O alojamento do recluso no estabelecimento prisional deve respeitar a sua dignidade. Os dados oficiais, até dezembro de 2020, revelam sobrelotação em algumas prisões. Analisamos a problemática no foro constitucional, dos direitos de personalidade e do direito penitenciário, recorrendo a fontes legais e doutrinárias. Concluímos que a sobrelotação configura um problema que tem de ser ultrapassado e que existe um claro desfasamento entre a law in the books e a law in action.

The current work builds a definition of irritability from both academic definitions and lay perspectives. In Study 1, a quantitative content analysis of academic definitions resulted in eight main content categories. In Study 2, a community sample of 39 adults participated in qualitative interviews. A deductive thematic analysis resulted in two main themes. The first main theme dealt with how participants positioned irritability in relation to other negative states. The second dealt with how participants constructed irritability as both a loss (...) of control and as an experience that should be controlled. The discussion integrates the findings of both studies and provides a concise, but comprehensive definition. (shrink)

Using data from the 2010 Brazilian census, this paper aims to describe the religious profile of the indigenous population in Brazil. We analyzed information from more than 800,000 individuals. Our results show that indigenous population is mostly Christian that are separated into Catholics and Evangelicals. Moreover, we found a reduced number of people who declared themselves belonging to indigenous traditional religions. Finally, we present the religious profile of the indigenous population according to region, place of residence, age, and schooling.

IntroductionThere is a need to maintain rehabilitation activities and motivate movement and physical activity during quarantine in individuals with Cerebral Palsy.ObjectiveThis paper sets out to evaluate the feasibility and potential benefits of using computer serious game in a non-immersive virtual reality implemented and evaluated completely remotely in participants with CP for Home-Based Telerehabilitation during the quarantine period for COVID-19.MethodsUsing a cross-sectional design, a total of 44 individuals participated in this study between March and June 2020, 22 of which had CP (...) and 22 typically developing individuals, matched by age and sex to the individuals with CP. Participants practiced a coincident timing game1 and we measured movement performance and physical activity intensity using the rating of perceived exertion Borg scale.ResultsAll participants were able to engage with the VR therapy remotely, reported enjoying sessions, and improved performance in some practice moments. The most important result in this cross-sectional study was the significant increasing in rating of perceived exertion in both groups during practice and with CP presenting a higher rating of perceived exertion.ConclusionChildren with CP enjoyed participating, were able to perform at the same level as their peers on certain activities and increased both their performance and physical activity intensity when using the game, supporting the use of serious games for this group for home therapy and interactive games.Clinical Trials Registrationhttps://Clinicaltrials.gov, NCT04402034. O êxodo rural brasileiro compreendeu um processo de grande magnitude desde o seu início, onde, em comparativo, poucos países experimentaram fluxo migratório tão intenso, tendo em vista a quantidade absoluta da população atingida. Uma das características encontradas nos movimentos migratórios brasileiros se estabelece na diferenciação por sexo. Estudos apontam que as mulheres migram mais do que os homens, além do fluxo migratório se caracterizar cada vez mais pela saída de jovens do campo. Nesse sentido, o presente artigo se propõe a (...) analisar a categoria rural, abordando a situação das mulheres migrantes no contexto do Norte de Minas. Para tanto, utilizará do levantamento bibliográfico na construção de uma revisão acerca das práticas migratórias do campo realizadas por jovens, de modo a entender e problematizar a questão do gênero no processo migratório. Como resultado parcial tem-se que as mulheres continuam migrando, sendo tal deslocamento realizado com propósitos variados e, muitas vezes, devido à ausência de políticas públicas regionais, que resultam em pouca perspectiva de valorização do campo/gênero. Sendo assim, o processo migratório, principalmente no que diz respeito à questão de gênero, não se encerra nas discussões apresentadas, sendo necessários estudos que acompanhem as distintas dimensões que o migrar implica. O presente artigo consiste no registro de memórias de um diretor e de uma diretora que atuaram em escolas públicas de M inas Gerais, e na análise de suas narrativas. O objetivo foi captar suas representações sobre as práticas administrativas e pedagógicas rememoradas dos anos de exercício profissional. Com a metodologia da história oral, nossa investigação buscou construir uma interpretação a respeito de atitudes, posturas e práticas enraizadas nos rituais da escola contemporânea. Pudemos observar que no período estudado havia uma (...) política extremamente centralizada, cujas diretrizes eram difundidas pelos órgãos centrais da administração burocrática. O trabalho de gestão das unidades escolares era pautado, principalmente, pelo controle do cumprimento das normas estabelecidas pela política pública de educação. (shrink)

