This article aims to expound the principle of justice, as a fundamental value and as an immanent category of law, as well as one of the fundamental human rights, prescribed and guaranteed by a myriad of international instruments and documents. After a brief historical account, by focusing on Article 40 of the Magna Carta Libertatum, which states that: “To No One Will we Sell, To No One Will we refuse or delay, right or justice”, this article claims to (...) show the importance of incorporation of this principle in the provisions of the Magna Carta and its impact on the development of theory and legislation in the past and present. Moreover, the article intends to explore the extent of influence that the priciple of justice has on the functioning of the law in general. Since justice implicates the permanent and constant will to render each person his due, and this achieved through equality, it results that justice means being equal. In this context, the article will explore the concept of equality as a precondition of justice, as well as the conditions and modalities for its implementation. Having in mind that the principle of justice is closely linked to the principle of equity, because equity precedes justice, or more precisely, equity is considered a source of justice, this article seeks to articulate the essential distinctions between these two concepts by focusing on their methods, i.e. in their approach for putting the idea of equality into action. Methodological principles guarantee autonomic regime of scientific investigations. Methodological principles are requirements the process of descriptive knowledge receiving as result of methodological analysis on best samples of scientific investigations, or methodological standards in history of science. There are mane principles in methodology of science: autonomic scientific investigation, competence, objectivity, expedience, systemness, verification, coherence, unity of methods, integration, differentiation, many-variation of formulizations, modernizations, diversity of chosen types of (...) descriptions, two logical meanings – truthfulness and falseness. The consensus is that in his 1755 Nova Dilucidatio, Kant endorsed broadly Leibnizian compatibilism, then switched to a strongly incompatibilist position in the early 1760s. I argue for an alternative, incompatibilist reading of the Nova Dilucidatio. On this reading, actions are partly grounded in indeterministic acts of volition, and partly in prior conative or cognitive motivations. Actions resulting from volitions are determined by volitions, but volitions themselves are not fully determined. This move, which was standard in medieval treatments of free (...) choice, explains why Kant is so critical of Crusius’s version of libertarian freedom: Kant understands Crusius as making actions entirely random. In defense of this reading, I offer a new analysis of the version of the principle of sufficient reason that appears in the Nova Dilucidatio. This principle can be read as merely guaranteeing grounds for the existence of things or substances, rather than efficient causes for states and events. As such, the principle need not exclude libertarian freedom. Along the way, I seek to illuminate obscure aspects of Kant’s 1755 views on moral psychology, action theory, and the threat of theological determinism. (shrink)

Most donated organs in the United States come from brain dead donors, while a small percentage come from patients who die in “controlled,” or expected, circumstances, typically after the family or surrogate makes a decision to withdraw life support. The number of organs available for transplant could be substantially if donations were permitted in “uncontrolled” circumstances–that is, from people who die unexpectedly, often outside the hospital. According to projections from the Institute of Medicine, establishing programs permitting “uncontrolled donation after circulatory (...) determination of death,” or uDCDD, throughout the United States has the potential to provide 22,000 more donation opportunities annually. In contrast, U.S. controlled donation after circulatory determination of death, or cDCDD, cases have increased progressively over the past decade from 87 to 848 donors, but currently account for only 10.6 percent of all deceased donors. Following the IOM recommendations, several projects exploring the feasibility of uDCDD were funded by the federal government, including a grant from the Health Resources and Services Administration that supported a pilot project in New York City in which the authors of this article participated.A key feature of our protocol, and indeed of many uDCDD protocols, is the initiation of preservation methods such as chest compressions and extracorporeal membrane oxygenation shortly after death in order to perfuse and preserve the donor's organs. Critics of uDCDD argue that the means of determining death deviates from generally ascribed principles. They assert that reinstituting circulation in order to preserve organs has the effect of “undoing” the prior determination of death. The result is that cDCDD is widely accepted and practiced routinely even though it only marginally increases the number of organs available for transplantation, and uDCDD is widely considered unacceptable despite being ethically embraced and proven to significantly increase organ donation opportunities in other countries. This article explores the evolution of this counterintuitive state of affairs and calls for a policy that, in line with the IOM report, allows for both cDCDD and uDCDD protocols. (shrink)

Background:Moral courage is defined as courage to act according to one’s own ethical values and principles even at the risk of negative consequences for the individual. In a complex nursing practice, ethical considerations are integral. Moral courage is needed throughout nurses’ career.Aim:To analyse graduating nursing students’ moral courage and the factors associated with it in six European countries.Research design:A cross-sectional design, using a structured questionnaire, as part of a larger international ProCompNurse study. In the questionnaire, moral courage was assessed with (...) a single question (visual analogue scale 0–100), the questionnaire also covered several background variables.Participants and research context:The sample comprised graduating nursing students (n = 1796) from all participating countries. To get a comprehensive view about graduating nursing students’ moral courage, the views of nurse managers (n = 538) and patients (n = 1327) from the same units in which the graduating nursing students practised were also explored, with parallel questionnaires.Ethical considerations:Ethical approvals and research permissions were obtained according to national standards in every country and all participants gave their informed consent.Results:The mean of graduating nursing students’ self-assessed moral courage was 77.8 (standard deviation 17.0; on a 0–100 scale), with statistically significant differences between countries. Higher moral courage was associated with many factors, especially the level of professional competence. The managers assessed the graduating nursing students’ moral courage lower (66.5; standard deviation 18.4) and the patients slightly higher (80.6; standard deviation 19.4) than the graduating nursing students themselves.Discussion and conclusions:In all countries, the graduating nursing students’ moral courage was assessed as rather high, with differences between countries and populations. It is shown that the uncertainty connected with a `random in a broad sense' (not necessarily stochastic) event always has some `statistical regularity' (SR) in the form of a family of finite-additive probability distributions. The specific principle of guaranteed result in decision making is introduced. It is shown that observing this principle of guaranteed result leads to determine the one optimality criterion corresponding to a decision system with a given `statistical regularity'.

