Abstract: There has been an ongoing dispute between defenders of world disclosure (understood here in a loosely Heideggerian sense) and advocates of normative debate. I will take up a recent confrontation between Charles Taylor and Robert Brandom over this question as my point of departure for showing how world disclosure can expand the range of normative argument. I begin by distinguishing pre-reflective disclosure—the already interpreted, structured world in which we find ourselves—from reflective disclosure—the (...) discrete intervention of a particular utterance or text. I discuss Taylor’s notion of social imaginaries as a way of thematizing our pre-reflective background and Talal Asad’s critique of Taylor to show how this background can be one space of argument. I then develop my own understanding of reflective disclosure, of which Taylor gives an indequate account, developing my argument with help of literature, including a close analysis of Susan Glaspell short story “A Jury of Her Peers.” This story illustrates how world disclosure can make normative arguments without confining itself to Brandom’s or Habermas’s idea of the exchange of reasons. Any attempt to elucidate the interconnections between phenomenology and critical theory must at some point confront the question of what role Heidegger's philosophy plays in that equation. The historical or biographical side of the question is interesting in its own right and can be philosophically illuminating.1 My focus here, however, will be systematic. In her excellent Heidegger, Language, and World-Disclosure Cristina Lafont urges a fresh way of looking at the issue: she argues that cognition and assertion are dependent not upon precognitive, engaged practice, but rather upon language as a holistic phenomenon. Being-in-the-world is at its core the disclosure of a symbolically mediated world in terms of which anything that we can experience, judge, or talk about is given its place and parameters. Entities and states of affairs are (...) accessible to us in terms of meaning, and meaning is itself made accessible to us through understanding. Understanding is, however, always essentially “discursive,” or symbolically mediated, so that our access to the world around us, and anything that might show up within that world, is structured by language. The difference between Lafont’s approach and its practice-oriented rival is especially clear vis-à-vis the “fore-structure of interpretation.” According to Lafont, cognition is grounded in what Heidegger calls “forehaving,” because forehaving is the disclosure of the whole of linguistic meaning available to the cognizer. According to a practice-oriented approach, by “forehaving” Heidegger means the holistic set of precognitive practices in which whatever we are currently doing is domiciled. (shrink)

This book deals with contemporary epistemological questions, connecting Educational Philosophy with the field of Science- and Technology Studies. It can be understood as a draft of a general theory of world-disclosure, which is in its core a distinction between two forms of world-disclosure: experiment and exploration. These two forms have never been clearly distinguished before. The focus lies on the experimental form of world-disclosure, which is described in detail and in contrast to the explorational (...) form along the line of twenty-one characteristics, which are mainly derived from empirical studies of experimental work in the field of natural sciences. It can also be understood as an attempt to integrate elements of the Anglo-Saxon Philosophy of Science with elements of the German tradition of Educational Philosophy. This is also reflected in the style of writing. In accordance to the content-level of the book, the argument for experimental forms of world-disclosure is written in an essayistic, readable style, which can be understood as an experimental form of writing. Many of these documents, and most of the scholars who consider the consent process, assume that all this information must be disclosed because it must all be understood. However, a wide range of studies surveying apparently competent participants in clinical trials around the world show that many do not understand key aspects of what they have been told. The standard (...) view of the conditions for valid consent therefore implies that these people have failed to give valid consent to research participation. In this paper we argue that the standard view is false. The primary function of the requirement that researchers disclose information about a study is the avoidance of illegitimate control over someone’s consent decision, which is a form of fraud.We derive the content and manner of appropriate disclosure by analysing the ways in which the manipulation of information can invalidate consent. Our analysis shows that the informational requirements for valid consent are conceptually distinct and thus unlikely to have identical contents. This paper focuses on the idea of exemplarity outlined by the Italian critical theorist Alessandro Ferrara that forms part of his general case for the centrality of disclosure to emancipatory political reasoning. Ferrara argues that “at its best” political thought should have the capacity to animate the democratic imagination by disclosing new political worlds and hence new possibilities for thought and action. I argue that Ferrara’s notion of exemplarity provides important conceptual resources for a re-grounding of critical theory in (...) the type of experientially based disclosing critique that has, post Habermas, been marginalized. In Critique and Disclosure, Nikolas Kompridis argues provocatively for a richer and more time-responsive critical theory. He calls for a shift in the normative and critical emphasis of critical theory from the narrow concern with rules and procedures of Jürgen Habermas's model to a change-enabling