The received view in medical contexts is that informed consent is both necessary and sufficient for patient autonomy. This paper argues that informed consent is not sufficient for patient autonomy, at least when autonomy is understood as a "relational" concept. Relational conceptions of autonomy, which have become prominent in the contemporary literature, draw on themes in the thought of Charles Taylor. I first identify four themes in Taylor's work that together constitute a picture of human agency corresponding to (...) the notion of agency implicit in relational accounts of autonomy. Drawing on these themes, I sketch two arguments against the position that informed consent secures autonomy. The first is that informed consent is an "opportunity" concept whereas autonomy is an "exercise" concept; the second is that informed consent requires merely weak evaluation and not strong evaluation. On Taylor's analysis of agency, strong evaluation is required for agency and for autonomy. (shrink)

Our contribute compares the concepts of Japanese and German primary school children relating to the topic of death, healing in the context of values education and the ethics of care. This is a project of the German-Japanese Research Initiative on Philosophizing with Children (DJFPK), cialis 40mg which aims to facilitate individual autonomy by enhancing philosophical-ethical judgment. It encourages the application and appropriate transfer of values based on philosophical-ethical knowledge and acquired through independent reflection to the situations of daily life.

In this paper, an objective conception of contexts based loosely upon situation theory is developed and formalized. Unlike subjective conceptions, which take contexts to be something like sets of beliefs, contexts on the objective conception are taken to be complex, structured pieces of the world that (in general) contain individuals, other contexts, and propositions about them. An extended first-order language for this account is developed. The language contains complex terms for propositions, and the standard predicate "ist" that expresses (...) the relation that holds between a context and a proposition just in case the latter is true in the former. The logic for the objective conception features a global classical predicate calculus, a local logic for reasoning within contexts, and axioms for propositions. The specter of paradox is banished from the logic by allowing "ist" to be nonbivalent in problematic cases: it is not in general the case, for any context c and proposition p, that either ist(c,p) or ist(c, ¬p). An important representational capability of the logic is illustrated by proving an appropriately modified version of an illustrative theorem from McCarthy's classic Blocks World example. (shrink)

I have two major aims in this chapter, which is philosophical in nature. One is to draw upon values that are salient in the southern African region in order to construct a novel and attractive conception of human dignity. Specifically, I articulate the idea that human beings have a dignity in virtue of their communal nature, or their capacity for what I call ‘identity’ and ‘solidarity’, which contrasts the most influential conception in the West, according to which our (...) dignity inheres in our rationality or autonomy. The second aim is to invoke this Afro-communitarian conception of human dignity in order to advance a new conception of why poverty is morally problematic and of what people, particularly states, are ethically required to do with regard to it. Common conceptions of poverty focus on it in terms of people lacking income, preference satisfaction (‘utility’) or general-purpose means (‘social primary goods’ in the Rawlsian jargon). In contrast, if what is special about human beings is our ability to commune with one another in a certain way, then the respects in which poverty can be an injustice and the ways that it must be fought must be understood in more communitarian or relational terms, which I both specify with several concrete examples in a South African context and contrast with the more dominant approaches. The essay presents a relational concept of the stranger parting from and at the same time going beyond Alfred Schutz’s famous and controversial conception of “The Stranger.” Not only the subjective viewpoint of the stranger entering an in‑group – as in the Schutzian outline – is relevant for the construction of strangeness, but also the interactional context and the receiving in‑group with its respective patterns of culture. For strangeness is a relational concept, it is only constructed (...) in relationships of individuals and groups; it is an ascription or “label” that is activated in interaction processes. Within in‑ and out‑group constellations, the stranger is objectified by social typification, which may be based on a de‑subjectivation and reification of the respective Other. Relational strangeness refers to the diverse possibilities of the social construction of the stranger, always taking into consideration the individuals involved in in‑ and out‑group relations. The paper analyses the concept of equality in theoretical, philosophical, and practical context, as it appears in the programs of the Polish political parties. Inquiries regard the concept of equality for the LGBTQ community (lesbian, gay, bisexual, transgender, queer) in the context of human rights. The concept of human rights is discussed within the vertical and horizontal approach. The following questions are addressed: How do political parties relate to the concept of equality? Does equality appear in the political (...) programs, and if it does, then in relation to which social groups? Do political parties engage in the problem of equality with regard to the LGBTQ community? The aim of the paper is to indicate significant differences in this respect between political parties. This article starts from the observation that in classical Athens the discovery of democracy as a normative model of politics has been from the beginning not only a political and a legal but at the same time a philosophical enterprise. Reflections on the concept of criminal law and on the meaning of punishment can greatly benefit from reflections on Athenian democracy as a germ for our contemporary debate on criminal justice in a democracy. Three main characteristics of the Athenian model (...) will be analysed: the self-instituting capacity of a democracy based on participatory and reflective citizenship, political power as the capacity of citizens for co-operating and co-acting with others, and the crime of hubris as one of the key issues in Athenian criminal law. These analyses will lead to the conclusion that one of the key issues of a democratic legal order lies in its capacity of recognizing the fragility of the human condition and of developing workable and effective standards of justice in that context. A relational conception of criminal law and punishment, based on proportionality, reflexivity, mutual respect and responsibility fits best with a democracy under the rule of law. (shrink)

The article aims to determine socio-economic causes of the emergence of an oligarchy and its functions in the Ukrainian economy in the context of postmodernism. The essence of postmodernism is worldview-philosophical, economic and political systems collapse. This is a kind of opposition to modernism. As for the economy during postmodernism, namely its formation, the changes relate to the view of social relations and human activity. So, oligarchic Ukraine is trying to solve its problems personally. However, a holistic view on (...) the concept of oligarchy is falling apart, since the dominance of financial and industrial groups in the economy of Ukraine monopolizes entire economic sectors, and authorities of different levels in different ways protect not so much the interest of the Ukrainian people, but the interest of its richest layer. Most Ukrainian oligarchs were able to earn their capital in the 1990s, using any opportunity. It was quite cheap redistribution of state property, friendship with the authorities, seizure of someone else’s property. At the same time, oligarchs successfully used imperfect legislation. They simply rewritten it “for themselves”, repeatedly using “substitute” politicians. It is concluded that at the present stage of Ukraine’s development, the oligarchy has not only ceased to fulfill its stabilizing function, but also turned into the main obstacle to modernization processes. Therefore, the current civilization choice of Ukraine, in particular, is important paradigm of comprehension and strategy of action. (shrink)

