This article contributes to the analysis of refusal to license cases as abuse of a dominant position pursuant Article 82 EC from an economic perspective. In the Microsoft case, the European Commission introduced an "Incentives Balance Test" to assess whether the refusal to give access to interface information can be justified by arguing that this information is protected by Intellectual Property Rights (IPRs): The Commission argued that if the overall innovative effects evoked by a compulsory license are significantly higher (...) than without this access, the IPR owner is obliged to license. This should be assessed through balancing the different incentives to innovate between the dominant firm and its competitors. In the paper we pursue two objectives: Firstly, we analyze to what extent the decision of the Court of First Instance, which confirmed the decision of the Commission, helps to clarify the criteria in refusal to license cases; in fact, it is disappointing in this regard. Secondly, we demonstrate that the basic idea of the Incentives Balance Test can be interpreted as a test whether the specific IPRs of the dominant firm can be defended from the perspective of the economics of IPRs. This implies that Article 82 allows competition law to correct economically not optimal IPRs through a specific economic analysis. This is followed by a broad overview on theoretical and empirical insights from economics of IPRs, innovation economics and competition and network economics that can help to develop a more general and sophisticated Innovation Effects Test that can be applied in Article 82 refusal to license cases. “This chapter looks at four arguments which Microsoft has used to justify the claim that illegal copying of software is wrong: software piracy is theft; software piracy violates the rights of copyright holders; software piracy is free riding; and software piracy reduces incentives to future innovation. It argues that the first argument is simply wrong, and the other three do not establish that it is in fact wrong to pirate Microsoft’s programs.

Late 2009, the Microsoft Corporation terminated its sales, distribution and upgrading of Microsoft Office Accounting. This article presents an ethical analysis of the way in which Microsoft Corporation effected its decision to withdraw the product with special emphasis on how consumer expectations were formed, maintained and handled throughout the lifecycle of the accounting software in question. This paper addresses the criticism recently directed at Internet companies who have chosen to do business in China. Currently, in order to conduct business in China, companies must agree to the Chinese government’s rule of self-censoring any information the government deems inappropriate. We start by explaining how some of these companies have violated the human rights of Chinese citizens to freely trade information. We then analyze whether the justifications and excuses offered by these companies are sufficient to absolve them of (...) moral responsibility. We argue that both justifications and excuses offered are insufficient. Wilfully abiding by unjust laws, albeit necessary to do business in China, should not trump moral actions that protect rights. This paper considers the arguments that could support the proposition that intellectual property rights as applied to softwarehave a moral basis. Undeniably, ownership rights were first applied to chattels and land and so we begin by considering the moral basis of these rights. We then consider if these arguments make moral sense when they are extended to intellectual phenomenon. We identified two principal moral defenses: one based on utilitarian concerns relating to human welfare, the other appeals to issues of individual (...) autonomy and private control. We conclude that intellectual property rights could not be defended from a moral perspective that emphasizes autonomy and individual control because copyright and patent restrict fundamental freedoms to transfer and redistribute one’s property. We also find it difficult to defend intellectual property in software from a utilitarian perspective because of the current structure of the market. We mention two characteristics of the software market that make it distinct and promote monopolistic conditions and excessive profit taking: the facility of replication, and the need for compatibility in operating systems. We conclude that there are good reasons to reverse the current market’s structure. We suggest three possible remedies. The government could rigorously enforce antitrust legislation, impose greater monitoring and price controls, or obviate the commercial aspect altogether by denying the application of intellectual property rights to software. This paper describes an Intelligent Tutoring System for helping users with ADO.NET called ADO-Tutor. The Intelligent Tutoring System was designed and developed using (ITSB) authoring tool for building intelligent educational systems. The user learns through the intelligent tutoring system ADO.NET, the technology used by Microsoft.NET to connect to databases. The material includes lessons, examples, and questions. Through the feedback provided by the intelligent tutoring system, the user's understanding of the material is assessed, and accordingly can be guided to different (...) difficulty level of exercises and/or the lessons. The Intelligent Tutoring System was evaluated by a group of users and the results were more than satisfactory in terms of the quality of the material and the design of the system. (shrink)