disclosure of possibility and the enlargement of meaning. Kompridis contrasts two visions of critical theory's role and purpose in the world: one that restricts itself to the normative clarification of the procedures by (...) which moral and political questions should be settled and an alternative rendering that conceives of itself as a possibility-disclosing practice. At the center of this resituation of critical theory is a normatively reformulated interpretation of Martin Heidegger's idea of "disclosure" or "world disclosure." In this regard Kompridis reconnects critical theory to its normative and conceptual sources in the German philosophical tradition and sets it within a romantic tradition of philosophical critique.Drawing not only on his sustained critical engagement with the thought of Habermas and Heidegger but also on the work of other philosophers including Wittgenstein, Cavell, Gadamer, and Benjamin, Kompridis argues that critical theory must, in light of modernity's time-consciousness, understand itself as fully situated in its time--in an ever-shifting and open-ended horizon of possibilities, to which it must respond by disclosing alternative ways of thinking and acting. His innovative and original argument will serve to move the debate over the future of critical studies forward--beyond simple antinomies to a consideration of, as he puts it, "what critical theory should be if it is to have a future worthy of its past.". This Article explores the costs and benefits of one subset of continuous and discontinuous rules. These expressions are shown to be distinct from the familiar dichotomy expressed as standards versus rules, but they share the difficulty of dividing the world of law in two. Still, regulatory approaches that focus on discontinuities can often be made more continuous, and vice versa. A speed limit is discontinuous in the sense that one drives above or below (or within) the announced limit. But (...) it is often made more continuous—even with more discontinuities— as when the stated limit is different for various kinds of vehicles. This Article works around these definitional problems to show that law often discourages useful disclosures by encouraging parties with information to offer continuous information in order to avoid after-the-fact lawsuits when specific disclosures prove to have inaccuracies. For example, it is common to hear or be warned that a medical procedure poses the risk of death, when a better-informed doctor or hospital could have given the precise percentages attached to various outcomes. Similarly, a corporation is on safe ground when it follows “generally accepted accounting principles,” when investors would have learned more from information about good and bad outcomes put in probabilistic terms. The Article works toward the suggestion that law might create a safe harbor in which probabilistic disclosures are protected when they are, or are certified to be, more useful than the ready alternative of fairly general disclosures. Disclosure of health information is a sensitive matter, particularly in the context of serious illness. In conservative societies—those which predominate in the developing world—direct truth disclosure undoubtedly presents an ethical conundrum to the modern physician. The aim of this study is to explore the truth disclosure practices of physicians in Jordan, a developing country. In this descriptive, cross-sectional study, 240 physicians were initially selected by stratified random sampling. The sample was drawn from four major hospitals in (...) Amman, Jordan. A closed-ended questionnaire was distributed and completed by self-report. A total of 164 physicians completed the questionnaire. Thirty-seven physicians usually withheld the diagnosis of “serious illness” from patients, while 127 physicians usually divulged the information directly. Among the latter, 108 physicians made exceptions to their disclosure policy. Specialists were more likely to withhold health information. Non-disclosure was primarily motivated by request from the patient’s family. In twenty cases, non-disclosure was undertaken independently. In conclusion, most respondents opt to disclose the truth; however, the vast majority of these respondents make exceptions. Instances of non-disclosure are primarily motivated by sociocultural constructs. (shrink)

Using a sample of 15,174 firms from 24 countries included in the 2009 World Bank Enterprise Survey, we investigate the impact of disclosure standards and auditing infrastructure on the bribery of public officials to secure government contracts. We find that firms are less likely to grant gift to secure a government contract in countries having more extensive financial reporting requirements and countries where audit firms face a higher litigation and sanction risk. Findings also show that firms are less (...) likely to bribe bureaucrats in case financial statements are reviewed by an external audit firm. Our results are economically significant and are robust to several sensitivity analyses. These findings support certain policies that are currently being implemented or discussed to mitigate bribery within the public sector across the globe. (shrink)

