This paper focuses on the meaning of Du Bois’s concept of “abolition democracy” and on the ideology of the abstract rights-bearing subject. In Abolition Democracy, Angela Y. Davis calls for the abolition of oppressive institutions, such as U.S. prisons, in order to engender abolition democracy. She also questions how subjects appear before the law, which justifies and normalizes inhumane practices, such as the death penalty. Despite the persistence of violence inside and around prisons, and the dubious adequacy of criminal law to respond to victim–survivors, international human rights (IHR) discourse increasingly promotes the mobilisation of the state’s penal apparatus to respond to human rights violations, including violence against women (VAW). Using an anticolonial feminist approach, this article scrutinises the ontological and epistemological commitments underlying ‘human rights penality,’ by analysing features of the Western-colonial register vis-a-vis more relational worldviews. Separateness, abstraction, and transcendence broadly underpin the (...) exclusion of embodied experience, context, and material reality from the juridical field. In the second part, through discourse analysis of Inter-American and European case law, the author shows the deployment of human rights penality, the displacement of experience, and the disregard of context in IHR discourse. VAW is construed as a procedural and penal matter: it is the absence of a penal process that courts regard as failure to protect women, rather than the state’s inability/unwillingness to address structural subordination. Moreover, the ‘virtues’ attributed to the penal system justify its expansion, which facilitates the continuity of penal violence and debilitates alternative approaches to justice. Finally, the author posits penal abolition as an anticolonial praxis, pointing at examples of anti-carceral feminist work. (shrink)

This article discusses the fortuitous genesis of the book of my conversations with Angela Y. Davis, Abolition Democracy and traces some of the intellectual and philosophical sources that informed the specific questions and approaches that inform the dialogue. Davis’ relationships to Georg Rusche and Otto Kirchheimer, as well as to Foucault, are discussed. Similarly, Davis’ place within a critical black American political-philosophical tradition is analyzed. The essay focuses mainly, however, on the way in which Davis’ work on the prison (...) industrial complex profiles an unsuspected contribution to political philosophy that links up the disciplinary origins of American democracy with its racial contract to give rise to the prison contract. In the tradition of Charles Mills, Davis’ radical theory of penality unmasks and denounces the over-determined relationship between surplus punishment and the racial character of the US polity in terms of theproductivity of the prison system. En examinant les discours les plus emblématiques produits par la philosophie moderne au sujet de la peine de mort, notre intention n'est nullement de "peser le pour et le contre" en vue de déterminer quelle position s'avère la plus raisonnable. Assumant d'emblée le point de vue abolitionniste, notre question est la suivante : dans quelle mesure est-il possible de fonder en raison le refus catégorique de la peine capitale? A cet égard, le détour par l'histoire de la philosophie nous montre (...) à quel point cette raison est avant tout divisée contre elle-même. En effet, au terme d'un travail visant à sonder la cohérence interne des partisans de la peine de mort (Locke, Kant, Stuart Mill) ainsi que de ses adversaires (Beccaria, Bentham), il nous est apparu impossible de conclure à un simple défaut de rationalité de la part des uns ou des autres. Ce que l'on constate au contraire, c'est que chaque démonstration se déploie à partir d'un certain nombre de principes éthiques indémontrables. Bien plus, chaque grande philosophie pénale est susceptible de donner lieu à des prises de position radicalement opposées. Mais pour peu que l'on se refuse à concevoir un abîme insurmontable entre la raison d'une part, et ce que d'aucuns nommèrent le "coeur" d'autre part, la philosophie morale peut bénéficier d'une approche dans laquelle le raisonnement et la sensibilité se complètent, au lieu de constituer une alternative. Paradoxalement, c'est dans l'oeuvre de Jean-Jacques Rousseau qu'il nous a semblé possible de repérer les éléments permettant de fonder au mieux l'abolition, tout en évitant le double écueil du rationalisme dogmatique et de l'émotivisme relativiste. Contesting Carceral Logic provides an innovative and cutting-edge analysis of how carceral logic is embedded within contemporary society, emphasizing international perspectives, the harms and critiques of using carceral logic to respond to human wrongdoing, and exploring penal abolition thought. With chapters from scholars across many disciplines, people in prison, as well as penal abolition activists, the book explores what a future without carceral logic would look like, as well as how such a future is to be (...) developed. The book is also an exploration of penal abolition thought as it is developing in the twenty-first century. Diverse geographical, cultural, identity and experiential frames inform