How does the integration of mixed reality devices into our cognitive practices impact the mind from a metaphysical and epistemological perspective? In his innovative and interdisciplinary article, “Minds in the Metaverse: Extended Cognition Meets Mixed Reality” (2022), Paul Smart addresses this underexplored question, arguing that the use of a hypothetical application of the Microsoft HoloLens called “the HoloFoldit” represents a technologically high-grade form of extended cognizing from the perspective of neo-mechanical philosophy. This short commentary aims to (1) carve up (...) the conceptual landscape of possible objections to Smart’s argument and (2) elaborate on the possibility of hologrammatically extended cognition, which is supposed to be one of the features of the HoloFoldit case that distinguishes it from more primitive forms of cognitive extension. In tackling (1), I do not mean to suggest that Smart does not consider or have sufficient answers to these objections. In addressing (2), the goal is not to argue for or against the possibility of hologrammatically extended cognition but to reveal some issues in the metaphysics of virtual reality upon which this possibility hinges. I construct an argument in favor of hologrammatically extended cognition based on the veracity of virtual realism (Chalmers, 2017) and an argument against it based on the veracity of virtual fctionalism (McDonnell and Wildman, 2019). The browser wars case is a useful springboard for considering the principle of positive competition and the proper regulation of platform technologies. There are lessons to be culled about policy, the application of antitrust law, and the parameters of fair competition. We argue that despite Microsofts opportunistic exploitation of its proprietary code, policy makers should resist the temptation to mandate an open source code model. Vigilant anti-trust enforcement is a preferable alternative. But courts must refrain from using antitrust law to (...) favor small innovators or to constrain the economic protections inherent in intellectual property rights, since those rights are still needed to encourage innovation. On the other hand, despite the exigencies of competition, platform leaders should respect the norm of fair competition and refrain from the impulse to tilt the platform in their favor. Preservation of robust intellectual property rights, deft application of antitrust statutes, and principled competition represent the best prescription for social wealth in the New Economy. (shrink)

When you type the word “serendipity” in a word-processor application such as Microsoft Word, the autocorrection engine suggests you choose other words like “luck” or “fate”. This correcting act turns out to be incorrect. However, it points to the reality that serendipity is not a familiar English word and can be misunderstood easily. Serendipity is a very much scientific concept as it has been found useful in numerous scientific discoveries, pharmaceutical innovations, and numerous humankind’s technical and technological advances. Therefore, (...) there have been many books written around the concept. So why do we need this additional book? This is not just another book about serendipity. It has evolved from the Editor’s question lingering for a decade after finishing his widely cited article (coauthored with Prof. Nancy K. Moving education to Zoom, Microsoft Teams, and the many alternatives during the COVID19-pandemic raised the question of pedagogical form. In a sense, pandemic education in its two-dimensionality was a frictionless, sanitized reduction of education to pure form; it offered a more efficient transfer of knowledge and was marked by a heightened means-to-an-end logic. This has made the informal, unforming and deformational activity that Stefano Harney and Fred Moten call study even more difficult, if not impossible during pandemic education. In (...) this article, we consider the pitfalls of thinking in terms of pedagogical form and the formalization of education by engaging with Emile Bojesen’s work on education as (de)formation. Via Harney and Moten, we reflect on what the concept/practice of study by way of formless formation teaches us about (pre-)pandemic education and about pedagogical forms that might be in keeping with study in post-pandemic education. Experimental philosophy of consciousness aims to investigate and explain our thinking about phenomenally conscious states. Based on empirical studies, researchers have argued (a) that we lack a folk concept of consciousness, (b) that we do not think entities like Microsoft feel regret, (c) that unfelt pains are widely accepted, and (d) that people do not attribute phenomenally conscious states to duplicated hamsters. In this article, I review these and other intriguing claims about people’s understanding of phenomenal consciousness. There is widespread agreement that there should be a principle requiring that artificial intelligence be ‘explicable’. Microsoft, Google, the World Economic Forum, the draft AI ethics guidelines for the EU commission, etc. all include a principle for AI that falls under the umbrella of ‘explicability’. Roughly, the principle states that “for AI to promote and not constrain human autonomy, our ‘decision about who should decide’ must be informed by knowledge of how AI would act instead of us” :689–707, 2018). (...) There is a strong intuition that if an algorithm decides, for example, whether to give someone a loan, then that algorithm should be explicable. I argue here, however, that such a principle is misdirected. The property of requiring explicability should attach to a particular action or decision rather than the entity making that decision. It is the context and the potential harm resulting from decisions that drive the moral need for explicability—not the process by which decisions are reached. Related to this is the fact that AI is used for many low-risk purposes for which it would be unnecessary to require that it be explicable. A principle requiring explicability would prevent us from reaping the benefits of AI used in these situations. Finally, the explanations given by explicable AI are only fruitful if we already know which considerations are acceptable for the decision at hand. If we already have these considerations, then there is no need to use contemporary AI algorithms because standard automation would be available. In other words, a principle of explicability for AI makes the use of AI redundant. (shrink)

