On April 16, 2007, Cho Seung-Hui used two semiautomatic handguns to kill 32 persons and then himself at Virginia Tech University in the largest campus shooting in U.S. history. Mr. Cho purchased his handguns from a pawnshop and a gun store in Virginia, where under state law a background check was conducted to determine whether he had any disqualifying criminal or mental health history. The paperwork for the background check was completed at the gun store, and the check itself was (...) conducted through an “instant” system facilitated by a toll-free telephone number. The entire transaction took approximately 20 minutes. At no point was Mr. Cho asked why he wished to purchase the guns. And although he had been deemed a potential danger to himself by a state magistrate in 2005 – which should have disqualified his purchase of a gun under federal law – this information never reached those conducting the background check. The United States and Canada regulate frearms, particularly handguns, quite differently. With only a few state and local exceptions, the U.S. approach emphasizes the ability of most individuals to purchase, possess, and carry handguns. By comparison, Canada has a form of restrictive licensing for handguns that places a premium on community safety. The authors first review the potential individual and community level harms and benefits associated with these differing fre-arm policies. Using this information, they explore the ethical dimensions of the (...) U.S. and Canadian approaches through three major themes of autonomy, prevention of harms, and social justice. The authors conclude that the Canadian approach is consistent with respect for the autonomy of persons, fosters the prevention of harms, and more appropriately furthers social justice. (shrink)

Obesity is widely recognized as a preventable cause of death and disease. Reducing obesity among adults and children has become a national health goal in the United States. As one approach to the obesity epidemic, public health practitioners and others have asserted the need to provide consumers with information about the foods they eat. Some state and local governments across the United States have introduced menu labeling bills and regulations that require restaurants to post information, such as calorie content, for (...) foods offered on their menus or menu boards. A major dilemma is whether state and local menu labeling laws are preempted by the federal Nutrition Labeling and Education Act . While few courts have addressed this issue, ongoing litigation in New York City provides an early glimpse of judicial interpretation in this area. This article explores these preemption issues, arguing that appropriately written and implemented menu labeling laws should not be preempted by the NLEA. We offer guidance for states and localities that wish to develop and implement menu labeling laws. (shrink)

Worldwide, obesity has become a major cause of preventable death, disease, and disability. While the epidemic of obesity is a significant public health issue in many developed nations, the United States has the highest prevalence of obesity among adults and children internationally. The National Health and Nutrition Examination Survey estimates that over 60 percent of U.S. adults are overweight or obese. According to the Centers for Disease Control and Prevention, “overweight” refers to adults whose body mass index, a number calculated (...) using weight and height measurements, is between 25 and 29.9. “Obese” refers to adults whose BMI is 30 or higher. Among American children and adolescents, approximately 17 percent are overweight. (shrink)

By situating (...) discourse about reconciliation within the context of Girardian thought, it becomes clear that like Peter who vowed he would never deny Jesus but ended up doing it three times any of us is susceptible to the siren call of angry resentment and retaliation. The purpose of this study is to see how Jon Stewart and his Daily Show colleagues hold traditional broadcast media accountable. This paper suggests Stewart is holding those who claim they are practicing journalism accountable to the public they claim to serve and outlines the normative implications of that accountability. There is a journalistic norm that media practitioners, and the media as a whole, should be accountable to the public. Here, accountability “refers to the process by which media are called (...) to account for meeting their obligations” (McQuail, 1997, p. 515). However, the government cannot enforce this accountability due to privileges afforded to the press by the First Amendment. Further, while national press councils have been effective in other countries, specifically India, there is no national press council in the United States. Enforcing accountability, then, falls to journalists—along with press critics. The researchers suggest that The Daily Show with Jon Stewart holds traditional broadcast media accountable in four distinct ways. (shrink)

What can the actions of stockbreeders, as they select the best individuals for breeding, teach us about how new species of wild animals and plants come into being? Charles Darwin raised this question in his famous, even notorious, Origin of Species (1859). Darwin's answer - his argument by analogy from artificial to natural selection - is the subject of our book. We aim to clarify what kind of argument it is, how it works, and why Darwin gave it such prominence. (...) As we explain more fully in our Introduction, we believe that the argument becomes much more intelligible when set, contextually, in a story stretching from classical Greek mathematics to modern evolutionary genetics: a long story, and a broad one too, encompassing everything from Darwin's earliest notebook theorising on the births and deaths of species, to agrarian capitalism as a distinctive form of economic life, to shifting Western reflections on art-nature relations. Music as an Imitation of Harmonious Balance.