The COVID-19 pandemic in 2020 has had a lasting impact on all areas of personal life. However, the political, economic, legal and healthcare system, as well as the education system have also experienced the effects. Universities had to face new challenges and requirements in teaching and examinations as quickly as possible in order to be able to guarantee high-quality education for their students.This study aims to examine how the German-speaking medical faculties of the Umbrella Consortium of Assessment Network have dealt (...) with the challenges but also the opportunities that the outbreak of the COVID-19 pandemic created in medical education and whether digitalisation has been driven forward as a result. In an initial online-survey we focused our questions on the current teaching situation with regard to digitised teaching content, the support or establishment of adequate framework conditions by the medical faculties and IT facilities and also the execution of examinations during the summer semester 2020.Between August and September 2020, a total of 88 examiners, educators, dean of study and/or technical admins from 32 partner faculties took part in the survey. Students were not included in our survey. Most respondents stated that a switch to a digital semester had worked, the use of e-learning increased compared to previous semesters and that most courses could be converted, with the exception of practical courses, which were largely cancelled. The respondents also indicated that most examinations could still be taken, with the exception of practical examination formats, like Objective Structured Clinical Examinations. However, in the case of face-to-face examinations, strict distance and hygiene conditions had to be obeyed or there had to be a switch to distance-online examinations, which raised many open issues such as equal opportunities of students and attempts at deception.In conclusion, we identified several issues regarding the rapid transition to a digital semester due to COVID-19 which were categorised into the following topics: Face-to-face teaching could not take place, know-how of educators, integrity aspects, technical aspects, additional personnel required, additional time and effort required for implementation of digital teaching. Our study shows that a switch to digital teaching and distance online examinations is feasible, but many problems were encountered concerning academic integrity and basic ethical principles still need to be solved. In order to investigate whether above mentioned issued could be solved one year after the transition to a digital semester, we conducted a second survey in which the 32 initially surveyed institutions were questioned again. _Purpose._ The authors of this paper seek to comprehend, on the basis of ethics of discourse and communicative philosophy, the dimensions of human existence in times of war. This involves solving the following research tasks: to show the importance of moral and ethical norms in the structure of human existence and to emphasize the need for their observance by a person in the realities of war; to find out what the role of responsibility and co-responsibility is in preserving the space (...) of human existence in times of war; to explore the influence of discourse on the establishment of rational and social dimensions of human existence, formation of communicative space of understanding. _Theoretical basis._ The ideas of communicative philosophy and principles of discourse ethics, focused on the problems of substantiating ethical norms and values in their relationship with the human life world, and its activities are underlying the research. The analysis of human existence in times of war was carried out considering the theoretical and methodological foundations of philosophical anthropology. _Originality._ It is substantiated that the recognition of the universality of moral norms and values, and the productive power of communication contribute to deepening the understanding of the complexity and versatility of human existence in times of war. It has been determined that human existence’s rational and moral dimensions acquire particular significance in the context of russian aggression against Ukraine. The role of discourse was defined for affirming the humanistic foundations of human existence, in achieving cohesion, interaction, social solidarity, which is a condition for human development as a collective and unique being. It is noted that in war conditions the value of individual forms of human existence is complemented by the obligatory responsibility and co-responsibility for a person, awareness of the significance of coexistence in a situation where there is a threat to human life. _Conclusions._ The study of human existence involves the use of the methodological potential of discourse ethics, the significance of the ideas of which is increasing in the modern world because of the dangers caused by russian aggression against Ukraine. The recognition of the power of universal moral norms and the productive power of communication results in the affirmation of the humanistic foundations of human existence, the formation of the communicative space of understanding and consent necessary for a person. This term refers to knowledge of what is axiological, id est everything related to human values, and the know-how on how to manage the study of values. In knowledge societies, we know and live axiological projects that we do not receive from anyone, but that we must construct ourselves in a situation of continuous change. In view of the fact that the axiological crisis in which we are immersed is the (...) most serious one that humanity has suffered over its long history, the seriousness and urgency of the issue in question is evident. Adequate knowledge is required to solve this problem, which is at the root of all the problems we are experiencing. This work offers a potential solution that, in contrast to the past, cannot be definitive, but must be transformed throughout the continuous changes to ways of life as a result of technoscience. Wolff's book defends the Kantian idea of a "general logic" whose principles underlie special systems of deductive logic. It thus undermines "logical pluralism," which tolerates the co-existence of divergent systems of modern logic without asking for consistent common principles. Part I of Wolff’s book identifies the formal language in which the most general principles of logic must be expressed. This language turns out to be a version of syllogistic language already used by Aristotle. The universal validity of logical principles, as (...) well as the translatability of other logical languages into this language, are shown to depend only on the meanings of its logical vocabulary. Part II of the book answers the metalogical question concerning the deductive relation between general logic and special logical systems, which also have their own (less general) principles. This part identifies the rules according to which logical rules can be derived from principles. By a valid inference is here understood an inference that succeeds in its aim to justify its conclusion given that its premisses are already justified. For an inference to be valid it is thus not enough that the sentence asserted in the conclusion is a logical consequence of the sentences asserted in the premisses. A proof is understood as a succession of valid inferences that is closed (i.e. all its assumptions are discharged and all its free variables are bound by (...) some of the inferences). On the other hand, in mathematics the justification of an assertion has traditionally been taken to consist in a proof of it, which gives rise to an explanatory circle.In an attempt to avoid this circle, I have in previous works tried to explain the notion of ground for an assertion without referring to valid inferences. However, it turns out that the resulting notion of ground has unwanted consequences like the notion of proof in the so-called BHK-interpretation of intuitionistic logic. For instance, one is guaranteed a ground or a proof of an implication A → B as soon as there is in fact no ground or proof of A, regardless of whether one really knows this fact, and hence without having a real justification of the assertion of the implication.In the absence of a non-circular explanation of the notions of valid inference and proof, I suggest that we should try to formulate a number of principles of how these two epistemic notions depend on each other. A more careful explanation of the validity of an inference results in what I call a heuristic idea about the validity of inference, which is used as a guide to formulate precise principles. One such principle generalizes Gentzen’s idea that his introduction rules define the meaning of the logical constants. Another principle generalizes a previously noted property of Gentzen’s elimination rules that I have called that of satisfying the inversion principle. It results in a notion that I call non-creativity, which implies validity. (shrink)

