This article reconsiders the way political representation was understood in the early modern Netherlands by focusing on the contemporary contribution of Simon van Slingelandt. His views of the representative nature of the government of the Dutch Republic were deeply polemical when he developed them, but went on to have a profound influence on the later literature and are notably sustained in modern histories of the subject. The best way to nuance the view of political representation our (...) historiography has inherited from Van Slingelandt is by returning to the earlier views he set out to discredit. By examining both views, I thus hope to shed some new light on the representative nature of early modern Dutch government. (shrink)

The ascendency of executive power in the presence of weak parliamentary and societal control has given rise to a need for deliberative forms of diplomacy in international relations. As Denmark, Finland, Iceland, Norway, and Sweden regularly include members of parliament, party representatives, and representatives of civil society in their delegations to the General Assembly of the United Nations, does this imply that a Nordic model exists? This book reviews the practice of these countries and finds that the role of societal (...) representatives has diminished from participating members of delegations to mere observers. The basic theoretical premise of this article is that representation does not necessarily imply a break with democratic principles. Its goal is to challenge the traditional liberal-elitist approach to representative government according to which this system is a mixed regime that is not identifiable with democracy since its main institution, election, is a mechanism that is inherently aristocratic, although it can be implemented in a democratic way. I question this powerful argument by questioning its main assumption: the (...) idea that representative government, since its 18th-century inception, has had a linear and univocal history which was essentially undemocratic.I go back to the age of the French Revolution and analyse Condorcet’s plan of constitution in order to prove my case. Condorcet devised institutional mechanisms and procedures that were able to make representative government democratic by overcoming the polarization between representation and participation and making them related forms of political action constituting the continuum of decision-making and opinion formation in modern democratic society. This paper analyzes how, during the Juncker Presidency, the European Commission employed argumentative strategies to address the question of member-states’ compliance with European Union law. There is a literature gap regarding how European leaders employ argumentative strategies to coax member-states to comply with EU legislation and how those strategies can be associated with multilevel governance designs and problem-solving approaches. Building on van Eemeren and Grootendorst’s pragma-dialectical approach to argumentation, the paper explores what dialectical and rhetorical strategies were employed by the (...) Juncker European Commission to build an argumentative regime where the question of compliance with European Union law is articulated with the representation of the European Union as an efficient multilevel governance system. Starting from the distinction between procedural and operational concepts of problem-solving in multilevel governance polities, the paper questions whether the Juncker Commission’s arguments on the need to ensure European Union law compliance favor a particular conception of problem-solving in multilevel governance systems. The paper argues that the argumentative strategies employed by the Juncker European Commission in the field of compliance reveal a preference for an operational notion of problem-solving combined with some aspects of a more procedural perspective of problem-solving in multilevel governance polities. The background of this paper is associated with the growing impact that European legislation has on member-states and also with the efforts developed by the Juncker European Commission in discussing how to improve EU regulation to increase compliance with EU law. How did the events of the early modern period affect the way gender and the self were represented? This collection of essays attempts to respond to this question by analysing a wide spectrum of cultural concerns - humanism, technology, science, law, anatomy, literacy, domesticity, colonialism, erotic practices, and the theatre - in order to delineate the history of subjectivity and its relationship with the postmodern fragmented subject. The scope of this analysis expands the terrain explored by feminist theory, while (...) its feminist focus reveals that the subject is always gendered - although the terms in which gender is conceived and represented change across history. Several authors have recently stressed the constitutive and ubiquitous nature of representation, which, as a result, can no longer be conceived as a relation between pre-existing entities. This has important consequences for democratic representation, traditionally thought in terms of authorization, accountability or representativity. This article argues that Jacques Rancière’s political philosophy makes a fruitful contribution to the necessary rethinking of democratic representation. Although Rancière never systematically developed a theory of representation, this concept is shown to constitute (...) a red thread throughout his political writings. His main contribution consists in shifting the focus from the relation between representative and represented to the relation between the distribution of the sensible as a space of representability and its disruption or contestation. This makes it possible to recast a critique of representative government, and to reconceive of democratic representation, which is about making the contingent equality underlying each order visible. Since representation and democracy were reconciled and combined, there has been constant tension and debate over whether representation enables, limits or prevents democracy. If one leaves aside questions over principles and turns to history, the democratic credentials of representation immediately become much clearer. Until democracy was reformulated to mean a representative system of government, it was dismissed as an antiquarian form of rule, inappropriate, if not impossible, for modern states. This article seeks to demonstrate (...) the `democratic-ness' of representation through historical argument. This focus leads to the revisions and challenges to `democracy' that occurred during the French Revolution, where crucial developments can be seen in the bringing together of the two previously antithetical concepts of democracy and representation. It is argued that this is when the conceptual and theoretical framework for modern democracy starts to be built in earnest. This is shown through a close reading of two key revisions in how democracy is understood in relation to representative rule, provided by a pair of political actors at the very heart of the Revolution: Thomas Paine and Maximilen Robespierre. What makes these two protagonists so important is that they offer bold and particularly modern revaluations of democracy, which simultaneously challenge both the `evaluative' and the `descriptive' sides of the concept. In so doing, Paine and Robespierre conceive of democracy as including representation and, at the same time, paint democracy as something positive and valuable. The reflections and innovations of democracy found in these two central and polarizing figures are exemplary in the unique combination of reconfiguring of democracy and representation — a pairing that may now seem very normal, but in the 18th century was nothing short of oxymoronic. John Stuart Mill (1806-1873) was a British philosopher, political economist, civil servant, and Member of Parliament.

