In the West, the term ‘tender, loving care’ (TLC) has traditionally been used as a defining term that characterizes nursing. When this expression informs practice, it can comfort the human spirit at times of fear and vulnerability. Such notions offer meaning and resonance to the ‘lived experience’ of giving and receiving care. This suggests that, in a nursing context, TLC is rooted firmly in relationship, that is, the dynamic that exists between carer and cared for. Despite this emphasis on (...) relationship, there is a scarcity of literature that draws a connection between TLC and the moral challenge that is so much a part of human interaction. In this article we will address this deficit and present a narrative that places TLC at the centre of moral engagement between nurse and patient; in essence, we offer an alternative means of viewing relational ethics. Previous research suggests that there are important gender disparities in the experience of leisure, but the issue of how mothers and fathers experience free time emotionally remains overlooked. The present study addressed this lacuna using the Experience Sampling Method and survey data from the 500 Family Study. Results showed that mothers and fathers spent the same amount of time on leisure activities. However, mothers had slightly less pure free time than fathers and were more likely to combine leisure with unpaid (...) work or spend time in leisure with children. Multilevel analyses showed that pure free time was associated with increased positive affect and engagement and decreased negative affect and stress, as was the combination of free time with unpaid work and personal care. These trends did not differ by gender. Adult leisure and free time with children were also beneficial to parents’ well-being. However, the relationship between free time with children and positive affect was stronger among fathers, whereas the association between adult leisure and engagement was stronger among mothers. These results suggest that mothers may feel more anxious about being criticized by others when engaging in leisure with their children, whereas spending time with adults alone may free them from the pressures of “good mothering.”. Adam Smith rejected Mandeville's invisible-hand doctrine of 'private vices, publick benefits'. In The Theory of Moral Sentiments his model of the 'impartial spectator' is driven not by sympathy for other people, but by their approbation. The innate capacity for sympathy makes approbation credible. Approbation needs to be authenticated, and in Smith's model authentication relies on innate virtue, which is not realistic. An alternative model of 'regard' makes use of signalling and is more pragmatic. Modern versions of the invisible hand in (...) rational choice theory and neo- liberalism are shown to be radical departures from the ethical legacy of Enlightenment and utilitarian economics, and are not consistent with Adam Smith's own position. Golden parachutes are often viewed as a form of excessive compensation because they provide senior management with substantial payouts following an acquisition while other stakeholders are subjected to layoffs, disrupted business relationships and other negative externalities. Using a sample of S&P 500 firms, an economic and ethical justification for this type of contract is given. Golden parachutes ensure effective corporate governance that, in turn, preserve the firm's value for all stakeholders. Boards of directors enter into parachute agreements to protect recently (...) hired CEOs' human capital during periods of financial uncertainty and, thus, potential takeover activity. From an ethics viewpoint, golden parachutes are valuable to all stakeholders because they encourage merger or acquisition in lieu of bankruptcy. (shrink)

Currently, there are many advocacy interventions aimed at reducing animal consumption. We report results from a lab (N = 267) and a field experiment (N = 208) exploring whether, and to what extent, some of those educational interventions are effective at shifting attitudes and behavior related to animal consumption. In the lab experiment, participants were randomly assigned to read a philosophical ethics paper, watch an animal advocacy video, read an advocacy pamphlet, or watch a control video. In the field experiment, (...) we measured the impact of college classes with animal ethics content versus college classes without animal ethics content. Using a pretest, post-test matched control group design, humane educational interventions generally made people more knowledgeable about animals used as food and reduced justifications and speciesist attitudes supporting animal consumption. None of the interventions in either experiment had a direct, measurable impact on self-reported animal consumption. These results suggest that while some educational interventions can change beliefs and attitudes about animal consumption, those same interventions have small impacts on animal consumption. (shrink)

