Glenberg's theory is rich and provocative, in our view, but we find fault with the premise that all memory representations are embodied. We cite instances in which that premise mispredicts empirical results or underestimates human capabilities, and we suggest that the motivation for the embodiment idea – to avoid the symbol-grounding problem – should not, ultimately, constrain psychological theorizing.

L’industrie de la culture qui est apparue en parallèle avec l’affaiblissement du dipôle travail social – art contemporain, a en même temps affaibli la possibilité des avant‐gardes de constituer une activité purement intellectuelle et artistique. C’est clair que l’apparition de cette culture de masse vient se lier avec l’évincement de l’art moderne authentique et la disparition quasi-totale de la culture populaire. Je pense que c’est indispensable de mentionner les points de vue des philosophes allemands, Theodor Adorno et Walter Benjamin (...) car je considère que malgré leurs limites historiques, ils exercent une influence déterminante sur la pensée contemporaine qui se relate à l’art dans le cadre de la société moderne postindustrielle. Bovens (2010) points out that there is a structural analogy between the Judy Benjamin problem (JB) and the Sleeping Beauty problem (SB). On grounds of this structural analogy, he argues that both should receive the same solution, viz. the posterior probability of the eastern region of the matrix in Table 1 should equal 1/3. Hence, P*(Red) = 1/3 in the JB and P*(Heads) = 1/3 in the SB. Bovens’s argument rests on a standard error in implementing Bayesian updating, which (...) is spelled out in Shafer 1985. When we are informed of some proposition, we do not only learn the proposition in question, but also that we have learned the proposition as one of the many propositions that we might have learned. The information is generated by a protocol, which determines the various propositions that we might learn. We should then update not on the proposition in question, but rather on the fact that we learned this proposition as one of the many propositions that we might have learned. A well-known application of this insight is the Monty Hall problem (MH) as Speed (1985: 276) points out in a discussion of Shafer 1985. As an illustration, let us apply Shafer’s insight to the MH. In the MH, the contestant in a game show learns that there is a goat behind two of three doors X, Y and Z and a car behind one door. She is asked to pick one of the three doors. The contestant picks door X. Monty will then open one of the remaining doors, which he knows to have a goat behind it. Suppose Monty opens door Y. The contestant is then asked whether she wants to …. Robert Eaglestone argues that postmodernism, especially understood in the light of the work of Emmanuel Levinas and Jacques Derrida, is a response to the Holocaust. This way of thinking offers new perspectives on Holocaust testimony, literature, historiography, and post-Holocaust philosophy. While postmodernism is often derided for being either playful and superficial or obscure and elitist, Eaglestone argues and demonstrates its commitment both to the past and to ethics. -/- Dealing with Holocaust testimony, including the work of Primo Levi and (...) This paper uses tools of philosophical analysis critically to examine accounts of the nature of racism that have recently been offered by writers including existentialist philosopher Lewis Gordon, conservative theorist Dinesh D'Souza, and sociologists Michael Omi and Howard Winant. These approaches, which conceive of racism either as a bad-faith choice to believe, a doctrine, or as a type of 'social formation', are found wanting for a variety of reasons, especially that they cannot comprehend some forms of racism. I propose (...) an account that conceives racism chiefly as a motivational/volitional matter, in short, as a form of moral viciousness. I show how this approach offers a unified account that comprises inter alia individual and institutional racism, expressed and unexpressed racism. I point out advantages that my view has over Thomas Schmid's somewhat similar suggestion, and use the account to examine a number of claims made about racism by H. L. Gates, Jr, Elizabeth Young-Bruehl, Gertrude Ezorsky, and others. Finally, I defend this approach from the general criticism that Benjamin DeMott has levelled against any effort so to understand racism. In this paper I defend the view that a zygote is a human from the fission objection that is widely thought to be decisive against the view. I do so, drawing upon a recent discussion of this issue by John Burgess, by explaining in detail the metaphysical position the proponent of the view should adopt in order to rebut the objection.
