The notions of perceptual normativity and optimality have generated much discussion in the last decade or so in the literature on Merleau-Ponty. Husserl’s position on the topic has been far less extensively investigated. Surprisingly, however, Husserl wrote a great deal about the question of perceptual optimality. Not only are there a considerable number of important passages scattered throughout the manuscripts, the archive also contains a few important full texts on precisely this issue. Given the role of fulfillment for Husserl’s concept (...) of intentionality, this should not really come as a surprise, since the teleological nature of the fulfillment structure terminates in an experience of the optimum. Hence, however marginal this topic might seem at first glance, reflecting on it rapidly leads us to the heart of Husserl’s project and sheds further light on his conception of intentional experience. Summary The author is of the opinion that as a result of Alexander the Great’s conquest of Syria, which had been a single administrative entity under the Achaemenids, it was divided into two satrapies – the northern and the southern one. He believes that Menon, son of Cerdimmas, was appointed as the first head of the northern satrapy, to be replaced by Arimmas, who, in his turn, was succeeded by Asclepiodorus, son of Eunicus. Besides, it seems that Andromachus became the (...) first head of the southern satrapy, and after he was killed, Menon, transferred from the north to the south, took his place. Already in Alexander’s lifetime, probably in 329/328, Syria was once again merged into one satrapy. It is unclear who was installed as satrap of the unified region. At any rate, it could not have been Menes, son of Dionysius: the hypothesis that in winter 331/330 he was made satrap of the new province including Syria and Cilicia does not stand scrutiny. In the author’s view, the main task Alexander assigned to Menes was to take control and then to keep open and organized the sea communications with the coast of Syria, Phoenicia and Cilicia, and in the matters concerning these activities Menes was fully independent of the local satraps. Summary The article deals with a complex of issues connected with the campaign waged by the Macedonian expeditionary corps in Asia Minor in 336–335 BC. The author clears up the aims set for the advance-guard, its command structure, strength and composition. He also describes the relevant military operations and reveals the reasons both for the Macedonians’ successes in 336 and their failures in 335. The idea is argued that despite the final failures, it is hardly possible to say that the (...) campaign the expeditionary corps conducted ended in its total defeat. Besides, it is noted that those military operations had major significance for Alexander’s campaign in Asia Minor in 334, because a number of preconditions for its full success had been created right in their course. Legal information certification and secured storage combined with documents electronic signature are of great interest when digital documents security and conservation are in concern. Therefore, these new and evolving technologies offer powerful abilities, such as identification, authentication and certification. The latter contribute to increase the global security of legal digital archives conservation and access. However, currently used cryptographic and hash coding concepts cannot intrinsically enclose cognitive information about both the signer and the signed content. Indeed, an evolution of these technologies (...) may be necessary to achieve full text researches within hundreds or thousands of electronically signed documents. This article aims at describing a possible model along with associated processes to create and make use of these new electronic signatures called “meaningful electronic signatures” as opposed to traditional electronic signatures based on bit per bit computation. This paper is an exploration of how to do a better job of accounting for nanomaterials as ‘new.’ We explore three alternative ways that nanomaterials might be made to fall under the TSCA regulatory umbrella. Since nanomaterials are of interest precisely because of the exciting new properties that emerge at the nano-scale, each of these three alternatives must meet what we call the ‘novelty condition’ and avoid what we call the ‘central paradox’ of existing regulatory policy. Failure to meet either of these conditions is a moral failure. This book examines the divine nature in terms of maximal greatness. It investigates each attribute associated with maximal greatness - omnipotence, omniscience, perfect goodness, eternity, and beauty, arguing that maximal greatness is necessary and sufficient for divinity.

