Abu Man ur al-Maturidi (gest. 333/944) gilt neben seinem Zeitgenossen Abu l- asan al-AS ari (gest. 324/936) als eine der prägenden Figuren des sunnitischen Islams und geniesst bis heute eine grosse Autorität. Die Denkschule der Maturidiyya fand breite Anerkennung in der islamischen Welt und ist heute vom Balkan über die Türkei bis nach Zentralasien prominent vertreten. Dennoch ist unser Wissen über sein Denken sehr begrenzt, da seine Schriften lange Zeit als verschollen galten, bis in den 70er Jahren des 20. Jahrhunderts (...) sein massgebliches kalam-Werk, das Kitab at-Taw id, ediert wurde und neue Forschungen anregte.Das Theodizeeproblem ist eine zentrale und hochkomplexe Fragestellung für jede monotheistische Religion. Wie kann im angesichts eines omnipotenten und absolut guten Gottes die Existenz von Bösem erklärt werden? Die islamische Theologie hat seit ihren Anfängen Antworten auf dieses Problem gesucht, wobei auch naturwissenschaftliche Erkenntnisse und weltanschauliche Überlegungen für die Apologie bemüht wurden. Many psychological studies of categorization and reasoning use undergraduates to make claims about human conceptualization. Generalizability of findings to other populations is often assumed but rarely tested. Even when comparative studies are conducted, it may be challenging to interpret differences. As a partial remedy, in the present studies we adopt a 'triangulation strategy' to evaluate the ways expertise and culturally different belief systems can lead to different ways of conceptualizing the biological world. We use three groups (US bird experts, US (...) undergraduates, and ordinary Itza' Maya) and two sets of birds (North American and Central American). Categorization tasks show considerable similarity among the three groups' taxonomic sorts, but also systematic differences. Notably, US expert categorization is more similar to Itza' than to US novice categorization. The differences are magnified on inductive reasoning tasks where only undergraduates show patterns of judgment that are largely consistent with current models of category-based taxonomic inference. The Maya commonly employ causal and ecological reasoning rather than taxonomic reasoning. Experts use a mixture of strategies (including causal and ecological reasoning), only some of which current models explain. US and Itza' informants differed markedly when reasoning about passerines (songbirds), reflecting the somewhat different role that songbirds play in the two cultures. The results call into question the importance of similarity-based notions of typicality and central tendency in natural categorization and reasoning. These findings also show that relative expertise leads to a convergence of thought that transcends cultural boundaries and shared experiences. (shrink)

The domain of phenomenological investigation delineated by the Husserlian term authentic empathy presents us with an immediate tension. On the one hand, authentic empathy is supposed to grant the subject access (in some sense that remains to be fully specified) to the Other’s experience. On the other hand, foundational phenomenological considerations pertaining to the apprehension of a foreign subjectivity determine that it is precisely a disjunction in subjective processes that is constitutive of the Other being other. In my approach to (...) this problem, I seek, within the context of a reading of Edith Stein’s work 'On the Problem of Empathy', to clarify the place of ascription in authentic empathy, and to render more explicit a certain notion of “contiguity” that I take to be informing Stein’s understanding of the co-givenness of the Other’s mental life. I go on to argue that a resolution to the problem of empathy lies in the idea that the respective lived experiences of self and Other are, as a matter of descriptive fact, phenomenally connected by a relation of resemblance, and that, consonantly, the essential structure of authentic empathy is characterised in its mature phases by an homological relation to picture consciousness. Evidence suggests that English speakers use pronouns when referring to the grammatical subject and predictable thematic role. We tested how grammatical role and thematic role predictability affect different types of referential forms, namely, overt pronouns and null pronouns in Mandarin Chinese. We found that both overt and null pronouns were sensitive to grammatical role. However, we did not find any evidence that overt and null pronouns were sensitive to thematic role predictability. Although null pronouns were influenced by grammatical role, the (...) rate of null pronouns for subject reference was very low compared to that of overt pronouns. Given the frequent occurrence of null pronouns in Mandarin, our results suggest that the use of null pronouns may not be explained by a simple grammatical role mechanism. (shrink)