Recent research in the cognitive science of religion suggests that humans intuitively believe that others survive death. In response to this finding, three cognitive theories have been offered to explain this: the simulation constraint theory (Bering, Citation2002); the imaginative obstacle theory (Nichols, Citation2007); and terror management theory (Pyszczynski, Rothschild, & Abdollahi, 2008). First, I provide a critical analysis of each of these theories. Second, I argue that these theories, while perhaps explaining why one would believe in his own personal immortality, (...) leave an explanatory gap in that they do not explain why one would intuitively attribute survival of death to others. To fill in the gap, I offer a cognitive theory based on offline social reasoning and social embodiment which provides for the belief in an eternal social realm in which the deceased survive—the afterlife. Søren Kierkegaard: Subjectivity, Irony, and the Crisis of Modernity examines the thought of Søren Kierkegaard, a unique figure, who has inspired, provoked, fascinated, and irritated people ever since he walked the streets of Copenhagen. At the end of his life, Kierkegaard said that the only model he had for his work was the Greek philosopher Socrates. This work takes this statement as its point of departure. Jon Stewart explores what Kierkegaard meant by this and to show how different aspects of (...) his writing and argumentative strategy can be traced back to Socrates. The main focus is The Concept of Irony, which is a key text at the beginning of Kierkegaard's literary career. Although it was an early work, it nevertheless played a determining role in his later development and writings. Indeed, it can be said that it laid the groundwork for much of what would appear in his later famous books such as Either/Or and Fear and Trembling. (shrink)

In his Lectures on the Philosophy of Religion, Hegel treats the religions of the world under the rubric "the determinate religion." This is a part of his corpus that has traditionally been neglected since scholars have struggled to understand what philosophical work it is supposed to do. In Hegel's Interpretation of the Religions of the World, Jon Stewart argues that Hegel's rich analyses of Buddhism, Hinduism, Zoroastrianism, Judaism, Egyptian and Greek polytheism, and the Roman religion are not simply irrelevant historical (...) material, as is often thought. Instead, they play a central role in Hegel's argument for what he regards as the truth of Christianity. Hegel believes that the different conceptions of the gods in the world religions are reflections of individual peoples at specific periods in history. These conceptions might at first glance appear random and chaotic, but there is, Hegel claims, a discernible logic in them. Simultaneously, a theory of mythology, history, and philosophical anthropology, Hegel's account of the world religions goes far beyond the field of philosophy of religion. The controversial issues surrounding his treatment of the non-European religions are still very much with us today and make his account of religion an issue of continued topicality in the academic landscape of the twenty-first century. Rarely in the short history of liberal-democratic government has a primer on basic liberal-democratic values and institutions been more needed than now. Popular discontent, even anger, with democratic governments has grown steadily over the past twenty years. And not since the 1930s have citizens and their elected officials been so baffled about their respective roles in the maintenance of both democratic governments and liberal economies. In recent years interest in the thought of Kierkegaard has grown dramatically, and with it the body of secondary literature has expanded so quickly that it has become impossible for even the most conscientious scholar to keep pace. The problem of the explosion of secondary literature is made more acute by the fact that much of what is written about Kierkegaard appears in languages that most Kierkegaard scholars do not know. Kierkegaard has become a global phenomenon, and new research traditions (...) have emerged in different languages, countries, and regions. The present volume is dedicated to trying to help to resolve these two problems in Kierkegaard studies. Its purpose is, first, to provide book reviews of some of the leading monographic studies in the Kierkegaard secondary literature so as to assist the community of scholars to become familiar with the works that they have not read for themselves. The aim is thus to offer students and scholars of Kierkegaard a comprehensive survey of works that have played a more or less significant role in the research. Second, the present volume also tries to make accessible many works in the Kierkegaard secondary literature that are written in different languages and thus to give a glimpse into various and lesser-known research traditions. In this essay I distinguish categories of animals by their mental capacities. I then discuss whether punishment can be appropriate for animals of each category, and if so what form punishment may appropriately take for animals of each category. The aim is to illuminate each type of punishment through comparison and contrast with the others. This both forestalls the overintellectualization of punishment which arises from viewing humans as the only paradigm case and forestalls the underintellectualization of human punishment which results (...) from making no essential reference, in an account of human punishment, to the human capacity for specifically critical reasoning. Aesthetic judgements formed on the basis of testimony are commonly held to be defective, illegitimate, or otherwise problematic. This first book-length treatment of the debate surrounding aesthetic testimony argues for the surprising conclusion that this widespread view is mistaken. Aesthetic testimony is in no way inferior as a source of judgement when compared to either first-hand aesthetic judgement, or testimony concerning non-aesthetic matters. Alongside establishing this position (an extreme form of ‘optimism concerning aesthetic testimony’) this work also responds to the (...) most prominent arguments for the opposing view (‘pessimism concerning aesthetic testimony’). A classicist, philosopher, and poet, Poul Martin Møller was an important figure in the Danish Golden Age. The traumatic event of the death of his wife led him to think more profoundly about the question of the immortality of the soul. In 1837 he published his most important philosophical treatise, "Thoughts on the Possibility of Proofs of Human Immortality," presented here in English for the first time. It was read and commented upon by the leading figures of the Golden Age, (...) such as Søren Kierkegaard. It proved to be the last important work that Møller wrote before his death in March of 1838 at the age of 43. (shrink)