If God is essentially all-good, then he is not morally responsible. If God is maximally great, then he is essentially both omnipotent and omniscient and these latter properties ensure that he is essentially all-good. From essential all-goodness, it follows that he does not have the power to choose evil. This in turn results in his lacking the power to do evil and thus his not being responsible for avoiding it. This conclusion is not defeated by objections that differ based on (...) whether they deny, assert, or are independent of the claim that God is essentially all-good. I conclude that a maximally great being is not possible. Theism might remain true, however, if God is not a maximally great being. However, I claim, without defense here, that the best arguments for theism assume or entail that God is a maximally great being. (shrink)

By defining God as a maximally great being Plantinga is able to devise an ontological argument which validly infers from the possibility of there being a God that there necessarily is a God. In this article I shall argue that Plantinga’s argument is not only question-begging, as several critics have complained, but circular in the strongest sense of the term. Based on reflections on the relation between the notions of coherence and possibility, I shall defend two arguments, previously proposed by (...) Tooley and Guleserian, against the existence of a maximally great being. The article concludes with some critical remarks on Plantinga’s rationale for conceiving God as such a being. (shrink)

In the region where some cat sits, there are many very cat-like items that are proper parts of the cat (or otherwise mereologically overlap the cat) , but which we are inclined to think are not themselves cats, e.g. all of Tibbles minus the tail. The question is, how can something be so cat-like without itself being a cat. Some have tried to answer this “Problem of the Many” (a problem that arises for many different kinds of things we regularly (...) encounter, including desks, persons, rocks, and clouds) by relying on a mereological maximality principle, according to which, something cannot be a member of a kind K if it is a large proper part of, or otherwise greatly mereologically overlaps, a K. It has been shown, however, that a maximality constraint of this type, i.e. one that restricts mereological overlap, is open to strong objections. Inspired by the insights of, especially, Sutton and Madden, I develop a type of functional-maximality principle that avoids these objections (and has other merits), and thereby provides a better answer to the Problem of the Many. This paper explores a variety of perfect being theism that combines Yujin Nagasawa’s maximal God thesis with the view that God is not atemporal. We argue that the original maximal God thesis still implicitly relies on a “static” view of divine perfections. Instead, following the recent re-evaluation of divine immutability by analytic philosophers, we propose that thinking of divine great-making properties as fluctuating but nevertheless remaining maximal either for every time t or across all times strengthens the (...) original maximal God thesis. Furthermore, we show that “temporalising” Nagasawa’s maximal God and adopting what we call the fluctuating maximal God thesis provides more effective ways of responding to objections to perfect being theism, in particular, the argument from evil and some conceptual problems pertaining to the Incarnation. Finally, we demonstrate that our proposal is compatible with Christian Scriptures and coheres with numerous biblical passages better than Nagasawa’s original proposal does. (shrink)

