Berkeley's essay on vision was published in the spring of 1709. It was recognised at once as a book of considerable importance, and there was a second edition within the first year. The author was still only 24. His design, he wrote, was to show the ‘manner we perceive by sight the distance, magnitude and situation of objects’. Hitherto, writers on optics had ‘proceeded on wrong principles’.

Having refuted the phlogiston theory, Lavoisier uses this second portion of his essay to expound his new theory of combustion, based on the oxygen principle. He gives a mechanistic account of thermodynamic phenomena in terms of a subtle fluid and its ability to penetrate porous bodies. He uses this hypothetical fluid to explain volume changes, heat capacity and latent heat. Here we consider two ways that nanomedicine might be disruptive. First, low-end disruptions that are intrinsically unpredictable but limited in scope, and second, high end disruptions that involve broader societal issues but can be anticipated, allowing opportunity for ethical reflection.

A major oversight in Catholicism’s clergy abuse crisis is its failure to examine how assumptions about children and norms concerning adult-children interactions contributed to child sexual abuse and bishops’ systematic cover-up. An adequate response must include new practices based on a revised child-centered account of what constitutes justice for children. In this paper, I develop an account of justice drawing on four sources: 1) Margaret Farley’s account of justice; 2) research findings from my ethnographic study observing and interviewing Catholic (...) class='Hi'>second graders about receiving the Sacrament of Reconciliation; 3) the interdisciplinary field of childhood studies; and 4) the Catholic tradition. Relatively little is known about those who consistently produce the valid response to Modus Tollens (MT) problems. In two studies, people who responded correctly to MT problems indicated how “convinced” they were by proofs of conditional reasoning conclusions. The first experiment showed that MT competent reasoners found accurate proofs of MT reasoning more convincing than similar “proofs” of invalid reasoning. Similarly, there was a tendency for MT competent reasoners to find an initial counterfactual supposition more convincing than did people who (...) were less competent in MT. The second experiment showed that when individuals produced the correct MT response, and found correct MT proofs to be more convincing than “bogus” proofs, they were also less likely to find the conclusions to Denying the Antecedent, or Affirming the Consequent problems valid, compared to individuals who could not discriminate between valid and bogus MT proofs. These findings are discussed in terms of both their implications for the mental logic and mental models positions, and individual differences in System 1 and System 2 reasoning. (shrink)

There is a well-established relationship between isolation and both morbidity and mortality in the context of addiction recovery, yet the protective effects of intimate and familial relationships have not been adequately assessed. The current paper uses the European Life In Recovery database to assess the association between relationship status and living with dependent children on recovery capital of people in recovery from drug addiction, operationalised by the Strengths And Barriers Recovery Scale. The study participants were drawn from the REC-PATH study (...) and supplemented by a second sample recruited by the Recovered Users Network across various European countries, resulting in a combined sample of 1,313 individuals completing the survey, primarily online. The results show that, in recovery, those who are married or co-habiting reported significantly greater recovery strengths and fewer barriers to recovery, and reported greater gains in recovery capital across their recovery journeys. Similar associations are found for participants who have dependent children living with them. There is also some indication that this association is stronger for female than for male participants. Finally, having more people that one can rely on and a greater proportion of people in recovery in the social network are both linked to greater recovery capital and greater self-reported growth in recovery capital. We conclude that this study provides further evidence in favour of a “social cure” in recovery, in which close familial ties are associated with stronger recovery resources. (shrink)

