The singular position of Montesquieu's political philosophy seems to raise the question: Isn't the opposition between republicanism and liberalism a largely artificial one? On the one hand, the description of the republican vivere civile in the Spirit of the Laws testifies to the important ties that exist between Montesquieu and the tradition of ?civic humanism?. However, this apparent theoretical proximity between Montesquieu and the British Neo-Harringtonians ought not to be taken too far, obscuring the deep divergences that differentiate their respective (...) positions, notably when it comes to the interpretation of history. Montesquieu's break from the republican tradition is exemplified by his rejection of its conception of freedom rooted in the citizens' necessary participation in power. But in the end, this does not enable us to conclude that he subscribes to a purely liberal theory. The British model shows that even if direct participation in the exercise of power is not necessary for the existence of liberty, a certain level of civic involvement and public awareness is needed. The liberal opposition between positive and negative liberty, political autonomy and enjoyment of rights without interference must therefore be transcended. (shrink)

A leitura liberal de Montesquieu não evoca apenas sua concepção de checks and balances, ela insiste na distância tomada por Montesquieu em relação à concepção republicana da liberdade. Montesquieu exprimiria sua escolha em favor da “república moderna”, representativa e comerciante à inglesa, em detrimento da “república participativa” dos antigos e da monarquia absolutista à francesa. O Espírito das leis faria do modelo inglês o regime mais conforme à natureza humana, aquele que garantiria melhor a segurança dos indivíduos. Caso se admita (...) essa visão das coisas, a liberdade positiva cede lugar aqui a uma liberdade negativa, definida como independência no interior de uma esfera protegida pelo direito, garantida pela separação dos poderes no seio do sistema representativo. O presente artigo, a fim de avaliar a pertinência dessa interpretação, examinará (I) as definições da liberdade política que Montesquieu distingue da liberdade dita “filosófica”; em segundo lugar, considerará a “solução” que propõe O Espírito das leis face ao risco que o despotismo causa a todos os governos. Cette contribution entend discuter ce jugement : la science nouvelle de L’Esprit des lois repose sur une anthropologie de la force, et de l’unité de la sensibilité.

Summary In this contribution, I reassess the opposition between Saint-Pierre's idealism and Rousseau's realism. Rousseau accuses Saint-Pierre of having a defect in his analysis and political judgement which, if he had been consistent, would have led to a revolutionary position in the strong sense ? a position of which the author of The Social Contract himself disapproved. In short, not only was Saint-Pierre far from being a convinced absolutist; Rousseau's own writings on the Abbé do not advocate a ?republican solution?, (...) which he regarded as impracticable for the Europe of his time. Cette contribution se propose d’étudier la manière dont Durkheim s’est réapproprié la philosophie de Rousseau. Le fondateur, après Auguste Comte, de la sociologie en France adopte une attitude ambivalente à l’égard de l’auteur du second Discours et du Contrat social : d’un côté, l’hommage rendu à celui qui a pensé la genèse empirique des rapports sociaux ; de l’autre, la critique de l’artificialisme du penseur du contrat. C’est entre ces deux limites qu’il faudra situer la réappropriation durkheimienne de Rousseau, qui (...) est une reconstruction et une réactualisation : la question de la genèse du sujet collectif est au cœur de leur dialogue posthume. Cette contribution reviendra donc sur l’interprétation durkheimienne du second Discours, ainsi que sur sa lecture du manuscrit de Genève. Il s’agira de montrer par quelle subtile distorsion du texte Durkheim parvient à imposer son exégèse de Rousseau et à en faire l’ancêtre de l’idée de « règne social », et de cerner comment la lecture durkheimienne du Contrat social procède à une réinterprétation originale de la théorie de la « volonté générale » dans des termes sociologiques. Parmi les nombreuses controverses qui affectent l’étude de la pensée économique naissante, la moindre n’est sans doute pas celle qui porte sur l’opportunité même du concept de « mercantilisme ». Les auteurs regroupés sous ce terme par les inventeurs de cette dénomination ne l’ont-ils pas été par leurs adversaires (Quesnay, Smith, E. F. Heckscher) ou par leurs défenseurs (G. Schmoller, W. Cunningham) qui, de surcroît, ne leur sont pas contemporains? Cette contribution se propose par conséquent de restituer la genèse du (...) concept polémique de « mercantilisme » et de présenter une synthèse des critiques qui lui ont été opposées (D. C. Coleman, J. Viner...). La question délicate de l’articulation entre théorie et pratique incitera à prendre la mesure des enjeux philosophiques soulevés par l’élaboration conceptuelle : ce sont alors les liens théoriques complexes entre machiavélisme et mercantilisme qui seront mis en lumière, afin de comprendre par quelles médiations la théorie politique de la raison d’État a pu trouver un champ d’application privilégié chez les auteurs et les acteurs dits mercantilistes. Cette contribution tentera de cerner les enjeux de l’interprétation contrastée de la philosophie des Lumières proposée par Charles Taylor. Pourquoi le déisme et le matérialisme sont-ils perçus par Taylor comme des fourvoiements de la modernité? Pourquoi considère-t-il que les Lumières ont méconnu la manière dont la subjectivité pouvait fonder ses aspirations morales et politiques? Nous verrons que la philosophie des Lumières « radicales », selon Taylor, produit une morale et une politique incohérentes : elle postule que l’harmonie sociale procède de (...) l’intérêt bien compris grâce à une ingénierie législative et éducative ; mais elle n’explique pas pourquoi l’idéal d’une société harmonieuse mérite d’être poursuivi. L’auteur des Sources du moi entérine de la sorte l’idée répandue d’une incohérence des philosophes matérialistes : leur psychologie hédoniste et égoïste est incompatible avec leur éthique, qui vise le plus grand bonheur du plus grand nombre. Les Lumières sont donc rendues responsables d’une vision contradictoire de la morale et d’une vision appauvrie de la subjectivité. (shrink)