ABSTRACT: In contemporary discussions of freedom in Stoic philosophy we often encounter the following assumptions: (i) the Stoics discussed the problem of free will and determinis; (ii) since in Stoic philosophy freedom of the will is in the end just an illusion, the Stoics took the freedom of the sage as a substitute for it and as the only true freedom; (iii) in the c. 500 years of live Stoic philosophical debate, the Stoics were largely concerned with the same philosophical (...) problems of freedom. In this paper I argue that (i) can be upheld only in a very restricted way; (ii) is altogether untenable; and regarding (iii), that, although there may have occurred little change in the Stoic philosophical position on freedom over the centuries, we can detect more than one transformation of the philosophical problems that were at the forefront of the discussion. Moreover, that all the conceptions and problems of freedom were linked to Stoic ethics, and that the differences between them become transparent when one considers their various roles in this context. The present article aims to reveal the historical and legal experience of the ancient Rome that laid foundations of contemporary private law and to compare the goals of the National Family Policy Concept and the state policy of the ancient Rome regarding family issues. The concept of family (...) framed by the National Family Policy Concept is based on matrimony. This is why the authors of the article focus on Roman matrimony. Having discussed the ancient Roman concept of marriage and Roman state policy regarding issues of matrimony and family and comparing it with the aims of the National Family Policy concept it might be stated that policy of encouraging family and promoting family relations based on matrimony that is provided by the Lithuanian state is not a new invention but may also refer to legal resolutions of the ancient Rome. Absence of health, that is, sickness in Africa is viewed in personalistic terms. A disease is explained as effected by 'the active purposeful intervention of an agent, who may be human', non-human (a ghost, an ancestor, an 'evil spirit), or supernatural (a deity or other very powerful being)' (Foster). Illness is thus attributed to breaking of taboos, offending God and/ or ancestral spirits; witchcraft, sorcery, the evil eye, passion by an evil spirit and a curse from parents or from an (...) offended neighbour. In view of these personalistic theories of ill health, treatment is through ritual purification, exorcism or sacrifices. For an appropriate diagnosis and intervention, it is imperative to determine 'who' caused the illness and then 'why' it was caused, to which answers are offered through divination by a healer. This interpretive framework, is applicable to all types of sickness, facilitates co-existence of African traditional healing and biomedical treatment, that is, plurality of health seeking practices. The approach fails to offer a constructive approach and contradicts the biblical healing framework whereby one may not have explanatory causes to a situation of ill health. This article engaged the biblical concept of shalōm as a relevant constructive framework. The Hebrew concept of shalōm, though distinctly salvific, is inclusive of holistic and personalistic healing aspects. The concept encompasses constructive aspects of completeness, wholeness, health, peace, welfare, safety, soundness, tranquillity, prosperity, perfectness, fullness, rest, harmony and the absence of agitation or discord, which provides a useful holistic healing theological framework. It therefore provides a health and well-being framework that is relational, sensitive and applicable to healing patterns in Africa. Using the case study of the Abaluyia people of East Africa, this article discussed bereavement as a state that requires healing and how the biblical framework of shalōm could be applied in fostering bereavement healing. The development of the peace concept is closely related to the development of the concept of the state and hence to the efforts for elimination of war as an instrument for resolving disputes between states. In that context, war and peace are traditionally treated as mutually exclusive concepts, i.e., war implies violence, while peace, nonviolence. So, the end of war marks the beginning of peace and vice versa. Therefore, both concepts simultaneously represent the inevitable outcomes of the continuous and (...) dynamic nature of social interaction in the international system, foreshadowing future war for nations and states that are currently at peace and, on the other hand, foreshadowing peace for nations and states that are currently at war. Starting from the indicated traditional understanding of the concepts of peace and war, as well as from the fact that the establishment of peace research begins during the 80s of the XX century, the focus in the paper is specifically placed on the analysis of the peace concept through the prism of the theory of international relationships. Namely, it is indisputable that until the establishment of peace and security research and studies, issues of peace and security are generally considered and interpreted within the framework of the various theoretical approaches for international relations. Hence, the paper more specifically explores the evolutionary character of the perceptions and understanding of the peace concept, especially from the perspective of: federalism, neorealism, liberalism and functionalism. The goal of the text is to reconstruct the concept of cultural normativity found in the phenomenological philosophy of law. The starting point of the text is the distinction between cultural normativity and normativity in culture. This distinction is based on reference to an extra-cultural, but not non-human instance – transcendent to the creations of humanity and its world, but in relations with the human equipment, with the characteristics of a specific human being and its existence. The specific relations between (...) cultural and legal normativity can be found in phenomenological concepts of law, which draw on the Husserlian transcendentalism and essentialism. The phenomenology of law attempts to answer the question of the sources, and the ontological and epistemological status of normativity as such. Normativity as a written and unwritten set of norms is characterized by phenomenologists with reference to value and axiology. The values are assumed by them as certain fixed reference points (“horizon of values” given to be recognized), because norms make it possible to establish rules for various individual and collective practices within a particular community and culture on the basis of values. Swiss-born Emer de Vattel was one of the last eminent thinkers of natural law. He shaped the later part of early-modern natural jurisprudence. At the time, the subject had become a fashionable academic sub-discipline in both jurisprudence and philosophy. Vattel's considerable impact on statesmen, political thinkers, diplomats and lawyers during his lifetime and after rested primarily on the fact that his The Law of Nations transformed natural law into the basis of a more comprehensive and practicable theory of interstate relations. (...) His ideas served to promote reform programmes whose comprehensive natures spanned the domains of economic reform, constitutionalism and international diplomacy and foreign trade policy. Newborn bloodspot screening programs are some of the longest running population screening programs internationally. Debate continues regarding the need for parents to give consent to having their child screened. Little attention has been paid to how meanings of consent-related terminology vary among stakeholders and the implications of this for practice. We undertook semi-structured interviews with parents, healthcare professionals and policy decision makers in two Canadian provinces. Conceptions of consent-related terms revolved around seven factors within two broad domains, decision-making and information (...) attainment. Decision-making comprised: parent decision authority; voluntariness; parent engagement with decision-making; and the process of enacting choice. Information ascertainment comprised: professional responsibilities ; parent responsibilities; and the need for discussion and understanding prior to a decision. Our findings indicate that consent-related terms are variously understood, with substantive implications for practice. We suggest that consent procedures should be explained descriptively, regardless of approach, so there are clear indications of what is expected of parents and healthcare professionals. Support systems are required both to meet the educational needs of parents and families and to support healthcare professionals in delivering information in a manner in keeping with parent needs. The nuclear community frequently refers to the concept of “future generations” when discussing the management of high-level radioactive waste. However, this notion is generally not defined. In this context, we have to assume a wide definition of the concept of future generations, conceived as people who will live after the contemporary people are dead. This definition embraces thus each generation following ours, without any restriction in time. The aim of this paper is to show that, in the debate about (...) nuclear waste, this broad notion should be further specified and to clarify the related implications for nuclear waste management policies. Therefore, we provide an ethical analysis of different management strategies for high-level waste in the light of two principles, protection of future generations—based on safety and security—and respect for their choice. This analysis shows that high-level waste management options have different ethical impacts across future generations, depending on whether the memory of the waste and its location is lost, or not. We suggest taking this distinction into account by introducing the notions of “close future generations” and “remote future generations”, which has important implications on nuclear waste management policies insofar as it stresses that a retrievable disposal has fewer benefits than usually assumed. In the last two decades, the term “quality-of-life” has become popular in medicine and health care. There are, however, important differences in the meaning and the use of the term. The message of all quality-of-life talk is that medicine and health care are not valuable in themselves. They are valuable to the extent that they contribute to the quality of life of patients. The ultimate aims of medicine and health care are not health or prolongation of life as such, but (...) preservation or improvement of the quality of life. The primary aims of medicine and health care, such as the prolongation of life, can – but need not always – come into conflict with the ultimate ones: medical treatments do not always benefit a patient. In this article I will, first, summarize the results of my explorations of the use and the meaning of the term “quality-of-life.” The use and the meaning of the term turn out to depend on the contexts of medical decisionmaking in which it is used. I will show that there are at least three different concepts of quality-of-life. Second, I will argue that the different concepts of quality-of-life are not unrelated. They point to different components of and/or conditions for happiness. Third, I will analyze the relation between the three concepts of qualityof-life, health and happiness. (shrink)