The three major essays collected in this volume were written in the latter half of Mill's life (1806-1873) and were quickly accepted into the canon of European political and social thought. Today, when liberty and representative government collide with other principles and when women still experience prejudice, Mill's essays reveal his sense of history, intelligence, and ardent concern for human liberty, and continue to shed light on politics and contemporary society.

Private governance raises important questions about democratic representation. Rule making is rarely based on electoral authorisation by those in whose name rules are made—typically a requirement for democratic legitimacy. This requires revisiting the role of representation in input legitimacy in transnational governance, which remains underdeveloped. Focussing on private labour governance, we contrast two approaches to the transnational representation of worker interests in global supply chains: non-governmental organisations providing representative claims versus trade unions providing representative structures. Studying the Bangladesh Accord for Fire and Building Safety, we examine their interaction along three dimensions of democratic representation: 1) creating presence, 2) authorisation, and 3) accountability to affected constituents. We develop a framework that explains when representative claims and structures become complementary but also how the politics of input legitimacy shapewhoseinterests get represented. We conclude by deriving theoretical and normative implications for transnational representation and input legitimacy in global governance. (shrink)

SummaryThis article offers a novel and comprehensive account of Walter Bagehot's political thought. It ties together an interpretation of Bagehot's liberal commitment to norms of discussion and deliberation, with an analysis of Bagehot's extensive arguments about the institutions of representative government. We show how Bagehot's opposition to American-style presidentialism, to parliamentary democracy, and to proportional representation were profoundly shaped by his conceptions of government by discussion, and the rule of public opinion. Bagehot's criticisms of English parliamentarianism, (...) both of its pre-1832 and post-1832 varieties were also motivated by those principles, as was his own proposal for parliamentary reform. By examining the whole range of Bagehot's writings on representative government and by connecting his institutional recommendations to his liberal principles, we are also able to better clarify Bagehot's position in Victorian political thought. The article concludes with a discussion of the debate leading up to the Second Reform Act, in which we elucidate Bagehot's disagreements with other prominent exponents of liberalism including John Stuart Mill, the “university liberals,” and Robert Lowe. Abstract‘[T]he “mainstream” of global governance has changed course’ and in so doing, might well have ‘outrun the standard tools of critical, progressive, and reform-minded international lawyers’, Fleur Johns wrote in 2019. It is especially the critical tools of ‘appeals to history, context, language [and] the grassroots’ in response to universalist planning that Johns sees absorbed in the turn to prototyping as a new ‘style’ of governance. In this article, we take on this observation and explore how the ‘lean start-up (...) mentality’ that Johns described has taken hold of tech-based climate governance. We base our reflections on the ‘Tech for Our Planet’ challenge that took place over 2021 and was showcased at the UNFCCC COP26 in Glasgow. While a turn ‘from planning to prototypes’ is observable, we question how exactly this ‘change of course’ affects the high modernist style of global governance and its critique by international lawyers. The ‘digital solutions for climate challenges’ that were showcased in Glasgow are indeed based on localized experiments with data science, thereby seemingly overcoming high modernist impulses towards universalist ideals. Yet, these experimental prototypes are developed with the ambition of being replicable and scaled up, to become a stack of tools deployable in any given scenario. This form of scaling up neither breaks with modernist aspirations based on technologically-mediated replicability—of moving the same logic inscribed in code to different sites and contexts—nor with a modernist understanding of knowledge as universal in its application. In our analysis, the determining feature is then not so much a matter of planning or prototyping in ideal type forms, but of replicability of knowledge production and scalability of technological know-how that underpin both planning and prototyping. Prototyping in the start-up space does not depart from, but rather reinscribes, a modernist representation of the human subject that forces its epistemological lens onto a world of nonhuman objects amenable to governance. Critical international lawyers’ toolkits must therefore be reconfigured with a focus on a governance style of disembodied knowledge production that runs through both planning and prototyping. A cette période, philosophes et acteurs engagés tentèrent de penser, avec une acuité particulière liée aux événements (guerres civiles, régicide, république, dictature), les tensions inhérentes au pouvoir, tout à la fois perçu comme contraignant, tyrannique et libérateur. Quatre d'entre eux ont été retenus : Thomas Hobbes (1588-1679), le théoricien de l’absolutisme, James