While there is a vast philosophical literature exploring the conditions under which it is appropriate to hold individuals morally responsible for their actions, relatively little attention has been paid to the related question of which kinds of individuals merit these responsibility ascriptions. Under normal circumstances, typical adult human beings are held morally responsible for their behaviour but infants and nonhuman animals are not. In this thesis, I aim to account for this difference. That is, I aim to give an analysis (...) of the concept of moral agency. In Chapter One, I begin with a schema of moral agency, under which moral agents are characterised by the possession of certain abilities, enabling certain actions, for which certain responses are warranted. The literature on moral responsibility offers many ways of filling in these details, primarily by specifying the relevant agential abilities in terms of various responsibility conditions. My aim in this chapter is to offer a basic account, under which moral agents are characterised by the simplest possible abilities while still being appropriate targets of the relevant responses, such as praise and blame. I draw on the work of Nomy Arpaly, whose account of moral responsibility identifies the relevant ability as the ability to act out of good or ill will. I offer an analysis of this ability, under which basic moral agency is characterised by the ability to have desires about others’ mental states. In Chapter Two, I consider a range of alternative responsibility conditions offered by other philosophers, each of which appears to be necessary for moral agency. I argue that these conditions are not necessary for a basic account of moral agency. In Chapter Three, I move beyond basic moral agency to offer a more restrictive account that aims to capture other important aspects of our moral lives: the practice of justification and our ability to improve our moral character. I claim these aspects are underpinned by the use of moral reasons to guide our behaviour, and in contrast to moral motivation, this guidance is characterised by the ability to have beliefs about the desirability of actions. In Chapter Four, I aim to answer two questions: at what age do humans become moral agents, and are there any nonhuman animals who are moral agents. I draw on the work of Josef Perner, who offers a three-stage framework of the development of mental representation during childhood. I consider the conceptual coherence of this framework, its applicability to both accounts of moral agency developed in the thesis, and the empirical evidence that bears on the framework. As a result, I tentatively conclude that basic moral agency develops at around 18 months of age and may be present in a few species of nonhuman animal, whereas the more restrictive type of moral agency developed in Chapter Three develops no earlier than around 3.5 years of age and is restricted to human beings. I attend to the debate between the A-theory of time and the B- theory of time by evaluating how each theory accounts for the possibility of change. I conclude in favour of the B-theory of time as an account of change. I begin by considering McTaggart’s argument against the reality of time. I connect McTaggart’s argument, and the attendant A-theory versus B-theory debate, to an argument against the possibility of change. This argument, the problem of change, can be refuted by (...) adopting either of an A-theory or B-theory account of change. I evaluate different approaches to change offered by various A-theories, including presentism, the growing block theory, the moving spotlight theory, and then proceed to consider different B-theory accounts of change, including relativiser endurantism, adverbialist endurantism, and perdurantism. I consider objections to each of these views. Finally, I compare the costs incurred by the best of the A-theory accounts and the best of the B-theorist accounts. (shrink)