Knowledge of human uses of animals is an important, but understudied, aspect of how humans treat animals. We developed a measure of one kind of knowledge of human uses of animals – knowledge of factory farming. Studies 1 (N = 270) and 2 (N = 270) tested an initial battery of objective, true or false statements about factory farming using Item Response Theory. Studies 3 (N = 241) and 4 (N = 278) provided evidence that responses to a 10-item Knowledge (...) of Factory Farming Scale predicted a reduction in consumption of animal products (rs = −.17- −.27) and approval of political actions aimed at factory farming (rs = .2 – .24). Path models from Studies 3 and 4 suggested that different kinds of knowledge uniquely predicted different outcomes. The Knowledge of Factory Farming scale was a unique predictor of approval of political actions concerning factory farmed animals but not animal consumption. Knowledge of Animals Used as Food predicted animal consumption but not political actions concerning farmed animals. These results highlight that different kinds of knowledge can be relevant for different animal related outcomes. (shrink)

Delaware case law has rendered the tender offer obsolete as a method for purchasing a company whose directors oppose the acquisition. A potential acquirer facing target opposition today must run an insurgent director slate, in the expectation that its directors are more likely to sell. The Delaware courts have not justified their preference for elections over markets as the preferred vehicle for implementing changes in control. Informal scholarly analyses ask transaction cost questions, such as whether proxy contests are more (...) costly than takeovers. This article attempts to break new ground by asking whether there are systematic differences in the performance of elections and markets in the corporate context. Recent models of voting processes, we argue, strongly suggest that elections are inferior to markets. Proxy contest elections sometimes can be won by incumbent managements when a transfer of control would be efficient, a conclusion consistent with the sparse data; and the proxy election process aggregates information regarding the sale decision less well than markets do, thereby implying that proxy voters are less well-informed. Theory and data thus suggest, at the least, that the intellectual burden of proof should change: the task now is to justify using elections to transfer control despite their apparent deficiencies. Adorno and his politically active graduate student Elisabeth Lenk offers fresh insights into both Adorno's view of surrealism and its relation to the student uprisings of 1960s France and Germany. Written between 1962, when Lenk moved to Paris and persuaded an initially reluctant Adorno to supervise her sociology dissertation on the surrealists, and Adorno's death in 1969, these letters reveal a surprisingly tender side of the distinguished professor. The question of how human beings are to understand their role in creation is of particular interest in our current time of extreme exploitation of the earth and severe environmental degradation. Historically, critiques have been raised against the Judeo-Christian interpretation of the biblical command to subdue the earth and rule over the animals. In all sincerity, the question then needs to be asked what Christian theology has to offer in response to these critiques. Having considered the various interpretations of the (...) meaning of the biblical command to subdue and rule, and with the understanding that the spiritual gifts of wisdom, understanding, knowledge and an ability to perform work have been bestowed by God on human beings, the proposition that this article offers is an alternative understanding of the role of human beings tendered in terms of ‘the justice of the peace’. The Hebrew understanding of peace is used as a basis; shalom does not refer to an absence of war but points to life and maintaining the balance and harmony in creation for life in all its varied forms to prosper. In the context of the imago mundi, it is proposed that human beings have been divinely appointed to uphold justice in creation and rule by keeping the peace.Contribution: The metaphor of ‘the justice of the peace’, used concomitantly with the verbs ‘subdue’ and ‘rule’ within ecotheology, offers a viable alternative to the idea of ‘stewardship’ of creation. This article focuses attention on possible alternative interpretations of the two verbs, contributing to an understanding of our relationship with creation. (shrink)