_Purpose._ The main purpose of this research is to comprehend the philosophical principles in the spread and legitimation of the Self-made-man idea in the worldview transformations of the 17th century. _Theoretical basis._ Historical and comparative methods became fundamental ones for the research. The research is based on the creative heritage of R. Descartes, T. Hobbes, J. Locke, as well as the works of modern researchers. _Originality._ The analysis shows that the Self-made-man idea, which originated in the ancient world and gradually (...) spreads in the Christian Middle Ages, gained a powerful impetus in the philosophical and moral-legal metamorphoses of the 17th century. These metamorphoses theoretically substantiated and radically accelerated the transition from mystical to rational, from theocentric to the anthropocentric worldview, and, as a result, to the recognition of the intellectual autonomy of the individuals and the freedom of their own will, the emergence of the construct of natural human rights, the requirements of religious tolerance and freedom of conscience, ultimately, to the principle of reliance on one’s own strength and the individual’s personal responsibility for one’s own destiny. Exactly these ideas in interaction with the ideas of Puritanism became the theoretical basis for the formation of B. Franklin’s views and the corresponding cultural code. _Conclusions._ The philosophy of the 17th century, having laid the principles of a new – subject-centric – metaphysics, as well as the philosophical and legal foundations of liberal ideology, provided philosophical and moral-legal legitimation to the sporadic attempts of man to break out of the triple circle of fatalism, paternalism, and conformity to a rationally founded and the ever-growing orientation of the individual towards active self-determination and self-realization, self-reliance and personal responsibility for their own destiny as key principles of the Self-made-man concept. Five years ago, an article co-written by some of us presented an emerging trend to disclose some individual genetic results to research participants within the international research community. At the time, ethical norms and scholarly publications on the return of results often did not distinguish between the return of research results in general and the return of unexpected results. Both technologies and research practices have evolved significantly. Today whole genome and exome sequencing are increasingly affordable and frequently used in genetic (...) research. Because these techniques produce a vast amount of interpretable and non-interpretable data about an individual, the issue of how to manage information generated by such technologies needs to be considered. However, the development of international ethical guidelines has not kept up with the rapid pace of technological progress. Indeed developments in genomic biobanking also challenge the duty to disclose research results. (shrink)

Five years ago, an article co-written by two of us (Joly and Simard) presented an emerging trend to disclose certain individual genetic results to research participants. Since then, both technologies and research practices have evolved significantly. Given this rapid evolution, our goal is to provide updated and thorough guidance on this issue. Our paper begins by identifying the ethical principles that support the return of results: justice, beneficence, and respect for persons. Then, it presents the results of an analysis of (...) international norms on the return of results, covering both general and individual research results. It reveals existing divergence and consensus on these topics within the international community. With the goal of promoting greater harmonization, we conclude by proposing a flexible framework for the return of individual research results. (shrink)

Alexander Pruss’s Principle of Sufficient Reason states that every contingent true proposition has an explanation. Pruss thinks that he can plausibly maintain both his PSR and his account of libertarian free will. This is because his libertarianism has it that contingent true propositions reporting free choices are self-explanatory. But I don’t think Pruss can plausibly maintain both his PSR and libertarianism without a rift occurring in one or the other. Similar to the old luck/randomness objection, I contend that Pruss’s (...) libertarianism is susceptible to what I call “the inexplicability objection”, which attempts to show that agents’ free choices involve contingent brute facts. Pruss may be able to partially explain a proposition such that Jones freely chose A for reason R, but he cannot adequately explain a contrastive proposition such as that Jones freely chose A for R rather than B for R*. The result is that either PSR is too explanatorily permissive for libertarianism, or libertarianism is too explanatorily impermissive to satisfy PSR. After considering what I take to be Pruss’s best response to the inexplicability objection, I conclude that his attempt to reconcile PSR and libertarianism is unsuccessful. (shrink)