the book's themes of analysing carceral logic as it harms disparate people in disparate places, creating anti-carceral knowledge, exploring case studies pointing to radical alternatives, and to contesting carceral logic from below. Ultimately, Contesting Carceral Logic provides the reader with an alternative and critical perspective from which to reflect on carceral logic, the punitive state and the criminalizing systems that almost exclusively dominate across the world. Finally, it raises the questions of how we are to build communities as well as transform our response to human wrongdoing in ways that are not defined by racism/ethnocentrism, class war and heteropatriarchy. Contesting Carceral Logic will be of great interest to not only scholars and activists, but also provides an introduction to key carceral issues and debates for students of penology, criminology, social policy, geography, politics, philosophy, social work and social history programmes in countries all around the world. The idea is that this change is an answer to the realization that value attribution is inevitable, and a new elaboration on the origins of morals, when the philosopher detaches from utilitarian concepts, with consequences for his moral psychology and theory of value. State policy in the field of law enforcement during the Khrushchev's period wasn't a stabile. The first wave of changes was associated with the abolition of some legislative acts of the Stalinist period, a significant softening of punitive line, narrowing of the scope of capital punishment, empowerment convicted people etc. On the one hand, these steps are partially rehabilitating the Soviet law enforcement. On the other hand, government actions were unreasoned and populist, designed for quick political effect. The next (...) wave of change was due to the spread of the idea of the gradual withering away of the state in terms of building a communist society. As a consequence of this ideology was the reduction of employees in the field of law enforcement and attracting a variety of civic organizations, labor groups and citizens to fulfill a variety of law enforcement functions (voluntary civil police, civil judges, civil assistant investigator, civilian prosecutors, civil lawyers, etc.). And finally, the soviet leadership made steps in the field of law enforcement toward stricter penalties for serious crimes, as well as expanding the scope of the death penalty. The country's leadership was actively intervened in the work of law enforcement. Communist Party took control the law enforcement agencies due to the appointment to senior positions along party lines and managing work of party members through the party cell. One of the major controversies of the time was mixing the steps to improve of law enforcement sphere (increased attention to the frames, structural changes, strengthening analytical work in the study of crime statistics), with a desire to demonstrate the advantages of the socialist way of life (which was manifested in the silencing of certain criminal manifestations, artificially lowering their significance by reducing the liability on them, outright ignoring problems and their causes, etc.). Contradictions were observed in the conduct of state punitive line too. On the one hand, it was a significant step up from the Stalinist penal system by expanding the rights of prisoners, procedural rules, which led to a softening of the repressive pressure on the population. On the other hand, the state retained its attitude to dissent; applying the new forms social exclusion of dissidents, for example, applying to them the impact of psychiatric measures. These moments hampered consolidation of the new format of normative behavior in the minds of ordinary citizens, and gave rise to "double standards", the imbalance between what is declared and what actually happened. In lieu of an abstract, here is a brief excerpt of the content:Mill on Capital Punishment-Retributive Overtones?Michael ClarkI.In his famous parliamentary speech of 18681 Mill defends the retention of capital punishment for the worst murderers on the Benthamite grounds of frugality and exemplarity.2 Punishment being an intrinsic "mischief," it should be no more severe than it needs to be to achieve its desired effect, principally that of deterring others from crime. That effect can be achieved more economically if the suffering (...) appears greater than it really is. Execution, Mill thinks, is less cruel than the alternative of life imprisonment with hard labour,3 for the offender would have died anyway sooner or later, probably in greater pain. It is also the most impressive way of punishing murder, since it closely resembles the offence. The more a penalty impresses itself upon people's minds the more likely it is to deter. And, as Bentham said, "exemplarity tends to increase the apparent, frugality to reduce the real [suffering]."4But the language Mill uses has seemed to import non-utilitarian, quasi-retributive elements into his thought. Thus Tom Sorrell says, "He brings in the appropriateness of execution to certain offences. The argument from appropriateness, if it is not retributivist, is at least consistent with retributivism, and has whatever intuitive appeal attaches to punishing purely