This paper uses the debate about whether capital punishment deters homicide as a case study for examining the claim, made by many feminists and others, that the traditional ideal of objectivity in seeking knowledge is misguided. According to this ideal, knowledge seekers should strive to gather and assess evidence independently of any influences exerted by either their individual and societal circumstances or their moral values. This paper argues that, although the traditional ideal rests on some valid precepts, it is neverthelesss (...) untenable. the author goes on to propose an alternative epistemological ideal – one that retains these valid precepts but also recognizes an important and legitimate role for people's circumstances and moral values in their efforts to find knowledge. "Evidentialism" is the view that a person's epistemic justification for a doxastic attitude is determined entirely by his or her evidence for the content of that attitude. This paper has two goals. The first is to argue that values and circumstances properly influence epistemic justification, and that evidentialism is therefore untenable, even as an epistemic ideal. The second is to outline a nonevidentialist theory of epistemic justification that avoids the common objection that nonevidentialist theories fail to preserve important distinctions between (...) epistemic justification, on the one hand, and moral and prudential justification, on the other hand. This view is attributed to Kant to relieve him of the charge that the first antinomy’s thesis argument presupposes transcendental idealism. I argue that important textual evidence speaks against this view, and Kant in fact affirms the conceptual possibility of actually infinite tota synthetica. While this means the first antinomy may not be decisive as an indirect argument for idealism, it gives us a better account of how (...) our ideas of the unconditioned generate the antinomies, and it allows us to see important and often overlooked elements in Kant’s account of the infinite. From accounts of migration and stories of personal alienation, through the fragmented memories of former incarnations, to fable-like tales of half-breeds and species metamorphosis, Ying Chen's fiction evolves as it revolves around questions of difference, otherness and identity, which is never fixed or singular. While presenting the narrators' inner preoccupations and, in some cases, unreliable nature, the increasingly complex texts of this francophone-Chinese writer (1961-) also reveal larger concerns about dominant discourses, the limitations of social realities, survival, and the relationship (...) between beings, all framed within an aesthetics of non-belonging. Intriguingly, the author achieves this by consciously distancing her works, from 1998 onwards, from any categorisation by ethnicity. This engaging study considers Chen's writing from the contemporary perspective of the breakdown of traditional spatiotemporal experiences, the homogenization of places, the erasure of cultural differences, and the resulting tendency towards universalism. This paper argues for a new understanding of Strawson’s distinction between personal, impersonal, and self-reactive attitudes. Many Strawsonians take these basic reactive attitude types to be distinguished by two factors. Is it the self or another who is treated with good- or ill-will? And is it the self or another who displays good- or ill-will? On this picture, when someone else wrongs me, my reactive attitude is personal; when someone else wrongs someone else, my reactive attitude is impersonal; and when (...) I wrong someone else, my attitude is self-reactive. Against this account, I argue that the basic reactive attitude types are better distinguished according to whether they express partial or impartial concern. This fits Strawson’s discussion in “Freedom and Resentment”, and it allows us to see an important point that the alternative approach obscures. Namely, while attitudes like resentment, gratitude, shame, and pride can arise as responses to our own treatment and behavior, they can also arise as third-party responses to the treatment and behavior of our family members, romantic partners, and close friends. Similarly, attitudes like moral indignation and disapprobation also have a wider scope than is often acknowledged; they can arise as responses to others’ treatment, but they can also arise as responses to our own treatment when we react impartially to circumstances involving ourselves. Anorexia nervosa and obsessive–compulsive disorder are commonly reported to co-occur and present with overlapping symptomatology. Executive functioning difficulties have been implicated in both mental health conditions. However, studies directly comparing these functions in AN and OCD are extremely limited. This review provides a synthesis of behavioral and neuroimaging research examining executive functioning in AN and OCD to bridge this gap in knowledge. We outline the similarities and differences in behavioral and neuroimaging findings between AN and OCD, focusing on set shifting, (...) working memory, response inhibition, and response monitoring. This review aims to facilitate understanding of transdiagnostic correlates of executive functioning and highlights