The notion of maximal greatness is arguably part of the very concept of God: something greater than God is not even possible. But how should we understand this notion? The aim of this paper is to provide a Śaivist answer to this question by analyzing the form of theism advocated in the Pratyabhijñā tradition. First, I extract a model of divine greatness, the Hierarchical Model, from Nagasawa’s work "Maximal God". According to the Hierarchical Model, God is (...) that than which nothing could be greater by virtue of being better suited than all other beings in relation to certain great-making properties (§1). I then offer an analysis of the form of theism advocated in the Pratyabhijñā tradition by discussing passages from the works of Somānanda, the founder of the Pratyabhijñā school, and of Utpaladeva, the most prominent of Somānanda’s disciples. I argue that the Pratyabhijñā theist cannot account for divine greatness in terms of the Hierarchical Model. My argument is that the Hierarchical Model requires a comparison between God and other beings that cannot be made with the Pratyabhijñā God (§2). Finally, I develop an original alternative model, the Unlimited Nature Model, that accounts for God’s maximal greatness in a way that suits Pratyabhijñā’s theism. According to the Unlimited Nature Model, the nature of all ordinary beings is metaphysically limited as a result of realizing only a small portion of the potential of what could be, and God is maximally great because only he has a completely unlimited nature (§3). In an ideal democracy, people from all walks of life would come together to talk meaningfully and respectfully about politics. But we do not live in an ideal democracy. In contemporary democracies, which are marked by deep social divisions, different groups for the most part avoid talking to each other. And when they do talk to each other, their speech often seems to be little more than a vehicle for rage, hatred, and deception. -/- Democratic Speech in Divided Times argues (...) that we should nevertheless not give up on the ideal of democratic public speech. Drawing on the resources of political theory, epistemology, and philosophy of language, this book develops a sustained account of the norms that should govern public discourse in deeply divided circumstances. Human activity is permeated by norms of all sorts: moral norms provide the 'code' for what we ought to do, norms of logic regulate how we ought to reason, scientific norms set the standards for what counts as knowledge, legal norms determine what is lawfully permitted and what isn't, aesthetic norms establish canons of beauty and shape artistic trends and practices, and socio-cultural norms provide criteria for what counts as tolerable, just, praiseworthy, or unacceptable in a community or milieu. Given (...) the diversity of norm-governed phenomena prevailing in our everyday experience, it is not surprising that the question of normativity has recently generated important debates in philosophy. However, the more specific question concerning the nature and function of 'norms in perceptual experience' has received comparatively little attention. Maximizing is a topic that has received significant attention from researchers and corporate organizations alike. Although extensive previous research has explored how maximizers behave in a decision scenario, a fundamental question remains about why they prefer a larger assortment regardless of whether the decisions are important or not. This study attempts to explore the underlying mechanism of this phenomenon. Four surveys were conducted, and participants from Mturk or Credamo online platforms were recruited. The maximizing tendency was measured by either maximization (...) scale or maximizing tendency scale, and perceived importance and preference for a large assortment were measured in different decision scenarios. Across four studies, we find that maximizers perceive the same decision as more important than satisficers, and perceived importance serves as the mechanism underlying the maximizers’ preference for a large assortment. In other words, in maximizers’ perceptions and interpretations, even seemingly trivial decisions are important enough to spend great effort on a large assortment. We additionally identified a boundary condition for the effect – cost salience. These findings illustrate a pioneering empirical exploration of the difference in the way maximizers and satisficers perceive their decision importance and the reason for maximizers’ preference for a large assortment. Optimal foraging theory has been criticized for underestimating patch exploitation time. However, proper modeling of costs not only answers these criticisms, but it also explains apparently irrational behaviors like the sunk-cost effect. When a forager is sure to experience high initial costs repeatedly, the forager should devote more time to exploitation than searching in order to minimize the accumulation of said costs. Thus, increased recognition or reconnaissance costs lead to increased exploitation times in order to reduce the frequency of future (...) costs, and this result can be used to explain paradoxical human preference for higher costs. In fact, this result also provides an explanation for how continuing a very costly task indefinitely provides the optimal long-term rate of gain; the entry cost of each new task is so great that the forager avoids ever returning to search. In general, apparently irrational decisions may be optimal when considering the lifetime of a forager within a larger system. (shrink)

We propose a generalization of expected utility that we call generalized EU (GEU), where a decision maker’s beliefs are represented by plausibility measures and the decision maker’s tastes are represented by general (i.e., not necessarily real-valued) utility functions. We show that every agent, “rational” or not, can be modeled as a GEU maximizer. We then show that we can customize GEU by selectively imposing just the constraints we want. The use of artificial intelligence (AI) to aid legal decision making has become prominent. This paper investigates the use of AI in a critical issue in employment law, the determination of a worker’s status—employee vs. independent contractor—in two common law countries (the U.S. and Canada). This legal question has been a contentious labor issue insofar as independent contractors are not eligible for the same benefits as employees. It has become an important societal issue due to the ubiquity of the gig (...) economy and the recent disruptions in employment arrangements. To address this problem, we collected, annotated, and structured the data for all Canadian and Californian court cases related to this legal question between 2002 and 2021, resulting in 538 Canadian cases and 217 U.S. cases. In contrast to legal literature focusing on complex and correlated characteristics of the employment relationship, our statistical analyses of the data show very strong correlations between the worker’s status and a small subset of quantifiable characteristics of the employment relationship. In fact, despite the variety of situations in the case law, we show that simple, off-the-shelf AI models classify the cases with an out-of-sample accuracy of more than 90%. Interestingly, the analysis of misclassified cases reveals consistent misclassification patterns by most algorithms. Legal analyses of these cases led us to identify how equity is ensured by judges in ambiguous situations. Finally, our findings have practical implications for access to legal advice and justice. We deployed our AI model via the open-access platform, https://MyOpenCourt.org/, to help users answer employment legal questions. This platform has already assisted many Canadian users, and we hope it will help democratize access to legal advice to large crowds. (shrink)