Ronit Stahl and Ezekiel Emanuel have recently issued a stark challenge to conscience protections in medical law and ethics. Their argument is flawed, however. They misrepresent the nature and relevance of conscientious protection in the military, misinterpret the scope of consent tendered by modern medical professionals, and offer no reason to think either that conscientious objection harms patient well-being or that such harm should solely determine the permissibility of conscientious objection. Moreover, and most fundamentally, Stahl and Emanuel do not recognize (...) that conscience protections promote moral integrity, a basic aspect of human well-being that justifies protective action. It is no accident that the book Benjamin wrote as a reader of himself, A Berlin Childhood, also begins with the description of a park, that of the Tiergarten zoo. However great the difference may seem between this collection of short prose pieces and Proust's three-thousand-page novel when viewed from the outside, Benjamin's book illustrates [his] fascination... A sentence in his book points to the central experience of Proust's work: that almost everything childhood was can be withheld from a person (...) for years, suddenly to be offered him anew as if by chance. "Like a mother who holds the new-born infant to her breast without waking it, life proceeds for a long time with the still tender memory of childhood" . Also reminiscent of Proust is the description of the mother who, on evenings when guests are in the house, comes in to see her child only fleetingly to say good night; so, too, is that of the boy attentively listening to the noises which penetrate into his room from the courtyard below and thus from a foreign world. But little is gained by this approach, and it would not be easy to refute the objection that such similarities lie in the authors' common raw material: childhood, the fin de siècle epoch, and the attempt to bring them both into the present. In this list, the pairs of opposites are in experience with a certain ultimate directness (...) of intuition, except in the case of the last pair. God and the World introduce the note of interpretation.—Alfred North Whitehead1Theistic finitism, the position that God is not omnipotent, is the most tenable solution to the problem of evil—but it also necessitates a slide toward immanence. Among the ranks of the finitists we find philosophers such as William James,2 process thinkers such as Whitehead and Charles Hartshorne,3 theological personalists such as Edgar Brightman (and, Rufus Burrow argues, his pupil Martin Luther King, Jr.),4 feminist disability theologians like Julia Watts Belser,5 and popular religion writers such as Harold Kushner.6 Like many others, Kushner found in finitism not an answer to an abstract theological puzzle, but an existentially necessary salve for the despair that nearly overtook him when his three year-old son was diagnosed with a terminal degenerative disease. If God is not all-powerful, then God need not be the author of our pain, but a friend who hurts with us as we bear it. Rather than sadistic puppeteer, a finite God becomes “the fellow-sufferer who understands.”7 As Jürgen Moltmann put it, “the one who cannot suffer cannot love either. So [God] is also a loveless being.”8 Or, as Dietrich Bonhoeffer reflected as he awaited execution in a Nazi concentration camp, “Only the suffering God can help.”9However, when one strips away divine omnipotence, one must also bid adieu either to God’s omniscience or creator-hood: for an omniscient creator, crafting the world with full knowledge of how everything would unfold, would be ipso facto omnipotent. We are left, then, with the following alternatives: we could posit a God who pressed the “create world” button not knowing what would happen (which seems irresponsible, calling into question God’s goodness)—as Tim Bayne puts it, “If future contingents fall outside the scope of God’s knowledge, then creation was a massive gamble.”10 We may share Albert Einstein’s famous distaste for a God who plays dice with the universe. The other alternative is that God’s knowledge and power are partial, that the Divine is merely one being/force among many. But if God is “just a stranger on the bus, trying to make his way home,”11 then in what sense can we say that God is God at all?This paper offers a construal of theistic finitism as a form of religious naturalism with an aesthetics of empathetic solidarity. That is, when we relinquish belief in God’s omnipotence, instead imagining that God is struggling and suffering along with us, we relinquish as well belief in an overbearing “supernatural realm” or “order” governing/underlying all things. This paper examines one approach to the ethics of companion animals, which emerges from the dominant historical tradition and is increasingly familiar in everyday life as well as in work on companion animals in the social sciences. I label it the “utilization with welfare-safeguards” model, or, more gently worded, “seeking benefits while ensuring welfare.” Some of the “benefits” considered are complex ones (like guiding the sight impaired) and others simpler (like reducing stress or providing affection). I explore several problems involved (...) in this approach (including the sometimes jarring inappropriateness of “benefit” terminology). I then offer an alternative account where the primary moral obligation toward companion animals is to develop, nurture, respect, and protect the loving relationship between them and their human companions, since thriving in such a relationship, I claim, has become part of their evolved telos (to use Bernard Rollin’s term)or evolved nature. This priority naturally leads to ensuring welfare, but the highly pro-active approach involved takes the