Les séminaires dispensés par Leo Strauss au Département de Sciences Politiques de l’Université de Chicago en 1965-1966 sont demeurés inédits à ce jour. Consacrés à L’Esprit des lois et aux Lettres persanes, ces cours offrent une interprétation forte et subtile de l’œuvre, qui a connu un retentissement majeur en raison des travaux de certains disciples (David Lowenthal, Thomas Pangle, Pierre Manent, Paul Rahe). L’exégèse straussienne mérite donc d’être mieux connue : elle ouvre la voie d’une analyse de la politique « (...) libérale » de Montesquieu et de ses illusions. (shrink)

Or en l'absence de devouement civique, les etats peuvent-ils fonder le lien social et garantir la liberte politique? La vertu patriotique, passion dominante des cites antiques, peut-elle devenir caduque sans (...) prejudice pour l'homme moderne? En revenant sur l'inscription de Montesquieu dans la tradition du liberalisme politique, cette etude explore les voies plurielles tracees par Montesquieu face au - mal politique - incarne dans le despotisme. Dans un article de 1984 intitulé « Le libéralisme et l’art de la séparation », Michael Walzer critique le fantasme libéral d’autodétermination. Afin d’illustrer sa thèse, il convoque la dernière tragédie de Shakespeare, Coriolan : « The liberal hero, author of himself and of social roles, is a mythic invention. It is Shakespeare’s Coriolanus, that aristocratic warrior and anti-citizen, who claims (and fails) to live “as if he were the author of himself and knew no other kin” ». Cet article (...) entend discuter cette interprétation. Au-delà d’une tragédie sur le rêve d’autonomie brisé, Coriolan donne à voir un personnage aux prises avec l’aliénation liée à l’éthique aristocratique. Relire Shakespeare dans le sillage de certaines exégèses marxistes et féministes invite donc à interroger la pertinence du « communautarisme libéral ». (shrink)