This paper argues that the augmented reality gaming application for smart devices, _Pokémon GO_ shows the fate of the legal subject as a neoliberal monster subjugated to the limitations imposed by hypercapitalism. The game, derived from Nintendo’s iconic Pokémon franchise, reveals the legal subject as a frenzied, diminished and impulsive being, allowed to see, move, catch and accumulate but unable to participate in more meaningful self-narration. It is not that the game is lawless, notwithstanding, anxieties in the semiosphere about users (...) trespassing or engaging in criminal behaviour. Rather the game is over structured and highly limited, both within its game-play which is repetitive and impulsive, and in its absence of narrative. Unlike the classic Nintendo Pokémon games which are within the role-playing game genre, _Pokémon GO_ abstracts the seeing, moving, catching and accumulating features of the classic games without the overarching narrative, questing and competition. In this _Pokémon GO_ manifests the transformation of the liberal legal subject of capitalism to the neoliberal subject of a digital orientated hypercapitalism where seeing, moving, catching and accumulating is immediate and impulsive, obliterating the ‘prudent’ subject participating in their own self-narration. In the study of Pali metres, abundant research has been conducted on the establishment of rules and taxonomy, and scanning of unscanned verses. In comparison, the stylistic aspects of metres have been somewhat neglected. When the audiences listen to verses with their ears only set for metrical rules but not also the interplay of various rhythmic patterns, they fail to fully capture the aesthetic beauty and the very philosophical messages embedded in them. Taking the verses in the Dasanipata of the (...) Theragatha as examples, this article focuses on the stylistic interplay of rhythmic uniformity and change in the expression of core messages in a Pali poem. It aims to unveil the poets’ strategies in the use of various types of metres and prosodic elements (opening, trimetre break, caesura and cadence) to create the narrative style of each poem and draw the audiences’ attention to the Buddha’s key teachings in the verses. This essay explores Confucian views on war as seen in the Spring and Autumn Annals . The interpretation is based mainly on the Gongyang Zhuan , supplemented by other authoritative sources in the Gongyang tradition, such as D ong Zhongshu (179-104 BCE) and H e Xiu (129-182). The Spring and Autumn Annals contains three components: facts, words, and principles. This essay explicates the principles for going to war and the principles for conducting a war. The Confucian perspective sheds light on (...) war against enemies of civilization, conditions for waging a preemptive war, punitive expedition, as well as the use of weapons of mass destruction. The Confucian views as presented here are realistic and pragmatic in nature but are also compatible with the humanistic concern of Confucianism. Transparency is an underpinning of workplace ethics. However, most of the existing research has focused on the relationship between leader transparency and its consequences. Drawing on social and self-regulation theory research, we examine the antecedents of followers’ transparency. Specifically, we propose that followers have higher levels of transparency when they are working with peers who have a high level of transparency. We further suggest that followers’ conscientiousness and agreeableness moderate the relationship between peer transparency and followers’ transparency. Using a time-lagged (...) design, we provide support for the proposed theoretical model. We found that follower conscientiousness substitutes the social regulation effect, while follower agreeableness enhances this social regulation effect. Theoretical and practical implications of these findings are also discussed. (shrink)

This paper examines the phenomenological considerations which govern an important transition in the thought of Edmund Husserl, namely his gradual disenchantment with the view that acts of the imagination are given to consciousness in the manner of a semblance, and his decision to replace it with the view that they should more accurately be understood to be reproductions of non-posited perceptions. The central conclusion of this paper will be that the logic of Husserl’s own analysis points to a further phenomenological (...) discovery that Husserl himself does not fully articulate, but which helps to explain his initial attraction toward an imagistic account of imagining. This is the finding that a structure homologous to picture-consciousness is liable to arise in the context of nested reproductions, and in particular that acts of remembering imagining bear the act-character of pictoriality. The prominent philosopher Feng Youlan in the late 1950s devised an 'abstract inheritance method' with which he sought to salvage traditional thought. The debates over this method and what it entailed lasted until the Cultural Revolution. This book is an examination of those debates, and therepercussions arising from them in the discussions on classical Chinese philosophy.