They must choose between the suggestions, the rules, the orders given to them. As men are always in search of some degree of consistency in their ways of thinking and acting, they fit together the ideas they choose, unconsciously, into systems, into personal, private, individual ideologies. Biologists and philosophers have been extremely pessimistic about the possibility of demonstrating random drift in nature, particularly when it comes to distinguishing random drift from natural selection. However, examination of a historical case-Maxime Lamotte's study of natural populations of the land snail, Cepaea nemoralis in the 1950s - shows that while some pessimism is warranted, it has been overstated. Indeed, by describing a unique signature for drift and showing that this signature obtained in the populations under study, Lamotte was able (...) to make a good case for a significant role for drift. It may be difficult to disentangle the causes of drift and selection acting in a population, but it is not impossible. (shrink)

Recent scholarship has emphasized the contributions of the great Maliki jurist Shihāb al-Dīn al-Qarāfī to Islamic legal thought. However, al-Qarāfī’s compilation of legal maxims and distinctions, al-Furūq, has not yet been studied, nor has the collection of his teacher, the prominent Shafiʿi jurist Ibn ʿAbd al-Salām, known as al-Qawāʿid al-kubrā. Furthermore, the original thought of Ibn ʿAbd al-Salām and his formative influence on al-Qarāfī have been understated. This article compares their two works to demonstrate that al-Qarāfī based his collection in (...) large part on Ibn ʿAbd al-Salām’s al-Qawāʿid and it examines the techniques that al-Qarāfī used, which included reordering, refining, and supplementing borrowed maxims, and anonymizing references to his teacher. Most salient, however, is al-Qarāfī’s “Malikization” of maxims, which entailed replacing Shafiʿi doctrines and authorities with their Maliki counterparts and deploying maxims to defend Maliki doctrines. The article concludes by explaining al-Qarāfī’s authorial choices in light of his Maliki affiliation and the politics between the legal schools in Mamluk Cairo. (shrink)

Diese maximale Perfektion beinhaltet, daß alle Aspekte der Erschaffungen Gottes einem Gesetz der Kontinuität gehorchen – "die Natur macht keine Sprünge", und daher beinhaltet jeder Übergang Kontinuität. Die unendliche Güte Gottes beinhaltet auch unendliche Gerechtigkeit. Für Leibniz verlangt die Gerechtigkeit Gottes aber, daß die Kreaturen, die für ihre Handlungen verantwortlich sind, besonderer Art sein müssen: (...) sie wurden im Bilde Gottes erschaffen; das heißt, daß sie selbst rationale Schöpfer sind. Dies scheint einen grundsätzlichen Unterschied von alien anderen Kreaturen vorauszusetzen, was aber augenscheinlich einen Verstoß gegen das Gesetz der Kontinuität wäre. Die Autoren behandeln die Frage, ob Leibniz tatsächlich beide Prinzipien benutzt und ob – und wenn ja wie – er das folgegerecht tun kann. (shrink)

Maxime Chastaing s'étonne de l'embarras manifesté par les philosophes pour s'assurer de l'existence des autres : ne va-t-il pas de soi que nous coexistons depuis toujours avec nos semblables et que nous ne doutons pas de leur présence tant que nous ne spéculons pas? Il s'agit dès lors de dénoncer avec énergie le faux problème philosophique de la connaissance d'autrui, tout en s'employant à rendre compte, grâce à la psychologie, des conditions de notre communauté d'existence. Cette perspective proprement psycho-philosophique est (...) déployée dès 1934, dans un travail inédit à ce jour, La compréhension d'autrui. Essai de psychologie descriptive. Proche à cette époque de Gabriel Marcel et d'Emmanuel Mounier, après avoir été l'élève de Jean-Paul Sartre au lycée du Havre, Chastaing est un des premiers en France à discuter les thèses de la phénoménologie allemande, d'Edmund Husserl à Max Scheler. Il anticipe ce faisant sur la phénoménologie d'autrui que Sartre développera, non sans résoudre par avance des difficultés que ce dernier mettra du temps à apercevoir. (shrink)
