O estudo do estado de exceção, paradoxo central da política moderna, é objeto da análise de diferentes vertentes conceituais que envolvem o poder soberano e o seu exercício. Sua prática tem importantes consequências para as Relações Internacionais, como no caso de refugiados, que muitas vezes se encontram à margem do amparo legal estatal por sua singular situação, carentes do exercício da cidadania e liberdade para agirem como agentes políticos transformadores do meio social. Este artigo propõe um delineamento de teorias político-filosóficas (...) sobre o tema, que perpassa o pensamento central de pensadores fundamentais para se entender o poder e a exceção, como Carl Schmitt, Walter Benjamim, Michael Foucault e Giorgio Agamben. Deste modo, faz-se uma reflexão de como os conceitos de poder constituinte, amigo e inimigo, discurso da verdade, contingência, mecânica do poder e vida nua ajudariam a explicar o refugiado e a sua condição limite ante à excepcionalidade no âmbito das Relações Internacionais. Esse desencadeamento teórico tem por objetivo compreender o exercício do poder de exceção usado como tática aplicada para adestrar a vida humana em sociedade, inserindo-o nas definições de biopoder e biopolítica, especialmente quando do exame das circunstâncias envolvendo os refugiados. The Vatican’s position on in vitro fertilization (IVG), found in the ’Instruction on Bioethics’ (1987), is that all IVF is immoral, for it violates the normative procreative act of married spouses. The dilemma created is, if all instances of IVF are immoral, then God’s act in the Incarnation (granting the traditional doctrine) must also have been immoral. Drawing from Goffman’s original observations on stigma and the consequences of interactions between the stigmatized and supportive or stigmatizing audiences, we conduct a 20-year review of the diverse literature on stigma to revisit the collective nature of stigmatization processes. We find that studies on stigma’s origins, responses, processes, and outcomes have diverged from Goffman’s relational view of stigma as they have overlooked important relational mechanisms explaining the processes of (de)stigmatization. We draw from those conclusions to justify the need to study (...) stigma as a collective phenomenon. We develop a relational perspective on stigma based on understanding how attributes are stigmatized (or not) by audiences in their interactions. We argue that to advance stigma research, it is necessary to build on Goffman’s theory to include the stigmatizers (i.e., the normal) and supporters (i.e., the wise); how they create, sustain, or remove stigma; and how they relate to the stigmatized (i.e., the targets). Accordingly, we provide a research agenda on stigma as a collective phenomenon that theorizes a relational perspective, proposes a typology of how audiences relate to stigmatization, and identifies patterns of relations between audiences. We thus offer a missing piece to existing accounts of stigma by focusing on the key role of audiences (i.e., stigmatizers or supporters of the stigmatized) rather than on the targets of stigma (i.e., the own). This article reports original research examining characteristics of the active followers of the American animal rights movement. Typical respondents were Caucasian, highly educated urban professional women approximately thirty years old with a median income of $33,000. Most activists think of themselves as Democrats or as Independents, and have moderate to liberal political views. They were often suspicious of science and made no distinctions between basic and applied science, or public versus private animal-based research. Whole eye transplantation (WET) remains experimental. Long presumed impossible, recent scientific advances regarding WET suggest that it may become a clinical reality. However, the ethical implications of WET as an experimental therapeutic strategy remain largely unexplored. This article evaluates the ethical considerations surrounding WET as an emerging experimental treatment for vision loss. A thorough review of published literature pertaining to WET was performed; ethical issues were identified during review of the articles.

According to a consensus view in philosophy, “deciding” and “intending” are synonymous expressions. Researchers have recently challenged this view with the discovery of a counterexample in which ordinary speakers attribute deciding without intending. The aim of this paper is to investigate the strengths and limits of this discovery. The result of this investigation revealed that the evidence challenging the consensus view is strong. We replicate the initial finding against consensus and extend it by utilizing several new measures, materials, and procedures. (...) Foundation models such as GPT-4 are fine-tuned to avoid unsafe or otherwise problematic behavior, so that, for example, they refuse to comply with requests for help with committing crimes or with producing racist text. One approach to fine-tuning, called reinforcement learning from human feedback, learns from humans' expressed preferences over multiple outputs. Another approach is constitutional AI, in which the input from humans is a list of high-level principles. But how do we deal with potentially diverging input from humans? How (...) can we aggregate the input into consistent data about "collective" preferences or otherwise use it to make collective choices about model behavior? In this paper, we argue that the field of social choice is well positioned to address these questions, and we discuss ways forward for this agenda, drawing on discussions in a recent workshop on Social Choice for AI Ethics and Safety held in Berkeley, CA, USA in December 2023. Background: Genomic analysis may reveal both primary and secondary findings with direct relevance to the health of probands’ biological relatives. Researchers question their obligations to return findings not only to participants but also to family members. Given the social value of privacy protection, should researchers offer a proband’s results to family members, including after the proband’s death? Methods: Preferences were elicited using interviews and a survey. Respondents included probands from two pancreatic cancer research resources, plus biological and nonbiological family members. (...) Hypothetical scenarios based on actual research findings from the two cancer research resources were presented; participants were asked return of results preferences and justifications. Interview transcripts were coded and analyzed; survey data were analyzed descriptively. Results: Fifty-one individuals (17 probands, 21 biological relatives, 13 spouses/partners) were interviewed. Subsequently, a mailed survey was returned by 464 probands, 1,040 biological family members, and 399 spouses/partners. This analysis highlights the interviews, augmented by survey findings. Probands and family members attribute great predictive power and lifesaving potential to genomic information. A majority hold that a proband’s genomic results relevant to family members’ health ought to be offered. While informants endorse each individual’s choice whether to learn results, most express a strong moral responsibility to know and to share, particularly with the younger generation. Most have few concerns about sharing genetic information within the family; rather, their concerns focus on the health consequences of not sharing. Conclusions: Although additional studies in diverse populations are needed, policies governing return of genomic results should consider how families understand genomic data, how they value confidentiality within the family, and whether they endorse an ethics of sharing. A focus on respect for individual privacy—without attention to how the broad social and cultural context shapes preferences within families—cannot be the sole foundation of policy. (shrink)