This thesis aims to illuminate Seneca’s criticisms of Neronian Rome through a novel exploration of the philosopher’s collection of moral letters – the so-called Epistulae Morales ad Lucilium. Noting the glaring absence of court politics in these letters the thesis identifies themes of dissimulation and veiled criticism, penned by Seneca in a concealed manner to ensure his safety during a time of dire political unrest. The first chapter establishes the cultural context of this collection by examining how they fit in (...) with the practice of elite Roman letter writing. This line of inquiry stems from a longstanding question in the scholarship as to whether the Epistulae Morales are letters in the earnest sense, or merely a literary-philosophical exercise contrived by Seneca. The chapter concludes that the letters can be seen as genuine, exchanged with their addressee. They were, however, also written for the wider senatorial class who are clearly the subject of Seneca’s moral discussions. The second chapter examines the circumstances which preceded the writing of these letters in order to identify points of political tension under Nero’s reign. Drawing on the Neronian books of Tacitus’ Annals and earlier Senecan treatises, this chapter identifies themes of political ideology which shaped the ongoing altercations between senate and emperor during Nero’s rule. With the political tensions identified, the third chapter unearths the underhanded ways in which Seneca criticises Nero’s reign throughout the letters. Additionally, this chapter showcases a range of techniques employed by Seneca to disguise his criticisms in order to maintain deniability and avoid persecution. The fourth and final chapter examines Letters 14 and 18 in detail, illustrating the techniques discussed in the preceding chapter and bringing to light Seneca’s veiled criticisms of Nero’s regime. The pair of case studies demonstrates that Senecan criticisms are present throughout the collection, and are apparent in both letters with overt political themes and those which are, at first glance, seemingly mundane and commonplace. This thesis is composed of three essays on the perdurantist approach to persistence and identity over time. In Chapter 1, I discuss how the following papers are to be understood as parts of a unified perdurantist account of persistence over time. This chapter also outlines some of my philosophical assumptions and provides some background information about the metaphysics of persistence. In Chapter 2, I respond to the objection that the worm theory is unable to account for our intuitions about ordinary (...) counting sentences. I do this by invoking the standard linguistic phenomenon of covert quantifier domain restriction and supplementing the worm theory with situation semantics. My version of the worm theory makes our intuitive judgements come out true, and it does so well enough that there is no need to adopt the stage theory or revisionary theories of counting. Furthermore, my version of the worm theory offers a unified account of event- and object-related counting. Chapter 3 focuses on a commonly neglected difference between different kinds of perdurantism, which are differences in mereological priority. I discuss three different views: parts-first perdurantism, no-priority perdurantism, and wholes-first perdurantism. I briefly outline all three views and some of the motivations for each of them. I fend off objections from and motivations for no-priority perdurantism. I also contend that intraperdurantist debates about phenomenology ought not to be framed with respect to these forms of perdurantism. Instead, I suggest that the relativity of simultaneity presents an interesting scenario for parts-first and wholes-first perdurantists. I respond to Thomas Pashby’s arguments against the doctrine of temporal parts in Chapter 3. Pashby argues that metaphysicians ought to give an account of how quantum systems persist over time and that nonrelativistic quantum mechanics is incompatible with perdurantism. I contend that his arguments rely on controversial, non-standard assumptions about the existence and importance of time observables. I demonstrate that perdurantists have no problem giving an account of how quantum systems persist over time in reference to an external time parameter. Finally, I conclude with a summary of my arguments and some thoughts about directions for future research. (shrink)

In this article, I describe how my personal experience of death prompted the writing of a novel and how the practice of writing about death led me to develop a critical inquiry into Continental philosophy and other theories of death. I discuss philosophical approaches to living authentically in the face of death and the human tendency to search for meaning. I undertake a close reading of Helen Garner’s The Spare Room in light of these issues and the changing attitudes to (...) death since modernism, particularly the need for open communication about death and the importance for the dying in feeling that their life has significance for other people. Legal philosophical discourse tends to be animated by some conception of self and the parameters of community. Reflecting a vast heritage of humanist philosophy and theology, western legal concepts reflect anthropocentric values. Theories of law and legal concepts promote human beings as separate to the environment and define frameworks for the exploitation of nature. Against this paradigm, environmental philosophers have sought to redefine human beings as integral members of a greater Earth community – nature is a community of subjects, not (...) a collection of objects. This alternative conception of self carries important consequences for legal philosophy. This paper explores these consequences first by analysing the ecological conception of self and community articulated by ‘geologian’ Thomas Berry. Second, this paper uses Berry’s analysis to develop an ecological theory of jurisprudence. This theory connects human law with ecological integrity and holds that human law attains legal quality when enacted for the common good of the comprehensive Earth community. Throughout this analysis, the paper also highlights the limitations Berry’s philosophical and legal writing and seeks dialogue with leftist political theory. (shrink)

There is a strong tradition of observational research in most areas of the social sciences, especially in Anthropology and Sociology. However, in business and management research observation is often seen as a poor relative to questionnaire surveys and qualitative interviewing. This chapter discusses the use of observational techniques especially for less experienced researchers planning their first major investigation, exploring the difference between participant and non-participant approaches, different techniques of data collection, recording and analysis. Rather than seeking to provide a full (...) guide to conducting participant observation, an impractical task in a single chapter, this offering discusses some of the key issues facing researchers in Business and Management who choose to conduct this sort of research, exploring different approaches to participant observation and some of the ethical and practical challenges associated with the collection and analysis of observational data. The chapter draws on the author’s experience of conducting participant observation in organizations with examples of both employee and customer perspectives. It will also draw from ‘classic’ observational studies such as Mars and Nicod and more recent examples such as Watson and Watson. (shrink)