obligation beyond standard welfare provision and “TLC” (“tender loving care”). The present paper considers the possible sense of “nonsensical” caring—caring (1) which for various reasons apparently cannot help the cared-for, and (2) in which the carer, though convinced that it will not be effective, whole-heartedly engages. The project is inspired by the fiction of Ali Smith, which offers varied, vivid and memorable examples of such caring: worried that her dead sister misses life experience, Clare in Hotel World makes sure her sensations are doubly intense and rich though she knows (...) her sister, being dead, will not benefit from them; in Summer Hannah and Daniel write to each other tender letters which they immediately burn for safety’s sake so that the addressee has not even the slightest chance of ever reading them; in “Virtual” a bed-ridden girl diligently takes care of her virtual pet, well aware that it is not alive, let alone sentient. Smith’s examples of “nonsensical” caring are strangely compelling, yet in real life such caring—predictably ineffective (as regards helping the other) and costly—is rare. Why? Under what metaphysical assumptions, if any, could “nonsensical” caring make sense? The paper considers these questions, taking Søren Kierkegaard’s extensive discussion of agape love in Works of Love (1847) as its primary point of reference. (shrink)

There exists a widespread consensus amongst contemporary jurisprudents, positivists and non-positivists alike, that the meaning of ‘obligation’ should not radically shift from law to morality, or any of the other domains of practical reason. Yet there is limited effort in contemporary discussions of legal obligation to engage with the metaphysics of normativity with an eye to a well-founded account of those elements that deliver its non-conditional character. On a recent occasion I discussed the shortcomings of a prominent positivist account of (...) legal obligation, that of Jules Coleman. In this chapter I turn to a prominent non-positivist account, the model of principle, and argue that, even though it identifies key elements or conditions of normativity simpliciter, it stops short of delivering a conclusive account of unconditional legal obligation, an account that would place legal obligation in the same continuum with all other types of obligation. Taking up from where the model of principle halts, I propose a complementary—if more fundamental—account of normativity simpliciter, which I dub the model of norms. I make a case for it, by looking into universal conditions of normativity and, in conclusion, offer some more specific remarks about the advantages of the model of norms over other competing models. Part 2 looks into the account of legal obligation tendered by the model of principle. According to it, law is an instance of action-directing action or action that purports to get other agents to comply with the ends it sets out to attain. The idea here is that the very logic of action-direction draws moral reasons—principles—into the picture of legal obligation, as the one item that can explain how and whether the facts of a social practice, which purports to direct action, come to acquire the status of reasons for action for the subjects of law. Subsequently, this model is contrasted with an alternative model of obligation that takes facts of authority to constitute reasons of action in virtue solely of their structure. In conclusion it is argued that, in contrast to the second model, the model of principle manages to capture what is distinctive about action-directing action in the domain of law—that is, the special normative significance of the possibility to coerce others under a scheme of public institutions. Part 3 opens by pointing to a more widespread worry that needs to be addressed before the model of principle can be deemed fit for the role it is employed—the worry relates to the ability of principles to constitute genuine reasons for action. In particular, the enquiry investigates the nature of principles and their ability to avoid certain flaws that might pertain to reasons for action in general. In taking up this line of enquiry the paper looks into the more general debate on normativity with a view to specifying requirements that anything which purports to be a reason ought to meet. I employ a rationalist analysis of normativity, which brings the idea that intentional thought is normative to bear on the analysis of the meaning of normative terms, such as ‘ought’, ‘obligation’, ‘duty’. In conclusion, I argue that the content of normativity consists in normative facts—ie norms—which purport to model the content of ideal—or counterfactual—states of the will. Such norms give exhaustively the content of normativity. In light of the above, part 4 advances a two-layered model of norms, with the higher level being populated by norms simpliciter, and the lower by norms in a domain. When considered jointly the two layers ground the possibility of non-conditional obligation without evoking moral realism and the concomitant suspicion of scepticism. On the face of it some key