We provide a retrospective of 25 years of the International Conference on AI and Law, which was first held in 1987. Fifty papers have been selected from the thirteen conferences and each of them is described in a short subsection individually written by one of the 24 authors. These subsections attempt to place the paper discussed in the context of the development of AI and Law, while often offering some personal reactions and reflections. As a whole, the subsections build into (...) a history of the last quarter century of the field, and provide some insights into where it has come from, where it is now, and where it might go. Le mouvement général des sciences est de fournir les moyens théoriques d'une reconstruction des phénomènes, en élaborant des lois explicitant leurs régularités sous-jacentes. Aujourd'hui, l'attitude générale en sciences repose sur l'a priori des déterminismes, quelle que soit leur forme. La pensée humaine, dans ses rapports au monde, est une confrontation permanente aux systèmes complexes qui nous habitent et dans lesquels nous habitons. Chacun des systèmes possède une histoire propre qui le rend singulier et source continue de surprises. On se prend (...) à le penser comme système autonome avec ses lois et ses degrés de liberté interne. Quand il s'agit de penser l'être humain, la tentation est encore plus forte de lui prêter un libre arbitre. La question fondamentale est donc celle de la compatibilité entre la pensée scientifique en quête de déterminismes, et la compréhension des complexités, génératrice d'indéterminismes. Comment obtenir une conciliation quand, de la physique à l'éthique, en passant par la cellule biologique, les êtres multicellulaires et les sociétés, on remonte les niveaux d'organisation? Peut-on y parvenir quant à l'être humain et la société sans remettre en question certains aspects cruciaux comme la responsabilité et l'éthique? Ce livre a pour but de revisiter ce débat fondamental, auquel fleuri Atlan a consacré une grande partie de son œuvre, en s'appuyant, d'une part, sur les approches récentes de la modélisation des systèmes complexes et, d'autre part, sur la tradition philosophique multimillénaire. Dans l'œuvre immense de Benedetto Croce (1866-1952) l'esthétique occupe une place centrale. Philosophe peu orthodoxe inspiré par les pensées de Kant et de Vico il a profondément marqué la culture italienne. Associé souvent à Gentile avec lequel il a rompu en 1925, en s'opposant au fascisme, il a réfléchi toute sa vie à une philosophie immanentiste de l'Esprit où l'esthétique trouverait sa place à côté d'une logique, d'une philosophie de la pratique et d'une économie ou philosophie de l'utile. L'influence de (...) Croce s'exerça non seulement sur les philosophes mais aussi sur des historiens de l'art comme Lionello Venturi, Carlo Ludovico Ragghianti, Julius Schlosser, Hans Sedlmayr ou encore Herbert Read et Pierre Francastel qui en discutèrent les thèses. Le Bréviaire d'esthétique (1912) rassemble quatre conférences destinées à un public nord-américain à l'invitation du " Rice Institute " qui ouvrait alors ses portes au Texas. Ces conférences jamais prononcées furent néanmoins publiées en anglais dès 1913, et marquent une étape importante dans la réflexion esthétique du philosophe napolitain qui qualifie alors l'art d'" intuition lyrique ". À ces conférences furent ajoutés plus tard deux autres textes ici traduits. Lire Croce aujourd'hui permet de revenir à la source d'un ensemble de questions auxquelles l'esthétique contemporaine est confrontée tout en découvrant une pensée qui, bien que souvent hostile à certaines manifestations de l'art de son temps (D'Annunzio ou les futuristes par exemple), restait paradoxalement ouverte à ses transformations qu'elle recommandait de saisir dans leur singularité et leur mouvement propre. D'où une conception particulière de la critique et de ses rapports avec l'histoire de l'art que l'on trouvera ici exposée. (shrink)