The concept of vulnerability is widely used in human rights policy documents, reports, and case law focusing on the impacts of climate change on human rights. In academic discussions, the concept, however, has also sparked a discussion on its benefits and challenges for the advancement of human rights, especially concerning the principles of equality and non-discrimination. This article aims at contributing to this debate from a frame-analytical perspective. In social sciences, frame-analysis is a form of discourse analysis which focuses on (...) the consequences of different concepts for legal, political, and social discussions and norms. With the example of selected UN documents on different human rights issues in the context of climate change, the article, firstly, analyzes whether and how the concept of vulnerability is defined in the documents and why it is used in the documents. Secondly, it is elaborated to which individuals and groups the concept is applied. Thirdly, it is discussed how vulnerability is conceptualized in relation to or in distinction to the concepts of inequality and discrimination. In a further section it is analyzed what narratives are mobilized by the frame of vulnerability. The article concludes that from a discourse-analytical perspective the frame of vulnerability mobilizes problematic narratives which has gendered and racialized implications for those labeled vulnerable. Brief consideration of (1) Peirce’s ‘logic of vagueness’, (2) his categories, and (3) the concepts of overdetermination and underdetermination, vagueness and generality, and inconsistency and incompleteness, along with (4) the abrogation of classical Aristotelian principles of logic, bear out the complexity of all relatively rich sign systems. Given this complexity, there is semiotic indeterminacy, which suggests sign limitations, and at the same time it promises semiotic freedom, giving rise to sign proliferation the yield of which is pluralistic, inter-relational semiosis. (...) This proliferation of signs owes its perpetual flowing change in time to the inapplicability of classical logical principles, namely Non-Contradiction and Excluded-Middle, with respect to elements of vagueness and generality in all signs. Hempel’s ‘Inductivity Paradox’ and Goodman’s ‘New Riddle of Induction’ bear out the limitation and freedom of sign making and sign taking. A concrete cultural example, the Spaniards’ world including the Virgin of Guadalupe and the Aztecs world including their Goddess, Tonantzín, are given a Hempel-Goodman interpretation to reveal the ambiguous, vague, and complex nature of intercultural sign systems, further suggesting pluralism. In fact, when taking the ‘limitativetheorems’ of Gödel, Turing, and Chaitin into account, pluralism becomes undeniable, in view of the inconsistency-incompleteness of complex systems. A model for embracing and coping with pluralism suggests itself in the form of contextualized novelty seeking relativism. This form of pluralism takes overdetermination, largely characteristic of Peirce’s Firstness, and underdetermination largely characteristic of Peirce’s Thirdness, into its embrace to reveal a global context capable of elucidating local contexts the collection of which is considerably less than that global view. The entirety of this global context is impossible to encompass, given our inevitable finitude and fallibilism. Yet, we usually manage to cope with processual pluralism, within the play of semiosis. Background: Mental healthcare needs person-tailored interventions. Experience Sampling Method (ESM) can provide daily life monitoring of personal experiences. This study aims to operationalize and test a measure of momentary reward-related Quality of Life (rQoL). Intuitively, quality of life improves by spending more time on rewarding experiences. ESM clinical interventions can use this information to coach patients to find a realistic, optimal balance of positive experiences (maximize reward) in daily life. rQoL combines the frequency of engaging in a relevant context (...) (a ‘behavior setting’) with concurrent (positive) affect. High rQoL occurs when the most frequent behavior settings are combined with positive affect or infrequent behavior settings co-occur with low positive affect. Methods: Resampling procedures (Monte Carlo experiments) were applied to assess the reliability of rQoL using various behavior setting definitions under different sampling circumstances, for real or virtual subjects with low-, average- and high contextual variability. Furthermore, resampling was used to assess whether rQoL is a distinct concept from positive affect. Virtual ESM beep datasets were extracted from 1058 valid ESM observations for virtual and real subjects. Results: Behavior settings defined by Who-What contextual information were most informative. Simulations of at least 100 ESM observations are needed for reliable assessment. Virtual ESM beep datasets of a real subject can be defined by Who-What-Where behavior setting combinations. Large sample sizes are necessary for reliable rQoL assessments, except for subjects with low contextual variability. rQoL is distinct from positive affect. Conclusion: rQoL is a feasible concept. Monte Carlo experiments should be used to assess the reliable implementation of an ESM statistic. Future research in ESM should asses the behavior of summary statistics under different sampling situations. This exploration is especially relevant in clinical implementation, where often only small datasets are available. (shrink)