advantages of the model of norms are discussed over the two other models of legal obligation, that of principle and that of authority. On the one hand norms resist the ‘talking past each other objection’ which is commonly levelled against principles. On the other, norms are much better suited to account for the moral limits of action-directing action than either principles or facts of authority, for they illustrate cogently that the grounds of any reason for action already include a concern for others’ autonomy. Rachel Lumsden analyzes Ethel Smyth’s 1913 musical composition “Possession,” an ode to same-sex intimacy displaying a “sonic meld” of (...) passion, desire, and political commitment. Sharmila Lodhia’s account of Nina Paley’s film Sita Sings the Blues considers how a sexually charged anitmated representation of a traditional epic can spur battles over cultural authenticity. Ariane Cruz examines how sexual pleasure presses against racist histories in a study on black women and BDSM. Whether sexuality is policed, as Chloë Taylor explores in her article, or the policing of sexuality is shunned, as Lynn Comella addresses in her review essay, it is clear that the grip of sexual politics on women ’s sexual lives is strong. Wang Zheng’s News and Views piece recounts recent global feminist tactics used to release five young feminists jailed in China, an urgent reminder about how women’s bodies are policed in violent ways. We begin this issue with Chloë Taylor’s essay reflecting on how sexology and psychiatry function to represent female desire in narrow ways. Taylor explores how female sexual dysfunction is constructed in sexology and psychiatric practice and locates this as part of a longer history of rendering selected bodies and sexual practices as deviant. Her analysis is a valuable rejoinder to the ever-expanding grip of psychiatry on the ordering—and disordering—of women’s bodies and sexuality. The line between normal and abnormal is always shifting, but its constant is how it maneuvers and is maneuvered to control female sexual desire. Taylor’s argument moves toward a non-normalizing feminist sexology that can interrogate sexual practice and function without rendering any as “right” or “wrong.” 256Preface Andrea Wood also turns to female sexuality, specifically lesbian sex, love, and romance, in her article on comics as a literary genre. Lesbian romance comics, Wood argues, offer a different discursive lens for “making the invisible visible.” Using queer theory to interrogate romantic depictions of lesbian sex and sexuality, she explores how the visual narrative form of comics allows for a different and politically compelling depiction of lesbian identity and sexual activity. Although lesbian romance and same-sex desire has been an interest of many feminist scholars, few have examined the visual field of lesbian comics—a genre, Wood insists, that demonstrates resistance to what Adrienne Rich identified as “compulsory heterosexuality.” Rachel Lumsden draws our attention to composer Ethel Smyth’s understudied song “Possession.” The song is a rumination on what it means to possess something or someone, and what it means to be possessed ; it is also a song that Smyth dedicated to Emmeline Pankhurst, her political comrade as well as her close friend and muse. Lumsden reads the song as a creative, strategically ambiguous “ode to an intimate female relationship,” a tribute to the respect, affection, and tenderness that Pankhurst and Smyth shared. Rather than reveal the “truth” of Smyth’s relationship with Pankhurst, Lumsden instead invites readers to consider the “sonic meld” of “Possession” as a space through which “themes of desire, activism, eroticism, solidarity, and sacrifice coalesce and congeal ” and as a site through which Smyth narrated her experiences, passions, desires, and political commitments. Sharmila Lodhia engages the controversy surrounding Nina Paley’s re-telling of the Ramayana in her film Sita Sings the Blues, which some critics have deemed “offensive,” “insulting,” and a “desecration of the Ramayana and the Hindu faith.” Lodhia treats Paley’s film—which positions Sita rather than Ram as the story’s protagonist, deploys animation and myriad narrator perspectives, fuses Paley’s own story with Sita’s story, and sets the story to a 1920s blues soundtrack—as a productive “body of critique about the epic’s central teachings on virtue, righteousness, and idealized gender roles.” By situating Paley’s retelling of the Ramayana in the context of numerous and varied Ramayana retellings, Lodhia reveals that Sita Sings the Blues is a “creative... The author gets human creativity to bridge phenomenology and metaphysics. He examines closely the poetical principle of Edgar Allan Poe and considers the artwork as a phenomenon appealing to the metaphysical beauty. He also considers the problem of free-dom in phenomenological and metaphysical aspects of creativity. To harmonize the freedom and phenomenology the author offers to differentiate two kinds of intentionality: “intentionality to” and “intentionality from”. Dhillon, editor of the Journal of