Media reports of the health hazards posed by nano-sized particles have turned a white hot spotlight on the risks of nanotechnology. Worried about the risks posed to workers producing nano-materials, the Washington Post has labeled nanotechnology a “seat-of-the-pants occupational health experiment.” This article examines our emerging knowledge base about the hazards of two types of exposure: inhalation of NSPs and topical application of products containing NSPs. It argues that a clear-eyed evaluation of the benefits and risks of nanotechnology is made (...) extremely difficult by the marriage of a complex science with a venture capitalist-like hype. It then suggests that, absent additional statutory authority, governmental regulators cannot readily address the risks posed by these products. This regulatory inaction leaves a significant role for the private insurance market, a role that regulators should support in tangible ways outlined in the article. (shrink)

Nanotechnology is a subject about which we know less than we should, but probably more than we think we do at first glance. Like Defense Secretary Donald Rumsfeld's “known unknowns,” we have learned enough to know what we should be concerned with. Glimmers of risk cropped up recently when German authorities recalled a bathroom cleansing product, “MagicNano,” that purported to contain nanosized particles and was on the market for only three days. More than one hundred people suffered severe respiratory problems (...) – six of whom were hospitalized with pulmonary edema. Although a subsequent analysis of MagicNano found that the nanoliquid ingredient morphed in the production into “supersized” particles, the recall nonetheless turned a white hot spotlight on the risk of NSPs. This article teases out the relationship between family form and the state's social safety nets around healthcare, showing the deep unfairness of measuring social safety nets by whether a couple marries. By continuing to tie healthcare benefits to specific family structures, we perpetuate the “galloping” inequality marking America today.This article concludes that, whatever happens with the thousands of benefits given to married couples in other domains, social policy should move beyond marriage with respect to healthcare. This Essay examines the elegantly simple idea that consent to medical treatment or participation in human research must be “informed” to be valid. It does so by using as a case study the controversial clinical research trial known as the Surfactant, Positive Pressure, and Oxygenation Randomized Trial. The Essay begins by charting, through case law and the adoption of the common rule, the evolution of duties to secure fully informed consent in both research and treatment. The Essay then utilizes the (...) SUPPORT study, which sought to pinpoint the level of saturated oxygen that should be provided to extremely low birth weight infants to demonstrate modern complexities and shortcomings of the duty to secure informed consent. This Essay shows how the duty is measured by foreseeability of risks and benefits in human research and why federal regulators believed the tradeoffs in risk and benefits from differing oxygen levels administered in the support study were foreseeable. It then explores the contours of the duty to secure informed consent when applied to researchers who also serve as treating physicians, highlighting how common law duties differ in jurisdictions that apply the professional standard and those that apply the patient-centered material risk standard. This Essay provides new insight into what the law must do to make real the notion that [e]very human being of adult years and sound mind has a right to determine what shall be done with his body.”. Although the incidence and composition of HECs has been well characterized, little is known about how HECs assess their performance. In order to describe the incidence of HEC self-evaluation, the methods HECs use to evaluate their performance, and the characteristics of HECs that influence self-evaluation, we surveyed the readers ofHospital Ethics. 290 HECs in 45 U.S. states, the District of Columbia, Puerto Rico and three Canadian provinces, completed questionnaires. Of the 241 HECs included in the data analysis, 97.9% had performed (...) some self-evaluation. Responding committees largely made formative rather than summative evaluations and appeared to evaluate performance in light of their own objectives rather than basing assessments on specific structural, process, and outcome measures of quality. Responding committees used certain evaluation criteria more extensively than others — among these, the number of participants and staff knowledge of the service provided — with the choice of criteria differing with the function being evaluated. Eight characteristics of HECs influenced the probability of self-evaluation, including age, number of beds and meetings, the existence of a mission statement, and a budget. The presence of certain characteristics made HECs six times more likely to evaluate their performance than HECs without the characteristic. (shrink)

Courts evaluating mandated disclosures gravitate to professional norms rather than the information most women would value: basic factual information about EC so that they can decide for themselves whether to use these drugs.