I focus on the religio-aesthetic concept of nature in Japanese Buddhism as a valuable complement to environmental philosophy in the West and develop an explicit comparison of the Japanese Buddhist concept of nature and the ecological world view of Aldo Leopold. I discuss the profound current of ecological thought running through the Kegon, Tendai, Shingon, Zen, Pure Land, and Nichiren Buddhist traditions as weIl as modem Japanese philosophy as represented by Nishida Kitarö and Watsuji Tetsurö. In this context, I (...) present the Japanese concept of nature as an aesthetic continuum of interdependent events based on a field paradigm of reality. I show how the Japanese concept of nature entails an extension of ethics to include the relation between humans and the land. I argue that in both the Japanese Buddhist concept of nature and the thought of Aldo Leopold there is a hierarchy of normative values which grounds the land ethic in aland aesthetic. I also clarify the soteric concept of nature in Japanese Buddhism by which the natural environment becomes the ultimate locus of salvation for all sentient beings. In this way, I argue that the Japanese Buddhist concept of nature represents a fundamental shift from the egocentric to an ecocentric position-i.e., a de-anthropocentric standpoint which is nature-centered as opposed to human-centered. In a Realist ontology relations are subsisting or existing entities distinct from ordinary things. Idealists claim that the notion of relations is subject to a vicious infinite regress. Nominalists claim that relations are particularized instances. In an attempt to search for the roots of a Realist conception of relations and to meet these challenges I investigate Plato's conception of relations in the Phaedo. ;Against the current of a majority of Plato scholars, Castaneda finds evidence for a distinction between (...) relations and properties at Phaedo 102 b-d. I enter the debate on Castaneda's side and find support for his interpretation of the passage in the context of the dialogue as a whole. The relation--quality distinction resolves the paradox of Simmias being both taller than Socrates and shorter than Phaedo at the same time, since Plato possesses relational characteristics of tallness and shortness, which are not contraries unlike the the contrary properties of hot and cold which could not coexist in an individual. Gallop offers the alternative essence--accident distinction which also resolves the paradox since tallness and shortness as accidents may coexist. The latter distinction however Aristotelianizes Plato. I have shown how the essence--accident distinction is incompatible with Plato's theory of Forms, as it leads to such odd conclusions as the admittance of accidental Forms. ;Castaneda claims that Plato reduces relations to Form-chains in which individuals participate in pairs. I offer the alternative of Plato's positing of relational Forms as distinct from monadic Forms. I survey the corpus of Platonic dialogues in search of support for the distinction between relations and properties. I find that in the Statesman there is a distinction between two types of Forms which generates the distinction between monadic Forms and relational Forms. ;I conclude that there is ample evidence in Plato's dialogues and in Aristotle's assessment of Plato to ascribe this distinction to Plato. Plato's explanation of relations in terms of Forms, which have the highest grade of reality for him, sets up the basis for any Realist theory of relations--for reductionist theories reducing relations to relational properties or some other subsisting entities, as well as for the irreducible concept of relations as abstract subsisting entities. We introduce and study a natural extension of Marcus external contextual grammars. This mathematically simple mechanism which generates a proper subclass of simple matrix languages, known to be mildly context-sensitive ones, is still mildly context-sensitive. Furthermore, we get an infinite hierarchy of mildly context-sensitive families of languages. Then we attempt to fill a gap regarding the linguistic relevance of these mechanisms which consists in defining a tree structure on the strings generated by many-dimensional external contextual grammars, and (...) investigate some related issues. The development of artificial intelligence (AI) in medicine raises fundamental ethical issues. As one example, AI systems in the field of mental health successfully detect signs of mental disorders, such as depression, by using data from social media. These AI depression detectors (AIDDs) identify users who are at risk of depression prior to any contact with the healthcare system. The article focuses on the ethical implications of AIDDs regarding affected users’ health-related autonomy. Firstly, it presents the (ethical) discussion of AI (...) in medicine and, specifically, in mental health. Secondly, two models of AIDDs using social media data and different usage scenarios are introduced. Thirdly, the concept of patient autonomy, according to Beauchamp and Childress, is critically discussed. Since this concept does not encompass the specific challenges linked with the digital context of AIDDs in social media sufficiently, the current analysis suggests, finally, an extended concept of health-related digital autonomy. It is proposed to examine the need for redefining self deception in an Indian socio-cultural context and also on the basis of different social roles that one plays in his/her life time. Self-deception can be defined as the process of acting or behaving against one’s true inner feelings to maintain one’s social status. The conceptconsists of two aspects: maintaining a belief and the behavioral expression of it. Most of the time, deception occurs in the latter part, because it helps (...) the deceiver to achieve a moral protection from the society and thereby, to get a mental pacification. In fact, in some situations, self deception helps to raise our self importance in the society. That is to say, if we express our inner truth, that which is unpleasant for the society, then it can lead to humiliation from the society. An individual adopts self deception as a method to evade dejection from the external world. Whenever I act against my inner feelings, it happens consciously or intentionally so I cannot feel both aspects, as a deceiver and the deceived, at the same time. Besides, I do respect the feelings of myself and in this sense one’s own self can never be deceived! Thus, self deception can be explained with relation to the expression of true beliefs in yourself. In “Conceptions of Care,” Tove Pettersen discusses and articulates select ways in which care can be comprehended. Several difficulties related to an altruistic understanding of care are examined before the author presents the case for a more favorable concept: mature care. Mature care is intended to take into account the interests of both parties to the caring relationship. This understanding of care facilitates the expression of the relational and reciprocal aspects of caring while emphasizing the equal worth of all (...) involved. This article discusses three related aspects of know‐how: skill, transversal abilities and project management abilities, which are often not distinguished within either the educational or the philosophical literature. Skill or the ability to perform tasks is distinguished from possession of technique which is a necessary but not sufficient condition for possession of a skill. The exercise of skill, contrary to much opinion, usually involves character aspects of agency. Skills usually have a social dimension and are subject to normative appraisal. Transversal (...) abilities rely on but are not reducible to the exercise of skill, but require a further degree of attention and seriousness in their exercise. Transversal abilities can be displayed in different ways using different skills, depending on context. They include: planning, communicating, evaluating—all important features of successful professional action. Project management or the putting into effect of relatively long‐term sequences of action involves the articulation of different transversal abilities. It is a form of agency which is considered to be important in some European vocational and professional education systems and usually involves a strong social dimension. The chapter concludes with a discussion of the educational implications of these distinctions and of their interrelationships. (shrink)

I critically examine how, from a Western cultural perspective of romantic love and Judeo-Christian tradition, certain liberal cultural values and prejudices are used presumptuously to criticize polygamy in African traditions. These criticisms assume, circularly, the superiority of Western cultural monogamous values over African cultural traditional practice of polygamy. I argue that these arguments are specious and particularly unreasonable from an intercultural philosophical perspective. A plausible liberal justification for Western legal imposition of monogamy is to prevent harm. I argue that if (...) polygamy is so harmful as to warrant legal restriction based on the liberal principle of harm, such harm also exists in monogamy. The harm that is falsely associated with polygamy is not the result of polygamy per se but other factors relating to the social-cultural context of the marriage or the character of the individuals in the marriage. My thesis tackles two related problems that have taken center stage in the recent literature on concepts: • What are the individuation conditions of concepts? Under what conditions is a concept C₁ the same concept as a concept C₂? • What are the possession conditions of concepts? What conditions must be satisfied for a thinker to have a concept C? I will develop a pluralist and contextualist theory of concept individuation and possession: different concepts have different individuation and possession conditions, (...) and contextual factors play a crucial role in determining what concepts we attribute to other subjects when we ascribe propositional attitudes to them. In chapters 1-3, I defend a contextualist, non-Millian theory of propositional attitude ascriptions. Then, I suggest contextualist theories of ascriptions can be applied to the problem of concept individuation/possession. In particular, I use contextualism to provide a new, more effective argument for Fodor’s “publicity principle”, according to which concepts must be shared in order for interpersonally applicable psychological generalizations to be possible. Publicity has important implications: in particular, it is inconsistent with existing versions of holism, on which concepts cannot be shared by ordinary thinkers. Nonetheless, in chapters 4-5 I show how holism can still play an important role in our best theory of concepts. More specifically, I argue that the tradition of appealing to modes of presentation in order to give an account of “Frege cases” is in fact committed to holism. To develop a version of holism that will give a successful account of Frege cases without violating publicity, I suggest we should adopt my pluralist-contextualist picture: on that picture, the concepts involved in a Frege case will be holistically individuated and not public, while other concepts will be more coarsely individuated and widely shared. In chapter 6, I will develop this view further by contrasting it with other pluralist theories and with rival theories of concepts, such as the localist views defended by Peacocke, Rey and Jackson. Luciano Floridi was not the first to discuss the idea of group privacy, but he was perhaps the first to discuss it in relation to the insights derived from big data analytics. He has argued that it is important to investigate the possibility that groups have rights to privacy that are not reducible to the privacy of individuals forming such groups. In this paper, we introduce a distinction between two concepts of group privacy. The first, the “what happens in Vegas (...) stays in Vegas” privacy (in the following: WHVSV privacy), deals with confidential information shared with the member of a group and inaccessible to (all or a specific group of) outsiders. The second, to which we shall refer as inferential privacy, deals with the inferences that can be made about a group of people defined by a feature, or combination thereof, shared by all individuals in the group. We show why we unreservedly agree with Floridi that groups can have a form of privacy that amounts to more than the mere fact of being sets of individuals each of whom has individual privacy; moreover, like Floridi, we find it plausible that at least some groups (those satisfying our definition of type-a groups) may have a right to a species of group privacy (that is, WHVSV privacy) as groups (and not just as individuals who belong to those groups). However, by turning our attention to the context of big data analytics, we show that the relevant, new notion of group privacy is one of inferential privacy. We argue that an absolute right (either of individuals or groups) to inferential privacy is implausible. We also show that many groups generated algorithmically (those satisfying our definition of type-b groups) cannot be right holders as groups (unless they become type-a groups). (shrink)

