Cet effet, appelé « le biais de financement », persiste depuis les travaux des années 1990 jusqu’aux travaux récents. Il peut être élargi à d’autres domaines tels que l’agro-alimentaire, l’étude des risques environnementaux et sanitaires, etc. Les conflits d’intérêts peuvent influencer la recherche par des voies inconscientes (...) ou volontaires. Nous analysons les modes d’action possibles des conflits d’intérêts sur le déroulement de l’activité scientifique, ainsi que l’efficacité des diverses solutions qui ont été proposées pour gérer ces influences.In the field of biomedicine, which is the main object addressed in this article, the literature shows a direct correlation between industrial funding for research and the communication of results that are favourable to the industry. This effect, known as the “ funding effect”, has been persistenly found since the 1990s. It can also affect other fields such as agri-foods or environmental and health risk assessments. Conflicts of interest can influence research subconsciously or deliberately. In this article, we analyse the various ways in which conflicts of interest can influence the way scientific activities proceed, as well as the effectiveness of the different solutions put forward to manage the influence exerted. L’image publique négative de la chimie, science et industrie, est une préoccupation importante pour nombre de chimistes. La proclamation de l’année 2011 comme « Année de la Chimie » par l’ONU en est une preuve. En réponse à cette préoccupation, deux modèles d’interaction avec le public peuvent être identifiés parmi les chimistes. Une première approche, structurée autour de l’idée d’« acceptabilité », vise à l’éducation du grand public et à la démonstration des bénéfices de la chimie dans la vie quotidienne. (...) Une deuxième approche, qui peut être appelée « dialogique », considère que les relations entre chimie et société vont au-delà d’une question d’image, et constituent surtout une question de fond. Comme pour d’autres sciences, il s’agit d’un changement nécessaire dans les pratiques des chercheurs et des industriels. Cet article analyse ces deux courants de pensée de façon comparative, selon trois aspects structurants : le concept de communication, l’image du public et les terrains de la communication.The negative public image of chemistry, science and industry, is a major concern for many chemists. Proclaiming the year 2011 as "Year of Chemistry" by the UN is proof. In response to this concern, two models of interaction with the public can be identified among chemists. One approach, structured around the idea of ​​"acceptability", aims to educate the general public and to demonstrate the benefits of chemistry in everyday life. A second approach, which can be called "dialogical", considers the relationship between chemistry and society beyond a question of image, and are mostly a matter of substance. Like other sciences, it is a necessary change in the practices of researchers and industrialists. Dans un cadre réglementaire de mise sur le marché des substances chimiques, l’information sur les risques chimiques pour la santé et l’environnement doit être généralement produite par les industriels, qui la soumettent aux agences sanitaires. L’accès du public à cette information est régulé par des dispositifs juridiques internationaux, européens et nationaux, et fondé sur les principes de transparence et de liberté d’accès et de réutilisation. Cependant, différents facteurs restreignent l’effectivité du droit à l’information et par conséquent le contrôle démocratique et (...) scientifique sur l’évaluation du risque. Les textes juridiques sont éclatés entre la législation environnementale et celle sur l’accès aux données publiques. Le droit d’accès peut être limité juridiquement pour des raisons de confidentialité et de secret industriel, des dispositions qui permettent aux entreprises de protéger leurs intérêts commerciaux mais qui peuvent être interprétés de manière arbitraire par les agences. Enfin sur le plan pratique, le manque de lisibilité du format, le langage employé et les interfaces peuvent constituer des obstacles à l’accès effectif et à la réutilisation des données.Under the regulations governing marketing authorisation for chemical substances, information on chemical risks to health and the environment generally has to be produced by the industries concerned for submission to the health agencies. Public access to this information is governed by international, European and national legal provisions, and based on the principles of transparency and the freedom to access and re-use the information. However, various factors are restricting the effectiveness of this right to information and, consequently, restricting democratic and scientific oversight of risk assessments. The relevant legal texts are split between environmental legislation and legislation on access to public data. The right of access can be legally limited on grounds of confidentiality and protection of trade secrets, under provisions that allow businesses to protect their commercial interests but which can be interpreted arbitrarily by the health agencies. Finally, on the practical level, the lack of clarity of the format, the language used and the interfaces can be an obstacle to effective access and re-use of the data. (shrink)