on account of guilt."5 Is this perhaps another of those non-utilitarian elements in Mill's philosophy that many commentators have, rightly or wrongly, claimed to detect, like the supposed tension between the Principle of Utility and Mill's regard for the value of liberty? I shall argue, however, that it is a mistake to interpret Mill's remarks in a retributive way. Is Mill here falling back on the idea that the criminal should receive a penalty which fits the crime because he has made himself worthy of it?Originally, Mill had opposed capital punishment, and, though he did allow that there might possibly be "atrocious crimes" against which it was the only effective deterrent, he doubted whether there were any such cases. "I have therefore always been favourable to the entire abolition of capital punishment, though I confess I do not attach much importance to it in the case of the worst criminals of all," he wrote in an 1841 letter to Robert Barclay Fox (CW XIII: 474). It is evident that he is making the usual assumption that the death penalty is more severe than life imprisonment. As a utilitarian, he could countenance the death penalty only if it were "the only effective deterrent" against aggravated murder.By the time of the Parliamentary Speech he had changed his mind about the relative severity of execution and life imprisonment. Execution was swift and generally less painful than the death the murderer would otherwise eventually face. Whereas traditional abolitionist arguments call for putting an end to capital punishment, French-Algerian philosopher Jacques Derrida emphasizes its survival, writing that “even when it will have been abolished, the death penalty will survive.” My dissertation interprets this perplexing claim by attending to the specificity of Derrida’s discourse on survival or survivance, contending that the death penalty serves an irreducible role in the constitution of the (individual or collective) subject, such that, even in the event of its abolition, some form (...) of the death penalty must continue. Through close readings of Heidegger, Kant, Nietzsche, Freud, Michel de Montagne, and Victor Hugo, as well as Shakespeare, linguist Émile Benveniste, Hungarian psychoanalysts Abraham and Torok, and the nineteenth-century political theorist Juan Donoso Cortés, the dissertation provides an account of the function of the death penalty as a specific institution within the modern penal system of a collective political body and as the legacy of ancient political economies based on sacrificial rites. This analysis interprets the death penalty both structurally and specifically, accounting for the indissociable relationship between the institution and its conceptual structure more broadly. Survivance, I argue, only ever occurs through an other, leaving open the question of the survival of the death penalty to the dissemination of indefinite and unpredictable forms that could consist in its abolition. The exploration of penal censure in this book is inspired by the fortieth anniversary in 2016 of the publication of Andreas von Hirsch's Doing Justice, which opened up a fresh set of issues in theorisation about punishment that eventually led von Hirsch to ground his proposed model of desert-based sentencing on the notion of penal censure. Von Hirsch's work thus provides an obvious starting-point for an exploration of the importance of censure for the justification of punishment, both within (...) von Hirsch's theory of just deserts and from the perspectives of other theoretical approaches. It also provides an opportunity for engaging with censure more broadly from philosophical, sociological-anthropological and individual-psychological perspectives. The essays in this collection map the conceptual territory of censure from these different perspectives, address issues for desert theory that arise from fuller understandings of censure, and consider afresh the role of censure within the jurisprudence of punishment. They show that analyses of censure from different vantage points can significantly enrich punishment theory, not least by providing a conceptual basis for perceiving common ground between and thus connecting different strands of penal theory. This paper analyses the demands for abolishing passports after WWI. The international regime of obligatory passports, as it exists today, is a legacy of the Great War. After the Armistice, two Passport Conferences organized by the League of Nations considered its abolition. Before the second conference, a resolution of the Sixth Assembly of the League of Nations stated that "public opinion is certainly waiting for at least one step towards the most generalized abolition of the passport system ". (...) Was this just a diplomatic figure of speech, or is there really such an "expectation" to be found, for instance, in the press? If there was such an expectation in the press, what was the political orientation of the newspapers in favor of abolishing passports: was it left-wing? This article analyzes a corpus of over 600 articles published in the French press between the World Wars to show, firstly, that interest in the "abolition of passports" was not circumstantial. It's not because the League of Nations is discussing it that the press is discussing