Leibniz was a philosopher of principles: the principles of Contradiction, of Sufficient Reason, of Identity of Indiscernibles, of Plenitude, of the Best, and of Continuity are among the most famous Leibnizian principles. In this article I shall focus on the first three principles; I shall discuss various formulations of the principles (sect. 1), what it means for these theses to have the status of principles or axioms in Leibniz’s philosophy (sect. 2), the fundamental character of the Principles of Contradiction and (...) Sufficient Reason (sect. 3), some attempts to demonstrate the Principles of Contradiction and Sufficient Reason (sect. 4), and one attempt to demonstrate the Principle of Identity of Indiscernibles (sect. 5). The common cause principle says that every correlation is either due to a direct causal effect linking the correlated entities or is brought about by a third factor, a so-called common cause. The principle is of central importance in the philosophy of science, especially in causal explanation, causal modeling and in the foundations of quantum physics. Written for philosophers of science, physicists and statisticians, this book contributes to the debate over the validity of the common cause principle, (...) by proving results that bring to the surface the nature of explanation by common causes. It provides a technical and mathematically rigorous examination of the notion of common cause, providing an analysis not only in terms of classical probability measure spaces, which is typical in the available literature, but in quantum probability theory as well. In this article, an argument is made for extending bioethical principles to place-based community and cultural group protections when there are conflicting perspectives on reporting individual results of biomonitoring studies. Bioethical principles of beneficence, nonmaleficence, respect for autonomy, and justice can incorporate participatory decision-making and understandings of the group conditions of individual research participants, particularly for research studies with vulnerable groups. Arguments for and against biomonitoring communication to individual participants are reviewed here. Assessments of risks and benefits of biomonitoring communication (...) can be improved by considering the contextual conditions of cultural groups and place-based communities. Providing participatory decision-making with all stakeholders about biomonitoring communication can provide more fair benefits than adopting a general, prescriptive clinical standard that favors only group report-backs when clinical utility is low and the scientific understandings of low dose exposures of chemical contaminants to humans are still uncertain. In a recent pair of publications, Richard Bradley has offered two novel no-go theorems involving the principle of Preservation for conditionals, which guarantees that one’s prior conditional beliefs will exhibit a certain degree of inertia in the face of a change in one’s non-conditional beliefs. We first note that Bradley’s original discussions of these results—in which he finds motivation for rejecting Preservation, first in a principle of Commutativity, then in a doxastic analogue of the rule of modus ponens (...) —are problematic in a significant number of respects. We then turn to a recent U-turn on his part, in which he winds up rescinding his commitment to modus ponens, on the grounds of a tension with the rule of Import-Export for conditionals. Here we offer an important positive contribution to the literature, settling the following crucial question that Bradley leaves unanswered: assuming that one gives up on full-blown modus ponens on the grounds of its incompatibility with Import-Export, what weakened version of the principle should one be settling for instead? Our discussion of the issue turns out to unearth an interesting connection between epistemic undermining and the apparent failures of modus ponens in McGee’s famous counterexamples. (shrink)

Analytical models describing the motion of colloidal particles in given force fields are presented. In addition to local approaches, leading to well known master equations such as the Langevin and the Fokker–Planck equations, a global description based on path integration is reviewed. A new result is presented, showing that under very broad conditions, during its evolution a dissipative system tends to minimize its energy dissipation in such a way to keep constant the Hamiltonian time rate, equal to the difference (...) between the flux-based and the force-based Rayleigh dissipation functions. In fact, the Fokker–Planck equation can be interpreted as the Hamilton–Jacobi equation resulting from such minumum principle. At steady state, the Hamiltonian time rate is maximized, leading to a minimum resistance principle. In the unsteady case, we consider the relaxation to equilibrium of harmonic oscillators and the motion of a Brownian particle in shear flow, obtaining results that coincide with the solution of the Fokker–Planck and the Langevin equations. Sometimes we receive evidence in a form that standard conditioning (or Jeffrey conditioning) cannot accommodate. The principle of maximum entropy (MAXENT) provides a unique solution for the posterior probability distribution based on the intuition that the information gain consistent with assumptions and evidence should be minimal. Opponents of objective methods to determine these probabilities prominently cite van Fraassen’s Judy Benjamin case to undermine the generality of maxent. This article shows that an intuitive approach to Judy Benjamin’s case supports maxent. (...) This is surprising because based on independence assumptions the anticipated result is that it would support the opponents. It also demonstrates that opponents improperly apply independence assumptions to the problem. (shrink)