The expression of products encoded by the major histocompatibility complex (MHC) on tumor cells has recently been studied extensively. The foundational status that Edmund Husserl envisages for phenomenology in relation to the sciences would seem to suggest that the successful unfolding of contemporary debates in the field of social cognition will be conditioned by progress in resolving certain central controversies in the phenomenology of intersubjectivity, notably in long-standing questions pertaining to the priority of subjectivity in relation to intersubjectivity, and the priority of empathy in relation to other forms of intersubjectivity. That such controversies are long-standing is in no small (...) part attributable to the fact that the debate surrounding Husserl’s seminal attempts to elucidate these problems has placed his account, and certainly his published position, under a certain amount of pressure, pressure which stems from the suspicion that intentionality toward others may be more deeply embedded in subjectivity than the Husserl of Cartesian Meditations seems prepared to admit. Is the primordinally reduced solipsistic subject of the Fifth Meditation really capable of discovering intersubjectivity in the way that Husserl describes, or is such putative discovery (indeed, subjective transformation) already conditioned by a more primitive form of intersubjectivity? This paper investigates two ways in which this kind of “circularity” objection might arise. Firstly, it might be argued that Husserl presupposes an external perspective on one’s own body, a perspective which rationally would have to be correlated with an indeterminate foreign subjectivity. Secondly, the view has been advanced (Zahavi in Husserl and transcendental intersubjectivity: a response to the linguistic-pragmatic critique. Ohio University Press, Athens, OH, 2001b) that horizonal perceptual awareness of another spatio-temporal entity turns out to be essentially intersubjective, on the grounds that awareness of some of an object’s averted aspects commits one to positing the possibility in principle of those averted aspects being available to an indeterminate foreign subjectivity. Objections such as these seem to place the phenomenological enquiry into the encounter with another person at something of a crossroads. On the one hand, they have led some to argue that basic empathy, as Husserl conceives it, must indeed be conditioned by the anonymous constituting influence of a more primitive form of intersubjectivity. On the other hand, the option remains open to seek to defend Husserl’s published position against the charges of circularity. This paper pursues the latter alternative, and argues that, with appropriate clarification, the objections from circularity can be convincingly answered. It will be argued that the key to understanding why the standard Husserlian position can be sustained lies in recognising the centrality of the activity of the imagination as a condition for the possibility of intersubjectivity. A consideration of Confucian ethics as a living ethical tradition with contemporary relevance.

Influential or frequently cited business ethics research does not appear in a vacuum; our study reveals its predominant sources and contributors by discipline. By examining citations from articles published in three top business ethics journals (Journal of Business Ethics, Business Ethics Quarterly and Business Ethics: A European Review) over the period 2004–2008, we document that the preponderance of influential business ethics research comes primarily from the management faculty. In addition, management journals and management books are the predominant sources for influential (...) business ethics research. Further, among the management fields, organizational behavior and organizational structure predominate leadership and strategy as the major subject areas for influential business ethics research, suggesting that this influential body of research is focused on a micro rather than on a macro context. These empirical results lend credence to the perception that there is a silo effect in influential business ethics research and suggest that business ethics research in a micro context might have permeated to the teaching of business ethics. This paper argues against the continued practice of Confucian familism, even in its moderate form, in East Asian hospitals. According to moderate familism, a physician acting in concert with the patient's family may withhold diagnostic information from the patient, and may give it to the patient's family members without her prior approval. There are two main approaches to defend moderate familism: one argues that it can uphold patient's autonomy and protect her best interests; the other appeals to cultural relativism by (...) construing the principle of ‘family autonomy’ to be incommensurable with that of individual autonomy. We respond to the first approach by explaining how the familist arguments either depend on some unreasonable assumptions or simply fail to articulate. The critique of the second approach is based on our recent survey showing that there is no dichotomy of relevant values between the East and the West: we believe that the result can effectively block the familist's reliance on certain traditional or cultural values to explain their resistance to the incorporation of pluralist values. Despite our disagreement with familism, we consider the Eastern emphasis on the family to be conducive to the communication between patient, family members and medical personnel, which is indispensible to the patient's well being and autonomy. We conclude that respect for patient autonomy is perfectly consistent with the involvement of the family in making medical decision as long as the family plays a merely consultant role. (shrink)