We study human performance in two classical NP‐hard optimization problems: Set Cover and Maximum Coverage. We suggest that Set Cover and Max Coverage are related to means selection problems that arise in human problem‐solving and in pursuing multiple goals: The relationship between goals and means is expressed as a bipartite graph where edges between means and goals indicate which means can be used to achieve which goals. While these problems are believed to be computationally intractable in general, they become more (...) tractable when the structure of the network resembles a tree. Thus, our main prediction is that people should perform better with goal systems that are more tree‐like. We report three behavioral experiments which confirm this prediction. Our results suggest that combinatorial parameters that are instrumental to algorithm design can also be useful for understanding when and why people struggle to choose between multiple means to achieve multiple goals. Kant’s critique/doctrine distinction tracks the difference between a canon for the understanding’s proper use and an organon for its dialectical misuse. The latter reflects the dogmatic use of reason to attain a doctrine of knowledge with no antecedent critique. In the 1790s, Fichte collapses Kant’s distinction and redefines dogmatism. He argues that deriving a canon is essentially dialectical and thus yields an organon: critical idealism is properly a doctrine of science or Wissenschaftslehre. Criticism is furthermore said to refute dogmatism, by (...) which Fichte means Spinozism. Schelling repudiates Fichte’s position in his Philosophical Letters by reviving Kant’s distinction. First, ‘critique’ for Schelling names a canon that is valid for all systems—including Spinozism—and thus favours none—not even the Wissenschaftslehre. Second, Schelling coins ‘dogmaticism’ to refer to what Kant calls ‘dogmatism’: reason’s uncritical claim to doctrine. Hence, he says all systems—even Fichte’s—are susceptible to the ‘enthusiasm’ of mistaking themselves for doctrines or ‘objects of knowledge’, instead of subjectively valid ‘objects of freedom’. I reconstruct Schelling’s argument for reviving Kant’s distinction, while noting two consequences for German idealism. First, if criticism favours no system, a system’s origin cannot be an act of knowledge, e.g., intellectual intuition, but only an act of endorsement. Second, if dogmaticism entails enthusiasm, a system’s goal cannot be absolute knowledge, but only infinite striving. Hence, by retrieving Schelling’s notion of dogmaticism, we can both gain a better understanding of the Letters and register the impact of a core Kantian distinction on the German idealist project. This book presents G. A. Cohen's Gifford Lectures, delivered at the University of Edinburgh in 1996. Focusing on Marxism and Rawlsian liberalism, Cohen draws a connection between these thought systems and the choices that shape a person's life. In the case of Marxism, the relevant life is his own: a communist upbringing in the 1940s in Montreal, which induced a belief in a strongly socialist egalitarian doctrine. The narrative of Cohen's reckoning with that inheritance develops through a series of sophisticated (...) engagements with the central questions of social and political philosophy. In the case of Rawlsian doctrine, Cohen looks to people's lives in general. He argues that egalitarian justice is not only, as Rawlsian liberalism teaches, a matter of rules that define the structure of society, but also a matter of personal attitude and choice. Personal attitude and choice are, moreover, the stuff of which social structure itself is made. Those truths have not informed political philosophy as much as they should, and Cohen's focus on them brings political philosophy closer to moral philosophy, and to the Judeo-Christian ethical tradition, than it has recently been. Fichte assigns ‘intellectual intuition’ a new meaning after Kant. But in 1799, his doctrine of intellectual intuition is publicly deemed indefensible by Kant and nihilistic by Jacobi. I propose to defend Fichte’s doctrine against these charges, leaving aside whether it captures what he calls the ‘spirit’ of transcendental idealism. I do so by articulating three problems that motivate Fichte’s redirection of intellectual intuition from being to acting: (1) the regress problem, which states that reflecting on empirical facts of consciousness leads (...) only to further facts and so cannot yield a first principle; (2) the rhapsody problem, which states that the categories form a haphazard set and so lack necessity unless they derive from a first principle; and (3) the nihilism problem, which states that a first principle cannot lie outside our cognition of it, lest it be the cause of our cognition and, being first, the cause of all our actions, reducing us to machines. Crucially, Fichte’s three motivating problems are in fact aspects of a single problem. Leaving any aspect unsolved spoils putative solutions to the other two. Consequently, Fichte requires a single unified solution to all three, which his doctrine of intellectual intuition provides. (shrink)

