In her 1996 book, Error and the Growth of Experimental Knowledge, Deborah Mayo argues that use- (or heuristic) novelty is not a criterion we need to consider (...) in assessing the evidential value of observations. Using the notion of a ''severe'' test, Mayo claims that such novelty is valuable only when it leads to severity, and never otherwise. To illustrate her view, she examines the historical case involving the famous 1919 British eclipse expeditions that generated observations supporting Einstein's theory of gravitation over Newton's. My plan here is to defend use-novelty as a valuable methodological principle. I begin by exposing a weakness in Mayo's criticism of use-novelty. Remedying this weakness re-establishes the worth of use-novelty under specific conditions; in particular, heuristically novel data are to be preferred, as I will say, ''prima facie''. Armed with this revised version of use-novelty, I re-examine the history of the eclipse experiments and offer an interpretation of this episode that to an extent-and contrary to Mayo-restores the mildly heretical, Earman/Glymour evaluation of this episode offered in their (1980). I conclude by responding to criticism of my assessment of Mayo's work. (shrink)

This paper and its predecessor () are about the question: 'Are the events in the entire universe encoded in and predictable from any of its parts?' To approach (...) class='Hi'> a positive answer in classical physics, the following result is proved and commented on: in Newton's theory of gravitation, the entire trajectory of a particle can be predicted given any segment of it, regardless of how the other particles are moving-provided that there is only a finite number of particles and that their speeds remain bounded. (It is this condition, together with a set of parameters characterising the motion of the other particles, which enables us to estimate the effect of the other particles on the trajectory of the given particle.) The extension of this result to other theories, in particular to special relativity, is discussed. (shrink)

Truth is a fundamental objective of adjudicative processes; ideally, `substantive' as distinct from `formal legal' truth. But problems of evidence, for example, may frustrate finding of substantive (...) truth; other values may lead to exclusions of probative evidence, e.g., for the sake of fairness. `Jury nullification' and `jury equity'. Limits of time, and definitiveness of decision, require allocation of burden of proof. Degree of truth-formality is variable within a system and across systems. (shrink)

This paper aims to analyze R. G. Collingwood’s maiden work in philosophy, Religion and Philosophy, in the light of the realism/idealism dispute in early twentieth-century (...) British philosophy. Due to scholars’ narrow scopes of interests, this book has suffered divided and unsettled understandings in literature that find only either realist or idealist character in it. By contrast, I comprehensively examine various aspects of the work on which both readings rest in turn—his conception of history and metaphysics. Consequently, I find out that Collingwood implicitly elaborates a series of negative doctrines attempting to overcome dualismspervading at both poles of the dispute, namely abstract/concrete, subject/object, and theory/action. Since this framework is to be more explicitly present in his subsequent philosophizing, I demonstrate that Religion and Philosophy was, against its underestimated status in literature, not mere juvenilia, but a substantialstarting-point for Collingwood’s philosophy constructively grounded in the contemporary debate. Professor Dray analyses critically the idea of re-enactment, explores the limits of its applicability, and determines its relationship to other key Collingwoodian ideas, such as the role of imagination in historical thinking, and the indispensability of a point of view. Aaron Ridley has concluded that “Collingwood’s global Idealism is really only a distraction from the much more important and interesting ideas that constitute his aesthetics.” My (...) class='Hi'>paper takes issue with this conclusion. Collingwood’s idealism is an integral part of his aesthetics, and it simply cannot be shucked off, leaving his aesthetics untouched and intact. A careful reading of Collingwood’s oeuvre in aesthetics reveals that it is his long-standing antipathy to realism that grounds both his critique of pseudo-art and his own theory of art, particularly his idealist theory of the imagination. If Collingwood’s aesthetics are interesting and important, so is the idealism that grounds them. (shrink)