Aesthetic Education, suggested to me one day that I might guest edit a special issue of the journal devoted to the topic of children’s literature, my initial reticence was toppled and my sense of resolve buoyed as I began to fantasize (...) with billowing excitement about just how this might be done. First, I dreamt up the image of guest editor as bountiful hostess—setting out delectable dishes in an elegantly appointed banquet before the readers of this journal. That metaphor faded, however, despite Maria Tatar’s eloquent reminder to us in these pages that gastronomy has frequently and salubriously been juxtaposed with reading. I could not help worrying (even though children vociferously protest the logic of this problem) that one cannot have one’s cake and eat it too. Therefore, switching to music, I began to imagine the editor as conductor of a highly select ensemble of musicians, all gifted with glorious well-seasoned voices. They might perform a concert (recorded for posterity, of course) of pieces aimed at an audience of those who care passionately about aesthetics, education, literature, and above all about children, and at those who, perhaps with tenderness, still recall their own childhood reading.But how to accomplish this in practical terms? Well, I reasoned, I would simply invite a group of distinguished senior scholars who, having achieved their reputations in related fields and having written on other subjects as well, have published highly significant works pertaining to children’s literature. Each person would contribute a composition in his or her own voice, and there would be complete freedom, carte blanche, no holds barred—the only constraint being page numbers. Would the results turn out to be harmony or cacophony? Well, I speculated, if each voice were finely tuned, resonant, and clear, whether treble or bass, forte or pianissimo, the outcome—although [End Page 1] unpredictable in terms of specifics—would, unquestionably, be musical. But that, dear reader, is ultimately for you to judge, for you have now heard precisely how this issue came into being and will, we hope, read on. Each author I asked responded to my call with alacrity and, in his or her original style and tone, made my task as conductor a perfect pleasure.We offer you a work in three parts. First, you will encounter two melodious and euphonious pieces, contributed respectively by Marina Warner (“Out of an Old Toy Chest”) and Maria Tatar (“From Bookworms to Enchanted Hunters: Why Children Read”). Here, the overarching themes of children’s play and make believe are set up, analyzed, and explored. Playing and reading are placed side by side, as well as reasons why children love to read and how they are variously exhorted, extolled, and even occasionally excoriated by adults for doing so.Our second movement consists of three apparently unrelated motifs, contributed in turn by Gareth Matthews (“Philosophical Adventures in the Lands of Oz and Ev”), Seth Lerer (“Style and the Mole: Domestic Aesthetics in The Wind in the Willows”), and myself (“Ethos in Steig’s and Sendak’s Picture Books: The Connected and the Lonely Child”). Asylbarns status og rettigheter i Norge er i kritisk søkelys. En særlig utsatt gruppe er barn av papirløse foreldre som fødes på norske sykehus. Med bakgrunn i Kirkens Bymisjons arbeid med denne gruppen, argumenterer jeg i denne artikkelen for at slike eksempler viser at norsk offentlig politikk overfor disse barna tenderer mot å gradere og dermed underminere deres grunnleggende menneskeverd, slik dette blant annet kommer til uttrykk i barnekonvensjonens krav om hensynet til barnets beste. Ved hjelp av Judith Butlers tenkning (...) om sårbarhet og «framing» samt Giorgio Agambens tenkning om «nakent liv» og unntakstilstanden, analyserer jeg hvordan denne graderingen av asylbarnas menneskeverd skjer. On the basis of the diaconal work of the Church City Mission in Oslo that aims at providing care and defending the rights of these groups through the Health Care Centre for Undocumented Migrants, the purpose of this article is to argue that the inherent human dignity of these children is being undermined in contemporary Norwegian politics. By relating to Judith Butler's thoughts on vulnerability and «framing» and Giorgio Agamben's theory of the «bare life» and the state of exception, the article aims at showing mechanisms that contribute to the undermining of the human dignity and rights of this group. The last part shows how the work of the health care center with its ethical and theological basis can be seen as offering resistance to these mechanisms and tendencies. (shrink)

