Cost-effectiveness analysis suggests that a society should allocate its health care budget in order to achieve the greatest total health for its budget. However, in ‘rescue’ cases, where an individual’s life is in immediate peril, reasoning in terms of cost-effectiveness can appear inhumane. Hence considerations of cost-effectiveness and of rescue appear to be in tension. However, by attending to the division of labour in medical decision making it is possible to see how cost-effectiveness analysis and rescue-style reasoning are commonly combined (...) in an ethically acceptable fashion. This article examines criticisms of cost-benefit analysis and the contingent valuation method from methodological and moral philosophical perspectives. Both perspectives argue that what should be elicited for public decisions are attitudes or values, not preferences, and that respondents should be treated as citizens and not consumers. The moral philosophical criticism argues in favour of deliberative approaches over cost-benefit analysis. The methodological perspective is here criticized for overemphasizing the importance of protest responses and anomalies and biases in contingent valuation, and for (...) failing to provide the necessary information needed to make public decisions over the allocation of scarce goods. The moral philosophical perspective is criticized for: failing to provide criteria for distinguishing between values and preferences, assuming impartiality requires expression of values and not preferences; failing to recognize the diversity of forms of expression of values, including expression of values through monetary evaluation; and assuming that cost-benefit analysis is necessarily an implementation of a utilitarian political philosophy. The article concludes by showing that deliberative decision-making mechanisms can be overly demanding on citizens, and argues for greater openness in the potential moral justifications of cost-benefit analysis. This is the first book to give a collective treatment of philosophical issues relating to tax. Given that the tax system is central to the operation of states and to the ways in which states interact with individual citizens, more interdisciplinary attention to conceptual and normative issues relating to tax is urgently needed.

Health‐related Quality of Life measures have recently been attacked from two directions, both of which criticize the preference‐based method of evaluating health states they typically incorporate. One attack, based on work by Daniel Kahneman and others, argues that ‘experience’ is a better basis for evaluation. The other, inspired by Amartya Sen, argues that ‘capability’ should be the guiding concept. In addition, opinion differs as to whether health evaluation measures are best derived from consultations with the general public, with patients, or (...) with health professionals. And there is disagreement about whether these opinions should be solicited individually and aggregated, or derived instead from a process of collective deliberation. These distinctions yield a wide variety of possible approaches, with potentially differing policy implications. We consider some areas of disagreement between some of these approaches. We show that many of the perspectives seem to capture something important, such that it may be a mistake to reject any of them. Instead we suggest that some of the existing ‘instruments’ designed to measure HR QoLs may in fact successfully already combine these attributes, and with further refinement such instruments may be able to provide a reasonable reconciliation between the perspectives. The term "third wave" within contemporary feminism presents some initial difficulties in scholarly investigation. Located in popular-press anthologies, zines, punk music, and cyberspace, many third wave discourses constitute themselves as a break with both second wave and academic feminisms; a break problematic for both generations of feminists. The emergence of third wave feminism offers academic feminists an opportunity to rethink the context of knowledge production and the mediums through which we disseminate our work.