This paper explores Jean Starobinski's often tacit conception of the implied author, with a view to clarifying his intellectual legacy for literary criticism. It argues that it is plausible to trace a certain strand in the intellectual genealogy of Starobinski's literary theory from the descriptive psychology of Wilhelm Dilthey to twentieth-century psychoanalysis and phenomenology. Accordingly, the question "Who is Jean Starobinski?" is formulated in a sense which seeks to move beyond the bare facticity of biographical detail, a sense that can (...) be expected to differentiate between scholarly and purely journalistic enquiry to ask: who, exactly, is the Jean Starobinski that we encounter in his major works - works like "The Living Eye" and "Transparency and Obstruction"? It is from this vantage point that the discussion proceeds to clarify Starobinski's ambivalent relations to both Rousseau and Freud, and thereby to illuminate some of the tensions and nuances inherent in his notion of the implied author. Critical thinking has been widely regarded as an indispensable cognitive skill in the 21st century. However, its associations with the affective aspects of psychological functioning are not well understood. This study explored the interrelations between trait mindfulness, critical thinking, cognitive distortions, and psychological distress using a moderated mediation model. The sample comprised 287 senior secondary school students (57% male and 43% female) aged 14–19 from a local secondary school in Hong Kong. The results revealed that high critical thinking was significantly (...) associated with high levels of psychological distress when mindful awareness was low among adolescents. Trait mindfulness was found to moderate the indirect effects of critical thinking on psychological distress via cognitive distortions as the mediator. Specifically, in low trait mindfulness conditions, critical thinking was found to associate positively with cognitive distortions and psychological distress. Such associations were not observed in high trait mindfulness conditions. The findings reveal that though critical thinking has positive associations with cognitive functioning, its associations with affective well-being might be negative. The results also suggest that mindfulness might play an important role in preventing the possible psychological distress associated with critical thinking. Educational implications relating to the fostering of critical thinking and mindful awareness are discussed. (shrink)

Dietrich von Hildebrand seeks to pursue the idea that the discipline of phenomenology can offer a way of surmounting what Kant saw as the intrinsic limitations of human metaphysical enquiry. In this book review of the 2021 edition of Hildebrand’s What is Philosophy?, Hildebrand’s train of thought is reconstructed in some detail, from his opening remarks about knowing in general through to his account of the intuition of essences, the question of objectivity, and the overarching purpose of philosophy. Hildebrand’s argument (...) culminates in the claim that philosophy is not only the fundamental activity of a mind turned toward God, but is properly a preamble to religious faith. The review concludes by raising a number of objections to Hildebrand’s version of phenomenological realism. (shrink)

This paper begins by affirming the view that if there is a debate to be had over whether literature can convey moral knowledge, then efforts by proponents to substantiate this claim will already be necessarily conditioned by an understanding of what morality consists in, independently of literature. This observation brings to light a certain danger for the debate, namely that if participants fail to explicitly specify the ethical theory that they rely on, then the debate can seem nebulous. This raises (...) a new question: is there an account of morality, independent of literature, which is most conducive to literary moral cognitivism, that is, which optimises literary moral cognitivism's chances of succeeding philosophically? This paper both formulates and investigates this hypothesis with reference to moral pluralism, the view that there is an irreducible plurality of foundational moral principles. It concludes that such an affinity exists, but with an important caveat: the affinity is stronger at the level of moral suggestion than the level of moral justification. This has implications for the strength of the version of literary moral cognitivism that it is ultimately plausible to endorse from a moral pluralist point of view. (shrink)