The Fallibility Norm—the claim that we ought to take our fallibility into account when managing our beliefs—appears to conflict with several other compelling epistemic norms. To shed light on these apparent conflicts, I distinguish two kinds of norms: norms of perfection and norms of compensation. Roughly, norms of perfection tell us how agents ought to behave if they’re to be perfect; norms of compensation tell us how imperfect agents ought to behave in order to compensate for their imperfections. I argue (...) that the Fallibility Norm is a norm of compensation, and that thinking of it like this helps us make progress in debates surrounding disagreement, higher-order evidence, and coherence. Lipsey and Lancaster's "general theory of second best" is widely thought to have significant implications for applied theorizing about the institutions and policies that most effectively implement abstract normative principles. It is also widely thought to have little significance for theorizing about which abstract normative principles we ought to implement. Contrary to this conventional wisdom, I show how the second-best theorem can be extended to myriad domains beyond applied normative theorizing, and in particular to more abstract (...) theorizing about the normative principles we should aim to implement. I start by separating the mathematical model used to prove the second-best theorem from its familiar economic interpretation. I then develop an alternative normative-theoretic interpretation of the model, which yields a novel second best theorem for idealistic normative theory. My method for developing this interpretation provides a template for developing additional interpretations that can extend the reach of the second-best theorem beyond normative theoretical domains. I also show how, within any domain, the implications of the second-best theorem are more specific than is typically thought. I conclude with some brief remarks on the value of mathematical models for conceptual exploration. (shrink)

While there need be no conflict in theory between addressing global inequality (inequalities between people worldwide) and addressing domestic inequality (inequalities between people within a political community), there may be instances in which the feasible mechanism for reducing global inequality risks aggravating domestic inequality. The burgeoning literature on global justice has tended to overlook this type of scenario, and theorists espousing global egalitarianism have consequently not engaged with cases that are important for evaluating and clarifying the content of their theories. The functional pragmatism advocated by Nicholas Rescher derives from the conviction that we have no strict evidence for the existence of extramental reality and therefore must postulate it in order to make any sense of truth, communication, and scientific projects. This essay challenges Rescher’s starting point by arguing that the reason extramental reality cannot be argued to is because it is immediately evident. Taking up the controversial issue of the value of the laws of non-ideal cities in Plato’s Statesman, the paper argues for a modified version of the traditional interpretation, as defended against Christopher Rowe’s influential criticism. The paper agrees with the traditional view that the established laws of non-ideal cities are assumed to be good laws and that the Eleatic Stranger’s justification for this assumption can be found in 300b. But it also argues that this defence of the traditional interpretation must (...) be based on a revised understanding of the role of legislation in the Stranger’s conception of ideal rule. The unique contribution of the expert to good government consists in his distinctive ability to judge what is appropriate in each case, not in his work as legislator, which, on closer inspection, turns out to be based on the very same ancestral traditions that the second best city must resort to. In this article I shall undertake a preliminary exploration of the notion of second best. I shall follow a three-step strategy. First, I shall introduce some applications of the theorem of the second best in different fields of philosophy and social sciences. Secondly, I shall make several conceptual distinctions related to the theorem. I aim to show that there are certain theoretical results that are similar but not identical to the theorem of the second (...) class='Hi'>best, and that the notion of second best is often used quite loosely. Finally, I shall try to shed some light on the question of how the theorem is description-sensitive. AT PHAEDO 96A-C Plato portrays Socrates as describing his past study of "the kind of wisdom known as περὶ φυσέως ἱστορία." At 96c-97b, Socrates says that this study led him to realize that he had an inadequate understanding of certain basic concepts which it involved. In consequence, he says at 97b, he abandoned this method and turned to a method of his own. But at this point in the dialogue, instead of proceeding immediately to describe his method, Plato has him (...) interjecting a complaint concerning Anaxagoras and his view that everything should be explained in terms of Mind. His complaint is that Mind would order things in the best possible way and that, therefore, an account of things in terms of Mind would amount to showing that they are ordered in the best possible way. But Anaxagoras did not show this and, instead, offered other kinds of explanations of the various phenomena. Socrates is not just criticizing Anaxagoras here for not doing what he set out to do; he makes it clear, for example at 99b-c, that he believes that the best kind of explanation of the phenomena would be to show that they are ordered in the best possible way. But he was unable to discover an explanation of this kind, either for himself or from others, and so turned to a method which he calls "second best". The actual description of this method is contained in two passages, 99e5-100a7 and 101d5-e1. Between these passages, Socrates invokes the doctrine of Forms and, in particular, the formula. (shrink)