This article examines the three works of Jeremy Bentham on capital punishment dating Irom 1775, 1809, and 1831. Besides Hugo Bedau’s analysis of Bentham’s 1775 and 1831 works and James Crimmins’s assessment of Bentham’s 1809 work, little attention has been paid to his abolitionist arguments on this contentious issue. I review some of the developments in Bentham’s position, noting where the later work corrects some deficiencies in the earlier work, and I assess the cogency of the position as it evolves. (...) I concentrate on deterrence and irremissibility, though I also comment on his discussion of popularity in his 1831 address and his 1775 essay.Cet article se penche sur les trois textes qu’a écrits Jeremy Bentham sur la peine capitale (ils datent de 1775, 1809 et 1831). Hormis l’analyse qu’a faite Hugo Bedau des textes de 1775 et 1831 et la prise en compte, par Benjamin Crimmins, de celui de 1809, la position abolitionniste de Bentham sur cette question controversée ne s’est méritée que très peu d’attention de la part des spécialistes. Any study of the 'Scientific Revolution' and particularly Descartes' role in the debates surrounding the conception of nature (atoms and the void v. plenum theory, the role of mathematics and experiment in natural knowledge, the status and derivation of the laws of nature, the eternality and necessity of eternal truths, etc.) should be placed in the philosophical, scientific, theological, and sociological context of its time. Seventeenth-century debates concerning the nature of the eternal truths such as '2 + 2 = 4' (...) or the law of inertia turn on the question of whether these truths were created along with nature, or were uncreated and subsisting in God's mind. One's answer to that question has direct consequences for conceptions of the necessity/contingency of mathematical and natural knowledge, how knowledge of such truths is accomplished by humans, and what grounds these truths. In this paper, I review the positions of four successors to Descartes' philosophy on the question of the eternal truths to illustrate how in specific ways that question with its theological, metaphysical, modal, and epistemological dimensions concerned the objectivity and certainty of the discoveries of the new science. At the beginning of the 5-week module, students will be assigned to one of three roles: Team A, Team B, and judge's panel. Students will be given the debate proposition, but will not be told which team will take the affirmative and which team the negative until the time of the debate. 2. Recommend a variation on the Classic Debate Format to encourage the development of argument: sequence begins with affirmative construction (8 minutes), negative construction (8 minutes), second affirmative construction (8 minutes), second negative construction (8 minutes), first negative rebuttal (4 minutes), first affirmative rebuttal (4 minutes), final negative rebuttal (4 minutes) and final affirmative rebuttal (4 minutes). 3. Judges Panel: will consist of 3–4 judges who will assess the performance of Teams A and B. Judgment should be based on the persuasiveness of the team position. 4. Evolutionary algorithms typically use direct encodings, where each element of the phenotype is specified independently in the genotype. Because direct encodings have difficulty evolving modular and symmetric phenotypes, some researchers use indirect encodings, wherein one genomic element can influence multiple parts of a phenotype. We have previously shown that Hyper- NEAT, an indirect encoding, outperforms FT-NEAT, a direct-encoding control, on many problems, especially as the regularity of the problem increases. However, HyperNEAT is no panacea; it had difficulty accounting for irregularities (...) in problems. In this paper, we propose a new algorithm, a Hybridized Indirect and Direct encoding (HybrID), which discovers the regularity of a problem with an indirect encoding and accounts for irregularities via a direct encoding. In three different problem domains, HybrID outperforms HyperNEAT in most situations, with performance improvements as large as 40%. Our work suggests that hybridizing indirect and direct encodings can be an effective way to improve the performance of evolutionary algorithms. (shrink)

In this paper I consider one of the leading philosophic-psychological theories of “folk psychology,” the simulation theory of Robert Gordon. According to Gordon, we attribute mental states to others not by representing those states or by applying the generalizations of theory, but by imagining ourselves in the position of a target to be interpreted and exploiting our own decision-making skills to make assertions which we then attribute to others as ‘beliefs’. I describe a leading objections to Gordon’s theory—the problem (...) of adjustment—and show how a charitably interpreted Gordon could answer this objection. I conclude, however, that the best case for Gordon’s position still runs into a new problem concerning the epistemological presuppositions of belief-attribution. This suggests a new account of folk psychological explanation that draws on children’s basic folk epistemological knowledge. Identifying this new alternative helps undermine the simplicity of a theory based on simulation-based explanation. (shrink)
Common arguments for truth in religious pluralism absolutize an ultimate or lived component of religion, reducing a positive affirmation of plurality to deeper unity or exclusion. The arguments of John Hick, William Connolly, Nicholas Rescher, and S. Mark Heim fall into such a trap. By considering how an indeterminate concept of ultimacy, proposed by Robert C. Neville, fares against the problems their arguments raise, it will be shown that such a concept of ultimacy can both give rise to and (...) grow out of communal experiences and the nature of the world. The indeterminate ultimate, communal experiences, and the world pluralize themselves once understood in mutual relation. (shrink)