Patient safety has only recently been subjected to wide-spread systematic study. Healthcare differs from other high risk industries in being more diverse and multi-contextual, and less certain and regulated. Also many patient safety problems are low-frequency events associated with many, varied contributing factors. The subject of this paper is the epistemology of patient safety. Patient safety research is considered here on the background of a risk management framework which requires researchers to: • Understand the context - as a subset of (...) healthcare quality, services and systems research, with technical and human behavioural components and a range of external and internal organisational influences, a wide range of research disciplines is necessary • Identify the risks - identify the things that go wrong and the frequency and nature of different types of incidents from sources such as medical record review, observational studies, audit, incident and medico-legal reports • Analyse the risks - deconstruct the things that go wrong, identifying contributing factors and trying to detect trends and patterns in contributing factors, detection, mitigation factors, ameliorating factors and actions taken to reduce risk • Evaluate the risks - decide on priorities, identifying preventive and corrective strategies and judging the risk- and cost-benefit of potential corrective strategies such as standardisation or simplification of a process or device • Manage the risk - evaluate and scope preventive and/or corrective strategies and then implement these, or place the problem on a risk register pending solution, or accept that what is needed is unaffordable • Communicate and consult - use interactive sessions, audit, on-going feedback, reminders and patient mediated prompts • Monitor and review the state of the problem - get baseline trends and patterns so that changes can be tracked and properly attributed to an intervention A hierarchy of levels of evidence has been proposed for clinical research and we argue that insufficient weighting has been given to lower ranked levels of research and to qualitative research, although critical interpretive synthesis is now gaining acceptance in mainstream thinking. Fundamental challenges remain including how to grasp the elusive concept of patient safety, how to quantify, characterise and cost the problems, how to judge the extent to which harm can be attributed to errors, violations or system failures, how to identify contributing factors and the extent to which they can be implicated, how to judge whether incidents or their precursors are preventable, how to generate strong evidence to make healthcare safer and how to translate research into practice. Future directions include addressing the mundane as well as rare, dramatic events, and developing further research in non-hospital settings and in developing countries. In summary, a mixture of qualitative and quantitative methods, using information from all available data sources and combining retrospective, real time and prospective study designs, is necessary to address some of the more difficult patient safety problems. Evidence-based nursing is the current fashion. It is being touted as the mechanism to achieve best practice in the clinical setting. But while evidence-based practice is being presented in the literature, discussed at nursing practice forums, and evidence-based centres of excellence have developed, there seems to be very little impact in the practice that nurses deliver on a daily basis. The case in point is the collection of vital signs. While not historically a nursing skill, over the last 60 years (...) it has become an integral component of practice in the postoperative general surgical setting. The evidence to support these practices is scant. Policies and text purport traditional routine-regulated practice without substantive evidence to support their claims. These policies are being used to control rather than support EBP. In conjunction with the traditional practice of vital sign collection and the culture of the clinical settings, the policies are limiting opportunities for clinicians to make individual decisions about care delivery based on the unique needs of each patient. Rather than focusing on EBP as the solution to the development of best practice, is it not time to change the focus to real strategies that will assist in achieving best practice? These include the creation of rigorous relevant evidence, the valuing of clinical expertise and the changing of the cultures in which nurses develop and practice. (shrink)