it - the opposite is true. The issue of the "abolition of passports" gave rise to a greater number of articles than the League’s "passport conferences". secondly, and more surprisingly, the newspapers that published the most articles on the abolition of passports were center-right and mostly regional. If a guilty offender is justly sentenced to be punished and an innocent volunteer agrees to be punished instead, is that any reason to leave the offender unpunished? In the context of mundane criminal justice, we mostly think not. But in a religious context, some Christians do believe in penal substitution as a theory of the atonement. In these lectures Michel Foucault presents for the first time his approach to the question of power that will be the focus of his research up to the writing of Discipline and Punish and beyond. His analysis starts with a detailed account of Richelieu’s repression of the Nu-pieds revolt and then goes on to show how the apparatus of power developed by the monarchy on this occasion breaks with the system of juridical and judicial institutions of the Middle Ages and opens out onto a “judicial State apparatus”, a “repressive system”, whose function is focused on the confinement of those who challenge its order. Michel Foucault systemizes the approach of a history of truth on the basis of the study of “juridico-political matrices” that he had begun in the previous year’s lectures and which is at the heart of the notion of “knowledge-power”. In these lectures Foucault develops his theory of justice and penal law. The appearance of this volume marks the end of the publication of the series Foucault’s courses at the Collège de France. The penal substitution account of the Atonement fails for conceptual reasons: punishment is expressive action, condemning the party punished, and so is not transferable from a guilty to an innocent party. But there is a relative to the penal substitution view, the vicarious punishment account, that is neither conceptually nor morally objectionable. On this view, the guilty person’s punishment consists in the suffering of an innocent to whom he or she bears a special relationship. Building Abolition: Decarceration and Social Justice explores the intersections of the carceral in projects of oppression, while at the same time providing intellectual, pragmatic, and undetermined paths toward abolition. The United States system of policing is in drastic need of change. Some recent critics have encouraged that we avoid trying to repair the system—and abolish it altogether. In advancing this position, they often invoke ideas of “dreams,” “speculative imagination,” and “horizons” to guide efforts at fixing the problems of policing. In this essay, I caution against the overuse of this sort of idealized discourse in debates about policing. Specifically, I show how idealizations risk being counterproductive with respect to abolitionists’ (...) activist goals, in that they suggest that if abolition is desirable, approximating abolition is also desirable; fail to clarify what the conditions of application of their view are; and operate without the feasibility-sensitivity that one should expect from a non-evaluative position. My goal is not to suggest that our system of policing is fine as is. Nor is it to diminish the importance of having a long-term revolutionary vision. By pointing out the ways in which the idealizations invoked are inconsistent with abolitionists’ activist agenda, I hope to help clarify the merits of police abolition as a guiding strategy for change and caution against the use of certain forms of idealized thinking in our efforts at police reform. This paper argues that Rwanda’s decision to abolish the death penalty should be viewed in a wider context rather than as a mere result of top–down pressure from the International Criminal Tribunal for Rwanda (ICTR). Part I traces the creation of the ICTR and the breakdown of negotiations as a result of the exclusion of the death penalty from the ICTR’s jurisdiction. It then outlines Rwanda’s efforts to prosecute the hundreds of thousands of individuals accused of committing genocide-related crimes and (...) notes the limited and steadily decreasing role the death penalty actually played within Rwanda. Part II discusses Rwanda’s legislation abolishing the death penalty and argues that both international pressure and local historical and political forces influenced the decision. Part III situates Rwanda’s story within a growing paradox of excluding the death penalty from international criminal tribunals for the most serious crimes while national jurisdictions maintain it. It concludes that as in Rwanda, any perceived or potential impact of international criminal law in national jurisdictions must be measured in light of local circumstances. (shrink)