Conceptions of omissions standardly come in two flavours: omissions are construed either as mere absences of actions or are closely related to paradigmatic ‘positive’ actions. This paper shows how the semantics of the verb ‘to omit’ constitutes strong evidence against the view of omissions as involving actions. Specifically, by drawing from an influential fourfold typology of verbal predicates popularised by Zeno Vendler, I argue that declarative statements involving reference to omissions are semantically stative, which is a finding that makes serious (...) trouble for the conception of omissions as being closely related to paradigmatic actions. But references to omissions, in certain linguistic contexts, undergo a shift of meaning to describe processes or activities engaged in by the agent. Still, despite the semantic flexibility of the verb ‘to omit’, its processive reading does not straightforwardly support the second conception of omissions. A subsidiary aim of this paper is to offer a sketch of the metaphysics of processive action in order to show what those who claim that omissions are closely related to actions might be committed to. Descartes's concept of the mind, as distinct from the body with which it forms a union, set the agenda for much of Western philosophy's subsequent reflection on human nature and thought. This is the first book to give an analysis of Descartes's pivotal concept that deals with all the functions of the mind, cognitive as well as volitional, theoretical as well as practical and moral. Focusing on Descartes's view of the mind as intimately united to and intermingled with the body, (...) and exploring its implications for his philosophy of mind and moral psychology, Lilli Alanen argues that the epistemological and methodological consequences of this view have been largely misconstrued in the modern debate. Informed by both the French tradition of Descartes scholarship and recent Anglo-American research, Alanen's book combines historical-contextual analysis with a philosophical problem-oriented approach. It seeks to relate Descartes's views on mind and intentionality both to contemporary debates and to the problems Descartes confronted in their historical context. By drawing out the historical antecedents and the intellectual evolution of Descartes's thinking about the mind, the book shows how his emphasis on the embodiment of the mind has implications far more complex and interesting than the usual dualist account suggests. Salafism is one of the most important issues of the last few centuries. There are intense discussions on the issues related to Salafism, its emergence, how it was first used by whom and in what sense. Discussions about Salafism are sometimes experienced in relation to whether this concept corresponds to a mentality or to a sect, and sometimes this phenomenon is brought up in relation to a number of important names that have taken place in the history of Islamic thought. (...) Ibn Taymiyya (d. 728/1328) emerges as the most frequently mentioned name in this context. Therefore, in this article, we have examined how Salafism/Salafiyya concept is used in the works of Ibn Taymiyya who is accepted as the theorist and the most powerful representative of Salafism. We have discussed the issue in a comprehensive manner by including the concept of Salaf, which is one of the most used concepts of Ibn Taymiyya. When we consider Ibn Taymiyya's use of the concepts of Salaf and Salafiyya, the concept of Salaf is seen to be used much more than the concept of Salafiyya. Thus, the concept of Salaf in the thought of Ibn Taymiyya refers to the Islamic society that lived in the early centuries and the conception of religion revealed by this society. The concept of Salafiyya, however, appears to have been used in a way that reflects a mentality and a way of thinking rather than a particular school or sect.Summary: Sects are human made structures that emerged with the institutionalization of differentiations in the conception of religion. The production of systematic theology and fiqh, the formation of its own literature, its dissemination and dissociation from other systems of thought are the most important turning points for the emergence of sects. One of the most important variables that determine the formation process of sects is the mentality of sect. It is known that the sects come into the realm of existence when the mindsets with the implicit reference system become visible. Therefore, there is a mentality on which every sect is based, but not every mentality has come to the point of being a sect. While some mentalities have influenced different sects in different shades, some of them have been confronted with only one sect.In fact, Salafism is one of the ways of thinking which is a mindset and it is a subject of important debates about whether it is a sect. Although the use of salafiyya is seen in the literature in the past, the fact that Salafism felt its existence as a kind of religion or mentality was realized in the 18th and 19th centuries. It is also known that the discussions about the definition of Salafism have started since these periods. From the second half of the 20th century, Salafism began to take a place in the agenda of both the Islamic world and the West. This has naturally led to efforts to define Salafism. Thus, Salafism is subjected to attempts to identify and associate with structures, such as denomination, ideology, religious understanding and mentality. In this direction, it is seen that Salafism is tried to be defined by establishing close link with the structures, such as Ahl al-Sunnah, Ahl-i Hadith, Hanbalism and Wahhabism or by reducing them directly to one of these structures. Thus, Salafism is sometimes backed up to the early stages of Islamic thought and sometimes associated with multilayered structures, such as the Ahl al-Sunnah, which embodies many political-mythic and fiqh structures.In line with the efforts of defining Salafism, it is also seen that many names that have had a say in classical Islamic thought or have been mentioned in modern times have been brought to the agenda. In addition to the names, such as Ahmad ibn Hanbal, Ibn Taymiyya, Ibn Qayyim al-Jawziyya, the names of Emir al-Saneyani, Muhammad ibn Abd al-Wahhab, Muhammad al-Shawkani, Shaykh Abdulaziz ibn Baz and Muhammad Nasir al-din al-Albani are frequently mentioned in this process. It should be noted that there is a special place of Ibn Taymiyya among these names. Ibn Taymiyya took the place of both in history of Islamic thought and Ahl al-Hadith-Hanbalite tradition and made a name for himself in the context of many subjects. It is claimed that Ibn Taymiyya, who was the theorist of the Hanbalite conception of religion, and the missionary of the New Hanbalism, was also the founding figure and the most important representative of Salafism. In modern times, most of those who declare ideas about Salafism place Ibn Taymiyya at the center of Salafism and present him as the founding name of this mentality. However, the question of what kind of relationship between the mentality called Salafism and Ibn Taymiyya's world of thought and religion is not the subject of academic studies. However, the works of Ibn Taymiyya, who is an author of a very velocity, should be analyzed from this point of view and all kinds of words about Ibn Taymiyya-Salafism relationship should be left behind this effort. Our study, which aims to fulfill this gap, was designed to explain topics, such as whether the concept of salafiyya was used in the works of Ibn Taymiyya, whether and how the past was used, and the extent to which the meaning attributed to the salafiyya coincided with the current Salafism. Understanding of the concept of the salafiyya in the works of Ibn Taymiyya depends on the explanation of how the term salaf was derived and used by Ibn Taymiyya. When the works of Ibn Taymiyya are scanned, it is seen that he used the word salaf much more than the word salafiyya. In fact, the word of salafiyya, which Ibn Taymiyya has rarely included, has been placed in some places in a way that refers to the meaning field of the word salaf. When we consider the use of the word salaf in the works of Ibn Taymiyya, we first see the generations who lived in the early historical periods of Islamic thought and the conception of religion which these generations have revealed. Other names that have taken place in the history of Islamic thought have similar opinions about the generation of the predecessors and the religious understanding of this generation. In other words, according to the general opinion of the predecessor, especially the first three centuries came to mind. However, it is seen that Ibn Taymiyya made some attempts to periodize both the generation of the predecessors and to define the understanding of religion of this generation. Nevertheless, Ibn Taymiyya could not provide a clear picture on this issue, and he occasionally contradicted his findings regarding his involvement in the predecessor generation. Nevertheless, he generally adopted generalizations and an attitude to limit the meaning of the predecessor to the first generations. The word salafiyya, which Ibn Taymiyya placed on the meaning of the word salaf, is used less compared to the word salaf and is given in more complete terms. This indicates that the main factor that influenced Ibn Taymiyya's salafi thought was salaf, not salafiyya as a systematic structure. These findings make it necessary to reconsider the claims of Salafism being a sect and it is being represented at the time of Ibn Taymiyya. (shrink)

