Argumentation, which can be abstractly defined as the interaction of different arguments for and against some conclusion, is an important skill to learn for everyday life, law, science, politics and business. The best way to learn it is to try it out on real instances of arguments found in everyday conversational exchanges and legal argumentation. The introductory chapter of this book gives a clear general idea of what the methods of argumentation are and how they work as tools that can (...) be used to analyze arguments. Each subsequent chapter then applies these methods to a leading problem of argumentation. Today the field of computing has embraced argumentation as a paradigm for research in artificial intelligence and multi-agent systems. In this paper, I take up the conciliatory-steadfast debate occurring within social epistemology in regards to the phenomenon of peer disagreement. I will argue, because the conciliatory perspective al-lows us to understand argumentation pragmatically—as a method of problem-solving within a community rather than as a method for obtaining the truth—that in most cases, we should not simply agree to disagree.

This article argues that, suitably modified, the method of reflective equilibrium is a plausible way of selecting moral principles. The appropriate conception of the method is wide and radical, admitting consideration of a full range of moral principles and arguments, and requiring the enquiring individual to consider others' views and undergo experiences that may offset any formative biases. The individual is not bound by his initial considered judgments, and may revise his view in any way whatsoever. It is (...) appropriate to describe the method as a balance between coherentism and fallibilist foundationalism. With these points in mind, various criticisms, including the claims that considered judgments are not initially credible and are shaped by prejudice, and that the method itself fails to determine principle selection, are challenged. It is a common view that arguments from analogy can only be evaluated on a case-by-case basis. However, while this reflects an important insight, I propose instead a relatively simple method for their evaluation based on just (i) their general form and (ii) four core questions. One clear advantage of this proposal is that it does not depend on any substantial (and controversial) view of similarity, unlike influential current alternative methods, such as Walton’s. Following some initial clarification of the (...) notion of analogy and similarity, I demonstrate the strength of this method by analysing and evaluating three prominent arguments from analogy. Dung’s argumentation frameworks are formalisms widely used to model interaction among arguments. Although their study has been profusely developed in the field of Artificial Intelligence, it is not common to see its treatment among those less connected to computer science within the logical-philosophical community. In this paper we propose to bring to that audience a proof-theory for argument justification based on tableaux, very similar to those the Logic students are familiar with. The tableaux enable to calculate whether an (...) class='Hi'>argument or subset of arguments are accepted or rejected in accordance to Dung’s preferred and grounded extension-based semantics. In evidence-based medicine (EBM), methodology has become the central means of determining the quality of the evidence base. The “gold standard” method, the randomised, controlled trial (RCT), imbues medical research with an ethos of disinterestedness; yet, as this essay argues, the RCT is itself a rhetorically interested construct essential to medical-professional boundary work. Using the example of debates about methodology in EBM-oriented research on complementary and alternative medicine (CAM), practices not easily tested by RCTs, I frame the problem of (...) method as a fundamentally rhetorical problem, situated within a boundary drama, and deeply rooted in the discursive practices of science and medicine. The genre of the RCT report, for example, idealises the research process and can tilt the course of arguments about CAM, while the notion of efficacy can function as a rhetorically mobile boundary object that can redefine the very terms of debate. I suggest herein that arguments about method in CAM debates can productively be read, metonymically, as expressions of more general anxieties in medicine about knowledge and evidence, community values, and professional boundaries; as such, these debates can illuminate some of the rhetorical dimensions of EBM. The aim is to provide a roadmap for the methodological assumptions, and related pitfalls, involved in the interdisciplinary investigation of the ethical and legal implications of neuroscientific research and technology. It illustrates these points via the debate about the ethical and legal responsibility of psychopaths. Argument and the conceptual analysis of normative concepts such as 'personhood' or 'human agency' is central to neuroethics. This Element discusses different approaches (...) to establishing norms and principles that regulate the practices addressed by neuroethics and that involve the use of such concepts. How to characterize the psychological features central to neuroethics, such as autonomy, consent, moral understanding, moral motivation, and control is a methodological challenge. In two often neglected passages of the Critique of Pure Reason, Kant submits that the Critique is a 'treatise' or a 'doctrine of method'. These passages are puzzling because the Critique is only cursorily concerned with identifying adequate procedures of argument for philosophy. In this book, Gabriele Gava argues that these passages point out that the Critique is the doctrine of method of metaphysics. Doctrines of method have the task of showing that a given science is (...) indeed a science because it possesses 'architectonic unity' – which happens when it realizes the 'idea' of a science. According to Gava's novel approach, the Critique establishes that metaphysics is capable of this unity, and his reading of the Critique from this perspective not only illuminates the central role of the Transcendental Doctrine of Method within it, but also clarifies the relationship between the different parts of the work. Davidson made a strikingly distinctive and valuable contribution to the practice of ontology. It was a species of argument for the existence of things of one kind or another. It combined Quine's doctrine that “To be is to be the value of a bound variable” with Davidson's own apparently anti‐Quinean views on semantics and logical form in natural language. Roughly: Suppose truth‐conditional analysis of certain English sentences assigns them logical forms containing characteristic quantifiers, and the quantifiers' domains include entities (...) of a certain sort. Then, assuming that some of the relevant sentences are true, it follows that there exist entities of that sort. Legal analysis is dominated by legal arguments, and the assessment of any legal claim requires the assessment of the strengths and weaknesses of those arguments. The ‘logocratic’ method is a systematic method for assessing the strengths and weaknesses of arguments. More specifically, it is a method designed to help the analyst determine what degree of warrant the premises of an argument provide for its conclusion. Although the method is applicable to any type of argument, (...) this essay focuses on the logocratic framework for assessing the strengths and weaknesses of evidentiary legal arguments, arguments offered in litigation in which evidentiary propositions are proffered to support hypotheses. The focus is on American law, but the logocratic analysis offered here could be adjusted without much trouble to handle arguments about evidence in other systems of litigation. In any legal system that aspires to have a fact-finding process that is sufficiently reliable to meet the requirements of justice, we might fashion an analogue for the Socratic maxim ‘the unexamined life is not worth living’: the unexamined evidentiary argument is not worth believing. Argumentation theory is a distinctly multidisciplinary field of inquiry. It draws its data, assumptions, and methods from disciplines as disparate as formal logic and discourse analysis, linguistics and forensic science, philosophy and psychology, political science and education, sociology and law, and rhetoric and artificial intelligence. This presents the growing group of interested scholars and students with a problem of access, since it is even for those active in the field not common to have acquired a familiarity with relevant aspects of (...) each discipline that enters into this multidisciplinary matrix. This book offers its readers a unique comprehensive survey of the various theoretical contributions which have been made to the study of argumentation. It discusses the historical works that provide the background to the field and all major approaches and trends in contemporary research. Argument has been the subject of systematic inquiry for twenty-five hundred years. Argumentation schemes are forms of argument that capture stereotypical patterns of human reasoning, especially defeasible ones like argument from expert opinion, that have proved troublesome to view deductively or inductively. Much practical work has already been done on argumentation schemes, proving their worth in A1 [19], but more precise investigations are needed to formalize their structures. The problem posed in this paper is what form justification of a given scheme, as having a certain precise structure of inference, should (...) take. It is argued that defeasible argumentation schemes require both a systematic and a pragmatic justification, of a kind that can only be provided by the case study method of collecting key examples of arguments of the types traditionally classified as fallacies, and subjecting them to comparative examination and analysis. By this method, postulated structures for schemes can be formulated as hypotheses to solve three kinds of problems: (1) how to classify such arguments into different types, (2) how to identify their premises and conclusions, and (3) how to formulate the critical questions used to evaluate each type of argument. Dominic Scott compares the Republic and Nicomachean Ethics from a methodological perspective. He argues that Plato and Aristotle distinguish similar levels of argument in the defence of justice, and that they both follow the same approach: Plato because he thinks it will suffice, Aristotle because he thinks there is no need to go beyond it.

Research using the intermodal preferential looking paradigm (IPLP) has consistently shown that English‐learning children aged 2 can associate transitive argument structure with causal events. However, studies using the same methodology investigating 2‐year‐old children’s knowledge of the conjoined agent intransitive and semantic role assignment have reported inconsistent findings. The aim of the present study was to establish at what age English‐learning children have verb‐general knowledge of both transitive and intransitive argument structure using a new method: the forced‐choice pointing (...) paradigm. The results suggest that young 2‐year‐olds can associate transitive structures with causal (or externally caused) events and can use transitive structure to assign agent and patient roles correctly. However, the children were unable to associate the conjoined agent intransitive with noncausal events until aged 3;4. The results confirm the pattern from previous IPLP studies and indicate that children may develop the ability to comprehend different aspects of argument structure at different ages. The implications for theories of language acquisition and the nature of the language acquisition mechanism are discussed. (shrink)

This study of Plato's Phaedo promotes better understanding of its arguments for the soul's immortality by showing how Plato intended them, not as proofs, but as properly dialectical arguments functioning in accordance with the method of hypothesis. Unlike the argument for the soul's immortality in the Phaedrus, which does seem intended as a proof, the Phaedo arguments are proceeding toward the first principles that could serve as the basis for a proof - the most important being an account (...) of the soul's own essential nature. This study attends to the substantial progress the Phaedo makes toward such an account. It also considers Socrates' epistemic situation in the dialogue and the problem of whether his confidence in the face of death is misplaced if his arguments have not been proofs before considering how the concluding myth draws together several of the dialogue's main themes. Perfect being theology is the attempt to decide questions about the nature of God by employing the Anselmian formula that God is the greatest possible being. One form of perfect being theology—recently defended by Brian Leftow in God and Necessity—holds that we can decide between incompatible claims that God is F and that God is not F by asking which claim would confer more greatness on God, and then using the formula that God is the greatest possible being to rule (...) out the one which confers less greatness on God. The aim of this paper is to show the unity and consistency of Kant’s reflections throughout all three sections of the Canon of Pure Reason. More specifically, I argue that Section 3, which is devoted to the issue of Fürwahrhalten, or taking-to-be-true, is crucial to achieving the methodological goal of the Canon, which is to justify the legitimacy of the speculative assumptions of pure reason. After examining the historical roots of Kant’s notion of a transcendental doctrine of method, I (...) focus on the methodological role that the practical element plays in the first two sections of the Canon. This paper has three objectives: arguing against levels of reality by employing the Lewis-Jackson method for doing metaphysics, also known as the Canberra plan; showing how this method renders the idea of levels of reality incoherent, but nevertheless leaves the conceptual space open for dualism; sketching out a concrete proposal for a dualism of mind and matter that relies on normativity and that employs ontic structural realism.