Historians of science have long considered the very idea of a law-governed universe to be the relic of a bygone intellectual culture that took it largely for granted that a divine lawmaker existed. Similarly, many philosophers of science today insist that the notion of a law of nature is fraught with implausibly theological assumptions, preferring instead to treat them as theoretical axioms in an optimal description of nature's regularities, or else as robust patterns of causal connections or causal powers whose (...) status can be reconciled to the stringent demands of metaphysical naturalism. Yet the metaphor of lawhood has proven more difficult to dislodge than the theistic commitments it once presupposed, not least because it preserves the widespread intuition that the task of scientific inquiry is not to stipulate the difference between a lawful and an accidental regularity in nature, but to discover it. Taking its cue from the repeated failure to find naturalistic alternatives to divine lawmaking, this book undertakes a retrieval and reappraisal of a high-scholastic philosophy of nature that grounds lawlike regularities in the conceptual and causal powers of God and, having done so, concludes that the metaphysical framework of classical theism yields a more powerful and parsimonious explanation of the rhythms and patterns of the natural world than its secular rivals. It is possible to retrieve viable sperm from a dying man or from a recently dead body. This sperm can be frozen for later use by his wife or partner to produce his genetic offspring. But the technical feasibility alone does not morally justify such an endeavour. Posthumous semen retrieval raises questions about consent, the respectful treatment of the dead body, and the welfare of the child to be.We present two cases, discuss these three issues, and conclude that such requests (...) should generally not be honoured unless there is convincing evidence that the dead man would want his widow to carry and bear his child. Thinking in Translation posits the Hebrew Bible as the fulcrum of the thought of Franz Rosenzweig (1886-1929), underpinning a unique synthesis between systematic thinking and biblical interpretation. Addressing a lacuna in Rosenzweig scholarship, the book offers a critical evaluation of his engagement with the Bible through a comparative study of The Star of Redemption and his Bible translation with Martin Buber. The book opens with Rosenzweig's rejection of German Idealism and fascination with the sources of Judaism. It then analyzes the (...) unique hermeneutic approach he developed to philosophy and scripture as a symbiosis of critique and cross-fertilization, facilitated by translation. An analysis of the Star exposes Rosenzweig's employment of translation in grafting biblical verses unto the philosophical discussion. It is followed by a reading that demonstrates how his Bible translation reflects an attempt to re-valorize the Tanakh as a distinctively Jewish scripture, over and against Christian appropriations. Thinking in Translation recasts Rosenzweig's life's work as a project of melding Judaism and modernity in an attempt to secure their spiritual and intellectual survival. (shrink)

Given the great importance of morality and values in modern sports, especially among young athletes, in this pilot study, we sought to broaden the exploration of the factors that may play role in these contexts, which have not been widely researched to date. Accordingly, the study tested the relationships between sport type (team or individual) and parenting styles (authoritative vs. non-authoritative), and moral decision-making in sport and sport values among 110 adolescent athletes whose age ranges from 11 to 22 (M= (...) 16.04,SD= 2.86). The findings indicated that participants with authoritative parents, as compared to those with non-authoritative parents, are significantly less accepting of cheating in sport, while they also tend more to keep winning in proportion and hold significantly stronger moral values toward sports. Moreover, participants whose main sport is a team sport type tend to accept more cheating and gamesmanship than participants whose main sport is an individualistic sport type. While no differences were recorded between these groups in moral values, team athletes tend to value status in sport more than individual athletes, while the latter tend to value competence regarding their sport. The implications of the findings are discussed in light of no interaction between the effects of parenting styles and sport type on moral and sport values. (shrink)

Two Lagrangians L and L′ are equivalent if the equations of motion derived from them have the same set of solutions. In that case, a matrix Λ may be defined which has the property that the trace of any analytic function of Λ is a constant of the motion. We extend this trace theorem to the case of classical field theory and discuss some of the implications for quantum theory and for procedures for finding equivalent Lagrangians.

A long history of extractive industries and activities have shaped the societies of northern Mozambique, and the Cabo Delgado province in particular. For centuries, the growing international demand on local resources had a great impact on the northern micro-societies. The demand for cheap labour and natural resources, ranging from ivory and cotton, to timber, rubies, land, gas and more, involved thousands of local actors in its extraction, reproducing systems of local power. The persistence of poverty, inequality and conflicts, as well (...) as simmering and sometimes grand-scale violence, fits into a long-term trend of extractivism. Through a historical approach and field observations, we focus on the political economy of extracting natural resources. We point out the persisting basic patterns of extractivism that accompanied Mozambique's integration into global markets, and continued or even deepened, in the post-independence period. These activities are oriented towards foreign markets. They are instigated by foreign investment, but invariably carried out in collaboration with a chain of national gatekeepers. In a clientelist system, local elites resort to their proximity to the state to reproduce their power, often at the expense of state expropriation. Weak state institutions have the functional effect of reproducing the elites, also serving the interests of extractivist capital. It is, however, a system with many and profound contradictions, producing conflict and violence, which also recurrently put those interests at risk. (shrink)

