Health care is transitioning from genetics to genomics, in which single-gene testing for diagnosis is being replaced by multi-gene panels, genome-wide sequencing, and other multi-genic tests for disease diagnosis, prediction, prognosis, and treatment. This health care transition is spurring a new set of increased or novel liability risks for health care providers and test laboratories. This article describes this transition in both medical care and liability, and addresses 11 areas of potential increased or novel liability risk, offering recommendations to both (...) health care and legal actors to address and manage those liability risks. The scope and severity of the opioid epidemic in the United States has prompted significant legislative intrusion into the patient-physician relationship. These proscriptive regulatory regimes mirror earlier legislation in other politically-charged domains like abortion and gun regulation. We draw on lessons from those contexts to argue that states should consider integrating their responses to the epidemic with existing medical regulatory structures, making physicians partners rather than adversaries in addressing this public health crisis.

Title VI of the Civil Rights Act of 1964 and its implementing regulations prohibit federally-funded educational institutions and healthcare centers from engaging in disparate impact discrimination “on the ground of race, color, or national origin” in all of their operations.

Over the past three decades, two separate federal regulatory structures have emerged, each seeking to assure separate aspects of the integrity and ethics of research conducted using federal funding. One set of regulations is described in the Public Health Service Policies on Research Misconduct and relates to research misconduct, defined as consisting of fabrication of data or results, falsification of data and results, or plagiarism, in accordance with the federal‐wide definition adopted by the Office of Science and Technology Policy. The (...) second set of regulations, set forth in the Department of Health and Human Services regulations on the protection of human subjects (known as the “Common Rule”), prescribes a set of ethical and procedural protections for research involving human subjects.These two sets of research regulations are distinguished from each other by having different foci of enforcement, priorities of protection, oversight officials, oversight procedures, seizure of evidence, standards of proof, expectations of privacy, and appeal procedures for researchers who are subject to adverse findings and penalties. These differences are significant and fundamental. They complicate the process of compliance for institutions and researchers, who are expected to adhere to both sets of standards for the same federally funded research activities in research with human subjects. Compliance is especially complicated when suspected violations of both sets of standards must be investigated and resolved concurrently. This document represents an effort to provide institutions and individuals with practical suggestions as they try to comply with both sets of regulations. (shrink)

The revised Common Rule includes a new option for the conduct of secondary research with identifiable data and biospecimens: regulatory broad consent. Motivated by concerns regarding autonomy and trust in the research enterprise, regulators had initially proposed broad consent in a manner that would have rendered it the exclusive approach to secondary research with all biospecimens, regardless of identifiability. Based on public comments from both researchers and patients concerned that this approach would hinder important medical advances, however, regulators decided to (...) largely preserve the status quo approach to secondary research with biospecimens and data. The Final Rule therefore allows such research to proceed without specific informed consent in a number of circumstances, but it also offers regulatory broad consent as a new, optional pathway for secondary research with identifiable data and biospecimens. In this article, we describe the parameters of regulatory broad consent under the new rule, explain why researchers and research institutions are unlikely to utilize it, outline recommendations for regulatory broad consent issued by the Secretary's Advisory Committee on Human Research Protections, and sketch an empirical research agenda for the sorts of questions about regulatory broad consent that remain to be answered as the research community embarks on Final Rule implementation. Little research has explored the possible effects of government institutions in emerging economies on ethical reviews of multinational research. We conducted semi-structured, in-depth telephone interviews with 15 researchers, Research Ethics Committees personnel, and a government agency member involved in multinational HIV Prevention Trials Network research in emerging economies. Ministries of Health or other government agencies often play pivotal roles as facilitators or barriers in the research ethics approval process. Government agency RECs reviewing protocols may face particular challenges, as they can (...) lack resources, be poorly organized, have inconsistent review processes and limited expertise, and use differing definitions of national interests, including upholding national reputation and avoiding potential exploitation and stigma of the country's population. The MOH/governmental review body may be affected by power dynamics and politics in study reviews; may consider issues both related and unrelated to research ethics as understood elsewhere; and may prioritize particular diseases, treatments, or interventions over other topics/types of research. Poor communication and deeply-rooted tensions may exist between sponsor and host countries, impeding optimal interactions and reviews. Investigators must understand and plan for the potential effects of governmental agencies on multinational collaborative research, including preserving adequate time for agency review, and contacting these agencies beforehand to address issues that may arise. Better understanding of these issues can aid and advance appropriate global scientific collaboration. (shrink)

