We argue that the dead donor rule, which states that multiple vital organs should only be taken from dead patients, is justified neither in principle nor in practice. We use a thought experiment and a guiding assumption in the literature about the justification of moral principles to undermine the theoretical justification for the rule. We then offer two real world analogues to this thought experiment, voluntary active euthanasia and capital punishment, and argue that the moral permissibility of terminating any patient (...) through the removal of vital organs cannot turn on whether or not the practice violates the dead donor rule.Next, we consider practical justifications for the dead donor rule. Specifically, we consider whether there are compelling reasons to promulgate the rule even though its corresponding moral principle is not theoretically justified. We argue that there are no such reasons. In fact, we argue that promulgating the rule may actually decrease public trust in organ procurement procedures and medical institutions generally – even in states that do not permit capital punishment or voluntary active euthanasia.Finally, we examine our case against the dead donor rule in the light of common arguments for it. We find that these arguments are often misplaced – they do not support the dead donor rule. Instead, they support the quite different rule that patients should not be killed for their vital organs. The United States’ Genetic Information Nondiscrimination Act of 2008 was sweeping legislation intended to protect the privacy of genetic information and prevent discrimination based on genetic factors in health insurance and employment. It protects the genetic privacy of individuals in these contexts and limits the likelihood that genetic discrimination will occur. However, in the case of employment, it does so at the cost of safety, both to the individuals it is meant to protect and to others. On occasion, adherence to (...) the dictates of GINA could lead to serious and avoidable harm to many people. Odd as it may seem, then, there can be such a thing as justified genetic discrimination. There are times when knowledge of genetic factors and subsequent action overrides reasons against obtaining or using such information. EfronAlmost a quarter-century ago Benjamin Nelson published his famous plea for what he called a “differential” and “comparative historical sociology of ‘science’ in civilizational perspective.” 1 Like Max Weber, Robert Merton, and Joseph Needham, Nelson believed that the growth of western science could be better understood when compared to the ways “science” fared in other cultures with other intellectual (...) and institutional and economic sensibilities and structures. A particularly propitious case study for such a differential and comparative historical study of science, as Hillel Levine observed in his 1983 essay about Jewish reactions to heliocentrism, are the Jews of early modern Europe, who constituted “a society geographically and culturally contiguous with those who framed and advanced occidental ‘science.’” 2Since about the time of Nelson’s plea, David B. Ruderman has been writing the history of Jewish attitudes towards, and engagements with, science during the period in which modern western science was constituting itself. It is no exaggeration to say that he established this as a field of study, producing a steady stream of historical studies, initially of Italian Jews who read and wrote about nature and its study, but continually expanding his compass. 3 The field [End Page 719] Ruderman established and the studies he produced have been “repercussive” (to borrow his own adjective) in many directions—shedding light on Jewish-Christian relations, on early-modern Jewish intellectual history, on the deployments of Kabbalah and magic in early modern times, and so on. One of Ruderman’s achievements—perhaps not the most important in his view (for he considers himself a historian of Jewish thought and culture and not a historian of science) but of great importance nonetheless—has been to begin to lay the groundwork for a comparative history of Jewish and Christian attitudes towards and participation in the “new sciences.”Ruderman’s newest book is a big step towards Nelson’s desideratum, using Jewish attitudes as the comparative case. It is a collection of twelve linked essays (five of which have appeared elsewhere in one form or another) framed by a synthetic introduction and epilogue. The essays are individual or group portraits of Jews who evinced interest in natural philosophy or medicine, in a variety of settings and for a variety of reasons, between the sixteenth and eighteenth centuries. Ruderman describes his subject as “three distinct but interrelated groups among early modern Jews”: (1) “converso physicians and other university-trained intellectuals who fled Spain and Portugal in the seventeenth century and settled in Holland, Italy, Germany, England, and even eastern Europe, serving as doctors and purveyors of scientific learning throughout the Jewish communities of Europe, while yielding considerable political and economic power,” (2) “certain circles of Jewish scholars in central and eastern Europe [who] pursued scientific learning, especially astronomy, in more informal settings as a desirable supplement to rabbinic study,” and (3) “the hundreds of Jews who attended Italian medical schools, primarily the University of Padua, from the late sixteenth through the eighteenth centuries.” 4In fact Ruderman covers even more ground than this. As background, he includes a brief essay on the attitudes of tenth- to fifteenth-century Jews towards nature and its study, surely the best survey of the sort available. Of the thirty or so early modern Jews that he describes in the remainder of the book, about twenty fit in at least one of the three camps upon which he focuses. 