The author considers situations in which there are sufficient conditions for a certain choice or action to be performed by someone, So that it is impossible for the person to choose or to do otherwise, But in which these conditions do not in any way bring it about that the person chooses or acts as he (...) does. In such situations the person may well be morally responsible for what he chooses or does despite his inability to choose or to do otherwise. There is growing interest in the use of neurointerventions to reduce the risk that criminal offenders will reoffend. Commentators have raised several ethical concerns regarding this practice. One prominent concern is that, when imposed without the offender’s valid consent, neurointerventions might infringe offenders’ right to bodily integrity. While it is commonly held that we possess a moral right to bodily integrity, the extent to which this right would protect against such neurointerventions is as-yet unclear. In this paper, we will assess (...) whether, why, and how severely three forms of neurointervention might infringe the right to bodily integrity. We show that the severity of the infringement of the right to bodily integrity differs across different forms of neurointervention. Moreover, we argue that mental and behavioral effects of neurointerventions could in some cases be relevant to determining the severity of infringements of the right to bodily integrity. (shrink)

In the Vocation of Man, Fichte makes the striking claim that life is eternal, rational, our true being, and the final cause of nature in general and of death in particular. How can we make sense of this claim? I argue that the public lectures that compose the Vocation are a popular expression of Fichte’s pre-existing commitment to what I call immortalism, the view that life is the unconditioned condition of intelligibility. Casting the I as an absolutely self-active or living (...) power enables his philosophical account of both the intelligibility of objects and of what it means to die. This explains his characterization of the Wissenschaftslehre as a system in which ‘all is act, movement, and life’. In Sect. 1, I explain the context of Jacobi’s use of ‘caput mortuum’ as a term for the thing in itself. In Sects. 2 and 3, I reconstruct two immortalist arguments from Fichte’s Jena period. The first is that the I’s self-activity rules out the existence of the thing in itself and thereby vanquishes ‘death’s head’. The second is that, insofar as the I charges us with the moral perfection of nature, it is the final cause of our entire life, including its end. This is to say that the I puts our every moment into question, even our last. In Sect. 4, I use these immortalist arguments to interpret the striking claim from the Vocation. (shrink)

This paper looks at what David Kaplan's work on indexicals can teach us about logic and the philosophy of logic, and also what Kaplan's logic (i.e. the Logic of Demonstratives) can teach us about indexicals. The lessons are i) that logical consequence is not necessary truth-preservation, ii) that that the linguistic doctrine of necessary truth (also called conventionalism about modality) fails, and iii) that there is a kind of barrier to entailment between non-context-sensitive and context-sensitive claims.

Throughout his career, Schelling assigns knowledge of the absolute first principle of philosophy to intellectual intuition. Schelling's doctrine of intellectual intuition raises two important questions for interpreters. First, given that his doctrine undergoes several changes before and after his identity philosophy, to what extent can he be said to “hold onto” the same “sense” of it by the 1830s, as he claims? Second, given that his doctrine of intellectual intuition restricts absolute idealism to what he calls a “science of reason”, (...) which he says cannot prove the absolute’s existence, what other doctrine does he require in order to prove this? I will answer these questions by tracing the shifts in Schelling’s doctrine of intellectual intuition from the 1790s to the 1830s and drawing out its evolving methodological role within his science of intelligibility. La théologie de Karl Rahner mérite-t-elle le label de «classique»? Pour instruire le débat, l’article présente quatre dissertations doctorales récentes , ainsi qu’un ouvrage collectif, consacrés à l’oeuvre de Rahner. Nature et grâce, christologie et triadologie, théologie et anthropologie, athéisme et sciences naturelles, expérience et subjectivité, épistémologie et apologétique: les thèmes abordés par ces études témoignent de la diversité des questions traitées par le corpus rahnérien. De cet examen, trois lignes de force caractéristiques du style de cette théologie peuvent être (...) dégagées: modestie du langage théologique, rigueur des critères de validation, audace spéculative et systématique. En contrepoint critique, trois questions peuvent légitimement être avancées concernant l’universalité du langage employé et de l’expérience décrite, la fidélité au mystère et les points aveugles du système. Il y a fort à parier que l’avenir confirme le diagnostic qui s’impose à l’issue de cette étude, à savoir qu’il convient de considérer Rahner comme un classique de la discipline théologique pour avoir proposé, en un moment critique de son histoire, une voie de renouvellement tout à la fois grandiose et contestable. Le thème de l’identité s’invite aux débats de la conscience collective. L’importance que lui accordent les théories sociale, éthique ou politique contemporaines est le signe d’une situation inédite, dont il revient au théologien de prendre la mesure. Qu’est-ce que l’intelligence de la foi peut, en ce lieu si contemporain, recevoir et donner? Le présent essai se propose, dans une première étape, de présenter à grands traits les analyses convergentes sur l’entrée dans l’ère de l’identité, qui coïncide avec l’ère de l’individu (...) émietté et des sociétés fragmentées, soumises à un processus d’accélération inédit. Dans une deuxième étape, on s’interrogera sur le mode paradoxal selon lequel l’Évangile envisage d’accomplir la promesse d’être soi: une identité en suspens, à conjuguer au régime présent d’existence. Entre construction et subversion d’identité, le christianisme a développé une tradition de pensée qu’il revient à la théologie d’acclimater à l’ère de l’identité. Habiter le site de l’identité suppose l’invention d’un chemin concret où soit vécue la grâce d’être soi. (shrink)