Objectives Disclosures of funding sources and conflicts of interests (COI) in published peer-reviewed journal articles have recently begun to receive some attention, but many critical questions remain, for example, how often such reporting occurs concerning research conducted in the developing world and what factors may be involved. Design Of all articles indexed in Medline reporting on human subject HIV research in 2007 conducted in four countries (India, Thailand, Nigeria and Uganda), this study explored how many disclosed a funding source (...) and COI, and what factors are involved. Results Of 221 articles that met the criteria, 67.9% (150) disclosed the presence or absence of a funding source, but only 20% (44) disclosed COI. Studies from Uganda were more likely, and those from Nigeria were less likely to mention a funding source (p<0.001). Of articles in journals that had adopted International Committee of Medical Journal Editors (ICMJE) guidelines, 56% did not disclose COI. Disclosure of funding was more likely when: ≥50% of the authors and the corresponding author were from the sponsoring country, the sponsor country was the USA, and the articles were published in journals in which more of the editors were from the sponsoring countries. Conclusions Of the published studies examined, over a third did not disclose funding source (ie, whether or not there was a funding source) and 80% did not disclose whether COI existed. Most articles in ICMJE-affiliated journals did not disclose COI. These data suggest the need to consider alteration of policies to require that published articles include funding and COI information, to allow readers to assess articles as fully as possible. Hannah Arendt is one of the few philosophers to examine the dynamics of political action at length. Intriguingly, she emphasises the disclosure of who the actor is as a specific distinction of political action. This emphasis is connected with some long-standing worries about Arendt’s account that centre on its apparent unconcern for political responsibility. In this paper, I argue that Arendt’s emphasis on disclosure actually harbours a profound concern with responsibility. I do so by examining three questions. The (...) main part of the paper focuses on how disclosure is bound up with political actors’ attempts to act with one another. It asks: what would it be for an actor to evade disclosure? And: what is involved in an actor acknowledging the fact of disclosure? – Looking at the matter negatively, attempts to evade disclosure and its implications lead to irresponsibility. Positively, for the actor to accept disclosure is to see herself as bound to her fellow actors and audience by relations of joint action and mutual accountability. The conclusion asks a third question: what would it mean for on-lookers to deny the relevance of actors’ disclosure? I argue that Arendt’s historiography – which revolves around stories in which political actors reveal who they are – reflects her conviction that people can and must take responsibility for their world. While the movement to ensure patient’s rights to information and informed consent spreads throughout the world, patient rights of this kind have yet to be introduced in mainland China. Nonetheless, China is no different from other parts of the world in that nurses are expected to shoulder the responsibility of safeguarding patients’ best interests and at the same time to uphold their right to information. This paper expounds on the principle of protectiveness grounded in traditional Chinese medical ethics (...) concerning the practice of informed consent. Nurses in China have a moral obligation to treat patients with sincerity. This notion carries a strong sense of parental protectiveness. As far as information-giving is concerned, nurses in China are ambivalent about the notion of truthfulness. The findings of an empirical study undertaken in seven Chinese cities reveal that nurses in China experience similar difficulties related to the disclosure of information as their counterparts in other parts of the world. A nurse’s narrative, the Chan case, is used to illustrate the typical difficult situation that nurses in China often encounter in looking after vulnerable patients who would like to learn more about their therapeutic regimens. The moral tension embedded in nursing practice is analysed. It is found that most nurses would prefer to tell the truth to patients, but their primary ethical justification is not that of respect for patients’ autonomy or safeguarding patients’ right to self-determination. Rather, it is basically beneficent in nature; that is, they base their decision to reveal the truth on whether or not patients will receive more relevant treatment and better nursing care. (shrink)

The purpose of this article is to problematise a particular social transparency and disclosure regulation in the UK, that transcend national boundaries in order to control slavery in supply chains operating in the developing world. Drawing on notions from the regulatory and sociology literature, i.e. transparency and normativity, and by interviewing anti-slavery activists and experts, this study explores the limitations of the disclosure and transparency requirements of the UK Modern Slavery Act and, more specifically, how anti-slavery activists (...) experience and interpret the new regulations and the regulators’ implementation of the regulation. This research found limited confidence among anti-slavery activists regarding the Act’s call for transparency in relation to the elimination of slavery from global supply chains. The research also found that the limits of the transparency provisions within the Act appear to hinder the attainment of normativity. This study provides new and unique insights into the critical role that social activists play in exposing the lack of corporate transparency and failures of responsibility to protect workers within global supply chains. Analysing the websites of 127 corporations from emerging countries, such as Brazil, Chile, China, India, Indonesia, Mexico, Thailand and South Africa, it becomes evident that both country of origin and industry sector have a significant influence over CSR information disclosure on the web (CSRIDOW). Mi propósito en este trabajo es reconsiderar una de las lecturas más relevantes y provocativas que se han hecho sobre John Dewey en el mundo de habla hispana. En la primera parte reconstruyo las circunstancias que rodearon la difusión, interpretación y traducción de las obras de Dewey en el México de mediados de los años 