Kierkegaard nos mostra, em boa parte de suas obras, sua categórica rejeição em aceitar que a religião cristã pudesse ser reduzida a uma questão de cultura. Mesmo vivendo numa época em que muitos parecem aceitar essa premissa, o filósofo enfrenta inúmeras dificuldades para fazer valer seu posicionamento e, por outro lado, sua proposta parece, ao mesmo tempo, profundamente discutível e polêmica. O cristianismo parece se confundir com a cultura desde seus primórdios e, inclusive, talvez tenha dependido disso para sua sobrevivência (...) até a atualidade. Desse modo, a tese kierkegaardiana de recusa a uma ligação mais efetiva entre cristianismo e cultura não pode ter, em si mesma, um aspecto intolerante ou reacionário? Para investigar tal questão, almejamos analisar aspectos da obra kierkegaardiana e, a partir de um dado recorte, o contexto de implantação do cristianismo no fim do mundo antigo. (shrink)

En una primera parte analiza desde diversas perspectivas las críticas cada vez más fuertes a las teorías éticas imparcialistas y universalistas, que han suscitado a su vez el renacimiento del tratamiento de la amistad como fenómeno moral; dicho análisis pretende también llamar la atención sobre diversos puntos críticos de las llamadas teorías de la amistad. En una segunda parte se analiza el modelo aristotélico (...) de las amistades virtuosas, mostrando la estructura de este tipo de amistad y su relación con la ética, para resaltar así algunos puntos de la teoría aristotélica de la amistad que pueden ser de ayuda para una mejor comprensión del problema hoy en día. El artículo pretende aportar algunos trazos teóricos, metodológicos y prácticos para la lectura de la cuestión del Estado y el poder, desde la perspectiva de la gubernamentalidad sugerida por Foucault y sus herencias latinoamericanas. Se parte del supuesto de que en la actualidad argentina y salteña, la multiplicidad de lógicas y prácticas de gobierno que codifican al Estado y sus avatares encuentran una clara expresión en el gobierno de la pobreza y en los diagramas vinculares entre gobernados y gobernantes, tejidos (...) en los móviles del poder y la resistencia. En esta dirección, se delinean dos ejes expositivos. Por un lado, una analítica de los conceptos y cuestiones sugeridas desde la propuesta de la gubernamentalidad; por otro lado, una aproximación al gobierno de la pobreza y con ello a dos casos que dan cuenta del entramado relacional entre gobernados-gobernantes y prácticas de gobierno, resistencia y autogobierno entre las cuales se configura y re-configura el rol del Estado. Apostando a una “una ontología del presente”, se analizan formas de poder y resistencia que aún hoy en día se constituyen, reconfigurándose. Asimismo se sugiere un cruce metodológico entre genealogía y etnografía, en la apuesta a un ejercicio crítico de pensamiento a fines de contribuir a desnaturalizar y des-sustancializar las prácticas de gobierno, sus lógicas y nuestras conductas presentes. Igreja em cada uma da partes que compõem a Folia, desde a saída do Terno até chegar o dia da festa de Santos Reis. O texto procura mesclar reflexão teórica conceitual sobre a festa com os métodos de pesquisa da História Oral, a partir da observação in loco . Conclui com a constatação de que esta importante tradição popular mantem-se ainda muito viva e forte, não apenas na comunidade em foco, mas ainda na região do Triângulo Mineiro. Reconhece que seu sentido se modificou ao longo do tempo e procura afirmar que esta festa não sofre da 'ameça da extinção', como quer a doxa corrente, representada pela voz da mídia, pelos agentes das secretarias de cultura, pesquisadores acadêmicos ou ainda pelos próprios devotos. The authors begin with the premise that revelers, "party goers" ( festeiros ) and devotees are, in the fortunate expression of Carlos Rodrigues Brandão, "experts" in the knowledge of devotion, for they feel responsible to represent the Church in each of the component parts of the Folia, from the departure of the Terno (group of musicians) up to the celebration of the Three Kings. The text seeks to merge a theoretical conception about the party with the research methods of oral history, based on direct observation. In conclusion, it observes that this important folk tradition has been kept very much alive and strong, not only in the community that was the focus of this study, but also in the Triangulo Mineiro region. It acknowledges that the meaning of the party has changed over time and intends to assert that this party does not suffer from the 'threat of extinction', as wants to believe the current doxa , represented by the voices of the media, by the officials from the departments of culture, by academic researchers or even by their own devotees. This paper analyzes the ergodic hypothesis in the context of Boltzmann’s late work in statistical mechanics, where Boltzmann lays the foundations for what is today known as the typicality account. I argue that, based on the concepts of stationarity (of the measure) and typicality (of the equilibrium state), the ergodic hypothesis, as an idealization, is a consequence rather than an assumption of Boltzmann’s account. More precisely, it can be shown that every system with a stationary measure and an equilibrium state (...) (be it a typical state with respect to the phase space or the time average) behaves essentially as if it were ergodic. I claim that Boltzmann was aware of this fact as it grounds both his notion of equilibrium, relating it to the thermodynamic notion of equilibrium, and his estimate of the fluctuation rates. Forty years on, G. A. Cohen’s reconstruction and defence of Marx’s theory of history is still widely, and justifiably, considered the best of its kind, and it remains unsurpassed in clarity, argumentation and textual support. This article presents an under-explored critique of the theory that arises once we recognize that it is meant to apply to the circumstances of women as well as men. The article argues that, when extended to women, the reconstructed theory’s predictions fail to materialize, its characterizations (...) of historical stages fall apart, and its functional explanations appear implausible. In addition, although the theory claims to be able to explain the emergence and diffusion of different ideologies by their effects on productive development, it cannot plausibly explain the presence of sexist ideologies despite their pervasive and profound impact across history. The article concludes by showing that these flaws highlight the many respects in which Cohen’s orthodox version of Marxism is a conservative ideology, and one that egalitarians in particular should view with suspicion. Once we analyse the different components of the theory, the idea of a right-wing Marxism no longer seems as odd as it sounds. (shrink)