The concept of facticity denotes conditions of experience whose necessity is not logical yet whose contingency is not empirical. Although often associated with Heidegger, Fichte coins ‘facticity’ in his Berlin period to refer to the conclusion of Kant’s metaphysical deduction of the categories, which he argues leaves it a contingent matter that we have the conditions of experience that we do. Such rhapsodic or factical conditions, he argues, must follow necessarily, independent of empirical givenness, from the I through a process (...) of ‘genesis.’ I reconstruct Fichte’s argument by tracing the origin of his neologism, presenting his Jena critique of Kant’s rhapsodic appeal to the forms of judgment, and illustrating the Jena period’s continuity with the Berlin period’s genetic method, while noting a methodological shift whereby Fichte directs his critique against his own doctrine of intellectual intuition in order to eliminate its ‘factical terms.’. Fichte argues that the conclusion of Kant’s transcendental deduction of the categories is correct yet lacks a crucial premise, given Kant’s admission that the metaphysical deduction locates an arbitrary origin for the categories. Fichte provides the missing premise by employing a new method: a genetic deduction of the categories from a first principle. Since Fichte claims to articulate the same view as Kant in a different, it is crucial to grasp genetic deduction in relation to the sorts of deduction that (...) Kant offers. I propose to interpret genetic deduction as the simultaneous fulfillment of two tasks: answering the question quid facti by deriving the categories from the I and answering the question quid juris by establishing our entitlement to the categories as conditions of experience. While the second task represents Fichte’s agreement with Kant’s transcendental deduction, the first reflects his correction of Kant’s metaphysical deduction. (shrink)

A precursor to the hard problem of consciousness confronts nihilism. Like physicalism, nihilism collides with the first-personal fact of what perception and action are like. Unless this problem is solved, nature’s inclusion of conscious experience will remain, as Chalmers warns the physicalist, an “unanswered question” and, as Jacobi chides the nihilist, “completely inexplicable". One advantage of Kant’s Copernican turn is to dismiss the question that imposes this hard problem. We need not ask how nature is accompanied by the first-person standpoint (...) because “I think” is an apperceptive form of thinking that must be able to accompany any cognition of nature. Kant’s formal conception of apperception worries Fichte in his Nova Methodo lectures. This conception arguably cannot exhaust the ground of experience, for it does not show why we posit objects “at all". For Fichte, it is our agency that first opens a world of objects, viz., as subjects, means, ends, and obstacles. In what follows, I argue that, for Fichte, the I poses no hard problem because it collides exclusively with nihilistic views like Spinozism, which are refuted by a properly transcendental idealist conception of apperception, according to which the first-person standpoint is the absolute ground of our experience of nature. If transcendental idealism refutes nihilism, nature is no more explicable than that there is something it is like for me to perceive and act. In Section 1, I show why Kantian apperception is necessary for possible experience. In Section 2, I reconstruct Fichte’s argument that a modified conception of apperception refutes guises of nihilism, thereby solving the hard problem of consciousness. In Section 3, I suggest that transcendental idealism undermines Chalmers’ proposed solution to and Dennett’s dismissal of this problem. (shrink)