1940, y en concreto las razones que llevaron a que la visión sociológica que José Medina Echavarría quiso dar de Dewey fuera finalmente desplazada por la (...) filosófica de José Gaos. En la segunda parte analizo la traducción y lectura que Gaos hizo de Experience and Nature de Dewey, teniendo muy presente sus comparaciones con Sein und Zeit de Heidegger . Finalmente, propongo algunas críticas a la visión que Gaos transmite de Dewey como un pensador carente de un tipo de "soberbia diabólica" propia de la verdadera gran filosofía. The purpose of this work is a reconsideration of one of the most relevant and provocative readings of John Dewey written in the Hispanic World. In the first part I reconstruct the circumstances which surrounded the publicity, interpretation and translation of John Dewey's works in the Mexico of the middle 1940's, particularly the reasons why the sociological reading of Dewey that José Medina Echavarría proposed was finally displaced by the metaphysic perspective of José Gaos. In the second part I reconsider Gaos' own translation and interpretation of Experience and Nature, taking in consideration his comparisons with Heidegger's Sein und Zeit . Finally I analyze critically Gaos' view of Dewey as a thinker whose philosophy lacked the "diabolical arrogance" that true great philosophy would seem to require. (shrink)

This book presents an account of Hannah Arendt's performative and non-sovereign theory of freedom and political action, with special focus on action's disclosure of the unique 'who' of each agent. It aims to illuminate Arendt's critique of sovereign rule, totalitarianism, and world-alienation, her defense of a distinct political sphere for engaged citizen action and judgment, her conception of the 'right to have rights,' and her rejection of teleological philosophies of history. Arendt proposes that in modern, pluralistic, secular public (...) spheres, no one metaphysical or religious idea can authoritatively validate political actions or opinions absolutely. At the same time, she sees action and thinking as revealing an inescapable existential illusion of a divine element in human beings, a notion represented well by the 'daimon' metaphor that appears in Arendt's own work and in key works by Plato, Heidegger, Jaspers, and Kant, with which she engages. Corporate social responsibility (CSR) has become a much-discussed subject in the business world. The Internet has become one of the main tools for CSR information disclosure, allowing companies to publicise more information less expensively and faster than ever before. As a result, corporations are increasingly concerned with communicating ethically and responsibly to the diversity of stakeholders through the web. This paper addresses the main question as whether CSR information disclosure on corporate websites is influenced by country of (...) origin and/or industry sector. Analysing the websites of 127 corporations from emerging countries, such as Brazil, Chile, China, India, Indonesia, Mexico, Thailand and South Africa, it becomes evident that both country of origin and industry sector have a significant influence over CSR information disclosure on the web (CSRIDOW). Today, more corporations disclose information about their environmental performance in response to stakeholder demands of environmental responsibility and accountability. What information do corporations disclose on their websites? This paper investigates the environmental management policies and practices of the 200 largest corporations in the world. Based on a content analysis of the environmental reports of Fortune’s Global 200 companies, this research analyzes the content of corporate environmental disclosures with respect to the following seven areas: environmental planning considerations, top management support (...) to the institutionalization of environmental concerns, environmental structures and organizing specifics, environmental leadership activities, environmental control, external validations or certifications of environmental programs, and forms of corporate environmental disclosures. This study explores the rationality behind firms’ decision to admit or deny their involvement in bribery when responding to confidential surveys conducted by international agencies. Specifically, we posit that firms’ reluctance to provide accurate information about their engagement in bribery is at least to some extent contingent on certain situational factors. In other words, we claim that this behavior is context dependent. The paper uses the notions provided by the theory of planned behavior to understand the way in which the (...) corruption of the legal environment, the intensity of market competition, and identification risk influence firms’ decision to lie about their involvement in bribery. To test these notions, we use databases from the fifth wave of the EBRD-World Bank Business Environment and Enterprise Performance Survey, country-level data from the Kauffman Foundation and macroeconomic information from the World Bank database. We run ordinary least squares with geographic region-clustered standard errors on data from 30 countries and 6122 individual firms during the period 2012–2013. Consistent with our expectations, the results indicate that firms operating within more corrupt legal environments, facing more competition, and bearing a higher risk of being identified are less likely to deny their involvement in bribery. We conclude that not all firms have the same incentives to lie about their participation in bribery, and therefore, identifying the drivers of this heterogeneity may help policymakers better assess the reliability of bribery information collected through confidential surveys. The present study concerns the issue of meaning in contemporary continental philosophy. In particular, it develops the two accounts of meaning offered by Heidegger and