S'attachant au Traité de la nature humaine de Hume, l'auteur essaie de montrer comment le concept moderne de naturalisme est un concept ambigu. D'un côté, Hume a ouvert la possibilité d'une science de la nature humaine, qui traite le sujet connaissant comme lui-même objet possible de connaissance. De l'autre côté, prenant en compte cette constitution du sujet connaissant comme pur fait et la réincorporant dans le flux de la vie (comme réalité et comme expérience), il a mis cette science (...) aux prises avec le risque du scepticisme, comme son envers. Dès lors, le naturalisme ne peut jamais être du seul ordre de la science. Focusing on Hume's Treatise of the Human Nature, the author tries to show how the modern concept of naturalism, according to its origin, is a very ambiguous one. On the one side, Hume has opened the possibility of a science of the human nature that deals with the knowing subject as itself a possible object of knowledge. On the other side, taking into account this constitution of the knowing subject as a mere fact and embodying it in the stream of life (as reality and as experience), he has confronted this science with the risk of skepticism, as its own back side. General jurisprudence-that branch of legal philosophy concerned with the nature of law and adjudication-has been relatively unaffected by the "naturalistic" strains so evident, for example, in the epistemology, philosophy of mind and moral philosophy of the past forty years. This paper sketches three ways in which naturalism might affect jurisprudential inquiry. My aim in this article is to argue that Philippa Foot fails to provide a convincing basis for moral evaluation in her book Natural Goodness. Foot’s proposal fails because her conception of natural goodness and defect in human beings either sanctions prescriptive claims that are clearly objectionable or else it inadvertently begs the question of what constitutes a good human life by tacitly appealing to an independent ethical standpoint to sanitize the theory’s normative implications. Foot’s appeal to natural facts about (...) human goodness is in this way singled out as an Achilles’ heel that undermines her attempt to establish an independent framework for virtue ethics. This problem might seem to be one that is uniquely applicable to the bold naturalism of Foot’s methodology; however, I claim that the problem is indicative of a more general problem for all contemporary articulations of virtue ethics.Je soutiens dans cet article que, dans son livre, Natural Goodness, Philippa Foot ne parvient pas à fournir de fondement convainquant à l’evaluation morale. Son argumentation échoue parce que sa conception des qualités et des défauts naturels, soit sanctionne des jugements prescriptifs qui sont manifestement susceptibles d’étre rejetés, soit commet par mégarde une pétition de principe en définissant ce qu’est la bonne vie morale au moyen d’une référence implicite à un point de vue éthique indépendant servant à assainir les implications normatives de la théorie en question. L’utilisation que Foot fait des données de la nature sur l’excellence humaine est ainsi identifi’e comme le talon d’Achille de sa théorie qui ruine sa tentative d’établir un cadre indépendant pour l’éthique de la vertu. Ce problème pourrait paraître concerner uniquement la méthodologie de Foot et son naturalisme radical. J’affirme cependant qu’il est le signe d’un problème plus general pour toutes les formulationscontemporaines de l’éthique de la vertu. (shrink)

La connaissance métaphysique est accessible et nous possédons un tel type de connaissance. Il faut pratiquer la métaphysique de manière directe, sans passer par des considérations de philosophie du langage ou de l'esprit. Les deux principales critiques de la métaphysique sont : le naturalisme évolutionniste et le kantisme. Le naturalisme est incohérent car il nie la possibilité défaire des hypothèses métaphysiques et pourtant il repose sur de telles hypothèses. Kant également ne va pas au bout de son projet, (...) car on ne peut éviter la question du contenu des pensées, une fois qu'on a réduit la métaphysique à une théorie de la connaissance. L'examen des arguments de Barcan-Kripke confirme la possibilité d'une argumentation métaphysique et l'impossibilité d'y échapper. Metaphysical knowledge is accessible and indeed, we have such a knowledge. Metaphysics shoud be done directly, without starting with considerations of philosophy of language or philosophy of mind. The two main critiques of metaphysics are evolutionary naturalism and Kantianism. Naturalism is inconsistent because it denies any possibility to make metaphysical hypotheses, but it hinges upon such hypotheses. Kant is also inconsistent because one cannot avoid the question of the content of thoughts once metaphysics has been reduced to epistemology. A scrutiny of the arguments by Barcan and Kripke confirms the possibility of a purely metaphysical argumentation and the impossibility to do without it. (shrink)