I. EXECUTIVE SUMMARY The MRCT Center Post-trial Responsibilities: Continued Access to an Investigational Medicine Framework outlines a case-based, principled, stakeholder approach to evaluate and guide ethical responsibilities to provide continued access to an investigational medicine at the conclusion of a patient’s participation in a clinical trial. The Post-trial Responsibilities (PTR) Framework includes this Guidance Document as well as the accompanying Toolkit. A 41-member international multi-stakeholder Workgroup convened by the Multi-Regional Clinical Trials Center of Brigham and Women’s Hospital and Harvard University (...) (MRCT Center) developed this Guidance and Toolkit. Project Motivation A number of international organizations have discussed the responsibilities stakeholders have to provide continued access to investigational medicines. The World Medical Association, for example, addressed post-trial access to medicines in Paragraph 34 of the Declaration of Helsinki (WMA, 2013): “In advance of a clinical trial, sponsors, researchers and host country governments should make provisions for post-trial access for all participants who still need an intervention identified as beneficial in the trial. This information must also be disclosed to participants during the informed consent process.” This paragraph and other international guidance documents converge on several consensus points: • Post-trial access (hereafter referred to as “continued access” in this Framework [for terminology clarification – see definitions]) is the responsibility of sponsors, researchers, and host country governments; • The plan for continued access should be determined before the trial begins, and before any individual gives their informed consent; • The protocol should delineate continued access plans; and • The plan should be transparent to potential participants and explained during the informed consent process. -/- However, there is no guidance on how to fulfill these responsibilities (i.e., linking specific responsibilities with specific stakeholders, conditions, and duration). To fill this gap, the MRCT Center convened a working group in September of 2014 to develop a framework to guide stakeholders with identified responsibilities. This resultant Framework sets forth applicable principles, approaches, recommendations and ethical rationales for PTR regarding continued access to investigational medicines for research participants. This paper examines one of the historical antecedents of Big Data, the social physics movement. Its origins are in the scientific revolution of the 17th century in Western Europe. But it is not named as such until the middle of the 19th century, and not formally institutionalized until another hundred years later when it is associated with work by George Zipf and John Stewart. Social physics is marked by the belief that large-scale statistical measurement of social variables reveals underlying relational (...) patterns that can be explained by theories and laws found in natural science, and physics in particular. This larger epistemological position is known as monism, the idea that there is only one set of principles that applies to the explanation of both natural and social worlds. Social physics entered geography through the work of the mid-20th-century geographer William Warntz, who developed his own spatial version called “macrogeography.” It involved the computation of large data sets, made ever easier with the contemporaneous development of the computer, joined with the gravitational potential model. Our argument is that Warntz's concerns with numeracy, large data sets, machine-based computing power, relatively simple mathematical formulas drawn from natural science, and an isomorphism between natural and social worlds became grounds on which Big Data later staked its claim to knowledge; it is a past that has not yet passed. In this paper I defend the view that knowledge is belief for reasons that are both objectively and subjectively sufficient from an important objection due to Daniel Whiting, in this journal. Whiting argues that this view fails to deal adequately with a familiar sort of counterexample to analyses of knowledge, fake barn cases. I accept Whiting’s conclusion that my earlier paper offered an inadequate treatment of fake barn cases, but defend a new account of basic perceptual reasons that is consistent (...) with the account of knowledge and successfully deals with fake barns. The adoption of personalisation as the principle on which policy and practices for social care in England should be developed has been hailed as marking a fundamental transformation in the nature of social care and the experiences of service users. This article examines both the discourse of personalisation and the practices that are being adopted to implement this from an ethic of care perspective. It adopts an approach based on Sevenhuijsen's ‘Trace’ analysis to trace the normative frameworks in key policy (...) documents (in particular Putting People First), noting that critics of care have largely succeeded in relegating care to a marginal position within policy discourse and that a relational sensibility is largely absent within this. The article considers the practices associated with personalisation in relation to the moral principles of an ethic of care and conceptions of the ‘individual’ within these. It addresses the implications