La réglementation européenne prévoit une évaluation des risques par les entreprises qui souhaitent (continuer de) produire et mettre sur le marché des pesticides et des substances chimiques industrielles. Cette information est produite par les industriels eux-mêmes et soumise à une évaluation par les agences nationales et européennes qui sont responsables de la mise en œuvre de ces réglementations (en France, l'ANSES , en Europe, l'EFSA et respectivement l'ECHA ). L'accès à ces informations soumises par les industriels et analysées par les (...) agences est essentiel pour s'assurer de la meilleure qualité de l'évaluation de ces risques. Les conséquences des évaluations du risque chimique touchent potentiellement des parties importantes de la population, car de nombreuses substances chimiques sont présentes dans nos vies. Il est donc important d'être capable d'assurer, par une veille collective, que ces évaluations soient réalisées de la meilleure manière possible et sur la base de données et méthodes scientifiques vérifiables. L'accès à l'information est fondé sur des principes généraux de transparence et de responsabilité des administrations de manière à faciliter la participation du public au processus démocratique et au contrôle des activités qui les concernent directement. Limiter l'accès à l'information revient à donner le pouvoir à certains acteurs d'influencer ces évaluations et pas à d'autres. Des questions de contrôle démocratique, d'équité et de justice évidentes se posent si l'exercice de ce pouvoir est d'une part donné aux acteurs industriels qui deviennent juges et parties (leur activité doit être régulée sur la base des informations qu'ils produisent eux-mêmes) et est d'autre part rendu difficile voire refusé aux acteurs de la société civile qui peuvent subir les effets des substances chimiques. Malheureusement aujourd'hui, différents facteurs restreignent l'effectivité du droit à l'information environnementale sur les risques chimiques et facilitent dans certains cas une telle injustice : * l'éclatement et le manque de lisibilité des textes encadrant cet accès à l'information, * les limitations juridiques au principe de liberté d'information qui ont été intégrés dans ces mêmes textes afin de défendre les intérêts des industriels, * les réticences administratives et la difficulté pratique des procédures et des recours, * et enfin les limitations pratiques à la compréhension et à l'utilité des données. Health policymakers employ utility measures to inform resource allocation decisions. They often rely on a conceptual tool called the quality-adjusted life year that discounts the value of years lived in a state of disability relative to years lived in full health. A representative sample of the general public is asked to place values on hypothetical health states as part of a standard gamble or time trade-off task. A foundational goal of cognitive linguistics is to explain linguistic phenomena in terms of general cognitive strategies rather than postulating an autonomous language module (Langacker 1987: 12–13). Metonymy is identified among the imaginative capacities of cognition (Langacker 1993: 30, 2009: 46–47). Whereas the majority of scholarship on metonymy has focused on lexical metonymy, this study explores the systematic presence of metonymy in word-formation. I argue that in many cases, the semantic relationships between stems, affixes, and the words they form can (...) be analyzed in terms of metonymy, and that this analysis yields a better, more insightful classification than traditional descriptions of word-formation. I present a metonymic classification of suffixal word-formation in three languages: Russian, Czech, and Norwegian. The system of classification is designed to maximize comparison between lexical and word-formational metonymy. This comparison supports another central claim of cognitive linguistics, namely that grammar (in this case word-formation) and lexicon form a continuum (Langacker 1987: 18–19), since I show that metonymic relationships in the two domains can be described in nearly identical terms. While many metonymic relationships are shared across the lexical and grammatical domains, some are specific to only one domain, and the two domains show different preferences for source and target concepts. Furthermore, I find that the range of metonymic relationships expressed in word-formation is more diverse than what has been found in lexical metonymy. There is remarkable similarity in word-formational metonymy across the three languages, despite their typological differences, though they all show some degree of language-specific behavior as well. Although this study is limited to three Indo-European languages, the goal is to create a classification system that could be implemented (perhaps with modifications) across a wider spectrum of languages. In his later moral writings Kant claims that we have a duty to cultivate certain aspects of our sensuous nature. This claim is surprising for three reasons. First, given Kant’s ‘incorporation thesis’ − which states that the only sensible states capable of determining our actions are those that we willingly introduce and integrate into our maxims − it would seem that the content of our inclinations is morally irrelevant. Second, the exclusivity between the passivity that is characteristic of sensibility and (...) the spontaneous quality of our free will that operates throughout Kant’s philosophy seems to preclude that any such cultivation is possible. Third, Kant’s specific arguments concerning why we are obliged to cultivate our sensible nature are unclear. The goal of this paper is to address each of these three concerns and thus fully explain Kant’s theory of the moral necessity of cultivation. (shrink)