important considerations for future research. This paper contributes to inquiries into the genealogy of governmentality and the nature of secularization by arguing that pastoralism continues to operate in the algorithmic register. Drawing on Agamben’s notion of signature, I elucidate a pair of historically distant yet archaeologically proximate affinities: the first between the pastorate and algorithmic control, and the second between the absconded God of late medieval nominalism and the authority of algorithms in the cybernetic age. I support my hypothesis by attending to the signaturial kinships (...) between, on the one hand, temporality and authority in our contemporary conjuncture, and, on the other, obedience and submission in Christian thought from late antiquity and the late Middle Ages. I thereby illustrate the hidden genealogical continuities between theological-pastoral technologies of power and technocratic-algorithmic modalities of governance. I conclude by suggesting that medieval counter-conducts may be redeployed in our present circumstances for emancipatory ends. (shrink)

Artificial intelligence is increasingly being developed for use in medicine, including for diagnosis and in treatment decision making. The use of AI in medical treatment raises many ethical issues that are yet to be explored in depth by bioethicists. In this paper, I focus specifically on the relationship between the ethical ideal of shared decision making and AI systems that generate treatment recommendations, using the example of IBM’s Watson for Oncology. I argue that use of this type of system creates (...) both important risks and significant opportunities for promoting shared decision making. If value judgements are fixed and covert in AI systems, then we risk a shift back to more paternalistic medical care. However, if designed and used in an ethically informed way, AI could offer a potentially powerful way of supporting shared decision making. It could be used to incorporate explicit value reflection, promoting patient autonomy. In the context of medical treatment, we need value-flexible AI that can both respond to the values and treatment goals of individual patients and support clinicians to engage in shared decision making. This paper explores the role of ethics and responsibility as drivers of a transition to a more sustainable agri-food system, by drawing on an investigation of the governance of social sustainability in the UK’s conventional food supply. The paper investigates how and why various non-state actors in the conventional food supply construe certain social obligations as being part of the remit of the food supply; whether ethics plays a motivating role; and the extent to which their activities are linked to (...) sustainability. The paper uses data collected via two surveys of diverse entities in the conventional food supply, the first a survey of public-facing websites, the second a series of in-depth interviews. The entities ranged from primary producers, manufacturers and food service operators to consultancies, standard-setting organisations and advocacy groups. The study finds that actors view a variety of socially focused or socially beneficial activities as legitimate governance concerns for the conventional food supply, and that ethics plays a role in motivating or justifying these activities. However, the activities are inconsistently associated with sustainability, a finding that may undermine the use of sustainability programmes as tools for driving ethical agendas. Moreover, the dominant business framing of the conventional food supply means that ethical considerations are often expressed in terms of more instrumental priorities. Social sustainability or responsibility actions can be justified on moral grounds as ‘the right thing to do’ but usually have to be backed up in more pragmatic terms as a way of ‘doing well by doing good’. Drawing on interviews with 140 young British males, this article explores the ways in which men talk about their own bodies and bodily practices, and those of other men. The specific focus of interest is a variety of body modification practices. We argue, however, that the significance of this analysis extends beyond the topic of body modification. In discussing the appearance of their bodies, the men we interviewed talked less about muscle and skin than about their own selves located within (...) particular social, cultural and moral universes. This article shows that, in talking about seemingly trivial questions such as whether to have one’s nose pierced or join a gym, men are actively engaged in regulating normative masculinity. Our analysis lends support to the claim that the body has become a new (identity) project in high/late/post-modernity, but shows how fraught with difficulties this project is for young men who must simultaneously work on and discipline their bodies while disavowing any (inappropriate) interest in their own appearance. The analysis highlights the pervasive individualism of young men’s discourses, and the absence of alternative ways of making sense of embodied experiences. (shrink)