In the literature on conspiracy theories, the least contentious part of the academic discourse would appear to be what we mean by a “conspiracy”: a secretive plot between two or more people toward some end. Yet what, exactly, is the connection between something being a conspiracy and it being secret? Is it possible to conspire without also engaging in secretive behavior? To dissect the role of secrecy in con- spiracies – and thus contribute to the larger debate on the epistemology (...) of conspir- acy theories – we dene the concepts of “conspiracy,” “conspirator,” and “secret,” and argue that while conspirators might typically be thought to commit to keeping secrets once their conspiracy is underway, the idea that conspiracies are necessarily secretive to start with is not as obvious as previously thought. Deliberative democratic theory emphasises the importance of informed and reflective discussion and persuasion in political decision-making. The theory has important implications for constitutionalism - and vice versa - as constitutional laws increasingly shape and constrain political decisions. Orr and Dentith argue that a recurrent problem in much of the wider academic literature on conspiracy theories is either conceptual confusion or a refusal to put theory before practice. Orr and Dentith show that a naive empiricism pervades much of the social science literature when it comes to these things called ‘conspiracy theories’ which not only runs at odds with the philosophical literature but also the general tenor of the social sciences over the latter part of the 20th Century (...) and beyond. Orr and Dentith argue that central to these confusions or refusals is not just a lack of philosophical rigour when it comes to defining and presenting views, but an active disinterest in such conceptual work. Surveys and routine clinical procedures applied in research protocols are typically considered only minimally risky to participants. The apparent benign nature of "minimal risk" tasks increases the chance that investigators and Institutional Review Boards (IRBs) will overlook the probability that clinical tools will identify signs, symptoms, or definitive test results that are clinically-relevant to subjects' welfare. "Minimal risk" procedures may also pose a particular hazard to participants in clinical research by increasing the therapeutic misconception because the tasks mimic clinical care (...) and are often conducted in clinical settings. Investigators should anticipate which measures could yield clinically-important findings and should describe explicit plans for data monitoring, disclosure, and follow-up. Protocols that include reliable and valid clinical measures should prompt a more detailed risk assessment by the IRB, even when the tasks meet the regulatory criteria for minimal physical, psychological, or emotional risk. In about 700, a century after his death, the Life of Columba was written by Adomnán, ninth abbot of Iona. It has long been valued as the major primary source on the subject, for the light it throws on (...) early medieval Scotland and Ireland, and as an important work of literature. The 1961 edition of the Life, by Alan and Marjorie Anderson, has long been unavailable. Marjorie Anderson has now revised both the Latin text and the English translation, provided new historical notes, and rewritten the Introduction to take account of recent work in the area. This new edition of a source indispensable for the study of the early medieval church meets a major scholarly need. (shrink)

Home advantage in sports has been extensively researched in the academic literature over the past five decades. A review of the literature reveals several factors that consistently underly this phenomenon. One of the most documented is the home crowd effect. While the crowd effect on the results has been widely researched considering noise, size, and density, there are conflicting findings of the effect and its extent. Furthermore, the perceptions of fans, athletes, coaches, and officials of the causes of home advantage (...) in general and the crowd effect in particular, remain marginal. This is especially important in the face of significant regulation changes in the stands caused by the COVID-19 pandemic. The current study, therefore, examined the perceptions of fans, athletes, coaches, and officials of the Israeli handball premier league regarding fans’ contribution to the home advantage phenomenon along with other factors. A questionnaire examining perceptions regarding home advantage was distributed to 232 Israeli participants. Results, based on MANOVA, ANOVA, and post-hoc analyses, indicated significant differences in participants’ perceptions of the different factors in general and the crowd factor in particular. Overall, the crowd was perceived as the most important factor contributing to the home advantage phenomenon. Furthermore, fans perceived their contribution significantly higher than the rest of the participants. On the other hand, officials ranked their contribution to the home advantage effect as low as well as significantly under ranked their contribution in comparison to the other groups. This result suggests that officials perceive themselves as relatively robust to the crowd effect compared to the other participants. Additional results are discussed in light of existing gaps in the literature on the home advantage phenomenon. Alongside the theoretical contribution, these findings contribute to applied implications of increasing the home advantage effect when playing at home and negating the home advantage when playing away. This article examines the process of one institution’s efforts to develop an educational academic integrity seminar through an ethnographic study approach. The educational program developed allowed the institution to transition from a punitive sanctioning system to an educational one. The institution cultivated cross-campus partnerships to develop the program. Both quantitative and qualitative data revealed that students had a positive experience attending the program and found it useful. This article serves as a framework for institutions to utilize when building their own (...) educational-based academic integrity on-campus seminar and sanctioning program. (shrink)