5 Nine [End Page 720] emerged from different circumstances (though these too were often highly influenced by one or more of the focus populations). What should philosophical theology look like after the critique of Onto-theology, after Phenomenology, and in the age of Speculative Realism? What does Kabbalah have to say to Philosophy? Since Kant and especially since Husserl, philosophy has only permitted itself to speak about how one relates to God in terms of the intentionality of consciousness and not of how God is in himself. This meant that one could only ever speak to God as an addressed and yearned-for holy Thou, but not (...) to God as infinite creator of all. In this book-length essay, the author argues that reality itself is made up of the Holy Name of God. Drawing upon the set-theoretical ontology of Alain Badiou, the computational theory of Stephen Wolfram, the physics of Frank Tipler, the psychoanalytical theory of Jacques Lacan, and the genius of Georg Cantor, the author works to demonstrate that the universe is a computer processing the divine Name and that all existence is made of information (the bit). As a result of this ontic pan-computationalism, it is shown that the future resurrection of the dead can take place and how it may in fact occur. Along the way, the book also offers compelling critiques of several significant theories of reality, including the phenomenological theologies of Emmanuel Levinas and Jean-Luc Marion, Process Theology, and Object-Oriented Ontology. Reality in the Name of God explores how the concepts of Jewish mysticism can be articulated and deployed as philosophical theses within current metaphysical debates. It provides a new and dynamic Structural Realist ontology of information. In this essay, I argue that, all else being equal, theism is more probable than naturalism on the assumption that human beings are able to arrive at a body of moral knowledge that is largely accurate and complete. I put forth this thesis on grounds that, if naturalism is true, the explanation of the content of our moral intuitions terminates either in biological-evolutionary processes or in social conventions adopted for pragmatic reasons; that, if this is so, our moral intuitions were (...) selected for their utility, not their truth; and that, if our moral intuitions were so selected, they are probably false. I defend the argument against three objections: first, that the argument amounts to a generic skeptical challenge; second, that ethical naturalism explains how our moral intuitions could have been selected for their truth; and third, that there is a pre-established harmony between the utility of moral beliefs and their truth-values. According to transhumanists who urge the radical enhancement of human beings, humanity’s top priority should be engineering “posthumans,” whose features would include agelessness. Increasingly, transhumanism is critiqued on foundational grounds rather than based largely on anticipated results of its implementation, such as rising social inequality. This expansion is crucial but insufficient because, despite its radical aim, transhumanism reflects beliefs and attitudes that are evident in the broader culture. With a focus on the yearning to eliminate aging, I consider four of (...) these: a disproportionate reliance on science and technology to address major human challenges; the conceptualization of human beings in terms of binaries like “young-old”; a repudiation of vulnerability; and intensifying perfectionism. Illuminating these interlocked commitments both deepens an existing critique of transhumanism and draws our attention to deleterious cultural views that must be vigorously contested if our commitment to human flourishing is to be deep and unwavering. Abstract: In this essay, I outline and defend a version of the aesthetic argument for the existence of God, according to which theism explains our capacity for subjective aesthetic experience better than its major competitor, naturalism. I argue that naturalism fails to adequately explain the nature and range of our aesthetic experiences, since these are amenable neither to standard Darwinian explanation nor to explanation in terms of more complex sociobiological mechanisms such as sexual selection or between-group selection. I concede that (...) aesthetic experience may be an evolutionary spandrel but argue that the conjunction of this thesis with naturalism is highly improbable given the prevalence of beauty in the natural world. Theism, on the other hand, furnishes a robust personal explanation of aesthetic experience, since on theism God has both good reasons to bring such experiences about and the power to do so. I address an objection to the theistic explanation from broadly negative aesthetic experiences, arguing that God plausibly has many reasons to allow these. I contend that this formulation of the argument is superior to other extant versions, since it does not depend on controversial probability judgments, dubious analogies between natural phenomena and human artefacts, or objectivism about aesthetic values. Is language understanding a special case of social cognition? To help evaluate this view, we can formalize it as the rational speech-act theory: Listeners assume that speakers choose their utterances approximately optimally, and listeners interpret an utterance by using Bayesian inference to “invert” this model of the speaker. We apply this framework to model scalar implicature (“some” implies “not all,” and “N” implies “not more than N”). This model predicts an interaction between the speaker's knowledge state and the listener's interpretation. (...) This article argues that we could improve the design of research protocols by developing an awareness of and a responsiveness to the social contexts of all the actors in the research enterprise, including subjects, investigators, sponsors, and members of the community in which the research will be conducted. ?Social context? refers to the settings in which the actors are situated, including, but not limited to, their social, economic, political, cultural, and technological features. The utility of thinking about social contexts is (...) introduced and exemplified by the presentation of a hypothetical case in which one central issue is limitation of the probability of injury to subjects by selection of individuals who are not expected to live long enough for the known risks of the study to become manifest as harms. Benefits of such considerations may include enhanced subject satisfaction and cooperation, community acceptance, and improved data quality, among other desirable consequences. (shrink)

