It has been argued that the inherent risks of advance directives made by healthy people are disproportionate to the potential benefits, particularly if the directive is implementable in cases of reversible mental incapacity. This paper maintains that the evidence for such a position is lacking. Furthermore, respect for the principle of autonomy requires that individuals be permitted to make risky choices about their own lives as long as these do not impinge on others. Even though health professionals have an obligation (...) to try and ensure that patients have appropriate information about possible future treatment options, they cannot predict and describe every eventuality but nor can they disregard firm decisions knowingly made on the basis of incomplete information by competent adults. Development literature on global gender empowerment devotes much attention to employment, a code word for the inclusion of women’s labor in the global market. Recent work in transnational feminisms shows that the emphasis on employment over assets may not prevent exploitation of labor and perpetuity of poverty. This paper first highlights research on how women are increasingly taking on too much responsibility, working in a confluence of survival-oriented activities that undermine their own well-being. I also address how women are increasingly (...) able to get out of poverty: when they can labor in such a way that they are not merely working to survive but also working for accumulation of their own material assets, foremost of which is basic housing. Finally, I consider these transnational feminist insights about the importance of housing for women in light of philosophical concerns about property ownership, specifically Locke’s theory of property. In justifying property rights through labor, and arguing against the state’s right to usurp property, a Lockean can give a defense against forced evictions that still occur in some contexts and give support for a normative connection between women’s labor and assets. American media is very quick to ask victims of anti-Black violence if they forgive their victimizers. The media’s nearly reflexive framing is a symptom of the broader, cultural demand that Black victims grant forgiveness for racist violence. Reading Juliet Hooker and Myisha Cherry, this paper links the current preponderance of such demand for forgiveness to a demand for apology in America’s lynching tradition. Drawing from Sonya Renee Taylor, Ida B. Wells, and Frederick Douglass, I give a history to both kinds (...) of normative demands and show how, though they appear as seem­ing contraries, demands for forgiveness and apology function together as methods of anti-Black violence. I then draw from work in transformative justice to differentiate the perspectives of asking, giving, and demanding forgiveness. When understood through the perspective of victims, a certain kind of embodied forgiveness can have liberatory potential. However, observers’ demands for forgiveness too often function as a method of racial oppression. (shrink)

The language that global justice theorists use to characterize global poverty, the terms of duty and charity, are detached discourses that fail to capture the reality of poverty as most people currently experience it, as slum dwellers living on the outskirts of the world’s megacities. In contrast, the language of alienation better captures the experience of global, urban poverty. This article’s aim is to draw from Hannah Arendt to form a new idea of alienation that responds to the specific conditions (...) of urban, global poverty. Arendt posits alienation in terms of the ‘loss of the world’: the deprivation of durable material structures and lasting institutions that are the preconditions for political speech and action. The language of alienation evidences how the problem of poverty is one of a lack of meaningful work, the kind of work that creates a livable world. (shrink)