Edmund Husserl gave his famous London Lectures (in German) in June 1922 where he says his purpose is to explain “transcendental sociological [intersubjective] phenomenology having reference to a manifest multiplicity of conscious subjects communicating with one another”. This effective definitionof semiotic phenomenology as Communicology was reported in English (1923) by Charles K. Ogden and I. A. Richards in the first book on the topic titled The Meaning of Meaning. This groundwork was in full development by 1939 with the first detailed (...) use of Husserl’s phenomenology to explicate human communication, i.e., the publication of Wilbur Marshal Urban’s Language and Reality. My paper addresses Urban’s use of Husserl’s philosophy toboth explicate the phenomenological method and to explore the constitutive elements of human communication and culture. Urban makes use of the workon language and culture by his famous colleagues at Yale University (USA): Edward Sapir (the linguist), Benjamin Lee Whorf (Sapir’s graduate student),and Ernst Cassirer. My own teacher at the University of New Mexico (USA) was Hubert Griggs Alexander, a doctoral student under Urban and a classmateof Whorf. The interdisciplinary focus on Culture and Communicology by Professors Cassirer, Sapir, Urban, and their doctoral students, Alexander and Whorf are collectively known as the “Yale School of Communicology.” Typical empirical examples of theoretical points are provided in the footnotes. : Erich Auerbach's famous comparative study of Homer and the Bible, "Odysseus' Scar," argues that their contrastive styles derive from the different possibilities available to oral tradition and literature. In support of this thesis, I invoke two theories of verbal art: Walter Benjamin's description of the storyteller's craft, and Victor Shklovsky's definition of art as "defamiliarization." Through a comparative analysis of the use of type-scenes in Homer and in biblical narrative, I demonstrate how Homer is a traditional storyteller, practicing (...) an "art of the familiar," whereas biblical narrative "defamiliarizes" traditional forms. Wolfhart Pannenberg's eschatological ontology has been criticised for undermining the goodness and reality of finite creaturely differentiation. Drawing on David Bentley Hart's recent ontological proposal, this article explores the critique of Pannenberg's ontology, and offers a defence of Pannenberg's depiction of the relationship between difference and totality, especially as it is presented in his 1988 work, Metaphysics and the Idea of God. In this work, Pannenberg articulates a structured relationship between difference and totality in which individual finite particularities are preserved (...) and affirmed within a coherent semantic whole. Creaturely differences are not sublated or eliminated in the eschatological totality, but they are integrated into a harmonious totality of meaning. This view of the semantic function of totality can be further clarified by drawing an analogy between Pannenberg's ontological vision and Robert W. Jenson's model of the eschatological consummation as a narrative conclusion to the drama of finite reality. (shrink)
Modern Jewish philosophy emerged in the seventeenth century, with the impact of the new science and modern philosophy on thinkers who were reflecting upon the nature of Judaism and Jewish life. This article maintains that it is the constitutional responsibility of the courts, here the courts of the State of Michigan, to engage in judicial policymaking in the process of formulating common law rules. The article is written in response to the views expressed by some Justices of the Michigan Supreme Court that separation of powers concerns should impose significant limits on the power of the courts to establish and develop the common law of Michigan. Specifically, the contention is that policymaking (...) is exclusively the province of the legislature, so that the courts cannot properly formulate common law rules that may have significant social and economic effects. The article strongly disagrees with the proposition that there is any kind of constitutional constraint, either prudential or structural, on the power, and indeed, the constitutional responsibility of the Michigan courts (or the courts of any state) to engage in judicial policymaking in the process of formulating common law rules.The judicial power given to the Michigan courts by the Michigan Constitution includes the power to do what courts have always done in the Anglo-American legal system. The judicial power gives the courts the responsibility to adjudicate controversies between private persons and in the process to develop a common law through the workings of binding precedent and stare decisis. In so doing, the courts may properly take into account considerations of social and economic policy just as the legislature does when it engages in the process of enacting legislation. The difference between what the courts do and what the legislature does is a difference in process, not a difference in substance. Judicial policymaking takes place within the judicial process, that is, in the adjudication of controversies between persons in which the courts promulgate common law rules. The common law develops in a line of growth through the workings of binding precedent and stare decisis, and to the extent that there are limitations on the development of the common law, these are limitations that inhere in the judicial process itself. When the courts, for example, consider whether a new claim or a new defense should be recognized by the common law, they must consider whether that new claim or defense properly follows in the line of growth from existing doctrine and precedent. But if the courts conclude that it does, that is, if the claim or defense is consistent with the line of growth of existing doctrine and precedent, the courts are not constrained from recognizing the claim or defense on the ground that the substance of the claim or defense is a matter for the legislature rather than for the courts or that the resulting common law rule may have significant social and economic effects. The legislature, in contrast, enacts legislation through the legislative process. That process is a freewheeling one, often dependent on political compromise and completely unrestrained by the kind of limitations that inhere the judicial process. There is no legislative concept of line of growth, and the legislature can and often does enact legislation that brings about fundamental societal change or reverses the course of public policy. In our constitutional system, the most important questions of public policy are, of course, determined by the Legislature. Where the legislature disagrees with the policy choices reflected in a common law rule, the legislature has the power to enact legislation changing the common law rule. But