Pleasure, the defining object of kāmaśāstric scholarship, is harmonious sensory experience, the product of a “good fit” between the self and the world. It comes about when one moves in a world of fitting sense objects, and one has made oneself fit to enter that world. The bulk of kāmaśāstric literature is devoted to developing, enhancing, and enacting specific bodily and sensory capabilities in order to maximize one’s ability to affect and be affected by the world. This article examines the (...) model of subjectivity implied by kāmaśāstra, tracking two sorts of changes to the self assumed by this body of texts. First, it presents and analyzes the ways in which the social actors described in this literature come into being in and through the cultivation and performance of particular bodily and social acts; the “artifactual” nature of the self is presumed. Second, it considers the changing set of acts that are described and prescribed over the course of kāmaśāstric history, noting the increasing place of physiognomy and of magico-medical alterations of the body, and the elision of the social sphere of sensual activity. Finally, this article situates the kāmaśāstric model of subjectivity in relation to the larger śāstric project, drawing out the model of empiricism that it presupposes, and speculating upon the epistemological/ontological implications of kāmaśāstra as a science. This paper sketches a causal account of scientific explanation designed to sustain the judgment that high-level, detail-sparse explanations—particularly those offered in biology—can be at least as explanatorily valuable as lower-level counterparts. The motivating idea is that complete explanations maximize causal economy: they cite those aspects of an event’s causal run-up that offer the biggest-bang-for-your-buck, by costing less (in virtue of being abstract) and delivering more (in virtue making the event stable or robust).

Ageism within the context of care has attracted increasing attention in recent years. Similarly, autonomy has developed into a prominent concept within health care law and ethics. This paper explores the way that ageism, understood as a set of negative attitudes about old age or older people, may impact on an older person’s ability to make maximally autonomous decisions within health care. In particular, by appealing to feminist constructions of autonomy as relational, I will argue that the key to establishing (...) this link is the concept of self-relations such as self-trust, self-worth and self-esteem. This paper aims to demonstrate how these may be impacted by the internalisation of negative attitudes associated with old age and care. In light of this, any legal or policy response must be sensitive to and flexible enough to deal with the way in which ageism impacts autonomy. (shrink)