Cette contribution entend appliquer aux institutions européennes la méthode généalogique élaborée par Rousseau dans le Discours sur l’origine et les fondements de l’inégalité parmi les hommes. Elle entend retracer dans ses grandes lignes l’histoire d’un détournement des institutions qui peut s’interpréter en termes de corruption ou d’usurpation. La nécessité de concevoir la génération des institutions, leur « esprit », prend sens dans cette perspective – non pour évoquer une théorie du complot en vertu de laquelle certains politiques alliés aux économistes (...) néolibéraux auraient « mis la main » sur une institution noble pour la tourner exclusivement à leur profit, mais pour montrer la variété des forces d’emblée à l’œuvre dans l’histoire, et les contingences ou les effets de structure qui ont dévié les intentions fondatrices. Car il ne faut pas simplifier la causalité historique : les institutions n’ont pas d’emblée été conçues dans un esprit néolibéral, qui n’aurait fait que s’accentuer dans les années 1980-1990 avec la dérégulation économique imposée à l’échelle mondiale. Il convient donc de distinguer, dans le projet européen et l’évolution des institutions, ce qui relève des intentions initiales et ce qui ressort des événements qui les ont altérées en profondeur dans les grandes scansions de la construction européenne. Dans les cours au Collège de France réunis dans Naissance de la biopolitique, Foucault soutient qu’une science économico-juridique est rigoureusement impossible. Or cette thèse radicale mérite discussion, à partir d’un auteur trop souvent ignoré des historiens de la genèse de l’économie politique. Montesquieu, à sa façon, contribue à la constitution de ce savoir économico-juridique, susceptible de penser ensemble sujet d’intérêt et sujet de droit. L’esprit de cette étude ne sera pas de critiquer Foucault en montrant que Montesquieu ne « rentre (...) » pas dans l’opposition de ses paradigmes, mais plutôt de tenter de mesurer l’originalité d’une pensée qui conçoit des échanges entre propriété et liberté qui ont pour effet d’unifier rationalité économique et rationalité juridique. This essay aims to show that implicit biases should not be conceived of as “inside the head” of individuals, but rather as embodied and social. My argument unfolds in three stages. First, I make the case for conceiving of implicit biases as perceptual habits. Second, I argue that we should think of perceptual habits and, by extension, implicit biases, as located in the body. Third, I claim that individual habits are shaped by the social world in which we find ourselves (...) and that the social world is itself shaped by our habitual ways of interacting with and perceiving others. This suggests that implicit biases are part of the fabric of the social world. Thus, I conclude that implicit biases should be understood as embodied and social. (shrink)

Malgré son ambition, la philosophie politique n'est jamais parvenue à prouver qu'il est rationnel (bon, avantageux pour l'individu autant que pour la collectivité) d'être juste. Ce livre entend évoquer les " personnages conceptuels " ou les " figures " théâtrales mises en scène par les philosophes eux-mêmes afin de mettre à l'épreuve leur théorie de la justice : de tels personnages viennent contredire le discours rationnel du philosophe, et souvent l'accuser d'idéalisme. Cette thèse philosophique s'accompagne d'une thèse sur le présent (...) : la théorie politique contemporaine dominante tend depuis les années 1970 à réduire la figure du " mal " politique, en l'assimilant, sous couvert de théorie du choix rationnel, au " passager clandestin ", qui ne contribue pas à la coopération sociale à la mesure de ce qu'il profite. Or un tel choix est pour le moins contestable, dans la mesure où il laisse dans l'ombre des figures plus " extrêmes " du mal politique : le nazi, le criminel de guerre, le terroriste. A cet égard, la philosophie politique moderne, quoique décidément rationaliste, a mieux cerné le risque que fait courir à la philosophie elle-même l'" Insensé " ou le " raisonneur violent ". Face au risque d'irénisme encouru par la théorie politique, sociale et morale contemporaine, dont le monde semble parfois peuplé de " zombies raisonnables ", il nous faut restituer le rôle de l'expérience tragique au coeur de la philosophie politique. This study investigates how diverse European legal systems and financial structures influence corporate social and environmental responsibility. The argument is developed by means of a framework that integrates legal systems and financial structures. Hypotheses relating to environmental responsibility have been tested using Innovest data gathered between 2002 and 2007 from 645 companies in 16 countries; and hypotheses relating to social responsibility have been tested using Innovest data gathered between 2004 and 2007 from 600 companies. The findings demonstrate that legal systems (...) influence corporate responsibility (CR) in both social and environmental spheres. They also support the claim that corporations are more likely to act in environmentally responsible ways when there are strong and well-enforced state regulations in place to ensure such behavior. Company size is shown to have a greater impact on CR than either excess cash or performance. Large companies tend to be more visible than small ones do, and society expects them to behave in a more socially and environmentally responsible manner regardless of their financial performance or available cash. Finally, these findings support the hypothesis that capital structure significantly influences CR: companies with a high number of publicly held shares and a low percentage of debt are more likely than others to commit themselves to social and environmental activities. The ability to reflect on and monitor memory processes is one of the most investigated metamemory functions, and one of the important ways consciousnesses interacts with memory. The feeling-of-knowing is one task used to evaluate individual’s capacity to monitor their memory. We examined this reflective function of metacognition in older adults. We explored the contribution of metacognition to episodic memory impairment, in relation to the idea that older adults show a reduction in memory awareness characteristic of episodic memory. A first (...) experiment showed that age affects the accuracy of FOK when predictions are made on an episodic memory task but not on a semantic memory task, suggesting a particular role for episodic memory awareness in metacognitive evaluations. A second experiment showed that the age-difference in episodic FOK accuracy was removed if one took into account subjective reports of memory awareness, or recollection. We argue that the FOK deficit specific to episodic memory is based on a lack of memory awareness manifest as a recollection deficit. (shrink)