Examples of extended cognition typically involve the use of technologically low-grade bio-external resources (e.g., the use of pen and paper to solve long multiplication problems). The present paper describes a putative case of extended cognizing based around a technologically advanced mixed reality device, namely, the Microsoft HoloLens. The case is evaluated from the standpoint of a mechanistic perspective. In particular, it is suggested that a combination of organismic (e.g., the human individual) and extra-organismic (e.g., the HoloLens) resources form part (...) of a common mechanism that realizes a bona fide cognitive routine. In addition to demonstrating how the theoretical resources of neo-mechanical philosophy might be used to evaluate extended cognitive systems, the present paper illustrates one of the ways in which mixed reality devices, virtual objects (i.e., holograms), and online (Internet-accessible) computational routines might be incorporated into human cognitive processes. This, it is suggested, speaks to the recent interest in mixed/virtual reality technologies across a number of disciplines. It also introduces us to issues that cross-cut disparate fields of philosophical research, such as the philosophy of science and the philosophy of technology. (shrink)

2017 saw the occurrence of two major IT disasters: the meltdown that plunged into chaos British Airways’ flights at Heathrow and Gatwick airports, and the WannaCry malware hit on Microsoft Windows systems. Incidents like these exemplify how fragile the digital is and how systemic the problems caused by digital failures can be. This paper explores some possible solutions to ensure that any damage caused by such failures is limited. These include redundancy, reflexivity and insurance, accountability, and collaboration.

Plagiarism detection is the process of finding similarities on electronic based documents. Recently, this process is highly required because of the large number of available documents on the internet and the ability to copy and paste the text of relevant documents with simply Control+C and Control+V commands. The proposed solution is to investigate and develop an easy, fast, and multi-language support plagiarism detector with the easy of one click to detect the document plagiarism. This process will be done with the (...) support of intelligent system that can learn, change and adapt to the input document and make a cross-fast search for the content on the local repository and the online repository and link the content of the file with the matching content everywhere found. Furthermore, the supported document type that we will use is word, text and in some cases, the pdf files –where is the text can be extracting from them- and this made possible by using the DLL file from Word application that Microsoft provided on OS. The using of DLL will let us to not constrain on how to get the text from files; and will help us to apply the file on our Delphi project and walk throw our methodology and read the file word by word to grantee the best working scenarios for the calculation. In the result, this process will help in the uprising the documents quality and enhance the writer experience related to his work and will save the copyrights for the official writer of the documents by providing a new alternative tool for plagiarism detection problem for easy and fast use to the concerned Institutions for free. This study deals with the failure of one of the most advanced chatbots called Tay, created by Microsoft. Many users, commentators and experts strongly anthropomorphised this chatbot in their assessment of the case around Tay. This view is so widespread that we can identify it as a certain typical cognitive distortion or bias. This study presents a summary of facts concerning the Tay case, collaborative perspectives from eminent experts: Tay did not mean anything by its morally objectionable statements because, (...) in principle, it was not able to think; the controversial content spread by this AI was interpreted incorrectly—not as a mere compilation of meaning, but as its disclosure; even though chatbots are not members of the symbolic order of spatiotemporal relations of the human world, we treat them in this way in many aspects. Este trabalho é um estudo observacional descritivo retrospectivo, com análise de dados quantitativos de abril a julho de 2019 no Hospital Universitário de Canoas. Foram avaliados 419 prescrições e dados de pacientes quanto a sexo, idade, patologias prévias, vias de administração e medicamentos mais prescritos no CTI. Para análise, foi elaborado um Instrumento de Coleta de Dados, no qual foram transferidos para uma planilha do software Microsoft Excel para análise de frequência. Os resultados encontrados foram que a maioria dos (...) pacientes era do sexo masculino (59%), com idade entre 40 e 69 anos (47%). As patologias mais frequentes foram Hipertensão Arterial (31%), Diabetes Mellitus (18%) e outras como infecções bacterianas, fraturas ou cirurgia cardíaca (46%). A via de administração mais utilizada foi a parenteral (63%). Os medicamentos mais prescritos foram analgésicos / antipiréticos (n = 175), analgésicos narcóticos (n = 126) e antieméticos (n = 126). A caracterização do perfil farmacoterapêutico permitiu definir estratégias de avaliação da prescrição e propor o serviço de farmácia clínica para contribuir com o conhecimento de outros profissionais relacionados aos medicamentos. Contract cheating is a major problem in Higher Education because it is very difficult to detect using traditional plagiarism detection tools. Digital forensics techniques are already used in law to determine ownership of documents, and also in criminal cases, where it is not uncommon to hide information and images within an ordinary looking document using steganography techniques. These digital forensic techniques were used to investigate a known case of contract cheating where the contract author has notified the university and the (...) student subsequently confirmed that they had contracted the work out. Microsoft Word documents use a format known as Office Open XML Format, and as such, it is possible to review the editing process of a document. A student submission known to have been contracted out was analysed using the revision identifiers within the document, and a tool was developed to review these identifiers. Using visualisation techniques it is possible to see a pattern of editing that is inconsistent with the pattern seen in an authentic document. (shrink)