Numerous philosophers allege that the "general theory of second best" (Lipsey and Lancaster, 1956) poses a challenge to the Target View, which asserts that real world reform efforts should aim to establish arrangements that satisfy the constitutive features of ideal just states of affairs. I demonstrate two claims that are relevant in this context. First, I show that the theory of second best fails to present a compelling challenge to the Target View in general. Background Doctors sometimes encounter parents who object to prescribed treatment for their children, and request suboptimal substitutes be administered instead. Previous studies have focused on parental refusal of treatment and when this should be permitted, but the ethics of requests for suboptimal treatment has not been explored. Methods The paper consists of two parts: an empirical analysis and an ethical analysis. We performed an online survey with a sample of the general public to assess respondents’ thresholds for acceptable harm and (...) expense resulting from parental choice, and the role that religion played in their judgement. We also identified and applied existing ethical frameworks to the case described in the survey to compare theoretical and empirical results. Results Two hundred and forty-two Mechanical Turk workers took our survey and there were 178 valid responses. Respondents’ agreement to provide treatment decreased as the risk or cost of the requested substitute increased. More than 50% of participants were prepared to provide treatment that would involve a small absolute increased risk of death for the child and a cost increase of US$<500, respectively. Religiously motivated requests were significantly more likely to be allowed. Existing ethical frameworks largely yielded ambiguous results for the case. There were clear inconsistencies between the theoretical and empirical results. Conclusion Drawing on both survey results and ethical analysis, we propose a potential model and thresholds for deciding about the permissibility of suboptimal treatment requests. (shrink)

What is the relevance of ideals for determining virtuous argumentative practices? According to Bailin and Battersby (2016), the telos of argumentation is to improve our cognitive systems, and adversariality plays no role in ideally virtuous argumentation. Stevens and Cohen (2019) grant that ideal argumentation is collaborative, but stress that imperfect agents like us should not aim at approximating the ideal of argumentation. Accordingly, it can be virtuous, for imperfect arguers like us, to act as adversaries. Many questions are left unanswered (...) by both camps. First, how do we conceptualize an ideal and its approximation? Second, how can we determine what is the ideal of argumentation? Third, can we extend Stevens and Cohen’s anti-approximation argument beyond virtue theory? In order to respond to these questions, this paper develops a second-best perspective on ideal argumentation. The Theory of the Second Best is a formal contribution to the field of utility (or welfare) optimization. Its main conclusion is that, in non-ideal circumstances, approximating ideals might be suboptimal. (shrink)