there are many areas of private law where the legislature has not acted. In our constitutional system, where the matter in issue is not covered or preempted by legislation, the courts may formulate a common law rule to cover that matter, and in so doing may engage in judicial policymaking. Judicial policymaking is a part of the development of the common law, and the courts cannot avoid their responsibility to engage in judicial policymaking to the extent that it is necessary in the process of formulating the common law. As a constitutional matter, there are no separation of powers considerations that prohibit the courts from engaging in judicial policymaking. This part of the article traces judicial policymaking and the common law back to the seminal writings of Oliver Wendell Holmes, Roscoe Pound and Benjamin Cardozo.The article then discusses at length judicial policymaking and the development of the common law in Michigan. It shows that the clearest history of judicial policymaking in development of the common law is the liability-limiting rules of the late nineteenth century that were promulgated in the wake of the Industrial Revolution to protect the newly-emerging industries. During that time the courts in Michigan and elsewhere grafted on to the general principles of negligence law liability rules such as assumption of risk, contributory negligence, and the fellow servant doctrine, all of which had the effect of denying recovery to workers and other victims of industrial accidents. Beginning in the middle of the twentieth century, however, the Michigan Supreme Court began excising its constitutional power to make changes in the common law, expanding significantly the scope of tort liability in Michigan. Emphasizing that "rules created by the court could be altered by the court," and that the court had a "corrective responsibility when dealing with judge-made law," the Court, in approximately a 30 year period: eliminated the imputed negligence doctrine, under which the driver's negligence was imputed to the passenger in the passenger's suit against a third party; eliminated charitable immunity as a defense to a tort action; held that a wife could maintain at tort action for loss of her husband's consortium; abrogated the defense of assumption of risk, which had been applied outside of the employment area, held that there could be recovery for pre-natal injuries and finally abolished contributory negligence as a complete bar to recovery in favor of a comparative negligence approach. In these cases the Court discussed the relevant policy considerations influencing their decisions with respect to the common law rule at issue. In the last quarter century, the Court continued to take into account policy considerations in developing the common law, but not infrequently there was disagreement on the Court as to where policy considerations should lead, with some Justices arguing that policy considerations supported the imposition of tort liability, while other Justices argued that they did not.The article concludes that it has been demonstrated that in the development of the common law of Michigan, the Michigan Supreme Court has at all times engaged in judicial policymaking. From the liability-limiting rules of the late nineteenth century designed to protect the newly-emerging industries in this state, to the Court's exercise of its power to change the common law in Michigan over a 30 year period by expanding significantly the scope of tort liability in Michigan, to its recognition of new claims, such as a child's right to recover for loss of a parent's consortium caused by a negligent injury, to its imposition of limits on tort recovery, such as the open and obvious doctrine, the Court has invoked considerations of policy in support of its decisions. In these cases, the Court's invocation of policy considerations was sometimes accompanied by substantial disagreement among members of the Court over where policy should lead, but at no time did the Court ever suggest that separation of powers considerations should somehow operate as a kind of restraint on the Court's use of policy in the development of the common law. It is the power and responsibility of the Michigan Courts under the Michigan Constitution to make policy choices in formulating the common law. (shrink)

After modernism and postmodernism, it is argued, the everyday supposedly is where a democracy of taste is brought into being - the place where art goes to recover its customary and collective pleasures, and where the shared pleasures of popular culture are indulged, from celebrity magazines to shopping malls. John Roberts argues that this understanding of the everyday downgrades its revolutionary meaning and philosophical implications. Bringing radical political theory back to the centre of the discussion, he shows how notions of (...) cultural democratization have been oversimplified. Asserting that the everyday should not be narrowly identified with the popular, Roberts critiques the way in which the concept is now overly associated with consumption and 'ordinariness'. In this paper, we describe the use of legal ontologies as a basis to improve IT support for professional judges. As opposed to most legal ontologies designed so far, which are mostly based on dogmatic and normative knowledge, we emphasize the importance of professional knowledge and experience as an important pillar for constructing the ontology. We describe an intelligent FAQ system for junior judges that intensively use the ontology.
We discuss our concerns associated with three assumptions upon which the model of Levelt, Roelofs & Meyer is based: assumed generalisability of decontextualised experimental programs, assumed highly modular architecture of the language production systems, and assumed symbolic computations within the language production system. We suggest that these assumptions are problematic and require further justification.
Draft version of essay. ABSTRACT: Benjamin Whichcote developed a distinctive account of human nature centered on our moral psychology. He believed that this view of human nature, which forms the foundation of “Cambridge Platonism,” showed that the demands of reason and faith are not merely compatible but dynamically supportive of one another. I develop an interpretation of this oft-neglected and widely misunderstood account of human nature and defend its viability against a key objection.