This article explores the critical role of emotions and bodies in the individual dynamics of engagement as well as the construction of collective identities and action in women’s groups in the 1970s in France. Much literature on emotion work in feminist organizations has tended to discuss emotions stemming from women’s dominant socialization processes as, above all, alienating, thereby as barriers to their activism. The Movement for the liberty of abortion and birth control offers essential insights into how gendered dispositions (...) can be primary determinants of feminist collective identity formation, and even spur innovative protest practices. With their specific organizational settings and action, some ‘dissident MLACs’ in Aix-en-Provence, Lille, Lyon and Paris – those which continued to practice abortion despite its legalization and in defiance of the 1975 law which forbade them to do so – mobilized reciprocal emotions and bodily experiences to sustain engagement and serve a political project. Drawing on a wide array of biographical interviews and archival sources centred on abortion practices, the article examines the distinctive emotion culture these groups constructed. Its anchoring in bodies, commitment to emotions like tenderness and compassion, but also domestic and relational skills consecrated a gendered repertoire of action which therefore notably appealed to women whose social properties did not predispose them to collective action. Paper, kr. 375,–Though many associate Kierkegaard with isolated individuality, Kierkegaard scholars are rather gregarious. Four times since 1985, Kierkegaard devotees from all the inhabited continents have gathered at St. Olaf College for several days (...) of intense paper reading. Since it is difficult to keep a handle on so much material presented orally and because many were not able to attend, it is a commendable service that Houe and Marino have edited and published many of the papers delivered at the 2001 conference, just as they had previously published essays from 1998 conference and C. Stephen Evans and I had published essays from the 1989 conference.This volume reflects its origins in several ways. First, the essays are unusually brief compared to most journal articles (around ten pages each). While this is an agreeable format when listening to many papers in a single day, I do think that many of these essays are rather rushed and less than fully developed. Accordingly, the reader of these essays may well feel stimulated by interpretive suggestions rather than satisfied by thoroughly worked out treatments.Second, the essays are quite diverse, as conference papers tend to be, even when, as in this case, a preferred theme—hermeneutics and communication—was stated in advance. Since, as Alastair Hannay notes in the opening keynote essay, "hermeneutics" is used in a wide variety of ways, this theme really did not limit participants to any significant degree. Essays in this volume look variously at Kierkegaard's practice of hermeneutics (especially in reference to the Bible), at our predicament of interpreting Kierkegaard's notoriously elusive and cryptic pseudonymous works, at hermeneutics as our existential disposition as sense-making creature thrust into an ambiguous world, at hermeneutics as a quasi-Hegelian project of engulfing particularity without remainder in a totalizing whole, and, in contrast, at radical hermeneutics (a term coined by John Caputo and applied to Kierkegaard) as an interpretive approach that refuses the consolations and consonances of its Gadamerian cousin. As the use of "hermeneutics" varies, we hear that Kierkegaard is both an exemplary hermeneuticist and "the ultimate non-hermeneuticist." And in a number of essays, the issue of hermeneutics only seems to come up in the vacuous sense that the author offers a reading of some Kierkegaardian text or texts.The wide variety of essays included here reflects itself in the unsatisfactory final article in which Poul Houe makes a thoroughly desultory attempt at pulling the various articles together. I've tried my hand at writing such a piece, so I feel empathy for Houe's plight. But the paragraph per essay tour of the book is so hurried and so perfunctory that I wonder what purpose it really serves in this case.Though widely varying in topic and approach, most of the essays in the volume are quite good, if tantalizingly short. Given that there are twenty-five essays in the volume, it is not possible to summarize them here. But several observations are in order. First, it is especially nice to see five essays by Danish scholars included in this book. The community of Kierkegaard scholars has increasingly come to appreciate that viewing him in terms of his local context can be quite illuminating. American scholars have done excellent work along these lines, but clearly Danes have a crucial role to play in this interpretive task. Second, there have been heated disagreements in Kierkegaard circles over how to place Kierkegaard in reference to philosophical postmodernism. That polemic is in evidence in this volume as well. Several essays, most notably that of David Goicoechea, affiliate [End Page 502] Kierkegaard with postmodernist refusals of the totalizing understandings. In contrast, Sylvia Walsh juxtaposes Kierkegaard's "erotic hermeneutics," which treats its phenomenon with amorous tenderness, with Derrida's deconstructive approach to interpretation, which Walsh sees as a violent expression of the will to power. Christopher Simpson tries to reconcile these divisions by reading Kierkegaardian faith as an attractive... (shrink)