Illustrated by critically examining a range of architectural journalism, from an article by artist Paul Nash in 'The Architectural Review', 1940, to an early project by contemporary French architects Lacaton et Vassal published in the journal '2G' in 2001, to recent photography by Hisao Suzuki published in the journal 'El Croquis', this book brings a radical and detailed analysis of the architectural media. It addresses issues of architectural criticism, architectural photography and the role of journal editors, and argues that the (...) architectural media is a site of contestation and ambiguity regarding the role of critical and speculative thinking. The book highlights moments where a different type of critical voice emerges within the architectural media, indicating the possibility of a more progressive engagement with the media as a platform for critical thinking about architecture. 0The study is underpinned by theory about utopian thinking/discourse, primarily from the work of the French semiotician and art theorist Louis Marin and the American Marxist critic Fredric Jameson. Through this, it builds a fresh theoretical approach to the architectural media and begins to reveal a hitherto unexplored dimension of ‘latent’ or ‘unconscious’ discourse within the media portrait of architecture. Following Jameson’s charting of the role of the utopian imagination in the modern and post-modern periods, the book suggests that genuine utopian thinking has undergone comprehensive suppression in our current times and that the task of theory is to now to detect its presence and explore its meaning within new forms and sites of cultural production. Newborn bloodspot screening programs are some of the longest running population screening programs internationally. Debate continues regarding the need for parents to give consent to having their child screened. Little attention has been paid to how meanings of consent-related terminology vary among stakeholders and the implications of this for practice. We undertook semi-structured interviews with parents, healthcare professionals and policy decision makers in two Canadian provinces. Conceptions of consent-related terms revolved around seven factors within two broad domains, decision-making and information (...) attainment. Decision-making comprised: parent decision authority; voluntariness; parent engagement with decision-making; and the process of enacting choice. Information ascertainment comprised: professional responsibilities ; parent responsibilities; and the need for discussion and understanding prior to a decision. Our findings indicate that consent-related terms are variously understood, with substantive implications for practice. We suggest that consent procedures should be explained descriptively, regardless of approach, so there are clear indications of what is expected of parents and healthcare professionals. Support systems are required both to meet the educational needs of parents and families and to support healthcare professionals in delivering information in a manner in keeping with parent needs. Maurice Warwick Beresford, a Fellow of the British Academy, was an economic and social historian born in Sutton Coldfield, Warwickshire to Harry Bertram Beresford and Nora Elizabeth Jefferies. He was ill at ease in the social fabric of Jesus College in the late 1930s. Still, Beresford flourished academically under the guidance of an understanding Tutor, Bernard Manning, and a supportive Director of Studies, Charles Wilson. Social work of various kinds was to remain a major interest throughout his life. In (...) the autumn of 1942, Beresford moved to Rugby to take up a residential post as Sub-Warden of the Percival Guildhouse, an adult education centre. By early 1946, he had applied for posts in history at Glasgow and economic history at Nottingham. While settling in at the University of Leeds in 1948, several papers resulting from his archival and fieldwork in the midlands were published. But before moving to Leeds, Beresford trespassed into archaeology for the first time. Beresford retired from Leeds in 1985. (shrink)