This article aims to contribute to a (post)extractivist aesthetics at a time of ontological shifts, meaning an aesthetics that focuses on the role of art in struggles for (post)extractivist worlds. First, it argues for a contextualized approach to the use of the extractivism framework and proposes that this framework is particularly productive for approaching the socio-environmental crisis due to the way it allows us to engage with the ontological basis of this crisis. The article then builds on empirical research conducted (...) in Argentina to develop the concept of prefigurative ontological design, one of the key functions, it is proposed, of artistic practice in anti- and post-extractivist movements. In this way, the article aims to expand our understanding of the potential of extractivism as a framework of analysis and contributes to the theorization of the relationship between art and extractivism through the lens of political ontology, offering new concepts for developing a (post)extractivist aesthetics. Individual decisions about how to exercise the legal right to procreative liberty may generate either positive or negative externalities. From within a resource egalitarian perspective, such as that of Ronald Dworkin, it can be argued that procreative justice is asymmetric in the following respect. Justice need not require that parents be subsidised if they produce a public good, yet its ideal achievement may require their activities be taxed if they threaten to produce a public bad.

The need to use green taxes to protect the environment is urgent, particularly because of climate change, and can be justified via sound deontological and consequence-based arguments. One very influential criticism of such taxes, however, claims that they disproportionately burden relatively poor individuals who tend to contribute to environmental problems far less than wealthier persons. Critics can also object that because of the link between economic inequality and environmental destruction it is preferable to adopt environmental measures that impede rather than (...) accelerate the growth of inequality. Defusing these criticisms, the article argues that various types of green fiscal reform can both avoid disproportionally burdening those who pollute least and reduce the economic inequalities that income taxes leave behind, and slow down the collectively self-defeating consumption arms race that currently besets so many affluent societies. Global progressive environmental taxation is also a possibility, and even easier to justify. (shrink)