The conception of saviour siblings using preimplantation genetic diagnosis coupled with human leukocyte antigen typing or HLA typing alone is controversial and receives a wide divergence of legal responses among countries around the world. The resulting child conceived through this procedure is dubbed a ‘saviour sibling’ as the child can potentially act as a compatible donor for an elder ailing sibling who needs a haematopoietic stem cell transplantation. At present, the acceptability of this procedure in Malaysia is ambiguous as (...) there is no specific statute governing assisted reproductive technology, and the guideline issued by the Malaysian Medical Council does not expressly address this issue. The ethical arguments relating to the conception of saviour siblings in the current literature are mainly thought to reflect a liberal viewpoint which is predominantly Western in nature. This paper seeks to explore the perception of selected key stakeholders on the acceptability of and ethical concerns related to this procedure in the Malaysian context. The findings indicate that stakeholders generally support the conception of saviour siblings and some of their concerns echo the Western viewpoint. Interestingly, many were highly anxious about its economic implication, which is rarely discussed in the current literature on saviour siblings. (shrink)

Based on ethnographic evidence collected over the last two decades in Gunayala Comarca (autonomous territory), Panama, this article explores understandings of human consciousness from the perspective of the Guna people. After a brief account of the linguistic, historical, and political context, it continues with a presentation of the notions of burba, niga, and gurgin, which are used to refer to notions of soul, spirit, and consciousness. After translating these words and describing their particularities, I show the extent to which (...) these notions, with roots in knowledge passed down from generation to generation, or revealed through dreams or visions, make it possible to understand the conception of the human being in relation with other non-human beings. Finally, the article seeks to open up a discussion with works produced over the last few decades by philosophers, psychologists, and neurologists, and to respond from the Guna standpoint to some of the questions that have recently been raised in these fields. In his recent article, ``Self-Consciousness'’, George Bealer has set outa novel and interesting argument against functionalism in the philosophyof mind. I shall attempt to show, however, that Bealer's argument cannotbe sustained.In arguing for this conclusion, I shall be defending three main theses.The first is connected with the problem of defining theoreticalpredicates that occur in theories where the following two features arepresent: first, the theoretical predicate in question occurswithin both extensional and non-extensional contexts; secondly, thetheory in question asserts that the relevant (...) theoretical states enterinto causal relations. What I shall argue is that a Ramsey-styleapproach to the definition of such theoretical terms requires twodistinct quantifiers: one which ranges over concepts, and theother which ranges over properties in the world.My second thesis is a corollary: since the theories on whichBealer is focusing have both of the features just mentioned, and sincethe method that he employs to define theoretical terms in his argumentagainst functionalism does not involve both quantifiers that range overproperties and quantifiers that range over concepts, that method isunsound.My final thesis is that when a sound method is used, Bealer's argumentagainst functionalism no longer goes through.The structure of my discussion is as follows. I begin by setting out twoarguments – the one, a condensed version of Bealer's argument, andthe other, an argument that parallels Bealer's argument very closely.The parallel argument leads to a conclusion, however, that, rather thanbeing merely somewhat surprising, seems very implausible indeed. Forwhat the second argument establishes, if sound, is that there can betheoretical terms that apply to objects by virtue of their first-orderphysical properties, but whose meaning cannot be defined via aRamsey-style approach.Having set out the two parallel arguments, I then go on to focus uponthe second, to determine what is wrong with it. My diagnosis will bethat the problem with the argument arises from the fact that it involvesdefining a theoretical term that occurs both inside and outside ofopaque contexts, for the method employed fails to take into account thefact that the types of entities that are involved in the relevanttruthmakers are different when a sentence occurs within an extensionalcontext from those involved when a sentence occurs within anon-extensional context.I then go on to discuss how one should define a theoretical term thatoccurs within such theories, and I argue that in such a case one needstwo quantifiers, ranging over different types of entities – on theone hand, over properties and relations, and the other, over concepts. Ithen show that, when such an approach is followed, the argument inquestion collapses.I then turn to Bealer's argument against functionalism, and I show,first, that precisely the same method of defining theoretical terms canbe applied there, and, secondly, that, when this is done, it turns outthat that argument is also unsound.Next, I consider two responses that Bealer might make to my argument,and I argue that those responses would not succeed.Finally, I conclude by asking exactly where the problem lies in the caseof Bealer's argument. My answer will be that it is not simply the factthat one is dealing with a theoretical term that occurs in bothextensional and non-extensional contexts. It is rather the combinationof that feature together with the fact that the theory in questionasserts that the relevant type of theoretical state enters into causalrelations. For the first of these features means that the Ramseysentence for the theory must involve quantification over concepts, whilethe presence of the second feature means that the Ramsey sentence mustinvolve quantification over properties in the world, and so no attemptto offer a Ramsey-style account of the meaning of the relevanttheoretical term can succeed unless one employs both quantification overconcepts and quantification over properties. Bealer, however, in hisargument against functionalism, uses a method of defining theoreticalterms that does not involve both types of quantification, and it isprecisely because of this that his argument does not in the end succeed. Phenomenographic research about teachers’ conception of teaching has consistently revealed that teachers’ conception of teaching influence their classroom practices, which in turn shape students’ learning experiences. This paper reports teachers’ conceptions of teaching with regards to the use of interactive spherical video-based virtual reality in Chinese descriptive composition writing. Twenty-one secondary teachers in Hong Kong involved in an ISV-VR-supported Chinese descriptive writing program participated in this phenomenographic study. Analyses of the semi-structured interviews establish seven conception categories that (...) are specifically related to the use of ISV-VR for descriptive Chinese composition writing: offering students more observational opportunities; improving students’ writing skills; promoting students’ learning participation and motivation; shifting learning from teacher-centric to student-centric, enhancing collaborative learning among students; cultivating students’ positive values and moral character, and shaping students’ self-identity as “writers.” The concurrent and convenient access to the ISV-VR resources was for the teachers an enriched and supportive environment for them to cultivate students’ writer identity. In addition, it was discovered that the structural relationships of the conceptions may be better organized along three axes of continuum: conception’s orientation, teaching attention locus, and understanding of writing. These categories form a hierarchy from skill-oriented to community-oriented, and finally to identity-oriented conception. The findings may provide researchers and practitioners with novel insight into the teaching of composition writing in the contexts of L1 acquisition supported by virtual reality technology. (shrink)

