This paper examines the life and work of T. C. Chamberlin, a prominent glacial geologist who developed an interest in interdisciplinary earth science. His work on the geological agency of the atmosphere informed his understanding of climate change and other terrestrial phenomena and led him to propose a new theory of the formation of the Earth and the solar system.Chamberlin's graduate seminar at the University of Chicago in 1896 contained all the themes that informed his research programme over the next (...) three decades. These included the carbon dioxide theory of climate change in its relationship to diastrophism and oceanic circulation, the role of water vapour feedbacks in the climate system, and the relationship between multiple glaciations, the climate system, and the formation of the planet. Hume’s view of reason is notoriously hard to pin down, not least because of the apparently contradictory positions which he appears to adopt in different places. The problem is perhaps most clear in his writings concerning induction - in his famous argument of Treatise I iii 6 and Enquiry IV, on the one hand, he seems to conclude that “probable inference” has no rational basis, while elsewhere, for example in much of his writing on natural theology, he seems happy to (...) acknowledge that such inference is not only reasonable, but is even a paradigm of reasoning against which the theistic arguments must be judged. In the face of this apparent contradiction, many recent commentators have proferred “non-sceptical” interpretations of Hume’s argument concerning induction, but in this paper I sketch an alternative and perhaps less radical method of resolving the problem, by identifying a major threefold ambiguity in Hume’s use of the word “reason”. On this interpretation, Hume indeed sees induction as a paradigm of reasonableness in what is arguably the most important sense, but he nevertheless believes induction to be entirely non-reasonable in another sense, which though less important in common life is nevertheless very significant philosophically. A comparison with Locke can help to illuminate Hume’s position, which though indeed not entirely sceptical about induction, is by no means entirely non-sceptical either. (shrink)

The traditional hermeneutic ruling not to use reports and legends for questioning edicts and rules signifies the tacit recognition, contrary to explicit statement, of the part of the Rabbinical leadership, of the inevitability of change in diverse aspects if Jewish life. This may invite criticism of the conduct of the ancient leadership, which, as always, is questionable and useless. Rather, an open discussion should be instituted on the proposal to make future changes openly, not surreptitiously; particularly the change from surreptitious (...) changes to open changes is better done openly. Retrospective rule-making has few supporters and many opponents. Defenders of retrospective laws generally do so on the basis that they are a necessary evil in specific or limited circumstances, for example to close tax loopholes, to deal with terrorists or to prosecute fallen tyrants. Yet the reality of retrospective rule making is far more widespread than this, and ranges from ’corrective’ legislation to ’interpretive regulations’ to judicial decision making. The search for a rational justification for retrospective rule-making necessitates a (...) reconsideration of the very nature of the rule of law and the kind of law that can rule, and will provide new insights into the nature of law and the parameters of societal order. This book examines the various ways in which laws may be seen as retrospective and analyses the problems in defining retrospectivity. In his analysis Dr Charles Sampford asserts that the definitive argument against retrospective rule-making is the expectation of individuals that, if their actions today are considered by a future court, the applicable law was discoverable at the time the action was performed. The book goes on to suggest that although the strength of this ’rule of law’ argument should prevail in general, exceptions are sometimes necessary, and that there may even be occasions when analysis of the rule of law may provide the foundation for the application of retrospective laws.