Since it is Hume who famously asked how an "ought" can ever possibly be deduced from an "is," it is Hume who is typically cast as the representative of empiricism's inadequacy for doing the work of ethics. Yet, as I will show, in his description of the proper functioning of the passions that necessarily involve other persons and their evaluations of us, Hume provides a naturalistic description that is not reductive of value, but rather incorporates values into the very ground (...) of empirical description. Contemporary moral philosophers who dismiss Hume's complex account of the passions as unnecessary for understanding his account of morals, and then fault the account of morals for its failure to move beyond mere description to any kind of normative assessment, ignore how the detail of Hume's own account of the passions suggests a way that an empirical account can in fact be value-laden, as we shall see. The article distinguishes metaphysical from practical communitarianism. Metaphysical communitarianism is alleged to involve a concealed ideological element, which leads its adherents to stereotypes when trying to capture the essence of the modem self. The claim is examined that minorities, or other ethnic and cultural groups have collective rights, either moral or legal in nature. Justifications of collective rights resorting to the value of cultural identity are said to be in need of explaining why the case protecting such value is through (...) rights. It is argued that practical communitarianism's case for collective rights needs embracing meta-normative and normative relativism, whose application to political action yields consequences at odds with widespread ethical intuitions. This study investigates how one important accounting professional authority—CPA Canada—discusses accounting ethics and exhorts its members to think about ethics-related issues. To do this, we rely on empirical evidence of the types of arguments used by CPA Canada to describe what they consider acceptable moral justifications in a variety of practical situations that accountants may encounter. We argue that the articles contained in the profession’s primary publication for all members, CPA Magazine, offer a wealth of such evidence. We analyze 237 (...) articles about accounting ethics that were published in CPA Magazine from January 2000 to December 2017, and find evidence of moral pluralism. Six categories of justifications dominate: private commitments, utility, perfectionist ends, general duties, and specific obligations, plus self-interest. Of these categories, the specific obligations logic is the most widely used. We offer a tentative explanation, and discuss the implications of our findings for a better grasp of the complexities of accountants’ practical conflicts and a rethink of the ongoing tension between professionalism and commercialism. In this article, I draw an important distinction between two kinds of inquiry. “Framed inquiries” take for granted and use a conceptual framework in order to ask and answer questions, while “framing inquiries” require the creation, revision, or expansion of the conceptual framework itself in order to address the problem at hand. This distinction has been largely ignored in epistemology, and collapsed by two radically opposed philosophical camps: representationalism and antirepresentationalism. While the former takes all inquiries to be in the (...) business of discovering mind-independent facts, the latter takes all inquiries to be primarily governed by pragmatic considerations. Against the objections raised by both camps, I defend a pragmatist and substantive distinction between framed and framing inquiry, inspired by Rudolf Carnap’s distinction between internal and external questions and reformulated in terms of John Dewey’s theory of inquiry. We adapted the Bubbles procedure [Vis. Res. 41 (2001) 2261] to examine the effective use of information during the first 282 ms of face identification. Ten participants each viewed a total of 5100 faces sub-sampled in space–time. We obtained a clear pattern of effective use of information: the eye on the left side of the image became diagnostic between 47 and 94 ms after the onset of the stimulus; after 94 ms, both eyes were used effectively. This preference for the (...) eyes increased with practice, and was not solely due to the informativeness of the eyes for the task at hand. The bias for the eye on the left side of the image is explained in terms of hemispheric specialization. Although there were individual differences, most participants exhibited this pattern of effective use of information. An intriguing finding is that most participants displayed a clear sinusoidal modulation of effective use of attention through time with a frequency of about 10.6 Hz. (shrink)