Individual research protections provided by bioethical principles can be extended to group protections, particularly for place-based communities and cultural groups who may share a common harm or burden. In this article, an argument is made for the need to consider the group conditions of individual research subjects in the ethics of individual report-backs of human biomonitoring results. Human biomonitoring, the measuring of concentration of chemicals or their metabolites in blood, urine, breast milk, hair, and other biological samples, can provide an (...) assessment of an individual's exposure to a chemical and can integrate exposures from multiple pathways and sources. Biomonitoring studies have been increasing in the past decade for such purposes as measuring the levels of chemicals that are ingested by members of the general population and at what concentrations, to determine if exposure levels are higher in some groups vs. others, to track temporal trends to establish reference ranges for chemical exposures, and to investigate an association with health. Scholars who doubt the existence of general political obligations typically criticize and reject theories of obligation based on individual moral principles, for example, consent, fairness, or a natural duty of justice. Astronger position can result fromcombining different principles in a single theory. I develop a multiprinciple theory of political obligation, based on the principle of fairness, a natural duty of justice, and what I call the “common good” principle. The three principles interact in three main ways: “cumulation,” (...) combining the separate state services that different principles cover; “mutual support,” combining the force of different principles in regard to the same state services; and simple overlap. The resulting theory is able to satisfy the main conditions for an adequate theory of obligation: demonstrating that all or nearly all inhabitants of society have moral requirements to obey the law, and that these extend to the full range of state services. Background: Theoretically, the principle of justice is strong in healthcare priorities both nationally and internationally. Research, however, has indicated that questions can be raised as to how this principle is dealt with in clinical intensive care. Objective: The objective of this article is to examine how significant others may affect the principle of justice in the medical treatment and nursing care of intensive care patients. Method: Field observations and in-depth interviews with physicians and nurses in intensive care (...) units (ICU). Emphasis was placed on eliciting the underlying rationale for prioritisations in clinical intensive care with particular focus on clinicians’ considerations when limiting ICU treatment. Results: Significant others could induce an unintentional discrimination of ICU patients. Family members who were demanding received more time and attention for both the patient and themselves. Patients’ and families’ status and position and/or an interesting medical diagnosis seemed to govern the clinicians’ priorities of patients and families—consciously as well as unconsciously. The clinicians emphasised that patient information given through families was important. However, patients’ preferences and values conveyed to clinicians through their families were not always taken seriously. This even applied in cases with very serious prognoses and an explicit patient wish to forego life-prolonging treatment. Conclusion: The principle of justice was violated when qualified attention was given to significant others, and through this also to patients. Attention given to significant others was influenced by the healthcare workers’ professional and personal values, attitudes and interests. (shrink)

The nature of attention is one of the oldest and most central problems in psychology. A huge amount of research has been produced on this subject in the last half century, especially on attention in the visual modality, but a general explanation has remained elusive. Many still view attention research as a field that is fundamentally fragmented. This book takes a different perspective and presents a unified theory of visual attention: the TVA model. In his 1910 book On the principle of contradiction in Aristotle, Jan Łukasiewicz claims that syllogistic is independent of the principle of contradiction . He also argues that Aristotle would have defended such a thesis in the Posterior Analytics. In this paper, we first show that Łukasiewicz's arguments for these two claims have to be rejected. Then, we show that the thesis of the independence of assertoric syllogistic vis-à-vis PC is nevertheless true. For that purpose, we first establish (...) that there is no possibility to account for Aristotle's original views on syllogistic without using per impossibile deductions. At last, following an idea due to Smith 1983, we prove that there is a complete reconstruction of assertoric syllogistic using ecthesis instead of reductio ad absurdum. Contrary to what is claimed in Smith 1983, we show that Smith's system SE has to be improved for such a reconstruction. The principle of subsidiarity can be an effective tool for adjusting economic systems and establishing the social rule-of-law concept in public organisation. In considering the usability of the principle of subsidiarity, the following aspects thereof are discussed: the role in the development of the European