We use a controlled laboratory experiment to study firm’s protection against potential technological damages. The probability of a catastrophic event is known, and the firm’s costly investment in safety reduces it. The firm can also buy an insurance with full or partial refund against the consequences of the catastrophic event, which ultimately reduces the variance of the firm’s investment-in-safety lottery. The firm makes these two choices simultaneously, after observing the insurance contract proposed by an insurer who chooses this contract within (...) a set of premium–deductible combinations. We parametrize the insurer–firm game such that a risk-neutral insurer maximizes his expected profit by offering an actuarially fair contract with full insurance; a risk-neutral firm is indifferent between investing in safety and accepting a fair insurance contract. We aim at understanding whether investment in safety and insurance are substitutes or complements in the firm’s risk management of catastrophic events. In line with our predictions, the experimental results suggest that they are substitutes rather than complements: the firm’s investment in safety measures is affected by the insurer’s proposed contract, the latter usually involving only partial insurance. Bodily mimicry often makes the mimickee have more positive feelings about the mimicker. Yet, little is known about the causes of mimicry’s social consequences. When people mimic each other’s bodily movements face to face, they can either adopt a mirrorwise perspective (moving in the same absolute direction) or an anatomical perspective (moving in the same direction relative to their own bodies). Mirrorwise mimicry maximizes visuo-spatial similarity between the mimicker and mimickee, whereas anatomical mimicry maximizes the similarity in the states of (...) their motor systems. To compare the social consequences of visuo-spatial and motoric similarity, we asked participants to converse with an embodied virtual agent (VIRTUO), who mimicked their head movements either mirrorwise, anatomically, or not at all. Compared to participants who were not mimicked, those who were mimicked mirrorwise tended to rate VIRTUO more positively, but those who were mimicked anatomically rated him more negatively. During face-to-face conversation, mirrorwise and anatomical mimicry have opposite social consequences. Results suggest that visuo-spatial similarity between mimicker and mimickee, not similarity in motor system activity, gives rise to the positive social effects of bodily mimicry. (shrink)

Most research on the corporate philanthropy of organizations has focused on the external benefits of such initiatives for firms, such as benefits for firm reputation and opportunities. However, many firms justify their giving, in part, due to the positive impact it has on their employees. Little is known about the effectiveness of such efforts, or how they can be managed strategically to maximize impact. We hypothesize a main effect of office-level corporate philanthropy on average employee attitudes in that office, but (...) also investigate three strategies that offices may use to enhance this impact. Testing our hypotheses with 3 years of data on attitudes of an average of 14,577 employees in 53 offices we find support for the main effect, but mixed support for the specific strategies used to enhance impact. This paper highlights the need to apply an equity lens when assessing the impact of preemption and related legal doctrines on community health. Community autonomy to set and pursue public health priorities is an essential part of achieving health equity. Unfortunately, the priorities of organized industry interest groups often conflict with health equity goals. These groups have a history of successfully using law to limit community autonomy to pursue public health measures, most notably through preemption and related legal doctrines. We (...) examine this phenomenon using two examples. First, we look at dental association efforts to block the spread of dental therapists in Indian Country. Native dental therapists have been improving the oral health of native people in Alaska for over a decade; yet the national and state dental associations have sought with mixed success to leverage state and federal laws to hinder other tribal governments from utilizing these providers. We compare these efforts with a restaurant association-led movement to limit what municipal governments can do to address food-based health inequities, focusing on a “model” ALEC bill that started in Ohio. Finally, we discuss how municipalities and Tribes are fighting back and continuing to pursue health equity for their communities. (shrink)

A classic problem in cognitive science concerns how listeners perceive and understand speech as comprised of discrete words. We propose a Syllable Inference account of spoken word recognition and segmentation, under which alternative hierarchical models of syllables, words, and phonemes are dynamically posited from cues that include current and past speech rate, with a goal of maximal prediction of sensory input. Three experiments using the Visual World eye‐tracking paradigm provide evidence supporting our proposal.