Conceptual engineering takes a distinctively normative and reconstructive approach to our conceptual repertoire. This approach is congenial to the ideas defended by philosophers belonging to the multifaceted tradition of American and Cambridge Pragmatism. This special issue is devoted to the investigation and development of these connections. Our introduction maps some of the historical and theoretical entanglements between the two fields and gives a short overview of the contributions to the special issue.

According to the standard analysis of degree questions, the logical form of a degree question contains a variable that ranges over individual degrees and is bound by the degree question operator how. In contrast with this, we claim that the variable bound by the degree question operator how does not range over individual degrees but over intervals of degrees, by analogy with Schwarzschild and Wilkinson's proposal regarding the semantics of comparative clauses. Not only does the interval-based semantics predict the existence (...) of certain readings that are not predicted under the standard view, it is also able, together with other natural assumptions, to account for the sensitivity of degree questions to negative islands, as well as for the fact, uncovered by Fox and Hackl, that negative islands can be obviated by some properly placed modals. Like Fox and Hackl, we characterize negative island effects as arising from the fact that the relevant question, due to its meaning alone, can never have a maximally informative answer. Contrary to Fox and Hackl, however, we do not need to assume that scales are universally dense, nor that the notion of maximal informativity responsible for negative islands is blind to contextual parameters. Building on previous works which argued that scalar implicatures can be computed in embedded positions, this paper proposes a constraint on exhaustification which restricts the conditions under which an exhaustivity operator can be licensed. We show that this economy condition allows us to derive a number of generalizations, such as, in particular, the ‘Implicature Focus Generalization’: scalar implicatures can be embedded under a downward-entailing operator only if the scalar term bears pitch accent. Our economy condition also derives specific predictions regarding (...) the licensing of so-called Hurford disjunctions. (shrink)

This chapter examines Dewey’s view of moral knowledge developed in Chapter 14 of the Ethics. I focus more specifically on the role played by sympathy in moral inquiry. While Dewey claims that sympathy is “the general principle of moral knowledge” as well as “the surest way to attain objectivity of moral knowledge,” it has not been the object of any extensive discussion by commentators on Dewey’s ethics. I emphasize the originality of Dewey’s position by contrasting it with that of David (...) Hume, Adam Smith, and John Stuart Mill, who all stressed the fundamental role of sympathy in making moral judgments. Accordingly, I examine their respective answers to the moral problem raised by natural sympathy: how can such a biased and partial psychological mechanism play a beneficial role in the formation of moral judgments, which specifically aim at impartiality and objectivity? I will argue that while Hume, Smith, and Mill choose to simply extend the scope of natural sympathy, Dewey argues in favor of a deeper transformation of natural sympathy: (1) the spontaneous emotional reaction becomes intentional perspective-taking; (2) it loses its function of direct approval or disapproval, and takes on an epistemic function of data-gathering subordinated to moral reasoning.
