discourse as a lonely philosopher dealing with abstract concerns unconnected to the intellectual debates of his time and place. Robert C. Holub counters this narrative, arguing that Nietzsche was very well attuned to the events and issues of his era and responded to them frequently in his writings. Organized around nine important questions circulating in Europe at the time in the realms of politics, society, and science, Nietzsche in the Nineteenth (...) Century presents a thorough investigation of Nietzsche's familiarity with contemporary life, his contact with and comments on these various questions, and the sources from which he gathered his knowledge. Holub begins his analysis with Nietzsche's views on education, nationhood, and the working-class movement, turns to questions of women and women's emancipation, colonialism, and Jews and Judaism, and looks at Nietzsche's dealings with evolutionary biology, cosmological theories, and the new "science" of eugenics. He shows how Nietzsche, although infrequently read during his lifetime, formulated his thought in an ongoing dialogue with the concerns of his contemporaries, and how his philosophy can be conceived as a contribution to the debates taking place in the nineteenth century. Throughout his examination, Holub finds that, against conventional wisdom, Nietzsche was only indirectly in conversation with the modern philosophical tradition from Descartes through German idealism, and that the books and individuals central to his development were more obscure writers, most of whom have long since been forgotten. This book thus sheds light on Nietzsche's thought as enmeshed in a web of nineteenth-century discourses and offers new insights into his interactive method of engaging with the philosophical universe of his time. A long-standing theme in discussion of perception and thought has been that our primary cognitive contact with individual objects and events in the world derives from our perceptual contact with them. When I look at a duck in front of me, I am not merely presented with the fact that there is at least one duck in the area, rather I seem to be presented withthisthing (as one might put it from my perspective) in front of me, which looks to (...) me to be a duck. Furthermore, such a perception would seem to put me in a position not merely to make the existential judgment that there is some duck or other present, but rather to make a singular, demonstrative judgment, that that is a duck. My grounds for an existential judgment in this case derives from my apprehension of the demonstrative thought and not vice versa. (shrink)

This review essay expands on two excellent collections dealing with Nietzsche and Wagner and is drawn from the proceedings of conferences in the bicentennial year of Wagner’s birth. It points to four areas underplayed in the contributions. The first involves Nietzsche’s adoption of Wagnerian ideology, especially anti-Judaism, in the late 1860s and early 1870s. The second deals with Nietzsche’s actual activities and sentiments regarding the inaugural Bayreuth festival in 1876 and his later reports of these activities and sentiments. A third (...) topic concerns the break from Wagner, its likely causes, and its stylization in Nietzsche’s recollections from the 1880s. And lastly the essay examines the ambivalence toward Wagner in Nietzsche’s writings from 1888 as part of an autobiographical imperative. In general, the collections reviewed place too much trust in Nietzsche’s own accounts of the relationship with Wagner and fail to recognize that, especially in the 1880s, the philosopher is engaged in a process of self-fashioning to bring his current views into harmony with a history embellished and manipulated to give the appearance of linear development and consistent beliefs. This book defends antitheodicism, arguing that theodicies, seeking to excuse God for evil and suffering in the world, fail to ethically acknowledge the victims of suffering. The authors argue for this view using literary and philosophical resources, commencing with Immanuel Kant's 1791 "Theodicy Essay" and its reading of the Book of Job. Three important twentieth century antitheodicist positions are explored, including "Jewish" post-Holocaust ethical antitheodicism, Wittgensteinian antitheodicism exemplified by D.Z. Phillips and pragmatist antitheodicism defended by William James. The authors argue (...) that these approaches to evil and suffering are fundamentally Kantian. Literary works such as Franz Kafka'sThe Trial, Samuel Beckett's Waiting for Godot, and George Orwell's Nineteen Eighty-Four, are examined in order to crucially advance the philosophical case for antitheodicism. This article is about the method of philosophizing employed by Karol Wojtyła. He worked out his main ideas concerning the human person within a Thomistic framework, but at the same time made extensive use of the method typical of phenomenology. The article sets out to demonstrate that these two approaches do not exclude each other, but can instead be considered complementary. Phenomenology, in the version employed by Wojtyła, aims to do justice to the experience of the person, and its analysis (...) helps us understand the richness of the latter. At the same time, all of the phenomena that pertain to the person demand further explanation, and this can be supplied by Thomistic metaphysics. Renate Holub provides a critical introduction to the philosophical foundations of human rights as developed by the Italian philosopher Giambattista Vico [1668-1744]. She demonstrate the profoundly innovative principles he contributed to and his contemporary relevance for a global theory of justice. Leading twentieth century transatlantic intellectuals, like Joseph Schumpeter, Arthur Nussbaum, Robert Cox who, though for quite different ultimate purposes, were variably working at the intersections between sociology, economic analysis, and international legal thought, squarely recognized the gravitas of the (...) unprecedented conceptual reach of the principles governing Vico’s social science. What is central to Vico’s international philosophy is an understanding of civilizational history not marked by permanent violence between individuals or groups of people. Rather, it is an understanding which outlines a broad historical tendency towards the reduction of violence in the internal and external organizations of social relations of peoples in all global regions. Vico’s political thought developed significant elements for a global theory of justice based not on legitimations of violence, as ‘just war’ theories, but for structuring, however minimally, the conditions of ‘permanent just global peace.’. Is consciousness a purely physical phenomenon? Most contemporary philosophers and theorists hold that it is, and take this to be supported by modern science. But a significant minority endorse non-physicalist theories such as dualism, idealism and panpsychism, among other reasons because it may seem impossible to fully explain consciousness, or capture what it's like to be in conscious states (such as seeing red, or being in pain), in physical terms. The article is primarily concerned with the ambiguities which surround the concept of the person. According to the philosophical tradition taking its roots from Locke's definition, personhood depends on consciousness. Therefore, “personhood” can be ascribed to different entities, and only these entities acquire a moral standing. This can entail that a human being may or may not be considered as a person, as well as higher animals and even artificial machines. Everything depends on manifest personal characteristics. In order to sort (...) out different meanings ascribed to “person,” I distinguish between being a person and acting as a person. Genetic engineering promises to change the human condition by changing certain human characteristics. Why not take control of such changes and secure positive outcomes, making use of our progressing knowledge about human genetic make-up and our increasingly sophisticated skills? This paper elaborates the meanings of the word “change,” a cornerstone of the enhancement debate, focusing not on technicalities of genetic engineering but on philosophical implications of its implementation. The paper then turns to some of the complexities and difficulties of the (...) debate. Finally, it takes up a strictly philosophical investigation of what we mean by “change” as far as a basic structure of the human being (the human person) is concerned, and examines what conclusions can be drawn for genetic enhancement. The paper deals with a possible interdependence between bioethics and transhumanism. It seems that nowadays transhumanism is a separate discipline and we can say at most about bioethical aspects of that. However, a more in-depth investigation reveals that transhumanism is a rival of the contemporary bioethics and tends to take control over it. So, this paper tried to prove that this is not a necessity. There are still vital differences between bioethics and transhumanism and they justify keeping the former separate. (...) The main difference concerns the object of investigation: bioethics is about ethical enquiry of the existing, bodily human being, whereas transhumanism is directed toward a future creature called posthuman. Thus, although there are attempts within transhumanism to replace bioethics, they are still two separate fields of investigation and hence the former is not a new and fully-fledged face of the latter.