The datafication and digitalization of health and medicine has engendered a proliferation of new collaborations between public health institutions and data corporations like Google, Apple, Microsoft and Amazon. Critical perspectives on these new partnerships tend to frame them as an instance of market transgressions by tech giants into the sphere of health and medicine, in line with a “hostile worlds” doctrine that upholds that the borders between market and non-market spheres should be carefully policed. This article seeks to outline (...) the limitations of this common framing for critically understanding the phenomenon of the Googlization of health. In particular, the mobilization of a diversity of non-market value statements in the justification work carried out by actors involved in the Googlization of health indicates the co-presence of additional worlds or spheres in this context, which are not captured by the market vs. non-market dichotomy. It then advances an alternative framework, based on a multiple-sphere ontology that draws on Boltanski and Thevenot’s orders of worth and Michael Walzer’s theory of justice, which I call a normative pragmatics of justice. This framework addresses both the normative deficit in Boltanski and Thevenot’s work and provides an important emphasis on the empirical workings of justice. Online service providers —such as AOL, Facebook, Google, Microsoft, and Twitter—significantly shape the informational environment and influence users’ experiences and interactions within it. There is a general agreement on the centrality of OSPs in information societies, but little consensus about what principles should shape their moral responsibilities and practices. In this article, we analyse the main contributions to the debate on the moral responsibilities of OSPs. By endorsing the method of the levels of abstract, we first analyse the moral (...) responsibilities of OSPs in the web. These concern the management of online information, which includes information filtering, Internet censorship, the circulation of harmful content, and the implementation and fostering of human rights. We then consider the moral responsibilities ascribed to OSPs on the web and focus on the existing legal regulation of access to users’ data. The overall analysis provides an overview of the current state of the debate and highlights two main results. First, topics related to OSPs’ public role—especially their gatekeeping function, their corporate social responsibilities, and their role in implementing and fostering human rights—have acquired increasing relevance in the specialised literature. Second, there is a lack of an ethical framework that can define OSPs’ responsibilities, and provide the fundamental sharable principles necessary to guide OSPs’ conduct within the multicultural and international context in which they operate. This article contributes to the ethical framework necessary to deal with and by endorsing a LoA enabling the definition of the responsibilities of OSPs with respect to the well-being of the infosphere and of the entities inhabiting it. In this paper, we have developed an Excel package to be utilized for calculating neutrosophic data and analyze them. The use of object oriented programming techniques and concepts as they may apply to the design and development a new framework to implement neutrosophic data operations, the c# programming language, NET Framework and Microsoft Visual Studio are used to implement the neutrosophic classes. We have used Excel as it is a powerful tool that is widely accepted and used for statistical (...) analysis. Figure 1 shows Class Diagram of the implemented package. Figure 2 presents a working example of the package interface calculating the complement. Our implemented Neutrosophic package can calculate Intersection, Union, and Complement of the nuetrosophic set. Digital personal data is increasingly framed as the basis of contemporary economies, representing an important new asset class. Control over these data assets seems to explain the emergence and dominance of so-called “Big Tech” firms, consisting of Apple, Microsoft, Amazon, Google/alphabet, and Facebook. These US-based firms are some of the largest in the world by market capitalization, a position that they retain despite growing policy and public condemnation—or “techlash”—of their market power based on their monopolistic control of personal data. (...) We analyse the transformation of personal data into an asset in order to explore how personal data is accounted for, governed, and valued by Big Tech firms and other political-economic actors. However, our findings show that Big Tech firms turn “users” and “user engagement” into assets through the performative measurement, governance, and valuation of user metrics, rather than extending ownership and control rights over personal data per se. We conceptualize this strategy as a form of “techcraft” to center attention on the means and mechanisms that Big Tech firms deploy to make users and user data measurable and legible as future revenue streams. Lean is a new open source