In the history of interpretations of Hegel, how one reads the chapter on “Absolute Knowing” in the Phenomenology of Spirit determines one’s whole perspective. In fact, Marx’s only comments on the Phenomenology concern this final chapter, taking it as the very “secret” of Hegel’s philosophy. But what is the secret hidden within the thicket of this impenetrable prose? My suggestion is that it turns on a very specific meaning of the “abolition of time” that Hegel describes in the very (...) last paragraphs. But the meaning of this idea is not what Marx criticized in his last Manuscript of 1844, that is, it is not simply a form of idealism which abolishes the finitude of man. Rather this relationship to time accepts such finitude, making it the central axis upon which the possibility of freedom turns. In this paper, I will present a reading of “Absolute Knowing” that focuses on the meaning of overcoming time, and connect it to some thoughts on “disposable time” that Marx discusses in the Grundrisse. El actual Derecho Penal de la seguridad que se expresa en el populismo punitivo tiene un sesgo orientado a la persecución penal de los delitos callejeros, violentos, mientras que los delitos del poder y los negocios discurre con mayor tolerancia de la sociedad y de los operadores jurídicos, porque se realizan en contextos normalizados. Para sustentar esta tesis, se analiza qué entiende mayoritariamente la sociedad por delincuencia grave, la visibilidad de los delitos y las estadísticas criminales, principalmente. Este (...) análisis nos lleva a la consideración de que la percepción del daño social, el miedo a ser víctimas de delitos, la tolerancia social hacia determinados comportamientos, los medios de comunicación que construyen estereotipos, la visibilidad que se muestra en las estadísticas, todo ello conjugado, da lugar a una construcción social del contenido material de delincuencia grave de manera selectiva, orientado hacia los delitos contra las personas, dejando fuera de foco los delitos socioeconómicos. There is something prophetic about abolition; some element of the elsewhere that marks its practice, and its discourse. In the work of undoing, there is a crack. In the refusal, a moment of imagination. Abolition is driven by definitive demands as much as by what is yet to come and what is still unfinished.

Illusionism claims that we are not conscious, that there is nothing it is like, in the usual sense of the word, to feel sad, or to smell lavender. According to Illusionists, we are, in a technical sense, zombies. Instead of arguing for the falsity of Illusionism directly, I will explain why the main philosophical motivations for it are mistaken – and I trust the rest will be taken care of by the extreme implausibility of the view. I want to spread (...) the good news to Illusionists that they don’t need to resort to this highly counterintuitive, strange, and as I will argue later, morally corrosive idea. One can be a physicalist and phenomenal realist since neither of the two types of arguments Illusionists rely on – the conceivability arguments, and the debunking arguments against physicalist phenomenal realism – work. In the last part of the paper, I will say something about the corrosive effect this metaphysics has on our moral and evaluative outlook. (shrink)

The movements for prison and police abolition today are not only analogous to but extensions of antebellum and postbellum movements for the abolition of slavery and segregation. Dreams of transformative justice, resistance to government, and the creation of alternative practices have been vital to abolitionist efforts to dismantle various US anarchies. Professor William Lane Craig argues that a particular set of concerns about the Christian doctrine of penal substitution (namely, that Jesus of Nazareth was sacrificed for the sins of humanity) can be satisfied. This article provides rebuttals to said replies in an attempt to render plausible the claim that God exists to the extent that God is perfectly just, and that divine justice requires, among other things, that God never engage in the harming of innocents, consistent with any doctrine (...) of retributivism worthy of the name. The doctrine of God, then, must remain consistent with unqualified negative retributivism. Any theism which might suggest otherwise violates such vital considerations of justice and fairness and must be rejected. (shrink)

This article discusses the removal of voting rights from those convicted of crimes. I focus on two recent defences of penal disenfranchisement: firstly, I question one justification of the view that voting rights are conditional on the fulfilment of certain responsibilities that offenders fail to meet. Secondly, I criticise an expressivist justification of disenfranchisement based on the idea that it is uniquely suited to express dissociation from serious wrongdoing. While embracing the expressivist perspective of the latter line of argument, (...) I argue that disenfranchisement also expresses attitudes that are incompatible with the commitment to equality. Disenfranchisement conveys the judgment that offenders are not fit to participate in the democratic process. In doing so, it violates the duty of the state to treat all its citizens with equal respect and undermines offenders’ equal status. Moreover, this policy fosters objectionable inequalities of esteem: other members of the community are very likely to internalise the judgment that offenders are second‐class citizens and to regard them as inferior, which in turn undermines their status in society. What is abolition? What is the logic of its movement, the character of its kinesthetic signature? By exploring abolition’s debts to Foucauldian genealogy, the