The article considers the modern meaning of Kant’s doctrine of war. The author examines the context and content of the key provisions of Kant’s concept of perpetual peace. The author also reviews the ideological affinity between Kant and previous authors who proposed to build alliances of states as a means of preventing wars. It is noted that the French revolution and the wars caused by it, the peace treaty between France and Prussia served as the historical background for the (...) conceptualization of Kant’s project. In the second half of the 20th century, there is a growing attention to Kant’s ethical and political philosophy. Theorists of a wide variety of political and ethical schools, pay attention to Kant’s legacy and relate their own concepts to it. Kant’s idea of war is reconsidered by Michael Doyle, Jürgen Habermas, Ulrich Beck, Mary Kaldor, Brian Orend. Thus, Doyle tracks democratic peace theory back to Kant’s idea of the spread of republicanism. According to democratic peace theory, liberal democracies do not solve conflict among themselves by non-military methods. Habermas, Beck, Kaldor appreciate Kant as a key proponent of cosmopolitanism. For them, Kant’s project is important due to notion of supranational forms of cooperation. They share an understanding that peace will be promoted by an allied authority, which will be “governing without government” and will take responsibility for the functioning of the principles of pacification of international relations. Orend’s proves that Kant should be considered as a proponent of the just war theory. In addition, Orend develops a new area in just war theory – the concept of ius post bellum – and justifies regime change as the goal of just war. (shrink)

The article analyzes the concept of universality in Oleg Drobnitskii’s ethics. As opposed to most Soviet ethicists of the 1960s and early 1970s, Drobnitskii viewed this concept along the lines of the principle of universality presented in the moral theories of Immanuel Kant and Richard Hare. However, while they considered universality to be a feature of individual moral thinking in the forms of maxims, principles, and evaluations, Drobnitskii understood universality as the main feature of moral requirements and essentially external to (...) the moral agent, representing to her social relations and the ‘general laws of history.’ It was conceptually significant in Drobnitskii’s approach to universality that he analyzed it within the context of a more general concept of morality—as a mode of normative regulation of behavior. In this capacity, universality was presented as a characteristic of general appeal, or the general way in which a moral requirement is binding. The principle of equality is a normative correlate of universality understood in this way. Universality also characterizes judgments, whose moral adequacy is verified through the procedure of universalization. Regarding universality, Drobnitskii discussed important questions of the individualization of the universal moral requirement in the form of the moral agent’s personal task and the universality of class moral views. He tried to explain these differing, and not always interconnected, aspects of universality by appealing to certain ‘general laws of history,’ and thus offered a historicist basis of morality. This article shows that, despite this unprecedented analysis of the issue of universality, Drobnitskii did not achieve a systematic conclusion in his conceptualization of universality. Nevertheless, he was able to offer a number of significant insights, with the potential to aid our further comprehension of the phenomenon of universality and how it ought to be understood. (shrink)

The purpose of this study is to reveal the function of the concept of Infāq, which is included in the terminology of the Qurʾān itself, in social assistance and solidarity. Poverty has always been one of the social problems from past to present. Although it is analyzed differently in each society via different criteria, poverty generally refers to the condition in which a person lacks the basic necessities for a minimum living standard. Unfortunately, millions of people starve for basic biological (...) and social needs such as nutrition, shelter, education, health, and even water. This is a shame for the humanity. There are both international and national charities working to reduce the misery and poverty. However, due to socio-economic and structural problems such as globalization, disproportion in income distribution, unemployment, overpopulation, economic crises, lack of social security systems, and wars, poverty rises gradually and it is still one of the major social problems needed to be solved. Islam which is the last one of Abrahamic religions and its holy book Qurʾān consider social cooperation and solidarity pretty important within the context of Infāq and hold the believers responsible for the organization of social life. Infāq is an umbrella concept in the Qurʾān, referring to all expenses and cooperation in the name of Allah and it is one of the main qualities of believers. Infāq, which includes other forms of cooperation such as obligatoryalms (zakāt) and charity (ṣadaqā), enables a person to share his tangible values with those who have worse life conditions than himself. In this way, the Quran aims to promote human relations and thereby enhancement and peace in the society. In other words, Infāq aims to eliminate social injustice which refers to social and economic inequalities, to protect the economically weak people against the difficulties in life, and thereby, to maintain economic and social stability. Helping the needy is a powerful path toward having spiritual peace, removing selfish feelings, and keeping emotional wellbeing. People with good mental health will be able to build more humane relationships with others. It is obvious that Infāq would play an important role inbuilding a sense of fellowship and trust. A wealth of person who shares his wealth with the poor will be deemed legitimate by the needy people. Thus, the needy people would be freed from negative feelings and behaviors such as jealousy, incapacity, hatred, bullying, and hostility, and feel a sense of fellowship and gratitude towards those who have better life conditions. One of the most important reasons for robbery, extortion, purse-snatching, and etc., which are currently occurring more frequently, is economic deprivation. Considering the fact that this kind of incidents takes place more frequently in poor countries than developed ones, it is obvious that Infāq has a strategic role in fulfilling the basic needs of the needy. Poverty might be linked to violence, which might end up with murder. Infāq which is divine cooperation approach would take an important role in fighting against criminal incidents that cause fear and indignation. Moreover, the Quran does not specify any certain economic condition to be able to do Infāq, and thereby, it makes people with various economic abilities become a part of the social cooperation. As everyone would take care of people who are relatively worse off, interindividual trust will be strengthen and circle of cooperation will be expanded. According to the Qurʾān, people’s all goods and possessions actually belong to Allah. People are just the trustees of this wealth. Allah grants as much wealth as He wills to whomever He wills. While the rich is responsible for sharing their wealth with the needy, the poor is responsible for bearing the troubles caused by poverty with patience and endeavoring to make money in a halal way. Unless Infāq is done in order to please Allah, it does not have any significance in the presence of Allah. The reason why people have different material living conditions is that both the poor and the rich are subject to test. Thus, they would get rewards for hereafter besides the sustaining of social unity and solidarity. Allah is the only warrantor of the tangible and spiritual wealth gained in return for Infāq. The utilitarian conception, which I call “action as production,” holds that action is a way of making use of the world, conceived as a causal mechanism. According to the rational intuitionist conception, which I call “action as assertion,” action is a way of acknowledging the value in the world, conceived as a realm of status. On the Kantian constructivist conception, which I call “action as participation,” action is a way of making the world, qua causal mechanism, come (...) to count as a realm of status. In 2005, The International Federation of Organic Agricultural Movements (IFOAM) developed four new ethical principles of organic agriculture to guide its future development: the principles of health, ecology, care, and fairness. The key distinctive concept of animal welfare in organic agriculture combines naturalness and human care, and can be linked meaningfully with these principles. In practice, a number of challenges are connected with making organic livestock systems work. These challenges are particularly dominant in immature agro-ecological systems, for example those that (...) are characterized by industrialization and monoculture. Some of the current challenges are partly created by shortages of land and manure, which encourage zero-grazing and other confined systems. Other challenges are created in part by the conditions for farming and the way in which global food distribution systems are organized, e.g., how live animals are transported, how feed is traded and transported all over the globe, and the development of infrastructure and large herds. We find that the overall organic principles should be included when formulating guidelines for practical organic animal farming. This article explores how the special organic conceptions of animal welfare are related to the overall principles of organic agriculture. The aim is to identify potential routes for future development of organic livestock systems in different contexts and with reference to the specific understanding of animal welfare in organic agriculture. We include two contrasting cases represented by organic livestock systems in northwestern Europe and farming systems in tropical low-income countries; we use these cases to explore the widely different challenges of organic livestock systems in different parts of the world. This article is constructed through a series of linked aphorisms that articulate the relations between autonomy, sense, the world, different people’s worlds, disagreement, and wonder. It advances anthroponomy—the organization of humankind to support autonomous life. In the context of the planetary, sociallycaused environmental changes of today such as global warming or the risk of a mass extinction cascade, a part of autonomous engagement with our planetary situation is developing an autonomous conception of it—a conception of our situation (...) that makes sense to us. This pluralistic idea has consequences for environmentalism, notably around coloniality, and the reduction of different autonomous worlds to a dominant world, which is currently part of the discourse of the Anthropocene. The aphorisms in this article develop a reflective path toward autonomous conceptions of our planetary situation given the reality of coloniality in how that situation is understood. One result of this path is to open up a way for people to become more autonomously engaged with our environmental situation, an engagement grounded in wonder and critical of the discourse of the “Anthropocene”. Given its centrality to the intellectual thought processes through which the great structures of logic, nature, and spirit are unfolded it is clear that mediation is vital to the very possibility of Hegel’s encyclopaedic philosophy. Yet Hegel gives little specific explanation of the concept of mediation. Surprisingly, it has been the subject of even less attention by scholars of Hegel. Nevertheless it is casually used in discussions of Hegel and post- Hegelian philosophy as though its meaning were simple and straightforward. (...) In these discussions mediation is the thesis that meanings are not atomic in that the independence of something is inseparable from its relation to something else. Hence being is mediated by nothing, the particular by the universal, the individual by society. But does Hegel ever explain mediation in a way which justifies such use of the concept? The same easy employment of mediation is found in Theodor Adorno whose works are replete with the use of this concept and, indeed, acknowledgements of its Hegelian origin. But the concept of mediation in Adorno’s negative dialectic is operative in an entirely different context from that of Hegel. How, it might be asked, can a concept be so adaptable? I want to argue that mediation is, in fact, an equivocal term which in both Hegel and Adorno covers a variety of entirely different conceptual relations. Furthermore, as propounded by both Hegel and Adorno it lacks the rigour which could allow the particular conclusions which the concept allegedly facilitates. (shrink)