This narrative scoping review examines ethical practice in educational and school psychology from a bioecological systems’ perspective. A search of four databases yielded 34 articles in the final narrative synthesis. Informed by Bronfenbrenner and Morris’ bioecological systems theory, the ethical experiences of educational and school psychologists were analyzed using the concepts of Process, Person, Context and Time. The complexity, intensity and frequency of ethical dilemmas are reviewed in Process. The demand, resource, and force characteristics impacting on psychologists as Person are (...) reviewed. Within Context, studies identified dilemmas that arose for psychologists across systems. In Time, issues including implications of the Fourth Industrial Revolution on psychologists’ ethical practice with the emergence of Artificial Intelligence are examined. This paper demonstrates the synergies and the interrelated influences on psychologists’ ethical practices arising from a systematic review of their experiences and their professional training needs. This paper is a response to H. Siegel’s “Arguing with Arguments” from a rhetorical perspective on argumentation. First I address Siegel’s concept of ‘argument in its abstract propositional sense’ and attempt to show that it is not at all an obvious object that should unquestionably be the privileged focus of argumentation theory. I then defend C. W. Tindale’s rhetorical perspective on argumentation against some of Siegel’s misreadings and also some of his legitimate disagreements regarding the relations between _persuasion_ and _rational_ (...) _justification_ and the way we should understand the source of argumentative normativity. Xenotransplantation is often deemed morally objectionable because of the costs it imposes on the organ donor and the risks it imposes on the recipient. For some, involving human–pig chimeras as donors makes the practice more objectionable or even abhorrent from the start. For others, by contrast, using such chimeras weakens recipient-based objections because it reduces the risk of organ rejection and malfunctioning, and cancels donor-based objections because the practice does not harm chimeras but instead gives them valuable lives they would (...) not otherwise have. The paper examines and eventually rejects the latter defense. It also discusses the additional risks of chimeric xenotourism in countries with less demanding procedural guidelines and reflects on two very different futures for humanity that may emerge from supporting or rejecting chimeric xenotransplantation. Social robots are an increasingly integral part of society, already appearing as customer service assistants, care-home helpers, teaching assistants and personal companions. This book argues that the wider inclusion of social robots in our society is having a revolutionary impact on some of our key intuitions regarding ethics, metaphysics and epistemology and, as such, will put pressure on many of our best theories. Social robots elicit an emotional and social response in humans that some have taken to be evidence that (...) robots deserve moral consideration. Others have argued that, as robots are only machines, we should avoid designing robots that encourage emotional engagement. The fictional dualism model provides a new way for us to view social robots and a new route for our continued relationship with them. When we engage with a social robot, we create a fictional overlay that has wants, needs and desires. Our emotional attachment to social robots is a natural continuation of our relationship to fiction: a life-enhancing and important connection, but not one that prompts moral consideration for the fictional entity. In this book, Paula Sweeney shows how the fictional dualism model of social robots differs from other popular models. In addition to providing a distinctive and ethically appropriate framework for emotional engagement without moral consideration, the model provides conditions for trusting social robots and, uniquely, allows us to individuate social robots as distinct persons, even in contexts in which they share a collective mind. This paper discusses Philippe Van Parijs’ claim that men’s lack of female longevity constitutes an injustice, whether this is caused by asocial factors or by gendered lifestyles. This response argues that, like others, such as John Kekes and Shlomi Segall, Van Parijs underestimates the resources of egalitarian liberalism to avoid this implication. One explanation treats individuals as liable for gendered life-shortening behavior, for example, when they value either life-shortening lifestyles or the choice between lifestyles, and one ca nnot say society (...) has not “done enough” for them. A second explanation claims a trait is not a relative advantage when it is systematically part of a package of traits that do not constitute a relative advantage. A third explanation claims a trait is not an advantage when its value to the trait bearer is conditional, and the relevant conditions are unlikely to be fulfilled. (shrink)

Introduction to special issue on justice and gender (in)equality in Law, Ethics and Philosophy.

In this article, the author describes sweeping changes in the gender system and offers explanations for why change has been uneven. Because the devaluation of activities done by women has changed little, women have had strong incentive to enter male jobs, but men have had little incentive to take on female activities or jobs. The gender egalitarianism that gained traction was the notion that women should have access to upward mobility and to all areas of schooling and jobs. But persistent (...) gender essentialism means that most people follow gender-typical paths except when upward mobility is impossible otherwise. Middle-class women entered managerial and professional jobs more than working-class women integrated blue-collar jobs because the latter were able to move up while choosing a “female” occupation; many mothers of middle-class women were already in the highest-status female occupations. The author also notes a number of gender-egalitarian trends that have stalled. (shrink)