messianism in Derridean deconstruction, and the affective resistance among queer/trans communities, this essay argues that abolition is a kite-idea. It moves by flying overhead, shimmering in the sun, and tugging at the hand. Abolition is a practice of history, a dream of the future, and an affective struggle lived today. L’article aborde la problématique des actes normatifs de droit pénal adoptés en Pologne dans les années 1944–1956. L’auteur essaie de répondre à la question : comment le régime politique et l’idéologie stalinienne ont-ils influencé la manière de rédiger les textes juridiques de cette branche du droit lors des plus grandes répressions par le pouvoir d’après-guerre en Pologne? À partir de 1944, le droit pénal a été adapté aux besoins des autorités communistes, contrôlées par l’Union soviétique. Dans la période analysée, on (...) a introduit en Pologne plus de cent actes normatifs englobant des dispositions pénales. L’idéologisation du droit pénal est visible dans toutes les parties des actes normatifs : titres, préambules et dispositions juridiques. On retrouve dans leur contenu les valeurs politiques, économiques et sociales fondamentales pour l’idéologie du stalinisme, dont les thèses ont été mises en œuvre en Pologne après la fin de l’occupation allemande. Analytic metaphysics of gender has taken an ameliorative turn towards ethical and political questions regarding what our concept of gender ought to be, and how gendered society should be structured. Abolitionism about gender, which claims that we ought to mandate gender out of existence, has therefore seen renewed interest. I consider three arguments for abolitionism from radically different perspectives: Haslanger’s simple argument, Escalante’s Gender Nihilism, and Okin’s argument from ideal theory. I argue that none of the above manage to establish (...) the desirability of abolitionism and that we should be wary of the abolitionist position, as it imperils trans lives. (shrink)

The series of conversations between Angela Y. Davis and Eduardo Mendieta entitled Abolition Democracy is a powerful investigation of the failed moral imagination of imperial democracies. After examining their discussion of how truncated political discourses enable abuses in both war and imprisonment, I look to the “exceptional” status of war prisons such as at Guantánamo and Abu Ghraib. I argue that domestic prisons, like international war prisons, are means for the paradigmatic functioning of the exception in modern democracy, as (...) described by Giorgio Agamben, and thus constitute no less of an “ultimate carceral threat.” Within the domestic prison, the legal status of inmates is virtually suspended and they are reduced to bare life. I conclude that we may yet share the hopes of Davis and Mendieta for an abolition democracy, and that such a democracy would bear the echoes of the unconditional sovereignty “to come” theorized by Jacques Derrida. This essay argues that a black radical Kantianism proposes a Kantian theory of justice in the circumstances of injustice. First, I describe BRK’s method of political critique and explain how it builds on Kant’s republicanism. Second, I argue that Kant’s original account of public right is incomplete because it neglects that a situated citizenry’s adoption of an ideal contributes to its refinement. Lastly, with the aid of W.E.B. Du Bois’s analysis of American Reconstruction and his proposal of an “abolition (...) democracy,” I offer my refined universalizable standard for political critique. Du Bois reconceptualizes the requirements of justice to protect the political liberties and productive powers of black freedmen and the working poor. While originating with the political demands of black freedmen during the Reconstruction era, the universal protection of political liberties and productive powers offers a novel public standard for political judgment that should still anchor deliberation today. This paper considers the justifiability of removing the right to vote from those convicted of crimes. Firstly, I consider the claim that the removal of the right to vote from prisoners is necessary as a practical matter to protect the democratic process from those who have shown themselves to be untrustworthy. Secondly, I look at the claim that offenders have broken the social contract and forfeited rights to participate in making law. And thirdly, I look at the claim that the (...) voting ban is essential part of the justified punishment of serious offenders. These arguments have in common the feature that they attempt to articulate the sense in which rights imply responsibilities, particularly that voting rights should be conditional on one’s having met one’s civic responsibilities. I argue that the only interpretation of this view that could justify prisoner disenfranchisement is that which thinks of disenfranchisement as fair and deserved retributive punishment for crime. Against widespread opposition to, and confusion about, the importance of retributive punishment, I offer a brief defence. However, I conclude that even if legitimate retributive purposes could in principle justify prisoner disenfranchisement, the significance of disenfranchisement is such that it should be reserved for the most serious crimes.