Because of his misogyny and disdain for the body, Kant has been a target of much feminist criticism. Moreover, as the epitome of eighteenth-century Enlightenment philosophy, his thought has been a focal point for feminist debate over the Enlightenment legacy—whether its conceptions of reason and progress offer tools for women's emancipation and empowerment or, rather, have contributed to the historical subordination of women in Western society. This volume presents radically divergent interpretations of Kant from feminist perspectives. Some essays see Kant (...) as having contributed significantly to theories of rationality and autonomy in ways that can further feminist projects. Other essays argue that Kant is a preeminent exponent of patriarchal views and that gender hierarchies are inscribed in the very structure of his theories of morality and aesthetic judgment. We describe several cases of content focused injustice, and we theoretically interrogate those cases by building up a general framework through which to understand them as a genuine form of epistemic injustice that stands in (...) intertwined relationships to other forms of epistemic injustice. The reclamation of slurs raises a host of important questions. Some are linguistic: What are the linguistic conventions governing the slur post-reclamation and how are they related to the conventions governing it pre-reclamation? What mechanisms engender the shift? Others bend toward the social: Why do a slur’s targets have a special privilege in initiating its reclamation? Is there a systematic explanation why prohibitions on out-group use of reclaimed slurs vary from slur to slur? And how does reclamation contribute to shaping (...) social identities and reversing oppressive social norms and stigma? Most analyses of slur reclamation advance a single model to answer these questions. The author argues that there are different varieties of reclamation. Two predominate, what she calls pride reclamation and insular reclamation. While many features unite pride and insular reclamation, they differ with respect to the purpose of the reclamatory act, the linguistic mechanisms reclaimers employ to execute the linguistic change, and the social and grammatical roles of the reclaimed slur. By distinguishing these two types of reclamation and offering a fine-grained characterization of their properties, the author argues that we gain deeper insight into the reasons why slurs may in principle only be ignited by the target group and why pride- but not insular-reclaimed slurs become available for use by out-group members. This article analyses Adam Smith's and Sophie de Grouchy's accounts of sympathy to show how they arrive at strikingly different views on whether inequality is a threat to, or precondition of, social order. Where many scholars have recently sought to recover Smith's egalitarianism, I instead focus on how his account of sympathy in The Theory of Moral Sentiments naturalises socioeconomic inequalities, while also highlighting the wider inegalitarian implications of his analysis. I demonstrate that Grouchy was alert to these implications and (...) reveal how her own account of sympathy challenges the moral psychology underlying Smith's position on inequality. By reconstructing Grouchy's response to Smith, I illustrate how retrieving the insights of long‐overlooked thinkers can reorient the way we understand key debates in the history of philosophy, since Grouchy was far more concerned than Smith with exposing how economic inequality imperils the prospects of relating to one another as equals. Distinctions in fundamentality between different levels of description are central to the viability of contemporary decoherence-based Everettian quantum mechanics (EQM). This approach to quantum theory characteristically combines a determinate fundamental reality (one universal wave function) with an indeterminate emergent reality (multiple decoherent worlds). In this chapter I explore how the Everettian appeal to fundamentality and emergence can be understood within existing metaphysical frameworks, identify grounding and concept fundamentality as promising theoretical tools, and use them to characterize a system of explanatory (...) levels (with associated laws of nature) for EQM. This Everettian level structure encompasses and extends the ‘classical’ levels structure. The ‘classical’ levels of physics, chemistry, biology, etc. are recovered, but they are emergent in character and potentially variable across Everett worlds. EQM invokes an additional fundamental level, not present in the classical levels picture, and a novel potential role for self-location in interlevel metaphysics. When given a modal realist interpretation, EQM also makes trouble for supervenience-based approaches to levels. (shrink)

A country doctor and natural philosopher, Bachelor was impelled to chronicle his life from 1870 to 1902, documenting the family's move to Arkansas, their settling a farm in Franklin County, and Bachelor's medical practice. Bachelor was an avid reader with wide-ranging interests in literature, science, nature, politics, and religion, and he became a self-professed freethinker in the 1870s. He was driven by (...) a concept he called "fiat flux," an awareness of the "rapid flight of time" that motivated him to treat the people around him and the world itself as precious and fleeting. This paper argues that we can acknowledge the existence of moral truths and moral progress without being committed to moral realism. Rather than defending this claim through the more familiar route of the attempted analysis of the ontological commitments of moral claims, I show how moral belief change for the better shares certain features with theoretical progress in the natural sciences. Proponents of the better theory are able to convince their peers that it is formally and empirically superior to its (...) rivals, and the better theory may be promoted to the status of the truth. Yet there is no 'decision-procedure' for ethics any more than there is for molecular biology. The betterness of true theories can be grasped through what I term 'undirectional narratives' of progress. And while there are true moral claims and perhaps numerous moral truths yet to be discovered, we should reject currently popular forms of moral realism with bivalence. Some moral claims lend themselves to the construction of fully reversible, bi-directional narratives and are likely neither true nor false. (shrink)