social model; employment in determining limits for the powers of the public and private sectors; the application in the market and planned economy systems; and the social justice function in the development of a (...) social welfare state. The principle of subsidiarity as an instrument for individuals’ interests, balancing and adjusting in the regulation of economic systems, helps to establish the relative sizes of public policy and the market, as subsidiarity can help ensure a more equitable distribution of public goods while guaranteeing the maintenance of the creative potency of operators and minimal satisfaction of vital needs of individuals unable to contribute to the production of goods. It amounts to a constitutional measure determining the balance of productive and protective state, thus ensuring the stability of the state organisation. In the concept of a social rule-of-law state, subsidiarity draws clear limits to the state’s powers, institutionally bringing together efforts of all members of the community to achieve welfare in the state. At first glance, the formulation of the principle of inertia—not. yet complete with Galileo, more precise with Gassendi, finally systematic with Newton—seems to constitute but one of the aspects of a process of deep transformations at the end of which traditional cosmology was replaced by various world systems. These transformations—or, to use a more classic term, this “ scientific revolution” —have been the object of numerous works, a list, of which would alone fill the pages of a thick volume. (...) But the principle of inertia itself, a principle about which can be said without exaggeration that it expressed the essence of this revolution at the same time as it stimulated it, has perhaps not received all the attention it deserves. And especially the impact of this principle on Western culture has not been fully measured. True, Alexandre Koyré has always insisted on the fact that, by reducing movement to a state like that of the state of rest, the principle of inertia expressed a new vision of the world more than a scientific result. But his admirable analyses deal more with the slow advent of the priciple of inertia among the natural philosophers who preceded, accompanied and then followed Galileo than with the theological, philosophical and literary impact of this principle. Moreover, by examining this impact, we discover that it is necessary to make a distinction between Euclidian space and absolute space, a distinction which is frequently implicit with certain scientific historians, but, and this must be emphasized, is more often ignored. Jeremy Bentham's work on The Principles of Morals and Legislation emerges from its historic roots in hedonism and teleology as a scientific attempt to assess the moral content of human action by focusing on its results or consequences. Proceeding from the assumption that human beings desire pleasure (and avoid pain), Bentham's unique perspective, known as utilitarianism, is used to construct a fascinating calculus for determining which action to perform when confronted with situations requiring moral decision-makingthe goal of which is to (...) arrive at the "greatest happiness of the greatest number." Toward this end, he endeavors to delineate the sources and kinds of pleasure and pain and how they can be measured when assessing one's moral options. Bentham supports his arguments with discussions of intentionality, consciousness, motives, and dispositions. Bentham concludes this groundbreaking work with an analysis of punishment: its purpose and the proper role that law and jurisprudence should play in its determination and implementation. Here we find Bentham as social reformer seeking to resolve the tension that inevitably exists when the concerns of the many conflict with individual freedom. The Principles of Morals and Legislation offers readers the rare opportunity to experience one of the great works of moral philosophy, a volume that has influenced the course of ethical theory for over a century. The problem of algorithmic fairness is typically framed as the problem of finding a unique formal criterion that guarantees that a given algorithmic decision-making procedure is morally permissible. In this paper, I argue that this is conceptually misguided and that we should replace the problem with two sub-problems. If we examine how most state-of-the-art machine learning systems work, we notice that there are two distinct stages in the decision-making process. First, a prediction of a relevant property is made. Secondly, a (...) decision is taken based (at least partly) on this prediction. These two stages have different aims: the prediction is aimed at accuracy, while the decision is aimed at allocating a given good in a way that maximizes some context-relative utility measure. Correspondingly, two different fairness issues can arise. First, predictions could be biased in discriminatory ways. This means that the predictions contain systematic errors for a specific group of individuals. Secondly, the system’s decisions could result in an allocation of goods that is in tension with the principles of distributive justice. These two fairness issues are distinct problems that require different types of solutions. I here provide a formal framework to address both issues and argue that this way of conceptualizing them resolves some of the paradoxes present in the discussion of algorithmic fairness. (shrink)