Levinas, each of whom presents us with a differing break from Husserl. As a first attempt to name the difference between these three thinkers, one could say that Husserl gives us an epistemological notion of meaning; whereas Heidegger gives us an ontological account, and Levinas gives us an ethical account. We will refine and reformulate this (...) division in relation to the issues of each chapter. ;We will thus see how both Heidegger and Levinas develop their separate notions in relation to Husserl's own revolutionary approach to the question of meaning. Whereas Husserl both replaced the term "experience" with the term "intuition" and gave a compelling account of the "prepredicative" roots of the meaningful, Heidegger advances the articulation of such a prepredicative realm of meaning even further than Husserl. He did so, however, in a way that ends up displacing Husserl's notion of intuition. This is the move from Husserl's account of phenomenological intuition to Heidegger's own notion of a more hermeneutic phenomenology . ;I will show how Heidegger articulates an account of meaning as that upon which any projection of understanding takes shape. Meaning becomes a quasi-transcendental, non-subjective notion of that which makes possible the disclosure of any "world." Levinas, on the other hand, offers an account of meaning---in intended opposition to Heidegger---as located primarily in the ethical exposure at the heart of language: in the "face-to-face" relation of Same and Other. He further develops his notion of meaning in terms of the notion of the saying and the said. Both Heidegger and Levinas give us a non-intentional account of the meaningful. For Heidegger it takes the form of a non-intentional background that makes possible both the "worldhood of the world" and the possibilities of Dasein . For Levinas, the meaningful is thought in terms of an interpersonal, quasi-ethical face to face relation between persons exposed to the vulnerability, obligation, and height of an "Other" in what he calls the "saying.". Recent scholarship on the nature of truth within Hans-Georg Gadamer’s and Martin Heidegger’s philosophies has focused primarily on identifying and explicating the commonality between their respective accounts of truth. However, this emphasis on commonality has overlooked Gadamer’s distinctive understanding of truth outside of and beyond a simple development of Heidegger’s consideration of truth as alētheia. This paper defends the claim that the specific manner in which Gadamer and Heidegger critique the correspondence theory of truth is indicative of their distinctive conceptions (...) of truth more generally. While Heidegger understands truth as the unconcealment of beings through the disclosure of Dasein as Being-in-the-world as such, Gadamer concludes that truth is the disclosure of human being through hermeneutical understanding as realized in concrete dialogical engagement in particular. These similar, but often conflicting, accounts of truth cannot be subsumed within one another without overlooking and thereby misunderstanding the philosophical insights found in Gadamer’s and Heidegger’s distinctive philosophies. More importantly, the inability or unwillingness to distinguish their conceptions of truth prevents any subsequent analysis of which thinker provides a more compelling critique of the correspondence theory of truth and which account is more plausible as an understanding of the phenomenon of truth broadly construed. This paper explores naturalism and supernaturalism as modes of disclosure that reveal and conceal different aspects of relationality. Naturalism is presented as a worldview or set of philosophical assumptions that posits an objective world that is separable from persons and discoverable or describable via scientific methods. Because psychotherapy tacitly endorses many naturalistic assumptions, psychotherapy relationships may be limited to an instrumentalist ethic premised upon use-value and manipulability. Given these naturalistic limitations, relationships may require a supernatural component – a (...) component which reaches beyond the naturalistic and into the miraculous. The alternative grounding for this supernatural disclosure is found in the philosophy of Martin Heidegger and that of Emmanuel Levinas, the former emphasizing the possibilities inherent in contemplative rather than calculative disclosures, and the latter emphasizing ethical obligation and absolute otherness. A therapeutic case is discussed as an exemplar of both kinds of relational disclosure – that is, naturalistic and supernaturalistic – and the therapeutic and relational consequences of each type of disclosure are explored. BACKGROUND: In today’s world of increased awareness regarding the concepts of corporate social responsibility (CSR) and corporate governance (CG), many firms in the developed countries consider noncompliance with CSR and CG standards as an important source of risk to their reputations with stakeholders. OBJECTIVE: The aim of this study is to investigate the relationship between the corporate social responsibility disclosure (CSRD) index and corporate factors, namely, board size, board independence, board meetings, CEO duality, a firm’s size, leverage, profitability (...) and age. This is the first known study in the case of Saudi Arabia to use the GRI 4th edition indicators to construct the CSRD index and evaluate Saudi listed firms. Results: The results show that profitability and size factor have positive and significant association with CSR disclosure in listed Saudi firms. While CG characteristics have no impact on CSR disclosure except board independence which has a negative impact. Conclusion: The average of CSRD index among Saudi firms is too low, it is about 11% that means Saudi firms disclose 11% of the information that they have to provide for stockholders according to GRI guidelines.