Luttrell, John It is now fifty years since the 'Goulburn Strike' when six Catholic schools in Goulburn New South Wales were closed by their bishops on Friday 13 July 1962 as a protest against the failure of the state government to fund the upkeep of the schools. On the following Monday 1500 pupils from these Catholic schools applied for enrolment in the government schools of Goulburn. There were places for only 640 applicants and these were selected mainly by ballot. (...) Authorising the closure were Eris O'Brien, Archbishop of Canberra-Goulburn Archdiocese, and his auxiliary bishop, John Cullinane who lived in Goulburn and had first suggested a closure protest to a meeting of Goulburn parents. In March of this year the British Medical Association , the Resuscitation Council and the Royal College of Nursing published guidelines outlining the legal and ethical standards for decision making in relation to cardiopulmonary resuscitation .1 The guidance follows a year of increasing public awareness and concern about the issue and builds upon joint guidance issued by these institutions in June 1999.In April 2000 Age Concern issued a press release stating that “some doctors are ignoring national guidelines on the resuscitation (...) of older people” and indicating that they had information on cases that had come to light in their campaign against age discrimination. Age Concern went on to say that older people have found “not for resuscitation” recorded in their medical notes without their agreement or knowledge.During the same month Professor Shah Ebrahim wrote a leader in the British Medical Journal stating that doctors regularly issue “do not resuscitate” orders for patients without their knowledge.2 He claimed that black people, alcohol mis-users, non-English speakers and those with HIV are more likely to get a “do not resuscitate” order, suggesting that prejudice is influencing medical decisions.This combination of events was followed by intense press and media interest in the way in which decisions were being made about cardiopulmonary resuscitation. Such was the level of concern that a health service circular was issued to all National Health Service trust chief executives in September 2000 asking that appropriate resuscitation policies be in place which respect patients' rights, are understood by …. In the academic year 1920-1921 at the University of Freiburg, Martin Heidegger gave a series of extraordinary lectures on the phenomenological significance of the religious thought of St. Paul and St. Augustine. In this short, dense essay, Jean Cavaillès evaluates philosophical efforts to determine the origin - logical or ontological - of scientific thought, arguing that, rather than seeking to found science in original intentional acts, a priori meanings, or foundational logical relations, any adequate theory must involve a history of the concept. Cavaillès insists on a historical epistemology that is conceptual rather than phenomenological, and a logic that is dialectical rather than transcendental. His famous call (cited by Foucault) to abandon "a (...) philosophy of consciousness" for "a philosophy of the concept" was crucial in displacing the focus of philosophical enquiry from aprioristic foundations toward structural historical shifts in the conceptual fabric. This new translation of Cavaillès's final work, written in 1942 during his imprisonment for Resistance activities, presents an opportunity to reencounter an original and lucid thinker. Cavaillès's subtle adjudication between positivistic claims that science has no need of philosophy, and philosophers' obstinate disregard for actual scientific events, speaks to a dilemma that remains pertinent for us today. His affirmation of the authority of scientific thinking combined with his commitment to conceptual creation yields a radical defense of the freedom of thought and the possibility of the new. In print for the first time in over ten years, Act and Crime provides a unified account of the theory of action presupposed by both Anglo-American criminal law and the morality that underlies it. The book defends the view that human actions are always volitionally caused bodily movements and nothing else. The theory is used to illuminate three major problems in the drafting and the interpretation of criminal codes: 1) what the voluntary act requirement both does and should require; 2) (...) what complex descriptions of actions prohibited by criminal codes both do and should require ; and 3) when two actions are 'the same' for purposes of assessing whether multiple prosecutions and multiple punishments are warranted. The book both contributes to the development of a coherent theory of action in philosophy, and it provides both legislators and judges a grounding in three of the most basic elements of criminal liability. Kierkegaard's Concluding Unscientific Postscript is a classic of existential literature. It concludes the first and richest phase of Kierkegaard's pseudonymous authorship and is the text that philosophers look to first when attempting to define Kierkegaard's own philosophy. Familiar Kierkegaardian themes are introduced in the work, including truth as subjectivity, indirect communication, the leap, and the impossibility of forming a philosophical system for human existence. The Postscript sums up the aims of the preceding pseudonymous works and opens the way to the (...) next part of Kierkegaard's increasingly tempestuous life: it can thus be seen as a cornerstone of his philosophical thought. In 2018, the Chinese scientist He Jiankui presented his research at the Second International Summit on Human Genome Editing in Hong Kong. While it was intended that he facilitate a workshop, he was instead called on to present his research in heritable human genome editing, where he made the announcement that he had taken great strides in advancement of his research, to the extent that he had gene-edited human embryos and that this had resulted in the live births of two (...) children. While his research ethic and methodology was interrogated, he insisted that two children, twin girls, had been born healthy and that there was another pregnancy (at the time) where birth of a third gene edited child would be imminent. This announcement generated a ripple effect in the scientific community and exposed the gaps in regulation and absence of law relating to the technology. This resulted in a flurry of activity and conversation around regulation of the technology, which scientists stated was not ready for human trials. This article reviews the Third Summit which was held in London in March 2023 and comments on the latest developments in the regulation of heritable human genome editing. (shrink)

Abstract:During the early 19th century, a peculiarly systematic way of organizing books emerged in Germany. This systematization, which purported to be a rational organization of subject matter, was an outgrowth of the philosophy of Hegel. This article attempts to outline Hegel's organizational practice. It argues that Hegel's encyclopedia was a reaction against the Enlightenment encyclopedia, and that it attempted to restore the systematic mindset of pre-modern reference books. Yet it did this, not in a straightforward fashion, but by developing a (...) method for organizing material that both stresses the interconnectedness of knowledge and promises to be highly scalable. In its attempt to trace the Hegelian organizational method, this article revisits and calls attention to a forgotten work in Hegel scholarship by Michael John Petry, who was the first writer to seriously stress the importance of classification in Hegel's work. This article is an attempt to demonstrate that Hegelianism and information organization can be brought into fruitful and mutually beneficial dialogue. (shrink)

In Alfonso de Cartagena's 'Memoriale virtutum' (1422) María Morrás and Jeremy Lawrance offer a new edition from the manuscripts of a compilation of Aristotle's Nicomachean Ethics addressed by the major Castilian intellectual of the day, bishop Alfonso de Cartagena, to the heir to the throne of Portugal, crown prince Duarte. The work was a speculum principis, an education for the future king in the virtues suitable to a statesman; Cartagena's choice of Aristotle was thus a significant index of the advent (...) of new Renaissance ideas. This edition shows how the "memorial" throws light on the ideological transformation of society those ideas would bring, setting new ethical guidelines for the ruling class at the crossroads between medieval feudalism and Renaissance absolutism. Attempts to think anew about philosophical questions from the perspective of breath and breathing. As a physiological or biological matter, breath is mostly considered to be mechanical and thoughtless. By expanding on the insights of many religions and therapeutic practices, which emphasize the cultivation of breath, the contributors argue that breath should be understood as fundamentally and comprehensively intertwined with human life and experience. This is an examination of Aristotle's notion of an "accidental being" -- something intermediate between a substance and a property. An accidental being (sometimes called "accidental compound" or "kooky object") is an ephemeral object, typically the compound of a substance and a property, that exists for only as long as its components are united. I set out the role that accidental beings play in Aristotle's solutions to several philosophical problems. I also investigate the similarity between these beings and the individual (...) non-substances of Aristotle's Categories. Finally, I propose that accidental beings can be assimilated into a more contemporary conceptual scheme as events -- the states or conditions that substances are in or undergo. (shrink)