The recent interest in systematic review methods in bioethics has highlighted the need for greater transparency in all literature review processes undertaken in bioethics projects. In this article, I articulate features of a good bioethics literature review that does not aim to be systematic, but rather to capture and analyse the key ideas relevant to a research question. I call this a critical interpretive literature review. I begin by sketching and comparing three different types of literature review conducted in bioethics (...) scholarship. Then, drawing on Dixon-Wood's concept of critical interpretive synthesis, I put forward six features of a good critical interpretive literature review in bioethics: answering a research question, capturing the key ideas relevant to the research question, analysing the literature as a whole, generating theory, not excluding papers based on rigid quality assessment criteria, and reporting the search strategy. In his 1918 lectures, _The Philosophy of Logical Atomism_, Russell discusses the impossibility of drawing a diagram or "map-in-space" of the form of belief (judgment). In this paper, I argue that an examination of diagrams appended to Russell's _Theory of Knowledge_ shows him already anticipating this symbolizing difficulty in 1913 and—in the midst of attempting to adopt Wittgenstein's doctrine of propositional bipolarity—jettisoning attempts to diagram the form of belief.

Classical archaeology in the service of the state and national identity is not a new concept, although it is one that is seen less, or at least less blatantly, in modern Europe. This particular use of the classical past is still very much in use in the region of Macedonia, both the Greek province and the Former Yugoslav Republic of Macedonia. Nationalism uses archaeology and the imagery of the ancient world to claim legitimacy in the modern world. By claiming the (...) ancient past and projecting it into the present, nations can create a strong national identity. By tying the present day inhabitants of an area to a strong cultural past, the nation itself becomes more legitimate. Problems arise when two nations seek to claim the same past as in the case in the Greek province of Macedonia and the Former Yugoslav Republic of Macedonia. This competition and issues surrounding the claim of ownership of a particular national past can be seen through the examples of the tumulus at Vergina and the differing traditions of the symposion in Macedonia and Athens. The projection of the past into the present can be seen in the Former Yugoslav Republic of Macedonia flag, in three pamphlets on the “Macedonian Question” from Greece, and in the recent rebuilding of Former Yugoslav Republic of Macedonia’s capital, Skopje. This article uses a discourse analytic perspective to analyse sex and relationship advice in a best-selling women’s magazine. It identifies three different interpretative repertoires which together structure constructions of sexual relationships: the intimate entrepreneurship repertoire, organized around plans, goals and the scientific management of relationships; men-ology, in which women are instructed in how to learn to please men; and transforming the self, which calls on women to remodel their interior lives in order to construct a desirable subjectivity. The article considers (...) each repertoire in turn, and also looks at how they work together in order to privilege men and heterosexuality. Discussion focuses in particular on the postfeminist nature of the advice, in which pre-feminist, feminist and anti-feminist ideas are entangled in such a way as to make gender ideologies more pernicious and difficult to contest. In jurisdictions where voluntary assisted dying is legal, eligibility assessments, prescription and administration of a VAD substance are commonly performed by senior doctors. Junior doctors’ involvement is limited to a range of more peripheral aspects of patient care relating to VAD. In the Australian state of Victoria, where VAD has been legal since June 2019, all health professionals have a right under the legislation to conscientiously object to involvement in the VAD process, including provision of information about VAD. While this (...) protection appears categorical and straightforward, conscientious objection to VAD-related care is ethically complex for junior doctors for reasons that are specific to this group of clinicians. For junior doctors wishing to exercise a conscientious objection to VAD, their dependence on their senior colleagues for career progression creates unique risks and burdens. In a context where senior colleagues are supportive of VAD, the junior doctor’s subordinate position in the medical hierarchy exposes them to potential significant harms: compromising their moral integrity by participating, or compromising their career progression by objecting. In jurisdictions intending to provide all health professionals with meaningful conscientious objection protection in relation to VAD, strong specific support for junior doctors is needed through local institutional policies and culture. A discourse of safety was prominent during the implementation of the Victorian legislation.Main textIn this paper, we analyse the ethical relationship between legislative “safeguards” and equal access. Drawing primarily on Ruger’s model of equal access to health care services, we analyse the Victorian approach to voluntary