This study provides a global perspective on citations of articles published in ten business ethics journals between 1999 and 2012 and establishes three findings. First, the results indicate that Journal of Business Ethics and Business and Society are the two top business ethics journals based on the distribution of normalized citations received. Second, although North America, particularly the US, remains the top producer of business ethics research, it has been surpassed by Europe in terms of weighted normalized research citations received (...) in 2012, implying a potential diminishing global role of US influence in business ethics research over time. Third, the top-ranked US institutions have reduced their business ethics research impact in recent years, while the European institutions have sharply increased theirs. (shrink)

Recent challenges to Chomsky's poverty of the stimulus thesis for language acquisition suggest that children's primary data may carry “indirect evidence” about linguistic constructions despite containing no instances of them. Indirect evidence is claimed to suffice for grammar acquisition, without need for innate knowledge. This article reports experiments based on those of Reali and Christiansen (2005), who demonstrated that a simple bigram language model can induce the correct form of auxiliary inversion in certain complex questions. This article investigates the nature (...) of the indirect evidence that supports this learning, and assesses how reliably it is available. Results confirm the original finding for one specific sentence type but show that the model's success is highly circumscribed. It performs poorly on inversion in related constructions in English and Dutch. Because other, more powerful statistical models have so far been shown to succeed only on the same limited subset of cases as the bigram model, it remains to be seen whether stimulus richness can be substantiated more generally. If the possible ends of art criticism are taken to include not only the provision of a detailed evaluation of the artwork, but, cognately, an elaboration upon how one has been, or believes oneself to have been, changed by a particular artistic encounter, then the very praxis of art criticism stands to benefit from a theoretical elucidation of the possible nature of the subjective transformations that may flow from the critical appreciation of art. We are entitled to enquire, in particular, (...) into the conditions under which, and indeed the extent to which, such putative change at the personal level can be explicated in moral epistemological terms. It is pertinent in this context also to investigate the phenomenal character of the experiences that have been operative and their essential structures; to enquire, in short, into the phenomenology of the transformative artistic encounter. In this thesis, the bearing, in particular, of intersubjectivity upon the content and modalities of disclosure in a literary context will be investigated. It will be shown how an understanding of the relevance of intersubjectivity to the phenomenology of literary experience can inform an assessment of the claims of literary aesthetic moral cognitivism. Yet the intention to clarify the connection between literary experience and intersubjectivity also requires reflection upon what it is in the first place to encounter someone else, and to apperceive a foreign subjectivity and its motivations. For this reason, the contributions of Edmund Husserl and Edith Stein to the investigation of the phenomenology of empathy will be discussed and evaluated. This discussion will in turn be shown to be of assistance in clarifying the role of the imagination in the apperception and comprehension of another person’s mental life. The thought of Jean Starobinski will prove to elucidate the question of why the insights of the phenomenological tradition are highly pertinent to the investigation of literary experience, and to the development, in particular, of a conception of an imagined ‘Other’ who is (in a sense that will be clarified) embedded within the literary text, a person, that is, to whom one might coherently refer as the “implied author”. For reasons which will emerge in the course of this study, it will be argued that authentic empathy, in its fulfilling explication (in the Steinian sense), is given to the empathising consciousness in the manner of a semblance, and, consonantly, that the phenomenological structure of authentic empathy is characterised in its mature phases by an homological relation to pictureconsciousness. The epistemological significance of literature’s capacities for moral suggestion will be explicated principally in terms of the unfolding of values within the human personality, and in terms of the disclosure of the phenomenal character and structures of virtuous experience. It will be explained why the structure of empathy has implications for the aesthetic value of literature. The question of the relation between aesthetic and ethical value will be clarified. In this context, it will be argued on phenomenological grounds that the appresentation of moral virtue in an implied author could contribute to the aesthetic value of a literary work, although it will also be shown that implied authorial moral virtue could conflict irremediably with other qualities like moral doubt and uncertainty, which may themselves be important sources of aesthetic value. For this reason, the thesis will conclude by challenging the ethicist view that an aesthetically relevant ethical flaw in a literary work must count as an aesthetic flaw. (shrink)

Hsieh's projects, I argue, also place universal estrangement in the service of liberation for particular marginalized groups whose lives confound our fantasies of recognition. At the same time, they illustrate some of the challenges facing attempts to treat particular struggles as embodiments of universal conflicts.