Individuals who become ill as a result of personal lifestyle choices often shift the monetary costs of their healthcare needs to the taxpaying public or to fellow members of a private insurance pool. Some argue that policies permitting such cost shifting are unfair. Arguments for this view may seem to draw support from luck egalitarian accounts of distributive justice. This essay argues that the luck egalitarian framework provides no such support. To allocate healthcare costs on the basis of personal responsibility (...) would arbitrarily and publicly burden socially detectable risk-takers while undetectable risk-takers continue to get a free ride. That problem is unavoidable even on the assumption that distributive institutions outside the healthcare sector are fully just. In actual, farfrom-just societies, imposing personal liability for the costs of voluntary risk taking would be wrong for an additional reason. Doing so would tend to magnify existing distributive injustices. These conclusions draw attention to two common ‘moral fallacies of the second best’ that can arise when applying ideal normative theory to matters of institutional design and in real-world policy contexts. Plato presents a hierarchy of five cities, each representing a structural arrangement of the soul. The timocratic soul, characterized by its governance by spirit and its consequent desire for esteem and aversion to shame, is ranked as the second-best kind of soul, though this should strike us as surprising since the timocratic figure would seem to be duplicitous, intellectually passive, and at the mercy of the fortuitous opinions of others. This timocrat's position thus raises problems concerning the intrinsic (...) value of the spirited part of the soul, problems that are best solved by comparing the auxiliary to the timocrat, both of whom represent different forms of second-best morality. A lengthy discussion of the early education's effect on the spirited part shows how the auxiliary represents the best kind of moral agent that the second-best nature (silver-souled individuals) can develop into. This is because the early education ensures that the auxiliary and the philosopher share the same basic structure of soul, with reason being in control of each, though the auxiliary's natural deficiencies create some limitations in terms of his or her moral self-sufficiency. The timocrat by contrast represents the second-best kind of moral agent that the best nature (gold-souled individuals) can develop into. The timocrat is morally inferior to the auxiliary and seems to embody Homeric shame-culture. Plato is critical of this approach to morality, but the timocrat justifiably occupies the second position in the hierarchy on account of his or her concern for the opinions of others. Xavier Landes | : In this article, consensus, defined as the consent of all citizens, is argued to be the first best for part of the liberal tradition on political legitimacy. Consensus would be the foundation of the liberal society that, when out of reach, needs to be approximated through, for instance, voting. I build on the timid attempts in political theory at using the theorem of the second best as a tool to settle difficult decision making (...) in applied political theory. More precisely, I defend the view that consensus would be the first best for part of the liberal tradition on political legitimacy. Furthermore, I illustrate how moral, factual, disagreements may create second-best problems, especially in terms of stability. Finally, I spell out some reasons why such problems directly affect a liberal order, on pragmatic grounds. The final purpose is to contribute to the literatures on legitimacy and on the application of the theorem of the second best outside economics. The best-interests standard is a widely used ethical, legal, and social basis for policy and decision-making involving children and other incompetent persons. It is under attack, however, as self-defeating, individualistic, unknowable, vague, dangerous, and open to abuse. The author defends this standard by identifying its employment, first, as a threshold for intervention and judgment (as in child abuse and neglect rulings), second, as an ideal to establish policies or prima facie duties, and, third, as a standard of reasonableness. According to the model of _Inference to the Best Explanation_, we work out what to infer from the evidence by thinking about what would actually explain that evidence, and we take the ability of a hypothesis to explain the evidence as a sign that the hypothesis is correct. In _Inference to the Best Explanation_, Peter Lipton gives this important and influential idea the development and assessment it (...) deserves. The second edition has been substantially enlarged and reworked, with a new chapter on the relationship between explanation and Bayesianism, and an extension and defence of the account of contrastive explanation. It also includes an expanded defence of the claims that our inferences really are guided by diverse explanatory considerations, and that this pattern of inference can take us towards the truth. Aristotle’s discussions of natural slavery, ‘barbarian kingship’, and the natural characteristics of barbarians or non-Greeks are usually read as calling into question the intellectual, ethical, and political accomplishments of non-Greeks. Such accounts of non-Greek inferiority or inability to self-govern also appear to presuppose a climatic or environmental account that on the whole would imply severe limitations on the possibility of political flourishing for peoples living outside the Greek Mediterranean basin. In light of such accounts, it is somewhat astounding to find (...) Aristotle praising the social and political institutions of Carthage within his discussion of the best constitution in the second book of the Politics. In the 4th century BCE, Carthage (modern day Tunis) was a Phoenician commercial empire that culturally and linguistically was Semitic and clearly non-Greek. That Aristotle contrasts Carthage, a non-Greek polis, favorably with both Sparta and Crete undermines both the claim that Aristotle embraced a categorical opposition between Greeks and non-Greeks and the claim that he was dismissive of the achievements of non-Greeks. In this issue of JCE, Douglas Diekema argues that the best interest standard (BIS) has been misemployed to serve two materially different functions. On the one hand, clinicians and parents use the BIS to recommend and to make treatment decisions on behalf of children. On the other hand, clinicians and state authorities use the BIS to determine when the government should interfere with parental decision-making authority. Diekema concedes that the BIS is appropriately used to “guide” parents in making medical (...) treatment decisions for their children. But he argues that the BIS is inappropriately used as a “limiting” standard to determine when to override those decisions. Specifically, Diekema contends that the BIS “does not represent the best means for determining when one must turn to the state to limit parental action.” He argues that this limiting function should be served by the harm principle instead of by the BIS.I contend that we should not reassign the BIS’s limiting function to the harm principle. In this article I make two arguments to support my position. First, the BIS has effectively served, and can serve, both guiding and limiting functions. Second, the harm principle would be an inadequate substitute. It cannot serve the limiting function as well as the more robust BIS. (shrink)