Harrington (1611-1677), le républicain (...) classique, Algernon Sidney (1623-1683), le martyr whig, John Locke (1632-1704), le père du libéralisme. Le propos de l’ouvrage est de montrer que, par-delà leurs différences, ces quatre penseurs partagent une approche qui constitue le socle commun d’une théorie de l’Etat moderne. Leur doctrine s’affranchit de l’exercice utopique comme de la théorie de la raison d’Etat et se conçoit comme une anatomie du corps politique. Par un examen minutieux des textes, l’auteur cherche à s’écarter de l' interprétation trop « idéologique » sans doute accentuée par les combats de l’histoire. ABSTRACTThe role of resistance in the politics of modern representative democracies is historically contested, and remains far from clear. This article seeks to explore historical thinking on this subject through a discussion of what Benjamin Constant and Alexis de Tocqueville had to say about resistance and its relationship to ‘representative government’ and democracy. Neither thinker is usually seen as a significant contributor to ‘resistance theory’ as this category is conventionally understood. But, in addition to their more familiar (...) preoccupations with securing limitations on the exercise of political authority and averting majority tyranny, both thinkers wrote extensively on the nature and meanings of resistance in ‘representative governments’ or democratic societies. Both thinkers are examined in the context of revolutionary and Napoleonic discussions about the legitimacy of resistance or ‘right to resist’ oppression, and against eighteenth-century discussions of the ‘spirit of resistance’ since Montesquieu. The article notes conceptual distinctions between resistance, revolution and insurrection in the period, and addresses the broader question of the extent to which early nineteenth-century French liberals sought to ‘institutionalise’ principles of resistance within modern constitutional frameworks. This article discusses the work of Cornelius Castoriadis, an important political thinker and theorist of democracy. Castoriadis developed not one but two theories of democracy based on two distinct understandings of autonomy. The first is compatible with the key features of representative government; the second is not. Unfortunately, Castoriadis models his interpretation of the idea of popular sovereignty on the second view, thereby concluding, like Rousseau before him, that it is incompatible with representative government. This article (...) discusses both approaches and presents a reinterpretation of political representation and of the idea of popular sovereignty in order to show how they can be made compatible. The Russian philosopher and cultural theorist Mikhail Bakhtin has traditionally been seen as the leading figure in the group of intellectuals known as the Bakhtin Circle. The writings of other members of the Circle are considered much less important than his work, while Bakhtin's achievement has been exaggerated in proportion to the downgrading of the thinkers with whom he associated in the 1920s. This volume, which includes new translations and studies of the work of the most important members of the (...) Circle, sets out to correct the distortions in the established representations of its activity. The original contributions to literary and linguistic theory made by Valentin Voloshinov and Pavel Medvedev (but frequently credited to Bakhtin) are assessed, and the distinctiveness of their approaches is highlighted. Representation in the Anglo-American tradition has often been conceived in terms of the “refine and filter” model commonly associated with The Federalist. Gregory Conti challenges this concept of representation by bringing to light an alternative tradition of “mirroring” that preoccupied nineteenth-century British thinkers who were intent on parliamentary reforms. While Conti’s recovery of this “mirroring” tradition offers potentially useful insights for contemporary theorists of descriptive representation, it nonetheless hinges on an assumption that representative government is (...) a qualitative matter of deliberation rather than the purely quantitative voting that has come to the forefront with the rise of mass democracy. This article attempts to re-establish the importance of Foucault's work for an understanding of the way in which modern law operates. This argument has two stages. Firstly, there is a critique of the interpretation of Foucault's work by legal and sociological thinkers. It is argued that by reading the term ‘juridical’ as synonymous with the term ‘law’ in Foucault, people miss the substance of Foucault's argument. The term juridical describes an arrangement and a representation of power rather than the (...) law. This is made clear through a critique of J. S. Mill's On Liberty which is shown to make a juridical distinction between power and a free space of action which is unsustainable. Secondly, Foucault's genealogy of power relations is recast from the perspective of a legal theoretician. Foucault's history of power relations is constructed from historical differences in the mode of operation of power and discourse. By analysing these differences and their relationship to the mode of operation of law, an account of the place of modern law in Foucault's genealogy is established. Modern law operates between Foucault's concepts of government and discipline. It provides a key way in which government decisions can adjust the relationships between disciplinary institutions. This introduces the idea that law begins to operate in the perspective of the complete lives of individuals rather than just to prevent certain actions. Law, then, operates in accordance with what Foucault calls ‘bio-power’. (shrink)