Four concepts of politics follow from an attempt to view the established order, its structural workings: actions and inactions, as more or less authentic politics by starting from Slavoj Žižek’s theory of authentic Political Act. In short Žižek’s theory is viewed from a slightly different angle in an attempt to approach more general theory of politics. When analysing political antagonisms, Žižek has suggested looking for the third term. Viewing an antagonism from both of its viewpoints suggest, however, that instead of (...) one position more, two conceptual positions more may be formulated. These two positions are proposed to be viewed as acts of both corresponding sides. What is called ‘Politics of revolution’ in the proposed schema suggests ‘prefer not to politics’ and what is called ‘Politics of maintenance’ suggests ‘prefer to politics’. Furthermore, a proposal to conceptually divide the politics of the established order in two is made in order to clarify the relation of found objects to their origins. Thus two respective conservatisms are identified: conservatism of ‘relics old particular all’ and conservatism of ‘relics of objects which might have saved the world’. In this context any re-Acts of these relics would fit the category of ‘Politics of maintenance’ and repressing these relics would fit the category of active maintenance through ‘prefer to politics’. Another conclusion is that in analysing the political antagonism of two, one could look for, not only for the third but for the fourth term as well. (shrink)

Life saving or life sustaining treatment may not be instigated in the clinical setting when such treatment is deemed to be futile and therefore not in the patient’s best interests. The concept of futility, however, is related to many assumptions about quality and quantity of life, and may be relied upon in a manner that is ethically unjustifiable. It is argued that the concept of futility will remain of limited practical use in making decisions based on the best interests principle (...) because it places such high demands on the individual responsible for decision making. This article provides a critical analysis of futility (in the context of the best interests decision-making principle), and proposes an ethically defensible notion of futility. (shrink)

This paper examines attempts to find a conception of justice in early Confucian contexts, focusing on the concept of yi (translated as ?appropriateness?, ?right?, ?rightness?, even ?justice?) in the Mencius. It argues against the approach of deriving principles of dividing burdens and benefits from the discussions of concrete cases employing the concept of yi and instead shows that Confucian ethical concerns are more attentive to what kinds of interpersonal relations are appropriate in specific circumstances. It questions the exclusive emphasis (...) in justice-centred ethical discourse on assessing actions, and even more narrowly actions of governments and other public institutions, and their consequences regarding distribution of rights and material resources and goods. Instead of applying some abstract principles of justice, whether of equality or some other priorities according to individual characteristics, distributive problems are approached from the perspective of the effect of any proposed distribution on interpersonal relationships. Principles of justice treat opportunities, resources, and goods that are supposed to be distributed as possessions or potential possessions of individuals always competing for resources and goods. Confucians treat them not as objects to be possessed by one and denied to others, but as facilitators of personal cultivation effecting appropriate interpersonal relationships constituting harmonious communities. The Mencius offers a different perspective on distributive problems by shifting our ethical attention from ?who gets what?? to ?how should we relate to others?? within a different conception of the good life and the ideal society or polity. P3 is the most prominent of the electrical potentials of the human electroencephalogram that are sensitive to psychological variables. According to the most influential current hypothesis about its psychological significance [E. Donchin's], the “context updating” hypothesis, P3 reflects the updating of working memory. This hypothesis cannot account for relevant portions of the available evidence and it entails some basic contradictions. A more general formulation of this hypothesis is that P3 reflects the updating of expectancies. This version implies that P3-evoking (...) stimuli are initially unexpected but later become expected. This contradiction cannot be resolved within this formulation. The alternative “context closure” hypothesis retains the concept of “strategic information processing” emphasized by the context updating hypothesis. P3s are evoked by events that are awaited when subjects deal with repetitive, highly structured tasks; P3s arise from subjects' combining successive stimuli into larger units. The tasks in which P3s are elicited can accordingly be classified in terms of their respective formal sequences of stimuli. P3 may be a physiological indicator of excess activation being released from perceptual control areas. (shrink)