assisted dying in terms of four dimensions: horizontal equity, (...) patient agency, high quality care, and supportive social norms. We argue that some provisions framed as safeguards in the legislation create significant barriers to equal access for eligible patients.ConclusionsWhile safety is undoubtedly ethically important, we caution against an overemphasis on safeguarding in voluntary assisted dying legislation given the implications for equal access. Clinical ethics records offer bioethics researchers a rich source of cases that clinicians have identified as ethically complex. In this paper, we suggest that clinical ethics records can be used to point to types of cases that lack attention in the current bioethics literature, identifying new areas in need of more detailed bioethical work. We conducted an analysis of the clinical ethics records of one paediatric hospital in Australia, focusing specifically on conflicts between parents and health professionals about a child’s (...) medical treatment. We identified, analysed, and compared cases of this type from the clinical ethics records with cases of this type discussed in bioethics journals. While the cases from journals tended to describe situations involving imminent risk to the child’s life, a significant proportion of the clinical ethics records cases involved different stakes for the child involved. These included distress, poorer functional outcome, poorer psychosocial outcome, or increased risk of surgical complications. Our analysis suggests that one type of case that warrants more detailed ethics research is parental refusal of recommended treatment, where the refusal does not endanger the child’s life but rather some other aspect of the child’s well-being. The prevailing accounts of Aristotle's view of practical wisdom pay little attention to all the intellectual capacities discussed in Nicomachean Ethics Book 6. They also contrast the phronimos with the wicked, the continent or the incontinent, rather than with those who have 'natural virtue' (innate or habituated), and thereby they neglect the importance of experience, through which those capacities are acquired. When we consider them, we can see what sort of experience is needed and hence what sort aspirants to full (...) virtue should be trying to acquire. It turns out that much of the knowledge such experience yields is just plain worldly knowledge. But it is not to be despised on that account. The phronimos must meet a threshold of knowledge that he will, indeed, share with some of the wicked, but will have a superior version that goes beyond theirs. (shrink)

In what follows, I give a dialectical reading of his dismissal of metaphysics and of Wittgenstein's objections to Russell in 1913. I argue that Wittgenstein must be read as advocating no particular theory or doctrine — that is, philosophy is an activity and not a body of truths. Furthermore, this insistence is thoroughgoing. Put differently, a dialectical reading must be applied to one's own thought and talk. Characteristically, this sort of dialectical philosophy begins with the question, Is there any definiteness (...) to what I am doing in my own thinking and speaking? Such a question undercuts the easy assumption that what we are doing may be expressed in a body of meaningful statements. In particular, I argue that Wittgenstein does not advocate any particular theory of language. A common reading of Wittgenstein is that he aims to prevent us from misusing language. This view assumes that, for Wittgenstein, the notion of a correct, acceptable or meaningful use of language may be taken for granted. In my view, Wittgenstein does not take the notions of use of language and grammar and its misuse for granted. For Wittgenstein grammar underdetermines what it is to use or misuse language. I argue that an ethical critique is implicit in Wittgenstein's objections to any attempt to speak a priori about language and thought. (shrink)

Umbilical cord blood has become the focus of intense efforts to collect, screen and bank haematopoietic stem cells in hundreds of repositories around the world. UCB banking has developed through a broad spectrum of overlapping banking practices, sectors and institutional forms. Superficially at least, these sectors have been widely distinguished in bioethical and policy literature between notions of the ‘public’ and the ‘private’, the commons and the market respectively. Our purpose in this paper is to reflect more critically on these (...) distinctions and to articulate the complex practical and hybrid nature of cord blood as a ‘bio-object’ that straddles binary conceptions of the blood economies. The paper draws upon Roberto Esposito’s reflections on biopolitics and his attempt to transcend the dualistic polarisations of immunity and community, or the private and the public. We suggest that his thoughts on immunitary hospitality resonate with many of the actual features and realpolitik of a necessarily internationalised and globally distributed UCB ‘immunitary regime’. This article finds firmer evidence than has previously been presented that men are more left-wing than women in older birth cohorts, while women are more left-wing than men in younger cohorts. Analysis of the European Values Study/world