SUMMARYThis paper examines the formal filters of the public's political will defended by JS Mill as consistent with the best form of representative government. Holding that institutions must adjust to democratic society, and that democratic society must be improved to achieve wise rule, Mill rejects secret ballots and electoral pledges, and advocates a constitutional council and graduated enfranchisement. He also recommends but does not require the indirect election of the President and a unicameral legislature. Mill's historically sensitive approach (...) puts pressure on interpreters to be sensitive to their own political and social context when applying Mill's ideas. In particular, obviously undemocratic measures such as plural voting should be adjusted to reflect Mill's view that the ratio between legitimacy and competence is constantly changing. The continual readjustment between the powers of masses and elites is the way that Mill's Considerations on Representative Government manage to avoid the now-traditional charge of expertocracy. This Article examines the authority of states to settle individual private property claims in post–conflict negotiations towards settlement. We analyze this question by exploring the limits of states’ authority to take or limit private property rights for the public good. We argue that this authority rests on two cumulative justifications: the inclusion of the property owners among the public that stands to benefit from the public good, and their representation by the government that decides on the taking of (...) the property. In post–conflict settlement, the negotiating states may redistribute both private property and the public good between and within their respective communities. Their authority to redistribute continues to rests on the same justifications of inclusion and representation. Hence, their authority extends only to the redistribution of property of owners who are members of the respective communities that negotiate the agreement, and who are represented by a negotiating government. This is the first English translation of the first work of Otto von Gierke, arguably the greatest historian of ideas of the nineteenth century. Community in Historical Perspective includes much of the first volume of Das Deutsche Genossenschaftsrecht, originally published in 1868, and the texts translated here have become essential reading for anyone interested not only in the history of ideas and alternatives to conventional socialism and liberalism, but also, as recent experience has shown, contemporary European affairs. Von Gierke's (...) represented an unparalleled attempt to justify a political programme of structural pluralism, and to interpret the entire course of European history from the Dark Ages onwards as a progressive interaction between 'fellowship' (or 'comradeship') and 'lordship' (or 'sovereignty'). This interaction was to generate a polity of autonomous associations within a constitutional state based upon consent and federal unity, and von Gierke here laid the basis for a distinctively Germanic programme of federalism and quasi-pluralism, with a strongly nationalist emphasis upon the unique capacity of Germans, despite long periods of absolute rule, for corporate self-management. This paper re-examines the idea of political vanguardism—long consigned to the dustbin of defunct scientific socialist ideology—to shed light on the theory of democratic representation. The discussion connects the use of the term “vanguard” by two prominent early socialist thinkers to what it terms the “cosmological” dimension of their writings. It shows how each author figured vanguard agency as fomenting different visions of the intellectual progress required for representative government, and that these visions were sustained by analogies (...) to the origin and development of astronomical objects. The “utopian” socialist Henri Saint-Simon (1770–1825) first invoked the vanguard metaphor to describe a way of thinking about scientific progress that would naturalize a new governing elite. The revolutionary communist Auguste Blanqui (1805–1881) then appropriated the vanguard idea to reimagine scientific authority in a way that would preserve and expand citizens’ capacities to hold their representatives accountable. The article pursues three goals. First, it provides a revisionist history of well-known scientistic attempts to stabilize mass democracy in the nineteenth century, revealing how claims to scientific authority were contested from within a socialist republican tradition usually seen as complicit in such agency-inhibiting ideologies. Second, the concept of vanguardism it reconstructs from this history, as a response to the “usurpation” of a vigilant attitude between citizens and office holders, offers new resources for theorizing democratic representation. Finally, it draws attention to the importance of cosmological rhetoric in the history of modern republican and socialist political thought. (shrink)