There is a broad philosophical consensus that both children’s and prospective parents’ interests are relevant to the justification of a right to parent. Against this view, I argue that it is impermissible to sacrifice children’s interests for the sake of advancing adults’ interest in childrearing. Therefore, the allocation of the moral right to parent should track the child’s, and not the potential parent’s, interest. This revisionary thesis is moderated by two additional qualifications. First, parents lack the moral right to exclude (...) others from associating with the child. Second, children usually come into the world as part of a relationship with their gestational mother; often, this relationship deserves protection. (shrink)

Current management of people with prolonged disorders of consciousness is failing patients, families and society. The causes include a general lack of concern, knowledge and expertise; a legal and professional framework which impedes timely and appropriate decision-making and/or enactment of the decision; and the exclusive focus on the patient, with no legitimate means to consider the broader consequences of healthcare decisions. This article argues that a clinical pathway based on the principles of the English Mental Capacity Act 2005 and using (...) time-limited treatment trials could greatly improve patient management and reduce stress on families. There needs to be early and continuing use of formal best interests meetings, starting between 7 and 21 days after onset of unconsciousness. The treatment options need to evolve as the clinical state and prognosis becomes more certain. A formal discussion of treatment withdrawal should occur when the upper bound of predicted recovery falls below a level the patient would have considered acceptable, and it should always be discussed when the condition is considered permanent. Any decision to stop treatment should be contingent on a formal second opinion from an independent expert who should review the clinical situation and expected prognosis, but not the best interests decision. The article also asks how, if at all, the adverse effects on the family and the resource implications of long-term care of people left in a prolonged state of unconsciousness should be incorporated in the process. This article generalizes the explanationist account of inference to the best explanation. It draws a clear distinction between IBE and abduction and presents abduction as the first step of IBE. The second step amounts to the evaluation of explanatory power, which consist in the degree of explanatory virtues that a hypothesis exhibits. Moreover, even though coherence is the most often cited explanatory virtue, on pain of circularity, it should not be treated as one of the explanatory virtues. We study a best-of-two contest with two homogeneous players (teams). The winner is the player who wins in both stages. In the case of one victory for each team, a draw determines the identity of the winner. Each team has a value of winning the contest as well as a value of winning a single game. A team’s value of winning a game at its home field is higher than its value of winning a game away from home. Seungbae Park argues that Bas van Fraassen’s rejection of inference to the best explanation (IBE) is problematic for his contextual theory of explanation because van Fraassen uses IBE to support the contextual theory. This paper provides a defense of van Fraassen’s views from Park’s objections. I point out three weaknesses of Park’s objection against van Fraassen. First, van Fraassen may be perfectly content to accept the implications that Park claims to follow from his views. Second, even if van (...) Fraassen rejects IBE he may still endorse particular arguments that instantiate IBE. Third, van Fraassen does not, in fact, use IBE to support his contextual theory. (shrink)