In his early writings, he adopted the Christian perspective according to which postlapsarian nature cannot by itself yield a juridical order, or in his poetic phrase, “life is not a mushroom growing out of death.” Yet—in accord with Catholic doctrine—he also found sources of life, or law, in this world. While he repudiated theories of collective self-legislation, he embraced a popular sovereign empowered to impose form on a chaotic society. In Political Theology (1922), he compared the form-giving power of the sovereign to an act of divine intervention. Law, he argued, can only function in a lawful or “normal” situation that precedes formalization, and the sovereign “produces and guarantees the situation in its totality” [13]. In The Crisis of Parliamentary Democracy (1923) Schmitt retained his theological terms: “A scientific study of democracy must begin with a particular aspect that I have called political theology” [32]. In the modern age, democratic constituent power (pouvoir constituant) replaces the will of God as the transcendent source of a substantial order, namely democratic homogeneity. Democratic will-formation thereby becomes an act prior to its subject, or as Schmitt wrote, “[...] only political power, which should come from the people’s will, can form the people’s will in the first place” [Crisis 28]. A variety of democratic theorists dwell on the paradoxical character of democratic sovereignty, sometimes tracing it back to Rousseau’s well-known formulations [see esp. Connolly and Honig]. They highlight the gap between a transcendent (ideal or fictive) will in whose name political power acts, and the bounded, material consensus it forms, ostensibly rendering the latter vulnerable to challenge. As I argue, however, a closer look at Rousseau’s discussion of democratic founding in On the Social Contract reveals instead a dynamic relay between dispersed substantial or immanent sources of affiliation, on the one hand, and various agents and techniques of political power that draw on and combine them in a collective will, on the other, or what I call the virtual and the virtuosic.2 After briefly exploring this dynamic in Rousseau’s [End Page 121] On the Social Contract, I will highlight similar dynamics at work in Schmitt’s Weimar writings, examining three instances: the complexio oppositorum (1923), national myth (1923), and the polemical opposition of friend and enemy (1927), focusing especially on the first. Contrary to familiar readings of Schmitt’s metaphysical “exceptionalism,” I argue that for Schmitt, as for Rousseau, political power does not create a normative order from a vacuum, and the apparent transcendence of sovereign authority has a variety of worldly sources.3 Finally, I consider what I call “democratic virtuosity,” or virtuosity from below, focusing on Walter Benjamin’s repudiation of sovereign acts of lawmaking or law preserving in favor of ongoing collective habit-formation. As I argue, Benjamin returns spiritual force to the material world not only to shatter human authorities, but also to democratize creation.Rousseau—Anticipating the PeopleIn the Social Contract, Rousseau formulated the paradox of democratic founding to which so many, including Schmitt, would return. “In order for an emerging people to appreciate the healthy maxims of politics, and follow the fundamental rules of statecraft, the effect would have to become the cause; the social spirit, which should be the result of the institution, would have to preside over the founding of the institution itself; and men would have to be prior to laws what they ought to become by means of laws” [Rousseau 69]. Personal autonomy presupposes the notion of rationality. What is not so clear is whether, and how, a compromise of rationality to various degrees will diminish a person's autonomy. In bioethical literature, three major types of threat to the rationality of a patient's medical decision are identified: insufficient information, irrational beliefs/desires, and influence of different framing effects. To overcome the first problem, it is suggested that patients be provided with information about their diseases and treatment choices according to the objective standard. (...) I shall explain how this should be finessed. Regarding the negative impact of irrational beliefs/desires, some philosophers have argued that holding irrational beliefs can still be an expression of autonomy. I reject this argument because the degree of autonomy of a decision depends on the degree of rationality of the beliefs or desires on which the decision is based. Hence, to promote patient autonomy, we need to eliminate irrational beliefs by the provision of evidence and good arguments. Finally, I argue that the way to smooth out the framing effects is to present the same information in different perspectives: it is too often assumed that medical information can always be given in a complete and unadorned manner. This article concludes with a cautionary note that the protection of patient autonomy requires much more time and effort than the current practice usually allows. (shrink)