Representation is a major and multifaceted concept of modern politics. Through open and regular elections, it shields the democratic character of representative governments, compelling politicians to pursue the interests of their constituencies and become responsive to their demands. But since the concept of representation is so embedded in the day-to-day workings of democratic regimes, it has largely lost significant traces of its history that shed light on its political dawn. It has been assumed that models give us knowledge because they represent their supposed real target systems. However, here agreement among philosophers of science has tended to end as they have presented widely different views on how representation should be understood. I will argue that the traditional representational approach is too limiting as regards the epistemic value of modelling given the focus (...) on the relationship between a single model and its supposed target system, and the neglect of the actual representational means with which scientists construct models. I therefore suggest an alternative account of models as epistemic tools. This amounts to regarding them as concrete artefacts that are built by specific representational means and are constrained by their design in such a way that they facilitate the study of certain scientific questions, and learning from them by means of construction and manipulation. This paper revisits Derrida’s and Deleuze’s early discussions of “Platonism” in order to challenge the common claim that there is a fundamental divergence in their thought and to challenge one standard narrative about the history of deconstruction. According to that narrative, deconstruction should be understood as the successor to phenomenology. To complicate this story, I read Derrida’s “Plato’s Pharmacy” alongside Deleuze’s discussion of Platonism and simulacra at the end of Logic of Sense. Both discussions present Platonism as the effort (...) to establish a representative order (of original ideas and authorized reproductions of them) with no excess or outside (simulacra, or ideas that cannot be tied to an eidos). Since such pure representation is impossible, Platonism functions by means of the violent suppression of the simulacra and pharamakoi that exceed its eidetic structures. To overcome Platonism is thus not to reverse it, but to establish something like a practice of counter-memorials: detecting, exhuming, and writing back textual traces of what Platonism excludes. I then briefly apply this practice to narratives about the history of deconstruction, and suggest that they tend to occlude precisely the materialist elements of that history, as (for example) the importance of Spinoza as an interlocutor. In other words, the emerging canonical narrative about deconstruction runs the risk of repeating the Platonic gesture that Derrida spent his career writing against. (shrink)

In the eyes of its citizens, liberal democracy is connected to at least three promises—the promises of autonomy, equality and rationality. To what extent citizens can view these promises as being fulfilled will affect political trust and support for democracy. The rise of populism and trends towards technocratic government have rightly been interpreted as arising from a gap between normative aspirations and institutional and practical realities. Does this mean that we should adjust our ideals to reality, or that we (...) should strive to bring realities closer to the ideal? Self-proclaimed ‘realists’ argue that democratic ideals are unattainable and that we should therefore settle for a second-best alternative, such as a competitive oligarchy. Against this position, we point out that deliberative democracy offers an attractive ideal for successful representation that can inform democratic innovation. However, deliberative democracy also remains institutionally underdetermined and needs to develop better criteria that enable us to determine if, how and under what conditions the attempt to fulfil democracy’s promises succeeds in practice. In this paper, we suggest a criterion of deliberative responsiveness as a measure for representative democracy’s success in fulfilling promises of autonomy, equality and rationality. We go on to show in what respects these promises tend to be broken in contemporary representative democracies and discuss strategies for institutional reform that have potential to counteract these problems. The Restoration (1814–1830) was a golden age for liberal philosophy in France, especially in the field of politics. The political thought of Benjamin Constant and François Guizot, two of the most well-known theorists of the representative regime, is today regarded as particularly useful for understanding the meaning of many of the institutions which post-revolutionary democracies inherited. However, this paper reveals the existence of another great theory of the representative regime in circulation during the French Restoration: that popularized in (...) the pages of Le Censeur (1814–1815), a major liberal newspaper of the time. Its editors, Charles Comte (1782–1837) and Charles Dunoyer (1786–1862), are today known for their important contribution to the rise of liberal political economy in France. Their earliest journalistic writings contrast with the rest of their work and predate their discovery of the Treatise on Political Economy by Jean-Baptiste Say. During the first Bourbon Restoration (1814), Comte and Dunoyer were concerned almost exclusively with political philosophy. Before adopting the doctrine of ‘industrialism’, they attempted to make a synthesis of the political thought of Rousseau and Montesquieu, in order to give a liberal form to the idea of popular sovereignty compatible with monarchical government.
