Objectives: The mental health legislation of most developed countries includes either a dangerousness criterion or an obligatory dangerousness criterion (ODC). A dangerousness criterion holds that mentally ill people may be given treatment without consent if they are deemed to be a risk to themselves or others. An ODC holds that mentally ill people may be given treatment without consent only if they are deemed to be a risk to themselves or others. This paper argues that the dangerousness criterion is unnecessary, (...) unethical and, in the case of the ODC, potentially harmful to mentally ill people and to the rest of the community. Methods: We examine the history of the dangerousness criterion, and provide reasoned argument and empirical evidence in support of our position. Results: Dangerousness criteria are not required to balance the perceived loss of autonomy arising from mental health legislation. Dangerousness criteria unfairly discriminate against the mentally ill, as they represent an unreasonable barrier to treatment without consent, and they spread the burden of risk that any mentally ill person might become violent across large numbers of mentally ill people who will never become violent. Mental health legislation that includes an ODC is associated with a longer duration of untreated psychosis, and probably contributes to a poorer prognosis and an increase risk of suicide and violence in patients in their first episode of psychosis. Conclusions: Dangerousness criteria should be removed from mental health legislation and be replaced by criteria that focus on a patient’s capacity to refuse treatment. (shrink)
Introduction No consent for health and medical research is appropriate when the criteria for a waiver of consent are met, yet some ethics committees and data custodians still require informed consent. Methods A single-blind parallel-group randomised controlled trial: 1129 families of children born at a South Australian hospital were sent information explaining data linkage of childhood immunisation and hospital records for vaccine safety surveillance with 4 weeks to opt in or opt out by reply form, telephone or email. A subsequent (...) telephone interview gauged the intent of 1026 parents (91%) in relation to their actions and the sociodemographic differences between participants and non-participants in each arm. Results The participation rate was 21% (n=120/564) in the opt-in arm and 96% (n=540/565) in the opt-out arm (χ2 (1 df) = 567.7, p<0.001). Participants in the opt-in arm were more likely than non-participants to be older, married/de facto, university educated and of higher socioeconomic status. Participants in the opt-out arm were similar to non-participants, except men were more likely to opt out. Substantial proportions did not receive, understand or properly consider study invitations, and opting in or opting out behaviour was often at odds with parents' stated underlying intentions. Conclusions The opt-in approach resulted in low participation and a biased sample that would render any subsequent data linkage unfeasible, while the opt-out approach achieved high participation and a representative sample. The waiver of consent afforded under current privacy regulations for data linkage studies meeting all appropriate criteria should be granted by ethics committees, and supported by data custodians. Is there ever any reason for a doctor to lie to a patient? In this paper, we critically review the literature on lying to patients and challenge the common notion that while lying is unacceptable, a related entity--'benevolent deception' is defensible. Further, we outline a rare circumstance when treating psychotic patients where lying to the patient is justified. This circumstance is illustrated by a clinical vignette.
We consider Sussman et al.'s suggestion that auditory biases for processing low-noise relationships among pairs of acoustic variables is a preadaptation for human speech processing. Data from other animal communication systems, especially those involving sexual selection, also suggest that neural biases in the receiver system can generate strong selection on the form of communication signals.

Les théories contemporaines de la fiction, comme les poétiques de la Renaissance, privilégient une conception de la mimesis fondée sur la vraisemblance : la démonstration du profit cognitif et moral de la fiction passe toujours par une définition de l’imitation (de quelque façon qu’on la définisse) fondée sur la rationalité. L’auteur de cet article examine tout d’abord le statut des contradictions et de l’impossible chez quelques théoriciens actuels (principalement J.-M. Schaeffer, M.-L. Ryan, L. Doležel) et poéticiens du 16e siècle (...) (L. Castelvetro et F. Patrizi). Sont ensuite étudiées la forme et la fonction que prend l’impossible dans trois fictions narratives de la Renaissance. L’hypothèse majeure qui est défendue est que ces paradoxes permettent de penser le non-existant, dans la continuité de la scolastique médiévale et en relation avec une problématique religieuse, sérieuse ou parodique. Par là même, et en raison de leur auto-référentialité constitutive, les paradoxes inscrivent dans la fiction une réflexion sur elle-même qui n’a rien d’une apologie. La pensée de la fiction s’articule en définitive de façon bien différente dans les théories et dans les fictions elles-mêmes. (shrink)
Our world is a world of change. Children are born and grow into adults. Material possessions rust and decay with age and ultimately perish. Yet scepticism about change is as old as philosophy itself. Heraclitus, for example, argued that nothing could survive the replacement of parts, so that it is impossible to step into the same river twice. Zeno argued that motion is paradoxical, so that nothing can alter its location. Parmenides and his followers went even further, arguing that the (...) very concept of qualitative change is inconsistent. Change in any respect is impossible, they argued, as change requires difference and nothing differs from itself. Few today would accept the Eleatic conclusion that change is impossible. But the topic of change continues to be a source of much debate, as it brings together various issues that are central to metaphysics, language, and logic – including identity, persistence, time, tense, and temporal logic. While the medical facts will help to determine what is medically appropriate, it is often difficult for patients, families, surrogate decision-makers and healthcare providers to navigate these difficult situations. Newly re-printed, Sydney Hook’s classic (1939) work on Dewey appears with an Introduction by Richard Rorty. Hook may help us see how Dewey fit into his own time. That story is important. The new printing may also help us see how Dewey fits into our time. Rorty lauds more recent treatments of Dewey’s work, especially Robert Westbrook’s intellectual biography John Dewey and American Democracy (1991), and Steven Rockefeller’s John Dewey: Religious Faith and Democratic Humanism (1991) gets honorable mention. Specific (...) comments focus on Alan Ryan’s John Dewey and the High Tide of American Liberalism (1995). “It may be that Dewey and Hook witnessed, as Alan Ryan suggests, ... ‘the high tide of American liberalism,’ but if this is so, then America has lost its soul.”1 Even future-focused pragmatists need to look back to Dewey and Hook. They were “Americans” who, in the final words of the Hook volume, “still had hope for what America may yet be.”. (shrink)
Earl Conee and Richard Feldman have argued that epistemic support should be understood in terms of explanatory considerations. Very roughly, they hold that one’s evidence supports a given proposition when that proposition is part of the best explanation of one’s evidence. This proposal is attractive, but T. Ryan Byerly has recently argued that it is false. Byerly claims that such explanationist accounts of epistemic support cannot account for the fact that one’s evidence can support propositions about the future. (...) Although leadership of organizations rarely is discussed in terms of the religious construct of repentance, we propose that repentance and continuous improvement are closely related ideas that profoundly impact individuals and organizations. We identify six parallels between repentance and continuous improvement and then show how these parallels apply to the fundamental principles associated with highly regarded leadership perspectives. We conclude by identifying five contributions of the article to the management literature.
Physicians vary in their moral judgments about health care costs. Social intuitionism posits that moral judgments arise from gut instincts, called “moral foundations.” The objective of this study was to determine if “harm” and “fairness” intuitions can explain physicians’ judgments about cost-containment in U.S. health care and using cost-effectiveness data in practice, as well as the relative importance of those intuitions compared to “purity”, “authority” and “ingroup” in cost-related judgments.