of this approach for broader political and policy issues: the universality of provision, collective responsibility for welfare and well-being, and broader issues of social justice in conditions of vulnerability. In this article it is argued that social power can be created based upon either the reproduction of social order or coercively but that in complex societies the former is the more important. Building upon the ideas of a number of authors - including Arendt, Parsons, Barnes, Bachrach and Baratz, Lukes, Giddens, Foucault and Clegg - a typology of seven forms of power creation is developed in a manner which allows for diverse phenomena from previously divergent perspectives to be (...) woven together into a theoretical whole which renders them commensurable. At the foundational level, social order presupposes the recreation of shared meanings which enable actors to act in collaboration in a way which they could not otherwise do. This observation is used as the basic premise from which to re-examine the reproduction of social order and the relationship between power, structure and knowledge. Perhaps Butler is too dismissive of the emancipatory potential of the liberal tradition and could do more to show how mania and the “fiction” of a relational self can be mobilized to turn violent self-preservation into nonviolent, collective-self-preservation. Nevertheless, her call to build a radically egalitarian world—based on the commitment to a daily practice of deidentifying with even our deepest convictions if they problematize viewing any life as anything less than incalculably valuable—invokes the sublime, nonviolent force of Mandela, King, and (...) Gandhi. Butler does all this in a manner capable of grappling with the multiple, competing streams in popular discourse that have led to such voices losing status as the wisest, most radical, and pragmatic life affirmations in the history of our species. The ability to hold up the nonviolent beacon of humanity to the best postmodern scrutiny marks Butler’s latest book as an essential message for our shared human community, standing, as we do, at the precipice where boundless life-affirmation meets unimaginable destructiveness. Claudian thus omits any account of Rufinus' activities during the campaign of Theodosius against Eugenius in 394 and the emperor's last months in Italy. This co-edited volume compares Chinese and Western experiences of engineering, technology, and development. In doing so, it builds a bridge between the East and West and advances a dialogue in the philosophy of engineering. Divided into three parts, the book starts with studies on epistemological and ontological issues, with a special focus on engineering design, creativity, management, feasibility, and sustainability. Part II considers relationships between the history and philosophy of engineering, and includes a general argument for the necessity of dialogue (...) between history and philosophy. It continues with a general introduction to traditional Chinese attitudes toward engineering and technology, and philosophical case studies of the Chinese steel industry, railroads, and cybernetics in the Soviet Union. Part III focuses on engineering, ethics, and society, with chapters on engineering education and practice in China and the West. The book’s analyses of the interactions of science, engineering, ethics, politics, and policy in different societal contexts are of special interest. The volume as a whole marks a new stage in the emergence of the philosophy of engineering as a new regionalization of philosophy. This carefully edited interdisciplinary volume grew out of an international conference on the philosophy of engineering hosted by the University of the Chinese Academy of Sciences in Beijing. Mark Jago presents an original philosophical account of meaningful thought: in particular, how it is meaningful to think about things that are impossible. We think about impossible things all the time. We can think about alchemists trying to turn base metal to gold, and about unfortunate mathematicians trying to square the circle. We may ponder whether God exists; and philosophers frequently debate whether properties, numbers, sets, moral and aesthetic qualities, and qualia exist. In many philosophical or mathematical debates, when (...) one side of the argument gets things wrong, it necessarily gets them wrong. As we consider both sides of one of these philosophical arguments, we will at some point think about something that’s impossible. Yet most philosophical accounts of meaning and content hold that we can’t meaningfully think or reason about the impossible. -/- In The Impossible, Jago argues that we often gain new information, new beliefs, and, sometimes, fresh knowledge through logic, mathematics, and philosophy. That is why logic, mathematics, and philosophy are useful. We therefore require accounts of knowledge and belief, of information and content, and of meaning which allow space for the impossible. Jago’s aim in this book is to provide such accounts. He gives a detailed analysis of the concept of hyperintensionality, whereby logically equivalent contents may be distinct, and develops a theory in terms of possible and impossible worlds. If the world itself is metaphysically indeterminate in a specified respect, what follows? In this paper, we develop a theory of metaphysical indeterminacy answering this question.