The purpose of this paper may be found in the following quotation. “Whenever an argument can be made to lead to a descending infinitude of natural numbers the hypothesis upon which the argument rests becomes untenable. In this paper I will present a visual method that I have created to demonstrate the validity of propositional arguments and predicates, based on the traditional Venn diagrams. This idea was born after becoming aware of how useful visual methods are in other scientific fields, such as geometrical representations of arithmetic and algebraic concepts. Professor Bochenski, as he himself points out in the prologue, is a logician; he is best known in England and the United States for his work in the history of logic, and more recently in Soviet and East European philosophy. But he has taught philosophy for many years - in Rome, in Switzerland, and on a number of visits to the United States - and in this book provides an elementary introduction to contemporary work in the field. As a means (...) to this end he has chosen to deal with four alternative methods employed by philosophers in the twentieth century. Philosophical methodology has not attracted much attention, in English speaking circles, as a distinct branch of the discipline of philosophy; the term "methodologist", if used at all, would ordinarily be taken to refer to somebody concerned with scientific rather than philosophical method. When, therefore, Professor Bochenski refers, as he frequently does, to "contemporary methodologists", meaning people who debate the re spective merits of phenomenology and mathematical logic as ways of approaching the world, the phrase has an odd ring. But philosophical methodology really makes a great deal more sense than scientific method ology. In science methodology is almost superfluous; given all the avail able information and a reasonably clear idea of what is wanted, there is usually not much ambiguity as to the means of getting it, or not much that could be resolved by mere argument. In this book two of the leading figures in argumentation theory present a view of argumentation as a means of resolving differences of opinion by testing the acceptability of the disputed positions. Their model of a 'critical discussion' serves as a theoretical tool for analysing, evaluating and producing argumentative discourse. Exploring the early development of an area of medical literature can inform contemporary medical debates. Different methods of inference include deduction, induction, abduction, and inference to the best explanation. I argue that early shaken baby research is best understood as using abduction to tentatively suggest that infants with unexplained intracranial and ocular bleeding have been assaulted. However, this tentative conclusion was quickly interpreted, by some at least, as a general rule that infants with these pathological signs were certainly cases of (...) abuse. Rather than focusing on inductive arguments, researchers today may be better off focusing on making a compelling inference to the best explanation. (shrink)

This article examines social research on the relations between (young) women's bodies and images through Bergson's method of intuition, which suggests that the only way a thing can be known is through coinciding with the uniqueness of its becoming. I suggest that in this aim, intuition is, necessarily, an intimate research method. Rather than apply Bergson's argument to this area of social research, I examine the resonances between his philosophical method and the moves within social research (...) to attend to the performativity, creativity or inventiveness of research methods. With a focus on my own research, which explored the relations between 13 girls' bodies and images from a feminist-Deleuzian position, I argue here that the interconnected issues of becoming, uniqueness and coincidence that Bergson raises connect with concerns in social research about ontology, concepts and methods. In particular, I suggest that relationality is crucial to these connections. Drawing through the significance of relations, I argue that intimate, intuitive research is desirable because of the ethics that it opens up and enables; ethics intimate in attention to the becoming unique to the object at stake in research and in the attempt to coincide with this uniqueness. First, on the role of mathematics as a paradigm of knowledge in the development of Kant’s Critical philosophy; second, on the nature of Kant’s opposition to his Leibnizean predecessors and its role in the development of the Critical philosophy; and finally, on the specific role of (...) intuition in Kant’s philosophy of mathematics. One of the points that I want to make is that recognizing the importance of these first two issues is essential to giving an adequate account of the third. That is, only by appreciating how Kant uses the example of mathematical knowledge, and in particular the objections he had to previous accounts of such knowledge, can we understand the philosophical role that he ascribes to intuition in his own account of mathematics.I don’t propose to explain the details of Kant’s philosophy of mathematics, but rather to compare his views on mathematics in the pre-Critical Prize Essay of 1764 to those of the Critique of Pure Reason, with the aim of showing how Kant’s doctrine of construction in pure intuition arises out of a combination of two factors: first, his attempt to ground the distinction between the respective methods of mathematics and philosophy, and second, his concern to defend the reality of mathematical knowledge against the views of those he called ‘the metaphysicians.’ The first factor demands an account of the certainty of mathematics, the second requires an account of its content. I shall argue that there is a possible conflict between Kant’s accounts of these features in the Prize Essay, a possibility which is finally ruled out only by means of the Critical doctrine of pure intuition. So I hope to show that there is a significant philosophical role for intuition in Kant’s account of mathematical knowledge (over and above the more logical role attributed to it on readings [End Page 629] such as those of Friedman, Beth, and Hintikka1) in reconciling the content of mathematics and its certainty.2. THE METAPHYSICIANSThroughout his early writings, Kant appealed to the evidence and certainty of mathematics; his attitude towards metaphysics, however, underwent a dramatic shift. In the Physical Monadology of 1756, Kant asked how metaphysics and geometry can be united,[f] or the former peremptorily denies that space is infinitely divisible, while the latter, with its usual certainty, asserts that it is infinitely divisible. Geometry contends that empty space is necessary for free motion, while metaphysics hisses the idea off the stage. Geometry holds universal attraction or gravitation to be hardly explicable by mechanical causes but shows that it derives from the forces which are inherent in bodies at rest and which act at a distance, whereas metaphysics dismisses the notion as an empty delusion of the imagination [1:475–6].2He attempted in this work to reconcile the respective positions of metaphysics and geometry regarding infinite divisibility, thereby demonstrating that “it is neither the case that the geometer is mistaken nor that the opinion to be found among metaphysicians deviates from the truth” [1:480]. Other examples might include Weber’s distinction between the politics of intention and the politics of responsibility. Moreover, such ambiguous concepts as “rights,” have antinomic interpretations. In each of these cases, the full realization of one ideal led, in practice, to consequences associated with the other: in political practice, neither polar ideal was realizable without concessions to the other. But these features are rooted in the deep history of institutions. They are contingent, not philosophical. They nevertheless preclude conventional approaches to political theory. (shrink)

Late ancient Platonists and Aristotelians describe the method of reasoning to first principles as "analysis." This is a metaphor from geometrical practice. How far back were philosophers taking geometric analysis as a model for philosophy, and what work did they mean this model to do? After giving a logical description of analysis in geometry, and arguing that the standard (not entirely accurate) late ancient logical description of analysis was already familiar in the time of Plato and Aristotle, I argue (...) that Plato, in the second geometrical passage of the "Meno" (86e4-87b2), is taking analysis as a model for one kind of philosophical reasoning, and I explore the advantages and limits of this model for philosophical discovery, and in particular for how first principles can be discovered, without circularity, by argument. Through a detailed analysis of the various modes of argumentation employed by Aristotle throughout his natural scientific works, I aim to contribute to the growing scholarship on the relation between Aristotle’s theory of science and his actual scientific practice. I challenge the standard reading of Aristotle as a methodological empiricist and show that he permits a variety of non-empirical arguments to support controversial theses in properly scientific contexts. Specifically, I examine his use of logical (logikôs) argumentation in the discussion of (...) mule sterility in Generation of Animals II 8, rational (kata ton logon) argumentation in his discussion of cardiocentrism throughout the biological works, and the method of division in Posterior Analytics II 13. It is commonly thought that Dioscorides’s view on medicine is purely pragmatic, focused entirely on the effectiveness of medicines, and derived from trial and error. One reason for this interpretation is that Dioscorides himself wrote little about his theory of medicine. In this article, however, we argue that he would have arranged De Materia Medica in a way that would have been useful only to a skilled practitioner. This argument implies that Dioscorides had a medical theory, as the arrangement (...) of the content could not have followed a trial-and-error approach. It is only in the sense of having a theory that he is able to claim that his text is more “complete” than others. This article provides a historical overview of the text from its genesis to its reception and, ultimately, to its falling out of use. This article concludes with a series of hypotheses on the correspondence between theory and arrangement of the treatise, with the aim of narrowing scholarly conjectures about both. In the final analysis, we argue that an arrangement by family resemblance most closely corresponds to the theory that animates Dioscorides’s text. (shrink)