Association between sister chromatids is essential for their attachment and segregation to opposite poles of the spindle in mitosis and meiosis II. Sister‐chromatid cohesion is also likely to be involved in linking homologous chromosomes together in meiosis I. Cytological observations provide evidence that attachment between sister chromatids is different in meiosis and mitosis and suggest that cohesion between the chromatid arms may differ mechanistically from that at the centromere. The physical nature of cohesion is addressed, and proteins that are candidates (...) for holding sister chromatids together are discussed. Dissolution of sister‐chromatid cohesion must be regulated precisely, and potential mechanisms to release cohesion are presented. (shrink)

Requests by patients or their families for treatment which the patient's physician considers to be "inappropriate" are becoming more frequent than refusals of treatment which the physician considers appropriate. Such requests are often based on the patient's religious beliefs about the attributes of God (sovereignty, omnipotence), the attributes of persons (sanctity of life), or the individual's personal relationship with God (communication, commands, etc). We present four such cases and discuss some of the basic religious tenets of the three Abrahamic faith (...) traditions as they relate to such requests. We suggest that religious reasons for requesting "inappropriate" treatment are "special" and deserve serious consideration. We offer guidance to assist clinicians and clinical ethicists as they attempt to resolve these conflicts, emphasising the importance of understanding the religious beliefs of the patient/surrogate and suggesting the assistance of a religious interpreter. We suggest open discussion with patients and families of both the clinical situation and the theological basis for these requests. We also suggest that clinicians use additional religious doctrines or principles from patients' own traditions to balance the reasons behind the requests. We conclude that most persistent requests for "inappropriate" treatment should be honoured. (shrink)

This paper predicts the probability of a profound world climate change that will affect the governance of the world's societies. Carbon dioxide levels in the earth's atmosphere may be doubled in sixty years, warming the earth's climate and altering drastically the patterns of food production, agriculture, forestry and consequently relations between societies.

The conventional approach to developing disease‐modifying treatments for neurodegenerative conditions has been to identify drivers of pathology and inhibit such pathways. Here we discuss the possibility that the efficacy of such approaches may be increasingly attenuated as disease progresses. This is based on experiments using mouse models of spinocerebellar ataxia type 1 and Huntington's disease (HD), where expression of the dominantly acting mutations could be switched off, as well as studies in human HD, which suggest that the primary genetic driver (...) of age‐of‐onset of disease is a much weaker determinant of disease progression in affected individuals. The idea that one may approach a point in the disease course where such rational therapeutic strategies based on targets which determine onset of disease have minimal efficacy, suggests that one needs to consider other approaches to therapies and clinical trial design, including initiation of therapies in presymptomatic individuals. One common feature of debates about the best metaphysical analysis of putatively lawful phenomena is the suspicion that nomic realists who locate the modal force of such phenomena in quasi-causal necessitation relations between universals are working with a model of law that cannot convincingly erase its theological pedigree. Nancy Cartwright distills this criticism into slogan form: no God, no laws. Some have argued that a more plausible alternative for nomic realists who reject theism is to ground laws of nature in (...) the fundamental dispositional properties or “pure powers” of physical objects. This article argues that for all its advantages over deflationary and rival realist accounts, a pandispositionalist account of law cuts against the commitment to metaphysical naturalism that its supporters almost always presuppose. It then examines and rejects a Platonic version of this account before elaborating and advancing a theistic alternative that is more theoretically powerful and more metatheoretically parsimonious.