In this essay, I reply to an influential objection to evolutionary debunking arguments against moral realism. According to this objection, our capacity for autonomous rational reflection allows us to grasp moral truths independently of distorting evolutionary influences, so those influences do not prevent us from having moral knowledge. I argue that rational moral reflection is not, in fact, autonomous from evolutionary influences, since it depends on our evolved, pre-reflective grasp of moral properties. I then consider and reject the suggestion that (...) realists can supply an autonomous foundation for rational moral reflection or do without any such foundation. Next, I address the allegation that my arguments have skeptical implications for rational reflection in non-moral domains. Finally, I conclude with a gesture toward a more promising route for realists who oppose debunking arguments. (shrink)

I argue for the viability of one neglected way of developing supervenience-based objections to metaethical non-naturalism. This way goes through a principle known as ‘Hume’s Dictum’, according to which there are no necessary connections between distinct existences. I challenge several objections to the Hume’s Dictum-based argument. In the course of doing so, I formulate and motivate modest and precise versions of Hume’s Dictum, illustrate how arguments employing these principles might proceed, and argue that the Hume’s Dictum argument enjoys some advantages (...) relative to other supervenience-based objections to non-naturalism. In this chapter, the author shows that the affinity between the two thinkers is far greater than interpreters like Farrell allow. He focuses on evaluating the argument that Richard Rorty is not able to get past the dichotomies ‐ although he will have cause to comment on the first one as well. In the context of a continued anti‐representationalism, Rorty comes to admit that there is a “truth in realism” and that our relations to the world are not just causal (...) but also normative. The author argues that with these admissions Rorty comes to articulate a view that can, with some plausibility, be said to have gotten beyond the dichotomies of scheme and content, subject and object, and realism and antirealism. D. Davidson agrees with Rorty that truth is not definable by simpler and more transparent concepts. Davidson has a pronged attack on the concept of representation. (shrink)

This paper explores the editorial influence of Joseph Banks on the Philosophical Transactions—still, at the time of his accession to the Presidency of the Royal Society in 1778, the most prestigious scientific periodical published in English. In particular, it examines how Banks forged, and wielded, personal influence over what went into the Transactions. Nominally, at least, the periodical was under the collective control of the Society's council, with significant statutory safeguards in place to prevent editorship by a presidential clique. Yet (...) this was exactly what Banks was able to speedily create and maintain. In this essay I explore how Banks accomplished this and the pressures it produced, addressing two key questions. First, I examine the social dimension of Banks's management of the Transactions (and what contemporaries thought of it), including particularly the questions of how and to whom access to the periodical was afforded or denied by Banks and his associates; and second, I consider how Banks and the Society dealt with the emerging competitive pressure of new commercial and learned society periodicals. I outline a sphere of scientific sociability partly created by informal processes of communicating, circulating, and evaluating papers developed by Banks and his close associates, and its significance for the Transactions in its engagements with other sites, genres, and conventions of scientific publication. In many spheres, the law takes the legal concept of causation to correspond to the folk concept (the correspondence assumption). Courts, including the US Supreme Court, tend to insist on the "common understanding" and that which is "natural to say" (Burrage v. United States) when it comes to expressions relating to causation, and frequently refuse to clarify the expression to juries. As recent work in psychology and experimental philosophy has uncovered, lay attributions of causation are susceptible to a great number (...) of unexpected factors, some of which seem rather peripheral to causation. One of those is the norm effect (Knobe & Fraser, 2008): Agents who, in acting as they do, break a salient norm, are more likely to be considered as having caused a certain consequence than when they do not violate a norm. According to some (e.g., Alicke, 1992) this constitutes a bias. According to others (e.g., Sytsma, 2020), the folk concept of causation is sensitive to normative factors, and there’s nothing wrong with that. In this paper, we explore the question whether the norm effect should be considered a bias from the legal perspective on the one hand, and from the psychological perspective on the other. To do this, we test whether norms which are nonpertinent to the consequences or outright silly also impact causation judgements. The data from two preregistered experiments (total N=593) clearly show they do. This, we argue, makes the bias interpretation plausible from the psychological perspective, and both plausible and problematic from the legal perspective. It also shows that the law should abstain from unreflectively assuming conceptual correspondence between legal and ordinary language concepts. (shrink)