McDowell argues that the shortcomings of recent theories of experience are the product of the modern scientistic conception of nature. Reconceive nature, he suggests, and we can explain how perceptual experience can be an external constraint on thought that, moreover, has conceptual import. In this article I argue that McDowell’s project is unsuccessful. Those wishing to construct normative theories, including theories of perceptual experience, face the normative trilemma—they must choose one of three styles of theory, each of which exhibits a (...) distinctive weakness. If we view McDowell’s approach in light of this choice, we see that he cannot adequately explain the link between experience and the world itself. I conclude that the real problem with theories of experience flows not from scientistic naturalism, but rather from the inconsistent demands we place on normative theories in general.McDowell soutient que les défauts des théories récentes sur l’expérience sont engendrés par la position scientifique moderne sur la nature. En reconcevant la nature, suggère-t-il, on est en mesure d’expliquer comment l’expérience sensorielle peut être une contrainte extérieure sur la pensée, contrainte qui joue, de plus, un rôle conceptuel. Je soutiens dans cet article que le projet de McDowell se solde par un échec. Ceux qui souhaitent élaborer des théories normatives, y compris des théories sur l’expérience sensorielle, font face au trilemme normatif — ils doivent choisir un type de théorie parmi trois types qui trahissent tous une faiblesse particulière. Si l’on envisage la démarche de McDowell dans la perspective de ce choix, on s’aperçoit qu’il ne peut expliquer de manière satisfaisante le lien entre l’expérience et le monde lui-même. J’en conclus que le véritable problème des théories sur l’expérience ne découle pas du naturalisme scientifique, mais plutôt des exigences incohérentes auxquelleson soumet les théories normatives en général. La philosophie de l’animalité chez Heidegger et Merleau-PontyLe présent essai est une tentative de réflexion à partir de l’oeuvre de Merleau-Ponty sur le problème anthropologique: comment penser l’humain dans son rapport ontologique avec l’animal sans retomber dans les dichotomies traditionnelles du spiritualisme et du naturalisme ou de la philosophie et de la non-philosophie, dans lesquelles la pensée contemporaine, en particulier la pensée heideggerienne, est restée à notre avis enfermée. L’originalité théorique de l’approche merleau-pontienne à l’égard de la thématique de (...) la différence anthropologique consiste dans le fait de vouloir repenser la vie, humaine et non humaine, au-delà des dichotomies classiques anthropologico-métaphysiques de la matière et de l’esprit, de l’instinct et de la raison, de la nature et de l’histoire, et ainsi de suite. Par conséquent, ce que nous proposons ici est de repenser la philosophie de l’animalité capable de rendre compte de la spécificité de l’humain sur la base d’une proximité ontologique inédite avec l’animal, comprise comme élément central de l’ontologie de la nature que Merleau-Ponty tentait d’élaborer dans les dernières années de sa vie. Une tâche qui, sans doute, plus qu’un aboutissement théoriques, pourrait être l’indice d’une série de problèmes que la philosophie, grâce avant tout à la contribution fondamentale de Merleau-Ponty, pourrait enfin affronter de manière radicale.The Philosophy of Animality in Heidegger and Merleau-PontyBased on Merleau-Ponty’s work, the present essay attempts to reflect on the anthropological problem: how to conceive the human in its ontological relation withthe animal – without falling back into the traditional dichotomies of spiritualism and naturalism or philosophy and non-philosophy, in which contemporary thought, in particular Heidegger’s thought, has remained, in our opinion, confined. The theoretical originality of Merleau-Ponty’s approach in regard to the thematic of anthropological difference consists in the fact of wanting to rethink life – both human and non-human life – beyond the classic anthropologico-metaphysical dichotomies of matter and spirit, of instinct and reason, nature and history, and so forth. As a result, what we propose here is to rethink the philosophy of animality in a way that is capable of accounting for the specificity of the human on the basis of a new ontological proximity with the animal. We understand this new ontological proximity as the central element of the ontology of nature that Merleau-Ponty attempts to elaborate in the last years of his life. No doubt, this is a task which, being more than a theoretical result, could be the index of a series of problems that philosophy, thanks above all to Merleau-Ponty’s fundamental contribution, can finally confront in a radical manner.