In this systematic review, we collected and analyzed literature works comparing self-reported fatigue and objectively-measured fatigue in individuals with cerebral palsy and in age-matched typically developing/typically developed controls. The search was conducted on four electronic databases/platforms using the key words “cerebral palsy” combined with “fatig*,” where the asterisk was used as a wildcard. As a critical appraisal tool, the Joanna Briggs Institute Critical Appraisal Checklist for Quasi-Experimental Studies was used. A total of 22 studies passed the critical appraisal rating and (...) were included in both narrative and quantitative analyses. The overall evidence quality of the findings was considered very good. Data of objectively-measured fatigue in performing maximal fatiguing tasks indicated lower fatigue levels in participants with CP, possibly due to their pathological inability to recruit highly fatigable muscle fibers. Highly trained individuals with CP and TD controls performing maximal fatiguing tasks seem to be an exception to this, as they exhibited similar levels of fatigue. In submaximal fatiguing tasks, including daily physical activities, either objectively-measured or self-reported fatigue was higher in participants with CP than in TD controls, indicating a lower ability for development of neurophysiological compensation for fatigue among participants with CP. Further studies on fatigue are needed to gain an insight into the multifold mechanisms of fatigue in individuals with CP. Understanding fatigue mechanisms could help in setting up strategies for effective intervention programs, with benefits in healthcare and improved quality of life of individuals with CP.Systematic Review Registration: [PROSPERO 2019], identifier [CRD42019143524]. Scientists typically use a variety of representations, including different kinds of figures, to present and defend hypotheses. In order to understand the justification of scientific hypotheses, it is essential to understand how visual representations contribute to scientific arguments. Since the logical understanding of arguments involves the truth or falsity of the representations involved, visual representations must have the capacity to bear truth in order to be genuine components of arguments. By drawing on Goodman's analysis of symbol systems, and on Tarski's (...) work on truth, I show that the figures used in science meet this criterion. (shrink)

According to Weyl, “‘inexhaustibility’ is essential to the infinite”. However, he distinguishes two kinds of inexhaustible, or merely potential, domains: those that are “extensionally determinate” and those that are not. This article clarifies Weyl's distinction and explains its enduring logical and philosophical significance. The distinction sheds lights on the contemporary debate about potentialism, which in turn affords a deeper understanding of Weyl.

Philosophers of perception have a notoriously difficult time trying to account for hallucinatory experiences. One surprisingly quite popular move, and one that cross-cuts the representationalism/relationalism divide, is to say that hallucinations involve an awareness of uninstantiated properties. In this paper, I provide a new argument against this view. Not only are its proponents forced to classify many hallucinations as veridical, such experiences turn out to be necessarily veridical. In addition, I show that representationalists who endorse the uninstantiated property view must (...) reject the common fundamental kind claim and adopt disjunctivism, and naïve realists/relationalists must radically modify their disjunctivism: The distinction between ‘veridical’ and ‘hallucinatory’ will no longer track a metaphysical distinction between the relevant experiences. Religion within the Boundaries of Mere Reason remains one of the most opaque of Kant's published writings. Though this opacity belongs, partly, to the text itself, a key claim of this article is that this opacity stems also from the narrow lenses through which his readers view this text. Often read as part of Kant's moral philosophy or his universal history, the literature has thus far neglected a different vantage point on the Religion, one that does not refute the utility (...) of these lenses but complements them. This paper places the Religion alongside parts of Kant's corpus that it is less typically paired with, namely his natural history writings—in particular, his writings on the concept of race and the development of the human races. I argue that by doing so, we can shed much light on Kant's infamous claim that there is a radical evil in the human species. More precisely, we will come to appreciate that this evil is not, as it is usually understood, a static property or fixed characteristic of human beings. Instead, radical evil concerns a dynamic, changing defect in human nature that increasingly threatens our aspirations to collective moral perfection. (shrink)