Values Survey provides the first systematic test of how processes of modernization and social change have led to this phenomenon. In older cohorts, women are more right-wing primarily because of their greater religiosity and the high salience of religiosity for left-right self-placement and vote (...) choice in older cohorts. In younger, more secular, cohorts, women’s greater support for economic equality and state intervention and, to a lesser extent, for liberal values makes them more left-wing than men. Because the gender gap varies in this way between cohorts, research focusing on the aggregate-level gap between all men and all women underestimates gender differences in left-right self-placement and vote choice. In On Virtue Ethics I offered a criterion for a character trait's being a virtue according to which a virtuous character trait must conduce to, or at least not be inimical to, four ends, one of which is the continuance of the human species. I argue here that this does not commit me to homosexuality's being a vice, since homosexuality is not a character trait and hence not up for assessment as a virtue or a vice. Vegetarianism is not up (...) for such assessment either, for the same reason, but, as a practice, may well be required by the virtue of compassion, and sacrificing one's life for an animal or alien may be required by courage. The clause about the continuance of the human species in my criterion does not specify a foundational value, because, following McDowell, I reject foundationalism. (shrink)

Clinical ethics has been developing in paediatric healthcare for several decades. However, information about how paediatricians use clinical ethics case consultation services is extremely limited. In this project, we analysed a large set of case records from the clinical ethics service of one paediatric hospital in Australia. We applied a paediatric-specific typology to the case referrals, based on the triadic doctor–patient–parent relationship. We reviewed the 184 cases referred to the service in the period 2005–2014, noting features including the type of (...) case, the referring department(s) and the patient9s age at referral. The two most common types of referral involved clinician uncertainty about the appropriate care pathway for the child (26% of total referrals) and situations where the child9s parents disagreed with the doctors’ recommendations for the child9s care (22% of total referrals). Referrals came from 28 different departments. Cancer, cardiology/cardiac surgery and general medicine referred the highest numbers of cases. The most common patient age groups were children under 1, and 14–15 years old. For three controversial areas of paediatric healthcare, clinicians had initiated processes of routine review of cases by the clinical ethics service. These insights into the way in which one very active paediatric clinical ethics service is used further our understanding of the work of paediatric clinical ethics, particularly the kinds of ethically challenging cases that paediatricians view as appropriate to refer for clinical ethics support. Given that it relies on claims about human nature, has Aristotelian virtue ethics been undermined by evolutionary biology? There are at least four objections which are offered in support of the claim that this is so, and I argue that they all fail. The first two maintain that contemporary AVE relies on a concept of human nature which evolutionary biology has undercut and I show this is not so. In Part 2, I try to make it clear that Foot's Aristotelian (...) ethical naturalism, often construed as purporting to provide virtue ethics with a foundation, is not foundationalist and is not attempting to derive ethics from biology. In Part 3, I consider the other two objections. These do not make a misguided assumption about Aristotelian ethical naturalism's foundational aspirations, nor question AVE's use of the concept of human nature, but maintain that some of AVE's empirical assumptions about human nature may well be false, given the facts of our evolution. With respect to these, I argue that, as attempts to undermine AVE specifically, they fail, though they raise significant challenges to our ethical thought quite generally. (shrink)

This paper argues that doctors' ethical challenges can be usefully conceptualised as role virtue conflicts. The hospital environment requires doctors to be simultaneously good doctors, good team members, good learners and good employees. I articulate a possible set of role virtues for each of these four roles, as a basis for a virtue ethics approach to analysing doctors' ethical challenges. Using one junior doctor's story, I argue that understanding doctors' ethical challenges as role virtue conflicts enables recognition of important moral (...) considerations that are overlooked by other approaches to ethical analysis. In contrast to Di Nucci’s characterisation, my argument is not a technoapocalyptic one. The view I put forward is that systems like IBM’s Watson for Oncology create both risks and opportunities from the perspective of shared decision-making. In this response, I address the issues that Di Nucci raises and highlight the importance of bioethicists engaging critically with these developing technologies.