Is life a simple result of a conjunction of physico-chemical processes? Can be reduced to a mere juxtaposition of spatially determined events? What epistemology or world-view allows us to comprehend it? Aristotle built a novel philosophical system in which nature is a dynamical totality which is in constant movement. Life is a manifestation of it, and is formed and governed by the psyche. Psyche is the organizational principle of the different biological levels: nutritive, perceptive and intelective. Driesch's crucial (...) experiment provided empirical proof of the principle of life, which he called entelechy. Entelechy is an intensive manifoldness and cannot be comprehended by the usual extensive parameters. The entelechian's own ambiance is duration. This allows the reintroduction of the concept of teleology in the sphere of the living, understood not as a final cause, but as an order born from desire and leading to action. (shrink)

The paper is about the physical theories which result when one identifies points in phase space related by symmetries; with applications to problems concerning gauge freedom and the structure of spacetime in classical mechanics.

The ruling of the Constitutional Court of 10 September 2009 which repealed the proclaimed early elections to the Chamber of Deputies because of their alleged unconstitutionality fully manifests unjustifiability of the interference by the Constitutional Court of the Czech Republic. The decision directly interfered with the process of democratic re-establishment of the Chamber of Deputies. At the same time, the Court´s intervention was only made possible by violating a number of constitutionally prescribed rules. Finally, the respective ruling could not be (...) issued without a “creative approach” on the part of the Constitutional Court towards the rules governing procedures before the Court. The approach eventually resulted in the violation of principles of fair trial – before a body that should guarantee them. The paper analyses in detail various individual aspects of the case, from general issues of the division of power and contents of the mandate of deputies to individual procedural stages before the Constitutional Court. The use of ‘placebos’ in clinical practice is a source of continued controversy for physicians and medical ethicists. There is rarely any extensive discussion on what ‘placebos’ are and how they work. In this paper, drawing on Louhiala and Puustinen's work, the author proposes that the term ‘placebo effect’ be replaced in clinical contexts with the term ‘positive care effect’. Medical treatment always takes place in a ‘context of care’ that encompasses all the phenomena associated with medical intervention: it includes (...) the particular method of treatment, the interpersonal relationships between medical staff and the patient and other factors, including physicians' and patients' beliefs in the power of the treatment. Together, these phenomena can result in a full spectrum of therapeutic effects to the patient—from no effects, to small effects, to large effects. In cases where there are significant therapeutic benefits to the patient, ‘positive care effects’ may be spoken of. Since the ethical codes of the General Medical Council and the American Medical Association demand transparency with respect to patient treatment and insist on complete openness in ‘placebo’ usage, the author argues that, as a matter of conceptual rigour and consistency, if the term ‘placebo effect’ is replaced by ‘positive care effect’, these ethical codes appear to insist on transparency about all such beneficial components of treatment. Given that this appears to be a counterintuitive obligation, the author concludes the paper with some comments on the clinical consequences of this conceptual revision, including a brief discussion of how this important debate might develop. Many medical interventions have both negative and positive effects. When health care professionals cannot achieve a particular desired good result without bringing about some bad effects also they often rely on double-effect reasoning to justify their decisions. The principle of double effect is therefore an important guide for ethical decision-making in medicine. At the same time, however, it is a very controversial tool for resolving complex ethical problems that has been criticized by many authors. For these reasons, I (...) examine in this paper whether the principle of double effect can serve as a basis for ethical decisions in medicine. The conclusion reached in this article is that even though this principle has desirable effects on clinical conduct, it is only an unreliable guide and physicians and nurses cannot feel secure in continuing to use this principle for ethical guidance. The study aimed to identify the effect of applying detection and prevention tools for career fraud in combating and preventing fraud and reducing its risks through an applied study on Palestinian Ministry of Health in Gaza Strip, Palestine. To achieve the objectives of the study, the researchers used the questionnaire as a main tool to collect data, and the descriptive and analytical approach to conducting the study. The study population consisted of (501) supervisory employees working at MOH in Gaza Strip, (...) Palestine. The researchers used the stratified random sample method and the multiple regression method to measure the effect. The study concluded a set of results, the most important of which is a positive evaluation among respondents about the levels of application of tools to detect and prevent job fraud within MOH, and the presence of a high interest in tools to prevent job fraud during the implementation of its various work. The study recommended the necessity for the Palestinian National Authority to develop and approve laws regulating health sector, so that those laws guarantee the prevention of conflicts of interest, especially for the category of doctors, by preventing job duplication of doctors working in the government sector. Also study recommended the need for MOH to adopt principles of health sector governance and begin immediately to implement them. This process to ensure transparency, disclosure and accountability in the business framework in a manner that realizes the effective protection of stakeholders and does not compromise or discriminate in the application of these principles, which ensures that all forms of job fraud are organized in an organized manner and within fixed legal frameworks. The essence of the Architectonic Philosophy of Technique is the human self-embodiment in ontogenetic, evolutionary and permanent times (Mitterauer, 1989; 2009). These time conceptions may allow the interpretation of technical processes of self-embodiment and challenge the concept of the soul. The existence of the soul in timeless permanence is my fundamental argument that technical embodiments in robots can only be generated in ontogenetic and evolutionary time periods, but not in permanence. Admittedly, the concept of the soul does not play a (...) significant role in the creation of humanoid robots by engineers, but it is immersed in the subjective experience of each human person. I conceive the soul as an all comprising active principle which guarantees subjective existence and is felt as the destiny for a perfect everlasting life. Since the modeler of the robot is also endowed with this principle, he (she) is intending to implement his (her) reflection processes as programs into a robot brain, but it is not possible to fully implement the principle of human individuality in the sense of the soul. Otherwise, the creator of the humanoid robot would self-destruct his (her) human existence - a contradictio in se. -/- In the perspective of the present article I will discuss the following. First, my brain model is outlined focusing on subjectivity and qualitative mechanisms of brain function. Then, the elementary brain operations in ontogenetic and evolutionary time scales are discussed. Furthermore, the theory of Transphysics of self-embodiment of human subjectivity in human robots is proposed. This process generates a Third Nature of robot societies. In the final section “The soul in self-embodiment” I argue that humanoid robots existentially differ from their human creators, since robots can never be endowed with a soul in its metaphysical characteristics. The Principle of Sufficient Reason must be justified dialectically: by showing the disastrous consequences of denying it. We formulate a version of the Principle that is restricted to basic natural facts, which entails the obtaining of at least one supernatural fact. Denying this principle results in extreme empirical skepticism. We consider six current theories of empirical knowledge, showing that on each account we cannot know that we have empirical knowledge unless we all have a priori knowledge of (...) the PSR. We consider objections based on Neo-Humeanism and the essentiality of origins, and we consider the possibility that we have empirical knowledge without knowing it. (shrink)

This article presents results from a qualitative empirical investigation of how Danish oncology physicians and Danish molecular biologists experience the principle of respect for autonomy in their daily work.

The following is a foundationalist exercise based upon a single observation or postulate distinguishing one’s knowledge of information versus one’s knowledge of one’s former unknowing of that information. This postulate is titled the “principle of implicit ignorance.” Utilizing this postulate, several theorems are constructed including the equivalence to Hume’s thesis regarding the absence of knowledge of a necessary connection. The postulate is then negated, demonstrating equivalence to Kant’s thesis regarding the presence of synthetic a priori statements. The final (...) class='Hi'>result is a single general epistemic postulate that brokers between the two respective positions. Because both systems are the result of this general principle, rejecting the results of one system necessarily forces one into the contrary position. (shrink)