theorem prover being developed at Microsoft Research and Carnegie Mellon University, with a small trusted kernel based on dependent type theory. It aims to bridge the gap between interactive and automated theorem proving, by situating automated tools and methods in a framework that supports user interaction and the construction of fully specified axiomatic proofs. Lean is an ongoing and long-term effort, but it already provides many useful components, integrated development environments, and a rich (...) API which can be used to embed it into other systems. It is currently being used to formalize category theory, homotopy type theory, and abstract algebra. This paper challenges Alasdair MacIntyre’s assertion that the modern firm — such as Google, Unilever, or Microsoft — is inimical to human flourishing within an Aristotelian framework. The paper begins by questioning MacIntyre’s rendering of utopian communities. It then addresses four specific criticisms of the modern firm to be found throughout MacIntyre’s oeuvre, namely compartmentalisation, myopia, inequality, and loss of community. Arguments are made to the effect that these criticisms do not vitiate the institutional role of the modern firm (...) in an Aristotelian context. The paper concludes with an invocation of the modern firm as institutional ideal within an evolving utopian vision of human flourishing. The algorithmic turn in photography raises the question of whether an algorithmically generated image is even a photograph at all. This paradox is abundant on India's urban streets, where the pedestrian or road user is met with giant photo saturated flex hoardings printed with political and community messages and photo-shopped portraits of gods, chief ministers and party workers. In this article, attention to photo-based political posters alongside art practices sharing common elements of digital capture and postproduction contextualizes a reading of (...) technologically produced visual landscapes in the South Indian city of Bangalore. Informed by Vilèm Flusser, the techno-materiality of hoardings are interpreted as visual practices whose reliance on Microsoft and Adobe softwares reveal more than the semiotic information that is ostensibly transmitted; in so doing the extent to which photography is a useful entry point for assessing the visuality in which we're currently living and how this gets locally inflected in the case of India is explored. It installs in minutes, is readily customized, and is designed to work with all major word processor programs such as WordPerfect, WordStar and Microsoft Works. It will also process ASCII files. I highly recommend Correct Grammar. It is a fine program.

The present paper looks at one of the most thorough articles on the intelligence of GPT, research conducted by engineers at Microsoft. Although there is a great deal of value in their work, I will argue that, for familiar philosophical reasons, their methodology, ‘Black-box Interpretability’ is wrongheaded. But there is a better way. There is an exciting and emerging discipline of ‘Inner Interpretability’ (also sometimes called ‘White-box Interpretability’) that aims to uncover the internal activations and weights of models in (...) order to understand what they represent and the algorithms they implement. In my view, a crucial mistake in Black-box Interpretability is the failure to appreciate that how processes are carried out matters when it comes to intelligence and understanding. I can’t pretend to have a full story that provides both necessary and sufficient conditions for being intelligent, but I do think that Inner Interpretability dovetails nicely with plausible philosophical views of what intelligence requires. So the conclusion is modest, but the important point in my view is seeing how to get the research on the right track. Towards the end of the paper, I will show how some of the philosophical concepts can be used to further refine how Inner Interpretability is approached, so the paper helps draw out a profitable, future two-way exchange between Philosophers and Computer Scientists. We examined the associations between the characteristics of Instagram users and the features of their photographs. Narcissism, life satisfaction, and loneliness were employed for user variables and the features at high- and low-levels were employed to analyze the Instagram photographs. An online survey was conducted with 179 university students, and their Instagram photographs, 25,394 in total, were collected and analyzed. High-level features were extracted using Computer Vision and Emotion Application Programming Interfaces in Microsoft Azure Cognitive Services, and low-level features (...) were extracted utilizing the program written by the authors. The results of correlation analysis indicate that narcissism, life satisfaction, and loneliness were significantly associated with a part of photograph features at high- and low-levels. The results of the predictive analysis suggest that narcissism, loneliness in total, and social loneliness could be predicted with acceptable accuracy from Instagram photograph features, while characteristics such as life satisfaction, family loneliness, and romantic loneliness could not be predicted. In this paper we examine the case of Tay, the Microsoft AI chatbot that was launched in March, 2016. After less than 24 hours, Microsoft shut down the experiment because the chatbot was generating tweets that were judged to be inappropriate since they included racist, sexist, and anti-Semitic language. We contend that the case of Tay illustrates a problem with the very nature of learning software that interacts directly with the public, and the developer's role and responsibility associated (...) with it. We make the case that when LS interacts directly with people or indirectly via social media, the developer has additional ethical responsibilities beyond those of standard software.