Construction process stages are argued to be vulnerable to the prevalence of corrupt practices. However, the validity of this argument has not been empirically explored in the extant literature of construction management. Therefore, this study examines the stages of the construction process susceptibility to corruption and its most prominent forms of corrupt activities. A total of forty-four project-related professionals were involved in an expert survey to assess such susceptibilities and the criticality of the identified corrupt activities at each stage. A (...) comparative study of expert views from developing regions against experts from developed regions is conducted. Expert scoring results revealed that three stages are most susceptible, namely: project execution, pre-qualification and tender stages. Such results were confirmed by application of the Mann–Whitney U test statistics tool, showing wide disparities in seven out of eleven identical stages. This study is intended to incite polemic discussions and greater empirical, evidence-based research from scholars in both developed and developing countries. This study adds to the extant literature corruption-related works on the construction process through deeper understanding of the dynamic nature of corrupt practices involved in the stages of the construction process in developing countries. Practically, it intends to offer a veritable plethora of information on the critical stages of the construction process for industry practitioners, policymakers and anti-corruption bodies to careen their attention towards the fight against corruption. Am I to reflect on that small window of time, one so small that I don’t actually remember it, when I did not know that I was different? My mom [End Page 196] has recounted vivid (...) moments where I seem to come to this realization—for example, at the age of three, when I see my twin sister and friends scrambling on a playground and I process that I am unable to join them. Realization of my differentness (my different body, my different way of moving, my different abilities) continued into my youth and adulthood (Can’t skate—check. Can’t ride a two–wheeled bike—check. Usually walk behind others, destined to be the last in a group—check. Was the smart kid in class, aka smartass–in–training—check).Eventually, I realized that my differentness was not contained to my body or my abilities. Were my mind, my self, and my relationships different as well? I seemed to empathize when others didn’t or couldn’t. I saw that certain things were just wrong, and was confused when others didn’t share my concern. I seemed to see, feel, and experience things that others did not. For instance, I had two invasive operations before the age of eleven, a handful of minor procedures and countless physiotherapy sessions. Some memories of these times are horrific. Some I cherish, including the genuine care of the health care staff. Some are hilarious, like being doped–up before invasive surgery at the age of ten and calling my favorite surgeon “So cute!!” But always, there was physical pain, pain, pain. At times, I was completely dependent on others to help me to the bathroom, the shower, to move around, and to recover. I received such tender and exquisite care from my mom during these times. The dependency, which I had no choice but to experience, the dependency that is feared by almost everyone I know (“If I am ever a burden to my family, shoot me”) is something that my mom and I constantly joke about (“Em, I will take care of you now, only if you change my diapers when I’m old, kay?”). I have come to learn that this dependency, along with those other shades of vulnerability, are an inevitable consequence of being human, and to deny this is to relinquish our capacity to connect with others.I had, and continue to have, relationships with strangers, friends and family, which are, in my best estimation, atypical. I am the recipient of staring, laughing, pointing, sympathy, disgust, empathy, tender care, curiosity, hostility, resentment, and ambivalence. While in the gym, complete strangers approach me to say, with all the kindness, enthusiasm, and obliviousness in the world: “Glad to see you out and about. Good for you!” For some, I am to be protected; for others, I am to be tiptoed around; and for others, I am to be congratulated for “overcoming my circumstance” and for being oh–so–valuable to society because of my smarts and productivity.It is a rare few who accept what Cerebral Palsy and epilepsy offer to my life and to their own, with all of their accompanying complexities, possibilities, and contradictions.It is ironic that the excellent health care and services I have received, which have probably changed my life for the better, are only made possible because of the “disability” label, which I have come to heartily dislike. Perhaps more accurately, the definitions and associations that stubbornly accompany the term (e.g., the disabled person as asexual, passive and in need of protection, the disabled person as the conquering hero) would never accurately describe me.