It is time to bring the rich resources of these traditions into the contemporary debate about the nature of self. This volume is the first of its kind.

Nondescriptivist views in many areas of philosophy have long been associated with the commitment that in contrast to other domains of discourse, there are no propositions in their particular domain. For example, the ‘no truth conditions’ theory of conditionals1 is understood as the view that conditionals don’t express propositions, noncognitivist expressivism in metaethics is understood as advocating the view that there are not really moral propositions,2 and expressivism about epistemic modals is thought of as the view that there is no (...) such thing as the proposition that Jack might be at home, over and above the proposition that Jack is at home.3 Of course, it is nearly always acknowledged that advocates of a nondescriptivist theory need not deny that there are conditional, moral, or modal propositions ‘at the end of the day’ – for if they also endorse a deflationary reading of talk about propositions, as famously advocated by Simon Blackburn, then they can employ such deflationary talk just as much as the rest of us. They just don’t appeal to propositions to do any of the work in their theories. Rather, they ‘earn the right’ to talk about propositions.4 It is the aim of this paper to upset this way of thinking about the proper attitude of nondescriptivists toward propositions, and to advocate a more constructive and in some ways more radical alternative on behalf of the nondescriptivist. I will begin by introducing and developing a set of problems that are faced by any nondescriptivist theory which tries to do without propositions. All of these problems are easily solved by any view which postulates propositions across the board, but none of them are solved by merely deflationary talk about propositions – their most promising solutions require propositions to do real theoretical work, and therefore the problems themselves remind us of and illustrate some of the important reasons why it is worth positing propositions in the first place.. Gaining information can be modelled as a narrowing of epistemic space . Intuitively, becoming informed that such-and-such is the case rules out certain scenarios or would-be possibilities. Chalmers’s account of epistemic space treats it as a space of a priori possibility and so has trouble in dealing with the information which we intuitively feel can be gained from logical inference. I propose a more inclusive notion of epistemic space, based on Priest’s notion of open worlds yet which contains only those (...) epistemic scenarios which are not obviously impossible. Whether something is obvious is not always a determinate matter and so the resulting picture is of an epistemic space with fuzzy boundaries. (shrink)

I discuss three ways of responding to the logical omniscience problems faced by traditional ‘possible worlds’ epistemic logics. Two of these responses were put forward by Hintikka and the third by Cresswell; all three have been influential in the literature on epistemic logic. I show that both of Hintikka's responses fail and present some problems for Cresswell’s. Although Cresswell's approach can be amended to avoid certain unpalatable consequences, the resulting formal framework collapses to a sentential model of knowledge, which defenders (...) of the ‘possible worlds’ approach are frequently critical of. During multiple testing, researchers often adjust their alpha level to control the familywise error rate for a statistical inference about a joint union alternative hypothesis (e.g., “H1,1 or H1,2”). However, in some cases, they do not make this inference. Instead, they make separate inferences about each of the individual hypotheses that comprise the joint hypothesis (e.g., H1,1 and H1,2). For example, a researcher might use a Bonferroni correction to adjust their alpha level from the conventional level of 0.050 to 0.025 (...) when testing H1,1 and H1,2, find a significant result for H1,1 (p < 0.025) and not for H1,2 (p > .0.025), and so claim support for H1,1 and not for H1,2. However, these separate individual inferences do not require an alpha adjustment. Only a statistical inference about the union alternative hypothesis “H1,1 or H1,2” requires an alpha adjustment because it is based on “at least one” significant result among the two tests, and so it refers to the familywise error rate. Hence, an inconsistent correction occurs when a researcher corrects their alpha level during multiple testing but does not make an inference about a union alternative hypothesis. In the present article, I discuss this inconsistent correction problem, including its reduction in statistical power for tests of individual hypotheses and its potential causes vis-à-vis error rate confusions and the alpha adjustment ritual. I also provide three illustrations of inconsistent corrections from recent psychology studies. I conclude that inconsistent corrections represent a symptom of statisticism, and I call for a more nuanced inference-based approach to multiple testing corrections. (shrink)

Predictivism asserts that novel confirmations carry special probative weight. Epistemic pluralism asserts that the judgments of agents (about, e.g., the probabilities of theories) carry epistemic import. In this paper, I propose a new theory of predictivism that is tailored to pluralistic evaluators of theories. I replace the orthodox notion of use-novelty with a notion of endorsement-novelty, and argue that the intuition that predictivism is true has two roots. I provide a detailed Bayesian rendering of this theory and argue that pluralistic (...) theory evaluation pervades scientific practice. I compare my account of predictivism with those of Maher and Worrall.