The Fold is a book of practical philosophy that takes a radical new approach to aesthetics. Laura U. Marks calls this philosophy "enfolding-unfolding aesthetics," based in ideas derived from Gilles Deleuze and others (G.F.W. Leibniz, David Bohm, and Édouard Glissant) that the universe is folded in on itself. She proposes a theory of mediation as contact and connection across the folds and a set of embodied methods for detecting such cosmic connections. Recent debates in metaphysics have highlighted the significance of type theories, such as Simple Type Theory (STT), for our philosophical analysis. In this chapter, I present the salient features of a constructive type theory in the style of Martin-Löf, termed CTT. My principal aim is to convey the flavour of this rich, flexible and sophisticated theory and compare it with STT. I especially focus on the forms of quantification which are available in CTT. A further aim is to argue that (...) a comparison between a plurality of theories is beneficial to the philosophical analysis. We may, for example, discover helpful features of one theory that we may want to import into another context, thus enriching our repertoire of formal tools. Or, through comparison with a less well-known theory, we may gain a better understanding of the characteristics of the theories we are familiar with. Human activity is permeated by norms of all sorts: moral norms provide the 'code' for what we ought to do, norms of logic regulate how we ought to reason, scientific norms set the standards for what counts as knowledge, legal norms determine what is lawfully permitted and what isn't, aesthetic norms establish canons of beauty and shape artistic trends and practices, and socio-cultural norms provide criteria for what counts as tolerable, just, praiseworthy, or unacceptable in a community or milieu. Given (...) the diversity of norm-governed phenomena prevailing in our everyday experience, it is not surprising that the question of normativity has recently generated important debates in philosophy. However, the more specific question concerning the nature and function of 'norms in perceptual experience' has received comparatively little attention. Predicativity is a notable example of fruitful interaction between philosophy and mathematical logic. It originated at the beginning of the 20th century from methodological and philosophical reflections on a changing concept of set. A clarification of this notion has prompted the development of fundamental new technical instruments, from Russell's type theory to an important chapter in proof theory, which saw the decisive involvement of Kreisel, Feferman and Schütte. The technical outcomes of predica-tivity have since taken a life of their own, (...) but have also produced a deeper understanding of the notion of predicativity, therefore witnessing the " light logic throws on problems in the foundations of mathematics. " (Feferman 1998, p. vii) Predicativity has been at the center of a considerable part of Feferman's work: over the years he has explored alternative ways of explicating and analyzing this notion and has shown that predicative mathematics extends much further than expected within ordinary mathematics. The aim of this note is to outline the principal features of predicativity, from its original motivations at the start of the past century to its logical analysis in the 1950-60's. The hope is to convey why predicativity is a fascinating subject, which has attracted Feferman's attention over the years. (shrink)

This systematic review identifies and critically evaluates instruments that have been developed to measure clinical trial informed consent comprehension in non-cognitively-impaired adults.Literature searches were carried out on Medline (Ovid), PsycInfo, CINHAL, ERIC, ScienceDirect, and Cochrane Library for English language articles published between January 1980 and September 2008. Instruments were excluded if they focused on consent onto paediatric trials, the construct under study was primarily capacity or competency, or the instrument was developed specifically for psychiatric or cognitively-impaired populations. Instruments selected for (...) review were evaluated against the following criteria: (1) method of item generation; (2) type and format of test items; (3) administration and interpretation of test results; and (4) psychometric properties.Three instruments met our defined inclusion criteria: the Deaconess Informed Consent Comprehension Test (DICCT), the Quality of Informed Consent (QuIC) questionnaire and the Brief Informed Consent Protocol (BICEP). Each instrument varied in terms of content measured. Significantly, these are the first standardized instruments developed to assess comprehension in non-cognitively-impaired adults. Yet, each instrument had its own set of limitations such as the lack of generalizability and the absence of details pertaining to how test results should be used to guide clinical decision-making.Standardized clinical trial informed consent comprehension assessments have been developed to identify gaps in research participants' understanding and ensure that respect for patient autonomy is satisfied. While various definitions of moral distress have been proposed, some agreement exists that it results from illegitimate constraints in clinical practice affecting healthcare professionals’ moral agency. If we are to reduce moral distress, instruments measuring it should provide relevant information about such illegitimate constraints. Unfortunately, existing instruments fail to do so. We discuss here several shortcomings of major instruments in use: their inability to determine whether reports of moral distress involve an accurate assessment of the requisite clinical and logistical facts (...) in play, whether the distress in question is aptly characterized as moral, and whether the moral distress reported is an appropriate target of elimination. Such failures seriously limit the ability of empirical work on moral distress to foster appropriate change. (shrink)

This paper offers a novel solution to the Wrong Kind of Reason problem that afflicts Fitting-Attitude analyses of value. I argue that we can distinguish reasons of the right kind from reasons of the wrong kind by being clear about what our reasons are for. In Wrong Kind of Reason cases, our reason to have a certain affective attitude is a reason for an action, and it is this category-mistake that is the source of the problem.