In this paper, I present an ethical analysis of the case of an elderly woman with dementia, Mrs S. The hospital treating Mrs S sought to cease her dialysis treatment despite Mrs S’s family’s protestations that continuing the treatment was in her best interests. Assuming Brock’s framework as a theoretical background, I consider the case in terms of three questions. Firstly, was ‘best interests ’ the appropriate basis for deciding on a course of action in this situation? Secondly, (...) assuming the appropriateness of a best interests principle, was it in Mrs S’s best interests for the dialysis treatment to be withdrawn as the hospital suggested? And thirdly, if it was in Mrs S’s best interests for dialysis to be withdrawn, was the hospital right to pursue this course of action in light of the family’s disagreement? Based on the changes to the patient’s ‘self ’ associated with dementia, I argue that a best interests principle was appropriate, that continuing dialysis was not in Mrs S’s best interests, and that the hospital should have pursued cessation of treatment even in light of the family’s contrary wishes. A second-order preference is a preference over preferences. This paper addresses the role that second-order preferences play in a theory of instrumental rationality. I argue that second-order preferences have no role to play in the prescription or evaluation of actions aimed at ordinary ends. Instead, second-order preferences are relevant to prescribing or evaluating actions only insofar as those actions have a role in changing or maintaining first-order preferences. I establish these claims by examining and rejecting the (...) view that second-order preferences trump first-order preferences. I also examine and reject the view that second-order preferences give additional normative force to an agent’s preferred first-order preferences. I conclude by arguing that second-order preferences should be integrated into an agent’s object-level preference ordering, and by explaining how best to make sense of this integration. (shrink)

In a situation in which several explanations compete, is the one that is better qua explanation also the one we should regard as the more likely to be true? Realists usually answer in the affirmative. They then go on to argue that since realism provides the best explanation for the success of science, realism can be inferred to. Nonrealists, on the other hand, answer the above question in the negative, thereby renouncing the inference to realism. In this paper I (...) separate the two issues. In the first section it is argued that a rationale can be provided for the inference to the best explanation; in the second, that this rationale cannot justify an inference to realism. The defence of the inference rests on the claim that our standards of explanatory power are subject to critical examination, which, in turn, should be informed by empirical considerations. By means of a comparison of the realist's explanation for the success of science with that of conventionalism and instrumentalism it is then shown that realism does not offer a superior explanation and should not, therefore, be inferred to. On one conception of “best interest” there can only be one course of action in a given situation that is in a person’s best interest. In this paper we will first consider what theories of “best interest” and rational decision-making that can lead to this conclusion and explore some of the less commonly appreciated implications of these theories. We will then move on to consider what ethical theories that are compatible with such a view and explore their (...) implications. In the second part of the paper we will explore a range of possible criticisms of these views. And in the third part we will criticise the view that a court is always or even often in a good position to decide what the patient’s best interest is. In the fourth and final part we will put forward a reconstructive proposal aimed at saving whatever is sound in the “best interest” conception. (shrink)

A common argument for atheism runs as follows: God would not create a world worse than other worlds he could have created instead. However, if God exists, he could have created a better world than this one. Therefore, God does not exist. In this paper I challenge the second premise of this argument. I argue that if God exists, our world will continue without end, with God continuing to create value-bearers, and sustaining and perfecting the value-bearers he has already (...) created. Given this, if God exists, our world—considered on the whole—is infinitely valuable. I further contend that this theistic picture makes our world's value unsurpassable. In support of this contention, I consider proposals for how infinitely valuable worlds might be improved upon, focusing on two main ways—adding value-bearers and increasing the value in present value-bearers. I argue that neither of these can improve our world. Depending on how each method is understood, either it would not improve our world, or our world is unsurpassable with respect to it. I conclude by considering the implications of my argument for the problem of evil more generally conceived. (shrink)