Volunteering in Ukraine is becoming an increasingly popular phenomenon that occupies an important place in the life of society. Many people choose volunteering as a way to help people in difficult life circumstances, as well as to develop their own personality and engage in active civic participation. As a significant social phenomenon, volunteering has its own ideological foundations that define its core values and principles. Volunteering is based on the desire to help people and nature regardless of their status, nationality, (...) religion, or political beliefs. The purpose of the study. The current study examines the ideological foundations of volunteering in Ukraine in wartime and their significance for volunteering, to study the practical experience of volunteers in Ukraine in 2014-2023, and to examine the peculiarities of the legal regulation of volunteering in Ukraine in wartime. Methods. Achieving the goal and objectives of the study was made possible by using a set of interrelated modern general scientific and special methods and approaches. The systematic approach made it possible to study volunteering as a holistic set of elements in the totality of the connections between them. Through the use of the method of systematization, the author provides a review of the legal framework for volunteering, factor analysis is used to determine the factors influencing the relationship between the state and society in the field of volunteering, and system analysis is used to assess the state of relations between the state and society in Ukraine at this stage through its quantitative indicators.Results. According to the study “Volunteer Movement in Ukraine”, prepared by GfK Ukraine on behalf of the UN in Ukraine, Ukrainian citizens pay great attention to the volunteer movement in the development of social processes: 62% recognize the role of volunteers in the changes in the last year; 85% believe that the volunteer movement helps strengthen peace; 81% tend to consider the volunteer movement an essential component of civil society. Regarding the legal regulation of volunteer activities in Ukraine, the Law of Ukraine “On Volunteer Activity” of April 19, 2011, No. 3236-VI was adopted in April 2011. The Law of Ukraine of 15.08.2022 No. 2519-IX On Amendments to the Law of Ukraine “On Volunteer Activity” on Support of Volunteer Activity regulates social relations related to volunteer activity in Ukraine. Discussion. One of the key principles of volunteering in Ukraine is selflessness and the ability to work in extreme conditions. Volunteers often work in difficult and dangerous conditions that require a high level of professionalism and skills. For many volunteers, the Ukrainian revolution of 2013-2014 and the events in eastern Ukraine were turning points that forced them to change their attitude to their own lives and start helping others. Ukrainian volunteers are an example of community and state cooperation that contributes to ensuring security and helping victims. They have shown that volunteering can be an effective tool in the fight against war and its consequences. Many volunteer organizations provided free medical care, took on the responsibility of supplying the military with necessary items and military equipment, organized the evacuation of people from the war zone, and provided psychological support to the military and their families. Conclusions.Volunteering in Ukraine is not a new phenomenon, but the war with Russia has become a catalyst for its development. This is a great example of how crises can encourage people to act together and interact to achieve a common goal. Volunteerism in Ukraine demonstrates the importance of spiritual unity and cooperation in difficult times, and is one of the most striking examples of civil society in action. The ideological principles of volunteering in Ukraine include non-profitability, openness, spirituality, and humanism, transparency and openness, security, and cooperation with government agencies and the military. The volunteer movement in Ukraine, especially in times of war, is an important factor in ensuring security and helping victims. Involvement of different groups of the population in volunteer activities, as well as cooperation with state and international structures, are important to ensure the effectiveness and success of volunteer activities. We offer a review of some of the most influential views on the status of Reichenbach’s Principle of the Common Cause (PCC) for genuinely indeterministic systems. We first argue that the PCC is properly a conjunction of two distinct claims, one metaphysical and another methodological. Both claims can and have been contested in the literature, but here we simply assume that the metaphysical claim is correct, in order to focus our analysis on the status of the methodological claim. We (...) briefly review the most entrenched or classical positions, including Salmon’s ‘interactive forks’, van Fraassen’s scepticism, and Cartwright’s generalisation of the fork criterion. We then go on to review the results of the ‘Budapest school’ on the existence of formally defined screening-off events for any correlation —by means of the ideas of probability space extensibility and (Reichenbachian common cause) completability. We distinguish the Budapest doctrine clearly from any of the classical conceptions, and thus present an overall framework for discussions of causal inference in quantum mechanics. The framework, however preliminary, is essential work for a thorough assessment of the conditions under which PCC may be a reliable tool for causal inference in a genuinely probabilistic (indeterministic) context. Classical statistical inferences have been criticised for various reasons. To assess the soundness of such criticisms is a very important task because they are widely used in everyday scientific research. This is one of the reasons why the philosophy of statistics is an exciting field of study. In this paper, I focus on two such criticisms. The first one claims that the use of the p-value violates the principle of total evidence. It is a thesis that has been defended (...) by Elliott Sober and Bengt Autzen. The second one says that the result of classical tests does not only depend on the data but on the sampling plan of the experimenter also. The underlying criticism of course is that the sampling plan is not part of the evidence and that classical tests therefore violate PTE. The intentions of the experimenter should not affect the result of an inference. My aim is to show that both criticisms are unsound. Doing so, I hope to clarify the concept of p-value and the nature of the evidence in classical statistical tests. The point of my paper is to show that the identification of the evidence on which those criticisms rest is inadequate. (shrink)

This paper aims to introduce, in the context of Latin America, the theoretical epistemic discussion regarding the theme of the ‘common’ as a political principle which substantiates instituting and autonomous processes of government, control and community regulation. The work seeks to relate a democratic scenario of the ‘common’ with the discourses of pluralist and decolonial normativity, in a way that would guarantee not only horizontal communal self-management, but also a legitimate ordering of forms of life, founded on common interest, (...) social relations and interconnected structures. For this purpose the instrument of critical-socio-legal analysis is applied at the intersections with the ‘participative-communitary’ type of legal pluralism. Our proposal is to combine the contemporary meaning of the ‘common’, its relation to the Latin American principles of ‘buen vivir’ (living well) and ‘interculturalidade’ (interculturality), as well as the instituting practice of the ‘common’, that engenders a normativity built ‘from below’, which is in opposition to the traditional positivist and state legal system imposed through colonization in Latin America. Such achievements that, although formalized, are not being successful against institutional ruptures, have ‘cloistered’ the practices of the ‘common’ and made the existence of legal pluralism invisible.