Philosophers of mind typically group experiential states together and distinguish these from intentional states on the basis of their purportedly obvious phenomenal character. Sytsma and Machery (Phil Stud 151(2): 299–327, 2010) challenge this dichotomy by presenting evidence that non-philosophers do not classify subjective experiences relative to a state’s phenomenological character, but rather by its valence. However we argue that S&M’s results do not speak to folk beliefs about the nature of experiential states, but rather to folk beliefs about the entity (...) to which those experiential states are attributed. In two experiments, we demonstrate that ordinary attributions of subjective experiences (of smell and felt emotions) to a simple robot are not sensitive to valence, but instead respond to functional assumptions about the entity to which the states are (or are not) attributed. The boundaries of honesty are the focal point of this exploration of the individualistic origins of modernist ethics and the consequent need for a more pragmatic approach to business ethics. The tendency of modernist ethics to see honesty as an individual responsibility is described as a contextually naive approach, one that fails to account for the interactive effects between individual choices and corporate norms. By reviewing the empirical accounts of managerial struggles with ethical dilemmas, the article arrives at the contextual (...) preconditions for encouraging the development of reflective moral agents in modern corporations. Nishida Kitarō is considered Japan's first and greatest modern philosopher. As founder of the Kyoto School, he began a rigorous philosophical engagement and dialogue with Western philosophical traditions, especially the work of G. W. F. Hegel. John W. M. Krummel explores the Buddhist roots of Nishida’s thought and places him in connection with Hegel and other philosophers of the Continental tradition. Among several possibilities for what reality could be like in view of the empirical facts of quantum mechanics, one is provided by theories of spontaneous wave function collapse, the best known of which is the Ghirardi–Rimini–Weber theory. We show mathematically that in GRW theory there are limitations to knowledge, that is, inhabitants of a GRW universe cannot find out all the facts true of their universe. As a specific example, they cannot accurately measure the number of collapses that a given (...) physical system undergoes during a given time interval; in fact, they cannot reliably measure whether one or zero collapses occur. Put differently, in a GRW universe certain meaningful, factual questions are empirically undecidable. We discuss several types of limitations to knowledge and compare them with those in other versions of quantum mechanics, such as Bohmian mechanics. Wesley Hohfeld is known the world over as the legal theorist who famously developed a taxonomy of legal concepts. His contributions to legal thinking have stood the test of time, remaining relevant nearly a century after they were first published. Yet, little systematic attention has been devoted to exploring the full significance of his work. Beginning with a lucid, annotated version of Hohfeld's most important article, this volume is the first to offer a comprehensive look at the scope, significance, (...) reach, intricacies, and shortcomings of Hohfeld's work. This is the English translation of volume V, originally published in 1930, of Bréhier's History of Philosophy. A revised and enlarged bibliography has been prepared by Wesley P. Murphey. Bréhier's History is a standard work in Europe, and its translation permits English speaking readers to become familiar with the background which continental colleagues bring to their work. This is not just a survey of selected philosophers presented in chronological order. It is a history of philosophy, its major and minor (...) trends, contributing influences, its effects and relations with other cultural and historical phenomena contemporary with it. Bréhier sees the eighteenth century as having three philosophical periods. The first, 1700-1740, is "a moment of relaxation for the synthetic and constructive mind." The great systems of Descartes' heirs were collapsing, Newton's doctrines took over the imagination and instruction of scholars, and a radical dualism of mind and nature dominated thought. In the second period, 1740-1775, "an interested and impassioned society," and even the public powers of church and state, are intimately involved in the issues on which the philosophers, were just then publishing their major works. The dominant philosophy, convinced that any ordinary mind when properly guided could penetrate every subject affecting the happiness of man, was both the agent and the result of the great social movement to which it gave expression. These writers came largely from the middle class, they desired to be useful and to make their reputations, so they shunned technical language. The third period saw a return to sentiment and immediate intuition, and the infusion of religious mysticism and elitism which produced great metaphysical systems up until the mid-nineteenth century. This is a translation of another volume of the monumental history of philosophy published in the 1930s by Bréhier. The bibliography is brought up to date by the translator with help from Wesley Piersol. Bréhier writes history of philosophy in the broad sense, showing the social, literary, and political forms taken by philosophical trends of the period. Many of the writings treated in this volume will be unknown to students trained in the Anglo-American tradition. There are only fifteen pages (...) on Scottish realism and British utilitarianism, and a page or so each on Kierkegaard and Emerson. In the substantial chapters on Fichte, Schelling, Hegel, and the trends in German thought following Hegel, one can find summaries of the positions of such philosophers as von Humboldt, Schleiermacher, Herbart, Feuerbach, Stirner, and others. There is a rich section of over a hundred pages on French social philosophy: Fourier, Saint-Simon, Comte, and Proudhon. Early work of Engels and Marx is mentioned, but fuller treatment belongs to the next volume. A chapter on Italian idealism is also included. This period saw the flowering of vast constructive systems. A sense of history and development transformed philosophical problems, and faith in the rational, reflective initiative of human wills was replaced by faith in a mysterious historical force, an immanent law which makes sport of efforts to resist it. The difference in substance is reflected in differences of style. The clarity and naturalness with which eighteenth-century men of action wrote for a general educated public was replaced by constraint, effort, conventionality, and above all, a prophetic and apocalyptic tone in the works of this time.--M.