Harmony Search Algorithm (HSA) is an evolutionary algorithm which mimics the process of music improvisation to obtain a nice harmony. The algorithm has been successfully applied to solve optimization problems in different domains. A significant shortcoming of the algorithm is inadequate exploitation when trying to solve complex problems. The algorithm relies on three operators for performing improvisation: memory consideration, pitch adjustment, and random consideration. In order to improve algorithm efficiency, we use roulette wheel and tournament selection in memory consideration, replace (...) the pitch adjustment and random consideration with a modified polynomial mutation, and enhance the obtained new harmony with a modified β-hill climbing algorithm. Such modification can help to maintain the diversity and enhance the convergence speed of the modified HS algorithm. β-hill climbing is a recently introduced local search algorithm that is able to effectively solve different optimization problems. β-hill climbing is utilized in the modified HS algorithm as a local search technique to improve the generated solution by HS. Two algorithms are proposed: the first one is called PHSβ–HC and the second one is called Imp. PHSβ–HC. The two algorithms are evaluated using 13 global optimization classical benchmark function with various ranges and complexities. The proposed algorithms are compared against five other HSA using the same test functions. Using Friedman test, the two proposed algorithms ranked 2nd (Imp. PHSβ–HC) and 3rd (PHSβ–HC). Furthermore, the two proposed algorithms are compared against four versions of particle swarm optimization (PSO). The results show that the proposed PHSβ–HC algorithm generates the best results for three test functions. In addition, the proposed Imp. PHSβ–HC algorithm is able to overcome the other algorithms for two test functions. Finally, the two proposed algorithms are compared with four variations of differential evolution (DE). The proposed PHSβ–HC algorithm produces the best results for three test functions, and the proposed Imp. PHSβ–HC algorithm outperforms the other algorithms for two test functions. In a nutshell, the two modified HSA are considered as an efficient extension to HSA which can be used to solve several optimization applications in the future. (shrink)

Background Best interests is a ubiquitous principle in medical policy and practice, informing the treatment of both children and adults. Yet theory underlying the concept of best interests is unclear and rarely articulated. This paper examines bioethical literature for theoretical accounts of best interests to gain a better sense of the meanings and underlying philosophy that structure understandings. Methods A scoping review of was undertaken. Following a literature search, 57 sources were selected and analysed using the thematic (...) method. Results Three themes emerged. The first placed best interests within the structure of wider theory, noting relationships with consequentialism, deontology, prudential value theory, rights and political philosophy. The second mapped a typology of processes of decision-making, among which best interests was ambiguously positioned. It further indicated factors that informed best interests decision-making, primarily preferences, dignity and quality of life. The final theme considered best interests from a relational perspective. Conclusions Characterisation of best interests as strictly paternalist and consequentialist is questionable: while accounts often suggested a consequentialist basis for best interests, arguments appeared philosophically weak. Deontological accounts, found in law and Kantianism, and theories of political liberalism influenced accounts of best interests, with accounts often associating best interests with negative patient preferences (i.e. individual refusals). There was much more emphasis on negative interests than positive interests. Besides preference, factors like dignity and quality of life were held to inform best interests decisions, but generally were weakly defined. To the extent that preferences were unable to inform decision making, decisions were either made by proxy authority or by an intersubjective process of diffuse authority. Differing approaches reflect bifurcations in liberal philosophy between new liberalism and neo-liberalism. Although neither account of authority appears dominant, bias to negative interests suggests that bioethical debate tends to reflect the widespread ascendancy of neo-liberalism. This attitude was underscored by the way relational accounts converged on private familial authority. The visible connections to theory suggest that best interests is underpinned by socio-political trends that may set up frictions with practice. How practice negotiates these frictions remains a key question. (shrink)

In the first part of this essay I sum up the theoretical genesis and foundations of Márkus’s theory of culture as a theory of modernity. Central to the high culture of modernity, defined in terms of the future-oriented creation of the new, is the structure of authorship, work, and reception that pertains across the sciences, philosophy, the humanities, and the arts. In the second part I question the scope of the concept in relation to the arts and philosophy in (...) the present and point to the inconsistency internal to Márkus’s conception that manifests itself in his neglect of the Romantic tradition in philosophy from Schelling to Heidegger, despite the integral role that the opposition between Enlightenment and Romanticism plays in his theory of cultural modernity. This article discusses how inference to the best explanation can be justified as a practical meta - argument. It is, firstly, justified as a practical argument insofar as accepting the best explanation as true can be shown to further a specific aim. And because this aim is a discursive one which proponents can rationally pursue in — and relative to — a complex controversy, namely maximising the robustness of one’s position, IBE can be conceived, secondly, as a meta (...) - argument. My analysis thus bears a certain analogy to Sellars ’ well - known justification of inductive reasoning ; it is based on recently developed theories of complex argumentation. (shrink)