How effectively communities of scientists come together and co-operate is crucial both to the quality of research outputs and to the extent to which such outputs integrate insights, data and methods from a variety of fields, laboratories and locations around the globe. This essay focuses on the ensemble of material and social conditions that makes it possible for a short-term collaboration, set up to accomplish a specific task, to give rise to relatively stable communities of researchers. We refer to these (...) distinctive features as repertoires, and investigate their development and implementation across three examples of collaborative research in the life sciences. We conclude that whether a particular project ends up fostering the emergence of a resilient research community is partly determined by the degree of attention and care devoted by researchers to material and social elements beyond the specific research questions under consideration. This book addresses the problem of how to make democratically-legitimate public policy on issues of contentious bioethical debate. It focuses on ethical contests about research and their legitimate resolution, while addressing questions of political legitimacy. How should states make public policy on issues where there is ethical disagreement, not only about appropriate outcomes, but even what values are at stake? What constitutes justified, democratic policy in such conflicted domains? Case studies from Canada and Australia demonstrate that two countries sharing historical (...) and institutional characteristics can reach different policy responses. This book is of interest to policymakers, bioethicists, and philosophers, and will deepen our understanding of the interactions between large-scale socio-political forces and detailed policy problems in bioethics. This essay discusses the ancient Greek philosophical ideas on the sense of smell. It sets out the difficulties of interpreting our source material and proposes to see the range of views from a developmental perspective, highlighting the deep influence the Peripatetic model of the golden mean has had on the way in which the early history of smell became known to us.

Contemporary medical education must train skilled and compassionate health care professionals who are rigorous in their approach to patient care and their pursuit of knowledge and solutions. Problem-based learning has been widely introduced, but there is no evidence that it leads to better outcomes than more traditional programs, and fundamental gaps in conceptual knowledge may result. Recently, emphasis has been placed on a solid grounding in underlying concepts combined with a systems-based approach, and ability to transfer information and solve problems. (...) Integrating traditional scientific and clinical disciplines with progressive and continuous assessment, may be a better means of achieving the combined aims of clinically relevant curriculum design, vertical integration of medical knowledge, and facilitation of the continuum of training. Being adaptable and flexible, cognisant of costs, and driven by evidence are key features of delivering medical education and contemporary medical practice. Educational research should lead to continuous improvement, but innovation without evaluation and attention to costs may create as many, or more, problems as are solved. (shrink)

Aim This paper presents a discussion of the role of the philosophy of pragmatism in the Joanna Briggs meta-aggregative approach to qualitative evidence synthesis. Background An increasing number of qualitative evidence syntheses are being published in journals, many of them influenced by an interpretive or a critical-realist perspective. One approach to qualitative evidence synthesis is meta-aggregation. Originally designed to model the transparency, auditability and reliability of the established process for effectiveness reviews, meta-aggregation makes a case for the production of synthesized (...) statements that refer to 'lines of action' informing decision-making at the clinical or policy level. Data sources This paper draws from the literature written on the philosophy of pragmatism and from the user guidance on meta-aggregation developed by the Joanna Briggs Institute between 2004 and 2007. Discussion Meta-aggregation as a methodology is founded on the principles and assumptions of the philosophical traditions of pragmatism. Meta-aggregation can only reach its full potential if the 'lines of action' suggested will somehow be supported by measures of effectiveness, as demonstrated in mixed method research. Implications for nursing The 'lines of action' presented as the result of a meta-aggregative synthesis are directive in nature and inform healthcare practitioners at the point of practical decision-making. Conclusion The real verification of the 'lines of action' suggested in a meta-aggregation consists of the satisfactorily ending consequences, mental or physical, which the synthesized statements that summarize the basic ideas emerging from the studies are able to generate in end users. PURPOSE: The paper aims to consider the underlying premises of Peter Drucker’s managerial writing and focuses on three main aspects: humans and relations, an evolutionary perspective and a pragmatic perspective. These ontological views are taken to a new level and applied to explore the world of networked firms. DESIGN AND METHODOLOGY AND APPROACH: The paper is a conceptual contribution based on a literature study by the author. FINDINGS: An examination of Drucker’s ontology shows how his world perspective led him to (...) an understanding of managers and organisations. The three elements of his ontology discussed are applied to research in business networks. RESEARCH LIMITATIONS AND IMPLICATIONS: The paper argues for research on human perspectives of business relationships and networks, particularly of issues such as time, timing, partner integration, relational and network embeddedness, network sensing, network horizons, and network identity. PRACTICAL IMPLICATIONS: Drucker’s ontological view enabled him to make pronouncements that cut through to the truth of reality in our organisationally shaped world. Understanding Drucker’s ontology provides managers with ways to deepen their understanding of an individual’s role at every level within an organisation. ORIGINALITY AND VALUE: The linking of Drucker’s ontology to research on new ways to organise and manage networked firms opens areas of future research. (shrink)