This contribution to the new readings of the early Wittgenstein presents in detail how one might read the Tractatus as a sustained attack on Frege's and Russell's philosophical and logical conceptions while at the same time (...) presuming Wittgenstein to have always been in some sense a "late Wittgensteinian," that is, already embarked on the therapeutic task of setting down "the way of release" from philosophical confusion and "ensnarement of thought" (1). Taking seriously the passage in the Tractatus (6.54) in which Wittgenstein assesses his "elucidations" as "nonsensical," Ostrow places himself among those readers who infer that straightforward theory-making was not Wittgenstein's aim, but differs from them in his original and challenging account of how the propositions of the Tractatus are nonsense.Wittgenstein, Ostrow contends, employed such (apparent) doctrines as the picture theory, the showing doctrine, the notion of tautology, and so forth dialectically, that is, as self-detonating attempts to expose philosophical nonsense in situ which were not themselves intended to be argued pro or con as philosophical assertions or theories. Wittgenstein's purpose in speaking in the Tractatus in avowedly though not patently nonsensical ways is, the author argues, to encourage us instead to see philosophical nonsensicality as "given in and through" the process of making such philosophical assertions, and in seeing how they "change their character, how they undermine their initial presentation as straightforward truth claims" (12). Thus the "central notions" and propositions in the Tractatus, according to Ostrow, "only have their life in relation to the philosophical temptations that the book aims to eradicate" (43).Such a reading involves the author (and his readers) in a task that is both detailed and delicate. Ostrow's work is detailed because he reads Wittgenstein as engaged in a systematic attempt to expose philosophical theories as nonsense case-by-particular-case, that is, by "working through philosophy from the inside, without making appeal to any kind of fixed criteria of sense and nonsense" (99). It is for this reason that Wittgenstein's articulation of the many structures in the Tractatus is necessary, and Ostrow's work, which he views as largely descriptive, must trace the same path.Ostrow's task is a delicate one because he must explore the themes in Wittgenstein's Tractatus (pictures, significant propositions, logical propositions, etc.) without appearing to contradict his position that the Tractatus offers no general doctrines meant to be taken as they stand. Thus, for instance, when Ostrow argues that for Wittgenstein pictorial form is constituted by a picture's application to reality and not an independent entity, he must remind the reader that he is not attributing to Wittgenstein a doctrine of "constitution of form" offered up as a philosophical alternative. Just as we are not to make pictorial form and its emergence in the Tractatus into a substantive theory in its own right but rather see it as having a role only in Wittgenstein's battle to expose such shibboleths (44), so too for all other parts of the Tractarian structure. Thus Wittgenstein's apparent explanation of the [End Page 281] possibility of depiction in terms of isomorphism is said to aim at showing that as an explanation, "talk of an isomorphism is empty" (39); Wittgenstein's show/say distinction is taken as a foil used to expose the logician's desire to get at essence (42), and so forth. Even the notion of tautology is, according to Ostrow, "as dialectical a move as any other," not one "put forth as a self-standing claim, an attempt to offer an overarching characterization of truth" (105).This book engages in its daunting task very ably and in fluid, confident prose.
